Know everything about Digital Personal Data Protection Bill 2023

Lok Sabha passed the Digital Personal Data Protection Bill, 2023 earlier. Here’s everything you need to know about the Bill.

The Bill will apply to the processing of digital personal data within India, whether obtained online or offline and then digitized. It will also apply to such processing performed outside of India if it is for the purpose of providing goods or services in India.

Personal data may be processed only for authorized purposes with an individual’s consent. Consent may not be necessary for certain lawful purposes, such as the individual’s voluntary sharing of data or processing by the State for permits, licenses, rewards, and services.

Data fiduciaries will be required to keep data accurate, secure, and erase it once its purpose has been fulfilled. Individuals are granted specific rights under the Bill, including the ability to acquire information, seek rectification and erasure, and have their grievances heard.

The central government may exclude government agencies from the Bill’s provisions in the interest of stated reasons such as state security, public order, and crime prevention.

The national government will establish the Data Protection Board of India to rule on noncompliance with the Bill’s requirements. Exemptions from data processing by the state for reasons such as national security may result in data collection, processing, and retention that exceeds what is required. This could be a violation of the fundamental right to privacy.

The Bill does not address the risks of harm associated with the processing of personal data. The Bill does not offer the data principal the right to data portability or the right to be forgotten.

Except for nations recognized by the central government, the Bill provides for the transfer of personal data outside of India. This mechanism may not enable proper review of data protection standards in countries where personal data transmission is permitted.

Members of India’s Data Protection Board will be appointed for a two-year term and will be eligible for reappointment. The short term with the possibility of reappointment may have an impact on the Board’s independence.

Monsoon Session: National Research Foundation Bill introduced in Lok Sabha

Dr. Jitendra Singh, Union Minister of Science and Technology, introduced the Anusandhan National Research Foundation Bill (NRF), 2023, in the Lok Sabha on Friday.

Earlier in June, the Union Cabinet adopted the NRF Bill, allocating 50,000 crore over five years to encourage research and development in the country through various levels of India’s research institutions, colleges, and universities.

In a statement issued the same month, the ministry of science and technology said, “The bill, after approval in Parliament, will establish NRF, an apex body to provide high-level strategic direction of scientific research in the country as per recommendations of the National Education Policy (NEP), at a total estimated cost of ₹50,000 crore during five years (2023-28).”

Parliament Monsoon session, Day 8: Expected return of Manipur violence to the forefront

The Manipur issue is likely to once again take center stage when Parliament reconvenes on Monday for what is predicted to be another turbulent session. Due to the violence in the northeastern state, the Monsoon session, which started on July 20, has been marred by disruptions and walkouts.

Members of Parliament from the I.N.D.I.After spending two days in the violent state, a group came back to New Delhi on Sunday. On Monday, the multi-party delegation of 21 MPs from the Indian National Developmental Inclusive Alliance will gather in the chamber of the leader of the opposition, Mallikarjun Kharge, in Parliament to receive an update on the situation in the troubled northeastern state. The members of the delegation will brief I.N.D.I. floor leaders. a coalition this morning at 9:30 in the Parliament building. Inside of Parliament, the Opposition will launch its assault on the Center.

The notice for a no-confidence motion against the government in the Lok Sabha was submitted by the Opposition front on Wednesday. The motion was later approved by the Lok Sabha Speaker Om Birla following the required headcount of over 50 MPs. Birla stated that he will set a date and time for the discussion after consulting with all parties. At 11 am, both Houses will convene.

The Bill replacing the Centre’s Ordinance on control of services in Delhi is on the government’s agenda for this week in both Lok Sabha and Rajya Sabha.
The Government of National Capital Territory of Delhi (Amendment) Bill, 2023, seeks to replace the ordinance brought by the Centre in May which excluded ‘services’ from the legislative competence of the Delhi legislative assembly. The ordinance was brought days after the Supreme Court judgement on the control of services in Delhi.
Meanwhile, Union Minister of Information and Broadcasting Anurag Thakur will introduce the Press and Registration of Periodicals Bill, 2023 in the Rajya Sabha today to provide for press, registration of periodicals and for matters connected therewith or incidental thereto. He will also move the Cinematograph (Amendment) Bill, 2023 in the Lower House today for its consideration and passage further to amend the Cinematograph Act, 1952.

Monsoon session: Dhankhar holds meeting with Opposition leaders to end deadlock in House

In the midst of the Rajya Sabha’s disruptions over the Manipur issue and the Opposition’s demand for Prime Minister Narendra Modi’s statement in Parliament, Rajya Sabha Chairman Jagdeep Dhankhar met with leaders of all Opposition parties on Friday to discuss the House’s proceedings next week.

After the meeting, Union Minister Piyush Goyal addressed a news conference and stated, “The Chairman has suggested that this logjam be broken through proper discussion.”

He further added that “the chairman emphasised that the Parliament should function properly through dialogue, debate and discussion. It is a forum to discuss public issues…He suggested that this logjam should be ended through proper discussion. Everyone should participate for the proper functioning of the Parliament.”

The meeting was an attempt to reach out to the opposition in order to restore normalcy and allow the House to function.

Chairman Jagdeep Dhankhar has directed that all leaders relay the chairman’s message to their respective top leadership and make a sensible choice within two or three days.

“Chairman was very upset and emotional about the way one member behaved in the House during the proceeding,” Goyal added.

Amarendra Dhari Singh, an MP from Rashtriya Janata Dal (RJD) who attended the meeting, told the news agency that, “We had the meeting with the Chairman, and its a long discussion meeting and he heard all of us and he appealed with due respect to all the members for smooth functioning of the House.”

Parliament Monsoon session, Day 6: I.N.D.I.A alliance MPs to wear black attire to protest over Manipur

To express their outrage over the situation in Manipur, all members of parliament from the Indian National Developmental Inclusive Alliance (I.N.D.I.A.) will attend parliament wearing black clothing. Congress and other opposition parties have been calling for Prime Minister Narendra Modi to make a statement and engage in a thorough discussion of the circumstances in Manipur. Since the start of the monsoon session of Parliament on July 20, they have turned to protests and sloganeering in both Lok Sabha and Rajya Sabha, forcing adjournments of the two Houses.

In the meantime, on Thursday in Parliament, the floor leaders of the opposition parties will meet with Mallikarjun Kharge, the leader of the opposition in the Rajya Sabha, to discuss crucial issues. On Wednesday, Speaker of the Lok Sabha Om Birla accepted the no-confidence motion against the government introduced by Congressman Gaurav Gogoi on behalf of the I.N.D.I.A alliance of opposition parties. The Speaker inquired about the number of members who supported the motion after Gogoi moved it.

It remains to be seen whether the Lok Sabha Speaker Om Birla will specify the date and time of the debate over the no-confidence motion passed against the Central Government by the I.N.D.I.A alliance.

Lok Sabha passed Forest Conservation (Amendment) Bill, Here’s what you need to know about it

The Forest Conservation (Amendment) Bill, which includes disputed exemptions for construction on forestland, was passed in the Lok Sabha on Wednesday, despite opposition protests about Manipur violence.

Earlier in the day, six bills were brought in the Lok Sabha, four of which were connected to Jammu and Kashmir, as the administration pushed its legislative agenda after Speaker Om Birla admitted the no-confidence motion against the government moved by the Congress and other opposition parties.

The Jammu and Kashmir Reservation (Amendment) Bill, 2023, the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023, and the Constitution (Jammu and Kashmir) Scheduled Castes Order (Amendment) Bill, 2023 were introduced in the House.

Two more bills were introduced: the Registration of Births and Deaths (Amendment) Bill, 2023, and the Mines and Minerals (Development and Regulation) Amendment Bill, 2023.

Meanwhile, the Rajya Sabha experienced many disruptions as opposition members pressed for a discussion on the Manipur crisis under Rule 267. Piyush Goyal, the Speaker of the House, objected to the remarks made by Congress leader P Chidambaram about the Chair.

Chairman Jagdeep Dhankhar stated that the original words of Congress members and his subsequent clarification remarks were in conflict.

The Lok Sabha Speaker accepted a no-confidence resolution against the government proposed by Congress MP Gaurav Gogoi on behalf of the I.N.D.I.A alliance of opposition parties.

“Honourable members, I have to inform the House that I have received a motion of no confidence in the Council of Ministers from Gaurav Gogoi,” Birla said.

He furthermore admitted the motion after ascertaining support to it and said the time of debate will be communicated later.

PM links us with terrorist organisations, Kharge replies to Amit Shah’s letter

On Wednesday, Rajya Sabha Leader of Opposition Mallikarjun Kharge responded to a letter from Union Home Minister Amit Shah seeking cooperation from opposition parties in Parliament for a discussion on the Manipur issue.

In response to the letter, Kharge remarked that the government’s attitude in Parliament, as outlined by the Home Minister in the letter yesterday, did not reflect reality.

Amit Shah issued a letter to both the Leaders of the Opposition in Lok Sabha and Rajya Sabha on Tuesday, saying that the government is ready for a full-fledged debate.

“The Opposition is demanding a statement from the government on Manipur. I want to tell you that not just a statement, the government is ready for a full-fledged discussion. But this will need the cooperation of all parties. Through you, I appeal to all Opposition parties that please come forward for a discussion in a good environment,” Amit Shah said in his letter.

To reply to the letter of Union Home Minister, Kharge on Wednesday said, “There is a difference between the words and actions of the government’s sentiments expressed in your letter.

“Contrary to the spirit of your letter, the attitude in the House has been insensitive and arbitrary. This attitude is not new and Opposition has also been seen in the last several sessions.”

Parliament Monsoon session: Several opposition MPs move notices seeking discussion on the Manipur situation

On Tuesday, the fourth day of the Monsoon session of the Parliament, a number of MPs from opposition parties filed notices in the Lok Sabha and Rajya Sabha requesting a debate on the Manipur issue, which has been a major source of impasse in both Houses ever since the session began.

In Lok Sabha, Congress MPs Manish Tewari, and Gaurav Gogoi have moved Adjournment Motion Notice demanding a discussion on the Manipur situation. Opposition Rajya Sabha MPs K Keshava Rao, KR Suresh Reddy, Joginipalli Santosh Kumar, Badugula Lingaiah Yadav, Ranjeet Ranjan, Manoj Jha, Syed Naseer Hussain, Tiruchi Siva, Imran Pratapgadhi have moved Suspension of Business Notice under Rule 267 to discuss the situation prevailing in Manipur.

Significantly, a meeting of the members of the Indian National Developmental Inclusive Alliance (I.N.D.I.A) has been convened at the office of Congress national president and the Leader of the Opposition in Rajya Sabha, Mallikarjun Kharge to chalk out a floor management strategy before the Upper House goes into session.
The meeting of the floor leaders will be held at 10 am.
The proceedings of Lok Sabha and Rajya Sabha were cut short on Monday amid a ruckus by opposition leaders, demanding Prime Minister Narendra Modi precede a discussion on the Manipur issue in both Houses.
Today in Lok Sabha, Sixty-sixth Report on ‘Excesses over Voted Grants and Charged Appropriations (2020-21)’ is scheduled to be tabled.
Union Minister Anurag Thakur is to make a statement regarding the status of implementation of the recommendations contained in the 351st report of the Standing Committee on Education, Women, Children, Youth and Sports on Demands for Grants (2023-24) pertaining to the Ministry of Youth Affairs and Sports, according to the Lower House.

The 20th report (Seventeenth Lok Sabha) of the Committee on “Tidal Power Development in India” is scheduled to be tabled after the Rajya Sabha resumes business on Tuesday at 11 a.m. This report details the government’s response to the criticisms and suggestions made in that report. Additionally, a copy of the 22nd report on “India’s Neighbourhood First Policy” from the department-related Parliamentary Standing Committee on External Affairs (Seventeenth Lok Sabha) will be laid on the table in the Upper House.

Parliament Monsoon session: MPs from opposition parties move notices requesting discussion on Manipur situation

Congress and other party MPs, including AAP, moved notices in both the Lok Sabha and the Rajya Sabha on Monday, demanding discussions on the situation in the violently disturbed state. This comes as opposition parties prepare to launch their attack on the Centre in Parliament, which has been plagued by disruptions since the Monsoon session began. In accordance with Rule 267, Congress MP Ranjeet Ranjan requested a discussion on the “grave matter of atrocities against women resulting from the ongoing violence in Manipur” and the “persistent failure of both the Union and Manipur Government in resolving the issues and facilitating the peace process.”

In addition, Manoj Kumar Jha of the Rashtriya Janata Dal (RJD), Binoy Viswam of the Communist Party of India (CPI), Tiruchi Siva of the Democratic Progressive Party, and Sanjay Singh and Raghav Chaddha of the Aam Aadmi Party have requested a suspension of business in the Upper House in order to discuss the Manipur situation.

Notably, earlier in the day, Congress Lok Sabha MPs Manickam Tagore, and Manish Tewari have proposed adjournment motion notices to discuss the situation of the northeastern state with the latter asking to suspend Zero Hour, Question Hour, and other businesses of the day to have a discussion regarding “ongoing ethnic clashes”.
The Monsoon session began on July 20 amid the pandemonium over Manipur violence, with the oppposition demanding Prime Minister Narendra Modi’s statements on the same “inside the House and not outside”.

Earlier on Sunday, Union Information and Broadcasting Minister Anurag Thakur hit out at the oppposition, stating that it is running away from the proceedings of the parliament.
Speaking to the media, Thakur said, “The government is ready for the discussion on Manipur but the opposition is avoiding the same. They are also running away from the proceedings of the parliament. What is their compulsion? They want to remain in the limelight but do not want to be in the discussion”.

Parliament Monsoon Session: Manipur issue is brought up by MPs from several opposition parties

Prior to the Monsoon session of Parliament, which starts on Thursday, a number of opposition MPs have submitted notices in both the Lok Sabha and the Rajya Sabha calling for discussions on the situation in Manipur in light of a recent controversy following the release and widespread distribution of a video showing two women being paraded naked.

The women were allegedly gangraped and the Manipur Police police said an investigation is on. Aam Aadmi Party MP Sanjay Singh has given suspension of Business Notice in Rajya Sabha under rule 267. and demanded to discussion on Manipur violence.
Congress MP Gaurav Gogoi and AIMIM’s Asaduddin Owaisi has moved adjournment motions in Lok Sabha over the issue.

Congress’ Manickam Tagore gave adjournment motion notices in Lok Sabha on the Manipur situation demanding a discussion on the “violence against women and children in the northeastern state.”
CPI MP Binoy Viswam, Rashtriya Janata Dal MP Manoj Jha and Congress MP Ranjeet Ranjan also gave suspension of Business Notices in the the Upper House under rule 267, to discuss the Manipur situation.

Manipur has been witnessing violence since May 3, following the protests by the Kuki and Naga communities against the High Court’s order asking the state government to consider the inclusion of Meitei community in the category of Scheduled Tribes (ST). Only STs can buy lands in hilly areas.
The majority Meitei community, which occupy the Imphal valley and nearby areas, sought the ST status keeping in view their increasing population and increased requirement of land, so that they could purchase lands in the hilly areas.

The Digital Personal Data Protection Bill, 2023 is one of 31 bills on the government’s agenda for the monsoon session of Parliament, which begins on Thursday. Parliament’s monsoon session will last until August 11. The session will include a total of 17 sittings. Beginning in the former Parliament Building.
