Kanjhawala Death Case: Delhi court raps police for filing vague reply in bail plea of accused Deepak

While dismissing the bail application of the accused Deepak Khanna, Rohini court rapped Delhi Police for filing an evasive and vague reply. The court said, “It appears that Investigation Officer (IO) is not opposing the bail application. The approach of the investigating agency appears to be non-serious.” The reply on future bail applications is directed to be supervised by the concerned DCP.

Additional Sessions Judge Sushil Bala Dagar said, “Further it is pertinent to mention that the reply which has been received to this bail application today is quite evasive, vague and non-specific on all grounds. It appears from the reply that the IO is not opposing the bail application.”

In future any application is moved in this matter, DCP is concerned to personally supervise the same and any response sent to the Court should be routed through the Office of DCP to reflect his supervision and application of mind over the investigation, the court directed.

“The investigation is still in the initial stages. The accused himself has given two versions to the investigating agency as mentioned in the bail application i.e. at the first instance, he stated that he was driving the vehicle and later on he is taking the defense that he was not driving the vehicle. Whether he was present inside the vehicle or not is yet to be investigated,” the court noted.

The Court further said that the arguments of Counsel for the accused regarding his GPS location or CDR are not tenable which seems to be his defence and the matter is still at the initial stage.

Delhi Car Horror Case: Murder Section added based on evidence

In the Kanjhawala hit-and-drag case, Section 302 (murder) of the Indian Penal Code (IPC) was added by the Delhi Police on Tuesday.

Meanwhile, the IPC’s Sections 304, “culpable homicide not amounting to murder,” and 302 are used to charge “murder” in the case.

Sagar Preet Hooda, special CP, Law & Order (Zone II, Delhi), said, “After the collection of evidence, police have added IPC Section 302 in place of Section 304.”

Moreover, the murder section was included by the police based on the physical, oral, forensic, and other scientific evidence collected.

However, further investigation into the case is underway.

In the Kanjhawala case, the Rohini court rejects Ashutosh Bhardwai’s bail plea on Thursday because of the gravity and sensitivity of the allegations.

The court said that the investigation against Ashutosh is still in the initial stages.

Meanwhile, the bail plea of Ashutosh was opposed by Delhi Police as during the investigation the accused tried to confuse the police.

Earlier in the day the bail plea of Ashutosh was reserved after hearing the submissions of Delhi police and defense counsel. After which Ashutosh’s lawyer said that Ashutosh was not present in the car at the time of the incident.

However, Ashutosh Bhardwaj’s counsel advocate Shipesh Chaudhary said when the incident took place his applicant was at his home. In this Ashutosh’s counsel submitted Ashutosh’s iPhone which records the live locations.

“The only allegations against him are under 212, 201, 120B Part, and these are bailable in nature,” Chaudhary said.

Chaudhary further said when the offense was committed Ashutosh was not in the car.

“Another accused Ankush is on bail,” Chaudhary said.

“Before the stage of charge, the document can’t be produced by the defense. The authenticity of this video can’t be established as these are without section 65B of the Evidence Act certificate,” Special public prosecutor (SPP) Atul Srivastava said.

SPP Srivastava also submitted, “We never said he (Ashutosh) was in the car. Our stand is that he provided his vehicle to a person who was not authorized to drive.”

“He did not inform the police regarding the accident for which he was under legal compulsion. He didn’t inform the police about the incident despite having knowledge,” SPP said.

In the Kanjhawala death case, the hearing on the bail plea of Ashutosh Bhardwaj has been adjourned on Tuesday by the Rohini Court, Delhi for Thursday. Ashutosh Bhardwaj is one of the accused in Anjali’s death case.

Meanwhile, the other six accused are under judicial custody. The concerned judge was not available today that’s why the hearing on the bail plea of Ashutosh was adjourned by Link Metropolitan Magistrate.

Accused Ashutosh’s Advocate Shilpesh Chaudhary requested the linked judge to list the matter. Earlier on Monday the court of Metropolitan Magistrate Sanya Dalal asked Delhi Police to reply to Ashutosh Bhardwaj’s bail plea.

Moreover, the Additional public prosecutor (APP) Atul Srivastava for Delhi Police said and urged that the accused be sent to Judicial custody.

The sections which are put up on the accused are 201, 212, and 120B part 2 which are bailable.

There is a new development in the Kanjhawala car accident death case in which the new CCTV footage revealed that the accused are seen outside the home of Ashutosh, the owner of the car after a 20-year-old woman named Anjali died after being dragged under a car for several kilometers in Delhi.

In connection with the 20-year-old woman’s death, the sixth suspect Ashutosh was taken into custody by Delhi Police on Friday and for the seventh person the hunt has been launched by the police.

After the accident, Ashutosh was seen talking to the accused in the CCTV visuals. At 4:07 am one of the accused arrived to meet Ashutosh and later he was seen coming and going into his house.

According to the police, the seventh accused in the case is none other than Ankush. Earlier on Thursday the Special Commissioner of Police (Law & Order) Delhi Police Sagar Preet Hooda said the five accused Ashutosh and Ankush Khanna- were friends.

“In the new CCTV visuals, Ankush is also talking to someone on the phone,” Delhi Police said.

“Ankush was talking to the accused on the phone. Ashutosh is last seen on CCTV walking toward his home at 4:52 am. According to the police, at 4.42 am Ashutosh left the house wearing a jacket and returned at around 4:52 am,” police said.

Meanwhile, to find out the truth Delhi Police is interrogating Ashutosh and said, “In the Sultanpuri case, the sixth accused Ashutosh has been arrested who had given false information to the police. Further investigation is on.”

According to the police, the car through which the victim was dragged was Ashutosh’s car and during interrogation, Ashutosh has given false information to the police.

Earlier, police arrested five accused named Deepak Khanna, Amit Khanna, Krishan, Mithun, and Manoj Mittal.

Moreover, for medical examination, all the accused were taken to Sanjay Gandhi Hospital on Thursday. 18 teams of Delhi Police are investigating the case.

“We are trying to file the charge sheet as early as possible. During the post-mortem, no evidence of sexual assault was found,” the Special CP said.

I was scared and ran away and returned home, didn’t tell anything to anyone. It is the fault of the girl who was driving in an inebriated state. I insisted that she shouldn’t drive. I told her ‘I am conscious, let me drive’. She didn’t trust me and trusted herself instead,” Nidhi claimed that Anjali was drunk while driving the scooty.

Anjali Singh’s mother denies all the statements given by her friend Nidhi. She calls it baseless that the victim was heavily drunk at the time of the accident on Sunday morning.

On a Sunday morning, Nidhi was riding pillion on Anjali’s scooter on their way back to home before the two-wheeler collided head-on with a Maruti Baleno car. Due to the impact of the collision, Nidhi was tossed off the scooter, and Anjali got stuck beneath a Baleno car that dragged her for several kilometers, resulting in her painful death.

On Tuesday, Nidhi claimed that Anjali was “not in her senses” when they left a hotel room after celebrating the new year.

“She had consumed a lot of alcohol (at the party). We even had a fight over who would drive the scooter. She was not at all in her senses. Before that accident, she was about to ram into a truck but I somehow managed to apply the brakes on time even as I was seated behind her… and we got saved,” Nidhi told media.

Reacting to Nidhi’s statement, Anjali’s Grandmother Kanta said, “I don’t believe her. She is lying. We did not even know Nidhi before this accident,” she told sources at her residence in the Sultanpuri area.

Taking to Twitter Arvind Kejriwal tweeted, “Talked to the victim’s mother. Will get justice for the daughter. Will field the biggest lawyer. His mother remains ill. Will get them fully treated. Will give a compensation of Rs 10 lakh rupees to the victim’s family. The government is with the victim’s family. If there is any need in future that also we will fulfill.”

However, by blunt force, all the injuries are produced by vehicular accidents and dragging. No injury has been suggestive of sexual assault in Anjali’s PME.

AAP Saurabh Bhardwaj: Delhi Police Is Protecting Kanjhawala Accused

Saurabh Bhardwaj, AAP National Spokesperson on Monday said that Delhi police is shielding Kanjhawala accused BJP party leader, Manoj Mittal. Contrary to the Deputy Commissioner of Police (DCP) Harendra Singh’s statement, Bhardwaj also said that there are higher chances of rape of the victim.

Talking to the media, Bhardwaj said, “After the arrest of the accused, the DCP is speaking the language of the accused and is trying to defend the accused. Why haven’t the DCP and SHO been dismissed yet? The DCP is trying to intimidate journalists.”

In the Kanjhawala incident in Delhi in which a woman dies after being dragged under car five people have been arrested.

Deputy Commissioner of Police (Outer District) Harendra K Singh on Monday said, “As per our investigation, it was a fatal accident. All five persons who were present in the car have been arrested. They will be produced before the court today. The postmortem of the deceased woman will be conducted through a board of doctors.”

Talking to the media deceased’s mother said, “I had a conversation with her at around 9 pm, and she said she will return by 3-4 am. She used to work as an event planner for weddings. In the morning, I got a call from the police and was informed about the accident. I was taken to the police station and was made to wait.”

“When my brother arrived at Police Station, he was told about the death of my daughter. My brother told me about it,” said the mother of the deceased.

“My daughter was the only earning member in our family. She was wearing so many clothes but not a single piece of cloth was there on her dead body, what kind of accident was it,” the deceased mother stated.

Meanwhile, the Kanjhawala incident was eyewitnessed by Deepak Dahiya runs a confectionery shop and narrated the horrific ordeal. Dahiya said the girl was dragged for 18 to 20 kilometers and got entangled under their vehicle.

“It was 3:20 am…I was standing outside the shop when I heard a loud noise from a vehicle about 100 meters away. Earlier I thought it was a tire burst. As soon as the car moved, I saw a body being dragged. I informed the police immediately,” Dahiya said.

Moreover, Delhi Commission of Women (DCW) chief Swati Maliwal also took cognizance of the incident and a notice has been issued to the Delhi police.

“The naked body of a girl was found in Delhi’s Kanjhawala, it is being told that some boys in an inebriated state hit her scooty with a car and dragged her for several kilometers. This matter is very dangerous, I am issuing an appearance summons to Delhi Police. The whole truth should come out,” Maliwal said.

Swati Maliwal further stated that all the five men in the car were drunk and said, “A very disturbing incident has come out. A girl was hit by a car and then dragged on the road. The car was driven by five badly drunk people. I have summoned Delhi Police to ask how will justice be provided to the girl. Secondly, I want to ask, despite the girl being dragged for kilometers, no check post was able to catch anything. No one stopped those drunk people. This is a very scary and shocking incident.”

However, at the SGM hospital, Mangolpuri the girl’s body was sent and at the mortuary of the hospital, the body has been kept.
