The Supreme Court expressed surprise on Monday upon learning that Senthil Balaji was appointed as Tamil Nadu’s minister shortly after being granted bail in the cash-for-jobs money laundering case.

Court Raises Concerns Over Timing

Justices Abhay S. Oka and Augustine George Masih questioned the timing of Balaji’s ministerial appointment. They said, “We grant bail and the next day you go and become Minister. Anybody will be bound to be under the impression that now with your position as a senior cabinet minister, witnesses will be under pressure. What is this going on?”

Hearing on Bail Reconsideration

The court was hearing a plea to reconsider its September 26 ruling, which granted bail to Balaji. The petition argued that his appointment as a minister could lead to witness intimidation. However, the court decided not to revoke the bail but focused on whether the witnesses were under pressure due to his new position.

Court Limits Inquiry to Witness Pressure

The bench instructed Balaji’s lawyer to get instructions and scheduled the next hearing for December 13. The court emphasized that its review would only focus on the possibility of witness intimidation, not the merits of the bail ruling.

September 26 Judgment Details

In its September 26 ruling, the Supreme Court granted Balaji bail despite acknowledging a prima facie case against him. The court considered his prolonged detention since June 2023 and the likely delays in the trial. Balaji was sworn in as a minister just three days after the bail was granted, on September 29.

Background of the Case

Balaji was arrested on June 14, 2023, in connection with a money laundering case linked to the cash-for-jobs scam during his time as Transport Minister in the AIADMK government. The Enforcement Directorate (ED) filed an Enforcement Case Information Report (ECIR) in 2021 based on three FIRs filed against him in 2018. These FIRs allege his involvement in the 2015 scandal. Balaji served as transport minister from 2011 to 2015 before joining the DMK in December 2018. After DMK came to power in May 2021, he was appointed Electricity Minister.

</excerpt>

The Delhi High Court has declined to halt trial court proceedings against former Delhi Chief Minister Arvind Kejriwal in a money laundering case linked to the alleged excise policy scam.

The court has also issued a notice to the Enforcement Directorate (ED) regarding Kejriwal‘s plea challenging the trial court’s decision to take cognizance of the ED’s prosecution complaints in the excise policy case, citing a lack of sanction.

A detailed hearing is scheduled for December 20, 2024.

This development follows Kejriwal’s recent request to set aside a trial court’s order, arguing that the special judge took cognizance of the chargesheet without the necessary sanction for his prosecution during his tenure as Delhi Chief Minister.

On November 12, the court sought the ED’s response to Kejriwal’s plea challenging the summons issued to him based on the agency’s complaint in the money laundering case. At this stage, the court has refused to stay the trial court’s proceedings in the criminal case.

Kejriwal was granted interim bail by the Supreme Court on July 12 in the money laundering case and was released on bail by the apex court in the CBI case on September 13.

The Delhi government implemented the excise policy on November 17, 2021, and scrapped it by the end of September 2022 amid allegations of corruption. The money laundering case stems from a CBI FIR lodged after Delhi Lieutenant Governor V.K. Saxena recommended a probe into the alleged irregularities in the policy’s implementation.

</excerpt>

In a major legal development, the Rouse Avenue Court in New Delhi granted bail to former Delhi minister and Aam Aadmi Party (AAP) leader Satyendra Jain, who had been in detention for 18 months in connection with a money laundering case. The court cited the prolonged delay in trial and Jain’s extended incarceration as significant factors for the bail.

Delay in Trial Violates Article 21

Special Judge Vishal Gogne, who presided over the case, underscored that Jain’s long detention without significant progress in the trial process was an excessive curtailment of liberty. The judge remarked, “Liberty is a core constitutional value under Article 21, and prolonged incarceration without trial violates this principle.”

Key Considerations for Bail

The court emphasized that Jain had not been arrested in connection with the predicate offence and had fully cooperated with the investigation under the Prevention of Money Laundering Act (PMLA). Furthermore, Jain’s arrest occurred five years after the registration of the Enforcement Case Information Report (ECIR), and no allegations were raised regarding the tampering of evidence or influencing witnesses.

Judge Gogne referenced the Supreme Court’s decision in Manish Sisodia’s bail matter, which also factored into his ruling. “Satyendra Jain is favorably suited by the parameters outlined in Sisodia,” the judge noted, citing the constitutional and mitigated twin conditions under Section 45 of the PMLA.

No Flight Risk, Court Says

The court ruled that Jain does not pose a flight risk and is unlikely to influence witnesses or tamper with evidence if granted bail. “The applicant has suffered incarceration without trial for an excessively long period, and with no significant progress towards trial, this amounts to a deprivation of liberty that violates Article 21,” the court added.

ED’s Opposition and Court’s Stand

Despite the Enforcement Directorate’s (ED) opposition to Jain’s bail plea, the court dismissed their arguments, stating that the role of the accused in delaying the trial was overstated. “The ED’s interpretation of past cases is flawed, and their argument for denying constitutional norms is against judicial progress,” the judge remarked.

Liberty vs. Stringent Laws

The court also raised concerns over the ED’s handling of cases, emphasizing that “liberty must be considered paramount, even under stringent laws like PMLA.” The judge further highlighted that detaining an individual without trial for an extended period without any arrest in the predicate offence is unreasonable and unjust.

</excerpt>

In a significant development on October 1, 2024, the Supreme Court of India requested a response from the Enforcement Directorate (ED) regarding a bail plea filed by former West Bengal Education Minister Partha Chatterjee. This plea is connected to a high-profile case involving alleged irregularities in teacher appointments and has drawn considerable attention due to its implications for political accountability and public trust in educational institutions.

Chatterjee, who has been in custody since July 2022, faces serious allegations under the Prevention of Money Laundering Act (PMLA). His arrest stemmed from a broader investigation into a cash-for-jobs scandal where numerous deserving candidates reportedly lost out on teaching positions to those who paid bribes. The Supreme Court’s bench, consisting of Justices Surya Kant and Ujjal Bhuyan, noted Chatterjee’s advanced age and health issues as factors warranting the ED’s timely response.

The case has been mired in controversy since it first came to light, with the ED’s investigations uncovering staggering amounts of cash and gold linked to Chatterjee’s associates. Notably, in July 2022, the agency recovered Rs 49 crore in cash and Rs 5 crore in jewelry from properties associated with Arpita Mukherjee, a close aide of Chatterjee, which pointed to a larger network of corruption involving various officials from the Trinamool Congress (TMC). This case underscores the challenges of political corruption in India and the potential implications for the current TMC government in West Bengal.

Chatterjee’s legal team, led by senior advocate Mukul Rohatgi, argued that he has already served over two years in custody, with the maximum penalty for his charges being seven years. His defense also emphasized that the previous court rulings lacked sufficient evidence linking him directly to the seized cash. Despite these arguments, the Calcutta High Court previously denied his bail request, citing a robust prima facie case against him. This consistent denial reflects the seriousness with which the judiciary is approaching cases of corruption, particularly in public service sectors.

Also read: Bihar: Seven Children Denote Homemade Bomb In Bhagalpur While Playing, Severely Injured

As the Supreme Court prepares for further hearings scheduled for October 17, the ED is expected to submit its response, which could significantly influence the case’s direction. The outcome of this case may not only affect Chatterjee’s future but could also have far-reaching consequences for other politicians and public servants entangled in corruption cases across India.

The ongoing developments highlight the judiciary’s role in tackling corruption and maintaining the integrity of public institutions, particularly in a context where educational opportunities are paramount for the country’s youth. As the public awaits the next steps, this case serves as a crucial litmus test for both the legal framework surrounding corruption and the political landscape in West Bengal.

</excerpt>

Former Tamil Nadu minister V Senthil Balaji was released from Puzhal Central Prison in Chennai on Thursday after the Supreme Court granted him bail in a money laundering case related to the cash-for-jobs scam. Balaji, who had been in judicial custody since his arrest by the Enforcement Directorate (ED) on June 14, 2023, walked out of prison following the top court’s decision.

Background of the Case

The money laundering charges against Balaji stem from his alleged involvement in a cash-for-jobs scam during his tenure as the Transport Minister in the All India Anna Dravida Munnetra Kazhagam (AIADMK) government from 2011 to 2015. The Enforcement Case Information Register (ECIR) was filed based on three FIRs lodged against him by local police in 2018.

The alleged scam dates back to his time in former Chief Minister Jayalalithaa’s Cabinet in 2015. He later joined the Dravida Munnetra Kazhagam (DMK) in December 2018 and became the electricity minister when the party took power in May 2021.

Previous Bail Rejections

Before the Supreme Court’s ruling, Balaji’s bail petitions had been dismissed multiple times. The Madras High Court rejected his bail plea on February 28, 2024, and earlier on October 19, 2023. Additionally, his bail petitions were dismissed by a local court on September 20, 2023, and again by the Chennai Sessions Court on January 12, 2024.

Balaji’s release marks a significant turn in the legal proceedings, as he now steps out on bail after over a year in custody related to the high-profile money laundering case.

</excerpt>

The Supreme Court on Thursday granted bail to former Tamil Nadu minister V Senthil Balaji in connection with a money laundering case stemming from a 2014 cash-for-jobs scam. Balaji, who was arrested earlier this year, had been under investigation for his alleged involvement in the scam, which reportedly involved accepting bribes in exchange for government job postings.

The apex court’s decision comes as a significant development in the high-profile case, which has seen extensive legal scrutiny and political debate. Balaji’s counsel argued for his release, citing health concerns and the prolonged duration of his incarceration without trial. The Enforcement Directorate (ED), however, opposed the bail plea, contending that his release could potentially influence the ongoing investigation.

The 2014 cash-for-jobs scam came to light when allegations surfaced that money was being exchanged for appointments in various state government departments. Balaji, who held the transport portfolio at the time, was accused of playing a key role in facilitating these illegal appointments.

The Supreme Court’s order granting bail includes several conditions to ensure that Balaji does not interfere with the investigation. He will have to surrender his passport and appear before the ED as and when required.

The ruling has drawn reactions from political circles, with Balaji’s supporters welcoming the decision as a step towards justice, while opposition parties have raised concerns over the implications for ongoing anti-corruption efforts.

</excerpt>

The Rouse Avenue Court has granted bail to Aam Aadmi Party (AAP) leader Durgesh Pathak while extending the judicial custody of Delhi Chief Minister Arvind Kejriwal until September 25. The case is part of an ongoing investigation by the Central Bureau of Investigation (CBI) into alleged money laundering and corruption.

Key Developments in the Case:

Durgesh Pathak Granted Bail: Pathak was released on bail after furnishing a bond of Rs 1 lakh. Other accused individuals involved in the case have also submitted their bail bonds.

Arvind Kejriwal’s Custody Extended: The Delhi Chief Minister, who is also facing charges in the case, appeared via video conferencing from Tihar Jail. His custody was extended until September 25 as the investigation continues. Another accused, Vinod Chauhan, who is also in custody in a separate money laundering case, appeared in court physically.

The CBI’s Charges Against the Accused:

Supplementary Chargesheet Filed: The CBI has filed a supplementary charge sheet against Arvind Kejriwal, Durgesh Pathak, and several other individuals. The charges stem from alleged financial irregularities tied to the now-scrapped Delhi Excise Policy. The CBI claims that funds received from the “South group” were funneled into AAP’s Goa election campaign.

Allegations Against Kejriwal: According to the CBI, Kejriwal promised ₹90 lakh to each candidate in Goa’s 40 constituencies. The funds were allegedly arranged through Vijay Nair, Kejriwal’s media manager, who had ties to the South group. Witnesses have provided statements supporting these claims, further deepening the controversy surrounding the case.

Financial Scandal and Key Players:

Pathak’s Role in the Scam: Durgesh Pathak, who managed AAP’s Goa election campaign, is accused of orchestrating the flow of funds to party candidates. The prosecution alleges that all money spent on the election was done under Pathak’s directions.

Connections to Liquor Scams: The case also ties in with the Mahadev liquor case, where Amit Arora, another accused, is alleged to have threatened witnesses and used illicit gains to influence business operations in the liquor industry. Statements from business figures and WhatsApp chat evidence have further implicated the accused.

</excerpt>

The Delhi High Court has granted bail to Hyderabad-based businessman Arun Ramchandra Pillai, a key figure in the high-profile Delhi Excise Policy case. The ruling, pronounced by Justice Neena Bansal Krishna, comes as a significant development in the ongoing investigation into alleged corruption surrounding the now-scrapped 2021-22 Delhi Excise Policy.

Key Highlights:
Bail Granted: Pillai, arrested by the Enforcement Directorate (ED) in March 2023, was accused of playing a central role in the money laundering case. His bail marks a turning point in the case, following the recent bail granted by the Supreme Court to Bharat Rashtra Samithi (BRS) leader K Kavitha, another accused.

Legal Representation: Pillai’s defense was led by Advocates Nitesh Rana and Deepak Nagar, who successfully argued for his bail in the Delhi High Court.

Allegations Against Pillai:
Money Laundering Accusations: Pillai is accused of receiving bribes from Sameer Mahendru, Managing Director of Indospirit, and distributing them among other individuals involved in the alleged scam.

Destruction of Evidence: The ED’s chargesheet alleged that Pillai provided false statements under Section 50 of the Prevention of Money Laundering Act (PMLA) and deliberately destroyed or replaced five mobile phones used during the period of the scam. Furthermore, key chat evidence involving Pillai, found on other accused individuals’ phones, was missing from his own devices.

Background of the Delhi Excise Policy Case:
Excise Policy Scrapped: The 2021-22 Delhi Excise Policy, under which the alleged corruption took place, was scrapped in 2022. This occurred after the Delhi Lieutenant Governor ordered a Central Bureau of Investigation (CBI) probe into the policy’s formulation and execution, citing irregularities and corruption.

Alleged Favors and Irregularities: According to the ED and CBI, undue favors were extended to license holders under the policy. Allegations include waiving or reducing the license fees, extending the L-1 license without approval, and refunding the ₹30 crore earnest money deposit against regulations. The irregularities allegedly caused a loss of ₹144.36 crore to the exchequer.

Today, the Supreme Court of India has granted interim bail to Delhi Chief Minister Arvind Kejriwal. The court is currently hearing his plea challenging the arrest and detention by the Enforcement Directorate (ED) in connection with an alleged excise policy scam.

Arvind Kejriwal will remain in custody as he is currently held in connection with the Delhi Liquor Policy case by the Central Bureau of Investigation (CBI).

The bench of Supreme Court justices Sanjiv Khanna and Dipankar Datta has referred Arvind Kejriwal’s petition to a larger bench to consider whether the requirement for arrest should be interpreted as a precondition under Section 19 of the Prevention of Money Laundering Act (PMLA).

The court also referred Kejriwal’s plea challenging his arrest by the Enforcement Directorate (ED) to a larger bench. During the hearing on Kejriwal’s bail plea, the SC also said that the court cannot direct an elected representative to step down and that the decision must be made by the CM himself.

The case revolves around accusations of funds being illicitly funneled to the Aam Aadmi Party (AAP) through hawala channels, with discussions between Kejriwal and hawala operators cited as evidence. Kejriwal, who received interim bail, contends that his arrest was politically motivated, coinciding with the announcement of the General Elections.

This is a developing story.

</excerpt>

A Delhi Rouse Avenue Court extended the judicial custody of Delhi CM Arvind Kejriwal on Wednesday until July 12 in relation to the money laundering case tied to the now-cancelled Delhi liquor excise policy of 2021-22.

The court also reserved its decision on Kejriwal’s request for his wife’s presence during medical consultations with the AIIMS special board, as ordered by the court on April 22. The decision will be announced on July 6.

On Saturday, the city court had remanded Kejriwal to judicial custody until July 12 following a plea by the Central Bureau of Investigation (CBI), which had arrested the Aam Aadmi Party (AAP) convenor on June 26.

Earlier in the day, Kejriwal approached the Delhi High Court regarding the CBI case against him. His bail plea was presented by counsel Rajat Bharadwaj before a bench comprising acting chief justice Manmohan and justice Tushar Rao Gedela.

Bharadwaj requested the court to hear the plea on Thursday, alleging that Kejriwal was taken into illegal custody without following section 41 of the CrPC. “Have filed a bail application. Applicant was taken into illegal custody without complying with section 41,” he stated.

The court agreed to schedule the hearing for Friday. “We’ll list it day after,” acting chief justice Manmohan responded.

The AAP national convener was arrested by the CBI on June 26 while in Tihar Jail, where he remains in judicial custody for a related money laundering case filed by the Enforcement Directorate (ED).

Kejriwal, initially arrested by the ED on March 21, had been granted bail by the trial court on June 20 in the money laundering case. However, the high court stayed the trial court’s order.

The Enforcement Directorate (ED) has arrested former DMK leader Jaffer Sadiq in connection with a money laundering case linked to drug offenses. Sadiq, who was already in Tihar jail under an NDPS case, was arrested on June 26 after being interrogated by ED officials.

The agency intends to seek his remand once he appears in court. Earlier this month, the court permitted ED to question Sadiq in Tihar Jail and record his statement under the Prevention of Money Laundering Act (PMLA).

Special NDPS judge Sudhir Kumar Sirohi granted ED permission to examine Sadiq on June 25 and 26, directing the jail authorities to facilitate the process.

Special Public Prosecutor NK Matta, representing ED, requested permission to use laptops and printers during the examination to record statements, citing the recovery of 50kg of Pseudoephedrine.

Previously, on May 1, the court had allowed ED to record statements of Sadiq and four others in Tihar Jail.

ED’s investigation includes raids conducted in Tamil Nadu as part of a probe into drug-related money laundering involving Sadiq, who was earlier arrested by the Narcotics Control Bureau (NCB) in an international drug trafficking case.

The ED initiated its case against Sadiq following findings by the NCB linking him to influential individuals and revealing his alleged role in smuggling pseudoephedrine to countries like Australia, New Zealand, and Malaysia.

</excerpt>

A Delhi court has deferred its decision on the bail request of Delhi Chief Minister and Aam Aadmi Party’s (AAP) national convenor Arvind Kejriwal regarding the money laundering case linked to the now-defunct excise policy.

The Enforcement Directorate (ED) presented documentary evidence indicating that a portion of the alleged proceeds of crime was utilized to cover Kejriwal’s accommodation expenses at the Grand Hyatt Hotel in Goa during the 2022 state elections.

The ED asserted that Charanpreet Singh paid Rs 1.5 lakh in installments of Rs 50,000 each to settle the hotel and banquet charges for Kejriwal’s stay. Charanpreet, reportedly managing AAP’s Goa poll funds, allegedly received around Rs 45 crore in cash from various hawala operators and was involved in handling cash for the party’s Goa election campaign.

Additionally, the ED mentioned that witness statements, including one from an individual named Sagar Patel, corroborate the cash payments made to Charanpreet, Prince Kumar, and Rajiv Mondkar for the AAP’s election expenses in Goa.

The ED argued that Kejriwal’s refusal to provide his phone’s password should result in an adverse inference against him, a ground for denying bail even under ordinary bail law. ASG Raju previously informed the court that the Delhi CM’s stay costs were covered partly in cash and partly by the GNCTD Admin Department, with payments initially concealed but later discovered to have come through hawala.

Earlier, the ED opposed Kejriwal’s bail, alleging that he demanded a Rs 100 crore bribe from the South Group for his party. The agency stated that if the AAP commits a crime, the person in charge of the party will be held culpable. The ED also highlighted that when former deputy chief minister Manish Sisodia was made an accused, the AAP was not named as an accused.

Kejriwal’s judicial custody was extended after he was produced before the court via video conference. His counsel argued that the case against him relied on statements from tainted individuals, discrediting the prosecution’s case. Kejriwal’s lawyer claimed there were contradictions in the statements made by several co-accused.

As a result, the court has deferred the arguments in this case and scheduled it for a hearing on June 14. This development marks another significant turn in the legal proceedings related to the alleged money laundering activities linked to the Excise Policy.

Arvind Kejriwal, a prominent political figure, has been embroiled in this case for some time now. The ED’s stance against granting him bail indicates the seriousness of the allegations and the legal complexities surrounding the matter.

The upcoming hearing on June 14 will likely see further deliberations and legal arguments regarding Kejriwal’s bail plea. The case has drawn significant attention due to its political ramifications and the implications for the ongoing investigations into financial irregularities.

Delhi Chief Minister Arvind Kejriwal has submitted a bail plea in the trial court related to a money laundering case associated with the former liquor policy. The Rouse Avenue Court is set to review Kejriwal’s plea at 2 pm today.

On Wednesday, the Supreme Court declined Kejriwal’s request for a seven-day extension of his interim bail in the liquor policy case. The court registry rejected the application, stating that Kejriwal had the option to seek regular bail from the trial court.

During Tuesday’s hearing, a vacation bench led by Justices JK Maheshwari and KV Viswanathan considered the arguments presented by senior advocate Abhishek Singhvi.

Kejriwal, in his plea for bail extension, cited health concerns, mentioning, “Unexplained weight loss is a symptom of life-threatening diseases. My health condition is partly attributable to the callous behaviour of the jail authorities. Another week of bail will allow me to take stock of health complications.”

Kejriwal was released from Tihar Jail on May 10 after the Supreme Court granted him interim bail in the liquor policy case. He has been directed to surrender by June 2, two days before the Lok Sabha poll vote counting.

The AAP leader was arrested on March 21 by the Enforcement Directorate (ED) following questioning at his residence in Delhi’s Civil Lines area.

Special Judge Rakesh Syal has granted the Enforcement Directorate (ED) time to respond to this application, with the decision made on Wednesday.

Siddiqui, represented by advocate Hemant Shah, has applied, whereas the Enforcement Directorate (ED) has filed a charge sheet against four individuals and a company in this case. A previous notice had been issued regarding this matter, and it is now scheduled for a hearing on June 3. It is stated that his mother is ill and needs hospitalization.

ED has filed charges against four individuals: Zeeshan Haider, his partnership firm Sky Power, Javed Imam Siddiqui, Dawood Nasir, and Kausar Imam Siddiqui. It accused them of money laundering in connection with the purchase and sale of property valued at Rs. 36 crores, allegedly orchestrated by AAP MLA Amanat Ullah Khan. Reportedly, the property was bought with illicit funds, and Amanat Ullah Khan personally delivered Rs. 8 crores in cash.

In response to a query about Amanat Ullah Khan’s involvement, the ED’s counsel stated that the investigation concerning the roles of other accused individuals is still ongoing.

Special Public Prosecutor (SPP) Manish Jain presented allegations of irregularities in the Delhi Waqf Board, detailing the involvement of the main accused, Amanat Ullah, in corrupt practices. The charges include misappropriation and siphoning of funds, with Rs. 100 crore worth of property misappropriated, and jobs provided improperly.

</excerpt>

After Court summoned AAP leader Atishi in a defamation case, Chief Minister Arvind Kejriwal claimed that she is next in line to be arrested and called it complete dictatorship.

In a post on X, Kejriwal said, “I had said earlier that they would arrest Atishi next. They are planning to do so now. Complete dictatorship. In completely flimsy, frivolous and false cases, they are arresting all functionaries of AAP one by one. Every single opposition leader will be arrested if (Narendra Modi) ji comes back to power. AAP is not important. Saving our dear country from dictatorship is important.”

Atishi responded, “I want to know from BJP how they formed the government in Goa, Manipur, Karnataka, Madhya Pradesh, and Arunachal Pradesh without a majority. BJP will have to answer how MLAs from other opposition parties reach BJP. It will also have to answer how it happens that NCP splits into two, and how CBI-ED cases against all their leaders who joined BJP ended one by one.”

She added, “BJP should answer how all cases of Economic Offences Wing against Ajit Pawar, his wife, and his nephew got closed after he joined BJP. ‘Operation Lotus’ of BJP is well known and AAP need not answer this.”

Delhi BJP spokesperson Praveen Shankar Kapoor claimed that Kejriwal was manipulating political or legal developments. “For more than two years, he and his colleagues, including Atishi, kept blaming BJP for running Operation Lotus. But now, by filing a defamation suit, we have made Atishi accountable towards the law of the land,” he said. Kapoor, who filed the defamation suit, added, “To take action or not is now in the purview of the court, but if CM Kejriwal and Atishi fear arrest or legal action so much, then they should apologize to BJP workers and end the matter.”

Kejriwal was granted interim bail by Justices Sanjiv Khanna and Dipankar Datta on May 10. He was instructed to turn himself in at Tihar jail by June 2. On May 17, the bench postponed its decision on his appeal against the lawfulness of his arrest by the ED in a PMLA case related to a liquor scam.

The Supreme Court rejected Kejriwal’s request to extend his temporary bail. They said since a decision is pending on whether his arrest was legal, his plea for more bail time doesn’t relate to the main case. The Court allowed him to ask the trial court for regular bail, making this request unnecessary.

Earlier on Tuesday, the Supreme Court declined to quickly hear Delhi Chief Minister Arvind Kejriwal’s plea to extend his temporary bail for seven days due to health reasons in the Delhi excise policy case. </excerpt>

The Supreme Court on Tuesday denied an urgent hearing for Delhi Chief Minister Arvind Kejriwal’s plea to extend his interim bail for seven days on medical grounds in the Delhi excise policy case. A vacation bench of Justices JK Maheshwari and KV Viswanathan stated that the Chief Justice of India should decide on the listing of Kejriwal’s application.

The bench deemed it appropriate for the Chief Justice of India to make the call on the application for the extension of bail, given that the judgment on the case has already been reserved. On May 17, the Supreme Court had reserved its verdict on Kejriwal’s plea against his arrest by the Enforcement Directorate (ED).

Previously, on May 10, the apex court had granted Kejriwal interim bail until June 1 to campaign for the Lok Sabha election, with a surrender date of June 2.

Senior advocate Abhishek Manu Singhvi, representing Kejriwal, mentioned the application for an urgent hearing. However, the bench responded, “This is a heard and reserved matter. We cannot do anything. Place before CJI for appropriate orders.”

In his fresh application, Singhvi requested “only a 7-day extension. This is just a medical extension and not an abuse of liberty.” The bench inquired why the application had not been mentioned before Justice Dipankar Datta, who was heading a vacation bench last week. Singhvi explained that the medical prescription had been given only the day before yesterday, preventing earlier action.

Justices Sanjiv Khanna and Dipankar Datta had previously heard the main case and granted interim bail to Kejriwal. In his application seeking a one-week extension, Kejriwal stated he needs to undergo diagnostic tests, including a PET-CT Scan. The application indicated that recent medical tests revealed elevated blood glucose and ketone levels, suggesting potential kidney-related complications.

Kejriwal was arrested by the ED on March 21 in connection with a money laundering probe related to alleged irregularities in the now-cancelled Delhi excise policy 2021-22.

</excerpt>

The Delhi High Court has taken cognizance of Aam Aadmi Party (AAP) leader Satyendar Kumar Jain’s plea for default bail in the Money Laundering Case, issuing a notice to the Enforcement Directorate (ED) on Tuesday. This comes after Jain contested the Rouse Avenue Court’s decision on May 15, which denied him default bail in the ongoing investigation.

Justice Swarna Kanta Sharma’s bench, after hearing submissions, has directed the ED to respond and scheduled a detailed hearing for July 9.

Satyendar Kumar, in his plea before the Delhi High Court, contends that the ED failed to conclude the investigation within the statutory period. He argues that the prosecution complaint, filed prematurely, aims to deprive him of default bail under Section 167 (2) of the Code of Criminal Procedure.

Emphasizing a legal precedent, Jain asserts that filing a chargesheet before completing the investigation violates Article 21 of the Constitution, which guarantees the right to life and personal liberty. He maintains that even in cases under the Prevention of Money Laundering Act (PMLA), incomplete investigations warrant the right to default bail.

Notably, the Supreme Court recently dismissed a similar bail plea filed by former Delhi Minister Satyendar Jain in a separate money laundering case. Last year, the Delhi High Court and the trial court had also rejected Jain’s bail petitions, citing concerns over his potential to influence evidence tampering.

Jain, arrested by the Enforcement Directorate on May 30, 2022, under the Prevention of Money Laundering Act (PMLA), remains in judicial custody. The ED’s case stems from a Central Bureau of Investigation (CBI) complaint, alleging Jain’s acquisition of movable properties between February 14, 2015, and May 31, 2017, without satisfactory explanation.

As the legal battle unfolds, Jain’s quest for default bail underscores the complexity and gravity of the ongoing investigation, further intensifying the legal scrutiny surrounding the prominent AAP leader’s involvement in the money laundering case.

This court finds that the current writ petition challenging the arrest of the national convenor of AAP is not admissible, as the individual is in judicial custody based on judicial directives, which are beyond the scope of this petition. Despite the clear references to the individual’s political position, the petition fails to mention the person by name,” stated a bench comprising acting Chief Justice Manmohan and Justice Manmeet PS Arora.

Although the order was issued on May 1, the detailed verdict became available on Friday. The high court deemed the petition devoid of merit, branding it “frivolous” and suggesting it was filed for publicity. Dismissing the petition, the bench asserted that petitioner Amarjeet Gupta, a law student, lacks the legal standing to seek relief for the arrested individual.

The court noted that a similar public interest litigation (PIL) was previously dismissed with costs by the court, as the petitioner lacked the necessary standing to seek relief regarding criminal proceedings against Kejriwal.

The high court emphasized that according to the law, any individual arrested by a law enforcement agency must be presented before the nearest magistrate within 24 hours of arrest. Further detention is only permissible with the magistrate’s orders.

“In the case described in the petition, the individual in question (referring to Kejriwal) was arrested and duly presented before the appropriate court. He remains in judicial custody based on court orders. Therefore, the request for separate information to the ECI lacks justification and undermines existing legal safeguards,” stated the court.

Regarding the plea to the ECI for establishing a policy allowing arrested undertrial political leaders or candidates to campaign virtually during elections, the bench remarked that it overlooked the existing regulations outlined in the jail manual governing the rights of undertrials.

“It is a well-established principle that courts refrain from issuing legislative directives unless there is a legislative void. The petition demonstrates ignorance of the separation of powers doctrine and seeks directives of a legislative nature, surpassing the jurisdiction of judicial review. Furthermore, the ECI lacks authority over the rights of undertrials in judicial custody,” stated the bench.

Although inclined to impose costs on the petitioner, the court noted the student status of Gupta, prompting his counsel to request exemption from costs. In dismissing the petition to permit arrested political leaders to campaign virtually for the Lok Sabha polls, the high court expressed concerns that such a provision might enable notorious criminals, including Dawood Ibrahim, to affiliate with political parties and engage in canvassing.

The petitioner cited dissatisfaction with the timing of politicians’ arrests, particularly that of the AAP national convener, following the enforcement of the MCC upon the EC’s announcement of the Lok Sabha polls schedule on March 16.

Kejriwal was apprehended by the Enforcement Directorate in connection with a money laundering case linked to the Delhi excise policy on March 21.

The petition argued that Gupta was troubled by the notion that voters are unable to exercise their fundamental right to access information under Article 19(1)(a) of the Constitution from politicians in custody, as they are unable to witness election campaigning.

“It also highlights that leaders of political parties are denied their constitutionally protected fundamental and legal right to campaign during elections,” the petition stated.

</excerpt>

The Supreme Court on Monday rejected a bail plea from suspended Jharkhand cadre IAS officer Pooja Singhal, who is implicated in a money laundering case connected to the purported misappropriation of MGNREGA funds and other allegations.

A panel comprising Justices Sanjiv Khanna and Dipankar Datta denied the bail request, deeming it an “extraordinary case”.

The Supreme Court declined to intervene with the decision of the Jharkhand High Court, which had rejected her bail plea. The panel acknowledged that the Enforcement Directorate (ED) had examined 12 out of 17 prosecution witnesses and expressed hope for a swift conclusion to the trial.

“You wait for some more time for bail. This is not a normal matter but an extraordinary case. There is something seriously wrong in this case. We are not inclined to entertain the instant petition. We hope the trial will be concluded expeditiously,” said the bench.

The court also granted Singhal the liberty to renew her bail plea if the trial prolongs or if there are any changes in circumstances. The ED opposed Singhal’s bail plea, citing that she had spent the majority of her custody period in a Ranchi hospital. On February 10, 2023, the Supreme Court provided Singhal with interim bail for two months, as she requested bail to care for her ailing daughter.

She has been in custody since May 11, 2022, following raids conducted at properties associated with her in connection with the money laundering case. The Supreme Court was considering an appeal filed by Singhal, an Indian Administrative Service (IAS) officer of the Jharkhand cadre, challenging the Jharkhand High Court’s dismissal of her bail plea.

The ED has charged Singhal with money laundering, alleging that its teams seized over Rs. 36 crore in cash, reportedly linked to illegal mining, as part of two distinct money laundering inquiries.

In addition to the 2000-batch IAS officer, the ED raided her businessman husband, a chartered accountant connected to the couple, and others as part of a money laundering investigation linked to a case of alleged corruption in the MGNREGA scheme.

Pooja Singhal was apprehended following assertions from the ED that it possessed substantial evidence of her association with CA Suman Kumar. At the time, Singhal held positions as the secretary of the Department of Mines and Geology and the managing director of Jharkhand State Mineral Development Corporation Limited (JSMDC).

Meanwhile, the Enforcement Directorate (ED) interrogated Amanatullah Khan for nearly 13 hours last week, focusing on alleged money laundering irregularities in the Delhi Waqf Board. Amanatullah visited the ED office on April 18 at 11 am to provide his statement. Upon his arrival, senior AAP leaders like Sanjay Singh claimed he had been arrested.

Officials from the investigation agency confirmed that Amanatullah Khan was allowed to leave after the extensive questioning session. According to ANI news agency, upon leaving the ED office, Amanatullah stated, “I was summoned by the ED for questioning. </excerpt>

Arvind Kejriwal, the chief minister of Delhi, is scheduled to appear before the Rouse Avenue Courts today to be charged with a money laundering case, which represents an important turning point in the going on legal battle surrounding him. As Kejriwal’s remand period ends, the next stage of his legal processes will begin.

This came about as a result of Kejriwal’s plea challenging his ED detention being denied by the Delhi High Court. In a prima facie finding, Justice Swarna Kanta noted that there was a large amount of evidence, such as statements from approvers, the involvement of middlemen, and signs of cash transactions relating to expenses for the Goa elections in 2022. The legal defence of the leader of the Aam Aadmi Party (AAP) was severely damaged by the decision.

The case concerns charges of money laundering and corruption related to the formulation and implementation of the excise policy for 2021–2022 by the Delhi Government, which was later canceled. The BJP government at the Center has been accused of misusing federal investigative agencies, which has put the ED’s efforts against Kejriwal under significant political and legal scrutiny.

Gopal Rai, the Cabinet Minister and convenor of the AAP’s Delhi unit, responded to these developments by accusing the BJP of using these agencies for political gain. Rai highlighted Kejriwal’s commitment to serving Delhiites and pledged to carry on their struggle via democratic methods, using the approaching election as a starting point for the search of justice.

The political consequences and heightened public interest surrounding Kejriwal’s judicial custody at Tihar Jail highlight the complicated relationship between the legal system and political forces in India. The country is watching the court hearings to see what will happen next in this well-known case, which has sparked a lot of discussion and attention.

</excerpt>

Bharat Rashtra Samithi (BRS) leader K Kavitha was arrested by the Central Bureau of Investigation inside Tihar Jail in connection with an alleged money-laundering case related to the Delhi liquor policy. This arrest follows recent questioning by the probe agency while she was in judicial custody. Kavitha, daughter of former Telangana chief minister K Chandrashekar Rao, is accused of being a key member of the “South Group,” which purportedly offered kickbacks of ₹100 crore to the ruling AAP in Delhi in exchange for a significant portion of liquor licenses in the national capital.

She was remanded to 14-day judicial custody last Tuesday. The 46-year-old was initially arrested on March 15 by the Enforcement Directorate from her residence in Banjara Hills, Hyderabad. CBI officials later questioned Kavitha inside the prison after obtaining permission from a special court. The interrogation focused on WhatsApp chats recovered from co-accused Buchi Babu’s phone and documents related to a land deal, allegedly involving a payment of ₹100 crore to AAP as kickbacks to influence the excise policy in favor of a liquor lobby in Delhi. CBI officials visited Tihar Jail on Saturday to further interrogate Kavitha on these aspects of the case.

In a letter to the court, Kavitha expressed her view that the investigation by central agencies, which she referred to as a “media trial,” has damaged her reputation and infringed upon her privacy.”I’m a victim. My personal and political reputation has been targeted. My mobile phone is displayed on all television channels, directly invading my privacy,” she stated in the letter, which was read out in court by her lawyer.”I have cooperated with the agencies and provided all the bank account details. I will surrender all the mobile phones that the ED claims I have destroyed,” the letter concluded.
