On January 16, Mahua Moitra, MP Trinamool Congress, took to social media to place a litany of complaints regarding the delivery issues of Swiggy after getting spoiled ice creams. The 50-year-old leader revealed that she had ordered 10 Minus Thirty mini sticks for Rs. 1,220, which arrived inedible.She demanded a refund or replacement for the “expensive” order.

Delhi Police filed a First Information Report (FIR) against Mahua Moitra, a Trinamool Congress (TMC) parliamentarian, for a ‘derogatory’ social media post concerning National Commission for Women (NCW) chairperson Rekha Sharma.

Moitra has been charged under Section 79 of the Bharatiya Nyaya Sanhita (BNS), a newly enacted law effective from July 1, which replaces the British-era Indian Penal Code (IPC). This section pertains to acts intended to insult the modesty of a woman.

The FIR was lodged based on a complaint filed by Rekha Sharma, the NCW chairperson.

On Thursday, Rekha Sharma visited Hathras in Uttar Pradesh following a stampede at a religious event on July 2 that claimed the lives of 121 people. Reacting to the video, Moitra wrote: “She is too busy holding up her boss’s pajamas.”

Jai Anant Dehadrai Summoned by Delhi HC, Here’s Why

Advocate Jai Anant Dehadrai is summoned by Delhi high court along with others in defamation case filed by the MP of BJD Pinaki Mishra on Wednesday.

Dehadrai accused Mishra of corruption. And also made use of defamatory words calling BJD MP “Canning Lane”, “Odia Babu” and “Dalal of Puri” etc.

Taking the note of the submissions, the bench of Jasmeet Singh issued summons to all defendants involved in the case.

What Happened?

As per the Pinaki Mishra’s suit, The MP earlier shared close friendship with the advocate’s close friend Mahua Moitra. Later due to personal differences, Jai Anant filed a complaint against TMC’s key leader. Under which he accused Moitra of corruption and bribery.

In his complaint, he further referred Pinaki Mishra as MP from Orissa. Who was a close aid of Mahua Moitra. Since November 2023, Jai Anant not only made series of allegations against Moitra, but he also accused those people with whom Mahua was close with which also included the complainant.

Later, the lawyer made series of tweets where the complainant, was repeatedly addressed with many names such as Canning Lane” / “Odia Babu” / “Dalal of Puri”. Along with the publication of criminal conspiracies. Further he also created the fake account by the name of “Chandrawami Pinaki Moitra”.

Thus, leading to the registration of the defamation complaint by the BJD MP.

Meanwhile the court observed that since CBI looking into the matter of corruption, one should refrain from making any allegations in public.

West Bengal Chief Minister Mamata Banerjee ridiculed the BJP’s goal of securing over 400 seats in the Lok Sabha elections, instead challenging the party to aim for at least 200 constituencies on Sunday.

Ms. Banerjee further declared her firm stance against the implementation of the Citizenship Amendment Act (CAA) in the state.

She cautioned the public, warning that applying for the CAA could potentially classify an applicant as a foreigner, and urged them against submitting applications for it.

“The BJP is saying “400 paar”, I challenge them to cross the 200 seats benchmark first. In 2021 assembly polls, they gave a call of 200 plus seats but had to stop at 77,” she said.

“The CAA is a trap to turn legal citizens into foreigners. We would allow neither CAA nor NRC in West Bengal,” she said while addressing her first rally in the election season after her injury earlier this month.

Ms. Banerjee, the TMC supremo, criticized the opposition bloc INDIA partners, comprising the CPI(M) and Congress– for “joining hands with the BJP” in West Bengal.

“There is no INDIA alliance in West Bengal. The CPI(M) and Congress are working for the BJP in Bengal,” she said while addressing an election rally at Krishnanagar in support of TMC candidate Mahua Moitra.

“Our MP Mahua Moitra was maligned and expelled from the Lok Sabha as she was vocal against the BJP,” she added.

CBI raids at Mahua Moitra’s residence linked with cash for query case

The Central Bureau of Investigation (CBI) is currently conducting searches at the residences and other locations of Trinamool Congress leader Mahua Moitra in Kolkata, relating to an alleged cash-for-query case.

This action follows the directive from Lokpal on Tuesday, instructing the CBI to investigate all aspects of the accusations against Trinamool Congress leader and former MP Mahua Moitra in the ‘cash for query’ case. The Lokpal, on March 15, had mandated the CBI to examine the allegations under Section 20(3)(a) and submit a report within six months. Additionally, the CBI was required to provide periodic updates on the investigation’s progress every month.

In its order, Lokpal stated, “After careful evaluation and consideration of the entire material on record, there remains no doubt regarding the fact that the allegations leveled against the Respondent Public Servant (RPS), most of which are supported by cogent evidence, are extremely serious in nature, especially in view of the position held by her. Therefore, in our considered opinion, a deeper probe is required to establish the truth.”

Previously, the CBI had conducted a preliminary inquiry into the allegations against Moitra based on a referral from the Lokpal. Moitra was ousted from the Lok Sabha in December last year after the House endorsed the findings of its ethics committee, which found her guilty of the accusations in the Cash for Query case.

Moitra has consistently denied any wrongdoing, asserting that she is being targeted for raising questions about the dealings of the Adani Group. BJP MP Nishikant Dubey had lodged a complaint against her with the Lok Sabha Speaker, alleging that she received “cash and gifts” from Dubai-based businessman Darshan Hiranandani to “pose questions in Parliament.”

Earlier this month, the Delhi High Court dismissed Mahua Moitra’s plea seeking to restrain Nishikant Dubey and Jai Dehadrai from making allegations in the cash-for-query case.

Expulsion from LS: SC to Hear Moitra’s Plea today

The Supreme Court on Monday will hear a petition filed by Trinamool Congress (TMC) leader Mahua Moitra, challenging her expulsion from the Lok Sabha. A bench comprising Justices Sanjiv Khanna and Dipankar Datta will hear the petition, wherein the court had previously declined to provide interim relief to Moitra, who had requested permission to participate in the Lok Sabha proceedings until her plea is finally adjudicated.

On January 3, the apex court had sought the response of the Lok Sabha secretariat while noting that one of the issues at hand pertains to the jurisdiction of courts and the power of judicial review in the matter. Solicitor General Tushar Mehta, representing the Lok Sabha secretary general, had urged the court not to delve into the internal disciplinary matters of another sovereign organ of the State.

He had contended that Parliament can internally address disciplinary matters concerning its members through its in-house procedures, which are not subject to judicial review, thus rendering Moitra’s plea non-maintainable. Senior advocate Abhishek Singhvi, appearing for Moitra, had argued that contrary to circulating theories, the TMC leader was expelled from the Lok Sabha for sharing her parliamentary login credentials.

Singhvi had stated that Moitra was expelled under a rule pertaining to hacking. On December 8 20203, following a heated debate in the Lok Sabha over a panel report, during which Moitra was denied the opportunity to speak, Parliamentary Affairs Minister Pralhad Joshi moved a motion to expel the TMC MP from the House for “unethical conduct”. The motion was adopted by a voice vote.

The ethics committee of the Lok Sabha found Moitra guilty of “unethical conduct” and contempt of the House for sharing her Lok Sabha members’ portal credentials user ID and password with unauthorized individuals, which purportedly had an irremediable impact on national security, as asserted by Joshi. The committee had further recommended that due to Moitra’s “highlyobjectionable, unethical, heinous, and criminal conduct,” a comprehensive legal and institutional inquiry be initiated by the government within a specified timeframe.

The motion initiated by Joshi stated that Moitra’s “conduct has additionally been found to be unbecoming as an MP for accepting gifts and illegal gratification from a businessman (Darshan Hiranandani) to further his interest, which is a serious misdemeanor and highly-deplorable conduct” on her part.

Previously, the chairman of the ethics committee, Vinod Kumar Sonkar, had presented the initial panel report on a complaint lodged by Bharatiya Janata Party (BJP) MP Nishikant Dubey against Moitra. In October 2023, Dubey, based on a complaint filed by Supreme Court lawyer Jai Anant Dehadrai, alleged that Moitra had posed questions in the Lok Sabha in exchange for cash and gifts from Hiranandani to launch an attack on industrialist Gautam Adani and Prime Minister Narendra Modi.

Expelled TMC MP Mahua Moitra’s office claims bungalow vacated before 10 am, no eviction occured

The office of former Trinamool Congress (TMC) MP Mahua Moitra told reporters that the TMC leader had left the government bungalow in the national capital by 10 am on Friday, prior to the arrival of “authorities,” and that “no eviction” had occurred.

“House number 9B Telegraph Lane occupied by Mahua Moitra, was fully vacated by 10 am this morning (January 19, 2024) and the possession was handed over by her lawyers to the Directorate of Estates, who are inspecting and engaged in due process. Premises were vacated before authorities arrived and no eviction took place at all,” Moitra’s office said in a statement.

The TMC leader was denied relief and a stay of the government bungalow eviction process earlier on Thursday by the Delhi High Court. Moitra requested a stay in opposition to the eviction order. The Supreme Court did not stay her eviction, the high court observed. The interim application seeking a stay of the January 16, 2024, eviction order’s operation was dismissed by Justice Girish Kathpaliya.

Dismissing her application the high court stated, “In view of the pendency of the issue of expulsion of petitioner before the Supreme Court and the issue of extension of time to vacate the government accommodation being inextricably linked with that, coupled with the fact that as on date petitioner has no right.”
“This court is not inclined to invoke jurisdiction under Article 226 of the Constitution of India to restrain the operation of the impugned eviction order. Accordingly, the application stands dismissed,” the HC stated in its order.

Mahua Moitra Challenges Eviction Notice, Warns of ‘Use of Force’ in Delhi High Court

Trinamool Congress leader Mahua Moitra is set to approach the Delhi High Court today to contest a notice instructing her to vacate the government bungalow allotted to her as a Member of Parliament (MP) and warning of the “use of force” if necessary, sources revealed to NDTV.

Moitra, who was expelled as a Lok Sabha MP last month on grounds of unethical conduct, will file a writ petition challenging the eviction notice in the court of Justice Manmohan shortly.

Her legal team argues that, as a candidate for the upcoming Lok Sabha polls, Moitra, like other MPs, is allowed to retain her residence from the last day of the Parliament session preceding a general election until the day of the results. Given her status as a candidate, they contend that this provision should apply to her as well.

The eviction notice, issued by the Directorate of Estates overseeing government properties, sternly instructs Moitra to vacate the premises immediately. It states that failure to do so may lead to eviction “by the use of such force as may be necessary.”

The notice asserts that Moitra had been given sufficient opportunity to prove she was not an unauthorized occupant, but she failed to do so.

Moitra had previously approached the high court, prompting the court to advise her to request the Directorate of Estates to allow her to remain in the bungalow for the time being. The court highlighted that rules allowed authorities to permit overstaying for up to six months under certain circumstances. While the court refrained from commenting on the case’s merits, it allowed Moitra to withdraw her petition.

The eviction order specifies that if Moitra decides to challenge the eviction notice in any court, she will be liable to pay damages for each month.

Moitra, occupying a bungalow in Delhi’s Telegraph Lane, had her government accommodation allotment canceled on January 7, a month after her expulsion as an MP. She had requested time until the Lok Sabha polls, citing the hindrance the loss of government accommodation would pose to her campaign.

Moitra faced expulsion in December after a Parliamentary panel found her guilty of unethical conduct for accepting expensive gifts from a businessman and sharing her Parliament login credentials with him.

Advocate Dehadrai alleges illegal surveillance by Mahua Moitra

On Tuesday, Advocate Jai Anant Dehadrai alleged that TMC leader Mahua Moitra is engaging in “illegal surveillance on him with her connections in West Bengal police.” In a letter to CBI Director Praveen Sood and Union Home Minister Amit Shah dated December 29, Advocate Dehadrai claimed that there is a possibility that Moitra is “tracking” his physical location using his aphone number.

Dehadrai’s letter also accused Moitra of a history of misusing her influence with certain senior officers of the Bengal Police to obtain Call Detail Records (CDR) of private individuals, allegedly to stalk specific individuals and their contacts.

The complaint highlighted an instance from 2019 when Moitra supposedly tracked a person named Suhaan Mukerji. Dehadrai alleged that Moitra had revealed orally and in writing (via WhatsApp on 26.09.2019) that she had actively monitored her ex-boyfriend, Suhaan Mukerji, suspecting him of being involved with a German woman.

Dehadrai further alleged that Moitra, assisted by “senior Bengal Police Officers,” had access to the complete call records and history of Mukerji’s phone, including detailed information about the individuals in contact with Mukerji and the precise physical location of his phone throughout the day.

The Advocate also claimed that Moitra had previously threatened him and that he had observed instances where he felt his car was being followed outside his residence in Delhi.
Responding to the allegations, Mahua Moitra ridiculed the claims made in the complaint. She called for the Ministry of Home Affairs to appoint a Special Director in the CBI to investigate complaints from “jilted exes” across India. She also made remarks involving political references and accused the Home Minister of honing surveillance skills while serving in Gujarat.

Moitra, who had faced cash-for-query allegations, was expelled from the Lok Sabha after the Ethics Committee’s report was adopted by the Parliament. She criticized the Ethics Committee for not conducting a thorough investigation into the matter, claiming unfair treatment.

The Supreme Court has deferred the plea filed by expelled Lok Sabha MP Mahua Moitra challenging her expulsion over alleged misconduct in the cash-for-query case. The hearing, scheduled for Friday, was adjourned until January 3. Ethics Panel report on TMC MP Mahua Moitra to be tabled in Lok Sabha

The report of the Ethics Committee on Trinamool Congress MP Mahua Moitra in an alleged “cash-for-query” case will be tabled in the Lok Sabha on Friday as the Parliament meets on Day 5 of the current Winter Session.

“Chairperson Vinod Kumar Sonkar and Aparajita Sarangi to lay on the Table the First Report (Hindi and English versions) of the Committee on Ethics,” the agenda released by Lok Sabha read.

The report was included in the Lok Sabha’s list of items for discussion on the first day of the current Winter Session of Parliament. It could not, however, be pursued. Following a 500-page report that examined the charges brought forth by BJP MP Nishikant Dubey, the Ethics Committee recommended on November 9 that Moitra be removed from the 17th Lok Sabha due to her “highly objectionable, unethical, heinous and criminal conduct.”

In the panel last month, the draft report was approved by a vote of 6:4. Sources claim that Mahua Moitra visited the United Arab Emirates four times between 2019 and 2023, during which time her login was accessed multiple times, as documented in the draft report on her cash-for-questions case.

“On 47 occasions, her member portal login credentials were accessed from Dubai,” sources said citing the draft report of the ethics committee.
The TMC has demanded that the MP Mahua Moitra be given a chance to put forth her defence. TMC MP Sudip Bandyopadhyay said, “I spoke with the Speaker, and he said that this committee report along with other reports will be tabled. I said that TMC MP Mahua Moitra should be given a chance to speak…”

Union Communication Minister Ashwini Vaishnaw will move the Post Office Bill, 2023 for consideration and passage in the Lower House as part of the legislative business agenda in the interim. The Rajya Sabha has previously passed the bill.

Also, Finance Minister Nirmala Sitharama will introduce a Bill to authorize payment and appropriation of certain further sums from and out of the Consolidated Fund of India for the services of the financial year 2023-2024.

Mahua Moitra, a Trinamool MP, attacked Union Minister Giriraj Singh’s “misogyny” and the BJP on Thursday in response to Singh’s “Thumka” comments directed at Mamata Banerjee, the chief minister of West Bengal and leader of her party.
Moitra said that the BJP party could not handle the success of an independent woman, referring to Singh as a “Besharam (shameless) Minister.”

Moitra said, “This ‘Besharam (shameless) Minister who can talk like this about a woman chief minister tells about the pathetic situation our country is in. All BJP ministers and their MLAs are misogynists. They are patriarchal and they dislike women. They cannot digest a woman’s success especially those who are successful without taking any man’s support.”

“He is such a liar. He used the word ‘Thumke lagana’ then he said I’ve not said these words. That is the problem with the BJP. Every time they open their mouth and their lips move, it is to lie,” the Trinamool MP said.
Asked if the party is demanding any apology on the issue from the Union Rural Development Minister, Moitra said said, “What to expect from a Besharam (shameless) minister.”

The controversy started when a video of Giriraj Singh saying that Minister Mamata Banerjee shouldn’t do “thumkas” because her state is not doing well economically or in terms of employment because of her poor leadership went viral on social media.

Preneet Kaur, the wife of former Punjab Chief Minister Captain Amarinder Singh, is currently in the BJP.

According to panel chairman Vinod Sonkar, the Lok Sabha Ethics Committee, which is investigating the “cash-for-query” claims made against Trinamool MP Mahua Moitra, will present a “detailed report” to Speaker Om Birla on Friday.
The Lok Sabha Ethics Committee met on Thursday to discuss Mahua Moitra’s alleged cash-for-query payments made by BJP MP Nishikant Dubey.
Following the meeting, Vinod Sonkar stated that four ethics panel members had provided dissenting remarks, while six members had backed the findings.

“A report had been drafted by the Ethics Committee on the allegations against Mahua Moitra. The agenda of today’s meeting was to adopt the report. Six members supported the report while four members submitted their dissent notes…A detailed report is being submitted to the Lok Sabha Speaker tomorrow…The action, whatever it is, will be taken by the Speaker…,” Sonkar told the media.

Preneet Kaur, a Congress MP, is one of the six lawmakers who backed the draft. According to sources on Thursday, the Committee accused Moitra of engaging in “unethical conduct” and disclosing her ID login credentials to unauthorized individuals in its draft report.

‘Cash for Query’ case report ready according to Lok Sabha Ethics Committe,will be discussed and sent to speaker

The Chairperson of the Lok Sabha Ethics Committee, Vinod Sonkar, announced ahead of the committee’s meeting that a report has been drafted and will be sent to the Speaker of the House following discussion regarding the cash-for-query allegations against Trinamool Congress MP Mahua Moitra.

“The ethics committee has seen all evidence examined, Darshan Hiranandani’s affidavit, Nishikant Dubey’s complaint and Mahua Moitra’s statement. A report has been drafted on which the Ethics Committee will hold a discussion. Following this, the report will be sent to the Lok Sabha Speaker,” Vinod Sonkar said, speaking ahead of the meeting.

Prior to Thursday’s meeting, the Ethics Committee Chairperson stated that two meetings were conducted during which Moitra’s statement was recorded, Dubey’s complaint and Hiranandani’s affidavit were reviewed.

“In the two meetings before this, we examined the complaint by Nishikant Dubey and the affidavit submitted by Hiranandani. Mahua Moitra’s statement was also recorded. After all this, today an Ethics Committee meeting is taking place. We will discuss all the issues in detail and send the proposal to the Lok Sabha Speaker,” he added.
When questioned about the possibility of revoking Mahua Moitra’s Lok Sabha membership, Sonkar said, “The Committee will decide on this. After examining all the facts, it will send its report to the Speaker.”

Sources claim that the committee has the authority to order Mahua Moitra removed from the Lok Sabha and to take action against committee member Danish Ali, a member of the Bahujan Samaj Party. She further described the episode as “proverbial vastraharan (stripping)” referring to the chapter in Mahabharat, where Kauravas humiliated Padavas’ queen Draupadi in darbar.
In a letter to Lok Sabha Speaker Om Birla, Moitra stated that “unethical, sordid, prejudiced behaviour was meted out” to her during the meeting.

Cash for query row: Lok Sabha’s Ethics Committee to adopt draft report on November 7

On November 7, in Delhi, the Lok Sabha Ethics Committee will convene in order to approve a draft report regarding the purported “cash-for-query” accusations made against TMC MP Mahua Moitra.

“Complaint dated 15 October 2023 given by Dr Nishikant Dubey, MP against Mahua Moitra, MP for alleged direct involvement in cash for query in Parliament with reference to examination/investigation of the alleged unethical conduct of Mahua Moitra, MP by the Committee on Ethics–Consideration and Adoption of Draft Report,” the agenda released by Lok Sabha read.
Earlier, TMC MP Mahua Moitra, who appeared before the Lok Sabha Ethics Committee on November 2 over cash-for-query allegations against her and opposition members of the panel “walked out” of the meeting.

Members of the opposition questioned the line of questioning and claimed that the Trinamool Congress MP was subjected to “personal questions.” Congressman Uttam Kumar Reddy, Janata Dal (United) MP Giridhari Yadav, and BSP MP Danish Ali were among those who left. “They probed the woman (Mahua Moitra) with private inquiries. We left because they had no right to inquire about our personal lives,” Giridhari Yadav subsequently remarked.

Nishikant Dubey has accused Trinamool MP Moitra of accepting bribes from Dubai-based businessman Hiranandani in exchange for Moitra raising “Cash for Query” allegations in Parliament directed at the Adani Group. In a letter titled “Re-emergence of nasty ‘Cash for Query’ in Parliament,” Dubey also asked that the issue be looked into. It was addressed to Om Birla, Speaker of the Lok Sabha. In addition, he said that he had received evidence of purported bribes from Advocate Jai Anant Dehadrai. Jai Dehadrai and Dubey have both appeared before the panel.
