Transgender Debate in Sports: Female Fencer Refuses to Compete, Faces Disqualification

There’s a new row in US athletics after female fencer Stephanie Turner was disqualified at a competition for refusing to face a transgender athlete. The move happened on March 30 at the Cherry Blossom D1A/Veteran Regional Open Circuit held at the University of Maryland.

Turner was to meet Redmond Sullivan, a trans athlete, in her scheduled match. Nevertheless, rather than begin the bout, she dropped to her knee in protest and would not fence. Due to this, referees gave her a black card, which sent her out of the tournament.

Turner subsequently clarified her decision, explaining that she wanted to ensure that her protest was seen.

“I saw that I was going to be in a pool with Redmond, and from there I said, ‘OK, let’s do it. I’m going to take the knee,'” Turner said to Fox News Digital. “I knew what I had to do because USA Fencing had not been listening to women’s objections regarding [its gender eligibility policy]”

Turner recounted her exchange with Sullivan at the time of her protest, “Redmond believed I was going to fence. So when I took the knee, I caught the eye of the ref and said, ‘I apologize, I can’t do this. I am a female, and he is a male, and it’s a women’s tournament. And I will not fence this man.'”

She also said Sullivan, at first thought, she might be hurt and came over to her in concern.

“Redmond didn’t hear me, and he comes up to me, and he thinks that I may be hurt, or he doesn’t understand what’s happening. He asks, ‘Are you OK?’ And I said, ‘I’m sorry. I have much love and respect for you, but I will not fence you.’”

USA Fencing Responds to the Disqualification

A USA Fencing spokesperson explained that Turner did not get disqualified for protesting the presence of a transgender athlete on the field but for not going on to the court to face an assigned match.

“In the case of Stephanie Turner, her disqualification was not related to any personal statement but was merely the direct result of her decision to decline to fence an eligible opponent, which the FIE rules clearly prohibit,” explained the spokesperson in an interview with Fox News.

USA Fencing referred to Article t.113 of the International Fencing Federation (FIE) Technical Rules, which provides that a fencer may not refuse to fence a duly entered opponent for any reason.

“According to the FIE (International Fencing Federation) Technical Rules, specifically Article t.113, a fencer is not permitted to refuse to fence another properly entered fencer for any reason. Under these rules, such a refusal results in disqualification and the corresponding sanctions. This policy exists to maintain fair competition standards and preserve the sport’s integrity,” the statement continued.

Tennis great Martina Navratilova, who has been critical of transgender athletes competing in women’s sports in the past, vocally condemned USA Fencing for penalizing Turner.

The notices were also extended to the head of the school in Jamnagar, Gujarat, and the chairperson of the private school in Khiri, Uttar Pradesh.

The petitioner alleges that her employment was terminated in both schools after her gender identity became known, emphasizing the challenge of pursuing remedies in two different high courts. The Supreme Court bench acknowledged the gravity of the situation and scheduled the plea for a detailed hearing after four weeks.

The counsel representing the transgender person provided insights into the unjust dismissals. In the Uttar Pradesh school, she was initially given a letter of appointment and taught for six days before being abruptly removed. Similarly, in the Gujarat school, the petitioner received an appointment letter but was subsequently denied the opportunity to join once her sexual identity was disclosed.

The core of the petitioner’s case revolves around the enforcement of her fundamental rights, asserting that the termination of her services based on her gender identity is a violation of these rights. Transgender Community Prays for Team India’s Victory in World Cup Final

As anticipation builds for the ODI World Cup 2023 final between India and Australia at Narendra Modi Stadium, members of the transgender community in Prayagraj performed prayers for the victory of the ‘Men in Blue.’ The vibrant display of support showcased the diverse ways in which fans are expressing their enthusiasm for the cricket extravaganza.

In addition to the prayers in Prayagraj, a ‘hawan’ was organised at Mumbai’s Madhavbaug Temple, where cricket enthusiasts gathered to pray for India’s success in the final match. Kerala makes history: Transgender students granted reservation in nursing courses

The Kerala government has decided to give transgender students who are enrolled in BSc nursing programs in their state reservations, which is a historic decision. “Transgender people have been given reservations in the nursing profession. Health Minister Veena George announced in a statement that one seat in the BSc nursing program and one seat in the general nursing program would be set aside for transgender students. For the first time ever, a reservation has been made for transgender people working in the nursing profession.

“This government is doing great work for the upliftment of the transgender community. In continuation of this, the representation of the transgender community will be ensured in the health sector as well”, added George.

The state government has been taking great initiatives for the upliftment of the marginalised community and the reservation in the nursing sector is part of such efforts.
“The reservation is envisaged to ensure the representation of the community members in the nursing sector as well,” the minister added.

Seeking Centre’s response on plea seeking separate vacancies for transgenders in public appointments: Delhi HC

The Delhi High Court in the case Jane Kaushik vs Lieutenant Governor, Nct Of Delhi and others observed and has seek response of the Central Government on a plea seeking notification of separate vacancies for transgender persons in public appointments which includes the teaching positions.

The bench headed by Justice Prathiba M Singh in the case impleaded Central Government’s Ministry of Home Affairs as a party to the plea moved by a transgender person and six weeks’ time has been granted for filing a reply.

Before the Court, it has been argued that there mere mention of ‘transgender’ as a separate gender in the application form would not be sufficient compliance of Transgender Persons (Protection of Rights) Act, 2019 as the persons would still being forced to apply in a vacancy, the vacancy is either being for male or for female candidates or for vacancies where no gender is being mentioned.

However, the petitioner had applied for recruitment in Delhi Subordinate Service Selection Board (DSSSB) and since 2019 the petitioner had been searching for employment in government schools since 2019.

The plea also seek framing of a policy for recruitm e nt o f t r a n s ge n d e r persons in all public appointments, apart from seeking implementation of provisions of Transgender Persons (Protection of Rights) Act, 2019 and its Rules.

The counsel appearing for the petitioner placed reliance in the decision taken by the Supreme Court in the case NALSA v. Union of India wherein recognising the rights of a transgender person.

Therefore, the petitioner’s grievance was that the vacancies advertised by DSSSB on 02.01.2020, mentioning the requirement of male or female genders. In relation of some posts, no identification of gender was mentioned.

It has been stated by DSSB in a response that now all three categories of genders, i.e. male, female and transgender, can apply for the posts on its online portal. It has also been argued by the counsel appearing for the petitioner that it would not be sufficient compliance of the law. Further, it has been submitted by the counsel before the court that the Delhi Government’s Department of Social Welfare has suggested to give age relaxation of 5 years and qualifying marks of 5 percent to transgender persons. Therefore, the letter dated 08.02.2021 was being addressed to Additional Chief Secretary was placed on record.

It has also been pointed out by the counsel appearing for the Delhi Government that the Department of Social Welfare has written to Under Secretary (UT) and Joint Secretary (UT) of Ministry of Home Affairs dated 02.03.2022 and 02.12.2021, with regard to implementation of the 2019 enactment.

The court has also directed the LG as well as Delhi Government’s Directorate of Education to place their stand on record in respect of the communications from Department of Social Welfare.

Therefore, the counsel appearing for the Delhi Government submitted that the Online Application Registration System facility allows a transgender to apply on DSSSB’s portal, the court stated that the the petitioner is free to apply under the category of transgender for the vacancies which the Petitioner deems appropriate wherein ignoring the gender mentioned qua the said vacancy.

Accordingly, the court listed the matter to be next heard on March 28. The court also stated that the petitioner may file applications for the vacancies in terms of this order, which shall be considered and processed by the court.

India’s first transgender judge wants reservation in government jobs

India’s first transgender Judge Joyita Mondal wants the government to reserve government jobs for her community.

Meanwhile, Mondal has demanded reservations in the police force and the railway that will change society’s outlook towards them and help in their advancement in life.

In the country her community also needs shelter homes in adequate numbers and for this government should launch a scheme said Mondal.

Talking to the media Mondal said, “It is very important to give reservation in government jobs to the transgender community. If I don’t have a job, who is going to feed me?”

Earlier on Friday Mondal attended a culture and literature festival, “Lit Chowk” and said, “If by virtue of reservation, transgender persons join the police force and the Railways, it will not only help community members march ahead in life but change society’s outlook towards them.”

However, Mondal further stated, towards her community members and authorities should be more sensitive as they face many issues.

However, in 2017 Mondal was appointed a judge in the Lok Adalat of Islampur in West Bengal and became the first person to hold such a post in the country from her community.

Furthermore, transgender activist Vidya Kamble in 2018 was appointed as a member judge in a Lok Adalat in Nagpur in Maharashtra. After this, Swati Bidhan Baruah also became the transgender judge and by this, the country got the third transgender judge.

MCD polls: Bobi wins from Sultanpuri, MCD to get first transgender councillor

Bobi, a transgender candidate for the Aam Aadmi Party (AAP), made history on Wednesday by winning the Sultanpuri-A ward in the MCD elections.

Following the significant victory, Bobi declared her desire to work for local development. She expressed her gratitude to everyone who had contributed to her historic victory.

“I want to dedicate my victory to the people who worked so hard for me. I would like to thank everyone. Now I just have to work for development in my area,” said Bobi.

Bobi contested the MCD polls in 2017 but did not seek enough votes.

Earlier on October 12, 2022, Bobi had filed a nomination. Speaking to the media, Bobi said, “I am grateful to Arvind Kejriwal for making me a candidate for the Aam Aadmi Party. Till now I was engaged in social service work at my level; now, after winning, I will work as a representative of my community.”
“I have been engaged in social service work since the time of Anna’s movement. So far, I have gotten 150 girls married, especially since I help all the disabled and helpless people who come. My aim is to win the election so that I can serve such people,” she had added.

She also aspires to help the people of the transgender community. She added, “I will also raise issues related to transgender people and help them. Most of the poor people live in my area, I will work for them. Today people are in favor of the Aam Aadmi Party, in Delhi BJP has given nothing except three garbage mountains in 15 years.”

When questioned about whether being transgender caused her any difficulties during the election campaign, Bobi responded, “There was no trouble in the campaign for me, people support us.”

With its victory in the Municipal Corporation of Delhi polls on Wednesday, the Aam Aadmi Party overthrew the Bharatiya Janata Party’s (BJP) 15-year reign of the city’s civic body.

Celebrations got underway at the Aam Aadmi Party office in the national capital well before the final results were announced because trends suggested that the party was likely to unseat the BJP in the MCD.

In front of the office, party members gathered and cheered, danced, and sang phrases honouring party leader Arvind Kejriwal.

In a closely contested contest, the BJP initially held the lead in the early trends for almost one and a half hours. However, the trends started to change as the AAP took the lead and kept it until the final results were announced.

Delhi Police arrests man for killing transgender partner to death

A man who allegedly killed a man and attacked a transgender has been arrested by Delhi Police. The arrested accused has been identified as Anil.

Earlier on Friday at Paharganj Police Station a PCR call was received regarding a fight with transgenders.

According to the police, “On reaching the spot, blood was seen everywhere on the floor and it came to light from a lady that the accused, who has been identified as Anil, came to the first floor of the building, where Sunita, the transgender lived with Guddu, and two other transgenders.”

“Anil started scuffling with Sunita and Gudu and during the scuffle, he attacked them with a knife. Due to this, the injury was caused to Sunita on the back and Gudu on his neck. Both the injured were taken to hospital by one neighbor and accused Anil was apprehended from the spot by the police staff. Later, information was received from the hospital that Gudu died during the treatment,” Police stated.

Meanwhile, during the police interrogation accused said he came into contact with Sunita in 2020 and started living together but Sunita left him after taking Rs. 40000. Later she started living at Multani Dhandha with Guddu.

“Anil was furious due to the same and used to threaten Sunita. On Friday, he came to the residence of Sunita and started fighting to return Rs. 40000 and during the fight, attacked them with a knife,” stated the police.

Moreover, the knife used in the killing and the blood-stained clothes of the accused have been recovered by the police.

However, further investigation into the matter is underway.
