</excerpt>

In a major development related to the Swati Maliwal case, Delhi HC declares Arvind Kejriwal’s aide Bibhav Kumar plea maintainable on Monday.

This plea challenges the arrest of Kumar made in connection with swati maliwal assault case. Following Justice Swaran Kanta Sharma’s judgement, a notice was issued to Delhi police.

Meanwhile Delhi Police’s Advocate Sanjay Jain opposed Kumar’s plea on the grounds that he did not disclose his previous plea to trial court, which was later rejected.

But Kumar in his plea alleged that his arrest violates section 41A of CrPC (notice to appearance before police officer).

Earlier, Bibhav Kumar was arrested on May 18 in connection with maliwal’s assault case. Following his arrest, he was sent to Police custody for 5 days magistrate court.

Later on May 24, he was sent to judicial custody for four days. After that, he was sent to police custody for three days.

Also an FIR is also lodged against Kumar under appropriate sections of IPC (Indian Penal Code) which include charges like criminal intimidation, assault or culpable homicide etc.

</excerpt>

The Delhi High Court is set to issue a ruling on July 1, 2024, regarding the maintainability of a petition filed by Bibhav Kumar, a close associate of Arvind Kejriwal, requesting that his arrest by the Delhi Police be declared illegal.

After extensive arguments, the bench of Justice Swarna Kanta Sharma reserved the order on the issue of maintainability on May 31, 2024.

Appearing for Bibhav Kumar, Senior Advocate N Hariharan submitted that, “I (Bibhav Kumar) put an anticipatory bail, while around 4:00-4:30, it is being heard, I am arrested around 4:15. If the arrest is happening in such a fashion, then the court must intervene. My fundamental right to be arrested in such a fashion was exploited, so I am here. You flouted the 41A procedure”.

Senior Advocate Sanjay Jain, representing Delhi Police, stated that their petition is not maintainable. The accused argued that arrest guidelines were violated, moving a separate application before the trial court. The Magistrate concluded that reasons for the urgent arrest were mentioned, leading to an order on May 20th, which should be taken seriously.

He said, “This order can be revised within 90 days by filing a revision application, but they skipped this step and approached us directly.”

Bibhav’s plea also sought compensation for his alleged illegal arrest, claiming it violated the law. It called for departmental action against the unknown officials involved in the arrest decision.

Trial Court further said, “The investigation is still at the nascent stage and the apprehension of influencing the witnesses or tampering with the evidence cannot be ruled out. Keeping in view the allegations made against the applicant, at this stage, no ground for bail is made out.”

” The allegations raised by the victim have to be taken at their face value and cannot be swiped away. The mere delay in registering the FIR would not have much impact on the case as the injuries are apparent in the MLC after four days. There seems to be no pre-meditation on the part of the victim as if it would have been so, then the FIR would have been registered on the same day,” said the court.

The applicant was found at the CM’s house despite termination, the court noted. The investigating agency reported the applicant formatted his mobile and withheld the password. CCTV footage from the CM’s camp office was also found blank, according to the order.

The judge noted that the complainant was medically examined at AIIMS Hospital on 16.05.2024, and her statement under section 164 Cr.P.C. was recorded by the Metropolitan Magistrate. Her complaint was corroborated by the medical report and her statement under section 164 of the Cr. PC.

The trial court denied Bibhav’s bail petition, citing the early stage of the investigation and concerns about potential witness tampering and evidence tampering. They also stated that Bibhav Kumar was included in the investigation but did not cooperate, leading to his arrest to prevent tampering with crucial evidence.

Kumar is accused of assaulting AAP Rajya Sabha MP Swati Maliwal on May 13 at the chief minister’s official residence. The decision to extend his custody was made during a hearing conducted through video conferencing before Metropolitan Magistrate Gaurav Goyal.

Kumar was arrested on May 18 and initially placed in police custody for five days. Despite his anticipatory bail plea becoming infructuous due to his arrest, he was remanded in custody following a magisterial court’s ruling.

Subsequently, on May 24, he was transferred to judicial custody for four days before being returned to police custody for an additional three days. An FIR was filed against Kumar on May 16, citing various sections of the Indian Penal Code related to criminal intimidation, assault, and attempt to commit culpable homicide.

Maliwal accused Bibhav Kumar of repeatedly hitting her with “full force” during the incident on May 13, alleging that he slapped her 7-8 times and kicked her in the chest and abdomen when she visited the chief minister.

</excerpt>

A court here on Friday remanded Chief Minister Arvind Kejriwal’s aide Bibhav Kumar in judicial custody for 14 days, saying the investigation was still at a nascent stage and completing it would require time. Kumar, personal assistant to Kejriwal, allegedly assaulted AAP Rajya Sabha MP Swati Maliwal at the chief minister’s official residence on May 13.

“I feel that investigation is at nascent stage and would require time to complete the investigation. In view of the submissions made by both the parties and facts of the case, accused Bibhav Kumar be remanded to judicial custody for 14 days and be produced on June 14,” Metropolitan Magistrate Gaurav Goyal said.

Additional Public Prosecutor Atul Srivastava submitted an application seeking judicial custody for Kumar for conducting a “proper investigation” and to prevent the accused from tampering with evidence or making any threat or inducement to the witnesses.

Karan Sharma, the counsel for Kumar, opposed the Delhi Police’s plea.

Meanwhile, the Delhi High Court has reserved its order on the maintainability of Kumar’s plea challenging his arrest.

Earlier on Monday, Kumar’s bail plea was dismissed by a sessions court which said there appeared to be no “pre-meditation” by Maliwal in lodging the FIR and that her allegations could not be “swiped away”.

Kumar was arrested on May 18. He was sent to police custody for five days the same day by a magisterial court which observed that his anticipatory bail plea had become infructuous because of his arrest.

He was sent to four-day judicial custody last Friday.

The FIR against Kumar was registered on May 16 under various Indian Penal Code provisions, including for criminal intimidation, assault or criminal force on a woman with the intent to disrobe her and attempt to commit culpable homicide.

</excerpt>

Bibhav Kumar, an aide to the Chief Minister, was sent to 14-day judicial custody by Delhi’s Tis Hazari court regarding the alleged assault on Aam Aadmi Party (AAP) MP Swati Maliwal. Kumar appeared in court after the three-day police custody granted on May 28 expired. He had been arrested by Delhi Police on May 18 in this case.

Metropolitan Magistrate Gaurav Goyal has ordered that Bibhav Kumar be held in judicial custody until his next court appearance on June 14. This decision follows a request from the Delhi Police for a 14-day judicial custody of Bibhav Kumar after questioning.

The Additional Public Prosecutor (APP) argued that the accused’s judicial custody is necessary for a thorough investigation, to prevent tampering with evidence, and to avoid any attempts at influencing witnesses through inducement or threats.

Defense counsels Rajat Bhardwaj and Karan Sharma opposed the judicial custody plea. They submitted that the accused is in no position to interfere with an investigation or tampering with the evidence. It was also stated, “I (Bibhav Kumar) am in no position to induce the witnesses.”

On May 28, APP Atul Srivastava stated that the accused formatted his phone and didn’t share the password. Police received a forensic expert’s interim report on CCTV footage, showing the accused entering the DVR area for 20 minutes, raising concerns of evidence tampering. The complainant also mentioned the accused recording the incident with two phones.

Defense counsel Rajiv Mohan argued against the allegations, pointing out the delay in filing a complaint, lack of medical evidence, and timing of the FIR leading to the accused’s arrest. He claimed police fabrication of evidence to obtain a favorable statement. The absence of CCTV footage was highlighted.

The defense emphasized no weapon involvement, the potential retrieval of mobile data, and the accused’s right not to share their password. They deemed the FIR simple and questioned its interpretation by the prosecution, also challenging the phone’s admissibility without a forensic report.

The defense argued that examining the accused scientifically doesn’t need custody; further custody requires strong justification as there’s no material to confront them with. However, the prosecution countered, citing an interim forensic report on footage blanks, alleging tampering due to the accused’s possession of two mobiles, including a second one.

</excerpt>

The Delhi High Court has reserved its order on the maintainability plea filed by Arvind Kejriwal’s aide Bibhav Kumar on Friday.

Through his plea, Bibhav Kumar challenged his arrest regarding Swati Maliwal’s assault case at CM’s house in the previous month.

Further, he has also asked for directions to declare its arrest illegal, emphasizing, it is a violation of section 41A provisions under code of criminal procedure.

But, Police’s lawyer has opposed the petitioner’s plea on the grounds, that it’s not maintainable.

Later, the senior counsel also asserted, that the objection regarding section 41A (notice of appearance before police officer) has already been dismissed by the trial court. Thus, contending that petitioner should file revision order against the verdict rather than a writ petition.

However, bibhav kumar’s lawyer emphasized, that his arrest violates fundamental rights of an individual and is against the law.

Furthermore, Kumar’s counsel argued, that there was neither reason nor necessity for the arrest, emphasizing that an individual’s liberty cannot be taken lightly.

In the petition, kumar also stated, that he was arrested with an “oblique motive”, even though his anticipatory bail is still pending in trial court.

He has also asked for “appropriate compensation” for his illegal arrest and actions against those officials, who were involved in the decision-making of the arrest.

Later, after hearing both the sides, Justice Swarna Kanta Sharma, reserved the order, saying “Order reserved on maintainability.”

Earlier on Monday, kumar’s bail plea was rejected by sessions court, asserting there was no ‘pre meditation’ in swati maliwal to register an FIR and her allegations could not be ignored.

What has happened In Swati Maliwal Case So Far?

On May 18, Arvind Kejriwal’s aide, Bibhav Kumar, was arrested and subsequently remanded to five days of police custody by a magisterial court, which noted that his anticipatory bail had become ineffective due to his arrest.

</excerpt>

The Delhi High Court on Friday declined to consider a public interest litigation (PIL) aimed at preventing the media from revealing the name of AAP Rajya Sabha MP Swati Maliwal in reports concerning her assault case, as well as from disclosing the contents of the FIR.

A division bench, including Acting Chief Justice Manmohan and Justice Manmeet PS Arora, criticized the petitioner, lawyer Sanser Pal Singh, suggesting that the plea had political motivations. The court questioned Singh’s standing in filing the PIL, noting that Maliwal herself has been discussing the case with media outlets.

“There is a political hue in this petition. It is very, very apparent. You have done this only for publicity,” remarked the bench.

Following these comments, Singh withdrew the plea.

Swati Maliwal had filed a written complaint with the Delhi Police alleging that Bibhav Kumar, a close aide of Chief Minister Arvind Kejriwal, assaulted her during a visit to Kejriwal’s residence on May 13. Kumar was subsequently arrested on May 18.

Singh’s grievance was directed at media outlets ETV Bharat, Gujarat Samachar, and India Today, along with social media platforms Meta, X, and WhatsApp. He claimed that the FIR was being publicly circulated via these channels, newspapers, and social media.

“Disclosing the name along with the contents of such FIR certainly lowers down the dignity of a woman. In the present case, this act has been deliberately done by the respondent no. 5 to 10 and did not even care for the law and judgments/guidelines of this Hon’ble Court and the Hon’ble Apex court in this regard,” Singh’s plea stated.

The PIL also sought directives for the Union Government, Delhi Government, and media and social media platforms to refrain from revealing the name, address, or other identities of victims in sensitive cases such as rape or molestation.

Kumar, a close aide of Delhi Chief Minister Arvind Kejriwal, filed a plea seeking the declaration of his arrest by Delhi Police as illegal, citing violations of Section 41A of the Code of Criminal Procedure.

The plea also requests appropriate compensation for the unlawful arrest and urges departmental action against officials involved in the decision-making process leading to the arrest.

The trial court recently denied bail to Bibhav Kumar, citing concerns about potential witness influence and evidence tampering, as the investigation is still in its early stages. The court noted Kumar’s presence at the CM’s house after his termination from employment and mentioned issues with accessing his mobile phone data and blank CCTV footage from the CM’s office.

During arguments, the complainant’s counsel emphasized Swati Maliwal’s status as an AAP MP and highlighted the severity of her injuries, indicating a long association with the CM’s office and alleging brutal assault by Kumar.

</excerpt>

The bail application of Bibhav Kumar, a former aide to Delhi Chief Minister Arvind Kejriwal, was dismissed by Tis Hazari court on Monday. Kumar stands accused in the assault case involving Rajya Sabha MP Swati Maliwal. Scheduled for a court appearance tomorrow, Kumar has completed four days of judicial custody. The dismissal came after Senior Advocate N Hariharan, representing Kumar, presented arguments countered by Additional Public Prosecutor Atul Srivastava and advocate Madhav Khurana, representing Maliwal.

Following extensive arguments, the court reserved its decision on Kumar’s bail plea. Maliwal, present at the hearing, opposed the bail, citing threats she had received and became emotional during the proceedings. Delhi Police initially opposed the bail, stating it was not filed in the appropriate court, a claim Hariharan contested, citing jurisdiction and the nature of the charges under Section 308 IPC.

Hariharan argued that Maliwal’s actions lacked permission or appointment and disputed the allegations outlined in the FIR, emphasizing the lack of contemporaneous complaint. He also questioned the severity of the injuries and the circumstances surrounding the incident. Despite assertions of self-inflicted injuries and lack of evidence, Srivastava opposed bail, emphasizing the seriousness of the charges and the impact on Maliwal’s reputation.

Khurana, representing Maliwal, highlighted her right to be heard and the delay in filing the FIR, stressing the significance of the injuries. He also referenced previous incidents involving Kumar and argued against his innocence, pointing to actions taken post-incident, such as phone formatting and complaint filing. Maliwal herself addressed the court, expressing concerns over her safety and alleging political influence on the case.

In rebuttal, Hariharan maintained that the charges did not align with culpable homicide, emphasizing the lack of evidence.

</excerpt>

Swati Maliwal, a Rajya Sabha MP, has stated that she has no intention of leaving the Aam Aadmi Party (AAP) because the party is not the property of a select few individuals. In an interview with The Indian Express, Maliwal addressed the recent incident where she alleged assault by Arvind Kejriwal’s personal assistant, Bibhav Kumar, during a meeting with the Delhi chief minister at his residence on May 13. She mentioned that no one from the Bharatiya Janata Party (BJP) reached out to her following the incident.

“If I was not speaking the truth, maybe (relations between her and the party could have been mended)… Despite being beaten up so badly, I tried to compose myself because there was a larger election underway and I knew this issue would be politicised. I understand it. I tried to control myself, but no way… They have harmed the entire women’s movement by victim shaming. I will stay in the party because it does not belong to two or three people. I have given it my sweat and blood too,” The Indian Express quoted Swati Maliwal as saying.

Former Delhi Commission for Women chief Swati Maliwal noted that the only person who spoke to her after the incident was Delhi Lieutenant Governor VK Saxena, but she acknowledged his position as a constitutional authority. Maliwal mentioned that he inquired about the situation and asked if she encountered any difficulties in her interactions with the police.

In a different interview with Hindustan Times, Swati Maliwal stated on Sunday that she has no plans to resign from the Aam Aadmi Party (AAP). She further asserted that she was warned that if she were to file a complaint regarding the incident, she would be labeled as a Bharatiya Janata Party (BJP) agent.

Requests for comments on the allegations made by Swati Maliwal were left unanswered by the AAP. In response, Bibhav Kumar filed a counter-complaint, alleging that Maliwal forcefully entered the CM’s premises and used abusive language.

“I left my job as an engineer in 2006… I was a full-time volunteer with Arvind Kejriwal. I was a core committee member of the Anna (Hazare) movement… My blood and sweat went into the foundation of the party… I was made MP because of my hard work and dedication… I want to make it clear that I did not have any personal animosity with anyone at the party. Delhi Police will investigate why I was assaulted and at whose behest,” she said.

Maliwal also claimed that Arvind Kejriwal had not called her so far. “The situation would have been different to the extent that at least to my mind, I would have been sure that he was not involved. I would have still filed a (police) complaint. That relationship would have remained intact and I would have liked to know what he thinks. Today I am not giving anyone a clean chit,” IE quoted the AAP MP as saying.

Bibhav Kumar has filed a bail plea in a Delhi court, prompting the court to request a response from the Delhi Police. Kumar’s legal representatives submitted the plea after he was remanded to judicial custody for four days last Friday. The court reviewed the plea on Monday.

Earlier, Kumar’s anticipatory bail plea was deemed “infructuous” by the court. According to Delhi Police, Kumar has been uncooperative during the investigation, providing evasive answers, and refusing to disclose his mobile phone password.

There is a call for action by the Delhi Police, and the Delhi CM is urged to clarify the source of threats against her.

Swati Maliwal attended Bibhav Kumar’s bail hearing at Tis Hazari Court in Delhi on Monday. On May 13, she visited Delhi Chief Minister Arvind Kejriwal’s residence around 9 am, waiting in the drawing room to meet Kejriwal. During this time, Kejriwal’s PA, Bibhav Kumar, entered aggressively and slapped Maliwal multiple times, around 7 to 8 times. Despite her resistance, Kumar continued to assault her, causing her to hit her head on a center table and fall to the floor. Maliwal cried for help, but no one intervened as Kumar continued his assault.

She further said that she is not aware whether she was beaten on the instructions of anyone or by himself or of his own accord and that this is all a matter of investigation.

Previously, at a shared media briefing alongside Samajwadi Party Chief Akhilesh Yadav, Kejriwal chose not to address the Swati Maliwal assault case and moved the microphone away.

</excerpt>

AAP MP Swati Maliwal arrived at Delhi’s Tis Hazari court for the bail hearing of Delhi CM’s aide, Bibhav Kumar. Senior advocate N Hariharan asserted the maintainability of the bail application, emphasizing the court’s jurisdiction.

Hearing underway for Bibhav Kumar’s bail plea in Swati Maliwal’s case. Here’s his counsel’s statement so far:

The ongoing hearing in Swati Maliwal’s case against Arvind Kejriwal’s aide, Bibhav Kumar, has seen arguments from his counsel. The FIR invoked Section 308 IPC, triable by the Court of Session. Senior advocate Hariharan contended that Maliwal visited the CM’s residence and contacted the PA, but Kumar was absent. He questioned Maliwal’s entry into the CM’s residence, arguing against such access to an official premises.

Bibhav Kumar’s counsel accused Maliwal of premeditated actions before entering the CM’s residence, highlighting her lack of mention about being called by the CM. He questioned whether being an MP granted permission for such actions and cited security statements regarding her entry.

The senior advocate argued that there was trespass and a report was filed, emphasizing Maliwal’s lack of appointment or prior notification of her visit. He referred to a report where Maliwal questioned security personnel about keeping an MP waiting and stated that she waited in the waiting room, asking security to speak to Bibhav Kumar.

The advocate contended that Maliwal’s claims in the FIR were false and not based on an immediate complaint, as the FIR was lodged three days later. He questioned the credibility of the allegations given the presence of many people at the alleged incident location and argued against the severity of the charges, citing the absence of grievous injury or intention to disrobe.

During the defence counsel’s argument, Maliwal broke down. The senior advocate argued that the FIR was an afterthought and reiterated their request for bail rather than acquittal.

CCTV has already been recovered, so there is no question of tempering, sr. Advocate. My (Bibhav) availability to police investigation is from the very beginning, sr. Advocate argued.

Everything is pre-planned and tailor-made to suit her story, sr. Advocate argued. It was an overreach by the prosecution preventing this court from passing an order on anticipatory bail, sr. Advocate submitted. They informed about the arrest when the court was dictating the order, he added.

He has been in custody since May 18, sr. Advocate concluded his arguments. Additional Public Prosecutor Atul Srivastava begins his arguments

Intention is not required to make out a case of Culpable homicide not amounting to murder, knowledge is sufficient, additional public prosecutor (APP) Atul Srivastava submitted.

The accused had beaten a lady who was alone dragged her and her head hit the centre table, will this not cause a death, APP argued If I slap a lady in an open place, it is outraging the modesty of a woman, APP argued.

Additional Public Prosecutor (APP) opposed the submissions of defence counsel that she went there with a premeditated mind to malign Bibhav Kumar.

Her reputation was kept in high esteem by the party chief and was called ‘Lady Singham’, APP submitted. The accused was terminated from his post, APP submitted.

Additional Public Prosecutor (APP) opposed the submissions of defence counsel that she went there with a premeditated mind to malign Bibhav Kumar.

Her reputation was kept in high esteem by the party chief and was called ‘Lady Singham’, APP submitted. The accused was terminated from his post, APP submitted

The accused did not tell the complainant that he was not in service and couldn’t arrange the meeting with the CM. It shows the intention on the part of the accused. There was no occasion earlier when she was asked to take a prior appointment, APP submitted.

Whyn’t the security officer make a call to PCR, APP argued. She was allowed to sit in the waiting room. It was implied permission, where is the question of trespass, APP submitted. When Bibhav Kumar reached there, he asked who allowed her to go inside, APP submitted

All the people at the place of occurrence were reporting to Bibhav Kumar. It shows that he is influential. He can temper the evidence, APP argued

Section 308 (Culpable Homicide not amounting to murder) IPC is made out against the accused, APP submitted. He added that the complainant was taken to AIIMS as she was residing at CR Park, Additional Public Prosecutor (APP) argued.

She (Swati Maliwal) was not maligning the accused, Additional Public Prosecutor (APP) said On the point of delay in FIR, the APP submitted that the complainant did not disclose the entire incident to the police. Even thereafter, police officer visited the place of incident.

In India women are very reluctant to report sexual offences, the Additional Public Prosecutor (APP) argued.

CCTV footage may be missing due to some technical reasons, APP submitted. The court asked, Why police are looking into the phone of the accused? iPhone was handed over after formatting, it is tempering, APP submitted

The accused went to Mumbai to format his phone. We may ask for further police custody. I strongly opposed the bail application, APP submitted Sr. Advocate N Hariharan opposed and said the counsel for the complainant couldn’t address the court. Advocate Madhav Khurana, counsel for Swati Maliwal arguing now Advocate Madhav Khurana is referring to judgement on whether he can address the court or not. He submitted that the victim has the right to be heard.

Bail application can’t be heard without issuing a notice to the victim, Khurana argued. Swati Maliwal is also standing with her counsel before the judge. He submitted that she said that she was going inside, you could call the police. But the police were not called. As per the MLC, the injuries were there even after four days, which shows the magnitude. Three-four days delay is inconsequential in these cases, her Advocate argued. The accused sent a complaint through email on May 17, Advocate Khurana submitted.

The accused was found at the place of occurrence, he was interrogated but was evasive in answering, advocate Khurana said.

He also submitted that the accused allegedly assaulted a public servant earlier. If the accused is innocent, then why format his phone, tempered the CCTV, file a complaint on May 17, Advocate Khurana said.

The complainant is receiving rape and murder threats, advocate Khurana argued.

Triple test not satisfied in this case, Khurana argued Swati Maliwal is addressing the court. She said after recording my statement APP leaders organised a press conference. I was called a BJP agent.

They have a huge troll machinery, they have pumped the machinery, she said. The accused was taken to Mumbai by the leaders of the party. If this accused is released on bail there would be a threat to me and my family

He is not an ordinary man, he uses the facilities used by the ministers, Maliwal said

There are no ingredients to make out the offence of Culpable homicide not amounting to murder, Sr. Hariharan rebutted He added that the DVR had been seized by the police, which is not in my complaint. There is no evidence that I tempered the CCTV.

Swati Maliwal assault case: The court reserves the order on bail of Bibhav Kumar

The proceedings are ongoing, awaiting further developments.

Defence counsel Advocate Rajiv Mohan told the Daily Guardian that “We moved an application under Section 165 to provide the list of search and seized items to the magistrate.He (Bibhav Kumar) has been sent to judicial custody for four days. </excerpt>

Aam Aadmi Party’s Rajya Sabha MP, Swati Maliwal, stated in an interview with ANI that she would not resign from her Rajya Sabha seat despite any pressure to do so. She emphasized her dedication to her position and her lack of desire for power. Maliwal highlighted her long-standing commitment to public service since 2006, even amidst adversity. Despite facing challenges and character attacks, she affirmed her resolve to continue serving.

Responding to questions about power dynamics within the party, Maliwal remarked on the rise of egos over the years. She reminisced about the earlier days of unity and enthusiasm among members, contrasting it with the current environment marked by ego clashes. Maliwal expressed disappointment over the treatment she received, including physical assault and character assassination, indicating a deterioration in values within the party.

In January of the same year, Maliwal, representing the Aam Aadmi Party, was elected to the Rajya Sabha unopposed. Regarding allegations of assault against a former aide of Chief Minister Arvind Kejriwal, Maliwal’s complaint led to the formation of a Special Investigation Team (SIT) and the arrest of the accused. Despite the gravity of the situation, Maliwal criticized the silence of AAP’s leadership, particularly Chief Minister Kejriwal, on matters concerning women’s safety, implying a lack of prioritization of such issues within the party.

</excerpt>

Following reports that Delhi Chief Minister Arvind Kejriwal’s parents would be questioned by the Delhi Police in Swati Maliwal’s assault case, the Aam Aadmi Party leader appealed to Prime Minister Narendra Modi, urging him not to involve his elderly parents in their disputes. Kejriwal emphasized that the fight is between him and the Prime Minister, not his parents.

In a video message, Kejriwal expressed his distress over the targeting of his aged parents, highlighting his mother’s illness and his father’s advanced age and impaired health. He urged PM Modi to cease the harassment of his parents, emphasizing that his parents should be left out of their political conflicts.

While sources indicated that the Delhi Police would not record statements from Kejriwal’s parents on the specified day, AAP leader and Delhi Minister Atishi condemned the interrogation, questioning whether PM Modi had resorted to persecuting elderly and ill parents. Atishi underscored the health challenges faced by Kejriwal’s parents, stressing the impropriety of subjecting them to further distress.

The assault case involving Bibhav Kumar prompted the formation of a Special Investigation Team (SIT) to probe Maliwal’s complaint. Bibhav was arrested by the Delhi Police and is currently in custody, having also lodged a counter-complaint against Maliwal, alleging forced and illegal entry into the CM’s residence.

</excerpt>

Recounting what happened on May 13, Aam Aadmi Party (AAP) Rajya Sabha MP Swati Maliwal on Thursday said that she was assaulted by Bibhav Kumar, personal aide of Delhi Chief Minister Arvind Kejriwal adding that she is not giving “clean-chit” to anyone.

In an exclusive interview with ANI, AAP Rajya Sabha MP recounted the entire incident of May 13 at Arvind Kejriwal’s residence.
“On May 13 at around 9 am in the morning, I went to meet Delhi Chief Minister Arvind Kejriwal at his residence. The staff asked me to sit in the drawing room and told her that Arvind Kejriwal ji was at home and he was coming here to meet me. After that the PA of Arvind Kejriwal ji Bibhav Kumar came in a state of aggression and I asked ‘Kya Hua Kejriwalji aa rahe hai. Kya hogya?’ I said this much, after which he slapped me. He (Bibhav Kumar) slapped me 7 to 8 times. When I tried to push him, he held my legs and mujhe ghaseet diya. Ensuring that my head bumped into the center table. I fell to the floor and he (Bibhav) started beating me with his legs. I was screaming and begging for help but no one came there,” Maliwal said.

She further said that she is not aware whether she was beaten on the instructions of anyone or by himself or of his own accord and that this is all a matter of investigation.
“Everything is a matter of investigation. I am very cooperative with the Delhi Police. I am not giving anyone the clean chit. Because the fact is I was in the drawing room and Arvind Kejriwal was at home and I was beaten up very badly. I was literally screaming very badly but no one came to help to out. I never thought what will happen to me and my career. What will they do with me? I just thought that ‘Jo cheez maine saari mahilao ko bola hai ki hamesha sach ke saath khade raho, aap sachi sachi complain karo and jo bhi aapke sath kuch galat hua hai toh uske liye jarur lado, toh aaj mai kaise nhi ladh sakti,’ she said with tears in her eyes.

Following the assault allegations levelled by Aam Aadmi Party MP Swati Maliwal against a former aide of CM Arvind Kejriwal, Delhi Lieutenant Governor VK Saxena said that the silence of the AAP chief on this matter shows his stance about the issue of the safety of women.
AAP Rajya Sabha MP Swati Maliwal has accused party chief Kejriwal’s former personal secretary Bibhav Kumar of assaulting her at the Chief Minister’s residence.
Bibhav Kumar has lodged a counter-complaint with the police on Friday, accusing Maliwal of gaining ‘unauthorised entry’ into the CM’s Civil Lines residence and ‘verbally abusing’ him.
A case was filed against Bibhav Kumar and a Special Investigation Team (SIT) was formed to investigate the case based on Maliwal’s complaint. Bibhav was arrested by the Delhi Police on Sunday, May 19, and is currently in police custody.

</excerpt>

Delhi Police will not record the statement of the parents of Delhi CM Arvind Kejriwal today in connection with the party’s Rajya Sabha MP Swati Maliwal’s assault case, sources said.

According to the Delhi Police sources, the statement that Swati Maliwal had recorded before the magistrate, she had written that before the assault, she had gone inside the CM house when both Sunita Kejriwal and her parents were present.
“She came out after meeting them. That’s why we are asking for time of two days to take their statement,” the sources said.

Meanwhile, Kejriwal said that he is waiting for the police and has not been informed yet whether they will come or not.
“I am waiting for the police with my parents and wife. Yesterday the police called my parents and asked for time for interrogation. But they have not given any information yet whether they will come or not,” the Delhi CM posted on X.

pic.twitter.com/38Yswozmoi

Atishi, a minister in Delhi and leader of the AAP, also expressed worries over Kejriwal’s parents being questioned by the Delhi Police on Thursday. She questioned whether Prime Minister Narendra Modi had “stooped so low” to target old and sick parents.
Has our PM gone so far as to target our parents who are sick and elderly? Atishi told the journalists, “I don’t think politics in the nation has ever sunk this low.”

Highlighting the health condition of CM Kejriwal’s parents, Atishi said, “Today, when violence is being inflicted upon the parents of Arvind Kejriwal, and Delhi Police are being called to interrogate his elderly and ailing parents, I believe that all limits have been crossed. CM Arvind Kejriwal’s mother is 76 years old and she has been in the hospital for a long time before her arrest.”

“Her condition is such that she can hardly walk and cannot leave her room. His father is 85 years old, unable to walk without support, with impaired vision and hearing,” she added.

The AAP leader urged Delhi residents to use their voting power to express their opposition to what she sees as the unfair prosecution of Chief Minister Kejriwal and his family.

“I have full confidence that the people of Delhi will respond to this persecution of Arvind Kejriwal and his elderly and sick parents with their votes,” Atishi said.
“We are waiting for the police to arrive. This is also a matter of concern for us because if elderly and sick parents are being called for interrogation, mentally harassing them, then this is a matter of concern for us as well,” she added.
She further criticized the Delhi Police’s involvement, alleging their alignment with BJP’s political agenda and insinuating a conspiracy orchestrated by the ruling party.

“Delhi police had said that they will interrogate Kejriwal’s parents. Everyone knows that the Delhi Police is a political tool of the BJP, working on BJP’s orders. The whole incident is a BJP conspiracy, and BJP should also be asked now because deals have been made with Swati Maliwal under which a whole conspiracy has been hatched,” Atishi said.

Based on Maliwal’s complaint, a Special Investigation Team (SIT) was established to look into the case that had been brought against Bibhav Kumar. On Sunday, May 19, Bibhav was taken into prison by the Delhi Police and remains in their custody.
Bibhav filed a countercomplaint against Maliwal, claiming that she had broken the law by forcing her way into the CM’s entrance.

</excerpt>

Aam Aadmi Party (AAP) leader Sanjay Singh made an accusation against the BJP on Thursday, alleging that the party was engaging in vindictive politics by targeting the elderly parents of Delhi Chief Minister Arvind Kejriwal.

Singh stated, “The Prime Minister has stooped to such a low level against Delhi CM that first he arrested ministers from Kejriwal’s cabinet, put them in jail, then arrested Kejriwal himself, and today crossed all boundaries by subjecting Kejriwal’s elderly parents to police harassment.”

He continued, highlighting the advanced age and health conditions of Kejriwal’s parents. “Kejriwal’s father, aged 84, requires support even for a walk and has hearing impairments. His mother, aged 76, underwent an operation two days before Kejriwal’s arrest, and he couldn’t even meet her before the operation before being sent to jail.”

Singh condemned what he described as the Prime Minister’s politics of vengeance, asserting, “The politics of vengeance of the Prime Minister has stooped so low that even Kejriwal’s elderly parents are not being spared. The entire country, the whole of Delhi, is watching this.”

Singh also alleged that the parents of the Delhi Chief Minister were being subjected to harassment under the guise of interrogation. The AAP shared a photo of Kejriwal’s mother, stating that she has been unwell and requires assistance to walk.

In a post on X, the AAP wrote, “This is the mother of Arvind Kejriwal, who recently visited Lord Shri Ram with Kejriwal. She has been ill for quite some time and needs support to walk. Today, dictator Modi is sending police to torture them in the name of interrogation. Modi ji, how low will you stoop for your dirty politics?”

AAP leader Atishi echoed Singh’s sentiments, alleging harassment of the Delhi CM’s parents and accusing the PM of orchestrating a conspiracy through the BJP. “All limits have been crossed as his (Delhi CM Arvind Kejriwal) old and ailing parents have been called for questioning today,” she said. “Has the PM stooped so low that old parents are being harassed? The people of Delhi will give an answer to this through their vote. This whole thing is a conspiracy by the BJP.”

Kejriwal was released from Delhi’s Tihar Jail on May 10, 50 days after he was jailed on corruption charges linked to the alleged liquor policy scam, following a bail grant by the Supreme Court until June 1.

</excerpt>

In a development surrounding the Swati Maliwal assault case, the Delhi Police have postponed the record of statements from Arvind Kejriwal’s parents that was to be taken today, adding a new twist to the ongoing investigation.

The incident allegedly involves Arvind Kejriwal’s personal assistant, Bibhav Kumar, accused of physically assaulting Swati Maliwal within the Chief Minister’s residence. The Aam Aadmi Party (AAP) swiftly came to Kumar’s defence, attributing the accusations to a BJP-led conspiracy against their party.

Recent reports suggest that besides Kejriwal’s parents, his wife Sunita Kejriwal may also face questioning in the investigation. Swati Maliwal has narrated the events before the authorities, implicating the Kejriwal family in the assault incident.

Atishi, a prominent AAP leader, criticised the actions of the Delhi Police and targeted Prime Minister Narendra Modi for meddling in the situation. She emphasised the vulnerability of Kejriwal’s aging parents and questioned the notion of their involvement in the alleged assault.

Delhi Chief Minister Arvind Kejriwal revealed on Wednesday that the Delhi Police would be questioning his elderly parents on Thursday, suspected to be related to the Swati Maliwal assault case.

“Tomorrow, Delhi Police will come to interrogate my old and ill parents,” stated the Delhi CM in a post on X.

Following Kejriwal’s announcement, Delhi Water Minister Atishi echoed his sentiments and criticized Prime Minister Narendra Modi for implicating Kejriwal’s parents in the case.

“I want to ask PM Modi and BJP that 85 years old father of Arvind Kejriwal who cannot walk alone without support and the mother of Arvind Kejriwal who just returned home a few days ago after spending a long time in the hospital, do they think that 85-year-old patients raised their hands on Swati Maliwal? Does the BJP feel this?” said Atishi.

Kejriwal stressed the need for a fair investigation into the case, highlighting the existence of two conflicting versions of the incident.

“I want fair investigation, justice in Swati Maliwal assault case as incident has two versions,” expressed Delhi CM Arvind Kejriwal to news agency PTI.

While acknowledging the matter’s sub-judice status and its potential impact on legal proceedings, Kejriwal emphasized the importance of impartiality in the investigation process.

“But I expect there will be a fair investigation. Justice should be served. There are two versions of the event. Police should investigate both versions fairly and justice should be done,” Kejriwal asserted.

Previously, the Delhi Police brought Bibhav Kumar, an aide to Delhi Chief Minister Arvind Kejriwal, to the CM’s residence as part of the investigation into the Swati Maliwal assault case. Kumar was detained at the CM’s house and arrested on Saturday in connection with the assault.

Following his arrest, Kumar was remanded to a five-day police custody by Delhi’s Tis Hazari Court. The court noted, “the fact that the mobile phone was formatted by the accused and the video footage was not found in the pendrive provided by the JE to the IO during the course of the investigation speaks volumes.” Additionally, the court acknowledged that this was not Kumar’s first encounter with the law.

In response to Kumar’s detention, Kejriwal referred to it as “Jail ka Khel,” accusing the Prime Minister of orchestrating a political vendetta against the Aam Aadmi Party (AAP). Kejriwal claimed in a video message shared on Saturday that the BJP-led government is systematically targeting and imprisoning AAP leaders.

</excerpt>

A Special Investigation Team (SIT) has been established to probe the Swati Maliwal case, following accusations by the Aam Aadmi Party (AAP) Rajya Sabha MP against Delhi Chief Minister Arvind Kejriwal’s former personal secretary, Bibhav Kumar, for assault. Police officials stated that the SIT is led by North Delhi’s Additional Deputy Commissioner of Police (DCP) Anjitha Chepyala, who is overseeing the investigation. The team also includes three inspector-rank officers, including the officer from Civil Lines Police Station where the case was filed.

The SIT will present its findings to senior officials after completing the investigation, according to the police.

On Monday, the Delhi Police took Bibhav Kumar to the drawing room of Kejriwal’s residence, where the alleged assault on Maliwal occurred, to reconstruct the events of the morning of May 13. The police documented Kumar’s answers, mapped them sequentially, and took photographs of the crime scene, officials reported.

Sources within the Delhi Police revealed that both the accused and the victim were brought to the crime scene to recreate the incident, and their accounts are now being analyzed. Officials also visited Bibhav Kumar’s residence as part of the investigation.

The police are attempting to retrieve Bibhav Kumar‘s mobile data, hoping it will provide new leads. They are also investigating whether the CCTV footage was tampered with, as alleged by Swati Maliwal. On Sunday evening, the police seized the DVR containing Kejriwal’s CCTV footage and are working to recover the missing portions.

Earlier, on Saturday, Bibhav Kumar was arrested in connection with the alleged assault on Maliwal. He was presented before the Tis Hazari Court, which remanded him to police custody for five days.

In her complaint, Maliwal alleged that Bibhav “slapped” her “at least seven to eight times” while she “continued screaming” and “brutally dragged” her while “kicking” her in her “chest, stomach, and pelvis area.” Following his arrest, Bibhav was taken to Delhi’s Tis Hazari Court, which remanded him to police custody for five days.

On Friday, Bibhav filed a counter-complaint against Maliwal, accusing her of gaining ‘unauthorized entry’ into the Chief Minister’s Civil Lines residence and ‘verbally abusing’ him.

</excerpt>

Following the arrest of Arvind Kejriwal’s aide, Bibhav Kumar, by the Delhi police in an alleged assault case, his father spoke out against what he perceives as injustice. He emphasized that in the 15 years Bibhav has been with Delhi CM Kejriwal, there have been no complaints against him. Bibhav’s father, Maheshwar Rai, revealed that the BJP has been pressuring Bibhav to distance himself from Kejriwal, implying that doing so would spare him harm. He recounted the incident where Bibhav allegedly confronted Swati Maliwal, asserting that Bibhav merely prevented her from meeting Kejriwal without permission and did not physically harm her.

Bibhav’s background as a student at Banaras Hindu University and his practice of journalism in Delhi were also highlighted. Hailing from Bihar’s Khudru village, Bibhav is described as coming from a socially engaged family with a history of supporting the underprivileged. Former village head Lal Sahib Yadav vouched for Bibhav’s character, denying any criminal inclinations and attributing the situation to political motives.

Despite Bibhav’s arrest, he expressed readiness to cooperate with the ongoing investigation into Maliwal’s assault claim. Simultaneously, he urged authorities to consider his own complaint, where he accused Maliwal of unauthorized entry, verbal abuse, and threats, while alleging BJP involvement.

As details emerged regarding Maliwal’s medical examination report, citing bruises on her left leg and right cheek, questions surrounding the incident intensified. The report, following Maliwal’s examination at AIIMS Delhi, shed light on the physical aftermath of the alleged altercation.

Earlier, an FIR had been filed by Delhi Police based on Maliwal’s complaint against Bibhav, alleging physical assault, including slapping and dragging, while she continued to scream.

AAP accused Maliwal of colluding with the Bharatiya Janata Party (BJP) against Arvind Kejriwal, alleging her involvement in a conspiracy. This accusation stems from an incident involving Kejriwal’s private secretary, Bibhav Kumar, who is accused of assaulting Maliwal, the former Delhi Commission for Women (DCW) chief.

Bibhav Kumar appeared before the Delhi Tis Hazari Court, where the Delhi police requested a 7-day police custody.

The additional public prosecutor (APP) representing the Delhi police stated, “The accused was arrested today, and we have provided the grounds for arrest. The primary reason for seeking police custody is the victim’s status as a public figure and member of parliament. She suffered severe physical assault, including being beaten, kicked in the private parts, and her head was banged, leading to the imposition of relevant sections.”

The APP continued, “The investigating officer (IO) visited the incident scene and received video footage. However, the footage during the incident period was blank upon playing the video. Additionally, the phone provided to us was formatted, and it was discovered that the formatting occurred yesterday.”

Bibhav Kumar, an aide to CM Kejriwal, was arrested on Saturday in relation to the purported assault on AAP MP Swati Maliwal. AAP countered by alleging that Maliwal was “blackmailed” by the BJP, citing her ongoing corruption case.

Kumar was arrested from the chief minister’s residence by a Delhi Police team. This action followed a day after Maliwal provided her statement before a magistrate at the Tis Hazari court.

Maliwal had accused Kumar of forcefully assaulting her, alleging that he slapped her in the face and kicked her in the chest and abdomen on May 13 when she visited the CM’s residence to meet Arvind Kejriwal.

The Police have taken statements from at least 10 individuals, including security personnel and other staff present at the CM’s residence during the alleged assault on May 13.

Earlier today, Bibhav expressed willingness to cooperate with the police investigation but requested them to also take into account his complaint against AAP’s Rajya Sabha MP.

On Friday, Kumar lodged a police complaint, accusing Maliwal of breaching the security of the CM’s residence to gain unauthorized entry on May 13 and causing disturbance.

The CM’s aide further claimed that when he attempted to intervene, Maliwal verbally abused him.

Senior AAP leader Atishi held a press conference, stating that if the Delhi Police acts impartially, it should also register an FIR based on Kumar’s complaint.

Maliwal underwent a medical examination at AIIMS on Friday. As per the medico-legal certificate (MLC), she has “bruises over proximal left leg dorsal aspect of approx size 3×2 cm and right cheek elbow below right eye of approx size 2×2 cm”.

Maliwal criticized her party for rejecting her assault allegations against Bibhav Kumar as “baseless,” asserting that the AAP has succumbed to “goon’s pressure” and is now questioning her character.

Maliwal stated that the AAP has made a “U-turn” just two days after acknowledging that Kumar had “misbehaved” with her.
