</excerpt>

The Rouse Avenue Court on Thursday sent AAP MLA Naresh Balyan to one day of judicial custody. He is set to be produced in court tomorrow.

Delhi Police has accused Balyan of being involved in identifying targets for extortion for a crime syndicate led by gangster Kapil Sangwan. It is alleged that he invested the extorted funds in property and took a share of the proceeds.

Balyan was presented before the District Judge at the Rouse Avenue Court, with the police seeking 10 days of custody. After hearing arguments from the Special Public Prosecutor (SPP) for Delhi Police and the defense counsel, Special Judge Kaveri Baweja ordered one day of judicial custody, citing the need to examine the submissions and evidence further before deciding on the custody plea.

The court noted, “It is already 5:30 PM. The offence in question is alleged to have been committed under MCOCA. Sometimes, it is necessary to go through the statutory provisions and case law cited during arguments from both sides. It is deemed expedient in the interest of justice to adjourn the matter for further arguments on the application.”

Balyan, arrested under the stringent Maharashtra Control of Organised Crime Act (MCOCA), will now be produced in a designated MP/MLA court. Police informed the court that the FIR in this case was registered in August 2024 and claimed that three co-accused are already in judicial custody. The prosecution argued that Balyan’s interrogation is essential to investigate properties where the extorted money was allegedly invested.

Special Public Prosecutor Akhand Pratap Singh stated that Balyan communicated with Kapil Sangwan via a VPN and played a critical role in facilitating the extortion network. Singh argued, “Balyan used to identify potential targets for extortion, and a portion of the extorted money would come to him.”

Opposing the police’s plea, Balyan’s counsel, Dr. N.C. Sharma, cited Section 2(D) of MCOCA, contending that his client had no involvement in any offense punishable with more than three years, apart from the current case. The defense also questioned the prosecution’s reliance on an audio clip purportedly linking Balyan to Sangwan. They argued there was no scientific verification of the voice in the clip or its source, which had been aired on a TV channel.

Delhi Police rebutted by stating that the MCOCA requirement for two charge sheets applies to the syndicate as a whole and not to each individual accused. However, the defense maintained that the lack of scientific evidence undermined the case against Balyan.

Earlier in the day, Balyan was produced before Principal District and Sessions Judge Anju Bajaj Chandna, who assigned the matter to Special Judge Kaveri Baweja, handling special MP/MLA cases. The court permitted Balyan to carry his prescribed medication during his time in judicial custody.

</excerpt>

Delhi Police’s Crime Branch arrested Aam Aadmi Party (AAP) MLA Naresh Balyan in connection with a 2023 extortion case. The arrest followed the emergence of an audio clip purportedly featuring a conversation between Balyan and gangster Kapil Sangwan, alias Nandu, discussing the collection of ransom money from businessmen.

Balyan, representing Uttam Nagar, was detained for questioning at the Crime Branch office in R.K. Puram and subsequently arrested. He is scheduled to be presented before the Rouse Avenue Court today as his custody period concludes. Balyan stated, “We are going to file a bail application.”

The AAP has condemned the arrest, with party MP Sanjay Singh alleging that the Bharatiya Janata Party (BJP) is orchestrating a conspiracy against AAP leaders following Chief Minister Arvind Kejriwal’s criticism of Delhi’s law and order situation. Singh asserted that the charges against Balyan are baseless.

Conversely, BJP leaders have accused Balyan of colluding with gangster elements to extort money from business owners. BJP spokesperson Gaurav Bhatia played the alleged audio clip during a press conference, questioning whether AAP leadership would take action against Balyan.

The case has intensified political tensions in Delhi, with both parties exchanging allegations over governance and public safety issues. Further investigation is underway to determine the extent of Balyan’s involvement in the extortion activities.

</excerpt>

The Rouse Avenue Court will deliver its verdict on Friday in a case against former Congress MP Sajjan Kumar, linked to the killings of Jaswant Singh and his son Tarundeep Singh during the 1984 anti-Sikh riots in Saraswati Vihar, Delhi. Special Judge Kaveri Baweja will announce the judgement, reserved earlier on November 8.

Case Background

The case dates back to November 1, 1984, amidst the anti-Sikh riots following the assassination of then-Prime Minister Indira Gandhi. The prosecution alleges that Sajjan Kumar instigated and led a mob that murdered the victims, burned their house, and looted their property. The charges include murder (Section 302 IPC), rioting (Sections 147, 148, 149 IPC), arson, and other offenses.

Initially registered at the Punjabi Bagh police station, the case was later investigated by a Special Investigation Team (SIT) formed on the recommendation of the Justice G.P. Mathur committee. The SIT filed a charge sheet against Sajjan Kumar after reopening 114 cases in 2016.

Defence Arguments

Advocate Anil Sharma, representing Sajjan Kumar, argued that Kumar’s name was not mentioned initially and was only introduced 16 years later by a witness. He claimed the investigation was delayed and flawed, asserting that the law of foreign lands and international conventions cited by the prosecution were not applicable.

Sharma also pointed out that a separate case in which Kumar was convicted by the Delhi High Court is under appeal in the Supreme Court. He emphasized that the law of the land prevails in such extraordinary cases.

Prosecution’s Stand

Additional Public Prosecutor Manish Rawat rebutted the defense, stating that the witness identified Sajjan Kumar after recognizing his photograph in a magazine. He argued that extraordinary circumstances during the riots, which the Delhi High Court termed “crimes against humanity,” justified the delay in the investigation.

Senior advocate H.S. Phoolka, representing riot victims, argued that the anti-Sikh riots were not isolated incidents but part of a broader genocide targeting minorities. He criticized the police for manipulating investigations to shield influential individuals and referred to the Geneva Convention and international rulings on genocide.

Phoolka also highlighted that the Supreme Court’s intervention, leading to the SIT’s formation, showed the seriousness of the delays in bringing justice.

Victim Testimonies

The complainant, in her statement recorded in 2016, described the mob’s violence, including the looting, arson, and murders of her husband and son. She alleged that Sajjan Kumar’s instigation led to the violence and claimed to have identified Kumar through his photograph in a magazine weeks after the incident.

Also read: Bengaluru Concert to Support ‘Chennai Express’ Singer SP Balasubrahmanyam Through Kannada Hits

Anticipation for Justice

The case against Sajjan Kumar is one of the most high-profile cases tied to the 1984 anti-Sikh riots, during which over 2,700 Sikhs were killed in Delhi alone. The Delhi High Court, in a previous case, termed the riots as “crimes against humanity.” The verdict on this case is expected to serve as a significant milestone in the decades-long quest for justice for riot victims.

Authorities and the public await the court’s judgement, which will not only decide Sajjan Kumar’s fate but also reaffirm the judiciary’s stance on justice in cases of communal violence and genocide.

</excerpt>

While hearing the bail pleas of four co-owners of the Old Rajender Nagar basement, the Rouse Avenue court questioned the CBI, “Was the show cause notice issued to the accused persons along with the coaching centre in August 2023.”

The accused claimed that Principal District and Sessions Judge Anju Bajaj Chandna directed the CBI on Monday to submit a typewritten copy of the show cause notice, as the original was not clear. The court also inquired whether the show cause notice had been issued and served to the accused co-owners. The case will continue tomorrow with further hearings. The court is reviewing the bail pleas of co-owners Harvinder, Parvinder, Tejinder, and Sarabjeet, who have been arrested in connection with the coaching centre death case.

During the hearing, the Court inquired of the counsel for the accused, “Did you share the occupancy/completion certificate with the tenant?”

Advocate Amit Chaddha argued that the property in question is commercial and was designated for use as a coaching institute, not as a library. He also pointed out that a fire safety certificate for the building was issued for three years on July 9, 2024. The court inquired about the circumstances of the incident. It was explained that water had flooded the basement after the gate was damaged by a wave created by an SUV driver.

The court asked, “Was the gate so weak that it crashed due to wave of water? What action has been taken against the person who constructed the gate?”

The counsel for the accused stated that the Delhi police had determined that Section 105 BNS did not apply to SUV driver Manuj Kathuria. Although he was previously considered the main suspect, he was granted bail. Advocate Amit Chaddha further argued that the investigation agency was acting beyond its authority by arresting innocent individuals. He also mentioned a complaint filed by a student on June 26.

The court asked, “If there was a complaint on June 26 regarding the basement, what action did MCD take ?”

Amit Chaddha also noted that during a hearing in the High Court, the MCD commissioner had acknowledged that the drain in front of RAU’s study centre was nonfunctional.

Chaddha argued that the Deputy Commissioner had issued a show cause notice to the lessee.

“Deputy commissioner had the knowledge that something is wrong. And still sitting on it. He was aware. Still, he allowed this to happen. This is an organised crime,” Chaddha argued.

“Even the commissioner admitted that drains were dysfunctional. Officers were cognisant. Investigation is also cognisant of this fact, he added. Should I start cleaning the drain myself?” he raised the question.

The CBI counsel stated that a notice had also been served to the owners. “Was the notice served upon the owner?” the court asked.

“It was issued on August 4, 2023. It shows the negligence of the civic agency. You have to provide its typewritten copy. This notice is really important,” the court said.

Chaddha said “Neither June 6 nor August 4, I am aware of it. It is at its best, a case of negligence defined under section 106 BNS.”

He also referenced the judgments from the Bhopal Gas Tragedy case to the Uphar Cinema fire case.

The CBI stated that the sliding gate serves the entire building, making the owner responsible for it. They also noted that the operation of the library from the basement was in violation of the MCD master plan, as outlined in the FIR. The sliding gate collapsed, which is mainly being held responsible for the waterlogging in the basement of the coaching centre.

“They are getting Rs 4 lakh per month but they are not concerned with the three deaths,” CBI said.

The court remarked that the civic agency was aware of the situation and questioned what actions had been taken. It was noted that the individuals are not the sole accused. The CBI responded that to address this question, the case has been handed over to them, and argued that neither morally nor legally are the accused entitled to bail.

During the hearing, a counsel representing the deceased also came up. “Is there no responsibility on the part of the owner? Were they not aware of the situation? A total of 10 minutes of rainfall can cause waterlogging”, it submitted.

The court inquired if there was any statement regarding this matter. The counsel further asked, “Was there any way out if the basement got waterlogged? Their responsibility was to provide a way out if the basement so big that hundred students were sitting.”
“Why did they not shut the library? They regularly asked for the rent? Why did they not cancel the lease deed,” the counsel for the victim asked.

A month earlier, a student had filed a complaint, indicating awareness of the issue. However, CBI claimed that they were unaware of it at that time. CBI noted that a few students might have been saved. The counsel mentioned that three lives had been lost, and Chaddha described it as a tragic event. He emphasised that decisions should be based on legal principles rather than emotions, adding that failure to take action would implicate others in the crime.

The Special Judge Kaveri Baweja prolonged Kejriwal’s custody respectively in money laundering and corruption case. These matters are separately investigated and registered by enforcement directorate & CBI.

For the money laundering case investigated by ED, the custody has been extended till July 31. While for the registered corruption case, it is extended till August 8.

However, the supreme court has already given interim bail to Arvind Kejriwal in ED case. But currently, he is still in Tihar jail, as he has not provided the bail bond in this matter.

</excerpt>

Delhi’s Rouse Avenue Court on Thursday extended the judicial custody of Chief Minister Arvind Kejriwal till August 8 in the CBI case regarding the Delhi excise policy scam. This development follows the previous extension, which was set to end today.

Background and Timeline
Kejriwal has been in jail since March 21, facing charges of money laundering under the investigation of the Enforcement Directorate (ED). On May 10, the Supreme Court granted him interim bail for 21 days to campaign for the Lok Sabha elections, after which he returned to prison on June 2.

Court Proceedings
In the latest hearing, Special Judge Kaveri Baweja extended Kejriwal’s judicial custody. He appeared via video conferencing from Tihar Jail. The court directed the ED to provide Kejriwal’s counsel and other accused with copies of the supplementary charge sheet.

Supplementary Charge Sheets
On July 9, the court acknowledged the supplementary charge sheet against Kejriwal and AAP, as well as against Vinod Chauhan and Ashish Mathur. This is part of the seventh and eighth supplementary charge sheets in the money laundering case linked to the Delhi excise policy.

Arrests and Allegations
The ED arrested Kejriwal on March 21. Other individuals arrested in connection with this case include Manish Sisodia, BRS leader K Kavitha, Sanjay Singh, and various businessmen. The ED has alleged that Kejriwal demanded a bribe of Rs. 100 crores, which went to AAP for the Goa election campaign.

Evidence and Opposition to Bail
ASG SV Raju, opposing Kejriwal’s bail plea, cited evidence of Hawala transfers amounting to approximately Rs 45 crore. These transfers are corroborated by call records, data from a Hawala firm in Goa, and witness statements. The ED also presented proof of cash payments made to support the AAP campaign in Goa.

</excerpt>

The Delhi High Court on Friday stayed the bail granted to Chief Minister Arvind Kejriwal by a trial court a day earlier.

On June 20, the Rouse Avenue Court had granted bail to the Aam Aadmi Party (AAP) leader upon the payment of a Rs 1 lakh bond. Kejriwal had been arrested by the Enforcement Directorate (ED) on March 21 in connection with the now-scrapped Delhi Excise Policy case.

The high court ruled that the trial court’s bail order would be stayed until it could properly hear the matter. This decision came after the Rouse Avenue Court denied the ED’s request to delay Kejriwal’s bail for 48 hours to allow time for further legal action.

The ED then took the issue to the high court on Friday. During the hearing, counsels Additional Solicitor General SV Raju and Special Public Prosecutor Zoeb Hossain argued, “We were not given ample opportunity to argue the matter before the vacation judge…I was not even given time to file a written submission.”

</excerpt>

Delhi Chief Minister Arvind Kejriwal is scheduled to be released from Tihar jail today after being granted bail by the Rouse Avenue court in connection with a money laundering case related to the alleged liquor policy scam.

Kejriwal’s legal team is expected to submit the bail bond of Rs 1 lakh to the court later today, after which he will be released. He has been in Tihar jail since June 2 following the end of his interim bail. Sources indicate that his wife, Sunita Kejriwal, is expected to visit the high-security prison at 4 PM today.

The Enforcement Directorate (ED) has stated that it plans to file a plea in the Delhi High Court to challenge the bail granted to the Aam Aadmi Party (AAP) leader. This follows the Rouse Avenue court’s dismissal of the agency’s request to delay the bail order by 48 hours, allowing them time to seek legal recourse.

The court has imposed specific conditions for Kejriwal’s bail, including not interfering with the investigation or influencing witnesses. The AAP chief has been instructed to appear before the court when required and to cooperate with the ongoing investigation.

Kejriwal was arrested by the ED on March 21, shortly after the Delhi High Court denied his request for protection from arrest in relation to summonses issued to him.

On May 10, the Supreme Court granted Kejriwal interim bail until June 1 to campaign in the Lok Sabha elections, requiring him to return to jail on June 2.

On June 5, the trial court denied his request for interim bail, which he sought due to various health issues.

ED and Kejriwal’s Legal Team Present Arguments

During the hearing on Thursday, the ED claimed to have evidence of Kejriwal demanding Rs 100 crore in kickbacks related to the liquor policy case. The agency also alleged that these kickbacks from liquor vendors were used to finance AAP’s election campaign in Goa.

Additional Solicitor General SV Raju argued that there was a direct money trail linking proceeds of the crime from the South Group, involving BRS leader K Kavitha, to the AAP.

ASG Raju also alleged that Kejriwal refused to provide the password to his phone during the investigation.

“Kejriwal says my phone is sacrosanct. Mai password nahi dunga. (I will not give my password). We had to resort to the phone of Vinod Chauhan (accused in the case). He is sitting quiet. An adverse inference has to be drawn from the fact that Kejriwal has refused to give his password. This is a ground for refusing bail under ordinary bail law, forget section 45 PMLA for the time being,” ASG Raju said.

The ASG further claimed that Vinod Chauhan was involved in managing transfers and postings of Delhi government officials.

Kejriwal’s Defense

Kejriwal’s defense, led by senior advocate Vikram Chaudhary, argued that the ED’s allegations were unsubstantiated and lacked evidence.

Chaudhary also pointed out that Kejriwal had not been named in any chargesheet filed under the Prevention of Money Laundering Act (PMLA).

“Is ED an independent agency or playing in the hands of some political masters? The ED draws all its conclusions based on hypothesis,” Chaudhary said.

The extension of his judicial custody indicates a continuation of legal procedures and investigations regarding the alleged charges.

Further, the court has fixed May 10 for the pronouncement of the order.

Earlier too on April 18, the court deferred on charges framing against Singh after the application filed by BJP MP.

In his application, Singh wanted permission to keep further arguments on the framing of charges. He also sought direction for inquiry regarding his presence at the WFI office on September 7, 2022.

However, on April 26, the court later dismissed the plea under which he demanded further investigation into the sexual harassment case.

Meanwhile, the counsel appearing for the complainant argued that there is a strategy at play for causing the delay of application. Also claimed that documents could have been sought at the section 207 level of the CrPC.

This development comes around the time, when just last month, Delhi Police filed a charge sheet against Singh under sections 354, 354A, 354D and 506 (1) (criminal intimidation).

But a closure report was also filed under POSCO which was lodged against Brij Bhushan by a minor.

</excerpt>

The Rouse Avenue Court has granted Delhi Chief Minister Arvind Kejriwal additional time to file a rejoinder regarding the replies filed by the Enforcement Directorate (ED) on his two revisions against the summons issued to him. This comes after the ED issued summons to Kejriwal on two complaints.

“Special Judge Rakesh Syal, after hearing submissions of counsels appeared for Kejriwal, granted two weeks to file rejoinders and for arguments on revisions,” reports ANI. “The matters have been listed on May 14 for further hearing.”

Advocates Rajiv Mohan, Mudit Jain, and Mohd. Irshad appeared for Arvind Kejriwal, while N K Matta and Simon Benjamin represented the ED.

The delay in filing the rejoinders was attributed to Kejriwal’s arrest in the Delhi Excise policy case, with his legal team needing additional time to prepare. Kejriwal has been in custody until May 7.

“The ED has already filed replies to two revisions challenging the issuance of summons on the complaints filed by the Agency in the Delhi Excise policy case,” reports ANI.

Earlier, the court had refused to grant a stay on the summons issued to Kejriwal on complaints filed by the ED.

“Kejriwal has challenged the summons issued by the court after taking cognizance of two complaints filed by the ED for avoidance of the summons issued to him,” reports ANI.

Kejriwal’s legal team argued that there was no intentional disobedience on his part, as he had provided reasons for not appearing, including his responsibilities as the Chief Minister. They also argued that the trial court had issued summons hastily without considering Kejriwal’s responses.

On the other hand, the ED argued that intentional disobedience is a matter of trial and that Kejriwal’s actions, such as attending the CBI office but not the ED office, indicated intentional disobedience. The ED also stated that any person can be summoned in person under the Prevention of Money Laundering Act (PMLA).

“ASG S V Raju opposed the submissions by the counsels for the accused and submitted that whether disobedience is intentional or not is a matter of trial,” reports ANI. “This revision is against the order of summoning.”

In the first complaint, the Rouse Avenue Court had taken cognizance of the ED’s complaint against Kejriwal for not complying with the summons issued in the Delhi liquor policy money laundering case. The ED wants to record Kejriwal’s statement regarding the formulation of the policy and allegations of bribery.

“The AAP has accused the Lieutenant Governor of ordering a probe into alleged irregularities in the policy, leading to its scrapping,” reports ANI. “The then Delhi Deputy Chief Minister, Manish Sisodia, was arrested by the CBI in February in connection with the case.”

Chanpreet Singh, who worked for AAP as a freelancer from May-June 2021 to March 2022 for the Goa election campaign, received salaries from both AAP and m/s Wizspk Communications.

The ED sought direction from the court to send him to judicial custody, which was granted until April 23, 2024. The Delhi liquor policy case, according to AAP, relies solely on the statements of approvers, some of whom have ties to the BJP. AAP alleges a politically motivated investigation by the ED and points out that after two years of investigation and over 500 raids, no evidence has been found against AAP leaders.

Earlier, the Central Bureau of Investigation (CBI) had also arrested Singh in the same case, which originated from a CBI FIR. Various individuals, including Delhi Chief Minister Arvind Kejriwal, have been arrested by the ED in connection with the Delhi excise policy-linked money laundering case.

</excerpt>

K Kavitha, the leader of the Bharat Rashtra Samithi (BRS), made an appearance in court on Friday morning at Rouse Avenue after being detained by the Central Bureau of Investigation (CBI) in relation to a suspected liquor policy fraud. The Delhi Chief Minister Arvind Kejriwal was approached by a spirits businessman from the “South Group” who was looking for support with his business. Kejriwal allegedly promised this support, and the CBI used this evidence to request a five-day jail detention for Kavitha. Significant evidence, the CBI alleged, including statements from people connected to the case and conversations on WhatsApp.

The central probe agency elaborated, stating, “Dinesh Arora, an accused turned approver, confirmed in his statement that Abhishek Boinpally informed about the transfer of Rs 100 crores to Vijay Nair. Statements from Hawala operators corroborate payments totaling Rs 11.9 crores. Chats recovered from Buchibabu indicate her involvement in a partnership with Indospririts. Despite being blacklisted, licenses were allegedly granted to Indospririts due to pressure from accused Manish Sisodia.”

Kavitha, daughter of former Telangana Chief Minister K Chandrashekhar Rao, was arrested by the CBI while already in judicial custody for a money laundering case. The CBI arrested her on Thursday for her alleged involvement in the liquor policy scam under sections of criminal conspiracy and falsification of accounts, among others.

Previously, on April 6, Kavitha was examined by the CBI in Tihar Jail in connection with the case. The CBI informed Special Judge Kaveri Baweja that they had already conducted the examination on April 6 and opted not to file any further reply.

The Delhi Court had granted permission on April 5, 2024, for the CBI to examine Kavitha during her judicial custody in Tihar Jail at any time during the ensuing week. Through their application, the CBI sought court authorization to interrogate Kavitha and record her statement regarding WhatsApp chats recovered from Buchi Babu’s phone and documents related to a land deal allegedly involving a payment of Rs 100 crores to the Aam Aadmi Party in kickbacks.

On Tuesday, the Rouse Avenue Court remanded K Kavitha to judicial custody until April 23, 2024. This came after her recent arrest by the Directorate of Enforcement in connection with a money laundering case linked to the Delhi excise policy.

</excerpt>

The Rouse Avenue Court of Delhi on Wednesday rejected the petition filed by the Delhi Chief Minister Arvind Kejriwal, requesting an increase in the number of legal consultations with his lawyers from two to five times a week. The court noted that the Chief Minister had utilized the allocated time for purposes other than legal discussions.

Special Judge Kaveri Baweja issued the order, stating that Arvind Kejriwal, the applicant, did not demonstrate to the court’s satisfaction that he had been utilizing the two allowed legal meetings per week solely for discussing ongoing legal matters with his attorneys.

According to the status report submitted by the investigating agency, it was revealed that the applicant had provided specific instructions to be conveyed to the Water Minister through one of his attorneys (whose identity he declined to disclose to the investigating agency) during a legal consultation.

While presenting arguments in the case, ED Counsel Zoheb Hossain, along with Naveen Kumar Matta and Simon Benjamin, contended that the relief requested by the Accused/Applicant through the application under review is inconsistent with the rules and provisions, and therefore cannot be sanctioned. They emphasized that the applicant is not entitled to any preferential treatment.

The court observed that the status report, which was presented to the High Court of Delhi and is under investigation, was also presented before this court during the arguments. It was highlighted that the legal meeting was being misused by the applicant for purposes beyond its intended scope, as evidenced by the aforementioned note. It was argued that the applicant had instructed his lawyer during a legal interview to convey specific directions to the Water Minister.

Advocates Vivek Jain and Mohd Irshad represented Arvind Kejriwal and asserted that he is involved in numerous legal disputes across various states of India, including Punjab, Gujarat, Uttar Pradesh, Bihar, Goa, Assam, and Delhi. They emphasized that the applicant needs consultations with lawyers to provide suitable instructions for contesting these litigations.

Kejriwal’s legal representatives also argued that due to the considerable number of cases being contested by the applicant and the extensive examination of documents required, longer discussions with counsel are necessary. They therefore requested that the Accused/Applicant be allowed to have five weekly meetings with his lawyers to discuss and strategize various pending litigations effectively before the respective courts spanning multiple jurisdictions.

The Delhi High Court affirmed the legality of Arvind Kejriwal’s arrest by the Enforcement Directorate (ED) in an Excise Case on Tuesday, citing his repeated failure to comply with summons over a six-month period as a contributing factor.

The court stated that had Kejriwal participated in the investigation following the issuance of summons under Section 50 of PMLA, he could have provided his account to the investigating agency regarding the collected material.

Kejriwal was apprehended by the ED on March 21 in connection with the excise policy case.

On April 1, the trial court ordered Arvind Kejriwal to judicial custody until April 15. The ED asserted that the Aam Adami Party (AAP) is the primary beneficiary of the proceeds of crime generated in the purported liquor scam.

</excerpt>

The Rouse Avenue court in the national capital rejected Bharat Rashtra Samithi (BRS) MLC K Kavitha’s detailed interim bail application on Monday, which she filed citing her minor son’s school examinations.

Kavitha is currently in judicial custody following her remand by the ED in the excise policy case. The interim bail plea was dismissed by Special Judge Kaveri Baweja, though a comprehensive bail order is still pending upload.

The ED opposed Kavitha’s bail plea, alleging that she tampered with evidence on her phone and coerced witnesses into retracting their statements. Despite Kavitha’s plea for bail due to her son’s exams, the court sided with the ED’s arguments.

Senior advocate Abhishek Manu Singhvi, representing Kavitha, argued that exceptions under Section 45 of the Prevention of Money Laundering Act (PMLA) should apply to her as a woman. Singhvi emphasized the emotional support needed for Kavitha’s minor child during the exams.

However, advocate Zoheb Hossain, the special counsel for ED, countered these arguments, presenting evidence of Kavitha’s involvement in destroying evidence and influencing witnesses.

Hossain highlighted instances where Kavitha deleted data from her phone and tampered with multiple devices. He argued against granting interim relief to Kavitha, citing the ongoing investigative efforts and the risk of her influencing the probe.

Additionally, the ED counsel referred to statements made by Arun Pillai, indicating further complications in the case.

Kejriwal’s appearance followed the conclusion of his remand period in the Delhi Excise policy money laundering case.

While entering the court complex, Kejriwal criticized PM Modi, stating, “Pradhan Mantri jo kar rahe hain woh desh ke liye achha nahi hai (What the PM is doing is not right for the country),” speaking to reporters.

The Enforcement Directorate (ED) brought Kejriwal to the court under tight security. The ED sought direction to send him to judicial custody, stating that further custodial interrogation is not required at the moment. Additional Solicitor General SV Raju represented the ED.

During the proceedings, Kejriwal’s lawyers requested permission for him to carry prescribed medicine and several books, including the Bhagavad Gita, Ramayana, and ‘How Prime Ministers decide’ by Neerja Chaudhary, during his judicial custody in Tihar Jail.

Earlier, Arvind Kejriwal’s wife, Sunita Kejriwal, along with Delhi Ministers Saurabh Bharadwaj and Atishi, were present at the Rouse Avenue court before his appearance. Kejriwal’s arrest by the ED is related to his alleged involvement in a money laundering case linked to the Delhi Excise Policy.

On Sunday, Sunita Kejriwal addressed the INDIA bloc rally, sharing a message from her husband. She defended Kejriwal’s integrity and patriotism, challenging BJP’s calls for his resignation due to his custody status.

</excerpt>

A formal complaint has been lodged with the acting Chief Justice of the Delhi High Court concerning a protest organized by the Aam Aadmi Party’s legal cell in response to the arrest of Chief Minister Arvind Kejriwal. The legal cell has announced a protest to take place in all Delhi courts on Wednesday.

Complainant Vaibhav Singh, a practicing advocate, is urging immediate action to halt the unlawful protest organized by the Aam Aadmi Party’s legal cell and political workers within court premises. The complaint also calls for thorough investigations into professional misconduct by the Bar Council of India and the Bar Council of Delhi.

Furthermore, the complainant seeks directives from district and high court bar associations to initiate disciplinary measures against lawyers and political workers participating in the illegal protest within court premises. The complaint emphasizes the imposition of suitable penalties on the Aam Aadmi Party’s Legal Cell for orchestrating an unlawful protest within Delhi court premises.

According to the complaint, it has become a recurrent practice for political parties to involve their legal cell members in strikes, protests, boycotts, or token strikes to exert pressure on law enforcement agencies and, at times, even on the judiciary.

The complaint highlights a video posted by Sanjiv Nasiar, Advocate and Vice-Chairman of the Bar Council of Delhi, on his Twitter handle on March 26. Nasiar’s video allegedly deemed Chief Minister Arvind Kejriwal’s arrest illegal and accused the Enforcement Directorate of acting at the central government’s behest. Such allegations against law enforcement agencies and the central government, followed by the utilization of court premises for political purposes, are deemed severe violations of professional ethics and the rules of the Bar Council of India, as well as contrary to Supreme Court directives.

The Aam Aadmi Party’s Legal Cell has scheduled protests in various Delhi courts on Wednesday, including the Delhi High Court, Patiala House Court, Dwarka Court, Saket Court, Karkardoona Court, Tishazari Court, and Rouse Avenue Court.

</excerpt>

Delhi Chief Minister Arvind Kejriwal has moved the Delhi High Court, disputing every summons issued to him by the Enforcement Directorate (ED) concerning the excise policy matter.

A bench comprising Justice Suresh Kumar Kait and Justice Manoj Jain is set to address the issue on Wednesday.

As per the legal representatives of the Delhi Chief Minister, all nine summonses issued by the Enforcement Directorate (ED) have been challenged. The plea asserts that these summonses are unconstitutional and unlawful.

The plea has additionally contested the validity of various provisions of the Prevention of Money Laundering Act.

Kejriwal was granted bail by the Additional Chief Metropolitan Magistrate of Rouse Avenue Court last week concerning two complaints filed by the ED due to non-compliance with summons. Kejriwal physically appeared before the court during the hearing.

According to the ED, the agency aims to record Kejriwal’s statement in the case regarding matters such as the formulation of policy, meetings held before it was finalized, and allegations of bribery.

In its sixth charge sheet submitted in the case on December 2, 2023, implicating AAP leader Sanjay Singh and his associate Sarvesh Mishra, the ED alleged that the AAP utilized kickbacks worth Rs 45 crore, accrued through the policy, as part of its assembly elections campaign in Goa in 2022.

The now-scrapped excise policy was aimed “at revitalizing the city’s flagging liquor business” and replacing a sales-volume-based regime with a license fee for traders.

Lieutenant Governor Vinai Kumar Saxena initiated an investigation into purported irregularities within the policy. AAP has leveled allegations against Saxena’s predecessor, Anil Baijal, suggesting that he undermined the initiative by implementing a few eleventh-hour alterations that led to revenues falling below anticipated levels.

Two prominent AAP figures, Manish Sisodia and Sanjay Singh, are currently held in judicial custody as part of the case.

Sisodia, who served as the Deputy Chief Minister of Delhi at the time, was detained by the CBI on February 26 after undergoing multiple rounds of questioning. On October 5, the ED arrested Sanjay Singh, who holds a position as a Rajya Sabha member.

</excerpt>

Bharat Rashtra Samithi (BRS) lawmaker K Kavitha appeared before the Rouse Avenue Court in New Delhi on Saturday in relation to the alleged money laundering case linked to the Delhi excise policy. Kavitha, a Member of the Legislative Council (MLC) and the daughter of BRS founder and former Telangana Chief Minister K Chandrasekhar Rao, was taken into custody following a day-long interrogation and a raid at her Hyderabad residence on Friday.

Before her court appearance, Kavitha stated to reporters, “it is an illegal arrest.” She was presented before Special Judge MK Nagpal at the Rouse Avenue court.

In the arrest order, the Enforcement Directorate (ED) investigation officer stated, “I believe that Smt. Kalvakuntla Kavitha…has been guilty of an offence punishable under the provisions of Prevention of Money Laundering Act, 2002 (15 of 2003).” The officer further added, “Now, therefore, in exercise of the power conferred upon me…I hereby arrest the said Smt. Kalvakuntla Kavitha…”

This action follows nearly two months after the ED issued a summons to the 45-year-old BRS leader. She had been questioned three times last year in connection with this case, with her statement recorded under the Prevention of Money Laundering Act (PMLA).

Earlier today, Delhi Chief Minister Arvind Kejriwal also appeared before the Rouse Avenue Court in the national capital in response to an Enforcement Directorate summons. The court later granted him bail in both complaints filed by the Enforcement Directorate.

Additional Chief Metropolitan Magistrate (ACMM) Divya Malhotra granted bail to the Delhi CM, with bail set at Rs 15,000 and a surety of Rs 1 lakh.

Kejriwal’s appearance followed summons issued to him based on two complaints by the ED regarding the Delhi Excise Policy case. The court reserved an order on the stay of summons issued to Kejriwal on complaints filed by the ED.

The ED moved the court with a second complaint alleging non-compliance with summons in the Delhi liquor policy money laundering case.

The Additional Chief Metropolitan Magistrate Divya Malhotra passed the order, stating, “The Enforcement Directorate has moved a second complaint against Arvind Kejriwal under Section 190 (1)(a) CrPC r/w section 200 CrPC 1973 r/w section 174 IPC, 1860 r/w section 63 (4) of PMLA, 2002 for non-attendance in compliance with Section 50, PMLA, 2002.”

Earlier, the ED had filed a complaint against Kejriwal, and the court had issued summons. Kejriwal appeared virtually and expressed his intent to join the court proceedings physically. The court granted an exemption for the day and set March 16 for his physical appearance.

On the first ED complaint, the Rouse Avenue Court had taken cognizance on February 7 this year. Kejriwal had agreed to appear virtually after March 12, calling the ED summons “illegal.” The ED aims to record Kejriwal’s statement on policy formulation, meetings, and bribery allegations.

In the Delhi liquor policy money laundering case, the AAP has been accused of using kickbacks for its Goa assembly elections campaign. The policy was scrapped after an alleged probe into irregularities. AAP leaders Manish Sisodia and Sanjay Singh are already in judicial custody in the case. Sisodia was arrested by the CBI on February 26, while Singh, a Rajya Sabha member, was arrested by the ED on October 5.

Divya Malhotra, Additional Chief Metropolitan Magistrate, took cognizance of the case and summoned Delhi Chief Minister Arvind Kejriwal […]
</excerpt>

On Wednesday, the Rouse Avenue Court heard the Enforcement Directorate’s (ED) latest charge against Delhi Chief Minister Arvind Kejriwal for failing to comply with the central probe agency’s summons in the Delhi liquor policy money laundering case.
Divya Malhotra, Additional Chief Metropolitan Magistrate, took cognizance of the case and summoned Delhi Chief Minister Arvind Kejriwal to appear in court on February 17.

The ED filed a new complaint case on Saturday under sections 190 (1)(a) and 200 of the Code of Criminal Procedure, Section 174 of the Indian Penal Code, and Section 63 (4) of the Prevention of Money Laundering Act (PMLA) for non-compliance with Section 50 of the PMLA.
On February 2, Kejriwal ignored the Enforcement Directorate’s summons for the seventh time in connection with the money laundering investigation into irregularities in the Delhi excise policy 2021-22 case. The new summons to the Delhi Chief Minister follows the fourth summons, which he ignored on January 18.

The party claimed that omitting the fifth summons was “unlawful.”
Kejriwal has so far ignored four earlier summons issued by the ED on January 18, January 3, November 2, and December 22, claiming they were “illegal and politically motivated.”
According to the ED, the agency wants to record Kejriwal’s statement in the case about policy formation, discussions held before it was completed, and charges of bribery.
The ED alleged in its sixth charge sheet filed in the case on December 2, 2023, citing AAP leader Sanjay Singh and his aide Sarvesh Mishra, that the AAP used kickbacks worth Rs 45 crore generated under the scheme as part of their Goa assembly election campaign in 2022.

The excise policy was designed to revitalize the city’s struggling liquor industry by substituting a sales-volume-based system with a license charge for merchants. It promised swankier stores and an improved shopping experience. For the first time in Delhi, the policy included discounts and special offers on booze purchases.
The initiative was scrapped after Lieutenant Governor Vinai Kumar Saxena ordered a review into alleged regime irregularities. The AAP accuses Saxena’s predecessor, Anil Baijal, of sabotaging the move with a few last-minute tweaks that resulted in lower-than-expected income.
Two prominent AAP leaders, Manish Sisodia and Sanjay Singh, are already in judicial detention in the case.

The CBI arrested Sisodia, the then Delhi’s Deputy Chief Minister, on February 26 after multiple rounds of questioning. On October 5, the ED arrested Singh, a Rajya Sabha member.

According to sources, the raids are part of the agency’s ongoing money laundering investigation. An ED raid is also apparently underway at AAP MP ND Gupta’s residence in Delhi. More information about Tuesday’s raids is awaited.

These raids come as the agency filed a complaint in a Delhi court against AAP national convenor Arvind Kejriwal for failing to appear for a summons for the fifth time in a matter related to the Excise policy.

On February 3, the ED filed a complaint at Rouse Avenue Court against Delhi Chief Minister Arvind Kejriwal for failing to comply with the agency’s summons in the Delhi liquor policy money laundering case.

After hearing the submissions on Saturday, the Additional Chief Metropolitan Magistrate, Divya Malhotra, scheduled the remaining statements and consideration of the agency’s fresh complaint for February 7.

On February 3, the ED filed a new complaint case under Section 190 (1)(a) Cr.P.C. r/w. Section 200 Cr.P.C., 1973 r/w. Section 174 IPC, 1860 r/w. Section 63 (4) of PMLA, 2002 for non-attendance in accordance with Section 50 of PMLA, 2002.

On February 2, 2024, Delhi Chief Minister Arvind Kejriwal ignored the Enforcement Directorate’s summons for the seventh time in connection with the money laundering investigation into irregularities in the Delhi excise policy 2021-22 case.

The new summons to the Delhi Chief Minister came after he ignored the fourth summons on January 18.The party stated that omitting the fifth summons was “unlawful.” “Kejriwal has so far skipped four previous summons issued by the ED on January 18, January 3, November 2, and December 22, calling them “illegal and politically motivated.”

Earlier this month, a team from the Delhi Crime Branch went to Arvind Kjeriwal’s residence in civil lines and presented him with a notice to join a probe into claims that the BJP attempted to “poach” MLAs to destabilize his government.

Senior advocate Mohit Mathur appeared for Sanjay Singh.
He submitted that Sanjay Singh was not called even once for questioning before October 4, 2023.
He further argued, “My (Singh’s) legal notice sparked problems for them. Then they started noticing me.”
“I am not asking for discharge. I am asking for bail. My personal liberty is sacrosanct in the Constitution,” the Senior advocate submitted.
He also raised contradictions in the statement of accused turn approver Dinesh Arora, Chandan Reddy and other witnesses.
He submitted that Dinesh Arora’s statement is hearsay. Now he has a pseudo-name Alpha. How can one assume that Dinesh Arora is telling the truth?
It is a business deal and can’t see corruption in every business deal. Alpha said he got money from Nitin Kapoor who denied this fact, he added.

</excerpt>

The Delhi Rouse Avenue Court on Tuesday extended the ED’s remand of businessman Dinesh Arora in connection with the ongoing investigation into the Delhi excise policy scam. The Enforcement Directorate represented Arora in court today at the completion of his remand period.

On Tuesday, Special Judge MK Nagpal granted the ED’s remand application and extended Arora’s remand by 6 days. While seeking further remand, ED counsels claimed that while in ED custody, he was confronted with specific people and papers related to the payment transfer of cash and proceeds of crime.

The ED further added that he has divulged certain critical facts and identities of those receiving proceeds of crime, but that searches are being conducted in Delhi and the NCR based on the information provided by the accused, which will result in the recovery of incriminating material.

According to the ED, three more people have already been summoned to join the investigation, including one person whose premises are being searched today, and they are expected to join the investigation in a day or two. The accused is also to be confronted with the people and to find the destination of the Rs 2 crore in criminal proceeds.

In the same case, Arora has been designated as an approver by the Central Bureau of Investigation (CBI). “I have not seen the grounds of arrest. Please see the background. It is a peculiar case. Before pardon was given on November 16, 2022, ED had called him in September,” Vikas Pahwa, senior counsel, appearing for Dinesh Arora submitted.

“His statements are being relied upon by the ED in various Prosecution Complaints. This court while rejecting bail, has ‘relied on his statement’,” the counsel submitted.

This decision came after an application was filed by Manish Sisodia’s legal team, alleging that he had been mistreated by security personnel inside the court premises.

Furthermore, the Delhi Police also submitted an application to the court, seeking permission to produce Sisodia solely through video-conferencing. The request was made due to concerns that physical production of Sisodia in court leads to chaos, with the presence of AAP supporters and journalists in the court corridors. Special Judge MK Nagpal took note of this situation and clarified that until a decision is made regarding the application, Sisodia will only be presented in court through video conferencing, and there will be no physical appearance in court.

Sisodia was also produced in court today through video conference from the court’s lockup.
Earlier, the Court took cognisance of the supplementary charge sheet filed against former Delhi Deputy CM Sisodia in the Money Laundering case related to the Delhi Excise policy case.The supplementary charge sheet filed by ED alleged that a proceed of the crime of around Rs. 622 crore has been generated due to activities of the present accused Manish Sisodia. The supplementary charge sheet was filed by special public prosecutor Naveen Kumar Matta.The supplementary charge has more than 2100 pages. The operating part has 271 pages. The charge has been filed within the stipulated period of 60 days.

Dhall is the director of Brindco Sales and was previously detained by the ED in connection with an alleged money-laundering scheme involving an excise fraud. The CBI detained Amandeep Dhall on Tuesday from Tihar Prison in connection with an excise policy corruption investigation.

On Wednesday, Special Judge MK Nagpal granted the CBI’s request for Dhall to remain in custody.
Dhall was lodged in Tihar Jail, in judicial custody, in connection with a money laundering case, which is tied to the excise case. He has moved a bail plea in the ED case and a hearing on the same has been scheduled for 26 April.

The CBI, through an application, stated, “Some fresh evidence has surfaced which requires further examination of Amandeep Singh Dhall to unearth the conspiracy hatched between the accused in relation to the Excise case”.

The executive director of Brindco Sales Private Limited, Dhall was arrested on 1 March, 2023, by the Enforcement Directorate (ED) under provisions of the Prevention of Money Laundering Act (PMLA) in the Excise case.
