The SUV driver, captured in a viral video, is still at large for as police continue their search for the suspects.
</excerpt>

Noida Police Commissioner, Lakshmi Singh has suspended two police officials over a cover up of the viral Thar case, where it was seen that a man was run over by a Mahindra Thar and sent flying into the side of the road following a social media feud.

Through an official written statement, the Noida Police Department has suspended SHO of Sector 24 Noida, Shyambabu Shukla and Jagmohan Singh, the OIC of Gijhore. The statement read, “On June 2, an incident of quarrel and brawl between two parties under the jurisdiction of Sector-24 police station went viral on social media. Despite knowing about the incident, the Sector-24 police station in-charge inspector Shyambabu Shukla hid the incident from the higher authorities and did not make any meaningful efforts to arrest the accused,”

“This act is a reflection of arbitrariness, negligence and indiscipline towards one’s duties and responsibilities. Taking cognizance of the incident, the Police Commissioner of Gautam Buddh Nagar has suspended the SHO and outpost (Chowki) in-charge with immediate effect. The concerned officials have been directed for departmental inquiry.” The police department added

Viral Thar Hit-and-Run: What Triggered the Attack?

A minor Instagram spat turned into a violent road rage attack in Sector 53 when two brothers, Saurabh and Sumit Yadav, were ambushed by a mob of 15–20 men led by Akash Awana. The altercation stemmed from a comment Akash made about a female friend of Ayush, a close associate of the victims. Expecting a verbal discussion, the Yadavs arrived at the meeting spot, only to be brutally attacked. The violence escalated when the assailants attempted to run them over with a Mahindra Thar SUV. Police are investigating, and a search is underway for the suspects involved.

The Noida traffic police has tracked down the Thar used in the viral video and subsequently issued a fine of ₹68,500 on the assailent who the police are actively trying to locate.

A Guard of Honour was held in his village.
</excerpt>

In a tragic road rage incident in Delhi’s Nangloi area on September 29, 2024, a 30-year-old Delhi Police constable named Sandeep lost his life after being dragged by a speeding car for nearly 10 meters. The incident occurred during the early morning hours while Sandeep was on patrol duty in civilian clothes to monitor burglary activities in the area. He noticed a car driving recklessly and signalled the driver to slow down. However, instead of complying, the driver struck Sandeep’s motorcycle from behind and dragged him along the road before he collided with another vehicle. This horrific incident led to Sandeep’s death from severe head injuries.

The police arrested one of the accused, Rajnish alias Sittu, from Noida. He was in the car at the time of the incident but was not the driver. The actual driver, who is believed to have committed the crime, remains at large, and efforts are ongoing to track him down. Multiple raids have been conducted in Delhi, Uttar Pradesh, and Haryana to locate the fugitive.

The Delhi Police have seized the car involved in the crime, and CCTV footage from the area has provided crucial evidence for the ongoing investigation. The video captured the moments leading up to the incident, helping authorities establish the sequence of events.

The death of Constable Sandeep has not only shocked his colleagues but also the entire community. A Guard of Honour ceremony was held in his village, Madina, in Haryana’s Sonipat district, where the Delhi Police paid tribute to his unwavering dedication to duty. Sandeep is survived by his wife, mother, and a five-year-old son.

Meanwhile, the case took a new turn when the habeas corpus petition was filed in the Delhi High Court. The petition claims that the wife of one of the accused had been detained illegally by the police, adding another layer of complexity to the investigation. The legality of this detention will be examined in a court hearing scheduled for October 1.
This tragic incident highlights the growing menace of road rage and reckless driving in the city. As Delhi Police continue their search for the main accused, the incident has sparked widespread calls for stricter road safety regulations and more responsible driving in the national capital.

Police Commissioner Amitesh Kumar stated, “Yes, we have inquired about everyone directly or indirectly involved in the Porsche car case, including MLA Sunil Tingre.”

The incident occurred on May 19, when a 17-year-old driving a luxury Porsche crashed into a motorcycle, resulting in the deaths of two young riders in Kalyaninagar. Following the accident, there were allegations that MLA Tingre attempted to intervene at the police station to protect the juvenile driver and used his political influence to sway the investigation.

MLA Tingre has denied these allegations.

Deputy Chief Minister Ajit Pawar recently mentioned in a public speech that Tingre was questioned by the police for three to four hours. Pawar asserted that Tingre had clarified his lack of involvement in the case and criticized those attempting to implicate him unfairly.

In a distressing sequence of events, two separate hit-and-run incidents have left communities in Chennai and Pune reeling. Car accidents have been a topic of concern recently due to several incidents that have occurred in the past.

Chennai Tragedy:

On Monday evening, Madhuri, daughter of YSR Congress Party’s Rajya Sabha MP Beeda Masthan Rao, allegedly drove her BMW over a 21-year-old painter named Surya in Chennai’s Besant Nagar area. The victim was sleeping on a pavement when the speeding car fatally injured him. Madhuri and her companion initially fled the scene, leaving behind a shocked community. The incident has sparked public outcry as Madhuri was subsequently arrested but released on bail. The case has been registered under section 304 A of the IPC (causing death by negligence).

Pune Incident:

Meanwhile, in Pune’s Yerawada area on Tuesday, a 41-year-old man named Kedar Chavan lost his life in a similar tragedy. Chavan, employed as a delivery man, was riding his motorcycle when it skidded, causing him to be run over by a Mercedes-Benz car driven by a doctor’s driver. The victim succumbed to his injuries at a nearby hospital.

Community Demands Justice:

Both incidents have ignited demands for justice from affected families and local communities. In Chennai, protests have emerged outside the J-5 Shastri Nagar Police Station, where Surya’s relatives and neighbors gathered, seeking accountability. In Pune, authorities are investigating the circumstances surrounding Chavan’s death, highlighting the need for stricter road safety measures.

These tragic events underscore the urgent need for enhanced road safety awareness and accountability in urban areas across India.

</excerpt>

The 17-year-old boy who tragically killed two young IT professionals with his luxury Porsche car on May 19 has reportedly confessed to the Pune Police that he was heavily intoxicated while driving at the time of the accident. According to India Today, which cited police sources, the teenager revealed during questioning that he could not fully recall all the events.

According to Hindustan Times, The teenager informed the Pune Police that he was so intoxicated at the time of the accident that he could not remember anything. He was questioned in the presence of his mother, who was arrested on Saturday, along with crime branch officials, including Assistant Commissioner of Police Sunil Tambe and the district child protection officer.

Despite efforts to elicit information, the juvenile remained tight-lipped during questioning, police told HT.

“Our officials asked the minor about his location before the accident, his presence in Blak and Cosie pubs, driving the Porsche, details of the accident, tampering of evidence, collection of blood samples and medical tests. To all the questions, the minor had a single answer – that he had no memory of anything as he was drunk,” said a crime branch official.

The initial investigation revealed that the minor and his friends had consumed alcoholic beverages at two pubs, where they accumulated a total bill of ₹48,000.

Meanwhile, The Times of India reported, citing Pune Commissioner of Police Amitesh Kumar, that the minor driver’s mother, who was arrested on Saturday for allegedly providing her blood sample in place of her son’s, claimed that doctors at Sassoon General Hospital had instructed her to give her blood instead of the boy’s.

“We have recorded the statement of the woman (49). She told us that the doctors of the hospital had told her to give her blood as sample instead of her son’s. She feigned ignorance on why the doctors told her so,” The Times of Indiaquoted Amitesh Kumar as saying.

On Sunday, a Pune court remanded the parents of the boy to police custody until June 5 in connection with a case related to the destruction of evidence.

The duo is under investigation for their alleged involvement in tampering with the minor’s blood sample following the car accident on May 19 in Pune, Maharashtra, which resulted in the deaths of two IT professionals.

The minor’s mother, Shivani Agarwal, was arrested on June 1 after it was revealed that the boy’s blood samples had been replaced with hers.

The Pune Police took custody of his father, realtor Vishal Agrawal, who was previously arrested in a related case, for his alleged role in destroying evidence. The police presented the couple before a holiday court in Pune and requested their remand, which was granted until June 5.

The police informed the court that Vishal and Shivani Agarwal conspired to destroy evidence related to the accident.

The police allege that the couple visited a state-run hospital and tampered with the minor’s blood samples. Their lawyer, Prashant Patil, stated that the police have already searched their home and recovered CCTV footage.

The couple has been charged under IPC section 201 (causing disappearance of evidence of an offence), which is a bailable offence. Patil argued that they should be sent to judicial custody.

In addition to the minor’s parents, the police have also arrested his grandfather, Surendra Agarwal, for allegedly kidnapping the family’s driver and pressuring him to take the blame for the accident, among other charges.

Furthermore, two doctors from the state-run Sassoon General Hospital and an employee have been arrested for allegedly swapping the minor’s blood samples.

The police have registered three separate cases related to the car accident. The first case is an FIR concerning the accident itself. The second case targets the bar that allegedly served alcohol to the minor.

The third case involves the wrongful confinement and coercion of the family driver to take the blame for the accident. Additionally, the boy’s father has been charged for allowing him to drive without a valid license.

</excerpt>

A speeding vehicle, clipped by another car, killed a pedestrian on Tuesday, May 28, after slamming into her at a Bronx intersection. The hit-and-run was caught on camera.

The video shows the woman, 30, crossing Washington Avenue at East 167th Street at 6 pm. She suddenly saw a blue Jeep SUV driving toward her.

The woman stopped in the centre of the crosswalk, taking a step backwards. A black Toyota Rav4 then clipped the Jeep, but the woman could not manage to walk back to safety on the sidewalk.

Hitting the Jeep’s rear bumper, the Rav4 sent the vehicle into a tailspin. The Jeep directly headed for the pedestrian.

The Jeep’s Driver Flees

After a violent collision with the Jeep, the woman was hurled into a stationary car. According to the NYPD, the driver of the Jeep subsequently exited the vehicle and fled the scene.

Three individuals emerged from the damaged Jeep, with the driver indicating the area where the woman was struck before calmly retrieving several items from the vehicle and departing. In contrast, the driver of the Rav4 remained present at the scene.

The woman was transported to Lincoln Hospital, where she was later pronounced deceased by the authorities. Her identity remains undisclosed.

It remains uncertain whether any of the vehicles involved disregarded a red traffic signal. Additionally, it is unclear which vehicle had the right of way.

An investigation into the incident is currently ongoing, with no charges having been filed as of yet.

</excerpt>

Tragedy struck in Sector 53 near Gijhore village on Sunday morning when a 53-year-old man lost his life in an Audi hit-and-run incident. Janak Dev Shah, a former Group D employee with All India Radio and resident of Sector 53, was out for his routine morning walk when the accident occurred.

According to ACP Arvind Kumar, Shah was returning home around 6:30 am when a speeding Audi struck him from behind near a primary school. The impact of the collision flung Shah into the air, and he landed approximately 20 meters away. Shockingly, the driver of the Audi failed to stop after the accident, leaving Shah critically injured on the road.

CCTV footage from a nearby camera captured the harrowing incident, showing Shah walking along the road with a can in his hand before the Audi struck him. Despite efforts to trace the driver, the vehicle’s number plate remains unidentified.

Following a complaint filed by Shah’s family, law enforcement authorities have registered a case against the driver under sections 279 (rash driving) and 304A (death due to negligence) of the Indian Penal Code (IPC). Two teams have been formed to locate the driver and conduct a thorough investigation, including scrutiny of CCTV footage from surrounding areas for further evidence.

Shah’s family members expressed shock and disbelief over the sudden tragedy, describing his routine morning activities. They recalled how Shah would often return home with milk after his morning walks. Devastated by the untimely loss, the family received news of the accident merely 20 minutes after Shah had left home.

This unfortunate incident serves as a stark reminder of the dangers posed by reckless driving and underscores the importance of road safety measures to prevent such tragedies in the future.

</excerpt>

Indian-origin man Sachin Sahoo, 42, was fatally shot by San Antonio police after he allegedly struck two officers with his vehicle while they were attempting to arrest him in connection with an aggravated assault case, according to PTI. Officer Tyler Turner shot Sahoo on April 21. Originally from Uttar Pradesh, sources suggested that Sahoo may have been a naturalized US citizen.

The initial investigation indicated that just before 6:30 pm on April 21, officers responded to a report of aggravated assault with a deadly weapon at a residence in Cheviot Heights in San Antonio. Upon arrival, they found a 51-year-old woman who had been intentionally struck by a vehicle, and the suspect, Sahoo, had fled the scene. The victim was taken to a local hospital in critical condition.

Following the incident, San Antonio Police Detectives issued a felony warrant for Sahoo. However, Sahoo returned to the scene hours later, as informed by neighbors to the police. When officers attempted to contact him, he struck two officers with his vehicle. One of the officers fired his weapon, hitting Sahoo, who was declared dead at the scene.

While one of the injured officers received immediate medical attention, the other was taken to a nearby hospital for treatment. The investigation is ongoing.

Police Chief Bill McManus stated that Sahoo had allegedly run over the woman, who was his roommate, with his vehicle. The woman underwent multiple surgeries and was in critical condition.

According to PTI reports, the police had issued an arrest warrant for Sahoo, and a few officers had gone to his known location on April 21 to attempt his arrest.

Sahoo’s ex-wife, Leah Goldstein, mentioned in a report on Kens5.com that Sahoo had been diagnosed with bipolar disorder. “He suffered the past ten years with bipolar disorder. He also had symptoms of schizophrenia,” she said. “He couldn’t understand what was wrong with him. He would hear voices. And hallucinate and just hear voices and just get stuck in his own mind. I was a stay-at-home mom for many years. He provided for us,” she added.

A tragic road accident took place near Kothapalli in Atmakuru Mandal on Sunday night, leading to the death of a motorcyclist. The incident happened when a car collided with a motorcycle, resulting in the victim being propelled into the air and landing on the car, where he ultimately succumbed to his injuries.

The car driver proceeded for about 18 kilometres without halting, finally stopping at Hanimireddypalli and then absconding. Officials are now reconstructing the entire series of events related to the incident. Sub-Inspector Atmakuru Muneer Ahmed reported that upon receiving reports of accident with an Innova, the police quickly arrived and began their inquiry, although the deceased biker’s body was not found at the location initially.

</excerpt>

Failure to stop and assist the injured on the roads also carries increased penalties
in comparison to the previous law, including imprisonment and fines.

The strike by Truck drivers protesting against the new laws which make hit and run a serious punishable offence is an attempt to bypass accountability which is the basic premise behind the new law. Many citizens including myself have been victims of serious case of negligence on roads by drivers who are driving under the influence of alcohol or are just aggressive on roads especially in areas where police presence is low. It is not just the truck drivers themselves who are at fault, it is rather the transport companies who hire the
drivers, who do not carry out the mandatory checks and balances which have made travelling on Indian roads a nightmare for many families.

The overloading of trucks is a common sight, which is a nuisance for other passengers on the roads and a health hazard. In this era and age, when the government is building world class infrastructure to take our country to the list of developed nations, it is imperative that
we have stringent laws with what promises to be one of biggest killers in the country.
Now it is important to understand what does the new law really say? The new hit and run law (effective December 2023) has some important provisions that gives up to years imprisonment and fine for accidents not amounting to culpable homicide and in the case of some serious injury up to 10 years imprisonment and fine. Failure to stop and assist the injured on the roads also carries increased penalties in comparison to the previous law, including imprisonment and fines. The last provision is imperative as countless people have lost their families and loved ones on the roads due to general apathy, lack of timely medical assistance, with the accused often fleeing the scene of crime.

In the absence of witnesses and any kind of evidence, many perpetrators have ended up
being free. For those who argue against such stringent provisions, there are some statistics that must be looked at before criticizing the new law or questioning its need.
According to the Ministry of Road Transport and Highways’ data, it’s alarming that hit-and-run cases in road accidents are consistently increasing in the country.

In 2020, there were a total of 52,448 hit-and-run incidents, resulting in the loss of lives for 23,159 individuals. In 2021, this figure rose, with 57,415 such incidents and 25,938 people losing their lives. These figures suggests that the existing laws were grossly inadequate for fixing accountability and ensuring justice for victims. A look at laws across the world suggest that the new law aims to catch up with the laws relating to hit and run cases. All countries of the world have imposed significant penalties for fatal and serious injury caused by hit and run, with imprisonment and fines being the primary punishments. However there are some differences, mainly in terms of punishments given where the government has left some room for manoeuvre. While in India, the maximum imprisonment for fatal hit and run (7 years) is lower than Australia (life) and China (10 years or life) however it is similar to some states in the US. It is important to understand the strict punishment is not done with an intent to punish but to provide deterrence and force transport companies to come up with measures which increase accountability. It is also done with an intention to provide citizens their right to safety and security on the roads.

All countries discussed have implemented strict laws and penalties to deter such acts. While the specifics of the laws and penalties may differ, the overall message is clear: leaving the scene of an accident is a serious offense with significant legal repercussions.

Kartikeya Sharma is a Member of Parliament.

</excerpt>

Protests by transporters and auto drivers are erupting opposing the proposed tightening of Section 104 in recent legislative changes. Truck, bus and tanker drivers are on a three-day strike to protest against the stringent jail and fine regulations under the newly-launched Bharatiya Nyay Sanhita (BNS) for hit-and-run cases.

Each year, thousands fall victim to hit-and-run incidents, often losing their lives due to delayed medical attention. The proposed laws dictate that in hit-and-run cases, fleeing individuals arrested for leaving an injured person alone may face up to a 10-year imprisonment alongside fines. Conversely, drivers who promptly report accidents may receive reduced penalties.

A Report of ministry of road and highways says that approximatly 5,00,000 people got injured in road accident in 2023.

‘India witnessed a 9.4% increase in fatalities due to road accidents in 2022 with 1.68 lakh people losing their lives last year either due to reckless driving, over speeding, drunken driving and non-compliance of traffic regulations while the total number of accidents went up by 11.9% to 4.61 lakh’, the ministry of road transport and highways said in its report.

This translates into 19 deaths every hour and 53 accidents per hour. The report said the number of injured people was 15.3% higher compared to last year at 4.43 lakh.

As per the report, for the fourth consecutive year in 2022, the fatal road accident victims largely constitute young people in the productive age groups. “Young adults in the age group of 18 – 45 years accounted for 66.5% of victims during 2022,” the report said, adding that people in the working age group of 18 – 60 years share 83.4% of total road accident fatalities.

The Hit and Run Law, outlined in Section 104 of the Indian Judicial Code, defines the act as causing harm to an individual or property due to reckless driving followed by fleeing the scene. This law stipulates a 10-year prison sentence for causing a victim’s death due to a driver’s negligence.

There is widespread public outcry across the nation concerning the recent amendment to the hit and run law introduced by the central government. The amendment is facing staunch opposition nationwide, sparking protests, particularly among truck drivers in multiple states like Madhya Pradesh, Uttar Pradesh, Rajasthan, and Maharashtra.

Consequently, long queues are witnessed at petrol pumps, with Madhya Pradesh experiencing the most significant impact. Additionally, the All India Transport Congress plans to convene a meeting in Delhi to decide on potential strike actions, scheduled for Tuesday.

Let’s delve into what constitutes a hit and run, the specifics of the new rule, the previous regulation, the necessity for the amendment, the grounds of opposition, and the government’s stance on the controversy.

What is Hit and Run
Hit and run incidents involve road accidents wherein harm is caused to an individual or property due to reckless and negligent driving, followed by the perpetrator fleeing the scene. These cases often pose challenges in capturing and penalizing the culprits due to a lack of evidence and eyewitnesses.

The New Rule
The contentious rule sparking national uproar is part of three recent laws passed by the Parliament. Specifically, it revises Section 104 of the Indian Justice Code (BNS), replacing the IPC. This section delineates punitive measures for causing death due to negligence.
Section 104(1) addresses causing death recklessly or negligently, warranting imprisonment up to five years and a fine.
Section 104(2) pertains to causing death due to negligent driving, constituting culpable homicide, leading to imprisonment extendable up to ten years and imposing a fine.

Previous Hit and Run Law:
In India, hit and run incidents were not explicitly punishable under the Indian Penal Code (IPC). However, sections 279, 304A, and 338 were relevant:
Section 279 defines and penalizes reckless driving.
Section 304A addresses death caused by negligence, punishable by imprisonment up to two years or a fine.
Section 338 addresses grievous hurt due to rash or negligent acts, carrying imprisonment up to two years or a fine.

Additional Regulations
The Motor Vehicles Act 1988 also applies to hit and run cases, encompassing Sections 161, 134(A), and 134(B):
Section 161 provides
compensation: Rs 25,000 for death and Rs 12,500 for severe injury.
Section 134(A) mandates immediate medical aid by the driver.
Section 134(B) requires the driver to report the accident to the police promptly, failing which leads to penalties.

Rationale for the Amendment:
The primary challenge in hit and run cases is the absence of direct evidence, making it arduous for law enforcement to identify culprits. Witnesses are often reluctant to cooperate due to legal concerns.

What is the cause of the protest?
The implementation of new regulations has stirred apprehension among drivers, who fear the rules are directed against them. According to the updated rules, drivers might face public backlash if they attempt to aid the injured.

What is the government’s stance on the controversy?
Union Home Minister Amit Shah recently disclosed in Parliament that the government has introduced stringent penalties for individuals fleeing the scene after causing a road accident, leaving victims unattended. Additionally, the Home Minister mentioned a degree of leniency for those voluntarily reporting the incident to the police and assisting the injured to the hospital. However, there exists no such provision in the Indian Penal Code.
