</excerpt>

The Delhi Police stated on Tuesday that the current accused is responsible for the offence, which carries a life sentence or the death penalty, and they rejected the bail request of accused Neelam Azad in the Parliament security breach case.
The accusations made against the defendant are vile, serious, and extremely serious. The police claim that the accused are involved in undermining India’s sovereignty and integrity.
The current accused is not entitled to bail because there is compelling, convincing, clinching, and credible material, evidence, and other documents against him. According to the police, there is sufficient, substantial, and appropriate evidence, along with other documents, against the current accused that demonstrate his involvement.

The police further stated that the material, evidence and other documentary evidence show her complicity in the offence and thus disentitle her to be released on bail.
Prima facie, there are reasonable grounds against the accused person that negate the extension of bail considering the fact that the investigation is pending, said the Delhi Police.
The accused persons are powerful and influential, which is detrimental to the investigating agency if they are released on bail. The nature of the offence, or gravity of the offence, and the severity of punishment are also relevant considerations at the stage of consideration of bail, further stated the Delhi Police.
Advocate Akhand Pratap Singh appeared for the Delhi Police and Advocate Suresh Chaudhary appeared for the accused, Neelam Azad, in the matter.

</excerpt>

The Delhi Police’s Special Cell filed a request in Patiala House Court on Thursday to be allowed to test all of the defendants in the Parliament Security Breach Case with a polygraph.
The matter was continued until January 2, 2024 by Additional Sessions Judge Dr. Hardeeep Kaur, who noted that certain accused individuals were not represented by a court-appointed lawyer.
During the plea hearing, all six of the accused who had been apprehended were also brought before the court.
The jail remand of all six defendants was extended by the court last week until January 5, 2024.
The Delhi Police’s public prosecutor, Akhand Pratap Singh, stated that a thorough inquiry was necessary to uncover a more extensive conspiracy that underpinned this well-planned attack.

Police also sought custodial remand to find actual motive behind the attack and accused association with any other enemy country as aell as terror organizations.
The security breach happened on the anniversary of the 2001 Parliament terror attack. Two people–Sagar Sharma and Manoranjan D–jumped into the Lok Sabha chamber from the public gallery during Zero Hour, released yellow gas from canisters and shouted anti-establishment slogans before being overpowered by the MPs. Outside it, in another incident, two protestors — Neelam (42) and Amol (25) — protested outside the Parliament with similar gas canisters.
Later Police had arrested two more accused Lalit Jha and Mahesh Kumawat in the case after finding their crucial role in the conspiracy.

</excerpt>

The Patiala House Court of Delhi expended the custodial remand of the accused Lalit Jha by 14 days on Friday. He was produced before the concerned court by the Special Cell of Delhi Police at the end of the remand period granted earlier last week by the same court. The court has extended custody of Lalit Jha till January 5, 2023.

Along with Lalit Jha, Manoranjan D, Sagar Sharma, Neelam Azad, Amol Shinde and Mahesh Kumawat were also arrested in the Parliament Security Breach Case. Reportedly, Manoranjan D and Sagar Sharma were arrested for jumping into the Lok Sabha hall from the visitor’s gallery and opening smoke cans to create a chaos while Neelam Azad and Amol Shinde were arrested for opening smoke canisters outside the Parliament building.

The incident took place on December 13. Kumawat allegedly contacted the main accused Jha and others through the Facebook group ‘Bhagat Singh Fan Page.’ Jha is accused of destroying evidence of the conspiracy.

Appearing for the Delhi Police, Public Prosecutor Akhand Pratap Singh further stated that a thorough investigation is necessary to uncover the larger conspiracy behind this well-planned attack. The police also sought his arrest to find out the real motive behind the attack and his connection with other enemy countries and terrorist organizations. The police will also confront all the accused against each other.

The Masterplan

Police officials confirmed that Jha disclosed that, all the accused individuals met several times to strategize the conspiracy before they executed it. Delhi Police further stated that Jha and the others planned this entire thing to create anarchy in the country and to compel the government to meet their demands.

Lalit Jha also destroyed the phones of all the accused people to hide the evidences of the conspiracy. He threw away the mobile phones on his way from Jaipur to Delhi. Earlier, two Deputy Commissioners interrogated Jha where he narrated the whole incident.

The interrogation threw light upon the planning. The preparations for the attack began months ago. Nobody can enter the premises of the Parliament without an entry pass so Lalit asked everyone who could arrange the passes so that his team mates could easily enter.

Along with this, two pair of shoes were made in special order as Lalit discovered that shoes do not get checked so they are perfect to hide the smoke cans. Lalit was continuously keeping an eye on the police movements and ongoing developments through news channels, as informed by the police officials.

Brief about the Attack

The security of the Parliament was compromised on the anniversary of the 2001 Parliament terror attack. The two accused individuals, Manoranjan D and Sagar Sharma jumped out of the visitor’s gallery into the Lok Sabha hall during Zero Hour. They released yellow gas from the canisters as they yelled anti-establishment slogans before the MPs overpowered them, leading to their arrest.

Meanwhile, Neelam Azad and Amol Shinde protested outside the Parliament with similar gas canisters. All the four people involved in the planning and execution of the conspiracy were arrested and sent to seven-day custody of Delhi Police Special Cell on Thursday.

The Central Hall of Samvidhan Sadan, the old Parliament building, resonated with solemnity as Lok Sabha Speaker Om Birla and Deputy Chairman of Rajya Sabha, Harivansh Narayan Singh, led a group of parliamentarians in heartfelt floral tributes to the late former Prime Minister Chaudhary Charan Singh on his birth anniversary.

In a dignified gathering, Secretary General of Lok Sabha Utpal Kumar Singh joined in paying homage to the esteemed leader, emphasizing the significance of the occasion. As a mark of remembrance, a meticulously crafted booklet detailing the life and achievements of Chaudhary Charan Singh, published in both Hindi and English by the Lok Sabha Secretariat, was presented to the distinguished attendees.

This ceremony echoes the tradition initiated on December 23, 1993, when Chaudhary Charan Singh’s portrait was unveiled in the Central Hall of Parliament House. The event was graced by the then-President of India, Dr. Shanker Dayal Sharma. The continued observance of this tradition underscores the enduring legacy and impact of the visionary leader on Indian political history.

Chaudhary Charan Singh, also known as a farmer leader, served as the fifth Prime Minister of India from July 1979 to January 1980.
On Saturday, the Patiala House Court in Delhi extended Mahesh Kumawat’s police custody, the sixth accused in the Parliament security breach case, by 13 days. The extension was granted by Special Judge Dr Hardeep Kaur in response to an application filed by the Delhi Police as part of the ongoing investigation into the breach incident.

The Delhi Police, represented by special public prosecutor Akhand Pratap Singh, stated that a psychological test of the accused was underway and further custody was necessary to confront him based on the psychology analysis report. Mahesh Kumawat had been in police custody for seven days before the extension.

Mahesh Kumawat was arrested in connection with the Parliament security breach incident on December 13. During the last hearing, the Delhi Police apprised the court that the conspiracy behind the breach had been in progress for over a year. They revealed that Mahesh attended all meetings held in various cities related to the conspiracy.

The public prosecutor disclosed that Mahesh had been in contact with the other accused for the past two years and actively participated in the conspiracy. His involvement extended to the destruction of a mobile phone and providing evidence to the prime accused and mastermind, Lalit Jha.

The police claimed that Mahesh, along with others, aimed to create anarchy in the country and compel the government to meet their ‘unjust’ and ‘illegal’ demands.

Simultaneously, the Delhi Police’s Special Cell conducted psycho-analysis tests on all the accused involved in the case. The tests, conducted at a government institute in Rohini, included Mahesh Kumawat and Lalit Jha. Additionally, the Special Cell is working on reactivating the destroyed SIM cards of all the accused, a move expected to yield new leads in the ongoing investigation.

The Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023, and the Press and Registration of Periodicals Bill, 2023 were among the bills passed on Thursday.

The winter session, which began on December 4, witnessed a security breach incident on December 13 when two individuals jumped into the Lok Sabha chamber. The session also saw the suspension of 100 opposition MPs, with most of them suspended for the remainder of the winter session due to “misconduct.” The opposition members had demanded a statement from Home Minister Amit Shah over the security breach incident.

In addition to these developments, the Lok Sabha passed three significant bills on Wednesday, aiming to replace the Indian Penal Code (IPC) of 1860, the Code of Criminal Procedure (CrPC), and the Indian Evidence Act of 1872. Home Minister Amit Shah highlighted that these bills mark the first time changes have been made in the laws governing the nearly 150-year-old criminal justice system.

The winter session of Parliament was originally scheduled to conclude on December 22. The session has been marked by crucial legislative discussions, security concerns, and disciplinary actions against certain members of the opposition.

The Patiala House Court has granted a 15-day extension to the custodial remand of four accused individuals—Manoranjan, Neelam, Sagar, and Anmol—in the Parliament security breach case. The accused will remain in the custody of the Special Cell of Delhi Police until January 5, 2024. The case revolves around the security breach that occurred on December 13 when two individuals jumped into the Lok Sabha chamber, triggering smoke cans and raising slogans.

Earlier in the day, the Counter Intelligence Unit (CIU) of the Special Cell brought all six accused in the Parliament breach case to recreate the event. This exercise aimed to match the sequence of events as per the versions provided by the accused. The accused had allegedly formed a WhatsApp group with 7-8 members to plan and share the entire conspiracy for breaching multiple levels of security and entering Parliament.

The Special Cell is actively engaging with all members of the group and seeking assistance from the Indian Computer Emergency Response Team (CERT-In) to retrieve the email used by one of the accused. The individuals were kept in different units of the Special Cell, where they underwent sustained interrogation. On Wednesday, the accused were handed over to the CIU for joint interrogation.

The security breach occurred on the 22nd anniversary of the 2001 terror attack on Parliament. Two individuals, Sagar Sharma and Manoranjan D, jumped into the Lok Sabha chamber from the public gallery during Zero Hour, deploying smoke cans and raising slogans before being overpowered. Simultaneously, two protestors, Neelam and Amol, demonstrated outside Parliament with similar gas canisters. All four were arrested and remanded in the custody of the Special Cell for seven days.

The Delhi Police is working to have the SIM card destroyed by the accused reissued to access the email used by one of them. Additionally, six teams from the Special Cell have been assembled to visit locations linked to the accused in Lucknow, Mysuru, Karnataka, Rajasthan, Maharashtra, and Haryana. Investigations have revealed that two pairs of shoes were specially ordered in Lucknow, as the accused aimed to exploit the lack of shoe checks for visitors to the new Parliament, allowing them to hide smoke cans under their footwear.

Congress leader Shashi Tharoor, in response to the mass suspension of opposition MPs from Parliament, declared a crisis for parliamentary democracy in India. Tharoor, a suspended Lok Sabha MP, participated in a march from the Parliament building to Vijay Chowk, protesting against the suspension of opposition lawmakers who were seeking Union Home Minister Amit Shah’s statement on the December 13 security breach.

Tharoor criticized the government’s disregard for its responsibility to run Parliament in a parliamentary democracy, highlighting the refusal of Shah to appear in the House after a major security breach. Tharoor expressed disappointment over the suspension of MPs who demanded the Home Minister’s presence and a discussion on the issue. He called the government’s actions unacceptable and a failure to honor the conventions of parliamentary democracy.

The passage of three criminal law bills in the Lok Sabha in the absence of 97 MPs was termed a “disgrace” by Tharoor. He criticized the government for bulldozing laws without consultation or discussion with the opposition, stating that it is a moment to contemplate the decline of parliamentary democracy in the country.

A total of 143 MPs—97 from Lok Sabha and 46 from Rajya Sabha—have been suspended for disrupting proceedings and demanding a statement from Union Minister Amit Shah on the Parliament security breach incident. Tharoor’s remarks reflect growing concerns about the state of democracy in the wake of the recent events in Parliament.

Another suspended MP, John Brittas of CPI(M), suggested that the Centre should amend the Constitution to declare India a monarchy. He characterized the situation as the brutal killing of democracy, asserting that the country has become an “Opposition-Mukt Parliament.”

Meanwhile, Rajya Sabha Leader of Opposition Mallikarjun Kharge denounced the passage of important legislations by suspending opposition MPs, describing it as a form of authoritarianism rather than democracy. Kharge called on the people of India to save democracy, emphasizing the need to raise voices against what he referred to as “dictatorship.”

</excerpt>

Addressing a press conference in Lucknow on Thursday, Bahujan Samaj Party (BSP) chief Mayawati expressed deep concern over the suspension of approximately 150 opposition Members of Parliament (MPs) in both the Rajya Sabha and Lok Sabha. Characterizing this move as a regrettable incident in Parliamentary history, Mayawati emphasized that such actions undermine the credibility of the government and opposition alike.

Mayawati asserted, “Our party believes that the suspension of about 150 opposition MPs in both Houses during the current session of Parliament is neither good work nor a good record for the government or the opposition.” She described the development as unfortunate and suggested it could erode the public’s trust in the democratic process.

The suspension of 143 MPs—97 from the Lok Sabha and 46 from the Rajya Sabha—occurred due to disruptions and chaos, with the opposition demanding a statement from Union Minister Amit Shah regarding the recent Parliament security breach. Mayawati also criticized the viral video of suspended MPs mocking the Rajya Sabha Chairman, deeming it inappropriate.

During the press conference, Mayawati emphasized the need to preserve democratic parliamentary traditions, urging cooperation between the government and the opposition. She stressed the importance of involving the opposition in passing significant bills that impact the common people, asserting that responsibility for upholding parliamentary traditions lies with all parties collectively.

Commenting on the security breach incident, Mayawati called it a matter of serious concern. She advocated for strict legal action against those responsible for the breach, urging a collective effort to prevent such incidents in the future. Mayawati also highlighted the need for heightened vigilance by the intelligence department to avert security lapses.

The security breach, coincidentally on the anniversary of the 2001 Parliament terror attack, involved intruders entering the Lok Sabha chamber and releasing yellow gas before being subdued. Four individuals, facing charges under anti-terror laws, were taken into custody by the Delhi Police Special Cell. Additionally, a friend of one intruder has been detained for questioning in connection with the case.

The disruptions centered around the recent Parliament security breach incident and the suspension of 78 MPs on Monday, marking the largest-ever action in the history of the Indian Parliament. In the Lok Sabha, Speaker Om Birla appealed to members to allow the Question Hour to proceed smoothly, emphasizing the importance of maintaining the House’s dignity. However, the Opposition MPs continued their protests, ignoring the Speaker’s call. Union Parliamentary Affairs Minister Pralhad Joshi claimed that Opposition members brought morphed photos of Prime Minister Narendra Modi into the House, condemning the act.

Meanwhile, suspended MPs from the INDIA bloc parties staged protests on Parliament premises, joined by Congress Parliamentary Party Chairperson Sonia Gandhi. The protests come a day after the suspension of 78 MPs—33 from Lok Sabha and 45 from Rajya Sabha—for the remainder of the Winter Session. The suspensions were a result of disruptions over the Opposition’s demand for a statement from Union Home Minister Amit Shah on the Parliament security breach. The unprecedented move, combined with earlier suspensions, brought the total number of lawmakers suspended for the ongoing session to 92. While 34 Rajya Sabha MPs were suspended for the rest of the Winter Session, 11 others had their ‘misconduct’ cases referred to the Privileges Committee. The ongoing Winter Session is scheduled to conclude on December 22, raising concerns about the functioning of Parliament amid heightened tensions between ruling and opposition parties.

Chairman Dhankhar had earlier rejected four notices under Rule 267 submitted by Opposition MPs, stating that they lacked merit. The suspension of 45 MPs on Monday was a response to their “misconduct” during House proceedings.

34 suspended MPs are barred from remaining in the Winter Session, while 11 face suspension until the Rajya Sabha’s Committee of Privileges reports are received.
