According to the CBI’s supplementary charge sheet, Arvind Kejriwal, as AAP’s National Convenor and Overall In-Charge, is implicated in the scheme.
</excerpt>

The Central Bureau of Investigation (CBI) has accused the Aam Aadmi Party (AAP) of benefiting from illicit funds linked to a criminal conspiracy in the Delhi Excise Policy case. According to the CBI’s supplementary charge sheet, Arvind Kejriwal, as AAP’s National Convenor and Overall In-Charge, is implicated in the scheme.

The investigation claims Kejriwal had a pre-conceived plan to privatize the Excise Policy, allegedly seeking financial backing for AAP in March 2021 during the policy’s formulation by the Group of Ministers (GoM), which was led by co-accused Manish Sisodia. Vijay Nair, AAP’s Media and Communication Head, allegedly demanded illegal payments from stakeholders in the Delhi Excise Business in exchange for favorable policy adjustments.

The CBI further asserts that Nair, who had no official authority to engage with these stakeholders, acted under Kejriwal’s direction. The charge sheet also accuses AAP of submitting a misleading statement on election expenses for the 2022 Goa Assembly Elections, omitting significant cash payments made to vendors and campaign workers.

The investigation reveals that illicit funds from the Delhi Excise Policy conspiracy were allegedly used to finance AAP’s election campaign in Goa. AAP leader Durgesh Pathak, in charge of election expenditures, is accused of overseeing these cash payments, with funds being funneled through hawala channels under the direction of Pathak and managed by Chanpreet Singh Rayat.

</excerpt>

The Rouse Avenue court on Thursday extended the judicial custody of Delhi Chief Minister Arvind Kejriwal in a CBI case linked to Delhi Excise policy. Kejriwal was produced before the court through video conferencing from Tihar Jail.

Special judge (CBI) Kaveri Baweja on Thursday extended the Judicial custody of Arvind Kejriwal till August 20. CBI moved an application seeking an extension of judicial custody.

CBI has already filed a charge sheet against Arvind Kejriwal on July 29. He was arrested by the CBI on June 26.

Kejriwal was granted interim bail in a money laundering case by the Supreme Court on July 12. Earlier he was granted regular bail by the trial court on June 20.

Earlier, he was arrested by the ED in the money laundering case in March. The court has already taken cognizance of the supplementary charge sheet against Kejriwal.

He was granted a bail in money laundering case by the trial court which was under challenge before the Delhi High Court.

In this, CBI has also arrested Former Deputy CM Manish Sisodia, BRS leader K Kavitha and others accused.

In the Delhi Excise Policy case, the Enforcement Directorate (ED) requested the High Court on Wednesday a short adjournment to address its plea for the cancellation of bail granted to Chief Minister Arvind Kejriwal.

The court expressed confusion about the potential consequences of canceling the bail, questioning whether such a move would result in Kejriwal’s re-arrest and saying, “I am confused. Are you going to arrest him again?”

The Delhi High Court questioned the Enforcement Directorate (ED) on whether canceling Chief Minister Arvind Kejriwal’s bail would lead to his re-arrest. The court’s inquiry aims to clarify the implications of the ED’s plea for bail cancellation.

The AAP termed the ED summons as ‘illegal’, claiming that the validity of the summons is now being litigated in court. […]
</excerpt>

Delhi Chief Minister Arvind Kejriwal, would not appear before the Directorate of Enforcement (ED) for interrogation in connection with an excise policy issue relating to money laundering, Aam Aadmi Party (AAP) officials said Monday.
The AAP termed the ED summons as ‘illegal’, claiming that the validity of the summons is now being litigated in court.

“ED itself has gone to court. Instead of sending summons again and again, ED should wait for the court’s decision,” a party source said.

On February 2, Kejriwal skipped the ED’s summons for the fifth time in connection with the money laundering investigation into irregularities in the Delhi excise policy 2021-22 case.
On February 17, Kejriwal appeared in Rouse Avenue Court via video conference following the ED’s complaint about his purported noncompliance with its summons.

Kejriwal, while appearing virtually, said the court that he wished to attend the court proceedings in person, but was unable to do so due to the confidence motion and budget sessions.

Additional Chief Metropolitan Magistrate Divya Malhotra granted Kejriwal’s exemption plea on Saturday and scheduled his physical appearance in court for March 16, 2024.

The ED has filed a new complaint case under Sections 190 (1)(a) and 200 of the Code of Criminal Procedure, Section 174 of the Indian Penal Code, and Section 63 (4) of the Prevention of Money Laundering Act (PMLA) for non-attendance in compliance with Section 50 of the PMLA.

According to the ED, the agency intended to record Kejriwal’s statement in the case about policy formation, discussions held before it was finalized, and charges of bribery.
The ED alleged in its sixth charge sheet filed in the case on December 2, 2023, citing AAP leader Sanjay Singh and his aide Sarvesh Mishra, that the AAP used kickbacks worth Rs 45 crore generated under the scheme as part of their Goa assembly election campaign in 2022.

The excise policy attempted to revitalize the city’s struggling liquor industry by substituting a sales-volume-based system with a license charge for merchants. It promised swankier stores and an improved shopping experience. For the first time in Delhi, the policy included discounts and special offers on booze purchases.

Two prominent AAP leaders, Manish Sisodia and Sanjay Singh, are already in judicial detention in the case.
The CBI arrested Sisodia, the then Delhi’s Deputy Chief Minister, on February 26 after multiple rounds of questioning. On October 5, the ED arrested Singh, a Rajya Sabha member.

</excerpt>

Delhi’s Rouse Avenue Court on Monday asked the Central Bureau of Investigation (CBI) when a person is no longer an accused how can a Look Out Circular (LOC) be continued against him.The court asked this question while hearing the application moved by Dinesh Arora, a businessman who was named as accused in the Delhi excise policy scam FIR, seeking withdrawal of LOC issued against him. Dinesh has now become an approver for the CBI. Special judge M K Nagpal while hearing the application pulled up the CBI and asked, ” Under which provision LOC can be continued?
“Better you withdraw it, if the court passes an order, it will pass it with stricture,” the judge said.The additional public prosecutor (APP) for the CBI submitted that the LOC is continued to ensure the presence of Dinesh Arora.
The court asked, “How long you (CBI) will keep the LOC continued?”
The court asked the IO of CBI and advocate R K Thakur to furnish the guidelines governing the issuance and withdrawl of LOC.

On the joint request, the matter has been adjourned till June 8.The court was informed by counsel R K Thakur that Dinesh Arora is to travel to the Netherlands on June 15 to join his wife and younger son. His elder son studied there.In November 2022, the Court had allowed Businessman Dinesh Arora, an alleged aide of Deputy Chief Minister of Delhi Manish Sisodia, to turn approver in the alleged excise policy case.Businessman Dinesh Arora, earlier an accused in the Delhi excise policy case had submitted that ” I am ready to make true disclosure voluntarily about the case and wants to be an approver in the case”Earlier, He said, “I am ready to make a voluntary and true disclosure with respect to my role in the commission of the alleged offences. I have also cooperated in the investigation of the case by CBI and have made true statements before the Investigation officer. I have also made a confessional statement before the ACMM regarding facts and events pertaining to the commission of alleged offences”.

A few days ago, the same court granted anticipatory bail to Dinesh Arora after CBI didn’t oppose the bail plea in the case.The Court noted that CBI in its reply against the anticipatory bail plea, stated that the applicant has supported the investigation and disclosed certain facts which are vital for the investigation; hence, the CBI has no objection if the anticipatory bail is granted to the applicant by this court.

</excerpt>

The Delhi High Court has postponed its decision on the regular bail petitions of Former Delhi’s Deputy Chief Minister Manish Sisodia and Vijay Nair, former Communication in-charge of the Aam Aadmi Party (AAP) in an Enforcement Directorate (ED) case related to the Delhi Excise Policy matter. Justice Dinesh Kumar Sharma, presiding over the bench, reserved the order after the completion of arguments on Friday. This comes after the same bench had previously reserved the order on Thursday regarding the bail plea of Abhishek Boinpally, a Hyderabad businessman involved in the same case. The Trial Court had previously denied bail to all the individuals involved.

Meanwhile, Sisodia’s legal team also moved an interim bail plea in Delhi High Court citing his wife’s medical illness. The interim bail is seeking court direction to grant six weeks of bail.The interim bail is opposed by the ED through Additional Solicitor General SV Raju who can visit his wife in a police escort. The court continues to hear the interim bail plea on Friday.Recently Delhi High Court dismissed the bail plea of Manish Sisodia in a CBI case alleging corruption in the implementation of the previous liquor policy in the national capital.

Last month, Delhi High Court issued notice to ED on Manish Sisodia’s bail petitions in a money laundering case in connection with the alleged excise scam.The Rouse Avenue Court earlier dismissed the bail plea of Manish Sisodia in a money laundering case related to the excise scam stating that “This case of economic offences having serious repercussions upon the general public and society at large as the evidence collected during investigation speaks volumes of his involvement in the commission of the said offence”

AAP leader Sanjay Singh took to Twitter and posted a video where he made allegations against the Enforcement Directorate (ED). He claimed that he had exposed the alleged dictatorship and misuse of power by the ED in the excise policy case. Sanjay Singh stated that after the ED failed to find anything incriminating against him, they began conducting raids at the homes of his colleagues.

He criticized these raids as acts of dictatorship and accused the ED of acting on the orders of Prime Minister Narendra Modi. Sanjay Singh expressed his determination to continue his fight against what he perceives as the misuse of the ED’s authority. He mentioned that his colleagues Ajit Tyagi and Sarvesh Mishra had their houses raided.

Sanjay Singh announced his intention to approach the High Court and Supreme Court if necessary, to challenge the actions of the ED. He vowed not to back down and promised to expose what he believes to be the wrongful practices of the ED in front of the entire country. </excerpt>

Manish Sisodia, a former deputy chief minister of Delhi, asserted before the High Court through Senior Advocate Dayan Krishnan that the Central Bureau of Investigation has no proof of his involvement in the alleged irregularities in the formulation and application of the Government’s excise policy.

After filing a FIR in the case more than six months prior, Sisodia was taken into custody on February 26, 2023. Additionally, not a single witness received a threat from the applicant during the whole inquiry that lasted six months prior to his arrest.

Sisodia (Applicant)in his bail stated that the possibility of a threat to witness cannot be said to arise without there being any material or antecedents of the Applicant. The witnesses in this case against the applicant are primarily civil servants, over whom the Applicant exercises no control, especially now since he has resigned from his official post.

After the conclusion of the submission arguements made by Sisodia’s lawyer, the bench of Justice Dinesh Kumar Sharma on Thursday fixed April 26, 2023, for the arguements of the Central Bureau of Investigation.
Meanwhile, Senior Advocate Mohit Mathur, also appeared for Aam Aadmi Party Leader Manish Sisodia submitted that my client was called for questioning for the second time in February 2023, so all these allegations about my being capable of influencing the witnesses is totally wrong.

Earlier the Delhi HC had issued notice to CBI on a bail plea moved by Manish Sisodia challenging a trial court order denying bail to him in a CBI case related to Excise.
Sisodia was arrested by the CBI on February 26, 2023, and is presently in Judicial custody. His bail plea was on March 31, 2023, by the trial Court in the case.
The trial Court while dismissing Sisodia’s bail plea said, “The court is not inclined to release him on bail at this stage of investigation of the case as his release may adversely affect the ongoing investigation and will also seriously hamper the progress”
According to the CBI, Sisodia had played the most important and vital role in the criminal conspiracy and he had been deeply involved in the formulation as well as the implementation of the said policy to ensure the achievement of the objectives of the said conspiracy.

The payment of advance kickbacks of around Rs. 90-100 crores was meant for him and his other colleagues in the GNCTD and Rs. 20-30 crores out of the above are found to have been routed through the co-accused Vijay Nair, Abhishek Boinpally and approver Dinesh Arora and in turn, certain provisions of the excise policy were permitted to be tweaked and manipulated by the applicant to protect and preserve the interests of South liquor lobby and to ensure repayment of the kickbacks to the said lobby, stated CBI.

Sisodia, in his bail petition in a trial court, stated that no fruitful purpose would be served to keep him in custody as all the recoveries in the case have already been made.He also stated that he joined the investigation as and when called for by the CBI. The other accused persons arrested in this case have already been granted bail, Sisodia noted further, adding that he held the important constitutional post of deputy CM of Delhi and has deep roots in the society.

In the alleged Delhi Excise Policy scam money Laundering case on Monday the custody of businessmen Sharath Reddy, Binoy Babu, Vijay Nair, and Abhishek Boinpally has been extended till 7 January 2023.

Meanwhile, while extending judicial custody of all the accused the court noted that the bail petitions of all the accused are pending in the court.

The special public prosecutor is in the process to fill out the supplementary chargesheet till 5 January 2023 against all arrested accused.

Earlier, in an alleged Delhi, Excise Policy scam money Laundering case the Enforcement Directorate (ED) informed the court that there will be a common chargesheet against all arrested accused.

Moreover, in a money laundering case revolving around an excise policy case, ED filed its chargesheet in November against the Businessman Sameer Mahendru and some entities.

However, on a recommendation from Delhi Lieutenant-Governor Vinai Kumar Saxena, the FIR was filed on a reference from the Union Home Ministry.

The Enforcement Directorate on Thursday made a statement in which ED said to destroy digital evidence more than 30 VIPs changed 140 mobile phones.

Delhi Deputy Chief Minister Manish Sisodia who is under the scanner of the Enforcement Directorate in the alleged corruption is also involved in destroying the evidence.

Meanwhile, in the special Prevention of Money Laundering Act (PMLA) court, the ED told that liquor policy was “leaked” to certain liquor manufacturers before it was introduced.

Earlier on Thursday, in connection with alleged corruption two more people were arrested- Benoy Babu, Delhi regional head of French wine company Pernod Ricard, and P Sarath Chandra Reddy, director of Aurobindo Pharma Ltd.

“34 important persons involved/suspected to be involved in the excise scam have changed a total of 140 phones (valued at about Rs 1.20 crore) with the intention to destroy digital evidence during the relevant period,” the probe agency said.

“These persons include all the main accused, liquor barons, senior government officials, the excise minister of Delhi, and other suspects. The timing of the change of phone indicates that these phones were mostly changed just after the scam surfaced,” ED said.

However, Delhi Deputy Chief Minister and in charge of the Delhi Government excise department Manish Sisodia was named as the primary accused and the FIR was also filed in August.

During interrogation, several people revealed that a “have revealed that bribe to the time of Rs 100 crore had been given in advance for undue benefits to select business groups to operate in the Delhi excise policy 2021-22.”

“It has also been found that kickbacks and bribes were demanded and taken by the excise officials of Delhi for the opening of retail shops in Delhi.”

However, the Aam Aadmi Party government passed the excise policy in 2021-2022, over which lieutenant governor VK Saxena showed the red flag and recommended a CBI probe into the matter.
