</excerpt>

As the counting of votes for the Delhi Assembly elections continues, initial trends suggest that the Bharatiya Janata Party (BJP) is moving towards a majority. Aam Aadmi Party (AAP) is trailing behind. Amid all these developments, AAP’s Rajya Sabha MP, Swati Maliwal, has stirred a controversy with her recent social media post using a powerful Mahabharat reference to target her party.

pic.twitter.com/kig39RQYmD

— Swati Maliwal (@SwatiJaiHind) February 8, 2025

Swati Maliwal’s Mahabharat Reference

Swati Maliwal has been vocal in raising all the issues that are there among the common mass of Delhi. All through the election campaign, she continually criticized the AAP government for not being able to meet the expectations of the people. Now, with the election results taking shape, Maliwal has once again expressed her displeasure with the way her party had handled matters.

Maliwal recently posted an image of the disrobing scene of Draupadi from Mahabharat on social media. No caption, but a clear symbolic message was sent. The humiliation of Draupadi in the image was seen by many as a direct jab at AAP’s governance.

The fact that she posted an image rather than words has conveyed the strength of her displeasure. Comparing the scenario with one such famous episode of Mahabharat where Draupadi was insulted in court seems to have sent across a message of this AAP government also having experienced something of this kind.

A Tense Moment in Delhi Politics

The internal squabbles within AAP over Maliwal’s social media post have raised eyebrows at the time when AAP seems to be unable to catch up with the BJP in electoral results. The vote count continues, and it is expected to finalize the results soon, but the Delhi political climate remains charged, and an anathema statement from Maliwal added fuel to the fire.

The case with AAP is going to get tougher and tougher as more leaders express their dissatisfaction, with the BJP in a strong position to garner its majority.

</excerpt>

Rajya Sabha MP Swati Maliwal has launched a sharp attack on the Aam Aadmi Party (AAP) over its decision to appoint Atishi as the new Chief Minister of Delhi. Maliwal claimed that Atishi’s family had fought to prevent the execution of convicted terrorist Afzal Guru, who was hanged in 2013 for his involvement in the 2001 Parliament attack.

Maliwal’s remarks followed Tuesday’s rapid political developments in Delhi, where AAP’s MLAs held a meeting and elected Atishi as their new legislative leader. This came after Delhi Chief Minister Arvind Kejriwal announced his intention to step down from the position, following his release on bail in the Delhi liquor policy case. Kejriwal has vowed not to return as Chief Minister until re-elected by the public.

Expressing her displeasure, Maliwal posted on social media, stating, “Today is a very sad day for Delhi.” She flagged concerns over Atishi’s family’s involvement in a 2013 mercy petition to save Afzal Guru from execution, which had been signed by several activists, including Atishi’s parents, Vijay Kumar Singh and Tripta Wahi.

Maliwal wrote, “A woman whose family fought a long battle to save terrorist Afzal Guru from being hanged is being made the Chief Minister of Delhi. According to them, Afzal Guru was innocent and framed in a political conspiracy.”

Raising concerns about national security, Maliwal suggested that Atishi could be a “dummy CM” and added, “This issue is related to the security of the country. May God protect Delhi!”

The 2013 petition, shared by Maliwal, urged then-President Pranab Mukherjee to halt Afzal Guru’s execution and requested a parliamentary inquiry into the case. An old video of Atishi’s mother, Tripta Wahi, has resurfaced, where she is heard saying, “We are unhappy that Afzal has been made, in our understanding, a scapegoat.”

In response, AAP MLA Dilip Pandey criticized Maliwal’s remarks and demanded her resignation from the Rajya Sabha. “Swati Maliwal goes to the Rajya Sabha on AAP’s support, but reads the BJP’s script. If she has even a little shame and morality left, she should resign,” said Pandey.

Atishi Becomes Delhi’s Next Chief Minister

On Tuesday, Atishi was chosen over Kailash Gahlot to succeed Arvind Kejriwal as Delhi’s Chief Minister. Her name was proposed by Kejriwal at the legislative party meeting, where AAP MLAs unanimously accepted the decision.

Born to Delhi University professors Vijay Kumar Singh and Tripta Wahi, the 43-year-old has been a prominent member of AAP since 2013. She gained widespread attention for her participation in the Jal Satyagraha in Madhya Pradesh in 2015. Currently the only woman in the Delhi Cabinet, Atishi holds 14 portfolios, including education, finance, and public works.

The political landscape in Delhi now awaits further developments as Atishi prepares to take over the helm from Kejriwal amidst ongoing controversies.

</excerpt>

In response to the nationwide outrage over the brutal rape and murder of a trainee doctor at RG Kar Medical College and Hospital in Kolkata, former Delhi Commission for Women chief Swati Maliwal has called on West Bengal Chief Minister Mamata Banerjee to impose the “strictest action” against the accused and those attempting to protect them.

In her letter to the West Bengal CM, Maliwal condemned the horrific crime, stating, “The inhuman atrocities inflicted upon this young woman have brought shame upon humanity and sparked widespread protests across the nation. As an advocate for women’s rights, I have been closely monitoring this case, and my revulsion only deepens with each new detail.”

Maliwal highlighted serious concerns arising from media reports, including delays in notifying the victim’s family and issues surrounding the investigation. “The post-mortem report indicates the assault occurred between 3 am and 5 am on August 9, yet the first notification to the family was significantly delayed,” she noted.

The former DCW chief also pointed out troubling aspects such as the denial of access to the body, the failure to promptly file an FIR, and misleading attempts to label the case as a “suicide.” Additionally, she criticized the recent transfer of the principal and the Calcutta High Court’s remarks about possible evidence tampering at the crime scene, which have fueled suspicions.

Maliwal further condemned the incident where a mob stormed RG Medical Hospital, damaging the emergency wing. She described this as “blatant hooliganism” that not only destroyed public property but also may have intimidated vital witnesses. The lack of police protection for such a critical site, especially following a heinous crime, underscores severe concerns about the state of law and order, according to Maliwal.

In her letter, Maliwal urged CM Banerjee to transcend “political expediency” and ensure the harshest penalties for those involved in crimes against women and children. She also called for full cooperation with the CBI to guarantee a thorough investigation and to hold accountable those who attempted to cover up the crime and shield the accused.

On August 9, the body of a post-graduate trainee doctor was discovered in the seminar hall of RG Kar Medical College and Hospital in Kolkata. Allegations of rape and murder have sparked nationwide protests by doctors and medical communities.

</excerpt>

The Delhi High Court dismissed Bibhav Kumar’s plea challenging his arrest by the Delhi Police in connection with the assault case involving Rajya Sabha MP Swati Maliwal. The decision was made by Justice Neena Bansal Krishna on Friday.

Kumar, a close aide to Delhi Chief Minister Arvind Kejriwal, argued that his arrest was illegal as it was made without a prior notice under Section 41A of the Criminal Procedure Code, which mandates that the police issue a notice to the accused before making an arrest. Kumar’s legal team contended that there was no urgency justifying his arrest, especially since he had indicated his willingness to cooperate with the investigation.

Senior advocate N. Hariharan, representing Kumar, claimed that the FIR was filed with a three-day delay, and that Kumar had been picked up without proper legal procedure. He argued that the arrest was made hastily, despite Kumar’s readiness to cooperate.

In response, Senior Advocate Sanjay Jain, representing the Delhi Police, argued that the arrest was justified based on evidence indicating tampering with evidence. Jain explained that Kumar’s phone was formatted and certain video recordings were missing, which led to the decision to arrest him.

The Delhi Police had arrested Kumar on May 18, following an FIR in the Swati Maliwal assault case. Kumar’s plea also sought compensation for the alleged illegal arrest and called for departmental action against the officials involved in the arrest decision. The High Court, however, upheld the legality of the arrest.

</excerpt>

New Delhi: AAP MP Swati Maliwal has sharply condemned the delay in holding accountable those responsible for the deaths of three UPSC aspirants at a coaching institute in West Delhi’s Old Rajinder Nagar. Maliwal decried the incident as “murder” rather than an accident, demanding immediate action against the involved officials.

Maliwal criticized the lack of response from Delhi’s government ministers, the Municipal Corporation of Delhi’s mayor, and other officials, who failed to address the situation even hours after the tragedy. She called for an FIR to be filed against these high-ranking officials and stressed the need for compensation of Rs 1 crore for the victims’ families.

“The students, who come from various parts of India with high hopes and dreams, faced a tragic end due to sheer negligence,” Maliwal said. “The absence of any immediate response from the authorities is unacceptable. This is not a disaster; it’s murder.”

AAP MLA Durgesh Pathak also condemned the incident, calling it a “criminal activity” and urging a thorough inquiry and strict action against those responsible. He criticized the BJP for past failures in maintaining Delhi’s drainage system but emphasized the need for accountability beyond party lines.

Delhi BJP Chief Virendra Sachdeva demanded an inquiry into the alleged corruption within the Delhi government and Municipal Corporation, questioning why the drainage issues were not addressed earlier.

In response to the incident, Delhi Police have arrested the owner and coordinator of the IAS coaching centre, where the flood occurred, leading to the tragic deaths of Shreya Yadav, Tanya Soni, and Nivin Dalwin. The bodies have been sent for autopsy, and investigations are ongoing.

The tragedy follows a recent incident where another UPSC aspirant was electrocuted on a waterlogged street in Delhi, highlighting ongoing concerns over safety and infrastructure in the city.

</excerpt>

The Bharatiya Janata Party (BJP) accused the ruling Aam Aadmi Party (AAP) for the deaths of three civil service aspirants who drowned in the waterlogged basement of their coaching facility in Delhi’s Old Rajinder Nagar. Virendra Sachdeva, the Delhi BJP president, termed the occurrence as murder.

“This is not an incident but a murder. Students come to Delhi to make their future, but they have become a victims of corruption. Nobody is answering how the library was established in the basement. There was an incident in Mukherjee Nagar, the Delhi government launched an investigation. What has happened to the investigation? Delhi Minister has still not reached the spot. The locals were asking for cleaning of drainage. Whoever is responsible should be punished. What is the fault of the students?” he stated.

Durgesh Pathak, an AAP MLA, blamed the incident on the BJP.

“The water has receded now but enough is enough… This is a completely criminal activity, strict action should be taken against the officials who are responsible… Desilting (of the drain) was done but still, there should be an inquiry and if someone is responsible, strict action should be taken… Delhi’s drainage system has collapsed and the reason for this is that the BJP was in power for 15 years. We have been here for the last year and are working on the drains, but I do not want to get into any blame game, I want it to be investigated and strict action should be taken against whoever is responsible,” he said.

DCP M Harshavardhan stated that three bodies have been retrieved during the rescue effort. The deceased have been named as Shreya Yadav from Uttar Pradesh, Tanya Soni from Telangana, and Nivin Dalwin from Ernakulam, Kerala. The police have filed a case under sections 105, 106 (1), 115 (2), 290 and 35 of the BNS.

“This case is against the coaching institute and the management of the building and those who were responsible for the maintenance of the drain of that place…so far we have detained the owner and coordinator of that coaching centre…further investigation underway,” he stated.

Swati Maliwal, an AAP MP, requested a compensation of ₹1 crore for the relatives of the deceased.

“This isn’t a natural disaster. It’s a murder. FIR should be registered and strict actions should be taken against those who are involved in this. ₹1 crore compensation should be given to the families of the students who lost their lives. Delhi government Ministers conduct press conferences in AC rooms. Delhi Mayor earlier asked people to enjoy the monsoon. Is this enjoyment? There is anger among students. They have been sitting here since last night but no one yet came to meet them,” stated Swati Maliwal.

She asked that Delhi’s ministries and Mayor Shelly Oberoi apologize to the country.

</excerpt>

New Delhi: Nilesh Rai, a 26-year-old UPSC aspirant, died of electrocution near Patel Nagar metro station in West Delhi on Monday. The incident drew criticism from both the opposition and ruling party members. The Bharatiya Janata Party (BPJ) declared, “We will not remain silent on this injustice; we demand justice.” BJP leader Manjinder Singh Sirsa stated, “This is not an accident; it is a murder caused by the insensitivity and inadequacy of the Kejriwal government.”

A police official reported that the student was electrocuted after touching an iron gate that had electricity running through it, which was exacerbated by waterlogging on the road. The official added that his body was found hanging from the iron gate of his nearby paying guest accommodation. He was immediately rushed to RML Hospital, where doctors declared him dead.

The incident drew criticism from both opposition and ruling party members. BJP leader Manjinder Singh Sirsa took to the social media platform X, stating, “A promising UPSC aspirant tragically lost his life due to the negligence and incompetence of the Kejriwal government.” He further alleged, “We will not remain silent on this injustice; we demand justice. This is not an accident; it is a murder caused by the insensitivity and inadequacy of the government.”

Meanwhile, AAP leader and Rajya Sabha MP Swati Maliwal described the incident as a murder rather than an accident, attributing it to the failure of the government system. In a social media post on X, she questioned, “What answer will the parents of that child receive for his death while walking on the road? Do the lives of ordinary citizens have no value?” She further called for an FIR to be filed and for immediate action to be taken against those responsible.

The Bharatiya Janata Party (BJP) has strongly criticized Delhi Chief Minister Arvind Kejriwal and the Aam Aadmi Party (AAP) following Assault Allegations made by AAP’s Rajya Sabha MP Swati Maliwal against the CM’s aide.

Bansuri Swaraj, a BJP leader, condemned the incident, stating that if the Assault Allegations are true and Kejriwal’s Officer on Special Duty (OSD) indeed assaulted and misbehaved with Swati Maliwal in the presence of the Delhi CM, it reflects poorly on Kejriwal’s leadership. Swaraj, who is also the BJP Lok Sabha candidate from New Delhi constituency, emphasized that such behavior is shameful, questioning Kejriwal’s ability to ensure the safety of women in Delhi.

Union Minister Anurag Thakur weighed in on the matter, highlighting concerns about the internal affairs of the AAP and the safety of women within the party. Thakur suggested that tensions within the AAP might escalate further, especially with the involvement of more members from the party’s leadership.

Meanwhile, Swati Maliwal visited the Civil Lines police station on Monday to report the alleged misconduct by a member of Kejriwal’s personal staff. Despite making PCR calls and raising the issue, no formal complaint has been filed yet.

Former Delhi Congress chief Arvinder Singh Lovely also criticized the AAP, questioning their ability to ensure national security when they cannot guarantee the safety of their own officials in government accommodations.

The incident has sparked concerns about the internal dynamics of the AAP and the safety of women under its leadership, prompting calls for accountability and action within the party.

</excerpt>

The Delhi High Court on Friday declined to consider a public interest litigation (PIL) aimed at preventing the media from revealing the name of AAP Rajya Sabha MP Swati Maliwal in reports concerning her assault case, as well as from disclosing the contents of the FIR.

A division bench, including Acting Chief Justice Manmohan and Justice Manmeet PS Arora, criticized the petitioner, lawyer Sanser Pal Singh, suggesting that the plea had political motivations. The court questioned Singh’s standing in filing the PIL, noting that Maliwal herself has been discussing the case with media outlets.

“There is a political hue in this petition. It is very, very apparent. You have done this only for publicity,” remarked the bench.

Following these comments, Singh withdrew the plea.

Swati Maliwal had filed a written complaint with the Delhi Police alleging that Bibhav Kumar, a close aide of Chief Minister Arvind Kejriwal, assaulted her during a visit to Kejriwal’s residence on May 13. Kumar was subsequently arrested on May 18.

Singh’s grievance was directed at media outlets ETV Bharat, Gujarat Samachar, and India Today, along with social media platforms Meta, X, and WhatsApp. He claimed that the FIR was being publicly circulated via these channels, newspapers, and social media.

“Disclosing the name along with the contents of such FIR certainly lowers down the dignity of a woman. In the present case, this act has been deliberately done by the respondent no. 5 to 10 and did not even care for the law and judgments/guidelines of this Hon’ble Court and the Hon’ble Apex court in this regard,” Singh’s plea stated.

The PIL also sought directives for the Union Government, Delhi Government, and media and social media platforms to refrain from revealing the name, address, or other identities of victims in sensitive cases such as rape or molestation.

</excerpt>

Swati Maliwal, an AAP MP, expressed concerns about her safety and that of her family if bail is granted to Bibhav Kumar, an aide to Delhi Chief Minister Arvind Kejriwal and the main accused in Maliwal’s assault allegations. Maliwal made these statements during a hearing on Kumar’s bail plea. She accused AAP of victim-shaming and alleged that the party’s social media machinery was being used against her.

Maliwal, a former chairperson of the Delhi Commission for Women, accused Kumar of assaulting her during a visit to the Chief Minister’s residence on May 13. While AAP initially acknowledged the incident and stated that Kumar would face consequences, they later accused Maliwal of being part of a BJP conspiracy against Kejriwal.

During the court proceedings, Kumar’s counsel questioned the Delhi Police’s investigation and alleged that Maliwal trespassed into the Chief Minister’s residence. They also questioned the delay in Maliwal filing a police complaint and the addition of certain IPC sections in the FIR.

The Delhi Police, opposing Kumar’s bail plea, argued that intent is not required in cases of assault, especially if the victim’s modesty is outraged. They questioned AAP’s allegations against Maliwal and highlighted Kumar’s termination from service by the vigilance department due to a previous case.

Swati Maliwal expressed fear for her safety if Kumar is granted bail, citing threats she has received. She criticized Kejriwal for associating with Kumar and accused AAP of orchestrating a campaign against her.

The court has reserved its judgment on Kumar’s bail plea until 4 pm. Kejriwal has not directly commented on Maliwal’s allegations but has suggested that Kumar’s arrest is part of a BJP conspiracy against AAP.

</excerpt>

Aam Aadmi Party (AAP) Rajya Sabha MP Swati Maliwal on Sunday claimed that she has been receiving rape and death threats following a ‘character assassination’ campaign allegedly orchestrated by AAP leaders and volunteers.

She further accused YouTuber Dhruv Rathee of further escalating the hate campaign by posting a ‘one-sided’ video against her.

The AAP MP said that her party officials had been victim shaming and character assassinating her while releasing multiple screenshots of violent remarks and rape threats she had received on social media on her X handle.

“After the leaders and volunteers of my party i.e. AAP orchestrated a campaign of character assassination, victim shaming and fanning of emotions against me, I have been getting rape and death threats. This got further exacerbated when YouTuber @Dhruv_Rathee posted a one-sided video against me,” Maliwal said in the X post.

The former head of the Delhi Commission for Women (DCW) also asserted that she is being intimidated by the party leadership into dropping her complaint against Bibhav Kumar, an advisor to Delhi chief minister Arvind Kejriwal.

Maliwal also voiced her dissatisfaction with the YouTuber, claiming that she tried to get in touch with him and tell her side of the tale, but he didn’t return her calls or texts. She further charged Rathee with being an AAP spokesman who poses as an independent journalist while victimizing the person.

“As far as the party leadership goes, it is very clear that they are trying to intimidate me into withdrawing my complaint. However, for Dhruv, I tried my best to reach out to him to tell him my version but he ignored my calls and messages. It is shameful that people like him, who claim to be independent journalists could act like other AAP spokespersons and victim shame me to the extent that I am now facing extreme abuses and threats,” she added.

The AAP MP further listed the facts and asked Rathee why he failed to mention that AAP took a U-turn after accepting that the incident happened or talk about her MLC (medicolegal case) report that reveals injuries due to the assault in his 2.5-minute-video.

Maliwal said,”Facts that he failed to mention in his 2.5 minute video against me –

1. Party took a U-turn on its stand after accepting the incident has happened.

2. MLC report that reveals injuries due to the assault.

3. Selected part of the video was released and then phone of the accused was formatted?

4. The accused was arrested from the crime scene (CM house). Why was he allowed to enter the place again? For tampering of evidence?

5. How a woman who always stood for the right issues, even went to Manipur alone without security could be bought over by the BJP?” she added.

Finally, Maliwal announced that she is reporting these death threats and rapes to Delhi Police and asked that the offenders face severe consequences.

“The manner in which the entire party machinery and its supporters have attempted to vilify and shame me speaks volumes about their stand on women’s issues. I am reporting these rape and death threats to @DelhiPolice. I hope they take strong action against the perpetrators,” Maliwal said.

The AAP lawmaker has accused Bibhav Kumar of physically torturing and manhandling her. She alleged that Kumar slapped her seven to eight times, ‘kicked on the chest, stomach, and pelvis area,’ and threatened to kill her when she went to meet Kejriwal at his official residence.

The AAP has denied the allegations, claiming that Maliwal is being “blackmailed” by the BJP to become part of their conspiracy.

Kumar was arrested by the Delhi Police on Saturday after being booked under Sections 354 (assault or use of criminal force on woman with intent to disrobe), 506 (criminal intimidation), 509 (word, gesture, or act intended to insult the modesty of a woman), and 323 (voluntarily causing hurt)of the Indian Penal Code (IPC). He is in judicial custody till May 28.

“It is a very big day for democracy. I want to appeal to everyone, especially women, to come out and cast their votes,” said Maliwal after casting her vote in Delhi.

The AAP has been under scrutiny since Maliwal accused Arvind Kejriwal’s former personal secretary, Bibhav Kumar, of assaulting her at the Delhi Chief Minister’s residence on May 13. Maliwal filed a complaint against Bibhav Kumar on May 14, and he lodged a counter-complaint accusing Maliwal of gaining unauthorized entry into the CM’s residence and verbally abusing him. Bibhav Kumar was arrested by the Delhi Police on May 19 and is currently in custody.

The sixth phase of the Lok Sabha elections is underway across 58 parliamentary constituencies in six states and two Union Territories. In Delhi, AAP and Congress, part of the INDIA bloc, are challenging the BJP, which won all seven Lok Sabha seats in the city in the last two elections. While Congress is contesting three seats, AAP is contesting four in Delhi.

Over 11.13 crore voters, including 5.84 crore males, 5.29 crore females, and 5120 third gender electors, are eligible to vote in this phase. Around 11.4 lakh polling officials are involved in conducting the election.

</excerpt>

AAP MP and former DCW chairperson, Swati Maliwal, has refuted claims that Bibhav Kumar, an aide to CM Kejriwal, assaulted her on May 13. Maliwal asserted that the incident followed her refusal to vacate her Rajya Sabha seat to facilitate the party leadership’s plans to appoint another individual who has significantly aided Kejriwal. Despite pressure, Maliwal remains steadfast in her decision not to resign.

In her first detailed statement since the alleged assault, Swati Maliwal addressed accusations of character assassination and victim-shaming, attributing these to efforts by her party to force her resignation. “If they had politely requested my Rajya Sabha seat, I would have considered it. The way they have treated me, I will not resign no matter what,” Maliwal told ANI. “I am determined to continue my work as the youngest woman Parliamentarian and strive to become an exemplary leader.”

Recounting the events, Maliwal alleged that while she was in the drawing room of the CM’s residence, Bibhav Kumar approached her aggressively. When she informed him she was waiting for the CM, Kumar allegedly began shouting and hurling abuses, calling her a “neech aurat” (vile woman) and slapped her multiple times. Despite her pleas for help, no one intervened, Maliwal claimed.

Describing Kumar as a powerful figure within the party, Maliwal highlighted his significant influence and the fear he instills. “He is not an ordinary PA; his house is more luxurious than any minister’s. There is already an assault case against him,” she noted. Maliwal emphasized that Kumar’s anger could spell the end of anyone’s career in the party.

Maliwal expressed her shock at the lack of support from Sunita Kejriwal and Minister Atishi, accusing them of victim-shaming. Drawing parallels with the Nirbhaya case, Maliwal criticized Atishi for making dismissive remarks about the absence of visible injuries. “This is the worst kind of victim-shaming. I never claimed in my FIR that my clothes were torn or that my head was wounded. I documented exactly what happened. I am willing to take a polygraph test to prove my truth,” she stated.

Feeling isolated by her party, Maliwal has called for a “free and fair investigation” by the Delhi Police. In a tweet, Maliwal alleged that there is immense pressure on party members to speak negatively about her and that those who support her are being threatened with expulsion. She described an orchestrated effort involving press conferences, tweets, and fake sting operations to discredit her.

Swati Maliwal asserted that while the party may mobilize against her, she remains steadfast, relying on the truth. “I am not angry with them; the accused is a very powerful man. Even the biggest leaders are afraid of him. No one has the courage to take a stand against him. I don’t expect anything from anyone. I feel sad that the woman minister of Delhi is smilingly maligning the character of an old female colleague of the party,” she added. She vowed to continue her fight for self-respect and justice despite being alone in her struggle.

Kumar is accused in the alleged assault case involving Maliwal. He was taken to Mumbai on Tuesday to recover data from his phone, which police suspect was formatted before his arrest. Kumar remains in five-day police custody, during which his phone, laptop, and CCTV footage from Kejriwal’s residence are being examined for evidence. His custody is set to end on Thursday, prompting officials to expedite the evidence-gathering process.

On Tuesday, the Delhi Police escorted Bibhav Kumar, an assistant to Delhi Chief Minister Arvind Kejriwal, to the airport. He departed for Mumbai to conduct an investigation into the assault case concerning AAP MP Swati Maliwal.

Subsequently, the police arrested Kumar in connection with the assault case involving Swati Maliwal, after detaining him at the CM’s residence. Delhi’s Tis Hazari Court later remanded Kumar to a five-day police custody, citing concerns over the accused’s formatting of a mobile phone and the absence of crucial video footage.

In response, Kejriwal denounced the arrest as a “Jail ka Khel” orchestrated by the Prime Minister, alleging a political vendetta against AAP. Consequently, AAP leaders, including Kejriwal, announced plans to protest at the BJP headquarters, condemning the arrest and threatening further arrests of AAP members.

Meanwhile, Maliwal lamented the disappearance of evidence and criticized the lack of support from her party.
Issuing a statement from Delhi’s Raj Niwas, Saxena claimed that Maliwal had previously called him to discuss her “traumatic experience” due to “sheer anguish.”

He further disclosed, that during their interaction, Swati maliwal recounted the intimidation and shaming she was subjected to by her own colleagues.

What Happened in the Case So Far

Meanwhile, Swati maliwal has accused Kejriwal’s aide Bibhav Kumar of kicking and slapping her several times in the drawing room of CM’s house.

However, Aam Aadmi party are supporting Bibhav kumar, claiming that Maliwal had barged into the house without any appointment.

Later, AAP also claimed, she is working on BJP’s orders to harm Kejriwal.

Moreover, the party has also released various CCTV clips in relation to this incident. Claiming, that Swati Maliwal is walking normally in the video after the alleged assault.

But today, the Bhartiya Janata Party has recently responded to AAP’s claim, questioning how swati maliwal entered the premises without prior appointment, despite the presence of Z plus security.

</excerpt>

Amid the intensifying political conflict between the ruling Aam Aadmi Party (AAP) and the Bharatiya Janata Party (BJP) over the arrest of Chief Minister Arvind Kejriwal’s former aide, new developments have emerged in the alleged assault case involving Rajya Sabha MP Swati Maliwal. Delhi Police sources revealed on Sunday that they are considering adding charges for the destruction of evidence to the case.

The decision follows accusations by Maliwal, former chairperson of the Delhi Commission for Women (DCW), that Bibhav Kumar, the arrested aide, deleted crucial CCTV footage from the CM’s Civil Lines residence. Maliwal claims this footage would have conclusively proven her allegations of assault.

Sources within the Delhi Police disclosed that Kumar, who was arrested on Saturday, has not been cooperating with the investigation. He was produced before the Tis Hazari Court, which remanded him in police custody for five days. Kumar is accused of assaulting Maliwal and is being interrogated for further leads.

Investigators suspect that Kumar may have disposed of or reformatted relevant phone data in Mumbai. They plan to take him there to attempt data retrieval with the assistance of forensic experts. Additionally, Kumar might be taken to the CM’s Civil Lines residence in Delhi to clarify the circumstances surrounding the alleged altercation.

On Saturday, Metropolitan Magistrate Gaurav Goyal authorized five days of police custody for Kumar, who is scheduled to be presented in court again on May 23. Kumar faces charges under several IPC sections, including 308 (attempt to commit culpable homicide), 354B (assault with intent to disrobe), 341 (wrongful restraint), 506 (criminal intimidation), and 509 (insulting the modesty of a woman).

In response to Kumar’s arrest, CM Kejriwal accused the BJP of engaging in a “Jail Ka Khel” (game of incarcerating leaders) against the AAP. He announced plans to lead a “Jail Bharo” march to the BJP headquarters on Sunday, accompanied by top party leaders and supporters.

Ahead of the AAP protest, Delhi Police implemented extensive security measures around the BJP’s national headquarters. A traffic advisory warned of potential congestion on DDU Marg, IP Marg, Minto Road, and Vikas Marg, indicating that DDU Marg might be closed to traffic between 11 am and 2 pm.

Maliwal’s complaint detailed the alleged assault, claiming that Kumar “slapped” her “at least seven to eight times,” “brutally dragged” her, and “kicked” her in the “chest, stomach, and pelvis area” while she “continued screaming.”

The situation continues to unfold, with the political and legal ramifications of the incident remaining a focal point of public and media attention.

As per insiders from the Delhi Police, investigators are considering transporting Bibhav to Mumbai due to suspicions that he discarded or erased crucial phone data in the city before reformatting it. Following this, the Delhi Police is considering adding the section for destruction of evidence in this case.

The recent event occurred shortly after the AAP leader and former head of the Delhi Commission for Women (DCW) accused Bibhav of erasing segments of the CCTV footage from the CM’s Civil Lines residence. These segments would have unequivocally proven his guilt. Meanwhile, Bhibav Kumar wasn’t cooperating with the ongoing probe. The police will attempt to recover the phone data with assistance from forensic specialists. Additionally, Kejriwal’s previous associate might be escorted to the CM’s Civil Lines residence in Delhi to ascertain the precise cause of the ‘fight’.

Maliwal, in her complaint, alleged that Kejriwal’s former personal secretary “slapped” her “at least seven to eight times” while she “continued screaming” and “brutally dragged” her while “kicking” her in her “chest, stomach, and pelvis area.” Bibhav was booked under IPC sections 308 (attempt to commit culpable homicide), 354B (assault or use of criminal force on a woman with intent to disrobe), 341 (punishment for wrongful restraint), 506 (punishment for criminal intimidation), and 509 (word, gesture, or act intended to insult the modesty of a woman).

Metropolitan Magistrate Gaurav Goyal remanded Bibhav to five days of police custody for further questioning in this case. </excerpt>

Launching a blistering attack on Bhartiya Janata Party, Arvind Kejriwal said, that his party doesn’t fear being arrested and their ideas will continue to live, even if they are gone.

Ahead of the protest, Arvind Kejriwal declared “You arrest all of us and then see if AAP gets destroyed or gets bigger.”

He further declared that he along with his MLAs and MPs will march towards BJP’s office, so that the Prime minister can send anybody to jail he wants.

“I along with my MLAs and MPs will go to the BJP office so that the Prime Minister can send anyone he wants to jail. said Kejriwal.

Operation Jhaadu

Earlier at the meeting, Arvind Kejriwal also declared, that BJP has started Operation Jhaadu, alleging, they don’t want them to grow and challenge them.

He also said, through this operation, the party accounts will get frozen, and their prominent leaders will be arrested in the days to come.

“ED’s lawyer has already given this statement in court that soon after the election AAP’s bank accounts will be frozen, he said that if they freeze our account now, we will get sympathy…after election, they will freeze our accounts, our office will be cleared out and we will be brought to streets. These are the three plans made by BJP.” said Kejriwal.

Meanwhile, another AAP Leader Saurabh Bhardwaj also echoed the same sentiments, alleging conspiracy against the party and spoke

“All our big leaders are being thrown behind bars. Though Arvind Kejriwal is out on bail for 22 days, they are conspiring every day to frame us in false cases and put more of our leaders behind bars. If Prime Minister Modi thinks he can crush and finish off the AAP by putting our leaders in jail, he is mistaken. We are gathering outside the BJP headquarters at noon today. Instead of throwing our leaders in jail one after the other, let them arrest us all at once. said Saurabh Bhardwaj to ANI.

Meanwhile, Rajya Sabha MP Swati Maliwal earlier lodged complaint against Kejriwal’s aide Bibhav Kumar, which subsequently lead to his arrest and detention on Saturday.

Later, talking about the arrest, Kejriwal said “”They are after our party and sending our leaders in jail one after another… Today you have sent my PA (Bibhav Kumar) to jail.”

</excerpt>

Amid a significant political confrontation over the arrest of Chief Minister Arvind Kejriwal’s former aide in connection with the alleged assault on AAP Rajya Sabha MP Swati Maliwal, Delhi Police detained several AAP workers on Sunday. The detentions occurred as they marched towards the BJP headquarters in a planned ‘Jail Bharo’ protest.

CM Kejriwal, decrying the arrest of his former aide, accused the BJP at the Centre of playing a ‘Jail Ka Khel’ (game of imprisoning leaders) against his party. He announced on Saturday that he would lead the ‘Jail Bharo’ march to the BJP headquarters, accompanied by top party leaders and workers.

Delhi Central DCP Harsha Vardhan Mandava, speaking to ANI, stated, “Based on information received through social media and other channels, we have made preventive arrangements on DDU Marg to maintain law and order. We are committed to ensuring adequate security deployments, with barricades in place to prevent any disruptions.”

He further informed that Section 144 has been imposed on DDU Marg, prohibiting any protests in the area. Earlier in the day, extensive security measures were implemented outside the BJP headquarters in anticipation of the AAP protest.

The Delhi Traffic Police issued an advisory ahead of the AAP protest, warning of potential traffic snarls on DDU Marg, IP Marg, Minto Road, and Vikas Marg. They advised commuters to avoid these areas, noting that DDU Marg might remain closed to traffic between 11 am and 2 pm.

The controversy began with the arrest of Kejriwal’s former personal assistant on Saturday in connection with the alleged assault on Swati Maliwal. The accused was produced before the Tis Hazari Court, which remanded him in police custody for five days.

In response to the arrest, Kejriwal released a video statement, accusing the BJP of targeting AAP leaders. “They are putting our leaders behind bars one after another. They have jailed me, Manish Sisodia, Satyendra Jain, and Sanjay Singh. Now they have arrested my former PA. They are threatening to jail Raghav Chadha, Atishi, and Saurabh Bharadwaj next. Perhaps our fault was building schools, mohalla clinics, and providing free electricity, which they failed to accomplish. Tomorrow, I will lead a march to the BJP headquarters with all my top leaders, MLAs, and MPs at noon. You can put whoever you want in jail,” Kejriwal said.

Last month, the Vigilance Department terminated Bibhav’s service as the CM’s personal assistant over a pending criminal case. The ongoing political drama highlights the escalating tensions between AAP and the BJP in the national capital.

Bibhav Kumar was picked up at the CM’s residence and arrested in connection with the assault case on Saturday. He was later sent to a five-day police custody by Delhi’s Tis Hazari Court.

“There was a time when we all came out on the streets to get justice for Nirbhaya. Today, after 12 years, we are out on the streets to save the accused who made the CCTV footage disappear and formatted the phone?” Swati Maliwal wrote in a post on X (formally Twitter) in Hindi.

“I wish we had made such as an effort for Manish Sisodia ji. If he had been here, maybe this wouldn’t have happened to me!” Swati Maliwal, who has alleged that Bibhav Kumar slapped her seven-eight times, “kicked on the chest, stomach and pelvis area”, said.

The AAP leader Arvind Kejriwal announced on Saturday that he and other politicians would visit the BJP headquarters on May 19 “so that the prime minister can send anyone he wishes to jail”.

Hours after his aide Bibhav Kumar was arrested in connection with the alleged assault on his party’s parliamentarian Swati Maliwal, he claimed at a press briefing that the BJP is saying they will send AAP MP Raghav Chadha, who had just returned from the UK, and Delhi ministers Atishi and Saurabh Bharadwaj to jail too.

On Saturday night, Swati Maliwal said that modified films were being disseminated and that the CCTV evidence of the incident on May 13—when she was reportedly beaten at Chief Minister Arvind Kejriwal’s residence—had “disappeared.”

“Bibhav gave me a severe beating at first. He kicked and slapped me. He went outside, contacted security, and began filming as soon as I got free and dialed 112. “I was yelling and telling the security that Bibhav had given me a brutal beating,” asserted Maliwal.

“The lengthy section of the film has been altered. It was only after I got tired of notifying the security that a 50-second video was made public.

“Now that the phone has been formatted, the entire video has been removed? The CCTV footage has vanished as well.

This is the height of conspiracy,” she said in a post on X in Hindi.

Earlier on Saturday, Arvind Kejriwal announced, that he along with other AAP leaders, would march towards BJP’s headquarters on May 19. saying “so that the prime minister can send anyone he wishes to jail”.

Later addressing Press conference after his PA Bibhav Kumar’s arrest in connection with Maliwal’s assault, he declared, that they along with Atishi and Saurabh Bharadwaj, will send Uk returned Raghav Chadha to Jail too.

What Has Happened In the Case So Far?

Meanwhile, the accused Bibhav Kumar has been picked up from CM’s house and has been arrested in regard to assault’s case on Saturday.

Later, he was also sent to Five-day police custody, after being presented in Delhi’s Tis Hazari Court.

Moreover, Maliwal also accused, that May 13 CCTV footages (In which she was assaulted) has disappeared and only edited videos are being released.

Taking to X, she said “”First I was thrashed brutally by Bibhav. He slapped and kicked me. When I freed myself and called 112, he went outside, called security personnel and started making a video. I was shouting and telling the security that Bibhav has thrashed me brutally…. that long portion of the video has been edited. Only a 50-second video was released when I was fed up of telling the security.

“Now the phone has been formatted and the full video deleted? The CCTV footage has also disappeared. This is the height of conspiracy.” said Maliwal in hindi.

The purported video shows Swati Maliwal being escorted by security personnel out of the chief minister’s house.

In the footage, the AAP says that on May 13, Swati Maliwal was seen walking limp-free and composed with the security guards. She was seen limping in another footage, according to AAP. Four days after the incident, the party accused Swati Maliwal of “acting to limp”.

Maliwal was allegedly walking alone, according to the party. The party said that given the specifics of the alleged assault as stated in the FIR, she would not have been able to walk by herself. In the video, the party inquired, “What is this game?”

— AAP (@AamAadmiParty) May 18, 2024

The AAP has already released two videos regarding the alleged assault. At Arvind Kejriwal’s house, Swati Maliwal got into a fight with the security guards in the previous video.

“On May 13, she made the assault charges. A video from the CM’s home on May 13th appeared online, showing her sitting on the couch and giving orders to others. In that video, she didn’t appear to be a victim. But in the video from yesterday, she was limping. The paradox is here, AAP spokesperson Saurabh Bharadwaj told PTI.

He claimed that as part of a plot against Arvind Kejriwal and the AAP, Swati Maliwal was in contact with BJP leaders.

“Senior leaders of the BJP are in contact with her… Delhi CM’s residence has CCTV cameras. Delhi Police will get the footage today or tomorrow… Till now, it seems her version of the story is not true,” he added.

Bibhav Kumar, Kejriwal’s secretary, has come under fire from Swati Maliwal for allegedly beating her up in the chief minister of Delhi’s drawing room. She said he kicked her in the stomach and repeatedly slapped her. A case has been filed by the police against Kumar.

In a complaint, Bibhav Kumar also states that she entered Kejriwal’s home without permission and mistreated him with the intention of assaulting him. He has refuted reports that he hit the AAP MP.

According to the AAP, Maliwal was targeting Kejriwal at the BJP’s request. Atishi, an AAP leader, asserted today that the BJP is utilizing her as a pawn.

</excerpt>

AAP Rajya Sabha MP Swati Maliwal, who alleged being assaulted by Delhi Chief Minister Arvind Kejriwal’s personal secretary Bibhav Kumar, has reportedly suffered bruises over her left leg and right cheek, as per the Medico-legal Case (MLC) report. The report, issued after Maliwal’s examination at the Jai Prakash Narayan Apex Trauma Centre at AIIMS Delhi on May 16, indicates a bruise measuring 3×2 centimeters on her “proximal left leg dorsal aspect” and another bruise of 2×2 centimeters below her right eye.

Earlier, an FIR was lodged by Delhi Police following Maliwal’s complaint against Kejriwal’s aide. In her complaint, Maliwal alleged that Bibhav Kumar “slapped” her “at least seven to eight times,” “brutally dragged” her, and “kicked” her in the “chest, stomach, and pelvis area.”

The FIR details the events of May 13 when Maliwal went to Chief Minister Kejriwal’s residence. “I went inside the camp office and called CM’s PS Bibhav Kumar but I could not go in. I then sent a message to his mobile number (through WhatsApp). However, there was no response. I then went inside the residential area through the main door as I have always done in the past year since Bibhav Kumar was not present I entered the residence area and informed the staff present there to tell the CM here to meet him,” the FIR read.

“I was informed that he was present in the house and I was told to wait in the drawing room. I went into the drawing room sat on the sofa and waited for him to meet me,” Maliwal said.

“One of the staff members came and told me that CM was coming to meet me and suddenly, the PS of CM, Bibhav Kumar barged into the room. He started screaming without any provocation and even started abusing me. I was stunned by this….and I reacted by telling him to stop talking to me like this and to call the CM,” her statement read.

“He then abused me and asked who are you to not listen to what I say. While saying these words, he came and stood right in front of me. Without any provocation whatsoever on my side, he started slapping me with full force. He slapped me seven to eight times at least while I continued screaming. I felt absolutely shocked and was screaming for help over and over again. In order to protect myself I pushed him away with my legs,” she said.

“At that time, he pounced on me, brutally dragged me and deliberately pulled my shirt up. My shirt buttons opened and my shirt flew up. I landed on the floor while hitting my head on the centre table. I was constantly screaming for help but no one came. After that, Bibhav Kumar did not relent and attacked me by kicking me in my chest, stomach and pelvis area with his legs. I was in extreme pain and kept telling him to stop. My shirt was coming up but he continued to assault me,” the AAP MP said.

The FIR has been filed under IPC Sections 308 (Attempt to commit culpable homicide), 341 (Punishment for wrongful restraint), 354B (Assault or use of criminal force to woman with intent to disrobe), 506 (Punishment for criminal intimidation), and 509 (Word, gesture or act intended to insult the modesty of a woman).

</excerpt>

Delhi Chief Minister Arvind Kejriwal needs to come clear on allegations being leveled against his personal secretary Bibhav Kumar, by Rajya Sabha MP, Swati Maliwal, that she had been assaulted by him, when she visited the AAP Supremo’s residence on Monday. The issue has snowballed into a major controversy, and could impact the AAP’s chances in the Lok Sabha polls in the national capital.

Swati, who was the Chairperson of the Delhi Commission of Women till very recently, has lodged a formal complaint with the police, and underwent a medical examination on Thursday to press her charges. A case against Bibhav Kumar under multiple sections has been registered, and his version of the incident is not known till now. Swati had accused Bibhav of physically assaulting her when she was in the living room of the Chief Minister and wanted to meet him. She had called the PCR after the alleged beating and even went to the Civil Lines police station but did not lodge any report.

While Swati has urged the BJP not to make a political issue of this matter, the immediate provocation on Thursday to make a formal complaint with the police was when Bibhav Kumar was seen accompanying the Chief Minister to Lucknow, for a joint meeting with Samajwadi Party Chief Akhilesh Yadav.

At one stage it appeared that the issue was being hushed up following assurance to Swati by her Rajya Sabha colleague, Sanjay Singh that the Chief Minister had taken cognizance of the incident and would accordingly take appropriate action against the suspect, who is for practical purposes, his Man Friday. Swati continues to be livid but has so far not spoken on the subject in public and is probably waiting for Kejriwal to speak first.

The entire issue has raised questions about the functioning of the AAP and the fact that an assault on a senior member of the party at the Chief Minister’s house, has gone unaddressed by the top functionaries, is not a good reflection on their working, particularly in the election season.

Those who have been following AAP affairs would recall that Swati Maliwal and Bibhav Kumar have been associated with Arvind Kejriwal since 2007, much before the India against Corruption movement was launched under the leadership of Anna Hazare. To begin with Swati was opposed to the formation of AAP but later overcame her thinking to once again work alongside her mentor and boss, Kejriwal.

There has been a history of differences between her and Bibhav Kumar in the past, but the assault is something which has come as a surprise for the cadres, and is perceived to be highly condemnable. The issue could have been resolved had Kejriwal intervened to understand the provocation for the assault, which in any case is unjustified.

The dilemma before the CM was apparently that he is over dependent on Bibhav Kumar, and by taking him along with him to Lucknow, he gave a signal, which was interpreted as his preference for his PA over his Rajya Sabha MP.

It needs to be pointed out here that a strong resentment had been building up in AAP against its Rajya Sabha MPs, most of whom have not risen to the occasion, when Kejriwal was arrested and jailed. Swati Maliwal had apparently gone abroad and was conspicuous by her absence as was Raghav Chadha, who has undergone a complicated eye surgery in London. Other Rajya Sabha MPs, particularly from Punjab like Harbhajan Singh, Vikramjit Singh Sawhney and Ashok Kumar Mittal, the founder and Chancellor of the Lovely Professional University have kept themselves away from the AAP agitation against Kejriwal’s arrest.

Sources said that when Swati had come to meet Kejriwal at his home, there was a hostile reception for her. The assault allegedly took place soon after, and thus the issue was brought out in the public domain. While Sanjay Singh has tried to do some firefighting, it is most unlikely that Swati Maliwal at this juncture would either withdraw or dilute her complaint. Therefore, Bibhav Kumar’s arrest in the matter is not ruled out.

The incident has cast a shadow over the Delhi Lok Sabha elections where the BJP was struggling, but is certain to cash in on these differences within the AAP. The AAP-Congress alliance in the capital is viewed as being formidable but there are already fissures that are visible.

The AAP for instance, has moved out all its key players from the constituencies which the Congress is contesting and put them in the seats where the party has put up nominees. There are some AAP elected representatives who are active in the Congress areas but they are not too prominent.

While at one stage, the AAP-Congress combination was looking at winning all the seven seats of the capital, there are enough reasons to revise this assessment. The AAP is doing well in West Delhi and in South Delhi, but is trying to find its feet in New Delhi and East Delhi. The Congress is involved in a fierce contest in North East Delhi and North West Delhi and in Chandni Chowk, its nominee, veteran leader Jai Prakash Aggarwal is making inroads.

However, the Swati Maliwal episode has given enough reason for the alliance partners to worry, and it is to be seen how the matter would die down before May 25th since the BJP would keep the issue alive.

</excerpt>

The recent allegation of Swati Maliwal being assaulted at Delhi CM Kejriwal’s residence has added to the political troubles faced by the Aam Aadmi Party (AAP) and has also created a dilemma for the Congress party, especially ahead of the Lok Sabha elections. While Priyanka Gandhi has addressed the issue, other Congress leaders have chosen to remain silent, indicating the complexity of the situation. The registration of the case by the police has intensified the matter, with emerging reports suggesting that Kejriwal’s challenges will only escalate further.

This development is expected to impact the remaining phases of the elections, especially in key constituencies like Rae Bareli and Amethi. In Amethi, senior BJP leader Smriti Irani is likely to capitalize on the issue, potentially influencing voter sentiments.

AAP finds itself embroiled in the Maliwal case, with conflicting statements from party leaders further complicating the situation. While Sanjay Singh acknowledged misconduct against Swati Maliwal, AAP leader Atishi accused the BJP of orchestrating the entire affair. Kejriwal’s absence from the meeting with Swati, despite their close association, raises questions, especially given Swati’s senior position within the party.

The unfolding developments in the Maliwal case are expected to become a significant issue in the upcoming elections, particularly in states like Uttar Pradesh, Delhi, and Punjab. The BJP is likely to leverage this matter to target both AAP and Congress, with a focus on states where elections are underway.

Congress is taking steps to distance itself from AAP, indicating that it may campaign independently in Delhi. However, concerns remain, especially in Punjab and other states where both parties are contesting. As campaigning intensifies in Rae Bareli and Amethi, political tensions are expected to escalate further, particularly in Delhi and Punjab.
