Supreme Court Grants Anticipatory Bail To Umar Ansari

Umar Ansari, the son of the late gangster-turned-politician Mukhtar Ansari, has been granted anticipatory bail in connection with the alleged violation of the Model Code of Conduct during the 2022 assembly elections.

The bench comprising Justices Hrishikesh Roy and PK Mishra had previously directed Umar to appear before the trial court in relation to the case.

After considering the arguments from both sides, the court was inclined to grant bail. However, it also noted that the charges framed against him are subject to trial’s adjudication.

Additionally, the court also ordered the furnishing of a bail bond amounting to Rs. 20,000.

Earlier, the Allahabad High Court had rejected Mr. Ansari’s plea for anticipatory bail, after reviewing the pertinent facts and circumstances of the case. Also making a offence out of it.

Subsequently, Ansari approached the high court to challenge the decision of the Allahabad Court. Then on January 25, the Supreme Court provided him protection from arrest in the case.

What had happened?

On March 4, 2022, an FIR was filed at Kotwali police station against Abbas Ansari (SBSP candidate for the Mau Sadar seat), Umar Ansari, and 150 unidentified individuals.

Alleging that Umar Ansari, together with Abbas Ansari and organizer Mansoor Ahmad Ansari, held a public meeting that called for the settling scores with the Mau administration,

Thus, leading to a case of Model Code of Conduct violation which was enforced during 2022 state Assembly election.

Abbas Ansari Transferred to Ghazipur Jail for Father’s ‘Fatiha’ Ritual

Under strict security, imprisoned Uttar Pradesh MLA Abbas Ansari was transferred to Ghazipur jail, from which he will be escorted by police to attend the ‘fatiha’ ceremony of his deceased father, Mukhtar Ansari, on Wednesday. The former mafia member and politician, Mukhtar Ansari, recently passed away due to cardiac arrest at a hospital in Banda, Uttar Pradesh.

On Tuesday, the Supreme Court granted permission to Abbas Ansari, currently imprisoned, to attend his late father Mukhtar Ansari’s ‘fatiha’ ceremony under strict security measures. The request by Abbas Ansari for authorization to participate in his father’s ‘fatiha’ was reviewed by a bench comprising Justices Surya Kant and K V Viswanathan on April 9. The bench stated that it found “no reason to deny him permission to attend the event.”

The Supreme Court has ordered that Abbas Ansari be returned to Kasganj jail by April 13. Additionally, the court has permitted Abbas Ansari to have family visits on April 11 and 12, with the stipulation that police authorities search all visitors to ensure no weapons are brought in. Furthermore, Abbas Ansari has been instructed not to speak to the media during these visits.

Senior Advocate Kapil Sibal, representing Abbas Ansari, appealed to the Supreme Court to permit his client to participate in the rituals and spend time with his family for a few days. The Uttar Pradesh government objected to Ansari’s request, citing that he faces charges under the Gangster Act and is accused of operating a gang from Chitrakoot jail, leading to his transfer to Kasganj jail.

Mukhtar Ansari’s cremation held in tight security

Gangster-turned-politician Mukhtar Ansari was laid to rest on Saturday morning in his residence in Uttar Pradesh’s Gazipur district, following the arrival of his mortal remains late Friday night. The city’s administration had enforced heavy police presence for the funeral proceedings.

Sibgatullah Ansari, Mukhtar Ansari’s elder brother, had initially announced that the last rites would take place on Saturday morning.

“We received the body after some delay so the last rites cannot be performed tonight. It will be done tomorrow morning. I request everybody to pray for him,” Sibgatullah Ansari told ANI on Friday.

Mukhtar Ansari, passed away in a Banda hospital where he was incarcerated in a jail. His demise was attributed to a cardiac arrest, although his family alleged that he had been administered what they termed “slow poison.”

The post-mortem examination confirmed that Mukhtar Ansari died due to a cardiac arrest and not poisoning. A senior hospital source, privy to the post-mortem report on condition of anonymity that “the cause of death of Mukhtar Ansari was found to be heart attack (myocardial infarction).” The autopsy was conducted by a panel of five doctors.

Mukhtar Ansari’s younger son Umar Ansari was present during the post-mortem conducted at the Rani Durgavati Medical College.

A three-member team has been appointed to conduct a magisterial investigation into Mukhtar Ansari’s death. Umar Ansari had requested that the post-mortem examination be conducted at Delhi’s AIIMS, a demand which was rejected. He expressed hope that the investigation would address the family’s concerns.

“We hope that the court will help investigate the suspicions that we are expressing. We will consult our legal team. We are confident that this is not a natural death but an orchestrated murder,” he stated on Friday.

Mukhtar Ansari was admitted to the hospital at 8:25 pm on Thursday, where a team of nine doctors attended to him, but he succumbed during treatment. Sibgatullah Ansari, his elder brother, alleged inadequate treatment had been provided to him.

Security tightened ahead of last rites of Mukhtar Ansari

District Magistrate Gazipur, Aryaka Akhoury, confirmed on Saturday that police have been deployed along the route from Mukhtar Ansari’s residence to the graveyard as his last rites are scheduled for today. Ansari, the gangster-turned-politician, will be laid to rest in Mohammadabad, located in the Ghazipur district of Uttar Pradesh.

Police presence outside the burial ground has been increased to maintain law and order as a large number of people have gathered to pay their respects to Ansari.

DM Akhoury stated, “Preparations are complete. Police have been deployed on a 600-meter route from his home to the graveyard. The movement of people is being monitored. The last rites will be conducted peacefully.” The last rites are scheduled to begin at 10 am.

Responding to queries, she mentioned, “Family, close relatives, and individuals on the guest list will participate in the last rites. Those who will participate in the ritual of throwing soil on the funeral will also attend to pay their respects and bid farewell.”

According to Mukhtar Ansari’s elder brother, Sibgatullah Ansari, the last rites are scheduled for Saturday, as there was a delay in receiving the body, necessitating the postponement of the ceremony to the following morning. Sibgatullah Ansari appealed for prayers for his late brother.

Earlier, Mukhtar Ansari’s body was transferred from Banda to Ghazipur after undergoing post-mortem at Banda Medical College and Hospital. Ansari passed away at a hospital in Banda, Uttar Pradesh, on Thursday.

Meanwhile, a three-member team has been assigned to conduct a magisterial investigation into Ansari’s death, following orders issued by the Chief Judicial Magistrate of Banda. This investigative panel, inclusive of two doctors, will conduct the post-mortem, which will be recorded on video.

Following the completion of the post-mortem examination, the body of notorious gangster Mukhtar Ansari is scheduled to be transported to Ghazipur for cremation. Mukhtar’s son, Omar Ansari, will superintend the journey. Mukhtar will be buried in Kalibagh cemetery

A detailed route has been charted for the journey, spanning approximately 400 kilometers and involving a convoy of 26 vehicles. The route includes entry into Prayagraj via Banda through Fatehpur and Kaushambi, while entry into Bhadohi will be from Kokhraj Handiya Bypass. From Bhadohi, the convoy will proceed to Ghazipur via Varanasi, with police and administrative officials accompanying the ambulance, while family vehicles will be positioned within the convoy.

Police force has been deployed in the cemetery. Along with the police force, LIUs are also deployed in plain clothes. The police will also keep an eye on those attending the funeral. There is a possibility of many henchmen attending the mafia’s funeral.

“Allegations made by his family require investigation,” Mayawati on Mukhtar Ansari’s death

Bahujan Samaj Party Chief Mayawati emphasized the need for a thorough investigation into the serious allegations surrounding Mukhtar Ansari’s death in prison. In a statement posted on X, she underscored, “The persistent apprehensions and serious allegations made by Mukhtar Ansari’s family regarding his death in jail require a high-level investigation so that the true facts of his death can be revealed. In such a situation, it is natural for his family to be sad. May nature give them the strength to bear this sorrow.”

Following gangster-turned-politician Mukhtar Ansari’s demise from cardiac arrest, his son Umar Ansari alleged foul play, stating that his father was poisoned and vowed legal action, expressing full confidence in the judiciary. Umar Ansari affirmed, “We have full faith in it,” highlighting their resolve to pursue justice despite facing obstacles from the administration. He disclosed, “Post-mortem will be conducted tomorrow, after that, they will give us the body. ‘My father was being given slow poison’ says Mukhtar Ansari’s son

Following the demise of gangster-turned-politician Mukhtar Ansari due to cardiac arrest, his son Umar Ansari asserted that his father was allegedly poisoned and vowed to pursue legal recourse, stating, “We have full faith in it.”

Umar Ansari expressed his lack of prior knowledge regarding the situation from the administration, saying, “I was not told anything from the administration side, I came to know about it through the media… But now the whole nation knows everything.” He reiterated their allegations of poisoning, specifying, “On March 19, he was poisoned in the dinner. We will move to the judiciary, we have full faith in it.”

Regarding the post-mortem process, Umar Ansari mentioned, “Post-mortem will be conducted tomorrow, after that, they will give us the body. We will then follow with the further process (cremation).” He highlighted the formation of a panel of five doctors for the post-mortem examination.

UP: Security Tightened in Aligarh, After Death of Mukhtar Ansari

Following the passing of Mukhtar Ansari due to a cardiac arrest on Thursday night, increased security measures have been implemented in Aligarh, Uttar Pradesh.

According to IG Aligarh Range Shalabh Mathur, police carried out a flag march in the region, and a statewide alert has been issued.

“After the death of Mukhtar Ansari, an alert has been issued in the entire state. There is also an alert in the area regarding this and now SSP Aligarh is with us and taking stock regarding this. Police administration will remain alert on all these points. All the officials will monitor the spread of rumours on social media,” he added.

As per the official statement from the hospital, the notorious gangster was admitted around 8:25 PM. A team of nine doctors provided medical care to him before his demise, as mentioned in the release.

Expressing condolences over the death of Mukhtar Ansari, the Samajwadi Party shared a post on Twitter that read, “Sad demise of former MLA Shri Mukhtar Ansari. May his soul rest in peace. May the bereaved family members get the strength to bear this immense sorrow. Humble tribute !”.

Speaking on the same, Congress leader Surendra Rajput launched an attack on the BJP and said, “Today Mukhtar Ansari’s death in jail raises a big question for the BJP-led UP Government…This should be investigated thoroughly so that everyone gets to know what is going on.”

Speaking to ANI, Naseem Haider, the lawyer for Mukhtar Ansari, said, “I received information that he has been brought here, so I have come here.”

After complaining of abdominal pain on Tuesday, he was admitted to a hospital in Uttar Pradesh’s Banda. Subsequently, upon discharge, he was transferred to Uttar Pradesh’s Rani Durgawati Medical College, as reported.

Ansari secured election as an MLA from the Mau assembly seat five times, with two victories under the Bahujan Samaj Party banner. Additionally, he wielded significant influence in Ghazipur, his native city.

In April 2023, Mukhtar Ansari received a conviction and a 10-year prison sentence for the murder of BJP MLA Krishnanand Rai by an MP MLA court. Subsequently, on March 13, 2024, he was sentenced to life imprisonment in a case linked to the use of forged documents to obtain an arms license in 1990.

Prior to these incidents, in December 2023, the MP/MLA Court of Varanasi had convicted Mukhtar Ansari for intimidating Mahavir Prasad Rungta, a witness in the murder case of 26-year-old coal businessman Nand Kishor Rungta. Ansari received a sentence of five and a half years of rigorous imprisonment and was fined Rs 10,000.

On October 15 of the previous year, the Enforcement Directorate seized lands, a building, and bank deposits valued at over Rs 73.43 lakh as part of the money laundering probe involving Mukhtar Ansari.

Mukhtar Ansari Receives 5.5-Year Jail Term in 26-Year-Old Case

Gangster-turned-politician Mukhtar Ansari has been sentenced to five years and six months in prison in a 26-year-old case related to threatening a witness in Varanasi. The MP/MLA court in Varanasi delivered the verdict, imposing a fine of Rs 10,000 on Ansari. Failure to pay the fine would result in an additional two months of imprisonment. The case, registered on November 5, 1997, under IPC section 506 (criminal intimidation) at Bhelupur police station, involved Ansari threatening businessman Mahabir Prasad Rungta, a witness in the murder case of his brother, coal trader Nand Kishore Rungta.

Currently incarcerated in Banda jail, this marks the seventh case in the past 15 months where Ansari has been convicted and sentenced. The recent case pertains to Ansari’s intimidation of Mahavir Prasad Rungta, who had witnessed the murder of Nand Kishore Rungta. In October of this year, Ansari received a 10-year imprisonment sentence from the Ghazipur MP/MLA court in connection with the murder of Kapil Dev Singh and the 2010 attempted murder case of Mir Hasan. The court also imposed a Rs 5 lakh fine, citing violations of the Gangster Act.

The UP government, responding to a Supreme Court petition by Ansari’s son Umar Ansari seeking his transfer outside UP, assured that it would enhance Ansari’s security within Banda jail if necessary. The Supreme Court bench of Justices Hrishikesh Roy and Sanjay Karol is reviewing the plea for Ansari’s transfer to a prison outside UP.

UP: Court convicts Mukhtar Ansari in 1991 Awadhesh Rai murder case

Mukhtar Ansari, a UP gangster, was convicted in the 1991 murder of Awadhesh Rai. Awadhesh, who was brother of former MLA Ajay Rai, was shot dead outside Ajay Rai’s house in Varanasi.

In the FIR, Ajay Rai named Mukhtar Ansari, Bhim Singh, and former MLA Abdul Kalim. Mukhtar Ansari is a feared gangster-turned-politician in Uttar Pradesh, serving as an MLA from the Mau Sadar assembly seat for five consecutive terms.

He did not run for re-election to the Uttar Pradesh Assembly in 2022, and his seat was won by his son Abbas Ansari of the Suheldev Bharatiya Samaj Party.

“Mukhtar has been convicted in the Awadhesh Rai murder case of 1991. The court will pronounce its judgment later in the day,” a lawyer revealed to the reporters.

Reacting to the development, Ajay Rai said, “This is the end of our many years of waiting. I, my parents, Awadhesh’s daughter and the whole family kept patience… Governments came and went and Mukhtar strengthened himself.

“But we did not give up. Because of our lawyers’ efforts, today the court has found Mukhtar guilty in the murder case of my brother,” Rai added.

Mukhtar Ansari was acquitted in a 2009 attempted murder case in May of this year. Mukhtar Ansari was imprisoned for several years because he was the defendant in several other cases.

Court decision in Awdhesh Rai murder case against Mukhtar Ansari today

The 32-year-old Awadhesh Rai murder case, in which gangster-turned-politician Mukhtar Ansari is the main culprit, will be decided by a special MP/MLA court in Varanasi, Uttar Pradesh, on Monday at roughly 2:00 p.m. Ahead of the judgement, security has been tightened at court premises and in the sensitive areas of the city. Earlier, the Special Court concluded the hearing after arguments on May 19, reserved its order, and fixed June 5 as the date to deliver it.
On August 3, 1991, Congress leader and brother of Former MLA Ajay Rai, Awadhesh Rai, was shot dead outside Ajay Rai’s house in Varanasi.
In this case, Ajay Rai had named Mukhtar Ansari, Bhim Singh and former MLA Abdul Kalim, in the FIR.
On May 17, a Ghazipur MP/MLA Court acquitted Mukhtar Ansari accused in a case of conspiracy of a murder attempt in Uttar Pradesh’s Mohammadabad area in the district.
In 2009, Mir Hasan filed a case of attempt to murder against Ansari under 120B. At the Mohammadabad police station in Ghazipur, a case was filed against Ansari under section 307 of the Indian Penal Code (IPC).

UP: Mukhtar Ansari’s kin’s properties attached by the police

The properties of jailed gangster Mukhtar Ansari has been sealed by the Ghazipur Police on Saturday. Meanwhile, in the name of the kin the properties were registered. “Two plots valued at Rs 4.5 crore and Rs 3.5 crore, registered in the name of Mukhtar’s mother Abiya Khatun, and brother-in-law Aizaz are being attached under the District Magistrate’s order,” SB Singh, Circle Officer, Ghazipur said. However, Ansari is convicted by the Lucknow bench of Allahabad High Court and sentenced for threatening then-jailer SK Awasthi for putting a pistol.

UP : former MLA Mukhtar Ansari receives two-year sentence for threatening jailer

Mukhtar Ansari, a former MLA, was convicted on Wednesday and given a two-year prison term for threatening a jailer and pointing a gun at him by the Allahabad High Court’s Lucknow bench.

The order was issued by Justice DK Singh after the Uttar Pradesh government’s appeal was accepted.

The case had begun in 2003 when jailer SK Awasthi of Lucknow District Prison filed a FIR with the Alambagh police, stating that he had been threatened for directing a search of visitors who had come to visit Ansari in custody.

In addition, Awasthi claimed that Ansari had abused him and pointed a gun at him.

Ansari was cleared in this matter by a trial court, but the government filed an appeal.

Ansari is presently lodged in Banda prison.

BSP leader Mukhtar Ansari raided by ED, lodged in Banda jail

On Thursday, the Enforcement Directorate raided the premises of Mukhtar Ansari, leader of the Bahujan Samaj Party in Lucknow and Ghazipur, in the context of an alleged money laundering case.

Ansari is currently detained in Banda jail in Uttar Pradesh.

A total of eleven locations have been covered during the search sessions.

Mukhatar Ansari’s brother, Afzal Ansari, is also under suspicion. The investigating agency is raiding Afzal’s residence as well.
