Saif Ali Khan Faces Legal Blow in ₹15,000 Crore Bhopal Royal Property Case

Bollywood star Saif Ali Khan and his kin suffered a huge setback early this week after the Madhya Pradesh high court cancelled a 25-year-old ruling validating their ownership right on the inherited property valued at a staggering ₹15,000 crore and directed a re-trial.

High Court Overturns Trial Court’s Decree

The decree and order of a trial court released two decades ago confirmed Saif Ali Khan and his relatives mother Sharmila Tagore and sisters Soha Ali Khan and Saba Ali Khan – as the owners of the properties left behind by the former rulers of the princely state of Bhopal. But justice Sanjay Dwivedi of the high court has now stayed that order and has directed the trial court to hold a new trial and try to dispose of the case in a year, PTI said.

The final nawab ruler of Bhopal – Nawab Hamidullah – had three daughters, Abida, Sajida and Rabia. Sajida wed Iftikhar Ali Khan Pataudi and became the Nawab Begum of Bhopal. When her older sister Abida had immigrated to Pakistan, Sajida took over their parents’ estate, which then passed on to her son Mansoor Ali Khan Pataudi.

Inheritance Passed to Saif Ali Khan and Siblings

Mansoor Ali Khan Pataudi, alias Tiger Pataudi, wed Bollywood actress Sharmila Tagore and they had three children – Saif Ali Khan, Soha Ali Khan and Saba Ali Khan – who inherited the assets valued at about ₹15,000 crore.

Other successors of Nawab Hamidullah objected to the inheritance by Pataudi siblings. Begum Suraiya Rashid and Nawab Mehr Taj Sajida Sultan, among others, had moved court with suits against ‘unfair’ division of property of Nawab Hamidullah. But the Bhopal district court ‘unfairly’ rejected their suit in a February 14, 2000 judgment, as per two separate appeals moved by them.

Appellants Argue for Fresh Division Under Muslim Personal Law

As per their attorneys, partition of Nawab Hamidullah’s movable property ought to have been carried out between them and defendants Saif Ali, Sharmila and 16 other heirs under the Muslim Personal Law, PTI quoted.

The single bench of Justice Sanjay Dwivedi has set the trial court’s decades’ old decree aside and asked it to decide on the matter again. It also directed the court to allow parties to present fresh evidence if required.

Justice Dwivedi said, “The matters are remanded back to the trial court for deciding it afresh.”
“And if so required, the trial court can allow the parties to lead further evidence in view of the subsequent development and changed legal position,” said his order.

The Government of India had issued a certificate on January 10, 1962, in favour of Saif Ali Khan’s grandmother Sajida, naming her the sole successor of all the private properties of the Nawab. The certificate was cited by the Pataudi’s to retain their claim over the wealth. However, the appellants have opposed the citation in their appeal.

Supreme Court Overruling Used as Basis to Cancel Earlier Verdict

A single bench of Justice Sanjay Dwivedi has overruled the trial court’s decades’ old order and requested it to rule on the issue once again. It also ordered the court to permit parties to submit new evidence if necessary.

In overruling the trial court’s 2000 order, Justice Dwivedi stated that it had rejected the appellants’ suits on the basis of judgement that has itself been overruled by the Supreme Court.

“I am of the opinion that the trial court, without considering other aspects of the matter, had dismissed the suits, that too relying upon the judgment which has already been overruled by the Supreme Court. Thus, in my opinion, the impugned judgment and decree deserve to be and are hereby set aside,” the judge said.
“It is made clear that since the suits were initially filed in 1999, therefore, the trial court shall make all possible efforts to conclude and decide it expeditiously, preferably within a period of one year,” he added, reported PTI.

Saif Ali Khan and the Bhopal Succession Deal

The order further stated that the princely state of Bhopal joined the Union of India upon independence on April 30, 1949 in an agreement which stated, “The agreement contained a clause disclosing that upon merger all the special rights which the Nawab (Ruler) enjoyed, shall continue and under the agreement, it was agreed upon that all the property which is their personal property, shall be of their absolute ownership and succession of the Gaddi (throne) shall be under the Bhopal Succession to the Throne Act, 1947.”

The actor was speaking during a panel discussion alongside Netflix CEO Ted Sarandos at the World Audio Visual Entertainment Summit (WAVES). Saif Ali Khan pointed to the international coverage streaming platforms attract, saying that his Netflix content has received greater overseas attention compared to his films’ theatrical runs.

What Saif Ali Khan Said

The actor admitted to receiving more phone calls from his peers around the world for his Netflix acting ventures than for his theatrical releases. “The fact that it goes out around the world and to so many people. I get phone calls from people who wouldn’t normally call me for a cinematic release, but on Netflix, everybody rings up, people ring up from Europe and America, and so we watch this and we’re compared to the rest of the world. It’s a very, very exciting space,” said Saif Ali Khan.

Streaming Enables Actors Like Saif Ali Khan to Break the Mold

The ‘Sacred Games’ star also highlighted the advantages of streaming platforms for the actors, as they allow them to play new characters and tell new stories in films and shows.

“It’s been the most liberating thing and the most amazing thing for all actors all over the world. Earlier, we had to kind of fit into specific boxes, and there was a formula, a look, a style for the kind of thing you had to do. Today, thanks to streaming, we can explore characters in a very different way and go into much more depth, and it is a fantastic platform to showcase all kinds of things like long-form storytelling,” said Saif Ali Khan.

Cinema and Streaming Can Coexist

Addressing the coexistence of cinema and streaming, Sarandos reaffirmed that theatrical releases still hold value.

“Cinemas are not outdated. Streaming and theatres are not competitors. They can move ahead coexisting with each other as the market before us is huge,” he said.

Saif echoed the sentiment, adding that the most meaningful projects for him are those rooted in Indian culture.

Saif Ali Khan played the lead role in the first original Hindi series of Netflix, ‘Sacred Games’, with actor Nawazuddin Siddiqui.

Saif Ali Khan on Why Taimur, Not Kareena, Took Him to the Hospital After Knife Attack

New Delhi: Saif Ali Khan was stabbed six times in the back by an intruder during a failed robbery attempt at his residence last month. The actor underwent two major surgeries, including the removal of a three-inch knife blade that was lodged dangerously close to his spine.

While well-wishers poured in with support, some questioned the authenticity of the incident. Recently, Saif revealed harrowing details of how he fought the armed attacker alone until his house help intervened. He admitted that had the intruder inflicted a more severe injury to his neck or spine, he could have been left “paralysed.”

In a conversation with The Times of India, Saif shared why his elder son, Taimur, accompanied him to the hospital instead of his wife, Kareena Kapoor. He said, “He (Taimur) was absolutely composed. He was fine. He said, ‘I’m coming with you.’ I was getting a lot of comfort just from looking at him at that time. And I didn’t want to go alone. My wife sent him knowing what he would do for me. Maybe it wasn’t… at the moment, it was the right thing to do. I felt good about it. And I also thought, if God forbid, something happens, I’d like for him to be there. And he wanted to be there also.”

While Saif and Taimur rushed to the hospital, Kareena took Jeh to her sister Karisma Kapoor’s home.

Recalling the terrifying night, Saif revealed that he and Kareena were asleep when, around 2 a.m., one of their house helps burst into their room, alarmed by an intruder demanding money in their younger son Jeh’s room. As Saif rushed to confront the situation, he found a masked man standing over Jeh’s bed, wielding what initially appeared to be two sticks, but were actually “sharp hexa blades.”

“Something took over me,” Saif recalled, describing how he instinctively grabbed the intruder and pulled him down. However, being armed, the attacker retaliated, stabbing Saif in the back and neck multiple times. “I couldn’t handle it after a while as there were two knives in action. I was praying that someone could get this guy off me at this point,” he shared. That’s when his house help, Geeta, stepped in and managed to pull the attacker away.

Saif further explained that he managed to lock the intruder inside Jeh’s room. However, the assailant escaped the same way he had entered—through the drainpipe in the kids’ bathroom. It was only after reaching the hospital that Saif realized the severity of his injuries.

Doctors informed him that a four-inch blade had penetrated his shoulder blade, reaching dangerously close to his spinal cord. He described it as a “massive stab,” revealing that the knife had even nicked the protective covering of his spinal cord, causing spinal fluid leakage and temporary numbness in his leg. “That’s how close it came—just one more millimetre, and we’d be talking paralysis,” he said.

Saif underwent an extensive six-hour surgery to treat his injuries.

The Mumbai police are currently investigating the case and have arrested Mohammad Shariful Islam Shehzad, a Bangladeshi national, in connection with the crime.

Justice Vivek Agarwal, while lifting the stay, pointed out that a statutory remedy is available under the amended Enemy Property Act of 2017. The court directed all concerned parties to file representations within 30 days.

The Enemy Property Act empowers the central government to seize properties owned by individuals who migrated to Pakistan after the partition of India.

The incident occurred around 4 a. m. , when an intruder allegedly broke into Saif Ali Khan’s residence and assaulted him. As per police reports, a confrontation took place between Saif and the intruder, who later fled after stabbing the actor six times.
