In connection with the alleged urination incident onboard, an Air India flight between New York and Delhi, Air India has submitted its reply to the Directorate General of Civil Aviation (DGCA).

Meanwhile, in the matter, the airline has submitted its reply to the DGCA, and after reviewing that, the final decision will be taken.

Earlier on 6 January a show cause notice was issued to the Accountable Manager of Air India, the Director of in-flight Services of Air India, and all the pilots and cabin crew members of that flight.

Moreover, only two weeks were given to the airline by the DGCA to submit their reply, and on that date action will be taken.

Earlier on Thursday, Air India banned accused Shankar Mishra from flying for four months in a urination case, and it is expected that other airlines will also ban him.

However, after the decision of Air India to ban Shankar Mishra from flying for four months, his legal team showed their disagreement with the committee’s findings.

Accused Shankar Mishra’s advocates, Ishanee Sharma and Akshat Bajpai, said, “We respect the authority and mandate of the Internal Inquiry Committee, we disagree with their findings and are already in the process of appealing this decision in accordance with the DGCA CAR for Unruly Passengers.”

Talking to the media Mishra’s lawyer said that “we would particularly like to point out that the Internal Inquiry Committee’s ruling hinges upon their incorrect understanding of the layout of the Aircraft.”

“When the Committee could not find an adequate explanation as to how the accused could have urinated on the complainant sitting on seat 9A without also affecting the passenger on Seat 9C, it has erroneously gone on to assume that there was a seat 9B in the business class in the aircraft and imagined that the accused could have stood at this imaginary seat and urinated on the complainant on seat 9A. However, there is no seat 9B in the business class on the craft – only seats 9A and 9C,” the statement said.

Furthermore, on 26 November, the incident took place on an Air India flight from John F Kennedy International Airport in New York to Delhi, the flight was on its way.

The accused Shankar Mishra, who had allegedly urinated on a co-passenger onboard an Air India flight between New York on 26 November has told the Delhi court that he did not pee on women but the woman herself peed on her seat.

“The complainant woman’s seat was blocked. It wasn’t possible for him (Mishra) to go there. The woman has a problem with incontinence. She urinated on herself. She is a Kathak dancer, 80 percent of kathak dancers have this issue,” the accused said through senior lawyer Ramesh Gupta.

“She herself urinated. The seating system was such that no one could go to her seat. The passenger sitting behind the complainant did not make any such complaint,” Gupta said.

Meanwhile, after making this statement Additional Sessions Judge Harjyot Singh Bhalla said, “It is not impossible to go from one side of the flight to the other. Sorry, but I have traveled as well. Anybody from any row can come around and go to any seat.”

The Additional Sessions Judge asked Delhi Police to investigate whether the accused person was intoxicated before boarding the flight or not.

“The appeal doesn’t seem to have been made before the magistrate court. It is not appropriate to decide on an order based on submissions not made before the magistrate. The ground seems to be widely worded and the magistrate can’t be expected to apply his mind to all possible situations,” Additional Sessions Judge said.

However, Patiala House Court sent Shankar Mishra to 14 days of judicial custody on 7 January and on 11 January the Patiala House Court reserved an order on Mishra’s bail plea.

Earlier on On 6 January, Mishra was arrested by Delhi Police from Bengaluru. On 7 January Mishra was sent to 14 days of judicial custody by Delhi’s Patiala House Court on Saturday.

However, for a medical examination, the accused was taken to Safdarjung Hospital before taking to the Patiala House Court in Delhi.

The accused Shankar Mishra, who had allegedly urinated on a co-passenger onboard an Air India flight between New York on 26 November the Patiala House Court on Wednesday reserved an order on Mishra’s bail plea.

Meanwhile, Mishra’s Advocate Manu Sharma during the detailed arguments said, “I couldn’t control my drink but the unzipping was not for sexual desire. The complainant’s case does not put him as a lustful man. The trial will take time but the man has been sacked from his job after these allegations. He is not at flight risk.”

“My client has clearly and willingly participated in any inquiries related to the alleged event, with the intention to establish his innocence and will continue to act in this bona fide manner and assist the police in the investigation into this matter,” submitted Adv Manu Sharma, lawyer of Shankar Mishra.

The Delhi Police opposed the bail of accused Shankar Mishra and said he can influence the complainant if Mishra enlarged on bail.

“Investigation at present on a nascent stage and accused can influence the complainant,” police said.

Moreover, 164 statements that have been recorded were represented by the Public Prosecutor.

Advocate Ankur Mahendru who opposed Mishra’s bail plea said Mishra’s father is sending me messages and later deletes them.

“He writes ‘Karma will hit you back’ and then deletes it,” said Mahendru.

Earlier on Friday Shankar Mishra stated through his lawyers that the lady has displayed no intention to complain.

Meanwhile, the lawyers of Shankar Mishra Ishanee Sharma and Akshat Bajpai have issued a statement in which the statement reads, “The WhatsApp messages between the accused and the lady clearly show that the accused had got the clothes and bags cleaned on November 28 and the same was delivered on November 30.”

The man Shankar Mishra who allegedly peed at an elderly woman traveling in business class on an Air India flight has stated through his lawyers that the lady has displayed no intention to complain.

“The lady’s persisting grievance was only with respect to the adequate compensation being paid by the Airline for which she has raised a subsequent complaint on December 20, 2022,” the statement stated.

Moreover, on 28 November the accused was given compensation and she agreed that she’ll not lodge a complaint but according to the lawyers, her daughter returned the money on 19 December.

According to the statement, there is no eyewitness to the incident and all evidence is merely hearsay.

However, in the statements the settlement reached between the parties has also been affirmed and so it was submitted to the cabin crew.

“The accused has full faith in the judicial system of the country and will cooperate with the investigation process,” the statement stated.
