A 17-year-old boy was allegedly brutally attacked by three school students on December 5 in Delhi’s Bhagirathi area. All the minors accused in the case were arrested, police official said.

The victim and the three minors accused live in the same neighbourhood in the capital’s Bhaghirati district. Three school students attacked a 17-year-old boy several times with a knife, police said.

According to police officials, the case was registered immediately under sections 304 and 34 of the Indian Penal Code (IPC). All accused have been arrested, and two knives that were used to kill the teenager have also been recovered from the accused.

After following all procedure, accused were produced before the Juvenile Justice Board (JJB) and sent to protective custody by the JJB. Further investigation is going on, police said.

Because the accused are from a different community, Pinki Bhaiya, the national president of the Hindu organisation Hindu Raksha Dal, is attempting to cast the incident in a divisive light.

Pinki Bhaiya shared a video in which he can be seen with victim on Facebook with the remark, “Listen to this very attentively and comprehend what is happening with Hindus,” written in Hindi. “If you are a Hindu, please spread the word about this link as widely as you can. Otherwise, you or your family may be affected by the upcoming catastrophe. Hindus, if you still don’t wake up, you’ll never wake up”, he added.

Officials said that the Ghaziabad police on Wednesday booked the office bearers of the Apartment Owners’ Association (AOA) in connection with an incident in which three minor girls got trapped inside an elevator for about 25 minutes on the eleventh floor of a high-rise in Crossings Republik Township, officials said.

The event occurred on Tuesday, and following a complaint from the girl’s father, a charge has been filed against Chitra Chaturvedi, president of Assotech Nest AOA, and Abhay Jha, AOA secretary.

Three young girls, ages 8 to 9, can be seen waving for help in a video of the incident that was taken from CCTV footage and went viral on social media.

The girls are seen on the video sobbing, frightened, and pressing the elevator buttons after it becomes stuck. The toddlers can also be seen in the footage struggling to push open the lift’s doors.

The FIR was filed in response to a complaint made by Shivam Gehlot, the father of one of the girls, who claimed that the developers were negligent in their maintenance and named the two AOA office holders.

Additionally, the housing society’s residents claimed that inadequate maintenance caused the lift to malfunction.

Following the complaint, a FIR was filed at the Crossings Republik police station late on Wednesday night under IPC sections 287 (for careless conduct with respect to machinery) and 336 (for hasty or negligent act endangering human life or the personal safety of others).

“The incident took place when my daughter boarded the lift from the 20th floor and her two other friends took the lift on the eleventh floor. Thereafter, the lift developed some snag and all three got stuck. They were trapped for 24 minutes,” said Shivam Gehlot.

“The high-rise has the provision of CCTV but the surveillance room gets locked by 6pm after the staff leaves. It was with great difficulty that I managed to get the CCTV footage of the incident and later I approached the police. The AOA office bearers have the responsibility for the maintenance works,” Gehlot added.

When contacted, AOA president Chaturvedi said that she was busy with her official work and requested the response be taken from the AOA secretary.

Abhay Jha, the secretary, said that the incident occurred as the lift developed some technical snag. It was an unfortunate incident, he said, adding that he was informed by the maintenance staff that some time was taken to rescue the girls.

He said that the incident was not reported to him or the president and directly an FIR was registered with the police.

“Upon knowing about the incident on Wednesday afternoon, I issued a show cause of the maintenance agency and also the lift maintenance agency. The lift agency staff arrived on Thursday and are taking up all remedial measures,” Jha added.

We have started an investigation, said Inspector Abur Rehman Siddiqui, SHO, Crossings Republik police station.

</excerpt>

According to a ruling by the Kerala High Court, a marriage between Muslims under personal law is not exempt from the scope of the Protection of Children from Sexual Offenses (POCSO) Act.

In addition, the court decided that POCSO Act offences would apply regardless of whether the marriage was valid or not if one of the parties was a juvenile.

The Single Bench of Justice Bechu Kurian Thomas further observed, “The POCSO Act is a special statute enacted specifically for the protection of children from sexual offences. Sexual exploitation of every nature against a child is treated as an offence. Marriage is not excluded from the sweep of the statute.”

“The POCSO Act is a special enactment. The advances and progress achieved in societal thinking have resulted in the enactment. This special statute was enacted based on principles arising out of jurisprudence relating to child abuse. The child abuse jurisprudence evolved out of the need to protect the vulnerable, the gullible and the innocent child. The legislative intent to protect the child from sexual predators hovering over them under different labels, including that of marriage, is explicitly evident from the statutory provisions,” he further observed.

The court further mentioned that underage marriages have historically been seen as a breach of human rights.

“A child marriage compromises the growth of the child to her full potential. It is the bane of society. The legislative intent reflected through the POCSO Act is to prohibit physical relationships with a child, even under the cover of marriage. This is the intent of society, too, for a statute is, as is often said, the expression or reflection of the will of the people. In the accomplishment of the said intent, the POCSO Act has defined the word ‘child’ in section 2(d) as ‘any person below the age of 18 years,” the court observed.

“Personal laws and customary laws are both laws. Section 42A intends to override such laws also. Therefore it cannot be gainsaid that after the coming into force of the POCSO Act, penetrative sexual intercourse with a child, even if it is under the guise of marriage, is an offence,” the court added.

A Muslim man, 31, who is accused of kidnapping and raping a minor girl, had filed for bail. The court denied his plea. According to the personal laws that applied to them, he claimed that he had legally wed the girl in March 2021.

Three minors killed a 21-year-old man on the occasion of Diwali on Sunday in Mumbai’s Shivaji Nagar neighborhood’s Natwar Parekh compound after they were stopped for lighting firecrackers inside a glass bottle.

The Mumbai Police have detained two of the accused, but one is still on the loose. The event was caught on camera when the victim, Sunil Sankar Naidu, fled from the accused after being stabbed.

Sunil Shankar Naidu allegedly prevented a 12-year-old child from setting off firecrackers in a glass bottle, and the boy then summoned his 14-year-old brother and a 15-year-old friend to attack Sunil, according to Shivaji Nagar police and eyewitnesses. The four got into a fight first, and the three minors then started pounding Sunil. In the midst of this, one of the juveniles stabbed the man in the neck and fled.

After receiving a neck wound, Sunil pursues the kids as well. The CCTV footage shows the victim lagging behind the minors. He is seen attempting to climb the stairs while holding his neck in one hand. He was unable to ascend and lay down on the ground, nevertheless.

Sunil was taken to the hospital right away, but he passed away from his wounds shortly after. The police have two of the juveniles in custody and have filed a murder case against them. One is still at large, though.

A police officer said three men were arrested and two minors were detained on Sunday for allegedly raping a 16-year-old tribal girl in Chhattisgarh’s Surajpur district.

The case’s investigating officer, Deputy Police Superintendent CB Kujur, stated that the girl, who is eight months pregnant, reported the incident on Saturday. He went on to say that the accused, Mohammad Mashuk Raza Mansoori, 20, Abu Bakar, 28, and Ashraf Ali, 27, were arrested the next day.

“The other two minor boys were also detained in the case and police are taking the statements of the accused,” Kujur said.

Police said the girl met Mansoori and one of the minors in December last year. “In February, the accused [Mansoori] insisted on meeting the girl…[he] took [her] to an abandoned fuel station where Bakar, Ali, and two minor boys …raped the girl,” said Kujur. The accused later threatened her with a sexual assault video and allegedly sexually exploited her a couple of times.

“When the girl got pregnant, she told her family about the abuse. The family reported the matter to the police,” said Kujur.

Six people have been arrested in connection with the death of two minor sisters from the scheduled caste community who were discovered hanging from a tree in the Nighasan police station limits of Lakhimpur Kheri district on Wednesday evening.

According to SP Lakhimpur Kheri Sanjiv Suman, one local villager, Chhotu Gautam, and five youths from a nearby village have been arrested in the case. Junaid, Sohail, Hafezul Rehman, Karimudeen, and Adil were identified as residents of neighbouring Lalpur village. The police official briefed the media on the arrests and the sequence of events, stating that Sohail and Hafeezul Rehaman raped and murdered the girls while Chhotu acted as a facilitator. According to the police, the girls had an affair with Junaid and Sohail.

Kareemudeen and Adil, the remaining two accused, assisted the other three in disposing of the bodies.

During a police encounter, Junaid was reportedly shot in the right leg in retaliation.

SP supplement Arun Kumar Singh previously stated that an FIR had been filed against Chhotu and three unidentified youths under Indian Penal Code sections 302 (murder), 323 (voluntarily causing hurt), 452 (criminal house trespass), and 376. (for rape). Sections 3 and 4 of the Protection of Children from Sexual Offenses Act (POCSO) were also included. According to Singh, the FIR was filed based on the sequence of events described by the girls’ mother and the allegations levelled by her.

Local villagers and the girls’ families accused three men of kidnapping and murder and staged a protest near the village’s Nighasan crossing. The mother of the girls claims that three kids from a nearby village on a bike kidnapped the two sisters while they were cutting fodder near a hutment.

The Uttar Pradesh government came under fire from opposition leaders after the deaths of two minor sisters. Congress general secretary Priyanka Gandhi Vadra questioned the “increase in heinous crimes against women” in Uttar Pradesh, claiming that “false advertisements in newspapers and on television” do not improve the law and order situation.

“The incident of murder of two sisters in Lakhimpur (UP) is heart-wrenching. The relatives say that those girls were abducted in broad daylight,” she tweeted in Hindi.

“Giving false advertisements in newspapers and TV every day does not improve law and order. After all, why are heinous crimes against women increasing in UP?”

Four of the five minors who had been detained in early June in relation to the gang rape of a 16-year-old girl who had been kidnapped from a Hyderabad bar were released on bail late on Tuesday.

However, the fifth juvenile, the son of a lawmaker, had his bail petition denied by the juvenile justice board in the Nampally criminal court complex because it was still pending before the high court.

The juvenile board heard separate bail petitions from the five minors twice in June, although they had already been denied. However, the four were released on bail on Tuesday after presenting a ₹5,000 surety for each.

They must comply with the investigating police and show up in front of the authorities whenever they are called, according to a court order.

At the same time, Saduddin Malik, the main defendant in the case, had his bail application denied by the Nampally Metropolitan Magistrate Court.

According to the Hyderabad police, Malik dragged the young woman into his Mercedes Benz at the Amnesia and Insomnia Pub on May 28 in the evening, drove her up to the pastry store, where they transferred her into a Toyota Innova and sexually assaulted her there.

In addition to the Protection of Children from Sexual Offences Act, police filed a complaint under sections 376-D (gang rape), 323 (causing harm), and 376 (kidnapping) of the Indian Penal Code. In accordance with the Information Technology Act, a second lawsuit was also filed for recording the rape and disseminating the images and video.
