Why Do Women Wear Hijab?

Muslim women choose to wear the hijab or other coverings for various reasons, primarily related to personal belief and identity. For many, it represents a divine commandment about modesty and a personal commitment to God, often adopted after puberty. In the U.S., particularly post-9/11, the hijab has become a symbol of Islamic identity, with some women wearing it to express their faith. Additionally, some Arab or Muslim women see the hijab as a way to assert their cultural identity and political affiliations.

On the other hand, some Muslim women opt not to wear the hijab, viewing it as a cultural rather than a religious requirement. They believe that modesty can be expressed in other ways and prioritize their internal spiritual relationship with God. Despite differing choices, most Muslim women agree that wearing the hijab should be a personal decision, reflecting individual beliefs and values.

They further stated that after morning prayers, the principal directed them to wear their hijabs differently and then asked them to leave.

The issue sparked considerable debate on social media following the video. But despite the firing discussion on social media, the school authorities have yet to issue an official statement.

Samajwadi Party leaders and the local Gramme Pradhan visited the school to address the situation. The police were also called to the scene and mediated discussions between the involved parties.

According to the police, the dispute centres around the school’s dress code policies, and the role of law enforcement is limited to maintaining order, with the matter falling under the purview of the education department.

</excerpt>

The Supreme Court on Friday partially stayed a circular issued by Chembur College in Mumbai, which had banned students from wearing hijabs, stoles, or caps on campus. A bench comprising Justices Sanjiv Khanna and Sanjay Kumar issued a notice on the petition challenging the ban and suspended the ban on hijabs and caps.

In its interim order, the bench stated, “We issue a notice in the week commencing November 18. We partly stay clause 2 of the impugned circular to the extent that it directs no hijab, no cap, and no badges will be allowed. We hope and trust this interim order is not misused by anybody.”

The court expressed surprise at the college’s decision and questioned the rationale behind the ban, emphasizing that such a rule could hinder the empowerment of women. Justice Khanna asked the college’s counsel, “How are you empowering women by telling them what to wear? Where is the choice for the woman?”

The college’s counsel argued that the intention was to avoid revealing students’ religious affiliations. However, Justice Khanna responded, “Religion is there in the names also. Do not impose such rules.” He further questioned whether the college would also ban bindi or tilak.

The Supreme Court agreed that face-covering veils like niqabs or burqas should not be allowed in class and did not interfere with that part of the college’s instructions.

This appeal follows a Bombay High Court order that upheld the college’s ban on students wearing hijabs, niqabs, burqas, stoles, caps, or badges on campus. The High Court had dismissed the plea filed by a group of female students, who argued that the dress code violated their fundamental rights to privacy, dignity, and religious freedom.

The college maintained that the ban applied to all religious symbols and was not specifically targeted at Muslims. The High Court had ruled that the dress code did not violate the Constitution and was intended to ensure that students focus on education rather than religious symbols.

</excerpt>

A professor at a private law school connected to the University of Calcutta resigned and stopped teaching after allegedly receiving a request from the institution’s administration not to wear a headscarf while at work. But in the face of controversy and public outcry, college officials claimed it was just a misunderstanding. On June 11, they declared that Sanjida Qadar, the three-year LJD Law College instructor, would be returning after rescinding her resignation.

“The diktat from the college governing body offended my values and religious sentiments,”Sanjida remarked

Sanjida began wearing the hijab to work since March, and during the last week, things have gotten worse. The college administration contacted her after her resignation became widely known, stressing that there had been a misunderstanding. They made it clear that they had never forbade her from donning a head covering while at work.

“I received an email from the office on Monday. I will analyze my next steps and then decide. But I am not going to the college on Tuesday,” she mentioned.

The email made it clear that every faculty member’s dress code is regularly reviewed. It confirmed that she was allowed to cover her head while teaching with a dupatta or scarf.

College governing body chairman Gopal Das said, “There was no directive or prohibition and the college authorities respect the religious sentiments of every stakeholder. She will resume classes on Tuesday. There is no misunderstanding. We engaged in prolonged discussions with her. The initial developments were the result of some miscommunication,” he said.

The Supreme Court of India has been approached by a group of girls from Karnataka on Monday requesting a directive to allow them to sit for examinations wearing hijab.

A bench consisting of Chief Justice DY Chandarchud, Justices V Ramasubramanian and JB Pardiwala, took note of senior attorney Meenakshi Arora’s arguments that an interim injunction was required in light of the practical exams that were due to begin for several schools in the state on February 6.

“This is the headscarf matter. The girls have practical examinations from February 6, 2023 and this matter needs to be listed for interim directions so that they can appear. The practical examinations will be held in government schools,” the senior lawyer said, appearing for some students.

“I will examine it. This is a three-judge bench matter. We will allot a date,” the CJI said.

A two-judge panel of the Supreme Court issued conflicting rulings in the hijab dispute and ordered the Chief Justice to appoint the proper panel to hear the matter on October 13, 2017, which was brought about by the state of Karnataka’s prohibition on the wearing of Islamic head coverings in schools.

There would be no restrictions on the wearing of the hijab anywhere in the state’s schools and colleges, according to Justice Sudhanshu Dhulia, who replaced Justice Hemant Gupta, who had dismissed petitions against the Karnataka High Court’s March 15 decision refusing to overturn the prohibition.

The Karnataka government responded to the petitioners by arguing throughout the proceedings that its circular enforcing uniform was religion-neutral and solely intended to promote uniformity and discipline in the state’s educational institutions.

In the Tunisha Sharma death case, an intriguing new development has come in which the uncle of the popular television actor, Pawan Sharma claimed that Tunisha’s behavior and lifestyle changed after she met Sheezan Khan.

Meanwhile, Pawan Sharma also claimed that Tunisha started wearing a ‘Hijab’ (a headscarf worn by Muslim women) after meeting Sheezan Khan.

Talking to the media Pawan Sharma said, “Today, the police submitted in court that Sheezan had relations with other women as well. They should probe Tunisha’s death from all possible angles.”

Moreover, the police in the court said that for one-and-a-half-hour on the day of Tunisha’s death Sheezan and his secret girlfriend had a conversation. After this, it is assumed that Tunisha was angry with the conversation with the secret girlfriend.

The 20-year-old Tunisha committed suicide on 24 December in the washroom on the set of the television serial ‘Ali Baba Dastaan-E-Kabul’.

Earlier on Tuesday Actor Tunisha Sharma’s last rites were performed at Mira Road cremation ground in Mumbai and fans, family and members of the television and film industry bid a teary farewell.

However, on Sunday Sheezan was arrested on charges of abetment of suicide. Sheezan and Tunisha were in a relationship but broke up 15 days ago.

Furthermore, Tunisha was 20 year old and have worked in many TV serials like Bharat Ka Veer Putra – Maharana Pratap, Chakravartin Ashoka Samrat, Gabbar Poonchwala, Sher-e-Punjab: Maharaja Ranjit Singh, Internet Wala Love, and Ishq Subhan Allah.

A scuffle had erupted between two group of students over wearing of hijab and namabali when one of them turned up at the school gate and demanded that they should be allowed entry wearing nambali while the other group of girls cam to school wearing hijab. The scuffle resulted in the cancellation of examination at a government school in West- Bengal’s Howrah district.

Police were called to defuse the tensions between the two groups which prompted the authorities to cancel the examination including pre-boards. “The pre-board exams were going on Monday when some students went to the school wearing hijab. Seeing them, another group of students demanded that they be allowed to wear namabali. The school authorities diffused the tension by asking students to follow the dress code,” said a police officer.

The next day girls arrived in school wearing hijab which prompted the tensions. “The school authorities informed police. The police did not enter the school first as it was an internal matter. But later officers of the local police station went inside to bring the situation under control,” said the officer.

Bengal minister Arup Ray said, “There has been an instigation. I have also spoken to police. I have requested police for a thorough probe, not only to find the perpetrators but also to find who instigated them.”

According to her family, a woman was arrested by the Iranian security forces for eating at a restaurant in public without a hijab.

Donya Rad was arrested after an image of her and another lady eating in a restaurant in Tehran without wearing headscarves went viral online, according to CNN.

The image, which surfaced on Wednesday, depicts the two ladies having breakfast at a cafe that, like the majority of cafés in Iran, is generally frequented by men.

According to Rad’s sister, security agencies contacted Donya and summoned her to explain her actions.

“After visiting the designated place she was arrested, after a few hours of no news, Donya told me in a short call that she was transferred to Ward 209 of Evin Prison,” her sister told CNN.

The dictatorship imprisons political dissidents in Tehran’s notoriously harsh Evin Prison, which is only intended for inmates under the control of Iran’s Intelligence Ministry.

According to reports, security officials have recently imprisoned a number of prominent Iranians, including the author and poet Mona Borzouei, the Iranian football star Hossein Mahini, and Faezeh Rafsanjani, the daughter of former Iranian President Ali Akbar Hashemi Rafsanjani.

According to the non-governmental organisation Iran Human Rights, Iranian artist Shervin Hajipour was also arrested this week after releasing a poignant song based on tweets shared by Iranians expressing their feelings about why people are demonstrating.

The song “For…” by Hajipour became extremely popular online, garnering millions of views and being extensively distributed among Iranians both inside and outside of their nation.

The killing of a Kurdish woman named Mahsa Amini sparked the country’s first anti-government protests.

Mahsa, 22, passed away in police custody after being arrested for reportedly wearing a “improper hijab,” in violation of Iran’s stringent laws regarding women’s attire.

The government crackdown has continued after almost two weeks of protests, with dozens dying in clashes between security forces. Iran Human Rights estimates that at least 83 people including children, are confirmed to have been killed in protests following the death of Mahsa Amini, reported CNN.

More than a thousand people connected to the protests have been detained as of last weekend. At least 28 journalists arrested were arrested as of Thursday, according to the Committee to Protect Journalists.

In a statement released on Thursday, Amnesty International stated that they are “investigating the authorities’ mass arrests of protesters and bystanders, as well as journalists, political activists, lawyers, and human rights defenders, including women’s rights activists and those belonging to oppressed ethnic minority groups.”

Videos circulating on social media show protesters in the cities of Qom, Rasht, and Mashhad calling for the overthrow of the clerical establishment despite the rising death toll and a stern crackdown by the police, according to CNN report.

The unrest sparked by the death of Mahsa Amini grew more intense for a sixth day when, on Thursday, protesters torched police stations and vehicles in Tehran, the capital of Iran, as well as numerous other cities around the nation. Mahsa Amini, 22, passed away last week after the morality police arrested her for not wearing a hijab.

The worst demonstrations in Iran since 2019 have spread to at least 50 cities and villages as a result of Mahsa Amini’s death.

Videos posted on the Iran protest-focused Twitter account 1500tasvir, which has about 100,000 followers, showed demonstrators yelling “We will die, we will die, but we’ll get Iran back” in the vicinity of a police station that was set on fire.

According to Reuters, a second police station in Tehran’s capital city was set on fire.

Iran banned internet access when there was no sign that the demonstrations were abating. Women have been a significant part of the protests, and several of them have waved or burned their hijabs or cut their hair in public.

Protests erupted in Iran following the death of Mahsa Amini, a 22-year-old Kurdish woman. Amini died in hospital on Friday, three days after being arrested and beaten by morality officers, according to reports.

Protesters gathered outside the hospital where Amini was being treated at first. According to the Guardian, security forces used pepper spray on the protesters, and several of them were arrested.

Amini’s body was transported on Saturday to her native Kurdistan province for burial.

Hundreds of people attended Amini’s funeral in his hometown. Some yelled anti-government slogans like “death to the dictator!”

Protest videos have gone viral on social media.

Amini was visiting Tehran on Friday when she was arrested by morality police for violating the country’s hijab law. According to reports, she was beaten up in the detention van. The police, on the other hand, believe Amini died of a heart attack.
