Calcutta HC asks CBI

<excerpt>The High Court, which has also asked the agency if there was a conspiracy behind the crime, also ordered CBI to produce the case diary related to its investigation on the next date of hearing on March 28.
</excerpt>

The Calcutta High Court asked the Central Bureau of Investigation (CBI) on Monday to clearly spell out whether the 31-year-old trainee doctor killed at Kolkata’s RG Kar Medical College and Hospital on August 9 last year was raped by a single person or gang-raped.

The Court was hearing a plea filed by the parents of the deceased doctor, seeking a fresh investigation into the incident. The parents sought a probe into the larger conspiracy around the rape of the victim and subsequent cover-up by the college authorities.

The High Court, which has also asked the agency if there was a conspiracy behind the crime, also ordered CBI to produce the case diary related to its investigation on the next date of hearing on March 28.

Justice Ghosh asked CBI if it ever found reasons to believe that the crime was committed by more than one person and not just just Sanjoy Roy, a former Kolkata police civic volunteer who was convicted for her rape and murder in January and handed down a life term by the Sealdah trial court.

Justice Ghosh also directed the CBI to explain the suspected conspiracy to cover up the crime.

“You must tell me if at any time you took into consideration an investigation under section 70 of BNS (gang rape)? The accused was convicted. What was the nature of your charge? Was it a sole accused or a gang rape? You must make it clear,” justice Ghosh told deputy solicitor general Rajdeep Majumder who appeared for CBI.

The High Court had taken the case from the Kolkata Police which had arrested Sanjoy Roy, and handed it over to the CBI on August 13, days after protests across the country

On September 14, CBI arrested Sandip Ghosh, the then principal of the medical college and Abhijit Mondal, the then officer-in-charge of Tala police station on charges of tampering with the evidence.

But the CBI did not file a charge sheet against them in connection with the doctor’s murder. A charge sheet was, however, filed against Ghosh in November last year accusing him of corruption at the hospital.

Justice Ghosh said: “If you ever believed more than one person was involved, who were the people in your mind? You must tell the court. Was it gang rape or destruction of evidence where multiple people were involved?”

Lawyer Sudipta Moitra, who represented the petitioners, told the court that there is no evidence that the CBI formed a special investigation team (SIT) for the case.

Lawyer and Trinamool Congress MP Kalyan Banerjee, who appeared for the State Government, told the court that the Government did not have any objection to further investigation but asked if there was any legal provision for it since the Sealdah court proceedings ended with Roy’s conviction after a 57-day in-camera trial.

The victim’s parents told reporters that the CBI did not make any attempts to expose the conspiracy behind the crime.

“My daughter was constantly protesting against corruption at the hospital. She used to say many patients died because of spurious medicines. The conspirators wanted to silence her. We told this to the CBI officials several times but they did not pay heed,” the victim’s mother said outside the High Court.

While the hearing was on, a few hundred doctors and nurses marched to the CBI office at the Salt Lake CGO Complex alleging that the agency did not carry out a thorough investigation.

The victim’s parents recently met the CBI director in Delhi and sought a fresh investigation and also moved the Supreme Court which directed the High Court to hear the petition.

In January this year, the trial court convicted and sentenced the prime accused, Sanjay Roy on charges of rape and murder after an in-camera trial that lasted 57 days.

Roy, a civic volunteer with the city police, was arrested by the Kolkata Police on August 10, 2024 a day after the incident. He was sentenced to life imprisonment.

In February this year, the High Court dismissed the appeal filed by the State government seeking the death penalty for Roy. A bench of Justices Debangsu Basak and Md Shabbar Rashid refused to grant permission to the State to file such an appeal since it was the CBI which had probed the matter and conducted the prosecution.

It thus allowed the CBI to file an appeal for the same punishment.

West Bengal Chief Minister Mamata Banerjee announced the removal of Kolkata Police Commissioner Vineet Goyal and the transfer of several top officials in the police and state health departments. This decision followed demands from junior doctors protesting the rape and murder of a trainee doctor at RG Kar Medical College and Hospital on August 9.

Mamata Banerjee agreed to most of the five-point demands from the junior doctors, including the dismissal of the Director of Medical Education (DME), Director of Health Services (DHS), and the Deputy Commissioner (North Division), who allegedly tried to bribe the victim’s parents.

“We will announce the name of the new police commissioner after 4 pm on Tuesday, following the scheduled Supreme Court hearing on the RG Kar hospital case,” Banerjee stated at midnight after a meeting with the protesting doctors at her Kalighat residence, just hours before the Supreme Court hearing.

Who is Vineet Goyal?

Vineet Kumar Goyal, a 1994-batch IPS officer, took over as the Kolkata Police Commissioner in December 2021, succeeding Soumen Mitra. An alumnus of IIT Kharagpur and IIT Kanpur, Goyal has held multiple roles in the Kolkata Police, including Deputy Commissioner for the Eastern Suburban Division, Special Branch, and Headquarters. He also served as Joint Commissioner for the Special Task Force and Traffic, and Additional Commissioner of Police.

Goyal has been awarded the police medal for gallantry twice, along with the police medal for meritorious service and the Chief Minister’s medal for outstanding service.

Allegations Against Vineet Goyal

Protests following the alleged rape and murder at RG Kar Medical College intensified demands for Vineet Goyal’s removal. Both doctors and opposition parties claimed that Goyal, like West Bengal’s Director General of Police, Rajeev Kumar, had strong ties to Mamata Banerjee.

Criticism against Goyal surged after the mishandling of the August 14 vandalism during a protest march at RG Kar hospital. Junior doctors accused him of procedural failures, which led to growing protests and political backlash.

In a recent administrative meeting, Mamata Banerjee revealed that Goyal had offered to resign, but she refused his request. Public dissatisfaction with his leadership grew following his handling of the hospital incident, particularly after August 14.

Goyal, visibly frustrated, commented on August 15 that rumors and malicious media and social media campaigns had damaged public trust in the police. His statement followed police clashes with protesters at RG Kar Medical College. Despite the unrest, Goyal maintained that the police had acted appropriately in managing the rape and murder case, which has sparked widespread protests demanding justice.

In an unexpected move aimed at resolving the ongoing conflict with protesting doctors, West Bengal Chief Minister Mamata Banerjee visited the protest site on Saturday and addressed the medical professionals staging a sit-in.

Doctors’ Protest Over Rape-Murder Case

The doctors’ protest began after a trainee doctor was raped and murdered at RG Kar Medical College and Hospital in Kolkata last month. Since then, they have been holding a sit-in outside Swasthya Bhavan, the headquarters of the West Bengal health department. Although there were previous efforts for discussions between the state government and the protestors, these talks stalled over the demand for live streaming of the discussions.

Mamata’s Address to the Doctors

On Monday, Banerjee arrived at the protest site and, amid slogan-shouting, calmly requested the doctors to listen. Speaking in Bengali, she said, “Please listen to me for five minutes and then shout slogans, it is your democratic right to do so. I have been waiting for a long time. Against the advice of my security officers, I have come here to salute your protests.”

Expressing empathy for the doctors, she added, “I have also been part of student movements, I know my post is not a big deal, your voice is. It was raining all night and you suffered. I couldn’t sleep either because I was feeling bad.”

CM’s Call for Dialogue and Justice

Acknowledging that the protests had been ongoing for over a month, Banerjee urged the doctors to return to work, assuring them that their demands would be taken seriously. She promised to study their grievances and consult with key government officials, including the chief secretary and police chief.

“I want justice for Tilottama (the victim’s pseudonym),” she said, calling on the Central Bureau of Investigation (CBI) to expedite its probe into the case. “If you trust me, come and talk to me, I will look into your demands.”

Appeal to Return to Work

Banerjee emphasized the urgency of returning to work, pointing out that many patients had suffered due to the ongoing strike. She promised the formation of hospital committees composed of senior and junior doctors to ensure accountability.

“Everyone found guilty will be punished. Please talk amongst yourselves and return to work. I will not take any action,” she reassured the doctors, contrasting her approach with harsher actions taken in other states like Uttar Pradesh.

“I have come to make a request as your ‘didi’ (big sister), not as a chief minister. I support your protest. I had also gone on a hunger strike for 26 days, but no one from the then government came to speak to me,” she added, recalling her past activism.

Protesters Demand Transparency

Despite welcoming Banerjee’s visit, some protesting doctors reiterated their demand for a transparent dialogue, specifically a live telecast of any meetings with the government. “We welcome Mamata Banerjee’s visit. We are ready to hold talks with her. Media is present here. Let there be a transparent meeting with her over our five demands,” one protestor said after the CM’s address.

The protest continues, with doctors awaiting further government action on their demands for justice and reforms in the medical sector.

</excerpt>

In a heartbreaking case that has shocked Kolkata, junior doctors from the city’s RG Kar Medical College and Hospital have appealed for justice after the brutal rape and murder of a fellow doctor. The West Bengal Junior Doctors Front has penned a four-page letter addressed to President Droupadi Murmu, asking for her immediate intervention. The letter has also been sent to Prime Minister Narendra Modi, Vice President Jagdeep Dhankhar, and Union Health Minister JP Nadda.

Doctors Demand Justice Amid Growing Fears for Safety
The doctors’ letter expresses their fear and uncertainty following the horrific crime, urging authorities to take action so that healthcare professionals in West Bengal can perform their duties without fear.

“We humbly place these issues before your esteemed excellency, as the head of state, to ensure that our colleague, the victim of this despicable crime, receives justice,” the letter read. The protesting doctors stressed that without intervention, they are struggling to work in an atmosphere of fear, distrust, and hopelessness.

Healthcare Services in West Bengal Disrupted by Protests
Junior doctors have been protesting outside Swasthya Bhawan in the Salt Lake area of Kolkata, despite heavy rains, to demand action. Many doctors have refrained from working within the hospital premises, choosing alternative means to fulfill their healthcare duties to citizens.

The protests come after the horrific August 9 incident, when a second-year postgraduate medical student was found raped and murdered in the seminar hall of RG Kar Medical College. The crime has not only shaken the medical community but has also prompted widespread concern over the safety of healthcare workers in the state.

West Bengal CM Mamata Banerjee Appeals to Doctors
The protests continued even after West Bengal Chief Minister Mamata Banerjee urged doctors to return to work. In a passionate statement, Banerjee offered to resign from her position, stating, “I am not concerned about the post; I want justice for the victim and care for ordinary people.”

Healthcare Workers Face Mounting Challenges
The junior doctors’ letter to President Murmu underlines the growing distress among medical professionals in West Bengal, emphasizing the need for immediate government action to ensure their safety. They believe that intervention from the highest offices of the country is crucial to restoring confidence within the healthcare community.

The mother of the young doctor who was tragically raped and murdered in Kolkata has accused West Bengal Chief Minister Mamata Banerjee of lying. Banerjee had claimed that the victim’s parents were “never offered money” as compensation. The grieving mother questioned the chief minister’s integrity, saying, “Why would I lie in my daughter’s name?”

“The chief minister is lying. My daughter won’t return. Would I lie in her name? She (the CM) told us that we would receive money and suggested we do something in her memory. I told her that I would collect the money only after justice is served for my daughter,” the mother told ANI.

Victim’s Family Denies CM’s Statement

The victim’s cousin also strongly contradicted Mamata Banerjee’s claim, saying with “full responsibility” that the Trinamool Congress leader herself had made the offer of financial compensation to the family.

Reaction to Banerjee’s Durga Puja Appeal

As Durga Puja approaches, Banerjee urged the public to return to the festive spirit, a plea that the victim’s mother found deeply insensitive.

“Durga Puja was celebrated in my house too; my daughter used to organize everything. But now, it will never be celebrated again in my home. The light in my home is gone. How can I ask people to return to the festival?” she asked. She further challenged Banerjee’s stance by questioning, “If such a tragedy happened in her family, would she say the same thing?”

The Fight for Justice Continues

Despite the pain and grief, the mother is determined to continue her fight for justice. She vowed that the movement for her daughter’s justice would persist “until justice is served.”

The Incident

The incident in question occurred on August 9 when the second-year postgraduate medical student was allegedly raped and murdered at RG Kar Medical College and Hospital in Kolkata.
A West Bengal doctors’ forum has written to Lok Sabha member Abhishek Banerjee, nephew of the state’s chief minister Mamata Banerjee, demanding an unconditional public apology for his statement regarding a patient’s death at Kolkata’s RG Kar Medical College and Hospital. Banerjee had claimed that a man died after not receiving timely treatment at the hospital.

The doctors at RG Kar have been protesting since the tragic rape and murder of a trainee medic at the hospital on August 9.

In their letter to Banerjee, the Joint Platform of Doctors, West Bengal, expressed deep concern over his comments, describing them as “untrue” and “malicious.” The forum clarified that the patient, a road accident victim with polytrauma, had been referred to RG Kar from Srirampur and was promptly admitted on September 6 at 9:10 am. Medical staff attended to him continuously until his unfortunate death at 12:30 pm, as documented in the death certificate.

The forum stated that Banerjee’s claim that the patient “bled for three hours without receiving care” was baseless and discredited the efforts of the doctors who tried to save the man’s life. They urged Banerjee to correct his “dangerous” remarks, warning that such statements could have negative repercussions for the already strained medical community in the aftermath of the August 9 incident.

</excerpt>

23 Deaths Reported Due to Ongoing Doctors’ Strike

On Monday, senior advocate Kapil Sibal reported to the Supreme Court that the ongoing doctors’ strike in Kolkata, which followed the rape and murder of a trainee doctor at RG Kar Hospital in August, has resulted in the deaths of 23 individuals. Sibal, who represents West Bengal, noted that the state government has submitted a status report on the investigation into the tragic incident.

Supreme Court Reviews Investigation Status

While the state government has provided the report, the solicitor general stated he had not yet received it. The Supreme Court bench, led by Chief Justice DY Chandrachud and including Justices JB Pardiwala and Manoj Misra, examined the report, which was submitted under seal.

Centre Seeks Action Over Security Issues

The Centre has urged the Supreme Court to address the West Bengal government’s alleged failure to support the Central Industrial Security Force (CISF), responsible for security at RG Kar Medical College and Hospital. The Union home ministry’s application highlighted the Trinamool Congress (TMC) government’s perceived lack of cooperation and requested that state authorities be directed to fully support the CISF.

Junior Doctors’ Strike and Investigation Progress

Junior doctors have been on strike since August 9, demanding justice for the trainee doctor who was allegedly raped and murdered. The Calcutta High Court transferred the case to the Central Bureau of Investigation (CBI). Nearly a month into the CBI’s investigation, only one arrest has been made—Sanjay Roy.

Challenges in the CBI Investigation

A CBI official revealed that the probe has faced difficulties due to missing evidence from the crime scene, complicating efforts to connect critical elements of the case and slowing progress. Additionally, it was disclosed that Dr. Sandip Ghosh, the former principal of RG Kar Medical College and Hospital, ordered the demolition of a restroom and toilet near the seminar room on August 10, the day after the body was discovered.

A Sealdah court expressed its frustration on Friday after both the Central Bureau of Investigation’s (CBI) investigating officer and lawyer failed to appear promptly at a bail hearing for Sanjay Roy, the prime suspect in the rape and murder of a 31-year-old trainee doctor from RG Kar Medical College and Hospital in Kolkata.

The court proceedings saw a significant delay when a CBI lawyer arrived 50 minutes late. The lawyer opposed Roy’s bail plea, arguing that granting bail could hinder the ongoing investigation, according to The Times of India.

Court Highlights Urgency

According to The Indian Express, the court emphasized the seriousness of the case, urging the CBI to act with greater urgency. Additional Chief Judicial Magistrate Pamela Gupta expressed her dissatisfaction with the lack of prompt action, remarking, “Should I grant bail to Sanjay Roy?”

Gupta criticized the CBI for its “very lethargic approach” and called the situation “highly unfortunate.”

Details of the Hearing

The Times of India reported that the hearing regarding Sanjay Roy’s bail application was delayed by 50 minutes due to the late arrival of the CBI lawyer. When informed of the delay, Magistrate Gupta initially stated that if the lawyer did not appear, bail should be granted.

At 4:20 pm, as the delay stretched on, the magistrate instructed a CBI officer to contact the lawyer. The officer left the courtroom to make the call and returned 15 minutes later, informing the court that the lawyer was on his way. The lawyer, Dipak Poria, finally arrived at 5:00 pm and opposed the bail without providing specific reasons.

Ultimately, the court rejected Roy’s bail plea and ordered him to remain in judicial custody until September 20 under the supervision of the CBI. Sanjay Roy, a civic volunteer with Kolkata Police, was arrested on August 10.

TMC Criticizes CBI’s Handling

Trinamool Congress (TMC) MP Saket Gokhale slammed the CBI’s handling of the case, accusing the agency of attempting to secure bail for the accused. Gokhale alleged that the CBI, BJP, and the Modi government were working together to bury the case for political reasons. He expressed disbelief at the agency’s absence in court, questioning the motives behind their actions.

The Supreme Court is set to resume its hearing on the case on September 9. A bench led by Chief Justice DY Chandrachud will examine the rape and murder case, which has drawn significant public attention. The trainee doctor’s body, which bore severe injury marks, was discovered on August 9 in the hospital’s seminar hall. The case was initially handled by Kolkata Police before being transferred to the CBI by the Calcutta High Court on August 13.

The upcoming Supreme Court hearing follows allegations from the Centre regarding a lack of cooperation from the West Bengal government in providing logistical support for the CISF, which is responsible for hospital security.

Earlier, on August 23, the Calcutta High Court had ordered the transfer of the investigation into these alleged financial irregularities from a state-formed Special Investigation Team (SIT) to the Central Bureau of Investigation (CBI).

A Supreme Court bench comprising Chief Justice D.Y. Chandrachud, Justice J.B. Pardiwala, and Justice Manoj Misra stated that Ghosh, as an accused, does not have the standing to be added to the petition. The bench remarked, “As an accused you have no locus to intervene in the PIL, where the Calcutta high court is monitoring the investigation.”

The case has gained significant attention due to the murder and alleged rape of a junior doctor at the state-run hospital, which has led to nationwide protests. The victim’s body, bearing severe injuries, was discovered in the seminar hall of the hospital’s chest department on August 9. Following this, a civic volunteer was arrested by the Kolkata Police in connection with the incident.

The August 23 order by the high court was in response to a petition filed by Akhtar Ali, the former deputy superintendent of the hospital, who sought a probe by the Enforcement Directorate into the financial misconduct allegedly involving Ghosh. The high court also ruled against Ghosh’s plea to be added as a party to the petition, stating that he was not a “necessary party” in the case.

Roy, who was arrested on August 10 following the brutal murder, claims he is being falsely accused.

According to his lawyer, Roy has consistently maintained his innocence, even during a polygraph test. Roy was reportedly questioned about his actions after the alleged murder, to which he responded that the question was irrelevant because he did not commit the crime. He told investigators that the woman was already unconscious when he entered the seminar hall, and he only saw her covered in blood. In a state of panic, he fled the scene, he claimed.

Roy also contends that he did not know the victim and believes he is being framed. When asked why he did not report the incident to the police if he was innocent, he explained that he feared no one would believe him.

Kavita Sarkar suggested that the real perpetrator might be someone else, highlighting a potential security lapse since Roy had easy access to the seminar hall. She argued that this breach could have allowed another individual to commit the crime.

The victim, a trainee doctor, was found raped and murdered in the seminar hall where she had been resting during her 36-hour shift. The autopsy revealed multiple injuries and evidence of sexual assault.

</excerpt>

Debashish Chakraborty of Kolkata Police may face permanent loss of vision in his left eye due to a brick attack during the ‘Nabanna Abhijaan’ on Tuesday, according to official sources. Sergeant Debashish Chakraborty, a 2015 batch officer, was among the police officials deployed during the Nabanna Abhijan march to the state secretariat, organised by the Paschim Banga Chhatra Samaj student group on August 27. Kolkata police sources report that Chakraborty is at risk of losing sight in his left eye after being struck by stones thrown by protesters and is receiving treatment at Shankar Nethralaya.

“During Nabanno Abhijaan, he along with others was deployed for duty at 11 Furlong gate. They were redeployed to Strand Road and while the team was moving towards Strand Road via Kingsway (Eden Garden) a number of protesters including both female and male student protesters had thrown brickbats on police vehicles. In which of the vehicles he was sitting where a brick hit his left eye directly. His left eye has been severely traumatised,” police sources told ANI.

Three other police personnel traveling with him during the attack were also injured and are receiving treatment. SGT Atanu Roy Chowdhary, SGT David Topno, and Home Guard Debasis Kundu also got hurt during the protests. Debasish Kundu is also hospitalised at Fortis Hospital with injuries to his eye and nose.

“Tragic consequences emerged during Nabanno Abhiyaan called by students on Tuesday. He has suffered a devastating injury, losing permanent eyesight in his left eye. After surgery, doctors indicate that his vision cannot be restored,” they added.

On Tuesday, the ‘Paschim Banga Chatra Samaj’ and other organisations carried out a protest march to the West Bengal Secretariat, known as ‘Nabanna,’ to condemn the recent rape and murder of a female trainee doctor in Kolkata. The rally, called “Nabanna Abhijan,” began at College Square in the West Bengal capital, with increased security around the state secretariat and protesters assembling in the Santragachi area of Howrah.

During the protest march, police used water cannons on demonstrators who climbed over barricades, clashed with officers, and broke the barriers at Santragachi in Howrah. Protesters also dragged away police barricades, prompting police to use lathi-charges and fire tear gas shells to disperse the crowd. This unrest followed the rape and murder of a postgraduate trainee doctor at RG Kar Medical College and Hospital in Kolkata on August 9, which triggered nationwide outrage and several subsequent protests demanding justice for the victim.

</excerpt>

Regarding the bike used by Sanjoy Roy, the main accused in the rape and murder case at Kolkata’s RG Kar Medical College and Hospital, it was registered under the name of the Kolkata Commissioner of Police. On Tuesday, the Kolkata Police issued a clarification, explaining that “all government vehicles belonging to Kolkata Police are officially registered under the Commissioner of Police.”

Taking to social media platform X, the Kolkata Police said, “The bike used by Sanjoy Roy–principal accused in the RG Kar Hospital alleged sexual assault and murder case, which was seized by Kolkata Police before being handed over to the CBI–was registered in the name of the Commissioner of Police, Kolkata. Some individuals on social media are attempting to create confusion around this. To clarify, all government vehicles belonging to Kolkata Police are officially registered under the Commissioner of Police before being assigned to various units.”

Sanjay Roy, the principal accused in the case, was a civic volunteer at the medical college and hospital, which is why he was assigned the vehicle. Earlier, a team of experts from the Central Forensic Science Laboratory (CFSL) in Delhi arrived in Kolkata on August 24 to conduct a polygraph test on Sanjay Roy, former principal of RG Kar Medical College, Sandip Ghosh, and others connected to the case, according to ANI sources. The test on the main accused was conducted in jail, while others were summoned to the CBI office in Kolkata, sources reported.

Earlier that day, Kolkata police stated that, following a court order, all documents concerning the alleged financial irregularities at RG Kar were handed over to the CBI by the SIT. Meanwhile, chaos erupted in the streets of Kolkata during the Nabanna Abhijan Rally, which was held to protest the RG Kar Medical College and Hospital rape-murder case. Security personnel responded by firing tear gas shells, using water cannons, and resorting to lathi charges to disperse protesters on Howrah Bridge as they marched towards the West Bengal State Secretariat, Nabanna. Protesters were seen breaking and dragging away barricades that had been set up in the Santragachi area, en route to the Secretariat.

Criticising the Nabanna Abhijan protest march, Trinamool Congress (TMC) MP Mahua Moitra labeled the protestors as goons who compelled the police to respond. On Monday, Additional Commissioner of Police Kolkata, Supratim Sarkar, stated that they had denied an application by ‘Paschimbanga Chhatro Samaj’ to organise the ‘Nabanna Abhijan’ rally on August 27. He explained that the police rejected the application because the group failed to seek formal permission and did not provide enough details.

All of this followed the rape and murder of a postgraduate trainee doctor on the premises of Kolkata’s R G Kar Medical College and Hospital, an incident that triggered nationwide outrage. Since then, numerous protests have been held demanding justice for the victim, who was found dead in the seminar hall on August 9.

“I came here straight from Delhi to meet the parents (of the deceased) and to understand their sentiments. They told me certain things. I would keep them confidential now. I will discuss the rest of the things with you later,” Bose said.

Earlier, Bose launched a mobile control room amid the ongoing unrest. The rape and murder of the trainee doctor have triggered nationwide protests.
In an interview with ANI on Monday, Durga Devi recounted her daughter’s troubled interactions with Roy, noting that Roy had physically assaulted her daughter, leading to a police complaint.

“My relations with him were very tense,” Durga Devi said, adding, “Initially, everything was good for 6 months. When she was 3 months pregnant, he caused a miscarriage. He thrashed her, and a police complaint was registered for the same. Following this, my daughter continued being ill, I bore all her expenses for medicines.”

“Sanjoy was not good. Hang him or do whatever you want with him. I won’t speak about the crime. He could not have done it alone. He can’t do it alone,” she said.

The rape and murder of a trainee doctor has ignited widespread outrage and protests in several cities, with demands for justice and punishment for the accused. The Supreme Court has taken suo motu notice of the case, with Chief Justice D.Y. Chandrachud scheduled to hear it on August 20.

The Central Bureau of Investigation (CBI) has been authorised to administer a polygraph test on the arrested suspect, according to earlier reports. On August 18, the CBI team conducted a 3D laser mapping of the emergency ward at RG Kar Medical College and Hospital in Kolkata.

In response, the West Bengal government has formed a Special Investigation Team (SIT) to investigate allegations of financial irregularities at RG Kar Hospital from January 2021 to the present. The SIT will have access to relevant documents from government departments and private agencies as needed for a swift investigation. The team is tasked with submitting its initial report within a month of its formation.

The SIT will be led by IG Pranav Kumar, with assistance from Murshidabad Range DIG Waquar Reza, West Bengal CID DIG Soma Das Mitra, and Kolkata (Central) DC Indira Mukherjee. </excerpt>

On Raksha Bandhan, Union Minister Chirag Paswan called on the youth to commit to ensuring the safety of women across India. Paswan emphasized the need for a cultural shift to prevent heinous crimes, drawing parallels to the 2012 Delhi gangrape and a recent incident in West Bengal where a postgraduate trainee doctor was allegedly raped and murdered at R G Kar Medical College and Hospital in Kolkata.

Celebrating Raksha Bandhan with his sisters in Bihar, Paswan urged young people to resolve to protect women and work towards eradicating the regressive mindset that leads to such violent crimes. “On Raksha Bandhan, every youth should pledge to ensure the safety of every woman in the country. We need to change the mentality that allows incidents like the Nirbhaya case to occur,” Paswan said.

Regarding West Bengal Governor CV Ananda Bose’s remarks about the state’s declining democracy, Paswan expressed concern. He highlighted the need for decisive action and strict punishment for those responsible for such crimes, regardless of political leadership. “It is troubling if the Governor makes such statements about a state led by a woman Chief Minister. We must ensure proper action and punishment to prevent such incidents in the future,” he said.

Paswan also referenced Prime Minister Narendra Modi’s recent statement at the Red Fort, stressing the collective responsibility required from lawmakers, law enforcement, and citizens to uphold safety and justice.

Additionally, Paswan criticized West Bengal Chief Minister Mamata Banerjee for her protest against the TMC government, viewing it as indicative of the ruling party’s weakness in the state.

</excerpt>

On Sunday, 71 Padma awardee doctors wrote to Prime Minister Narendra Modi, expressing deep concern over the recent rape and murder of a trainee doctor at RG Kar Medical College in Kolkata. They have requested his immediate intervention to address the issue and combat violence against healthcare professionals.
In their letter, the doctors highlighted the gravity of the situation, stating, “We, the undersigned Padma Awardee doctors, write to you with deep concern regarding the horrific events at RG Kar Medical College. As the head of our nation, we implore your immediate intervention to address this alarming situation. Such brutality undermines the very essence of medical service and emphasizes the urgent need to combat violence, particularly against women, girls, and healthcare professionals.”
The doctors urged both central and state governments to quickly enact a specific law to protect healthcare workers, pointing out that a bill proposed in 2019, “The Prevention of Violence Against Doctors, Medical Professionals and Medical Institutions Bill,” has yet to be passed. They called for the introduction of an ordinance and swift passage of the bill to ensure the safety of those working in healthcare.
Dr. AK Bhalla, Secretary of the Board of Management at Sir Gangaram Hospital, and a Padma Awardee, emphasized the need for time-bound punishment for offenders and enhanced safety measures in medical institutions. Dr. Anil Kohli, Padma Bhushan and Padma Shri awardee and President of the Dental Council of India, condemned the violence, stating it is an attack on the care that binds society. Dr. Harsh Mahajan, Padma Shri and Founder of Mahajan Imaging Centre, called for immediate legislative action to protect healthcare workers from abuse.
The case has sparked widespread outrage, with the Supreme Court scheduling a hearing for August 20. Protests by junior doctors, students, and football fans have led to the cancellation of a Durand Cup match. On August 9, the rape and murder of the postgraduate trainee doctor led to massive protests, and on August 14, the RG Kar Medical College campus was vandalized, prompting police intervention. To maintain order, Kolkata police have imposed Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, around the hospital from August 18 to 24.

Trouble is mounting for Dr. Sandip Ghosh, the former Principal of RG Kar Medical College, following the recent rape and murder of a junior doctor at the institution. Dr. Ghosh, who resigned from his position at RG Kar just hours before receiving a new appointment, now faces severe criticism from former neighbors. These neighbors have accused him of violence against his wife and unethical practices during his tenure.

Allegations of Domestic Violence

Dr. Ghosh’s former neighbors have come forward with disturbing allegations about his personal life. According to a report by Hindustan Times Bangla, they claim that Dr. Ghosh kicked his wife in the belly just two weeks after she gave birth. The incident reportedly led to several of her stitches opening up. His wife, also a doctor at Nil Ratan Sircar Medical College in Kolkata, was reportedly rescued by locals and taken to a hospital for treatment.

Accusations of Professional Misconduct

In addition to the personal allegations, former locals have accused Dr. Ghosh of charging extra fees for patient consultations conducted at his home, despite being employed at a government facility. They also described his mother as being “cruel” to his wife and child, claiming she did not provide essential clothing for the newborn.

Previous Controversies

Dr. Ghosh’s tenure at RG Kar Medical College has been marred by past controversies, including multiple transfer reversals. He was allegedly reinstated after leveraging his influence. Accusations of corruption have followed him, with former senior officials describing him as an “extremely corrupt” individual. Akhtar Ali, a former deputy superintendent at RG Kar, claimed that Dr. Ghosh operated a mafia-like network within the institution, engaging in practices such as taking commissions on tender orders and supplying alcohol to students at his guesthouse.

As the controversy unfolds, Dr. Sandip Ghosh remains a focal point of public scrutiny, with calls for further investigation into his actions both within and outside of his professional life.

The BJP’s women’s wing plans to hold a candlelight rally to West Bengal Chief Minister Mamata Banerjee’s residence, demanding her resignation over the incident and the vandalism that occurred at the hospital.

In addition, the Socialist Unity Centre of India (Communist) has called for a 12-hour general strike in West Bengal on August 16 to protest against the vandalism and to demand the arrest of those responsible for the rape and murder. Meanwhile, Chief Minister Mamata Banerjee will lead her own protest on August 17, calling for capital punishment for the accused.

Banerjee has urged the Central Bureau of Investigation (CBI), which has taken over the case from the Kolkata Police, to deliver justice by the following Sunday.

Despite the 12-hour strike, Kolkata Metro Railway has confirmed that it will operate normal services on August 16.

The Indian Medical Association (IMA) has announced a 24-hour nationwide withdrawal of non-emergency services from 6 a.m. on August 17 to protest the incident and the subsequent vandalism at RG Kar hospital.

Key developments in the case include a silent candlelight march organized by the BJP Mahila Morcha in all district headquarters of West Bengal on August 16, with a specific march at RG Kar Medical College led by national leaders of the Mahila Morcha.

The Jadavpur University Teachers’ Association has also called for a day-long cease-work on Friday, condemning any attempts to hide evidence related to the case and demanding justice for the victim’s family.

In Delhi, Resident Doctors’ Associations (RDAs) will hold a joint protest march on Friday, and the Delhi Medical Association (DMA) will organize a candlelight vigil at India Gate. The Maharashtra Association of Resident Doctors (MARD) is also planning a protest at Azad Maidan in Mumbai on August 16.

The incident, which took place on August 9, has sparked nationwide outrage and protests, with members of the Bengali film and television industry joining the demonstrations at RG Kar Medical College. </excerpt>

Bharatiya Janata Party (BJP) MP Bansuri Swaraj stated on Wednesday that the INDIA bloc defends and shields ‘corrupt and rapists,’ labelling it an alliance that is both anti-women and anti-social.

Speaking to ANI, Swaraj said, “I.N.D.I.A. alliance is an alliance that only supports and protects the corrupt and the rapists. This is an anti-women and anti-social alliance. Despite having a woman chief minister in West Bengal, TMC leaders dishonoured the mothers and sisters in Sandeshkhali in the TMC office.”

She also remarked that the rape and murder of the doctor in Kolkata is a deeply shocking incident that has shaken the conscience of the people.

“The Kolkata rape and murder incident of the doctor has left souls trembling in the country. A couple of days ago, a 15-year-old girl was also raped by an SP leader in Uttar Pradesh. The Congress party does not even take a minute when it comes to raising the slogans of ‘Ladki hoon, Lad Sakti hoon,’ but when it comes to incidents in places like West Bengal, Uttar Pradesh and even Delhi, they fall silent,” she said.

She further stated that it seems the opposition has neglected their responsibilities while engaging in their battle with the government.

She said, “The opposition has forgotten their duties and have brought shame to the nation. They keep maintaining silence and also support the criminals who commit gruesome acts. Their work speaks for itself.”

Earlier today, Union Minister and West Bengal BJP President Sukanta Majumdar remarked that no woman MP from the TMC has addressed the murder and rape of the Kolkata doctor. He said that, despite being graduates of the same medical college, two TMC MPs and three MLAs have remained silent, suggesting that “something is amiss.”

</excerpt>

Following a violent mob’s attack on vehicles and the RG Kar Medical College and Hospital building in Kolkata, Police Commissioner Vineet Goyal criticised the media, claiming that the incident was a consequence of a ‘wrong and malicious media campaign.’

Addressing the media, Goyal said, “My DCP, who was protecting the boys, is unconscious and what has happened here is because of the wrong, malicious media campaign, which has been going as far as Kolkata police are concerned. What has the Kolkata Police not done?”

This took place after a mob entered the RG Kar Medical College and Hospital campus, causing damage to the protest site and public property, which led security personnel to disperse the crowd. Goyal also mentioned that the Kolkata police have taken all necessary actions under his direction and have arrested the primary suspect in the case.

“In this case, they have done everything and I am saying, everything under my command. My men have worked day and night to collect evidence. They have collected the best evidence. The main accused have been arrested,” he said.

He expressed intense frustration over the rumours circulating about the issue and added that the malicious media campaign has eroded public trust in the Kolkata Police.

“We have tried to satisfy the family but the rumours are being floated that some Mahapatra is being connected with a political Mahapatra. He is an intern who comes from a small place. His father is a primary school teacher and doesn’t have any kind of background. People are spreading these rumours and some of them are his friends, these doctors. Pathetic, I am extremely angry. We have not done anything wrong. Because of this malicious media campaign, people have lost trust in Kolkata Police. We never said there is only one person; we are waiting for evidence as we don’t have anything to support,” he said.

Goyal also noted that it goes against his principles to arrest individuals based on rumours and emphasised that they have not attempted to protect anyone involved in the case.

“I can’t just some kind of rumour can’t arrest an intern; it’s against my conscience. As far as I am concerned, my team is concerned we have done what is right. Now the case is already gone. CBI will be investigating it. We have been transparent with everyone. We wanted the students to form a seven-member committee on Sunday to share everything with them but they haven’t come up with the committee till today. It’s the most unfortunate thing–the motivated media campaign that was being run has portrayed the Kolkata Police in a very bad light. We are always with the people of Kolkata, but unfortunately, this kind of incident wouldn’t have happened if this kind of malicious campaign wasn’t run by the media. We have not tried to save anyone,” he said.

The mob also damaged a vehicle belonging to the Kolkata Police.

In a statement to ANI, the driver of the vandalised car, Badyu Jamaan, said “The crowd came suddenly and damaged the car. A brick hit me on my back when I was standing by the side of my car.”

Meanwhile, addressing the media about the rape-murder incident, CPI (M) General Secretary D Raja said, “What happened in Kolkata was a heinous crime and such crimes should not take place anywhere in the country. We are celebrating 78 years of Independence. What is the meaning of independence if we cannot provide security and protection to our own women and children? If this happens to a lady doctor in a city like Kolkata, think of the condition of our working women in the agricultural field in tribal areas. What is happening? This is a very serious issue. What the Bengal government has done so far is not satisfactory. The union government should take note and provide adequate security to our women and children.”

On August 9, a post-graduate trainee doctor was discovered dead in the seminar hall of RG Kar Medical College and Hospital. The victim’s family claims she was raped and murdered, prompting widespread protests by doctors and medical communities across the country.

</excerpt>

Resident doctors from the Brihanmumbai Municipal Corporation (BMC) and the Maharashtra Association of Resident Doctors (MARD) have decided to extend their strike until their demands are fully addressed and documented. This decision follows the recent brutal rape and murder of a postgraduate trainee doctor at RG Kar Medical College and Hospital in Kolkata, an incident that has deeply shocked the medical community.

The statement released by BMC MARD said, “We the office bearers of BMC MARD convened a meeting, and have decided that the ongoing strike will continue until all the demands put forth by the association are fully met and provided in writing. The decision to persist with the strike is firm, and no actions will be taken to end it until our demands are addressed satisfactorily.”

The incident that took place on August 9 has ignited widespread outrage and prompted protests both within the medical community and beyond.

On Tuesday, doctors from Anugrah Narayan Magadh Medical College Hospital (ANMMC), the largest government hospital in South Bihar, staged a protest in response to the incident. They went on strike in front of the hospital’s superintendent, holding placards and calling for justice. Visuals showed the doctors with placards, emphasising their demand for accountability.

On Tuesday, resident doctors at Agartala Government Medical College (AGMC) held a protest in response to the incident. Dr Himanshu from the psychiatric department told ANI that the doctors had presented three key demands. He noted that while all outpatient departments (OPDs) were closed during the protest, emergency services remained available for patients.

“We have only three demands. The culprit should be immediately punished. There should be a central Act for all the residents’ doctors and their protection inside the hospital,” he said.

Junior doctors at Guwahati Medical College & Hospital in Assam organised a candlelight march to express their solidarity with the victim of the rape and murder incident at RG Kar Medical College and Hospital.

</excerpt>

Congress leader Rahul Gandhi voiced profound shock on Wednesday over the horrific rape and murder of a junior doctor in Kolkata. He underscored the increasing insecurity faced by both, the medical community and women nationwide. In a post on X, Gandhi condemned the purported efforts to “save the accused rather than providing justice to the victim,” expressing serious doubts about the actions of the hospital administration and local authorities.

“The way the layers of this cruel and inhuman act are being revealed has created an atmosphere of fear. If doctors aren’t safe in a medical college, how can parents feel secure sending their daughters out for studies?” Gandhi asked.

Gandhi, reflecting on the wider issue of violence against women, urged for serious dialogue and effective measures to tackle the increasing frequency of such incidents. He drew comparisons to previous cases in Hathras, Unnao, Kathua, and now Kolkata, highlighting that, despite the stringent laws enacted following the Nirbhaya case, these crimes persist.

“This incident has forced us to think that if doctors are not safe in a place like medical college, then how can parents send their daughters outside for studies? Why are even the strict laws made after the Nirbhaya case unsuccessful in preventing such crimes? Every party, every section of the society will have to hold serious discussions and take concrete steps on the continuously increasing incidents against women from Hathras to Unnao, and from Kathua to Kolkata,” he said.

“I stand with the victim’s family in this unbearable pain. They should get justice at all costs and the culprits should be given such a punishment that it is presented as an example in the society,” Rahul added.

Dr Basav Ghosh, State Secretary of the Indian Medical Association (IMA) in Tripura, stated that the protest rally organised by the doctors received backing from both, the IMA state branch and Agartala Government Medical College.

“The protest is not only in Tripura but all over India. We need security and a fearless atmosphere for our doctors to work. These doctors who are protesting here have been fighting for their justice since the morning,” Ghosh said.

He further added “CCTV cameras need to be installed in the hospitals. These incidents should be stopped. We do not want to take out such rallies.”

Shivani Kambuj, a resident doctor at AGMC hospital, described the incident as deeply shameful. She mentioned that the resident doctors and students chose to protest in order to demand justice.

“Whatever happened on August 9 was a very shameful incident and we are taking part in this protest here, at the AGMC hospital to seek justice from the incident,” said Kambuj.

</excerpt>

Union Health Minister and BJP national president J.P. Nadda has strongly condemned the recent rape and murder of a post-graduate student at RG Kar Medical College and Hospital in West Bengal. Describing the incident as “heart-wrenching” and deeply unsettling, Nadda expressed his dismay over the brutal act and criticised the state government’s handling of the situation.

In a statement, Nadda expressed his indignation over both, the incident and the alleged attempts by the West Bengal government to suppress and obscure the case. “The incident that took place with the young woman PG student in West Bengal is really heart-wrenching and has shaken the world and the country. I condemn it and express great sorrow that such an inhumane incident has happened. The way the incident took place and the way the government has tried to hide it, no amount of condemnation will be enough”, Nadda said.

Nadda highlighted the increasing lawlessness and rising violence against women in West Bengal, despite the presence of a woman chief minister. He pointed out that the deterioration of law and order in the state is particularly troubling.

The union minister welcomed the High Court’s decision to mandate a CBI investigation into the case, expressing confidence that the inquiry would uncover the truth. Nadda assured that the central government would take appropriate action against those responsible for the incident. “I have assured everyone that the Central Government will take action against anyone connected with this incident. I will definitely find a remedy for this and I am sure that whatever steps are necessary for this, the Government and the Ministry will take them”, said Nadda.

Over the past two days, delegations from various Doctors’ Associations have met with Nadda, who reiterated his commitment to addressing the issue and ensuring justice for the victim.

</excerpt>

Doctors and medical students protested at Nair Hospital in Mumbai on Tuesday following the Federation of All India Medical Association (FAIMA) calling for a nationwide OPD shutdown. The protest was in response to the sexual assault and murder of a woman post-graduate trainee doctor at Kolkata’s RG Kar Medical College and Hospital on August 9.

BMC MARD General Secretary Dr Akshay Dongardive said, “The woman doctor was on duty when she was raped. Post–mortem said that blood was oozing from her private parts. This is a major rape-murder case after the Nirbhaya incident. It puts us all to shame. We have joined in the nationwide protest. All resident doctors across all government hospitals in Maharashtra are observing suspension of services today. Emergency services are still operational, patients are not facing any issues.”

He added that there should be a Central Protection Act for doctors.

“We demand justice for our sister with whom injustice has been done. We request the State Government and Centre to intervene and order a CBI inquiry at the earliest. All demands of RG Kar Medical College and Hospital doctors should be met. Nearly 40,000 doctors in Maharashtra are on strike,” he further said.

In Nagpur, doctors and medical students held a protest in front of the OPD at Government Medical College & Hospital (GMCH).

Dr Diksha Bajaj from the hospital said, “Doctors spend more time in hospitals than they do at their home. This is our second home. If we are not safe here, where will be safe? We demand our safety and nothing else. We are serving the patients but our safety is important too. If we are not safe, how will we do our work? We want justice. We will call off our strike, once we get justice.”

Patients are facing the consequences of FAIMA’s nationwide OPD service shutdown. At RG Kar Medical College and Hospital in Kolkata, the Outpatient Department (OPD) was closed, leaving patients waiting in line for medical services amidst uncertainty about service availability.

A patient in the queue reported that he had been waiting for over two hours.

The patient said, “We have been standing here for two hours. We don’t know if the hospital is open. Nobody has told us anything.”

IMA has addressed a letter to Union Minister J.P. Nadda, calling for a thorough investigation into the factors that allowed the crime to occur, and requesting measures to enhance the safety of doctors, particularly women, in their work environments.

“We submit to you our demand for the safe zone, defined security measures and Central Law on violence as deterrent measures. We hope you would consider our demands favourably in the light of the deteriorating ground situation,” the IMA letter reads.

On August 9, a post-graduate trainee doctor was found to have been raped and murdered at RG Kar Medical College and Hospital.

</excerpt>

The appointment of Prof (Dr) Sandip Ghosh, the former principal of RG Kar Medical College & Hospital, to the position at Calcutta National Medical College & Hospital in Kolkata sparked widespread protests on Tuesday. The unrest escalated when West Bengal minister Javed Ahmed Khan and TMC MLA Swarna Kamal visited the site this morning. Ghosh, who had resigned from his previous role just a day earlier, was quickly reassigned to the Calcutta National Medical College & Hospital.

Students criticised the reinstatement of Ghosh to Calcutta National Medical College & Hospital as deeply troubling and unethical. They appealed to Minister Javed Ahmed Khan for justice with folded hands and chanted “Go Back” in protest against Ghosh. The students expressed their desire to avoid a repeat of the situation at RG Kar Medical College & Hospital.

In response to the sexual assault and murder of a woman post-graduate trainee doctor at RG Kar Medical College & Hospital on August 9, the Federation of All India Medical Association (FAIMA) has called for a nationwide OPD shutdown starting Tuesday. Consequently, the Outpatient Department at RG Kar Medical College & Hospital was closed, leaving patients waiting in line for medical services amid ongoing uncertainty. Some patients reported waiting for over two hours.

A patient said, “We have been standing here for two hours. We don’t know if the hospital is open. Nobody has told us anything.”

On Monday, the Indian Medical Association (IMA) called on the West Bengal government to conduct a thorough and impartial investigation into the case and ensure the perpetrators are punished.
