</excerpt>

In the wake of a “cash for votes” controversy ahead of the assembly elections in Maharashtra’s Palghar district, police raided a hotel in the Nalasopara assembly constituency on Tuesday. During the operation, cash and diaries were seized, and multiple FIRs were registered.

The Election Commission‘s flying squad participated in the raid, which was initiated following complaints that BJP leaders were allegedly distributing money at a hotel in Virar to influence voters. Workers from both the BJP and the Bahujan Vikas Aghadi (BVA) were found at the hotel during the raid.

“On the upper floors, BJP members were present, while BVA workers were present on lower floors. Some amount of money and a few diaries have been recovered,” said Vasai Deputy Commissioner of Police (Zone II) Pournima Chougule.

Following complaints by BVA workers, who accused BJP leaders of distributing cash in violation of the Model Code of Conduct (MCC), the police filed two FIRs. A third FIR was registered for holding a press conference during the silent period, which also contravenes the MCC.

“Three FIRs have been filed under relevant sections of the Bharatiya Nagarik Suraksha Sanhita, 2023, and also under the Representation of the People Act, 1951. The situation is under control,” DCP Chougule told ANI.

Maharashtra’s Additional Chief Election Officer Kiran Kulkarni affirmed that “everything is under control” and promised strict action against anyone found violating the MCC.

“The flying squad reviewed the premises and made some seizures. The process of registering an FIR is ongoing. Anyone violating the MCC will face legal action,” Kulkarni said.

Election Commission official Shekhar Ghadge confirmed that a political party meeting was in progress at the hotel.

“We received a complaint regarding a meeting of a political party. When our team arrived, it saw that a meeting was going on. Some cash has been seized. Police have registered two cases. This will not have any impact on the election,” Ghadge said.

However, BJP National General Secretary Vinod Tawde dismissed the allegations made by BVA leaders, asserting that the meeting was solely to discuss election protocols and complaint procedures.

“A meeting of MLAs of Nalasopara was underway. I went there to tell them about the Model Code of Conduct for the day of voting, how will voting machines be sealed and how to go about if an objection has to be made. The workers of the party (Bahujan Vikas Aghadi), Appa Thakur and Kshitij thought that we were distributing money. Let the Election Commission and police inquire, let them get CCTV footage,” Tawde said.

He expressed confidence that the investigation would vindicate him, citing his long-standing association with the BJP.

Also read: Vande Bharat Set to Roll into Kashmir as Railway Connectivity Nears Completion

“I have been in the party for 40 years. Appa Thakur and Kshitij know me, and the entire party knows me. Still, I believe that the Election Commission should conduct an impartial investigation,” he added.

</excerpt>

The Jharkhand BJP has been asked to take down a social media post the Election Commission says violates the Model Code of Conduct. The party has also been asked to explain “the alleged violation of provisions of MCC (Model Code of Conduct) on account of their referred social media posts.”

The poll panel’s decision came following a complaint by the ruling Jharkhand Mukti Morcha and ally Congress.

The two parties complained that the BJP message — posted on X and Facebook — “contains a communal, malicious and misleading video with the caption ‘poore Jharkhand ka kaya palat denge’ (Will change the face of Jharkhand),” the Commission said in its order.

“On perusal of the complaint, it appears that the above referred social media post is prima facie violative of the MCC. It is therefore, directed to take immediate action as per existing laws and procedures and thereafter direct the concerned social media platforms, through the authority designated in the State of Jharkhand under section 79(3)(b) of the IT Act to take down the referred posts immediately,” the order to the state’s Electoral officer read.

The JMM-led ruling coalition is hoping for a second term in power, riding on its welfare schemes including Maiyan Samman Yojana.

The NDA has promised a stop to infiltration and corruption by the Grand Alliance government, pointing to the arrest of Chief Minister Hemant Soren in a corruption case ahead of the election.

The BJP’s key promises include “driving out infiltrators,” implementing Uniform Civil Code (UCC), Rs 2,100 per month to every woman, and 5 lakh employment opportunities for the youth.

The first phase of election in Jharkhand is already over, in which voting was held for 43 of 81 assembly seats.

The second phase of elections will be held on November 20, while the votes will be counted on November 23.

</excerpt>

Chief Election Commissioner (CEC) Rajiv Kumar on Friday voiced a strong condemnation of offensive remarks directed at women leaders. Sources from the Chief Electoral Office of Maharashtra that Kumar called for “timely and stern action” against any derogatory statements made by candidates, emphasizing the importance of preserving the dignity and respect of women in public discourse.

During a detailed review meeting with District Election Officers, Police Commissioners, Superintendents of Police, Municipal Commissioners, and Returning Officers, the CEC expressed grave concern over the increasing use of language that undermines the honor of women in politics. The review meeting served as a platform for Kumar to underline the Election Commission’s commitment to respectful campaign conduct, particularly regarding the treatment of women in leadership positions.

According to sources, Kumar firmly reminded political parties and candidates of their responsibility to avoid actions or statements that could be seen as demeaning to women. He underscored that political criticism should not encroach upon any aspects of private life unrelated to public activities, and that low-level personal attacks should be completely off-limits in the campaign discourse.

The CEC directed officials to ensure that any derogatory comments or actions in violation of the Model Code of Conduct (MCC) should prompt immediate and strong responses. Kumar urged authorities to remain vigilant and take appropriate measures to protect the dignity of women, stressing that any language disrespectful to women would not be tolerated under the MCC’s provisions.

Kumar expressed hope that all candidates and party leaders would elevate their rhetoric and demonstrate respect towards women, both in their speeches and interactions with the public. This call for accountability reflects the Election Commission’s stance on fostering a more inclusive and respectful electoral environment, prioritizing the dignity of women in political spaces.

Also read: Australia Today Responds to Canada’s Social Media Ban Following Jaishankar Interview

This directive follows the Election Commission of India’s ongoing efforts to curb disrespectful language in political campaigns. Earlier in April 2024, the Commission had issued notices to political leaders across various states for making offensive remarks against women, highlighting its consistent commitment to ensuring respectful campaign practices across the country.

</excerpt>

After concluding his Lok Sabha campaign, Prime Minister Narendra Modi has recently visited Kanyakumari on Thursday, where he began a 45-hour meditation session at Vivekananda Rock Memorial.

As a result, opposition parties like Congress and TMC have raised a question on Bhartiya Janata party over this visit.

Later on, Wednesday, Congress issued a complaint to the Election Commission of India, demanding that the Prime Minister’s visit be either rescheduled or its broadcast be banned, as it allegedly violates the model code of conduct.

The delegation led by national spokesperson Abhishek Singhvi met the ECI officials and lodged the complaint. “We told the ECI that no one is allowed to campaign directly or indirectly during the silence period…” said singhvi.

Before understanding ECI’s action, let’s take a look at the concept of silence period.

What is a Silence Period?

The “silence period” typically spans a 48-hour duration, during which political parties and candidates are prohibited from campaigning.

According to Section 126 of the Representation of the People Act, 1951, all election campaigning must cease during the 48-hour period leading up to the conclusion of voting.

Moreover, restrictions are imposed to mitigate the influence of media and politicians on voters.

As per Indian express’s report, the district magistrate issues direction for the ban of unlawful assemblies, public meetings, the use of loudspeakers, and limiting gatherings to fewer than five people.

But door-to-door campaigning is allowed. However, political advertisements through electronic and social media aren’t allowed.

Why Opposition Complained?

On Wednesday, Congress Spokesperson Abhishek Singhvi informed the media that they had met EC officials to express their grievances.

During their meeting, they told EC, that during silence period, no one is allowed to campaign directly or indirectly.

Citing instances on how PM is violating Model code of conduct, singhvi asserted,

“These are ways that you are campaigning or are broadcasting yourself through channels and print media. We have kept two very simple points before the ECI. Either the PM starts this 24-48 hours later. After June 1 evening, he can do it. And if he insists that he will start it… then it is necessary that a ban is imposed on its broadcasting on print and visual media. He is himself a candidate in the last phase. This kind of broadcast should not be allowed.”

Were The MCC Rules Violated? What Will ECI Do?

As the Prime Minister is expected to observe a 45-hour period of meditation, technically he is not engaged in campaigning during the 48-hour silence period.

Consequently, it ensures that Section 126 of the model code of conduct has not been violated.

According to an Economic Times report, the Prime Minister’s Office (PMO) had previously informed the Election Commission about Modi’s visit to Kanyakumari on May 29.

Additionally, the multi-phase nature of this election might work in the Prime Minister’s favor.

As, a note from the poll panel clarified on April 2 that media coverage during the period referred to in Section 126 of the Representation of the People Act is not applicable in multi-phase elections.

ECI’s Earlier Response to PM Modi’s 2019 Kedarnath Visit

Previously during 2019 election, PM Modi earlier visited kedarnath, ahead of Varanasi’s polls.

That time, many opposition parties complained to ECI, but poll body gave him the nod for the visit.

However, the PMO was reminded, that the model code of conduct is still in force.

</excerpt>

The Election Commission of India on Tuesday censured former Calcutta high court judge and BJP’s candidate Abhijit Gangopadhyay over personal attacks on West Bengal Chief minister Mamta Bannerjee. Thus, violating the model code of Conduct.

Further, the poll body also debarred BJP’s Tamluk candidate from campaigning for 24 hours starting from 5 pm today. And also warned him to be careful in future during the period of Model Code of Conduct.

Earlier, addressing a public meeting in Haldia on May 15, Gangopadhyay made an alleged personal attack on WB CM and spoke

“Mamata Banerjee, how much are you being sold for? Your rate is Rs10 lakh, why? Because you’re getting your make-up done by Keya Seth? Mamata Banerjee, is she even a woman? I keep wondering sometimes.” said Abhijit Gangopadhyay in Bengali.

Later, ECI taking the cognizance of the case, declared, that it is beyond reasonable doubt, that Gangopadhyay has made a “low-level personal attack”, Thus violating MCC code.

Condemning the statement, ECI said, “The Commission…finds Shri Abhijit Gangopadhyay’s statement a direct affront on the “erosion of status of women in India”; such statement that is outrightly condemnable when used in respect of any woman, not to speak of a senior political leader and holder of a constitutional position.”

After that, ECI had sent the show-cause notice to the former calcutta judge, seeking response from Gangopadhyay by 5 pm on May 20.

In its notice, it has declared, Gangopadhyay comments have been made in bad taste, and is found to be “beyond dignity in every sense of term”

Making Election Commission on the track to record a biggest overhaul of the inducements in the 75-year history of the general elections in the country on Friday.

<img loading="lazy" decoding="async" class="aligncenter" src="https://www.hindustantimes.com/ht-img/img/2024/04/15/550x309/The-ECI-also-warned-parties-against-the-use-of-mal_1683047530854_1713175720975.jpg" alt="According to the poll body, the seizures are a crucial aspect of the ECI's determination to conduct Lok Sabha elections free from inducements and electoral malpractices, ensuring a fair electoral process.
This marks the drastic increase in the seizure of inducements if the whole of the 2019 Lok Sabha election is taken into account.

As Revealed by the ECI, 45% of the seizures are of drugs and narcotics, which happen to be under the special focus of the commission. The Commission further revealed that the “The seizures have been possible by comprehensive planning, scaled up collaboration and unified deterrence action from agencies, proactive citizen participation and optimal engagement of technology.”

Coming to the breakdown of the distribution of the seized inducements by the States, according to the released data, Rajasthan was at the top where the seizure of Rs. 778 crore was seized. Followed by Gujarat and Maharashtra with seizure of Rs.605 crore and Rs.431 crore respectively.

This seizure comes just after the last month when the Chief Election Commissioner Rajiv Kumar, made an emphasis on ‘Money power’ as one of the 4M challenges i.e, Money, Muscle, Disinformation and the Model Code of Conduct violations.

Emphasizing more on the money power, Commission’s statement further said that the “Use of black money, over and above political financing and accurate disclosure thereof, may disturb the level playing field in favor of a more resourceful party or candidate in specific geographies.”

These enhanced seizures on Election Commission of India’s part, reflects the steadfast commitment to keep a track on inducements and curbing electoral malpractice to ensure a level-playing field for the various political parties especially for the smaller & less resourceful parties according to the Poll Body’s statement.

</excerpt>

The Punjab Police have taken strict action for the violation of the Model Code of Conduct, registering a case against the owner and managers of Prime Cinema and the in-charge of Qube Cinema based on the recommendations of the MCMC Committee Patiala.

Chief Electoral Officer Sibin C provided further details, stating that the office received a complaint on April 6 from an RTI activist regarding a significant breach of the Model Code of Conduct. The complaint highlighted the playing of promotional video ads in cinemas across the state featuring the Punjab government logo and the Chief Minister’s appearance.

In response to the complaint, the CEO Punjab promptly sought reports from relevant authorities, including the Deputy Commissioner Patiala and the Secretary of the Public Relation Department, Government of Punjab. This was to determine the status of such Government advertisements in cinemas across the state.

Following this, a notice was issued to Paramjit Singh, Manager of Prime Cinemas in Rajpura, on April 6, and a flying squad visited the cinema. Subsequently, as the matter pertained primarily to the display of advertisements in cinemas, it was referred to the MCMC Patiala (Media Certification and Monitoring Committee).

Based on the MCMC Patiala’s recommendations, the Patiala police filed a complaint on April 8 under sections 188 and 177 of the IPC against the owner and managers of the cinema, and under section 188 of the IPC against the representatives, manager, and person in-charge of the Cinema.

The CEO office, Punjab, sent a report to the Election Commission of India for further instructions.

The CEO noted that, according to reports from the other 22 districts, no similar incidents were reported from any other part of the state.

</excerpt>

The Election Commission of India (ECI) has reprimanded BJP leader Dilip Ghosh and Congress leader Supriya Shrinate for making disrespectful comments that undermine the dignity of women. The Commission emphasized its stance on the electoral process as a promoter of women’s status and asserted its commitment to preventing any degradation of their position.

In its ruling issued on Monday following their responses to notices regarding violations of the Model Code of Conduct (MCC), the Commission stated that it is persuaded that the two leaders engaged in a derogatory personal attack, thereby contravening the MCC regulations.

They have been cautioned to exercise caution in their public statements during the MCC period. The Commission will subject their election-related communications to enhanced scrutiny and monitoring from this point forward.

A copy of the warning notice has also been forwarded to party chiefs to sensitize their members to exercise caution while communicating in the public domain. They are urged to refrain from making any derogatory remarks and violating MCC guidelines.

The Commission has meticulously reviewed the contents and statements provided in the responses from Shrinate and Ghosh. Additionally, it has reexamined the remarks made by both individuals.

As a reminder, ECI had previously issued a show cause notice to Supriya Shrinate for her disparaging comments directed at Bollywood actress and BJP candidate Kangana Ranaut. Shrinate subsequently asserted that her social media profiles had been tampered with and emphasized that she would never make such remarks about any woman.

ECI also issued a notice to Dilip Ghosh, MP from West Bengal, for his objectionable and disrespectful remarks against West Bengal CM Mamata Banerjee. Ghosh later asserted that he had made the comments within a political context.

The Commission stressed that it “considers the whole process of conduct elections as a major enhancer of status of women in India and is committed not to allow any erosion of this status in any manner during the election period under its own aegis.”
