</excerpt>

A Kolkata court has sentenced Sanjoy Roy, the convict in the RG Kar rape-murder case, to life imprisonment while making strong observations regarding the response of the hospital authorities and police. The case pertains to the brutal rape and murder of a 34-year-old doctor within the hospital premises, an incident that exposed significant lapses in the handling of the situation by the authorities.

Court Points to Police Negligence

In his 172-page verdict, Judge Anirban Das highlighted several procedural lapses by the police, particularly officers from Tala Police Station, who were among the first responders. The court observed that the victim’s father had to struggle significantly to have his complaint registered, questioning why the police initially attempted to withhold information. The order specifically mentioned that an Assistant Sub-Inspector, Anup Dutta, allegedly provided undue support to the accused, enabling him to lead a life unbefitting of a disciplined force member. The judge urged the police commissioner to take strict action against such misconduct and emphasized the need for better training in handling cases involving electronic and scientific evidence.

Hospital’s Response Under Scrutiny

The court also criticized the state-run hospital’s initial response, noting that hospital representatives misinformed both the police and the victim’s family by suggesting that the doctor had died by suicide. The order stated that there were clear attempts to suppress the truth to avoid scrutiny and potential consequences. The judge condemned the hospital authorities’ failure to consider the possibility of unnatural death and their reluctance to notify law enforcement in a timely manner. The court credited junior doctors for their protests, which played a crucial role in ensuring the case received proper attention.

Convict’s Guilt Established Beyond Doubt

Despite confusion over certain aspects of the case, the judge asserted that the prosecution had provided sufficient evidence to prove Roy’s guilt. The court noted that Roy failed to offer a credible explanation for his presence at the crime scene and dismissed his claims during his examination under BNSS provisions. The court also observed that Roy’s actions were impulsive and not premeditated, emphasizing that motive, though not always evident, is often a psychological phenomenon beyond direct proof.

Why Life Imprisonment Over Death Penalty

Addressing the question of sentencing, the court justified its decision to impose life imprisonment rather than the death penalty, citing the principle of reformative justice. The judgment referred to precedents, such as the Bachan Singh vs State of Punjab case, emphasizing that life imprisonment is the rule and the death sentence should be reserved for the ‘rarest of the rare’ cases. The court stated that justice should focus on rehabilitation rather than vengeance and that public sentiment should not dictate judicial decisions. It further noted that there was no prior criminal record for the convict, making life imprisonment an appropriate punishment.

This landmark ruling has not only delivered justice in the case but also highlighted the urgent need for systemic reforms in both law enforcement and healthcare institutions to prevent such lapses in the future.

</excerpt>

Junior doctors from government hospitals across West Bengal, along with concerned citizens, held torch rallies on Sunday, pushing for justice in the case of a rape and murder of a trainee doctor at Kolkata’s RG Kar Medical College. The protests came just ahead of a significant Supreme Court hearing regarding the case.

Demand for Justice and Better Security

The junior doctors, who previously staged a 41-day cease-work protest, are calling for improved safety measures at hospitals. Their main demands are justice for the victim and increased security for medical staff at their workplaces. The rallies took place at key medical institutions including RG Kar Hospital, Sagore Dutta Hospital, SSKM Hospital, Calcutta Medical College, and Jadavpur.

Organised by the West Bengal Junior Doctors’ Front

The rallies were led by the West Bengal Junior Doctors’ Front, a group representing medical professionals from hospitals across the state. Besides justice for the victim, the protests highlighted the issue of a “threat culture” prevalent in medical colleges, where students reportedly face intimidation.

Renewed Protests Following Another Assault

The protests gained momentum after reports surfaced of an assault on three doctors and three nurses at Sagore Dutta Hospital. Medical staff argue that these attacks show the government’s failure to deliver on its promises to improve security at hospitals.

Threat of Cease-Work Strike

Junior doctors have warned they may resume their full cease-work strike if the state government does not take urgent steps to improve security at hospitals. “We are giving an ultimatum to the state government,” said one junior doctor. “If the government fails to take positive measures to strengthen security in hospitals and improve infrastructure, we will go on a full strike from Monday.”

RG Kar Hospital Rape-Murder Case

The victim, a trainee doctor, was found dead in a seminar room at RG Kar Hospital on August 9. The autopsy confirmed she had been sexually assaulted and severely injured. CCTV footage led to the arrest of the main suspect, Sanjay Roy, whose Bluetooth headphones were found near the crime scene. The case has since been handed over to the Central Bureau of Investigation (CBI).

Nationwide Outcry

Following the incident, there were widespread protests across the country, with people demanding swift justice for the victim and calling attention to the broader issue of safety for medical professionals in West Bengal. The Supreme Court hearing is now a focal point for the ongoing movement.

</excerpt>

As we all know by now, the recent rape case at Kolkata’s R.G. Kar Medical College has reignited the demand for a special law or new legislation to protect female staff in hospitals. Over the past few years, we have witnessed how the government has enacted and amended rape laws in response to public outcry. From the Bhanwari Devi case, which resulted in the Supreme Court’s Vishakha Guidelines of 1997, through to Nirbhaya (2012), bringing sweeping and radical changes to criminal laws including amendments to Juvenile Justice Act where Justice Verma Committee recommendations were implemented.

However, these changes in the law have not stopped the rape cases numbers from increasing. A woman is sexually assaulted every 15 minutes across the country, according to a government report – and in 2022, police received 31,000 reports of rape. This is evident because the number of rape cases has not decreased, even with changing laws. Clearly, our legal system has not made an impression deterrent in society. But in such situations, who should be held accountable? Let’s take the recent R.G. Kar case as an example to discuss this problem. It was found that several corruption cases had been registered against the principal, Dr. Sandip Ghosh, yet no action was taken against him. Why? Despite allegations and evidence being presented to the appropriate authority, no steps were taken. In fact, those who filed complaints were threatened by government officials and transferred from R.G. Kar Hospital. This clearly indicates corruption and a misuse of the powers given to the executive body.

In India, the doctrine of the separation of powers is followed. This constitutional law doctrine divides government responsibilities into three branches: legislative, executive, and judicial. The goal is to prevent any one branch from having too much power and to provide checks and balances. Each branch is given certain powers to check and balance the others. However, in reality, we see a dominance and overlapping of power, undermining this principle. Considering this recent case when it mentioned by the legislature that the medical college has to follow certain guidelines for their staff and patients when why there is no check system in the medical institutions? Its compulsory for everyone to follow Vishakha Guidelines in the workplace but how many institutions or workplace are actually following this guideline strictly. In the judiciary, for instance, the Criminal Law Amendment Act of 2013 mandates that trials for certain offenses must be completed within two months of the chargesheet being filed. The Act also requires that trials be held daily, with adjournments allowed only for compelling reasons that must be recorded. However, the pressing question remains: how many cases have actually been resolved within this timeframe? In rape cases, the victim and her family are repeatedly traumatized—not just by the crime itself but also by society, the media, the police, and the judiciary. Even if justice is eventually served, they often find that half of their lives and finances have been consumed by court fees, leaving them in a state of despair.

When the accused comes from an influential family, as in the Jessica Lal murder case, the pursuit of justice can become even more prolonged. If we truly want to control crime in our society, we must enforce a proper separation of powers and, to do that, we must first tackle corruption. Corruption is the root cause of society’s apathy, where people believe that filing a case or protesting is futile because no one will hear their plea. Even if they manage to file a case, they are often pressured to withdraw it or threatened by goons.

This is the current reality in India. The situation cannot be changed merely by enacting new laws; it requires proper implementation and execution of existing ones. In light of the recent R.G. Kar case, it’s time for a mass feminist movement—one where every woman, whether working or not, student or not, regardless of caste, creed, religion, or marital status, raises her voice against corruption, the system, and those responsible for our protection who fail to fulfil their duties. It’s time for another “Me Too movement” but this time it should be a “Safety Movement in the Workplace”. With this movement, women and female students from all sectors across India can highlight security issues they face in their workplaces so that by gathering information from their grievances, government considers can frames uniform laws and policies regarding workplace safety.

This move addresses most of the doctors’ demands, aiming to resolve ongoing issues in the healthcare system.
</excerpt>

West Bengal Chief Minister Mamata Banerjee has taken decisive action following a tense meeting with protesting doctors. In response to their demands, Banerjee has announced the removal of two top health officials and the Kolkata Police Commissioner.

Key Changes Announced:

– Health Officials Removed: The Director of Medical Education, Dr. Kaustav Nayek, and the Director of Health Services, Dr. Debashish Halder, have been removed from their positions.

– Police Leadership Shake-Up: Kolkata Police Commissioner Vineet Goyal and Deputy Commissioner of Police (North), Abhishek Gupta, are being replaced.

Doctors’ Demands and Meeting Details:

The doctors’ demands included strict punishment for those involved in a recent tragic incident, improved security, and reform within the healthcare system. The meeting with Banerjee, held from 6:20 PM to 8:45 PM, ended with significant concessions but did not fully meet all the doctors’ demands.

Next Steps and Government Response:

Banerjee urged the doctors to return to work, highlighting that 99% of their demands were met. She appealed for continued dialogue to resolve any outstanding issues. The government has agreed to record the minutes of the meeting and provide copies to the doctors.

Police Investigation and Ongoing Protests

Police have cordoned off the area and are conducting further investigations. Meanwhile, the protests have entered their 34th day. These protests have seen renewed discussions between the protesting doctors and the West Bengal state government.

State Government’s Call for Talks

On Wednesday, Chief Secretary Manoj Pant reached out to the protesting doctors, inviting them to a meeting. His letter emphasized the disruption caused to patients and their families due to the protests. Pant proposed a meeting at the state secretariat, Nabanna, suggesting that a delegation of 12-15 doctors attend the discussions.

In his strongly worded letter, the Chief Secretary urged the doctors to limit the number of participants as per government guidelines, while assuring them that the state is eager to resolve the issue through dialogue.

Protesters’ Response to Government Invitation

However, the doctors pushed back against the invitation, requesting that their delegation consist of at least 30 members. They also demanded that the meeting be broadcast live for full transparency. The doctors further insisted that West Bengal Chief Minister Mamata Banerjee be present at the meeting, and that discussions focus on addressing their five main demands.

What Are the Doctors’ Demands?

The protesting doctors have put forward five key demands:

Holding accountable and punishing those responsible for the rape and murder, including any individuals involved in tampering with evidence.

Disciplinary action against former RG Kar Medical College Principal Sandip Ghosh.

The resignation of Kolkata Police Commissioner Vineet Goyal and Health Secretary Narayan Swaroop Nigam.

Improved security measures for healthcare workers.

Addressing the ongoing culture of threats within government healthcare institutions.

The situation remains tense as both sides seek a resolution to the ongoing protests while ensuring justice for the deceased doctor.

</excerpt>

Agitating junior doctors continued to spar with the State Government over conditions to engage in talks with Chief Minister Mamata Banerjee, which the Government rejected, insisting on talks “without preconditions”. The junior doctors are pressing for justice for a young medical student who was raped and murdered at the state-run RG Kar Medical College and Hospital on August 9.

State minister Chandrima Bhattacharya alleged that the fact that the agitating doctors had sent an email to the Chief Minister’s Office at 3:50 am laying down their pre-conditions pointed to the “political nature” of the protests. The doctors’ rejected the charge.
The protesting junior doctors had shared their list of five demands in an email sent to the state government. “Those creating trouble in justice should be asked to resign. Elections should be conducted, college counsel should be given recognition, and elected representatives should be part of it and not ‘selected’ representatives”.

The junior doctors maintained their sit-in outside Swasthya Bhawan, the State Health Department’s headquarters, for a second day, demanding the removal of the Kolkata Police Commissioner and senior Health Department officials from their positions.
Earlier in the day, the West Bengal Government had invited 12-15 representatives of junior doctors for talks at State secretariat Nabanna by 6 pm. Protesting doctors claimed that the Chief Secretary’s invite sent in the afternoon inviting them for talks did not mention about Mamata Banerjee’s presence during the proposed meeting. The doctors continued to insist on holding a face-to-face discussion with the Chief Minister which would have to be telecast live “in the interests of transparency”.

“Once again, as another opportunity, we invite your delegation preferably consisting of 12-15 colleagues to join us for a discussion at 6 pm today, i.e. 11.09.2024, at Nabanna. A list of the members of your delegation may please be intimated by email,” said a communication from the State Government sent by the Chief Secretary Manoj Pant on Wednesday afternoon.

Responding to the Chief Secretary’s invite for a meeting, the protesting junior doctors demanded at least a 30-member delegation to meet Chief Minister Mamata Banerjee. “There are 26 State Government colleges in West Bengal. We want at least one representative from each college to be present,” said Kinjal Nanda, one of the striking doctors.

Other demands of the doctors include a discussion on their five-point demand in presence of the Chief Minister and live streaming of their meeting for the sake of “transparency”.
After declining the Health Secretary Narayan Swarup Nigam’s invite on Tuesday, the agitating junior doctors had sought a meeting with the Chief Minister to discuss their demands and resolve the impasse. They declined yesterday’s invite for a meeting from the Health Secretary claiming the email invite felt “insulting”.

On Monday, at a press conference, Mamata Banerjee had invited the junior doctors for a meeting at the State secretariat to address the issue. State Finance Minister Chandrima Bhattacharya said the Chief Minister was waiting, but a protesting doctor called the email an “insult,” citing their demand for Nigam’s resignation and the limit on representation.
Despite the Supreme Court’s directive to resume duties by 5 pm on September 10, protesting junior doctors in Kolkata continued their strike for the 33rd day on Wednesday.
The Supreme Court on Monday had directed doctors on strike to resume work today at 5 pm, assuring them that they would not face any adverse actions, including punitive transfers. However, they also warned that if doctors did not return to work, they could not be held responsible for any actions taken against them. The Trinamool Congress also hailed the court’s judgement

Meanwhile, Mamata Banerjee has called a review meeting on September 12 with principals, directors and medical superintendents from all State-run medical colleges and hospitals. All police commissioners and district magistrates have also been invited.
The agitating doctors also slammed senior advocate Kapil Sibal, representing the West Bengal Government, for presenting “false and concocted information” before a Supreme Court bench led by Chief Justice D Y Chandrachud and also comprising Justices J B Pardiwala and Manoj Misra.

On Monday, Sibal had presented a status report prepared by the State Health Department. “A status report has been filed. The State Health Department has filed a report. Twenty-three people have died as doctors are on strike,” Sibal told the bench
Reacting to the stand-off between agitating junior doctors and the State Government, Congress leader Adhir Ranjan Chowdhary termed the protest as “historic”. “We are supporting them and are fighting for them. This is historic, the world will remember it”, he said.

The ruling Trinamool Congress claimed the ongoing junior doctors protest has affected patients access to critical care across hospitals. “A month after the R G Kar tragedy, confusion clouds the minds of countless patients. The cease-work by junior doctors has left vulnerable people unsure about access to critical care. Those already battling illness are now being turned away by hospitals meant to be their last hope”, the party posted on X.
Another Trinamool Congress MLA Humayun Kabir threatened that “people would soon hit the streets protesting against the doctors’ stir and therefore, he would not be able to guarantee the safety of doctors.”

</excerpt>

The barbaric act of brutally raping and killing a doctor in RG Kar Medical College in Kolkata the other day has remained a shock to the nation and even the whole world. This heart wrenching event raises an old and uncomfortable question: Hum apni suraksha ke liye kis par bharosa karein? And as we recall this tragic event, one has to wonder why we stay with conventional security measures and systems when we can have AI which may contain these act in time. Thus the need for AI and modern securities system has never been more urgent, we have the tools to ensure that tragedies like this one never happen again. So, why aren’t we using them?

To understand how the use of AI can avoid such occurrence like the one that was experienced at RG Kar Medical College, it is necessary to look into details the working of an AI security system. These systems employ sophisticated algorithms that enable it work on a large amount of data obtained from video feeds, motion detectors, and other sensors in real time. Unlike human guards who might miss something or be in the wrong place at the wrong time, AI systems can monitor multiple areas simultaneously without getting tired or distracted.

In case of when AI detects something queer for instance someone has breached a restricted area or is acting in an abnormal manner the AI alerts security whose next course of action is to act. This response is very important is in order to avoid the situation get worst in affecting many lives. And also, one can state that, as the AI system can get acquainted with similar situations, it will enhance its performance in terms of threat identification. This means that the longer the system is in place the more it evolves and develops into a recognized system that can detect certain impending evils.
The development of AI systems shall follow the same fundamental approach as the experienced detective becomes more efficient in solving cases with every single case because AI learns from data and feedback mechanisms.

What I am talking is not a science fiction, it is happening in the other part of world like many states and organization has integrated the Artificial intelligence in their security system. One such example is in the New York there is a City’s Domain Awareness System (DAS), which was built in association with the Microsoft. In this system AI works as it monitors the thousands of CCTV cameras across the city and analyse the real time video feeds and identifies the illicit or suspicious behaviour and then they quickly informed to the security agencies. This system is effective and efficient as it allows the security agencies to respond to the threat in a proactive manner and they can be very much capable of then curb the threats before it escalate into the serious incident, that model of integrating modern technology with the traditional one, can be very much effective and we should adopt also and make and work towards modernising our security measures. Although, we should appreciate the Indian Railway board as they are going to integrate the artificial intelligence systems for the upcoming Kumbh mela to monitor the tracks and it also prevents any damage that may come by antisocial element. This will set an example that AI can be deployed and easily adopted within the established setup and it can also ensure the safety of the entire railway line. This means that by incorporating conventional security measures with artificial intelligence capabilities like what happened during this event, it guarantees that current investments are not thrown away but instead built upon thereby enabling better risk control through active monitoring where necessary.

Had such integrated systems been implemented at RG Kar Medical College, AI might have detected abnormal activities or unauthorized access in real time thus alerting security personnel before the tragic event occurred. The potential of security systems is shown by this successful combination of conventional surveillance and artificial intelligence to protect institutions most likely to be attacked such as hospitals. It also prevent future incidents from happening again.

Analysing the growing incidence of attacks on healthcare personnel along with the understanding that hospitals and medical colleges are weak points, it can be stated that traditional measures taken may not be enough. A camera alone cannot prevent a determined criminal from perpetrating the crime and security personnel cannot also monitor all areas at once, but these two tools can complement each other especially with AI support. AI has the capacity to monitor those areas that may not be easily noticed or are not easily accessible hence the promise of no part of a building is left unmonitored. And also it can be integrated with access control systems which directs only the authorised persons to some specific areas hence reducing cases of intruders who may bring such calamities. Thus, in this sense AI is all seeing protector that is never tired.

An important concern regarding integration of AI in safety is the invasion of privacy, while these systems gives more safety than before, they also bring concerns on excessive surveillance, to which reply at the moment is the Information Technology Act 2000, concerning electronic surveillance and data protection. Section 66E of IT Act deals specifically with privacy protection, making it illegal to capture or distribute pictures/videos without consent where a person expects privacy should prevalence place exist under broader legal provisions relating maintenance public order safety through use such this these there be done. Despite these provisions, there is a need for updating the legal framework so as to accommodate advancements brought about by AI driven security systems.

What happened at RG Kar Medical College must act as a wakeup call for all of us, because we have been negligent or those who risk their lives every day. Thus if at all we are going to avert such experience from happening again AI has to be an integral part of our security systems. The tools are there waiting to be used, let’s protect our institutions together with people who are associated with such institutions either to work or study.

This is not merely about technology, it is about being proactive, assuming responsibility and envisioning what may happen if things are not changed otherwise the tragedy at RG Kar will continue to haunt us in form of similar events that in one way or the other could have been prevented if the correct strategies and adequate equipment were employed. We cannot wait for anything more as this point means entry into the age where everything requires protection and thus is considered as dangerous unless proven otherwise.
There should be no waste of the sorrowing circumstance that follows the tragic event that happened in RG Kar Medical College. We have to make this a moment of change which will push us towards an era where technology is utilised for protection of lives, towards preventing such tragedy and ensuring that such things do not happen in places meant for healing and saving lives again. Well, we now have it in our capabilities to prevent another disaster, so please let’s do it now!

</excerpt>

The Central Bureau of Investigation (CBI) officially registered an FIR against Dr. Sandip Ghosh, the former principal of RG Kar Medical College and Hospital, following a directive from the Calcutta High Court. The investigation stems from allegations of corruption, and the CBI launched its probe after the High Court’s single bench ordered them to take up the case.

On Saturday morning, a Special Investigation Team (SIT) from the Calcutta High Court delivered crucial documents related to the case to the CBI office at Nizam Palace. Acting promptly, the CBI filed the FIR and submitted a copy to the Alipur Chief Judicial Magistrate (CJM) Court the same day. The investigation is now underway, with CBI officials confirming that further actions will depend on the evidence gathered.

In parallel, a team of experts from the Central Forensic Science Laboratory (CFSL) in Delhi arrived in Kolkata to conduct polygraph tests on Dr. Sandip Ghosh and others linked to the alleged rape and murder of a trainee doctor at RG Kar Medical College. The Calcutta High Court had granted the CBI permission to carry out these tests. The polygraph tests will involve Dr. Ghosh, Sanjay Roy, the main accused, four other doctors, and one volunteer.

The High Court has set a deadline of three weeks for the CBI to submit a progress report on the investigation, which is due on September 17. Meanwhile, the case has drawn significant attention and led to increased security measures. Earlier this week, the Supreme Court ordered that security at RG Kar Medical College be transferred to the Central Industrial Security Force (CISF) in response to the ongoing unrest in West Bengal. The CISF’s deployment aims to bolster security and help maintain public order amidst the heightened tensions in the state.

Protests have erupted across West Bengal following the alleged rape and murder of the trainee doctor, whose body was found in the seminar hall of RG Kar Medical College on August 9. Doctors from multiple institutions, including Ram Manohar Lohia Hospital, All India Institutes of Medical Sciences (AIIMS), and Indira Gandhi Hospital, participated in a strike to protest the incident.

However, the Supreme Court intervened, urging the medical community to return to work. Following the Court’s appeal, the Resident Doctors Association of Indira Gandhi Hospital officially called off its 11-day strike. On Thursday, other hospitals, including AIIMS and Ram Manohar Lohia, also ended their protests. The Supreme Court assured the doctors that it would prevail upon authorities to avoid taking adverse action against them once they resumed their duties.

As investigations continue, the case remains under intense scrutiny. The deployment of CISF personnel at RG Kar Medical College underscores the seriousness of the situation, and all eyes are now on the progress of the CBI’s investigation and the outcome of the polygraph tests. The court’s ongoing oversight ensures that the investigation remains on track, with the next update expected by September 17.

The Chief Justice had been incorrectly pronouncing “Kar” as “Kaar,” a mistake pointed out by Justice Hrishikesh Roy.

Correction Made During Hearing

While the Supreme Court was reviewing petitions related to the brutal rape and murder of a 31-year-old doctor at the Kolkata hospital, an advocate representing junior doctors highlighted the issue. The Chief Justice DY Chandrachud acknowledged the error, stating, “By the way, Justice Hrishikesh Roy pointed out to me that you kept on saying ‘Kaar,’ ‘Kaar,’ it’s ‘Kar.’ I apologise.”

Background Information On RG Kar Medical College

The RG Kar Medical College, established in 1886 as the Calcutta School of Medicine by Indian physician Radha Gobinda Kar, initially lacked an associated hospital or campus. The college moved to its own building in 1902, was renamed Belgachia Medical College in 1916, and then Carmichael Medical College in 1918, honoring Bengal’s Governor Thomas Gibson-Carmichael. Post-Independence, the college was renamed in honor of its founder. The West Bengal government later took over the management of the hospital.

Nationwide Protests and Supreme Court Action

The college has recently been in the spotlight following the discovery of a postgraduate trainee doctor’s body in a seminar hall on August 9, confirmed to have been sexually assaulted. The incident has ignited nationwide protests by doctors demanding safer working conditions, which have disrupted healthcare services across the country.

In response to the ongoing crisis, the Supreme Court has established a National Task Force to propose measures to enhance working conditions for healthcare professionals. During the hearing, an advocate revealed that doctors often endure shifts of up to 36 hours. Chief Justice Chandrachud empathized, sharing his personal experience: “Please assure the doctors that we know they are working for 36 hours. I have personally slept on the floor of a public hospital when one of my family members was unwell.”

Ongoing Developments

The Supreme Court’s intervention highlights the urgent need for reforms in the healthcare sector to ensure the safety and well-being of medical professionals and address the concerns raised by the recent tragic events.

</excerpt>

Facing massive protests over brutal rape and murder of a doctor at Kolkata’s RG Kar Medical College and Hospital, West Bengal Chief Minister Mamata Banerjee has written to Prime Minister Narendra Modi, seeking a tougher legislation against rape.
In her letter, which was shared by her chief adviser Alapan Bandyopadhyay, the Chief Minister said that it was “horrifying to see that almost 90 cases of rapes occurred daily throughout the country”.

“This shakes the confidence and conscience of the society and the nation. It is a bounden duty for all of us to put an end to it so that the women feel safe and secure,” she wrote according to her chief adviser Alapan Bandyopadhyay.

“Such serious and sensitive issues need to be addressed in a comprehensive manner through stringent Central legislation prescribing exemplary punishment against the persons involved in such dastardly crimes. Setting up of fast-track special courts for speedy trials in such cases should also be considered in the proposed legislation to ensure quick justice. Trial in such cases should preferably be completed within 15 days.”

Earlier today, Trinamool Congress MP and Mamata Banerjee’s nephew, Abhishek Banerjee said the country needs a strong law that mandates trials and convictions within 50 days, followed by the severest punishments.
In a tweet, he said that over the past 10 days, while the nation has been protesting against the RG Kar Medical College incident and demanding justice, 900 rapes had occurred across different parts of India.

“Sadly, a lasting solution still remains largely undiscussed. With 90 RAPES REPORTED DAILY, 4 EVERY HOUR AND 1 EVERY 15 MINUTES – the urgency for a decisive action is clear. We need strong laws that mandate TRIALS & CONVICTIONS WITHIN 50 days, followed by the severest punishments, not just empty promises. State Governments must act and urgently push the Union for a comprehensive anti-rape law that ensures swift and strict justice. Anything less is merely symbolic and tragically ineffective.”

This action follows the brutal incident that has sparked nationwide outrage and raised serious concerns about the safety of healthcare workers.

Earlier today, the Federation of All India Medical Associations (FAIMA) filed an urgent petition with the Supreme Court seeking intervention regarding the tragic rape and murder of a trainee doctor at RG Kar Medical College and Hospital in Kolkata. FAIMA expressed gratitude to the Chief Justice of India for considering the working conditions of resident doctors and for the assurance that the Supreme Court is addressing the issues of safety and security for medical professionals.

The FAIMA petition underscored the urgent need for improved security measures and better working conditions for doctors, especially women, who often face significant risks in their roles. The horrific incident has led to widespread protests from doctors and public outcry across the country.

In response, the Supreme Court on Tuesday established a 10-member National Task Force to address violence and ensure safer working environments for medical professionals. The task force, which includes Surgeon Vice Admiral Arti Sarin, will make recommendations aimed at preventing such tragedies in the future.

The victim, a trainee doctor, was found dead in the seminar hall of RG Kar Medical College and Hospital on August 9, 2024.

CJI Chandrachud Voices Concerns

During the hearing, Chief Justice of India (CJI) DY Chandrachud, leading a three-judge bench including Justices JB Pardiwala and Manoj Misra, raised serious questions about the actions of both the hospital administration and local police. “Why was the FIR registered three hours after the body was handed over for cremation?” the bench inquired, highlighting the significant delay that has come under scrutiny.

CJI Chandrachud also questioned the role of the hospital’s principal and the police, pointing out that a serious crime had occurred within the hospital premises. “What was the principal doing? FIR was not filed; the body was handed late to the parents. What is the police doing? A serious offence has taken place, the crime scene is in a hospital… What are they doing? Allowing vandals to enter the hospital?” he remarked, indicating dissatisfaction with how the situation was managed.

Principal’s Actions Under Investigation

The principal of RG Kar Medical College, Sandip Ghosh, who resigned just two days after the incident, has been under intense scrutiny by the Central Bureau of Investigation (CBI). Mr. Ghosh has been questioned for nearly 53 hours over the past four days regarding his actions following the doctor’s death. The Supreme Court noted that despite his resignation, Mr. Ghosh was reassigned as the principal of another medical college, a decision that has since been challenged.

Calcutta High Court Steps In

In response to the developments, the Calcutta High Court has ordered the West Bengal Health Department not to appoint Mr. Ghosh to any other medical college until further notice. This directive followed his brief appointment as the principal of Calcutta National Medical College and Hospital, which triggered protests from students and junior doctors, further complicating the situation.

Nationwide Protests and Calls for Justice

The incident has fueled nationwide protests, with citizens and organizations demanding swift justice and better safety measures for women, particularly those working and studying in medical colleges. The Supreme Court’s intervention has added significant pressure on the state government and law enforcement agencies to ensure a thorough and transparent investigation into the tragic event

</excerpt>

As the investigation and protests continue in the wake of the brutal rape and murder of a trainee doctor in Kolkata, Durga Devi, the mother-in-law of the accused Sanjay Roy, has suggested that more individuals might be involved in the crime. She expressed doubt that Roy could have acted alone in committing the heinous act.

Speaking to ANI on Monday, Durga Devi recounted the troubled relationship between her daughter and Sanjay Roy. She described the marriage as strained and revealed that Roy had physically abused her daughter, which led to a police complaint being filed.

“Our relationship with him was very tense,” Durga Devi stated. “Initially, everything was fine for about six months. But when she was three months pregnant, he caused her to have a miscarriage. He beat her, and we filed a police complaint. After that, my daughter’s health deteriorated, and I had to bear all her medical expenses.”

She further remarked, “Sanjay was not a good person. Whether he is hanged or whatever is done to him, I won’t comment on the crime itself. But I don’t believe he could have done it alone. He can’t do it alone.”

The rape and murder of the trainee doctor have triggered widespread outrage and protests across various cities, with demands for justice and strict punishment for those involved. The Supreme Court has taken suo motu cognizance of the case, and a bench led by Chief Justice DY Chandrachud is scheduled to hear it today.

The Central Bureau of Investigation (CBI), which is leading the probe, has been granted permission to conduct a polygraph test on the accused, according to CBI sources.

On August 18, the CBI team conducted an examination and 3D laser mapping in the emergency ward of RG Kar Medical College and Hospital, where the crime took place.

In a parallel investigation, the West Bengal government has formed a Special Investigation Team (SIT) to investigate allegations of financial irregularities at RG Kar Medical College and Hospital from January 2021 to the present. According to a notification from the Home and Hill Affairs Department, the SIT will have access to all relevant documents from government departments and private agencies to expedite the investigation. The team is expected to submit its initial report within a month.

The SIT will be led by IG Pranav Kumar, with assistance from Murshidabad Range DIG Waquar Reza, West Bengal CID DIG Soma Das Mitra, and Kolkata (Central) DC Indira Mukherjee.

The postgraduate trainee doctor was tragically found dead in the seminar hall of RG Kar Medical College and Hospital in Kolkata on August 9, sparking the ongoing investigation and public outcry.

In addition to their strike, the RDA will offer elective outpatient department (OPD) services outside Nirman Bhawan, which houses the Ministry of Health, starting from 11 a.m. on Monday. This initiative will see resident doctors providing services across 36 specialties, including medicine, surgery, obstetrics and gynecology, pediatrics, ophthalmology, and orthopedics.

Highlighting Safety Concerns for Healthcare Workers

The primary aim of this protest is to draw attention to the inadequate security for healthcare professionals nationwide. The RDA has urged the government to implement a central ordinance to ensure the safety and security of healthcare workers and institutions. They have requested authorities to facilitate the necessary arrangements for their OPD services outside Nirman Bhawan.

Indefinite Strike and Plea for Government Intervention

Since August 12, AIIMS Delhi resident doctors have been on an indefinite strike, halting all elective and non-essential services, including OPDs and ward activities. On Sunday, the RDA wrote to Prime Minister Narendra Modi, seeking his intervention to enact a central law through an ordinance aimed at protecting healthcare workers. Their letter emphasizes the sanctity of hospitals as spaces of healing and the urgent need for protective measures.

The police have arrested Sanjoy Roy, the main suspect, but investigations are ongoing to determine if others were involved. The horrific crime has ignited widespread outrage and has sparked protests within the medical community and beyond.

In a heartfelt letter released on Sunday, Dr. RV Asokan, President of the Indian Medical Association (IMA), expressed profound grief and outrage over the recent tragic death of a postgraduate trainee doctor at RG Kar Medical College and Hospital in Kolkata. The 32-year-old woman was allegedly raped and murdered while on duty last week, igniting widespread protests and calls for justice.

A Nation’s Grief

Dr. Asokan’s letter poignantly captures the collective mood of the nation. He writes, “We failed her in life but, we as a nation did not let her down in death. It is difficult to capture the mood of the nation. Anger, revulsion, frustration, helplessness.”

The letter describes the victim’s harsh reality: “She was on a 36-hour shift. Had dinner at 2 am before retiring to makeshift beds in the seminar room adjacent to the ward. Only daughter of lower-middle-class parents. The orphaned doctor’s nameplate at the entry remains a vestige of family pride. Simple archetypical Indian parents. Inconsolable. Lost the meaning and purpose of life. Innocent and naive with the trust like children. The streets were empty. Fear hung in the air. Few conscientious youth protested in a corner. Strange eerie silence.”

Ongoing Outrage and Protest

The death of the trainee doctor has sparked a massive outcry among medical professionals. Dr. Asokan assured that the IMA will persist in leading the nationwide protests. “She had lit a million candles. Thousands of war drums reverberated. Every Indian family lost their daughter. Mothers boiled. Fathers wept silently,” he stated.

Dr. Asokan praised the resilience of medical professionals who have led the charge in protests, stating, “First out were the residents. Next seven days they never slept. Used to 100-hour weeks. Their vigil and firepower the only hope of the nation. They chiseled the Resistance.”

Nationwide Actions

The Indian Medical Association, the country’s largest organization of doctors, has been at the forefront of the push for justice. On Saturday, the IMA organized a nationwide strike, halting all non-essential medical services for 24 hours. This action was part of a broader movement that saw thousands of women across the country participating in “Reclaim The Night” marches on Wednesday night, demanding justice for the victim.

The brutal murder and the subsequent protests highlight the urgent need for improved safety measures for healthcare professionals and justice for those affected by such heinous crimes.

</excerpt>

As protests intensify over the recent rape and murder of a female doctor in Kolkata, BJP leader Sajal Ghosh, a prominent figure in the Durga Puja celebrations, has called on all Puja committees across West Bengal to reject the state government’s Rs 85,000 honorarium. This move, he argues, would serve as a protest against the government’s “failure to ensure women’s safety.”

Ghosh, the chief organizer of the widely attended Santosh Mitra Square Puja in North Kolkata, has long been known for creating themed pandals that attract large crowds. Speaking to PTI, Ghosh expressed his deep dissatisfaction with the current administration. “Women are being violated, raped, and murdered in public spaces, workplaces, and even their homes under Mamata Banerjee’s regime. The government has failed to protect them. When public outrage grows, she blames everyone but herself,” Ghosh stated.

He specifically referenced the recent case where a young woman doctor was allegedly raped and murdered while on duty at her hospital, with only one arrest made so far. “In light of this tragic event, it would be paradoxical for Puja committees to accept the Rs 85,000 grant from a government that has shown such a lack of concern for women’s safety,” Ghosh added.

Despite the tragedy, Ghosh mentioned that his committee has not altered its original plans for the Puja celebrations, which include a dazzling display of lights and a spectacular sphere of illumination. He did, however, leave open the possibility of paying tribute to the victim, saying, “We are considering it, but nothing has been finalized yet. The Puja is a time when people want to escape from their sorrows and stress.”

Ghosh noted that his Puja committee has historically refused financial support from the state, except for the first year when the government offered Rs 10,000 to every community Durga Puja.

In response to Ghosh’s appeal, Debashis Kumar, the chief organizer of the popular Tridhara Sammilani Puja and a TMC MLA, challenged Ghosh to seek a vote among all Durga Puja committees regarding the acceptance of the honorarium. “If Ghosh is so certain about the committees’ opinions, he should initiate a vote. Otherwise, his statements are merely political posturing,” Kumar told PTI.

Kumar further criticized Ghosh for linking the tragic incident with Durga Puja celebrations, accusing him of “insulting the sentiments of thousands of Hindus and Puja organizers across the state.”

Partha Ghosh, president of the Shivmandir Puja Committee and a founding member of the Forum for Durgotsab, also weighed in on the controversy. He suggested that the decision to accept the state honorarium should be left to the discretion of each individual Puja committee.

</excerpt>

West Bengal Chief Minister Mamata Banerjee on Thursday accused “outsiders” and opposition parties of instigating the recent violence at RG Kar Hospital, claiming that members of the Left and BJP were responsible for the chaos. Banerjee asserted that these groups, whom she referred to as “Bam” (the Left) and “Ram” (the BJP), were attempting to disrupt peace in the state.

“Bam and Ram want to create unrest in Bengal, and they have come together to orchestrate this,” Mamata Banerjee said, suggesting that the violence was politically motivated.

Banerjee distanced the vandalism from the ongoing protests by doctors, who have been agitating following the rape and murder of a postgraduate trainee doctor. She emphasized that those responsible for the destruction were not linked to the student movement at RG Kar Medical College but were instead politically motivated outsiders.

“The individuals who vandalized RG Kar Hospital yesterday are not connected to the student movement of the college. They are outsiders. I have reviewed several videos, and in three of them, I can see individuals carrying national flags, who are affiliated with the BJP, and others holding red and white flags, associated with the DYFI,” Mamata Banerjee said, according to reports from ANI.

The incident in question occurred on Wednesday night when a mob stormed the RG Kar Hospital campus, causing significant damage to the protest site, vehicles, and other property. Doctors and nurses participating in the protest maintained that the vandals were not part of their movement.

Praising the police for their restraint during the incident, Banerjee recounted how officers, including a Deputy Commissioner and two Officer-in-Charges, were attacked. “The police were assaulted yesterday; among the injured were one Deputy Commissioner and two Officer-in-Charges who were present for security purposes. They went missing for an hour and were later found unconscious with severe head injuries. I instructed the police at 3 am to take them to Apollo Hospital. I commend them for their patience—they did not retaliate or harm anyone,” she said.

Mamata Banerjee also noted that the case has been transferred from the West Bengal police to the Central Bureau of Investigation (CBI), urging anyone with information to approach the CBI. “The case is no longer in our jurisdiction; it is now in the hands of the CBI. If you have any information, you should inform them,” she added.

The Chief Minister also emphasized the severity of the crime, stating that the only appropriate punishment for the doctor’s rape and murder would be the death penalty. “This is a heinous crime, and the only fitting punishment is that the accused should be hanged. Only then will a lesson be learned, but no innocent person should be punished,” she concluded.

The doctor was reportedly raped, tortured, and murdered inside a seminar hall at the state-run hospital. She had entered the hall to rest during her night shift.

The parents and relatives of a 31-year-old trainee doctor, who was tragically raped and murdered at Kolkata’s RG Kar Medical College and Hospital, have recounted their devastating experience following the news of her death on August 9.

In an interview with India Today’s Lallantop, the father of the victim revealed his suspicions arose immediately when he started receiving calls from the hospital. He recalled, “I knew something had happened to my daughter,” after being informed by hospital staff that “your daughter has died by suicide. Come immediately.” The semi-naked body of the doctor was discovered in a seminar hall at the state-run RG Kar Hospital that Friday morning.

Initially, the Kolkata Police suspected suicide but later revised their statement as further investigation revealed the true nature of the crime.

Three-Hour Wait and Disturbing Discoveries

Upon hearing the tragic news, the victim’s parents, a nearby relative, and an acquaintance rushed to the hospital, only to be kept waiting for three hours. A relative described the distressing scene, saying, “I heard her (the mother) cry aloud. When I arrived, she hugged me and cried that everything is over. She recounted receiving a call from the hospital stating her daughter had died by suicide.”

Despite their pleas, the family was not permitted to see the body immediately. The relative added, “When we were finally allowed to enter the seminar hall, we were told we could only take a picture. The father showed me the photo, and it was horrifying—her legs were spread apart at a 90-degree angle, indicating severe physical trauma.”

Autopsy Reveals Brutal Details

The post-mortem report, a chilling document spanning four pages, revealed severe injuries consistent with “perverted sexuality” and “genital torture.” It noted that the doctor’s thyroid cartilage had been broken from strangling, and there were multiple injuries to her belly, lips, fingers, and left leg. The report also detailed that her spectacles were shattered, with glass shards penetrating her eyes.

“The report indicated bleeding from both her eyes and mouth, as well as injuries to her private parts and other areas,” the relative explained. The time of death was estimated between 3 am and 5 am on Friday. The doctor had been on night duty on August 8 and, after completing her rounds, had rested in the seminar hall around 2 am.

Calls for Justice

In response to the horrific details, BJP spokesperson Shehzad Poonawalla and Shiv Sena (UBT) MP Priyanka Chaturvedi have called for justice. Poonawalla shared the family’s ordeal on X, emphasizing, “The chilling details of brutality… Never forget. Never forgive.” Chaturvedi echoed these sentiments, urging that the accused be punished severely and that the cover-up of the crime as a suicide be addressed.

Both Left-wing groups and the Bharatiya Janata Party (BJP) have accused hospital authorities of attempting to tamper with evidence related to the incident.

The Democratic Youth Federation of India (DYFI) and the Students’ Federation of India (SFI), both affiliated with the CPI(M), have raised concerns over renovation work that began near the seminar room where the doctor’s body was found. Protestors gathered at the hospital’s Emergency building gate, alleging that the authorities were destroying evidence to shield the perpetrators.

While West Bengal is seething with anger, given Mamata Banerjee’s apathy and Kolkata Police’s botched cover-up attempt, RG Kar Medical College authorities break down room walls, inside the Chest Medicine Dept, where the on-duty junior doctor was subjected to brutal rape and… pic.twitter.com/j2mJyziwNt

Dr. Subarna Goswami, associated with the Left-affiliated Joint Forum of Doctors, claimed that the postmortem report indicated the victim might have been sexually assaulted by multiple individuals. “It is evident that this was not the act of a single person… she was gang-raped,” Goswami told The Indian Express, referring to observations made while with the victim’s family.

The Kolkata Police have arrested a civic volunteer, Sanjoy Roy, in connection with the case, and the Central Bureau of Investigation (CBI) has now taken over the investigation. BJP IT cell head Amit Malviya accused West Bengal Chief Minister Mamata Banerjee and the Kolkata Police of attempting to cover up the crime. He alleged that the renovation work, which involved demolishing walls and a women’s toilet in the Chest Medicine Department, was a deliberate attempt to erase crucial circumstantial evidence.

The Indian Express reported that the demolition was planned to create a rest area for students, as per their demand, and was not intended to obstruct the investigation.

DYFI state secretary Minakshi Mukherjee, who led the protests at RG Kar Medical College, accused the ruling Trinamool Congress (TMC) government of trying to protect those responsible for the crime. Suvendu Adhikari, BJP MLA and Leader of Opposition in the Assembly, called for the resignation of Mamata Banerjee, demanding that the CBI take immediate action due to alleged tampering with evidence.

The Calcutta High Court has ordered a CBI probe into the case and directed the Kolkata Police to transfer all relevant documents. A specialized CBI team, including medical and forensic experts from Delhi, has arrived in Kolkata to commence the investigation.

In solidarity with the victim, doctors and medical students organized protests, including a nationwide shutdown of outpatient services led by the Federation of All India Medical Associations (FAIMA).
