The All India Muslim Women Personal Law Board has publicly supported the Waqf (Amendment) Bill, 2025, which Parliament passed earlier this week. The board has urged the central government to bring more transparency in the functioning of Waqf boards and ensure that Muslim women receive their rightful share in Waqf-related benefits.

Shaista Amber Commends the Government’s Step

Shaista Amber, who leads the women’s board, praised the present government for introducing the bill. She pointed out that previous governments and religious leaders should have taken such steps earlier.
She said, “Positive work should be done. Those who donate to the Waqf, their intention is that their donation will be used for the poor… But it was not happening.” She stressed that while not all Waqf land was misused, the board had failed to act with honesty and responsibility in many cases.

Appeal for Transparent Use of Waqf Land

Shaista demanded that Waqf land should benefit the poor as originally intended. She stated, “We expect and request from the government that if the bill has come, the Waqf lands be used for the poor section with full transparency.”
She accused past governments of neglecting the Muslim community. “None of the governments to date worked for the Muslims; they just did the politics for votes,” she said.

Calls to Free Encroached Properties

Shaista also asked the government to take firm steps to remove illegal encroachments from Waqf land. She urged the BJP-led government to uphold women’s rights and ensure that the board functions openly and honestly.
She questioned why no political party took action until now. “What other parties did till now, were they asleep?” she asked strongly. She called for an investigation into land encroachments and punishment for those responsible.

Suggestion to Help Divorced Muslim Women

Highlighting women’s issues, she suggested using Waqf land to build houses for divorced Muslim women. She said this would be a meaningful way to use the property for social welfare and empower women in need.

Speaker Om Birla condemned the comments while PM Modi hailed the bill’s passage as historic.
</excerpt>

The Budget Session of Parliament came to a close on Friday as both Houses were adjourned sine die following intense protests over critical remarks by Congress leader Sonia Gandhi about the Waqf (Amendment) Bill, 2025. The remarks sparked uproar from the treasury benches, with BJP MPs demanding an apology from Gandhi for saying the bill was “bulldozed” through Parliament.

Lok Sabha Speaker Om Birla spoke to Lok Sabha after its resumption at noon, labeling the comments as “most unfortunate” and “against the dignity of parliamentary democracy.” Birla did not mention Sonia Gandhi by name but reacted after Parliamentary Affairs Minister Kiren Rijiju asked his ruling on the issue.

Speaker Om Birla Condemns Remarks, Cites Protracted Debate on Waqf Bill

Referring to the House, Om Birla pointed out that the Waqf (Amendment) Bill had seen detailed deliberation. “There was division thrice on the bill and it was passes as per the rules of the House. That is why it is highly unfortunate that despite the House sitting till late night and passing the bill after a long debate, a senior member is casting aspersions on the House proceedings which is not appropriate,” he stated.

He again asserted that Parliament had discussed the bill for 13 hours and 53 minutes, with cuts across several parties, denying reports of procedural rushes.

Sonia Gandhi’s Statement Provokes Demonstrations

Controversy had started after Sonia Gandhi, addressing the Congress Parliamentary Party in Samvidhan Sadan on Thursday, condemned the way the bill was passed. “Yesterday, the Wakf Amendment Bill, 2024 was passed in the Lok Sabha and today it is scheduled to come up in the Rajya Sabha. The bill was in effect bulldozed through. Our party’s position is clear. The Bill is a brazen assault on the Constitution itself. It is very much part of the BJP’s deliberate strategy to keep our society in a state of permanent polarisation,” she said.

After her remarks, BJP MPs chanted slogans of “Sonia Gandhi Maafi Maango” in Parliament, calling for a public apology.

Despite the commotion, both Houses approved the Waqf (Amendment) Bill, 2025. The Rajya Sabha cleared it early on Friday morning with 128 votes and 95 against, after rejecting all opposition-suggested amendments. The Lok Sabha had approved the bill on Thursday with 288 MPs voting for it and 232 against.

PM Modi: “A Historic Step Towards Inclusive Growth”

Prime Minister Narendra Modi thanked the bill passing and characterized it as a groundbreaking step. “The Waqf (Amendment) Bill and Mussalman Wakf (Repeal) Bill passage in both Houses of Parliament is a landmark moment in our common quest for socio-economic justice, transparency, and inclusive growth,” he added.

“These legislations will specifically benefit those who have long lingered on the periphery, thereby being deprived of both voice and opportunity,” PM Modi further added.

He thanked all parliamentarians and members of committees who took part in the debate. “Appreciation to all Members of Parliament who have taken part in the Parliamentary and Committee debates, shared their opinions and helped build these legislations. A particular thanks also goes to the many people who have submitted their valuable suggestions to the Parliamentary committee. Again, the significance of widespread debate and discussion has been proved,” he added.

PM Emphasises Transparency and Welfare for Marginalised

The Prime Minister also emphasized the shortcomings of the current Waqf system. “For years, the Waqf system was equated with a lack of transparency and accountability. It particularly victimised Muslim women, needy Muslims, and Pasmanda Muslims. The legislations enacted by Parliament will enhance transparency and also protect people’s rights,” he added.

He signed off with a social justice and national unity message, “We will now begin an era wherein the framework would be more modern and sensitive towards social justice. On a grander scale, we continue to be committed to upholding the dignity of each citizen. That is also how we construct a more robust, more inclusive and more empathetic India.”

</excerpt>

Nadeem Akhtar became the fifth JD(U) leader to resign over the party’s decision to support the Waqf Amendment Bill. His exit followed similar resignations by Raju Nayyar, Tabrez Siddiqui Alig, Mohammad Shahnawaz Malik, and Mohammed Kasim Ansari.

Raju Nayyar Resigned First

Earlier, Raju Nayyar stepped down soon after the bill passed in the Lok Sabha. In his letter, he said, “I resign from JD(U) after Waqf Amendment Bill is passed and supported in the Lok Sabha.”
He expressed his anger further: “I am deeply hurt by the JD(U) voting in favour of this black law, which oppresses Muslims.”
He also added, “I resign from the post of former state secretary of JD(U) youth and primary membership of the party. I request to send a letter to the Honorable CM Nitish Kumar and relieve me from all responsibilities.”

Muslim Leaders Accuse JD(U) of Betrayal

The All India Muslim Personal Law Board (AIMPLB) had earlier urged all secular parties, including BJP allies, to oppose the bill. Despite this call, JD(U) supported the bill, which led to a wave of resignations.

Tabrez Siddiqui Alig wrote to JD(U) National President and Bihar Chief Minister Nitish Kumar. In his letter, he said the party had “betrayed the trust of the Muslim community.”

Mohammad Shahnawaz Malik expressed similar disappointment. He wrote, “Millions of Indian Muslims like us had the firm belief that you are the flag bearer of purely secular ideology. But now this belief has been broken.”

Likewise, Mohammed Kasim Ansari said he felt “deeply hurt” by the party’s stance and resigned in protest.

Timing Raises Political Concerns

These resignations come at a crucial time for JD(U) as Bihar heads towards assembly elections. The backlash from the Muslim community may weaken the party’s support base.

Parliament Passed the Controversial Bill

The Waqf Amendment Bill 2025 passed in Parliament after a long and heated debate. Rajya Sabha Chairman Jagdeep Dhankhar declared, “Ayes 128 and Noes 95, Absent zero. The Bill is passed.”

Additionally, Parliament also passed the Mussalman Wakf (Repeal) Bill, 2024, adding to the controversy.

PM Modi says it empowers marginalized Muslims.
</excerpt>

Union Minister of State for Social Justice and Empowerment Ramdas Athawale expressed strong support for the Waqf (Amendment) Bill, 2025, in the Rajya Sabha on Friday. Highlighting the fact that the bill is aimed at bringing justice to the largest Muslim population while fostering communal harmony throughout the country, Ramdas Athawale termed it a “revolutionary” measure.

“This bill is intended to provide justice to all Muslims — nearly 90% of them. It is not against the Constitution. It is a revolutionary bill and aims to integrate Hindus, Muslims, Sikhs, and all communities,” Ramdas Athawale announced in the Upper House after the passage of the bill.

Poetic Defense of PM Modi’s Policies by Ramdas Athawale

Athawale continued, “Modiji Musalmanon ki baat karte hain, Congress wale to Musalmanon ki baat karte hain. Modiji gareebon ki baat karte hain, aur ve hamesha Musalmanon, alpasankhyakon ki baat karte hain.”

His poetic speech eased the long and serious legislative session. Famous for blending poetry with politics, Athawale’s witty one-liners transcended party lines and brought smiles during the otherwise somber debate.

Congress Draws Scathing Criticism for Opposing the Bill

The minister was not far behind in criticizing the Congress party for raising objections to the bill. Charging that it had been pursuing a “divide and rule” policy, Ramdas Athawale stated, “Muslims have suffered injustice for a long time. The Congress Party is adopting a policy of divide and rule and is not providing justice to Muslims and Dalits.”

Bringing humor and poetry to the solemn parliamentary discourse, Athawale quoted wry couplets that rang out with laughter and applause from other members. Targeting the opposition while seconding the bill, he resorted to his signature rhyming satire.

“Waqf bill ka hum karte hain smaran, lekin vipaksh ko hum kar denge haran. Modiji hain Musalmanon ke sacche wali, Kharge sahab bajao zor-dar taali. Mat do roz Modiji ko gaali, nahi to kursi karo khaali. Vidrohi dalon ki raat ho rahi kaali, Nadda sahab bajao aap bhi taali” he recited, mixing wordplay and political jabs.

Athawale continued with another couplet, “Itni ho gayi hai raat, main kar raha hoon Waqf bill par baat, main de raha hoon Modiji ko saath, isliye main Congress ko dikha raha hoon haath.”

PM Modi Calls Passage of Waqf Bill a Milestone for the Marginalized

Prime Minister Narendra Modi termed the passage of the Waqf (Amendment) Bill, 2025, as a “milestone moment” for delivering justice and opportunity to the marginalized.

Posting on X (formerly Twitter), PM Modi said, “The passage by both Houses of Parliament of the Waqf (Amendment) Bill and the Muslim Waqf (Repeal) Bill is a landmark in our collective journey towards socio-economic justice, transparency, and inclusive growth. It will particularly benefit those who have been long on the margins and therefore denied voice and opportunity.”

The passage of the Waqf (Amendment) Bill and the Mussalman Wakf (Repeal) Bill by both Houses of Parliament marks a watershed moment in our collective quest for socio-economic justice, transparency, and inclusive growth.
Modi laid stress on the fact that the revised law would protect individuals’ rights and address the absence of transparency and accountability in the Waqf system that had inflicted damage on Pasmanda Muslims’ and Muslim women’s interests.

Bill Aims to Modernize and Improve Waqf Administration

Earlier, the Lok Sabha cleared the Waqf (Amendment) Bill following a marathon debate that lasted beyond midnight. The government accepted suggestions made by a Joint Parliamentary Committee, which had gone through the draft legislation laid out in August last year.

The bill aims to amend the Waqf Act of 1995 to remove its deficiencies and enhance the Waqf property administration in India. Some of the major aims are to make Waqf boards more efficient, simplify the process of registration, and use technology to enhance Waqf record management.

The Waqf Board is the third-largest landowner in India. As of December 2022, it managed around 872,000 registered properties. However, various reports suggest that its total landholdings go beyond 940,000 acres. These properties are mainly used for religious and social welfare purposes, including mosques, madrasas (Islamic schools), graveyards, dargahs (shrines), and community centers.

What Is a Waqf Property and How It Works

Waqf properties are lands or buildings that are donated for the welfare of the community in accordance with Islamic principles. Once a property is registered as Waqf, it is considered a permanent donation to Allah. That means the ownership cannot be reversed or changed. The word ‘Wakf’ comes from the Arabic term ‘wakufa,’ which means to dedicate something in the name of God or for public benefit. In India, the Waqf system is governed by the Waqf Act and treated as a minority rights issue. It operates with a level of independence. In contrast, in countries like Pakistan and Bangladesh, Waqf matters fall under Islamic law and are directly regulated by the government.

After India’s independence, the Waqf system expanded significantly as more individuals donated land for religious and charitable causes. The government established the Central Waqf Council in 1964 to guide and monitor state Waqf Boards. Over time, the number of registered Waqf properties grew rapidly—from around 490,000 in 2006 to over 872,000 by December 2022, covering nearly 940,000 acres. Waqf lands began supporting not only mosques and dargahs but also schools, hospitals, and welfare programs. Despite reforms like the Waqf Act of 1995 and digitization efforts through the WAMSI project, the system still faces issues such as land encroachments, legal disputes, and poor management.

Historic Contributions by the Nizams of Hyderabad

One of the biggest contributors to Waqf land in India were the Nizams of Hyderabad. The title ‘Nizam’ comes from ‘Nizam-ul-Mulk,’ which means ruler of the state. Hyderabad had ten Nizams between the 18th and 20th centuries. The last ruler, Mir Osman Ali Khan, also known as Asaf Jah VII, was especially generous. He donated thousands of acres of land for Waqf purposes, especially in the Deccan region, to support religious and social institutions.

Waqf Land from Mughal Rulers

Several Mughal emperors also played a key role in expanding the Waqf system in India. Rulers like Akbar, Shah Jahan, and Aurangzeb donated large areas of land to support religious institutions in cities like Delhi, Agra, and Hyderabad. Royal women such as Jahanara Begum, daughter of Shah Jahan, were also known for donating valuable properties to Waqf for religious and public use.

Donations from Followers of Sufi Saints

The spread of Sufism in India led to large contributions to Waqf by the followers of famous saints. Devotees of Hazrat Nizamuddin Auliya in Delhi and Khwaja Moinuddin Chishti in Ajmer offered land for the maintenance and growth of their shrines. Other well-known dargahs, like those of Salar Masood Ghazi in Bahraich and Baba Farid in Punjab, also benefited from such contributions.

Support from Businessmen and Prominent Personalities

Wealthy Muslim merchants and landowners have also supported Waqf through donations. Industrialists like Sir Syed Muhammad and the Vakeel family of Ahmedabad donated land to educational and religious causes. In more recent times, well-known figures such as Wipro founder Azim Premji and former Vice President of India, Hamid Ansari, have supported Waqf institutions, particularly for the development of education and healthcare. Institutions like Darul Uloom Deoband and Nadwatul Ulama have received considerable support in this way.

Where Are Most Waqf Properties Located

While Waqf land is spread throughout the country, some cities have a particularly high concentration of properties. These include Delhi, Hyderabad, Lucknow, and Ajmer. The income generated from these lands is used for religious purposes, educational services, healthcare programs, and helping the underprivileged.

Ongoing Problems and Legal Disputes

Despite the vast number of properties under its control, the Waqf Board faces several challenges. Legal disputes over land ownership and encroachments are common. Some properties are poorly managed, leading to misuse or loss of valuable assets. In many cases, lack of proper records and monitoring makes it difficult to resolve conflicts or ensure transparency.

Over centuries, kings, nobles, saints, businessmen, and ordinary people have helped build India’s Waqf system through generous donations. These properties continue to serve religious and social purposes even today. While the system has deep historical roots and great potential, it also faces modern challenges that require careful management and legal clarity. The story of Waqf in India reflects both a rich tradition of charity and the ongoing need for reform and accountability.

The Congress party announced on Friday that it will soon challenge the constitutionality of the Waqf (Amendment) Bill, 2025, in the Supreme Court. Party leader Jairam Ramesh criticized the Bill, calling it an “assault of the Narendra Modi government on the Indian Constitution.” He emphasized that Congress would continue to resist such actions.

Congress’s Previous Legal Battles

Ramesh highlighted several ongoing legal challenges initiated by the party. He mentioned that the Supreme Court is already hearing Congress’s cases against the Citizenship (Amendment) Act, 2019, amendments to the Right to Information Act, 2005, and changes to the Conduct of Election Rules (2024). Additionally, the party has intervened to uphold the Places of Worship Act, 1991. He confirmed that the Waqf (Amendment) Bill, 2025, would also be challenged soon.

“We are confident and will continue to resist all assaults of the Modi Govt on the principles, provisions, and practices that are contained in the Constitution of India,” Ramesh stated.

On early Friday, Parliament approved the Waqf (Amendment) Bill, 2025, after the Rajya Sabha passed it following an over 13-hour debate. The Bill had already received approval in the Lok Sabha. The discussion saw fierce objections from opposition parties, who labeled the Bill as “anti-Muslim” and “unconstitutional.” The government defended it as a “historic reform” aimed at benefiting the minority community.

The Rajya Sabha passed the Bill with 128 votes in favor and 95 against. In the Lok Sabha, 288 members supported it, while 232 opposed it.

Several opposition parties, including the Congress, TMC, DMK, AAP, Shiv Sena (UBT), Samajwadi Party, RJD, and Left parties, strongly opposed the Bill. They accused the government of introducing it with “mala fide intentions” to seize Muslim-owned properties and transfer them to corporations. Some opposition leaders even demanded that the Bill be withdrawn.

Along with the Waqf (Amendment) Bill, 2025, Parliament also passed the Mussalman Wakf (Repeal) Bill, 2025. The Rajya Sabha approved the Bill after it had already been passed by the Lok Sabha.

The government claims it will bring transparency, while the Opposition argues it targets minority rights. Here’s a breakdown of the key changes and ongoing controversy.
</excerpt>

The Waqf Amendment Bill was approved by the Lok Sabha late last evening following a heated, several-hour debate. The bill now moves closer to being an Act. The government argues that the amendments will introduce transparency and efficiency into the operations of Waqf Boards.

The Opposition, however, has strongly opposed it as an attack on minority rights and accused the government of seeking to take over Waqf land, covering 9.4 lakh acres.

What Is Waqf?

The word is derived from the Arabic term “waqufa,” which means “to hold.” This means the properties are committed solely to Muslim beneficent causes. As soon as a property is announced to be Waqf, its sale or utilization for any other cause is strictly banned. The ownership of such properties is considered to be given to Allah, and donors cannot recover them.

The institution in India goes back to the 12th century under the Delhi Sultanate. It is on record that Sultan Muizuddin Sam Ghaor, or Muhammad of Ghori, gifted two villages to the Jama Masjid in Multan (now in Pakistan). With the passage of centuries, the number of Waqf properties increased manifold. A notable case in the late 19th century saw a Waqf property dispute from British India reach the Privy Council of London, which initially declared Waqf “invalid.” However, a 1913 law safeguarded Waqf, ensuring its continuation in India.

How Much Property Does the Board Hold in India?

The Board is India’s third-largest landholder after the Railways and the Armed Forces. Waqf boards now own 8.72 lakh properties in India, spreading over nearly 9.4 lakh acres, as per the Minority Affairs Ministry. The estimated market value of these properties, estimated, stands at Rs 1.2 lakh crore.

Out of the 3,56,051 Waqf properties, most are located in Uttar Pradesh, where there are more than 1.2 lakh properties under the Waqf Board. There are also 16,713 movable properties, the highest number of which is in Tamil Nadu.

The government asserts that most Waqf properties are involved in disputes, usually cases of encroachment. As many as 40,951 property cases are pending before tribunals at present, and almost 10,000 of these have been filed by Muslims against the Waqf administration. The Centre says that the absence of provisions to refer disputes to courts delays their settlement.

Monuments and Waqf

Most famous historical monuments in India belong to the board. Some of the well-known examples are:

Jama Masjid, Delhi – Under the administration of the Delhi Waqf Board

Fatehpur Sikri (including the Tomb of Salim Chishti)

Bada Imambara, Lucknow

The ownership of monuments by Waqf authorities has resulted in administrative conflicts with the Archaeological Survey of India (ASI). For example, the Uttar Pradesh Sunni Waqf Board previously argued ownership of the Taj Mahal. The Supreme Court, however, dismissed the argument when the board could not provide documentary proof. Such conflicts also arise regarding protected monuments such as Safdarjung Tomb, Purana Qila, and the Humayun’s Tomb complex.

Controversial Claims by the Board

A number of controversies over the board’s property claims have appeared in the past few years.

Tamil Nadu Village Dispute

In 2022, the Tamil Nadu Waqf Board announced Thiruchenthurai village as Waqf property, leaving residents stunned. A local farmer named Rajagopal found out when he tried to sell his land and was requested to take an NOC from the Waqf Board. The village, home to a 1,500-year-old Hindu temple, had protests, and the issue is still pending.

Gujarat Housing Society Incident

A Gujarat housing society resident had his apartment registered with the Waqf Board, which was thereafter utilized for religious activities. This concerned that private property can be turned into Waqf without the consent of the community, which needed to be reformed.

Main Reforms in the Waqf Amendment Bill

The new Amendment Bill brings several significant reforms:

Eligibility for declaration: The declaration of a Waqf property can only be made by a Muslim who has practiced Islam for the past five years.

Ownership criterion: A property can be declared as Waqf only when the donor legally owns it.

End of ‘Waqf by User’: The existing legislation permits properties to be considered Waqf as a result of extended religious utilization. The proposed bill does away with this feature.

Protection of Rights of Inheritance: Declaration cannot deprive legal heirs, including women, of their inheritance rights.

Exclusion of Government Property: Government property cannot be classified as Waqf anymore.

Restriction on Waqf Board Powers: The boards will not be able to decide whether a property is Waqf or not.

Reform in Waqf Council and Board Composition

The 1995 Waqf Act mandated that all Central Council members be Muslims and required at least two women members.

The new bill requires two non-Muslim members and ensures at least two women members from the Muslim community.

State governments can now nominate MPs, MLAs, or MLCs to the Board, even if they are non-Muslims.

The Bill provides for Bohra and Agakhani community representation if they possess properties in a state.

According to the current law, Waqf Tribunal orders are final and non-appealable in courts. The new bill provides for appeals to the High Court within 90 days.

Government’s Position on the Bill

Minority Affairs Minister Kiren Rijiju, who moved the Bill in the Lok Sabha, has said, “Crores of poor Muslims will thank Prime Minister Narendra Modi once it becomes a law.”

He also justified the amendments, saying many properties are ill-managed, and this law will make them more accountable.

Why the Protests?

Muslim bodies, headed by the All India Muslim Personal Law Board (AIMPLB), have opposed the bill, describing it as discriminatory. AIMPLB President Maulana Khalid Saifullah Rahmani said:

“If this amendment is passed, there will be a surge in illegitimate governmental and non-governmental claims on Waqf properties, making it easier for Collectors and District Magistrates to seize them.”

The Opposition parties, including Congress and the Samajwadi Party, have also strongly opposed the bill. Samajwadi Party Chief Akhilesh Yadav criticized the government, saying, “The Bill has been brought to mask the government’s failures.”

AIMIM lawmaker Asaduddin Owaisi ripped apart the Bill in Parliament, branding it as unconstitutional and blaming the BJP for instigating religious unrest.

Union Minister Kiren Rijiju defended the bill, citing its extensive deliberations, while the opposition expressed concerns over its impact on religious communities.
</excerpt>

The Rajya Sabha met on April 3, 2025, to consider the Waqf Amendment Bill 2025 and the Mussalman Wakf Repeal Bill 2024. The session commenced with Vice President Jagdeep Dhankhar’s address on the day of the Rajya Sabha. Leader of Opposition Mallikarjun Kharge rose to voice his strong objection over BJP MP Anurag Thakur’s statement in the Lok Sabha against Waqf properties, asking for an apology.

The Waqf Amendment Bill 2025, which was cleared by the Lok Sabha after a heated 12-hour debate last night, was brought to the Rajya Sabha by Union Minister Kiren Rijiju. The bill was voted on by 288 MPs for and 232 against, with opposition amendments rejected.

Kiren Rijiju Defends Waqf Bill, Seeks Opposition’s Support

Union Minister of Minority Affairs Kiren Rijiju introduced the bill, calling upon the opposition to support it. “”I would like to appeal to the Congress and other parties to come and support this bill,” Rijiju stated. Rijiju contended that the appropriate utilization of Waqf resources could significantly improve India’s development, saying, “Right use of Waqf can transform India.”

He also pointed out the enormous size of Waqf properties in India, stating that the number of Waqf properties has increased manifold over the years. “As of today, there are 8.72 lakh Waqf properties. In 2006, the Sachar Committee estimated the earnings from 4.9 lakh Waqf properties at Rs 12,000 crore. You can imagine the income these properties must be generating now,” Rijiju informed the Rajya Sabha.

UPA’s 2013 Waqf Amendments vs. Present Bill

Rijiju contrasted the legislative process of the present bill with the changes brought about by the UPA government in 2013. He noted that the current deliberations were more comprehensive. “In 2013, during the elections, the UPA government introduced certain changes. A Joint Parliamentary Committee (JPC) was formed then as well. The select committee at that time had 13 members, whereas now we have 31 members. There were 22 sittings back then; this time, we had 36. Earlier, 14 states participated in discussions, while this time, 25 state governments and the Minority Commission took part,” he said.

“We Don’t Want to Hurt Religious Sentiments”: Rijiju

Allaying fears, Rijiju assured Parliament that the government did not intend to violate religious rights. “We don’t want to hurt anyone’s religious feelings,” he stated firmly. He urged opposition parties to take a look at the long-term gains of the bill and reiterated that the government is still committed to protecting the interests of all communities.

Opposition Expresses Concern, BJP Replies Criticism

The bill has been controversial, with opposition leaders accusing it of targeting the Muslim community. Opposition MPs have said that the bill gives too much government authority over Waqf properties, reducing religious autonomy.

But, BJP leaders refuted these allegations, saying that the bill only addresses property management and not religious practice. Union Home Minister Amit Shah jumped into the debate, making it clear that donors and administrators of Waqf properties can only be Muslims. “A manager/administrator of a Waqf—a charitable endowment—and the donor can only be from the Muslim community.”. Non-Muslims have been made part of a Waqf Board or Council for administrative reasons and to make sure that any donation is being utilized for the purpose it is intended for,” Shah explained.

Manipur President’s Rule & Other Parliamentary Discussions

Besides the Waqf Bill, Home Minister Amit Shah is also likely to introduce a motion in the Rajya Sabha to impose President’s Rule in Manipur. While this, the Lok Sabha is going to deliberate The Coastal Shipping Bill, 2024, to be proposed by Union Minister Sarbananda Sonowal.

With the controversy over the Waqf Amendment Bill 2025 heating up, everybody’s attention is still focused on Rajya Sabha, where the bill’s fate will be determined in the days to come.

</excerpt>

Congress MP Sonia Gandhi has roundly condemned the BJP government for ramming through the Waqf Amendment Bill in the Lok Sabha. Addressing the Congress general body meeting, she said the action was a calculated attempt to keep Indian society in a “state of permanent polarisation.

“The Waqf Amendment Bill was in effect bulldozed through. Our party’s position is clear. The bill is a brazen assault on the Constitution itself,” Sonia Gandhi stated.

Sonia Gandhi, Chairperson, CPP & Congress MP at CPP General Body meeting, says,” Yesterday, the Waqf Amendment Bill, 2024 was passed in the Lok Sabha, and today it is scheduled to come up in the Rajya Sabha. The bill was in effect bulldozed through. Our party’s position is clear.… pic.twitter.com/nSUiA9KdON

The Congress has already claimed several times that the Joint Parliamentary Committee (JPC) constituted to scrutinize the bill overlooked the recommendations of the opposition, rejecting 44 suggested amendments. The party accuses the bill of undermining the values of the Constitution and consolidating power in the hands of the Centre for Waqf properties.

Midnight Vote Passes Contentious Bill

Waqf Amendment Bill was approved by the Lok Sabha following a contentious 12-hour debate that ended just after midnight on Thursday. The bill was passed with 288 votes in the affirmative, against 232 MPs who voted against it. The bill gives the government considerable leverage over Waqf properties, an action which has found opposition from leaders of the opposition.

Sonia Gandhi also blamed the Modi government for deliberately dismantling democratic institutions. “Whether it is education, civil rights and liberties, our federal structure or the conduct of elections, the Modi government is dragging the country into an abyss where our Constitution will remain on paper, and we know their intention is to demolish even that,” she further said.

Legal Challenge and Opposition Mobilization

Congress MP and JPC member Imran Masood declared that the party would move court against the Waqf Bill. The DMK, a Congress ally, has also threatened to move court. Sonia Gandhi also asked Congress MPs to fight the BJP’s “falsehoods” with the same ferocity and expose the failures of BJP-ruled states.

Congress to Oppose One Nation One Election Bill

Sonia Gandhi also made strong objections during the meeting to the One Nation One Election Bill, which suggests simultaneous elections for the state legislatures and Lok Sabha. The bill is being examined by a JPC and is likely to be reintroduced in the Monsoon session.

“The One Nation One Election Bill is another subversion of the Constitution. We strongly oppose this legislation,” she asserted.

As legal battles loom and political pressures build, the fight over the Waqf Amendment Bill and other controversial reforms will escalate in the months to come.

</excerpt>

The reforms suggested in the Waqf Amendment Bill, 2024, which was introduced in the Lok Sabha on Wednesday for discussion and passage by Parliamentary Affairs Minister Kiren Rijiju, place India ahead of many Western, European, and even Muslim-majority countries in terms of Waqf management, offering a specialized framework designed to reflect contemporary values of accountability and inclusivity.

The new framework, which is being challenged by the opposition parties—understandably driven by their political compulsions—aims to improve the efficiency, transparency, and inclusivity of Waqf management, while also aligning it with modern governance standards.
Significantly, many of the ‘liberal’ Western countries that have criticized India on grounds of ‘plurality’ and ‘secularity’ do not have any specific laws to govern Waqf properties.
Similarly in Asian countries where the Muslim population is substantial, the laws that govern the Waft properties are archaic and serve no beneficial purpose for the community as a whole.
As per the bill, which has been made public, it incorporates 25 recommendations made by the Joint Parliamentary Committee (JPC) and brings reforms, especially in terms of gender equality, sectarian inclusivity, and government oversight. An analysis of the bill, and a comparison to similar laws governing Waqf in Western and European countries, as well as Malaysia, Indonesia, and Sri Lanka, all of which have substantial Muslim populations, weakens the opposition’s claims that the bill is anti-Muslim.
Speaking in the parliament Rijiju, pointed out that the most ‘draconian’ provision in the previous Act was Section 40, under which the Waqf Board could declare any land Waqf property. The said provision has been removed in the new bill which is likely to be passed in both the houses given the majority enjoyed by the government. Another contentious rule, ‘waqf by user’ under which a property is considered as a waqf property because it is being used for a long time for religious or charitable purposes, even without formal documentation, has been abolished.
In Western and European countries, Waqf properties are primarily regulated under the general framework of charity law or trust law, which do not have provisions specifically targeting the unique governance needs of Waqf assets and there are no dedicated Waqf Boards or specific laws for Waqf management.
Instead, Waqf properties are usually treated as part of Islamic charitable organizations or Islamic foundations, governed by general legal structures designed for all charitable activities.
In the United Kingdom ( where Muslim population: 4.4%), Waqf properties are managed under the oversight of the Charity Commission, a body that regulates charitable organizations. There is no specific legislation for Waqf properties; they are simply categorized as charitable assets and managed according to the general framework provided by the Charity Act 2011.

The Charity Commission ensures that these organizations adhere to laws regarding transparency, accountability, and governance, but there is no dedicated body for Waqf properties alone, and the issue of ‘gender equality’ or ‘sectarian representation’, which is mentioned in the Indian law, does not come under the specific purview of charity law.
No separate benefits are given by the charity commission to these bodies on the ground of religion.
Similarly, in the United States (Muslim population: 1.1%), Waqf properties are managed through Islamic charitable organizations, and their management is governed by state-specific trust laws and federal charity regulations, including the IRS tax code which is known for its stringent rules and regulations.
In the U.S., like in the UK, these properties are treated like any other charitable asset, subject to tax-exempt status regulations and general charitable governance. There is no specialized regulatory framework for Waqf, and governance is usually handled at the level of the individual charitable organization.
In France too (Muslim population: 8.8%), Waqf properties are incorporated within the broader scope of Islamic charities, which are regulated by general charity laws that govern all religious and non-profit organizations, and there is no specific framework for Waqf properties.

In Germany (Muslim population: 5.0%) and Canada (Muslim population: 3.2%), the situation is similar, with Islamic charitable organizations managing Waqf properties under the broader charity law framework.
In Germany, charitable foundations or organizations manage Waqf assets, and governance falls under the oversight of the Federal Ministry of the Interior, which ensures compliance with the German Civil Code (Bürgerliches Gesetzbuch, BGB), but there is no specialized body for Waqf management, and there are no specific provisions for gender equality or sectarian representation in the administration of Waqf.
In contrast to these Western and European countries, India’s Waqf Amendment Bill, 2024 is a dedicated piece of legislation that provides specific rules and frameworks for Waqf management.
The Bill empowers the Central Government to create rules regarding Waqf registration, auditing, and accounts, ensuring a high level of transparency and accountability in the handling of Waqf properties.
Additionally, the Indian Waqf Amendment Bill has introduced gender equality provisions. The law mandates the representation of at least two Muslim women on both the Central Waqf Council and State Waqf Boards, a measure aimed at empowering women in the governance of Waqf assets.
Furthermore, the Bill ensures that female inheritance rights to Waqf properties cannot be denied. This contrasts sharply with Western systems, where gender representation is not mandated in the management of Islamic charitable organizations.

Another significant feature of the Indian law is its commitment to sectarian inclusivity. The law mandates that representatives from various Muslim sects—Sunni, Shia, Bohra, Agakhani, and others—be included in the State Waqf Boards, ensuring that all Muslim communities are represented in the decision-making process. This provision is a significant departure from the Western countries, where sectarian representation is not required.
The Indian bill also introduces an appeal process where decisions made by Waqf tribunals can be challenged in the High Court within 90 days. This formal legal recourse ensures that there is judicial oversight of Waqf-related matters, providing a mechanism for addressing grievances.
In contrast, in the West, while charity laws offer legal recourse for disputes, there is no specialized tribunal system for Waqf, and cases related to Waqf are handled under broader trust law or charity law frameworks, which lack the the focus on Islamic endowments.
In Malaysia (Muslim population: 61.3%), the management of Waqf properties is handled by a specialized body called the State Islamic Religious Councils (SIRCs). These councils are empowered by the Administration of Islamic Law (Federal Territories) Act 1993 and other state-specific legislation to oversee the management and administration of Waqf assets.
Unlike India’s new law, which mandates gender representation and sectarian inclusivity, Malaysia’s system places a significant emphasis on the State’s role in managing Waqf properties. While the SIRCs play a crucial role in Waqf management, they are not as inclusive in terms of gender or sectarian diversity as the Indian system.
An analysis of the law shows that Malaysia’s approach is more centralized, with the government having significant control over the administration of Waqf properties, and the inclusion of women or minority sects is not a central feature of the governance system.

In Indonesia (Muslim population: 87.2%), the Waqf Board of Indonesia (BWI) is tasked with overseeing Waqf properties. Established under Law No. 41/2004 on Waqf, the BWI is responsible for the registration, monitoring, and supervision of Waqf properties across the country.
While Indonesia has a more centralized system for Waqf management than some other countries, it does not have the same gender-focused provisions as India’s law.
The BWI focuses more on the legal administration and utilization of Waqf assets, often aimed at increasing the economic productivity of Waqf properties, but gender inclusivity and sectarian representation are not specifically emphasized in the law.

In Sri Lanka (Muslim population: 9.7%), the Waqf laws are governed under the Waqf Act, No. 51 of 1955, which establishes the Sri Lanka Waqf Board. Similar to Malaysia and Indonesia, Sri Lanka’s system of Waqf governance is largely state-controlled.
The Sri Lankan Waqf system is less inclusive than India’s in terms of gender equality and sectarian representation. The Sri Lanka Waqf Board primarily focuses on the legal registration and management of Waqf properties, without specific mandates for gender representation or inclusivity of Muslim sects in its governance structure.
In terms of government oversight, India’s centralized control over Waqf registration and the audit process is more comprehensive than the systems in Malaysia, Indonesia, and Sri Lanka, where state governments typically have greater discretion in managing Waqf properties, without the same level of detailed centralized regulation and oversight seen in the Indian bill.

Apart from being a progressive law that promotes gender inclusion and sectarian diversity, it is also designed to ensure that transparency and accountability are maintained at every level of governance, which is a feature that is not as robust in the Waqf management systems of these countries.

Bill Faces Strong Opposition

As the Budget Session nears its conclusion on April 4, the Waqf Amendment Bill has become a flashpoint between the ruling NDA and the opposition. The INDIA bloc has vowed to defeat the legislation, arguing that it undermines minority rights. The bill, initially introduced last year, was referred to a joint parliamentary committee for review before being brought back for passage.

What Does the Bill Propose?

The Waqf (Amendment) Bill seeks to introduce key changes in the management of waqf properties, aiming for more transparency and efficiency. However, critics argue that it could lead to government overreach into minority affairs.

Reactions & Political Battle

The BJP-led NDA, which holds 293 seats in the 542-member Lok Sabha, remains confident in pushing the bill through. Meanwhile, opposition parties insist they will not allow its passage without a strong fight.

“Owaisi’s act of tearing the bill is against parliamentary norms. It shows a lack of respect for democratic processes,” said BJP leader Jagdambika Pal.

Despite the protests, the government is determined to proceed with the bill’s passage. Will the opposition succeed in blocking it, or will the NDA push it through? The coming days will decide.

On Wednesday, the Lok Sabha considered the Waqf (Amendment) Bill, 2025, incorporating recommendations from the Joint Parliamentary Committee (JPC) that reviewed the bill introduced in August 2024. Additionally, the House took up the Mussalman Wakf (Repeal) Bill, 2024 for discussion and passage. Minority Affairs Minister Kiren Rijiju moved both bills, highlighting their significance for the country.

Opposition Alleges Lack of Time for Amendments

During the debate, Congress leader KC Venugopal accused the government of rushing the bill without providing enough time to propose amendments. “You are bulldozing the legislation; we need time for amendments,” he asserted. Speaker Om Birla responded by assuring that he had fairly considered amendments from both the government and opposition members.

Amit Shah Defends Government’s Process

Raising further objections, RSP MP NK Premachandran questioned the procedural approach. However, Home Minister Amit Shah clarified that the Union Cabinet had already approved the amendments based on the JPC report, dismissing any procedural concerns. “There is no point of order,” he stated firmly.

Kiren Rijiju Calls the Bill ‘Historic’

Speaking to the media, he said, “Today is a historic day. The Waqf Amendment Bill is being introduced for the benefit of the entire nation, not just crores of Muslims. Those opposing it are doing so for political reasons.”

Key Objectives of the Waqf (Amendment) Bill, 2025

The bill seeks to modernize the management of waqf properties, strengthen the Waqf Boards’ efficiency, and improve record-keeping through technology by amending the Waqf Act, 1995. Following its introduction last year, the bill underwent review by the JPC, led by BJP MP Jagdambika Pal, before reaching the Lok Sabha for final approval.

Union Minister Kiren Rijiju emphasized on Wednesday that the Waqf Amendment Bill, set to be introduced in the Lok Sabha, was drafted in the nation’s best interest. He dismissed opposition to the bill as politically driven, stating that if objections were raised based on logic, the government had answers prepared.

Speaking to the media, Rijiju described the day as “historic” and reiterated that the bill had broad support. He claimed that while some groups opposed it for political reasons, the majority of Muslims, along with the entire country, would back the proposed amendments. “I will present the facts in the House,” he asserted. “If someone opposes it, they should do so based on logic, and we are ready to answer them.”

Bill Prepared After Careful Consideration

The Union Minister stressed that the bill had been drafted after extensive discussions and thorough preparation. “When we bring such a bill, we do so after a lot of thought and planning,” he said.

Meanwhile, Union Minister and Rashtriya Lok Dal (RLD) President Jayant Chaudhary voiced his party’s support for the bill, affirming their alignment with the ruling NDA. “We are with NDA. We’ve issued a whip,” he stated.

Support from Various Leaders and Communities

Union Minister George Kurian also backed the amendment, claiming that it had support across communities. He argued that only large landowners opposed the bill, whereas poor and middle-class Muslims were in favor. “All communities support this amendment bill. We can see that poor Muslims and the middle class also support it. Only big landlords are against it,” he told ANI.

Kurian further explained that the bill ensured transparency as it was related to land and property. “It is very transparent because it deals with land and property,” he remarked.

Opposition Accused of Vote Bank Politics

Uttar Pradesh Minister OP Rajbhar criticized opposition parties like the Samajwadi Party (SP), Bahujan Samaj Party (BSP), and Congress, accusing them of engaging in vote bank politics. “SP, BSP, and Congress supporters are doing vote politics,” Rajbhar alleged.

He pointed out that the Waqf Board rules had been amended three times previously, with changes made to correct shortcomings and ensure beneficiaries under Waqf Board regulations received proper benefits. “The rules have been amended three times before, and shortcomings have been fixed each time. Now, it is being improved again,” he explained.

Rajbhar also challenged those opposing the bill to name a single poor person who had benefited from Waqf Board land. “The government wants to ensure that those under the Waqf Board rules get their due benefits. These people are opposing it just for votes,” he added.

Waqf Amendment Bill Set for Debate in Parliament

The Waqf (Amendment) Bill will be tabled in Parliament on Wednesday. Both the BJP and Congress have issued whips, instructing their MPs to be present in the House for the discussion and voting.

With no clear consensus between the ruling BJP-led National Democratic Alliance (NDA) and the opposition INDIA bloc, the bill’s fate will likely depend on numerical strength in Parliament.

</excerpt>

DMK leader A Raja on Wednesday lodged a protest with Joint Parliamentary Committee (JPC) on Waqf (Amendment) Bill chairman Jagdambika Pal over the meeting called on January 24 and 25 and urged him to change the dates to January 30 and 31. In his letter to Pal, Raja, who is also the DMK’s Chief whip in the Lok Sabha said that as per the instruction of the Lok Sabha Secretariat through the letter dated January 20, the members of JPC have been requested to send their Amendments to the proposed Bill latest by 4 pm on January 22 and also, the next sitting of JPC has also been convened on 24 and 25 of this month for clause by clause consideration of the Bill.

The DMK leader argued that it is needless to say that the tour programmes of the JPC to meet the stake holders at Patna, Kolkata and Lucknow were completed only on January 21. He highlighted that the members were dispersed from the tour programme to their Constituency or States to continue their scheduled programmes earlier. “It is very strange that the next dates for sitting of JPC were hurriedly announced without any formal discussion when the JPC was already on tour,” the DMK leader said, adding that even during the sitting of JPC at Lucknow itself it was requested by the members that the proposed sittings on 24 and 25 January were practically not possible as the members are expected to discharge their duties or programmes in the locality.

“Moreover, the members are not in a position to recollect the evidences or materials in such a short notice which are essentially needed for the moving the Amendments and discussion thereon. Of course, you have directed the stakeholders who participated in the tour programme at Patna, Kolkata and Lucknow to submit their views and submission in writing within seven days and the committee is waiting for the same for circulation. “Hence, it was requested by the most of the members at Lucknow sitting that the proposed sittings of JPC on 24 and 25 have to be necessarily postponed on 30 (full day) and 31 January after the Presidential Address in the Parliament,” he said

Raja also mentioned that Pal had reacted to the request that it will be considered positively after consultation with the government realising the justification offered by the members for the postponement. “Unless the sittings of the JPC is postponed, the purpose of the Constitution of the JPC itself will be defeated as it raises the doubts in the minds of the people of India that the secular fabrics of the Constitution embodied in its preamble itself are endangered and the due process in conducting the JPC is also not followed,” Raja said.

</excerpt>

The Winter Session of Parliament is set to commence on November 25 and will continue until December 20, as announced by Union Minister of Parliamentary Affairs, Kiren Rijiju, on Tuesday. In a post on X, Rijiju stated, “President, on the recommendation of Government of India, has approved the proposal for summoning of both the Houses of Parliament for the Winter Session, 2024 from 25th November to 20th December, 2024 (subject to exigencies of parliamentary business).”

He also mentioned that on November 26, Constitution Day, the 75th anniversary of the adoption of the Constitution will be celebrated in the Central Hall of Samvidhan Sadan.

During this session, the government aims to pass the Waqf Amendment Bill, which is currently under review by the Joint Parliamentary Committee (JPC). Additionally, there is a possibility of introducing the ‘One Nation, One Election’ bill.

Prime Minister Narendra Modi has emphasized his government’s commitment to implementing ‘One Nation, One Election,’ aiming for simultaneous polls for the Lok Sabha and state assemblies. He stated, “We are now working towards ‘One Nation, One Election,’ which will strengthen India’s democracy, give optimum outcome of India’s resources and the country will gain new momentum in achieving the dream of a developed India.”

However, the Congress party has expressed opposition to this concept. Congress President Mallikarjun Kharge dismissed the idea as ‘impossible,’ stating, “What PM Modi has said, he will not do it, because when it comes in the parliament, he has to take everybody into confidence, then only this will happen. This is impossible, ‘One Nation One Election’ is impossible.”

The Joint Parliamentary Committee on the Waqf Amendment Bill 2024 is actively engaging with various stakeholders across different states to address concerns and seek a consensus on the bill.

The outcomes of the Assembly elections in Jharkhand and Maharashtra, scheduled to be announced on November 23, are also anticipated to be discussed in both houses during the session.

</excerpt>

Delhi Police has announced strict prohibitory measures under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) from September 30 to October 5, 2024, in response to intelligence reports signaling potential unrest. The decision comes as the national capital faces a tense law-and-order situation due to several volatile issues. Among these are the contentious Waqf Amendment Bill, rising communal tensions surrounding the Shahi Idgah in Sadar Bazaar, ongoing political clashes around the MCD Standing Committee elections, and the pending results of the Delhi University Students’ Union (DUSU) elections.

With legislative elections underway in Jammu, Kashmir, and Haryana, the authorities are also tightening border security around Delhi to monitor movements and prevent any infiltration attempts by anti-social elements. Additionally, the influx of VVIPs in New Delhi for Gandhi Jayanti celebrations on October 2 has necessitated heightened security.

The imposed restrictions include a ban on gatherings of five or more people, carrying weapons, and holding unauthorized protests or sit-ins. Violations will be punishable under Section 223 of the BNSS, a provision meant to safeguard public order.

These measures are seen as crucial to maintaining peace amid political and communal tensions, especially given the upcoming elections and the potential for demonstrations across the capital

Speaking on Sunday, Owaisi slammed the bill, arguing that allowing district collectors to adjudicate disputes where the government has a stake violates the principles of natural justice.

“Under Section 3 of the Waqf (Amendment) Bill, if the government takes over a Waqf property, the district collector is empowered to resolve the dispute. But how can a collector be a judge in his own case? This is against the principles of natural justice,” Owaisi stated.

Owaisi highlighted instances where the government has seized Waqf properties, particularly citing that over 200 properties in Delhi are under government control. “In such cases, will any collector admit that the property belongs to Waqf? Why would a collector rule against the government?” he questioned.

The AIMIM chief further alleged that the Modi government is targeting Waqf properties, including mosques, graveyards, and agricultural land, with the aim of taking over these assets. He emphasized that Waqf properties are private, donated by Muslims, and criticized the government for turning the issue into a public matter.

Owaisi also raised concerns about the proposal to include non-Muslim members on Waqf boards, drawing a comparison to the Kashi Vishwanath Temple Act of 1983 in Uttar Pradesh, which mandates that only Hindu members can be part of the temple board.

The Waqf (Amendment) Bill 2023, introduced during the budget session of Parliament, is currently under review by a Joint Parliamentary Committee (JPC) consisting of 31 members. Minority Affairs Minister Kiren Rijiju has stated that the JPC’s report is expected to be submitted by the first week of the winter session of Parliament.

While the government asserts that the bill is intended to improve governance and streamline the management of Waqf properties, opposition parties have raised concerns about potential overreach and the erosion of Waqf institutions’ autonomy.

Speaking to media ahead of a JPC meeting on the bill, Mhaske emphasized that the bill seeks to address issues highlighted in the Sachar Committee report presented earlier by the Congress. He asserted, “We want the poorest and most backward citizens to get justice. If the Waqf Board stands above the Constitution, a legal decision will have to be taken.”

JPC chairperson Jagdambika Pal noted that the committee will prioritize input from minority organizations while deliberating the bill. Pal added that the government’s primary goal is to ensure Waqf properties benefit backward Muslims and women. The committee includes 21 members from the Lok Sabha and 10 from the Rajya Sabha.

The Waqf (Amendment) Bill 2024 was introduced during the budget session of Parliament and subsequently referred to the JPC for further review. The proposed amendments include renaming the Waqf Act of 1995 as the Unified Waqf Management, Empowerment, Efficiency, and Development Act. The bill seeks to redefine “Waqf” as property endowed by a practicing Muslim for at least five years, ensuring the creation of Waqf-alal-aulad does not infringe upon women’s inheritance rights.

Key provisions include omitting “Waqf by user,” assigning survey responsibilities to the Collector, broadening the composition of Waqf councils and boards, and ensuring representation of Muslim women and non-Muslims. The bill also proposes establishing separate Auqaf boards for Boharas and Aghakhanis, reforming the Tribunal structure, and allowing appeals to the High Court within 90 days.

Minority Affairs Minister Kiren Rijiju, who introduced the bill in the Lok Sabha, announced that the JPC is expected to submit its report by the first week of the winter session of Parliament.

Union Parliamentary Affairs Minister Kiren Rijiju announced the committee members on Friday, including notable figures such as AIMIM chief Asaduddin Owaisi and Congress MP Imran Masood.

In the Lok Sabha, Rijiju proposed 21 MPs for the JPC, and the Rajya Sabha was asked to nominate 10 members. The selected Lok Sabha MPs include Jagdambika Pal, Nishikant Dubey, Tejasvi Surya, Aparajita Sarangi, Sanjay Jaiswal, Dilip Saikia, Abhijit Gangopadhyay, DK Aruna, Gaurav Gogoi, Imran Masood, Mohammad Jawed, Maulana Mohibullah Nadvi, Kalyan Banerjee, A Raja, Lavu Sri Krishna Devarayalu, Dileshwar Kamait, Arvind Sawant, Suresh Gopinath, Naresh Ganpat Mhaske, Arun Bharti, and Asaduddin Owaisi.

In the Rajya Sabha, the committee will include Brij Lal, Dr. Medha Vishram Kulkarni, Gulam Ali, Dr. Radha Mohan Das Agrawal, Syed Naseer Hussain, Mohammed Nadeem Ul Haq, V Vijayasai Reddy, M. Mohamed Abdulla, Sanjay Singh, and Dr. Dharmasthala Veerendra Heggade.

The proposal was approved by both Houses, which have since adjourned sine die.

The formation of the JPC follows strong opposition from parties such as Congress, DMK, NCP, Trinamool Congress, and AIMIM, who criticized the bill’s provisions as contrary to federalism and constitutional principles. Some members called for the bill’s withdrawal, while others suggested it be sent to a standing committee.

The Waqf (Amendment) Bill, 2024, seeks to rename the Waqf Act, 1995, to the Unified Waqf Management, Empowerment, Efficiency, and Development Act, 1995.

</excerpt>

Former Union Minister and senior BJP leader Mukhtar Abbas Naqvi on Thursday said here that the Waqf Amendment Bill will pave the way for “constitutional hierarchy over un-constitutional anarchy”.

The Waqf Amendment Bill introduced in Parliament is a positive and constructive step towards “a logical ending solution to a long pending problem” Naqvi told reporters. This is the need of the country, religion as well as the Waqf and Waqt (time).

Naqvi said that those who are trying to create “communal confusion on constitutional correction” must desist from spreading fear and fallacy through their communal fanatic conspiracy to impose a Talibani lock on an inclusive reform. He said that in the name of autonomy, the arrogance of super constitutional authority is not in the interest of the country and the community both. The Waqf system should move beyond its “touch-me not” syndrome as this mentality, supported by the communal caucus, has made the Waqf system as a hostage of their narrow minded self-interests.

Naqvi said that this is the right time to bring the Waqf system out of the darkness of mistrust and anarchy. The Waqf Amendment Bill will ensure transparency and accountability in the Waqf system for empowerment of the society.

The Haj Association of India welcomed the Waqf (Amendment) Bill, 2024, moved in Lok Sabha on Thursday and called it a “big initiative” by the government of India.
Haj Association of India chairman A Aboobucker said that this bill will be “good for women’s empowerment” and also help the poor.

“On behalf of the Haj Association of India, New Delhi, we welcome this amendment as this Act is quite old. As per the current scenario, some amendments need to be made. Govt of India has taken a big initiative and we welcome that, there is no doubt,” Aboobucker said. He also criticised those opposing the bill and said that “some of the organisations and political parties, a few are opposing this at the pan India level, I think it will be good for women’s empowerment and will help the poor people.”

The Waqf (Amendment) Bill, 2024, Waqf Act provides for the renaming of the Waqf Act, 1995, as the Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995. Union Minister for Minority Affairs Kiren Rijiju moved the bill in Lok Sabha on Thursday. The bill seeks to “effectively address issues” related to the powers of the State Waqf Boards, registration and survey of waqf properties and removal of encroachments.

</excerpt>

Giving a mixed reaction to the Waqf (Amendment) Bill, National President of All India Muslim Jamaat, Maulana Shahabuddin Razvi Barelvi said on Thursday that an amendment is necessary but the appointment of non-Muslims in the Board is against the Shariat and the law.

“Waqf should be looked at from a completely Islamic point of view. Waqf board was formed to maintain the land given by the elders. In the new era, the property of the Waqf has increased by many times. An amendment is necessary. Waqf Board chairman, members, and officials were buying and selling land with the help of land mafias. Waqf board diverted from its purpose and got involved in collecting money. We support the amendment but we are against the appointment of non-Muslim members in it. We are against the appointment of a district officer,” he said.

“Appointment of non-Muslims is against the Shariat and the law. Giving the authority to the DM is also wrong. These points must be removed from the amendment,” he added further.
Earlier, Congress MLA from Bhopal Arif Masood opposed the Waqf Board Amendment Bill, 2024, saying that Waqf properties are private properties and do not belong to any individual.

Launching scathing attacks on the Centre over the Waqf (Amendment) Bill, AIMIM Chief and Hyderabad MP, Asaduddin Owaisi said that there are a lot of dangerous sections and it is not legislation but something to bulldoze Waqf and finish Muslims.
Meanwhile, targeting the Opposition over “misleading Muslims” on the Waqf (Amendment) Bill, Union Minister of Minority Affairs Kiren Rijiju said on Tuesday that Muslim delegations approached him alleging mafia has taken over Waqf Boards and there is a need for amendments.

He also asserted that the government has held multi-layered country-wide consultations on this bill.

The Waqf (Amendment) Bill, 2024, Waqf Act provides for the renaming of the Waqf Act, 1995, as the Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995.

It seeks to clearly define “waqf” as waqf by any person practising Islam for at least five years and having ownership of such property and ensure that the creation of Waqf-alal-aulad does not lead to the denial of inheritance rights to women.

The bill proposes to amend the Waqf Act, 1995, and rename it the Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995. It seeks to clearly define “waqf” as property held by individuals practicing Islam for at least five years, ensure that Waqf-alal-aulad does not infringe on women’s inheritance rights, and update various provisions for improved management and representation within Waqf institutions.

Opposition parties, including Congress, DMK, NCP, Trinamool Congress, and AIMIM, strongly criticized the bill, arguing that it violates federalism and constitutional principles. They called for the bill’s withdrawal or its referral to a standing committee for further examination.

In response to the opposition’s concerns, Rijiju agreed to refer the bill to a Joint Parliamentary Committee (JPC) for detailed scrutiny. “We are not avoiding any scrutiny. If it needs to go to a committee, I propose that a JPC be formed to discuss it in detail,” he said.

Rijiju also addressed the opposition’s points and noted that the bill is based on recommendations from a panel established during the Congress-led UPA government. Additionally, he introduced the Mussalman Wakf (Repeal) Bill, 2024, which aims to repeal the Mussalman Wakf Act, 1923.

The Waqf (Amendment) Bill includes provisions to establish a separate Board of Auqaf for Boharas and Aghakhanis, ensure broader representation within the Central Waqf Council and State Waqf Boards, and streamline Waqf registration and mutation procedures. It also proposes the omission of certain outdated provisions and reforms to the Tribunal structure.

The government has decided to withdraw the Waqf Properties (Eviction of Unauthorised Occupants) Bill, 2014, previously introduced in the Rajya Sabha under the Congress-led UPA government.

</excerpt>

The Haj Association of India has expressed strong support for the Waqf (Amendment) Bill, 2024, which was introduced in the Lok Sabha on Thursday, describing it as a “significant initiative” by the government.

A Aboobucker, chairman of the Haj Association of India, praised the bill, stating that it would be beneficial for women’s empowerment and provide assistance to the poor. “We welcome this amendment as the Waqf Act is quite old and needs updates in line with the current scenario. The government of India has taken a big initiative, and we fully support it,” Aboobucker said. He also criticized the opposition to the bill, asserting that some organizations and political parties are resisting necessary reforms.

The Waqf (Amendment) Bill, 2024, proposes to rename the Waqf Act, 1995, as the Unified Waqf Management, Empowerment, Efficiency, and Development Act, 1995. It seeks to address issues related to the powers of State Waqf Boards, registration and survey of waqf properties, and the removal of encroachments. Union Minister for Minority Affairs Kiren Rijiju, who introduced the bill, emphasized that it does not interfere with the freedom of any religious body but aims to grant rights to those who have historically been deprived.

However, the bill faced strong opposition in the Lok Sabha. Congress MP KC Venugopal called it an “attack on the federal system,” while NCP-SCP MP Supriya Sule urged the government to either withdraw the bill or send it to a standing committee for further consideration. RSP MP NK Premachandran warned that the law could be struck down if subjected to judicial scrutiny, and DMK MP Kanimozhi argued that the bill violates Article 30, which protects the rights of minorities to administer their institutions.

Samajwadi Party MP Akhilesh Yadav and AIMIM MP Asaduddin Owaisi also voiced their opposition, with Owaisi claiming that the bill breaches the principles of Articles 14, 15, and 25 of the Constitution.

Despite the opposition, the bill has found support from other quarters. Earlier this week, the All India Sufi Sajjadanshin Council (AISSC) also welcomed the proposed amendments, with Chairman Syed Naseruddin Chishty urging all parties to cooperate with the government in passing the bill. Chishty highlighted the need for transparency in Waqf Board operations and stressed the importance of protecting dargahs and addressing corruption within Waqf boards across states.

</excerpt>

The Waqf (Amendment) Bill, 2024, has sparked intense debate in the Lok Sabha, drawing strong opposition and heated exchanges among members of parliament.

Opposition Voices Concerns

RSP MP NK Premachandran voiced his strong disapproval of the bill, stating, “You are totally disempowering the Waqf Board and the Waqf council… You are dismantling the system. It is against the principles of the Constitution. I caution the government that if this law is put through judicial scrutiny, then it will definitely be struck down.”

Echoing similar sentiments, NCP-SCP MP Supriya Sule urged the government to reconsider the bill. “I request the government to either withdraw this bill completely or send it to a standing committee… Please do not push agendas without consultations,” she said.

Rajya Sabha Chairman Expresses Frustration

In a dramatic turn of events, Rajya Sabha Chairman Jagdeep Dhankhar temporarily ceased presiding over the House and left, expressing his frustration with the lack of support. “Making this sacred House a centre of anarchy, attacking Indian democracy, tarnishing the dignity of the post of the Speaker, this is not just indecent conduct, this is conduct that crosses all limits… What I have been seeing in recent days and the way the challenge is being given through words, letters, through newspapers, how many wrong comments have been made. This challenge is not being given to me but this challenge is being given to the post of the Chairman. And this challenge is being given because they (opposition) think that the person sitting on this post is not worthy of it,” Dhankhar said.

Government and Allies Defend the Bill

BJP MP Hema Malini defended the bill, criticizing the opposition’s stance. “The opposition always opposes, that’s their work. They label good things as bad. The PM has brought many good schemes, but they say that all these things are wrong. I have also seen it from the last 10 years,” she stated.

JD(U) MP and Union Minister Rajeev Ranjan also spoke in favor of the bill, challenging the opposition’s arguments. “How is it against Muslims? This law is being made to bring transparency… The opposition is comparing it with temples, they are diverting from the main issue… KC Venugopal (Congress) should explain how thousands of Sikhs were killed…which taxi driver killed Indira Gandhi? Now, they are talking about minorities,” Ranjan said.

The debate over the Waqf (Amendment) Bill, 2024, highlights deep divisions within the parliament, raising questions about transparency, minority rights, and the legislative process.

The government has decided to withdraw the Waqf Properties (Eviction of Unauthorised Occupants) Bill, 2014, which was introduced in the Rajya Sabha in February 2014 under the Congress-led UPA government. The bill, scheduled for withdrawal from the Rajya Sabha on Thursday, pertains to the eviction of unauthorised occupants from waqf properties.

In addition to introducing the Waqf (Amendment) Bill, 2024, Rijiju will also present The Mussalman Wakf (Repeal) Bill, 2024, which aims to repeal the Mussalman Wakf Act of 1923. The Waqf (Amendment) Bill, 2024 proposes renaming the Waqf Act, 1995 to the Unified Waqf Management, Empowerment, Efficiency, and Development Act, 1995.

Key provisions of the Bill

The bill aims to define “waqf” as property held by individuals practicing Islam for at least five years and who have ownership of the property. It also seeks to ensure that establishing Waqf-alal-aulad does not exclude women from inheritance rights. Additionally, the bill proposes eliminating provisions related to “waqf by user,” transferring the responsibilities of the Survey Commissioner to the Collector or a designated officer of Deputy Collector rank for surveying waqf properties. It also calls for a more inclusive composition of the Central Waqf Council and State Waqf Boards, ensuring representation of both, Muslim women and non-Muslims.

The bill, as outlined in the statement of objects and reasons, aims to establish separate Boards of Auqaf for Boharas and Aghakhanis. It also seeks to ensure representation for Shia, Sunni, Bohra, Agakhani, and other marginalised groups within the Muslim communities. Additionally, the bill proposes streamlining waqf registration through a central portal and database and introduces a detailed process for property mutation according to revenue laws, including giving proper notice to all relevant parties before officially designating any property as waqf.

The bill aims to remove Section 40, which grants the Board the authority to determine whether a property is classified as waqf. It also proposes that mutawallis file waqf accounts with the Board via a central portal to enhance oversight of their activities. The bill includes plans to reform the Tribunal by reducing its membership to two members and allows for appeals against Tribunal decisions to be taken to the High Court within ninety days. According to sources, the Business Advisory Committee has decided that the Waqf Amendment Bill will be introduced in the Lok Sabha on Thursday. Opposition parties are advocating for the bill to be reviewed by the standing committee.
