One of the locations included the Mumbai home of actor Dino Morea.
</excerpt>

The Enforcement Directorate (ED) conducted raids at 15 places on Friday as part of its investigation into the Mithi River desilting scam. One of the locations included the Mumbai home of actor Dino Morea.

BMC Lost ₹65 Crore in Alleged Fraud

The ED suspects that the scam caused a ₹65 crore loss to the Brihanmumbai Municipal Corporation (BMC). The agency is investigating the case under the Prevention of Money Laundering Act (PMLA).

According to officials, the raids were carried out at several locations in Mumbai and Kochi. These included the homes of Dino Morea and his brother, as well as offices of contractors and middlemen.

Dino Morea Was Recently Questioned

Before these raids, the Mumbai Police’s Economic Offences Wing (EOW) had already questioned Dino Morea regarding the case. The EOW had earlier filed an FIR against 13 people, including contractors and BMC officials.

Irregularities in Desilting Work

The ED’s investigation is based on the EOW’s FIR, which alleged major irregularities in the desilting of the Mithi River. The accused are suspected of working together to cheat the BMC.

The scam allegedly happened between 2021 and 2023. During this period, sludge was supposed to be removed from the Mithi River and transported for safe dumping. However, the ED believes the process was tampered with to benefit selected suppliers.

The tenders for hiring dredging machines were also allegedly rigged to favour certain companies.

SIT Probing Larger ₹1,100 Crore Spending

The Special Investigation Team (SIT) is also reviewing a larger expenditure of ₹1,100 crore spent on the Mithi River desilting project from 2005 to 2021. Officials are checking if more financial mismanagement occurred during that time.

A Key Flood-Prevention Project Under Scrutiny

The Mithi River is an important part of Mumbai’s flood-prevention system. It flows through the city and empties into the Arabian Sea. The desilting project was designed to prevent flooding during the monsoon.

Now, investigators are treating this as part of a wider probe into corruption and misuse of funds in one of Mumbai’s biggest civic projects.

</excerpt>

The Congress Party launched a wave of protests across India soon after the Enforcement Directorate (ED) filed a chargesheet against Sonia Gandhi and Rahul Gandhi in the National Herald case. Senior Congress leaders swiftly took to the streets, calling the move a politically motivated attack on the opposition.

Police Detain Congress Leaders in Delhi

In Delhi, police detained several Congress leaders as they attempted to breach security barricades near the party’s national headquarters. Authorities acted promptly to block further escalation, deploying heavy security around the area.

Congress Slams ED for Targeting Opposition

Reacting sharply, Congress leader Amit Chavda accused the BJP-led government of using central agencies to suppress dissent. “The government is clearly using the ED and CBI to distract citizens from real issues and intimidate the opposition,” Chavda told reporters. “This is a calculated move to stifle democratic voices.”

Imran Pratapgarhi Links ED Action to Upcoming Elections

Congress MP Imran Pratapgarhi linked the ED’s move to the BJP’s fear of losing in upcoming state elections. “The BJP knows it’s losing ground in Bihar and Assam. That’s why it’s misusing the ED to harass the Opposition,” he said.

“Just look at the timing—Rahul Gandhi visits Modasa in Gujarat, and suddenly, the ED files a chargesheet. This isn’t coincidence; it’s political strategy.” He added, “The BJP wants to crush the Opposition completely, but it forgets that the Gandhi family has made immense sacrifices for this nation. Congress will not remain silent.”

Sachin Pilot Vows Legal Fight

Congress leader Sachin Pilot also condemned the chargesheet, vowing to fight the case through legal means. “This is nothing but a politically motivated attack,” he said. “We believe in the judicial system and will challenge this legally. The BJP is targeting Sonia and Rahul Gandhi to suppress our voice.”

ED Moves Case to Rouse Avenue Court

On Tuesday, the ED submitted the prosecution complaint at Delhi’s Rouse Avenue Court. The chargesheet names Sonia Gandhi, Rahul Gandhi, Sam Pitroda, Suman Dubey, and others. The court will take up the matter on April 25 to decide whether to proceed with the case.

Congress Plans Statewide Protests Outside ED Offices

In response, Congress announced it would stage demonstrations at ED offices in all districts. The party accused the BJP of orchestrating a coordinated attack through investigative agencies. This case began after BJP leader Subramanian Swamy filed a complaint, alleging financial irregularities involving the National Herald newspaper and Congress-linked firms.

Bansal had earlier filed a complaint against former ED Assistant Director Vishaldeep, who is accused of demanding bribes from educational institutions involved in the Himachal Pradesh scholarship scam.
</excerpt>

The Enforcement Directorate (ED) on Thursday conducted a raid at the residence of Vikas Bansal in Sector 16, Panchkula. Bansal had earlier filed a complaint against former ED Assistant Director Vishaldeep, who is accused of demanding bribes from educational institutions involved in the Himachal Pradesh scholarship scam. The Panchkula Police had registered a case against Vishaldeep based on Vikas Bansal’s complaint. According to Bansal, his brother Rajneesh Bansal had also filed a complaint against Vishaldeep, after which the Central Bureau of Investigation (CBI) had registered a case against him under the Prevention of Corruption (PC) Act.

In this case, Rs 1.25 crore was recovered from Vishaldeep’s brother Vikasdeep. Bansal further alleged that on January 3, around 4 PM, his nephew Mannat received a phone call from a person named Rohit Gurjar, who claimed to be a member of the Lawrence Bishnoi gang. The caller allegedly threatened the family and demanded Rs 50 lakh to withdraw the complaint against Vishaldeep. He also warned of dire consequences if the complaint was not taken back.

The Himachal Pradesh scholarship scam took place between 2012 and 2017, involving the misappropriation of Rs 181 crore. In 2019, after a CBI investigation, cases were registered against 29 educational institutions in Himachal Pradesh. ED also launched a separate probe into the matter. During the investigation, Vishaldeep, who was then an ED Assistant Director, was accused of demanding a bribe of Rs 2.5 crore. Following this, the CBI team from Chandigarh arrested Vishaldeep, along with his brother and cousin.

Bansal had filed a complaint with the Sector 14 police station on January 9 that the CBI had registered a case against Vishaldeep on the complaint of his brother Rajnish Bansal. Vishaldeep’s brother Vikas Deep has also recovered Rs 1.25 crore from the accused in the case. In Himachal Pradesh, a scholarship scam of Rs 181 crore took place during the year-2012-17. In 2019, a case was registered against 29 educational institutes in Himachal Pradesh after a CBI probe. The ED had also registered a separate case in this regard.

The case was then being probed by ED Assistant Director Vishaldeep and Vishaldeep was accused of demanding bribe of Rs 2.5 crore. The CBI team, Chandigarh, had registered a case and arrested Vishaldeep and his brother and cousin. ED Attaches Rs. 87.64 Crore in Properties of Gupta Builders Under PMLA in Mohali

The ED’s Zonal Office has provisionally attached immovable properties worth Rs. 87.64 Crore under the provisions of Prevention of Money-laundering Act (PMLA), 2002 belonging to Ms. Gupta Builders and Promoters Pvt. Ltd. (M/s. GBPPL). As per the ED the attached properties include incomplete flats, shops and villas at GBP Camellia situated at Aujla village of district SAS Nagar. The ED had initiated investigation on the basis of FIRs registered by Chandigarh and Punjab Police against real estate company Ms. GBPPL through its Directors namely Satish Kumar and Raman Gupta, Pardeep Kumar, Vinod Kumar and Anupam Gupta.

ED investigation revealed that an aggregate amount of Rs. 478 Crore was collected by thecompany from buyers. They duped the innocent buyers by promising them to deliverflats/plots/commercial spaces. However, they neither delivered the projects nor returned their money.

During the course of the investigation, searches under PMLA, 2002 were also conducted at various premises of entities and persons. Further, as the Directors of Ms. GBPPL failed to join ED investigation despite frequent opportunities, the Special Court (PMLA), Chandigarh declared Satish Gupta, Pardeep Gupta, Vinod Gupta and Raman Gupta as “Proclaimed Offenders vide its order in August 2023 result of PMLA investigation, |various movable and immovable properties related to Proceeds of Crime worth Rs. 305.51 Crore purchased in the name of Ms. GBPPL and other related persons were identified and attached by ED.

Supreme Court admonishes ED, Former Congress MLA Surendra Panwar acquitted in money-laundering case

<excerpt>Arrest in money laundering case declared illegal by Supreme Court, ED’s appeal rejected.
</excerpt>

In a major relief to the former Haryana Congress MLA Surendra Panwar the Supreme Court has upheld the decision of the Punjab and Haryana High Court, in which Panwar’s arrest in a money laundering case was declared illegal.

Rejecting the special leave petition (SLP) filed by the Enforcement Directorate (ED), the court clarified that the High Court’s decision was based only on the legality of the arrest and it would not affect the merits of the case.

Panwar was arrested by the ED on July 20 last year on charges of illegal mining and money laundering. He alleged that after the arrest, he was kept for continuous interrogation for 15 hours.

However, the High Court rejected his arrest on 23 September 2024 and Panwar was released on September 25, ahead of voting of Haryana Assembly Elections which he contested on Congress ticket from Sonipat assembly constituency. Later the ED challenged the High Court’s decision in the Supreme Court.

Meanwhile, ED lawyer Zoheb Hussain argued in the Supreme Court that the High Court wrongly recorded that Panwar was questioned continuously for 14 hours and 40 minutes, claiming that Panwar was given a dinner break at night and the agency took care of human rights in the interrogation. However, the Supreme Court rejected this argument of the ED and called the long interrogation inhuman.

Dismissing the Enforcement Directorate (ED)’s plea against the High Court order, the Bench held, “We are not inclined to interfere with the finding of the high court that the arrest of the respondent was illegal.” The High Court’s findings, it said, were only for deciding whether Panwar’s arrest was illegal. “These findings will not affect the merits of the pending complaint under Section 44 of the Prevention of Money Laundering Act (PMLA), 2002,” said the Bench in its order on December 2.

The court said the ED’s approach in conducting the probe was a “shocking state of affairs” where a person was virtually forced to make a statement. ED’s counsel Zoheb Hussain said the high court had erred in its finding that Panwar was continuously quizzed for 14.40 hours, pointing to a dinner break during the interrogation. The lawyer said ED in a 2024 circular asked its officials to maintain certain standards of interrogations and to ensure people were not interrogated during late night and in early hours of the day.

On September 29, 2024, the High Court said primarily, as per the grounds of arrest, the allegation(s) against the petitioner pertained to illegal mining or supplying the illegally mined material. Therefore, it said, the foundation of the case was illegal mining whereas the rest of the allegations in all the nine FIRs were peripheral, relatable to illegal mining. “Of course, ‘illegal mining’ is an offence under Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957 (MMDR Act), but neither ‘illegal mining’ nor the MMDR Act has been included under the schedule attached with the PMLA. In other words, ‘illegal mining’ is not a scheduled offence under the PMLA. Hence, prima facie, petitioner cannot be prosecuted on that count,” said the High Court.

It noted the ED itself said Panwar was issued summons under Section 50 of the PMLA and appeared before the agency at around 11 am in Gurugram on July 19, 2024 and was constantly interrogated till 1.40 a.m. (July 20, 2024) for 14 hours and 40 minutes. The High Court observed the continuous interrogation for over 14 hours “was not heroic” on ED’s part and it was rather against the dignity of a human being. “For future, in view of the mandate under Article 21 of the Constitution, this court is observing that Directorate of Enforcement shall take remedial measures and sensitize the officers to follow some reasonable time limit for investigation in one go against the suspect(s) in such cases,” it said.

Instead of subjecting someone to “unnecessary harassment” for such a long duration, the high court called for a necessary mechanism to carry out a fair investigation of the accused in line with the basic human rights laid down by the United Nations. It said there was no material with the ED to substantiate that petitioner was directly or indirectly involved in any process or activity connected with the proceeds of crime, in any manner or projected it as untainted by any means. Panwar, 55, was taken into custody in the wee hours of July 20, 2024, in Gurugram and produced before a special PMLA court in Ambala which sent him to the custody of the ED till July 29, 2024 in an illegal mining-linked money laundering case.

The agency raided the premises of the former Sonepat MLA in January, 2024, on charges of “large-scale illegal mining” in the Yamunanagar area of the State. The money-laundering case stems from several FIRs registered by the Haryana Police for probing alleged illegal mining of boulders, gravel and sand that took place in the past in Yamunanagar and nearby districts despite a ban imposed by the NGT. The ED is also probing an alleged fraud in the “e-rawana” scheme, an online portal that was introduced by the Haryana government in 2020 to simplify the collection of royalties and taxes and prevent tax evasion in mining areas. According to the ED, the alleged illegal mining generated slush funds of about Rs 400-500 crore over the last few years.

After the Supreme Court’s decision Panwar’s lawyers called it a victory of justice stating that the court’s ruling has proved that the action taken under political pressure cannot last.

</excerpt>

The Directorate of Enforcement (ED) Lucknow Zonal Office provisionally attached 86 land parcels worth ₹31.94 crore in connection with the Shri Lakshmi Cotsyn bank fraud case. The attachment was carried out under the Prevention of Money Laundering Act (PMLA), 2002, as part of an ongoing investigation into financial irregularities committed by Shri Lakshmi Cotsyn Limited. The properties, primarily agricultural land, are situated in Chhattisgarh’s Bhatapara and Baloda Bazar districts and are registered under the names of the company, trusted employees, and other individuals.

Bank Fraud Allegations and Initiation of ED Investigation

The ED launched its investigation based on an FIR filed by the Anti-Corruption Branch of the Central Bureau of Investigation (CBI) in New Delhi. The case began after a senior Central Bank of India official filed a complaint in June 2021 against Shri Lakshmi Cotsyn Ltd, including key figures such as Mata Prasad Agarwal (Chairman and Managing Director), Pawan Kumar Agarwal (Joint Managing Director), and other directors and employees. The allegations involve cheating, criminal breach of trust, conspiracy, forgery, falsification of accounts, and misuse of public funds between 2010 and 2018.

The investigation revealed that Shri Lakshmi Cotsyn Ltd had sought loans from a consortium of 23 banks, led by the Central Bank of India, for manufacturing textiles. Due to mismanagement, these accounts were marked as Non-Performing Assets (NPAs) by individual banks. A forensic audit indicated several violations of loan agreements, including inflated inventory records, manipulation in the auction process, and undisclosed transactions with related parties. Further, the company allegedly provided unauthorized discounts totaling ₹207.29 crore to related entities and customers, with some transactions linked to fictitious addresses.

The ED found that funds from Shri Lakshmi Cotsyn Ltd were diverted to its group company, Shri Lakshmi Power Ltd, and subsequently transferred to individuals via an ICICI bank account in Baloda Bazar, Chhattisgarh. These funds were then used to acquire land registered in the names of trusted employees and local residents, many of whom were tribal people in Chhattisgarh.

Liquidation and Debt Recovery Efforts

Shri Lakshmi Cotsyn Ltd underwent liquidation under the National Company Law Tribunal (NCLT), and assets worth approximately ₹265.44 crore were sold to help recover debts. The case involves an outstanding loan amount of ₹7,377 crore, already declared a fraud by the Reserve Bank of India (RBI). The liquidation and attachment of assets are part of efforts to recover these funds.

The ED continues to investigate financial misconduct by Shri Lakshmi Cotsyn Ltd and associated entities. The current attachment of 86 land parcels represents a step in the legal and financial process to address the large-scale bank fraud associated with the company.

The new internal guidelines follow directions from the Prevention of Money Laundering Act (PMLA) Court regarding statement recordings under Section 50 of the PMLA.

Timing and Preparation for Recording Statements

According to the guidelines, ED officers must be well-prepared with necessary documents and questionnaires before questioning summoned individuals. To avoid prolonged waiting times, officers should ensure examinations begin promptly at the appointed time and date. Aiming to limit the duration of questioning, the ED recommends completing the examination on the same day or the following day.

Special Provisions for Elderly and Ailing Individuals

The ED’s guidelines specify that examinations for elderly persons, those with serious medical conditions, or those who are otherwise infirm should strictly occur during regular hours. In such cases, officers may reschedule the examination to a mutually agreed date if necessary.

Extended Hours for Exceptional Cases

In exceptional circumstances—such as when there is credible information suggesting the risk of evidence concealment, dissipation of proceeds, or evasion—ED officers may extend statement recording beyond regular hours. However, these cases require documentation and prior approval from a senior ED official (deputy, joint, or additional director).

The ED stated that the guidelines are part of a larger effort to streamline processes, safeguard the integrity of investigations, and comply with PMLA court directives.

</excerpt>

The Enforcement Directorate (ED) has filed a supplementary chargesheet against Aam Aadmi Party (AAP) MLA Amanatullah Khan in connection with its ongoing investigation into money laundering related to the Delhi Waqf Board. The 110-page chargesheet also names Mariam Siddiqui as an accused, although she has not been arrested. The court is expected to consider the chargesheet on November 4.

Arrest and Allegations

Khan was arrested by the ED on September 2 at his residence in Okhla following a series of raids and hours of questioning. He remains in judicial custody. The investigation began when the ED sought an arrest warrant in April for Khan’s failure to appear before the agency. In January, the agency had already charged several of his associates, including Daud Nasir and Zeeshan Haider, with similar offenses.

The ED alleges that Khan misappropriated significant amounts of cash through illegal staff recruitments at the Delhi Waqf Board, using the proceeds to acquire immovable assets in the names of his associates. Furthermore, the agency claims Khan benefited from leasing Waqf Board properties during his tenure as chairman from 2018 to 2022.

Ongoing Investigations and Legal Proceedings

On October 18, the ED informed the Delhi High Court that its investigation into Khan under the Prevention of Money Laundering Act (PMLA) is based on multiple FIRs. The agency opposed Khan’s plea challenging his arrest, asserting that he misled the court by focusing on the outcome of one FIR while ignoring ongoing investigations tied to others. Evidence, including recorded statements, suggests Khan appointed individuals close to him and bypassed legal procedures for personal gain during his time as chairman of the Delhi Waqf Board.

Arrest and Extradition Process Underway

The arrest was confirmed on Friday, with UAE authorities notifying India’s Ministry of External Affairs about Chandrakar’s detention. Indian authorities are now finalizing the necessary documentation for Chandrakar’s extradition, which will soon be submitted to UAE officials.

Chandrakar was previously placed under “house detention” in Dubai in December 2022, prompting Indian agencies to closely monitor his movements. The extradition efforts are being managed through diplomatic channels to facilitate his return to India.

Key Figure in Money Laundering Case

Chandrakar is considered a prime suspect in a major money laundering investigation related to the Mahadev Online Betting app, a case that has connections to several political figures in Chhattisgarh and other regions.

The ED filed its initial charge sheet in a special Prevention of Money Laundering Act (PMLA) court in Raipur, naming Chandrakar, his uncle Dilip Chandrakar, and several others. Before moving to Dubai in 2019, Chandrakar ran a juice shop with his brother in Bhilai, Chhattisgarh.

The ED alleges that Chandrakar spent nearly Rs 200 crore on his wedding, which took place in Ras Al Khaimah, UAE, in February 2023. The extravagant event included private jets for guests and performances by Bollywood celebrities.

The ED estimates that the proceeds of crime related to the Mahadev app could amount to Rs 6,000 crore. Investigators revealed that the app operates from a central headquarters in the UAE, using a franchising model in which profits are shared with associates on a 70-30% basis.

Chandrakar’s arrest marks a significant development in the case, as authorities continue efforts to crack down on the illegal betting operations tied to the Mahadev app.

</excerpt>

Karnataka Health Minister Dinesh Gundu Rao criticized the Enforcement Directorate’s (ED) involvement in the alleged MUDA scam involving Chief Minister Siddaramaiah, arguing that no monetary transactions occurred in the case. He questioned the ED’s jurisdiction, stating, “What role does the ED have in the MUDA case, where no monetary transactions have occurred? The ED’s mandate is to investigate financial irregularities, yet in this case, no exchange of funds has taken place.”

Gundu Rao took to social media to express his views, accusing the Bharatiya Janata Party (BJP) and Janata Dal (Secular) of engaging in a political conspiracy against Siddaramaiah. “Two things are clear: BJP and JD(S) are trying to orchestrate a political conspiracy against Siddaramaiah. They are desperate to silence a leader who champions backward communities,” he asserted.

Warning Against Political Vendettas

The Health Minister warned that targeting Siddaramaiah could have severe consequences, emphasizing that political vendettas should not cross a line. “If Siddaramaiah is unjustly targeted, the consequences could be beyond anyone’s imagination. It is high time the BJP and Janata Dal (S) recognize that undermining Siddaramaiah’s political image not only targets a respected leader but also disrespects the communities he represents,” Rao added.

Siddaramaiah Defends Himself, Draws Distinction from Yeddyurappa’s Case

CM Siddaramaiah addressed the allegations against him, affirming that he would not resign and stating that his case differs from that of former Chief Minister BS Yeddyurappa. “BS Yeddyurappa’s case and mine are different. He did denotification of land, and I am not involved in it. I will not give my resignation as a self-witness. Whether ED or anything else, I will fight it out legally,” Siddaramaiah stated.

He further clarified that the land in question was gifted to his wife by her brother, and the Mysore Urban Development Authority (MUDA) had encroached on it. Siddaramaiah’s wife offered to surrender the 14 plots allotted to her, following allegations of irregularities.

The Mysuru Lokayukta initiated an inquiry into the MUDA land allotment scam, following a court order on September 27 to investigate allegations that 14 sites worth Rs 56 crore were illegally allotted to Siddaramaiah’s wife, Parvathi.

Meanwhile, Karnataka Law Minister HK Patil criticized the ED’s case under the Prevention of Money Laundering Act (PMLA) against Siddaramaiah, calling it “one of the greatest blunders” by the agency.

BJP’s Response to Site Return Complicating Situation

Former Karnataka Chief Minister and BJP MP Basavaraj Bommai stated that Siddaramaiah’s decision to return the MUDA site had complicated matters further. “By returning the site, they have made the issue more complicated,” Bommai said, arguing that the situation could have been resolved had an investigation been conducted through High Court judges earlier.

As investigations continue, the Karnataka government faces increasing scrutiny over the MUDA land allotment controversy, with political tensions rising between ruling and opposition parties.

</excerpt>

The Enforcement Directorate of (ED) has provisionally attached immovable properties valued at Rs. 834.03 crore belonging to EMAAR India and MGF Developments involving former chief minister Bhupinder Singh Hooda and the former Director of Directorate of Town and Country Planning Trilok Chand Gupta.

The attached properties, covering 401.65 acres spread in 20 villages across Gurugram district, Haryana, and Delhi. The case alleges that EMAAR-MGF in collusion with Hooda and Director DTCP Trilok Chand Gupta, acquired land at undervalued prices, resulting in significant losses to both the public and the government.

This move comes as part of an ongoing investigation into a money laundering case connected to the issuance of a license by the Department of Town and Country Planning (DTCP) in 2010 for a residential plotted colony in Sector 65 and 66 of Gurgaon.

The ED’s investigation was triggered by an FIR registered by the Central Bureau of Investigation (CBI) under various sections of the Indian Penal Code (IPC) and the Prevention of Corruption Act, 1988. Besides Hooda and Gupta, the FIR also named EMAAR MGF Land Limited and 14 other colonizer companies as accused.

The case revolves around allegations of cheating landowners and the state of Haryana by exploiting the Land Acquisition Act of 1894. The accused are alleged to have issued notifications under Sections 4 and 6 of the Act to compel landowners to sell their land at prices significantly lower than market rates. Following this, the companies allegedly obtained Letters of Intent (LOIs) and licenses fraudulently, causing substantial financial losses to landowners and the state while reaping wrongful gains.

The origins of this controversy date back to June 2, 2009, when the Congress led Haryana government under Bhupinder Singh Hooda had allegedly issued a notification under Section 4 of the Land Acquisition Act, 1894, affecting 1417.07 acres of land, which included sectors 58 to 63 and 65 to 67 of Gurugram. A subsequent notification under Section 6, issued on May 31, 2010, covered approximately 850.10 acres of this land. During the period between these notifications, nearly 600 acres were selectively released from acquisition proceedings, enabling the grant of LOIs and licenses to the accused companies, reveals the ED.

</excerpt>

The Rouse Avenue Court in Delhi has extended the judicial custody of Chief Minister Arvind Kejriwal until August 27, 2024, in connection with the Central Bureau of Investigation (CBI) probe into the Delhi excise policy case. Special Judge Kaveri Baweja scheduled the matter for further hearing on August 27, the same day the court will review the Enforcement Directorate’s (ED) supplementary chargesheet filed against Kejriwal and others.

Senior Advocate D.P. Singh represented the CBI in the hearing. Last week, the Supreme Court issued a notice to the CBI seeking its response by August 23 on Kejriwal’s bail plea and his challenge against the Delhi High Court’s order upholding his arrest in the corruption case.

A bench comprising Justices Surya Kant and Ujjal Bhuyan refused to grant interim bail to Kejriwal despite arguments from his counsel, Senior Advocate Abhishek Manu Singhvi, who cited health grounds. The bench stated, “We are not granting any interim bail. We issue notice.”

Singhvi argued that Kejriwal was granted interim bail on three occasions in the related money laundering case, despite the stringent provisions of Section 45 of the Prevention of Money Laundering Act (PMLA). He questioned why Kejriwal was being denied regular bail in the CBI case, which is governed by the less stringent Prevention of Corruption Act, terming Kejriwal’s arrest by the CBI as an “insurance arrest.”

The Supreme Court was hearing Kejriwal’s plea challenging his arrest and a separate bail plea. Earlier, on August 5, the Delhi High Court had upheld his arrest, deeming it “legal.” The court dismissed Kejriwal’s challenge against his arrest, stating that the CBI proceeded only after gathering sufficient evidence and obtaining the necessary sanctions in April 2024.

The High Court’s order highlighted concerns that Kejriwal could influence witnesses, noting that several witnesses came forward only after his arrest. It emphasized that Kejriwal, being a distinguished public figure and recipient of the Magsaysay Award, could potentially exert significant control and influence over witnesses.

Kejriwal was first arrested by the ED on March 21, 2024, as part of a money laundering investigation linked to alleged irregularities in the now-cancelled Delhi excise policy of 2021-22. Subsequently, on June 26, 2024, the CBI arrested Kejriwal while he was still in ED custody.

The court will now take up the matter on August 27.

A bench comprising Justices BR Gavai and KV Viswanathan requested responses from the CBI and ED concerning Kavitha’s plea against the July 1 High Court decision. Senior advocate Mukul Rohatgi, representing Kavitha, informed the court that she has been in jail for five months.

Recently, the Enforcement Directorate (ED) filed a supplementary charge sheet in Delhi’s Rouse Avenue Court related to the money laundering case linked to the alleged excise policy scam. The charge sheet names BRS leader K Kavitha and other accused, including Chanpreet Singh, Damodar, Prince Singh, and Arvind Kumar.

On May 6, the Rouse Avenue Court rejected bail petitions filed by K Kavitha in connection with both CBI and ED cases. Kavitha was arrested by the ED on March 15, 2024, and by the CBI on April 11, 2024.

The CBI investigation was initiated based on a report from the Delhi Chief Secretary filed in July, which indicated prima facie violations of the GNCTD Act 1991, the Transaction of Business Rules (ToBR)-1993, the Delhi Excise Act-2009, and the Delhi Excise Rules-2010. The ED and CBI have alleged that irregularities were committed during the modification of the excise policy, including granting undue favors to license holders, waiving or reducing license fees, and extending the L-1 license without proper approval.

A senior CBI official confirmed that the ED official has been arrested from the Lajpat Nagar area in Delhi.

CBI received a complaint and acting on the same, a trap was laid and the ED official was caught red-handed while accepting the bribe.

The searches, which took place earlier this week, were carried out at six locations in Leh, Jammu, and Sonipat (Haryana) as part of an investigation into a cryptocurrency scam.

The ED’s action is linked to a money laundering case involving one AR Mir and others. The case centers on allegations of defrauding individuals by falsely persuading them to invest in a fictitious cryptocurrency called ‘Emollient Coin,’ according to an ED post on X.

On August 2, the ED recovered various incriminating documents, property records, digital devices, and the cash during the search operations.

</excerpt>

Delhi’s Rouse Avenue Court on Thursday extended the judicial custody of Chief Minister Arvind Kejriwal till August 8 in the CBI case regarding the Delhi excise policy scam. This development follows the previous extension, which was set to end today.

Background and Timeline
Kejriwal has been in jail since March 21, facing charges of money laundering under the investigation of the Enforcement Directorate (ED). On May 10, the Supreme Court granted him interim bail for 21 days to campaign for the Lok Sabha elections, after which he returned to prison on June 2.

Court Proceedings
In the latest hearing, Special Judge Kaveri Baweja extended Kejriwal’s judicial custody. He appeared via video conferencing from Tihar Jail. The court directed the ED to provide Kejriwal’s counsel and other accused with copies of the supplementary charge sheet.

Supplementary Charge Sheets
On July 9, the court acknowledged the supplementary charge sheet against Kejriwal and AAP, as well as against Vinod Chauhan and Ashish Mathur. This is part of the seventh and eighth supplementary charge sheets in the money laundering case linked to the Delhi excise policy.

Arrests and Allegations
The ED arrested Kejriwal on March 21. Other individuals arrested in connection with this case include Manish Sisodia, BRS leader K Kavitha, Sanjay Singh, and various businessmen. The ED has alleged that Kejriwal demanded a bribe of Rs. 100 crores, which went to AAP for the Goa election campaign.

Evidence and Opposition to Bail
ASG SV Raju, opposing Kejriwal’s bail plea, cited evidence of Hawala transfers amounting to approximately Rs 45 crore. These transfers are corroborated by call records, data from a Hawala firm in Goa, and witness statements. The ED also presented proof of cash payments made to support the AAP campaign in Goa.

Stay updated with the latest developments in the Delhi excise policy scam case and Arvind Kejriwal’s judicial proceedings.

</excerpt>

Searches at seven locations in Punjab, Delhi, and Madhya Pradesh have resulted in the seizure of unaccounted cash amounting to Rs 78.15 lakh, the ED said while conducting raids in premises associated with liquor company Malbros International Pvt Ltd and its former Director Gautam Malhotra in a money laundering probe pertaining to environmental violations.

The raids made on July 16 also resulted in the recovery of digital devices and incriminating documents. These were carried out under the Prevention of Money Laundering Act, 2002.

The investigation was initiated following a criminal complaint by the Punjab Pollution Control Board to the Court of the Chief Judicial Magistrate, Ferozepur. It had charged Malbros International Pvt Ltd with violating different sections of the Water (Prevention and Control of Pollution) Act, 1974, by contaminating the soil and groundwater from its factory premises.

Preliminary investigations by the ED revealed that the company was draining industrial effluents into the illegally installed bore-wells in its premises, contaminating the soil and water, which posed a risk to the health of the public and caused the death of cattle in surrounding areas.

It has also found that money generated from these environmental crimes was being used for the business operations of the company. Tracing the money trail, part of the ongoing investigation, would be continued by the ED.

</excerpt>

Law enforcement agency ED (Enforcement Directorate) approached the Supreme Court against Hemant Soren’s bail, which was granted by Jharkhand HC.

As per the agency, this judgement was faulty and disputed the findings, that there was no prima facie evidence, that Hemant Soren was found guilty under PMLA act.

Earlier, the Jharkhand HC had given bail to chief minister and JMM leader Hemant Soren on June 28, after deciding that there is indeed a reason to believe that he isn’t guilty of money laundering in connection with the scam.

Moreover, the single-judge bench also ruled, that the claim of timely action taken by ED in preventing Soren and others from illegally acquiring the land is ‘vague’ since witnesses claimed that the land indeed had been taken by soren.

Additionally, the court also observed, that no registers or revenue records reflect soren’s direct involvement in either acquiring or possessing the land. And lastly, nobody upset individual came forward to voice its grievance against the matter, even though soren that time, was not in power in the state.

Overall, looking at these observations, the court granted bail to the JMM leader.

Meanwhile, soren left the post of CM on January 31 after his detention by ED in money laundering case. Later the close aide Champai soren became state’s CM.

But later, after acquiring bail, Hemant soren again became CM of the state on July 4.

As per sources, this raid aims to expose the evidence of money laundering and other financial irregularities in connection with the scam.

Currently, the officials are searching the premises for documents and records related to this multi-crore fraud.

This crackdown comes around the time, when just recently the haryana police has lodged an FIR against Haryana Shahri Vikas Pradhikaran (HSVP) and other accused related to this scam.

</excerpt>

In a major development related to Delhi’s excise policy case, Delhi HC dismissed the bail petition of BRS leader K Kavitha in cases registered by both CBI and ED on Monday.

This judgement was given today by Justice Swarana Kanta Sharma. Earlier, the court had reserved its order on May 28 after hearing both ED and K Kavitha.

As per Kavitha’s counsel’s submission, Kavitha owing to her gender needs to consider her bail plea as the law keeps woman on a different pedestal.

While both ED and CBI on the other hand were against her bail emphasizing, that she can potentially influence witnesses.

Also, responding on woman clause, the agencies also contended, that a woman is playing a crucial role in this conspiracy and being an active politician, she cannot be kept at a same pedestal with that of vulnerable woman.

Meanwhile, K Kavitha is one of the politicians who was arrested in Delhi excise policy case, as she was a member of ‘South Group’, who allegedly paid AAP kickbacks of Rs 100 crore in exchange for bigger share in liquor licences in Delhi.

</excerpt>

The Enforcement Directorate (ED) informed the Supreme Court on Wednesday that the trial court judge rushed through proceedings and failed to provide the prosecutor with an opportunity to oppose Delhi Chief Minister Arvind Kejriwal’s bail case connected to the alleged excise scam. The federal agency criticized the trial court’s June 20 order granting bail to Kejriwal, labeling it “perverse” due to non-compliance with the mandatory conditions under Section 45 of the Prevention of Money Laundering Act (PMLA).

A vacation bench comprising Justice Manoj Misra and Justice SVN Bhatti noted the ED’s affidavit, which was filed in response to Arvind Kejriwal’s bail case challenging the interim stay on his bail granted by the Delhi High Court on June 21.

In its affidavit, the ED highlighted that Section 45 of the PMLA mandates two conditions: the public prosecutor must be given an opportunity to oppose the bail, and if opposed, the court must be convinced that there are reasonable grounds to believe the accused is not guilty and will not commit any offense while on bail. The ED argued that the trial court judge hurried the process and did not allow the Additional Solicitor General sufficient time to oppose the bail.

Arvind Kejriwal was arrested by the ED on March 21 and received regular bail from the trial court on June 20. The trial court’s decision was based on initial investigations that did not establish Kejriwal’s guilt, and the ED’s failure to provide a direct link between Kejriwal and the alleged money trail. However, the Delhi High Court stayed the bail order on Tuesday, stating that the lower court did not “appropriately appreciate” the evidence presented by the ED.

The ED is now seeking to have the trial court’s June 20 order overturned, emphasizing the procedural lapses and the need for strict adherence to legal prerequisites in such significant cases.

</excerpt>

A Mumbai court has overturned an Enforcement Directorate (ED) order seeking to seize properties worth over Rs. 180 crore belonging to Praful Patel, a member of the Nationalist Congress Party (NCP) in the Rajya Sabha. The order, issued by an Appellate Tribunal under the Smugglers and Foreign Exchange Manipulators Act (SAFEMA), is a significant relief for Patel.

The properties in question are located on the 12th and 15th floors of Ceejay House in Worli, Mumbai, and are registered in the name of Patel’s wife and his company, Millennium Developer. The ED had alleged that these properties were acquired illegally from Hajra Memon, the widow and first wife of Iqbal Mirchi, a notorious drug mafia and associate of Dawood Ibrahim.

The tribunal ruled that the properties were not involved in money laundering and were not linked to Mirchi, thus rejecting the ED’s attachment order. It further clarified that since Memon’s property in Ceejay House had already been attached, there was no need for double attachment of Patel’s property.

The tribunal’s decision has sparked criticism from the opposition in Maharashtra, with Sanjay Raut of the Shiv Sena questioning the credibility of the ED. Raut accused the ED and the Central Bureau of Investigation (CBI) of being extensions of the BJP, suggesting political motives behind the actions against Patel.

Patel, a close aide of Ajit Pawar, had supported him during a political rift with Sharad Pawar in 2023, which led to the split of the NCP into two factions. Ajit Pawar later aligned with the BJP and Shiv Sena, becoming one of the Deputy Chief Ministers of Maharashtra.

The Rouse Avenue Court in Delhi has extended the judicial custody of Manish Sisodia, former Deputy Chief Minister and prominent AAP leader, until July 6. This decision comes in connection with the CBI case pertaining to the Excise Policy.

Sisodia, along with other accused individuals, remains in custody over allegations raised by the Central Bureau of Investigation (CBI) regarding irregularities in the Delhi liquor policy. Additionally, Sisodia faces charges in a money laundering case linked to the same alleged scam.

Both the CBI and the Enforcement Directorate (ED) have accused officials of modifying the Delhi excise policy with irregularities, granting unwarranted favors to license holders, and reducing or waiving license fees without proper approval from the competent authority. Furthermore, the agencies allege that the beneficiaries of these actions diverted “illegal” gains to the accused officials and falsified financial records to evade detection.

Manish Sisodia was arrested by the Central Bureau of Investigation (CBI) on February 26, 2023, for his purported involvement in the scandal. Subsequently, on February 28 of the same year, Sisodia resigned from his position in the Delhi cabinet.

Earlier, the agency registered its first charge sheet in the case before a special court.

What Happened In Sandeshkhali?

On January 5th, the team of the enforcement directorate was attacked by a mob consisting of 1000 people in SandeshKhali, when they came to raid Sheikh Shahjahan’s house in connection with a west Bengal’s multi-crore ration distribution scam.

Apparently, at that time, the ED officers had come to the riverine island to arrest the sheikh in connection with his links to the former state food minister Jyoti Priya Mallick, who herself was under the radar for the scam.

Later, this island, again came on the news, where local women made allegations of land grabbing and sexual abuse against sheikh and his henchmen.

After that, the investigation of these three incidents was transferred to CBI.

Subsequently, sheikh Shahjahan was arrested by west Bengal police after 55 days on February 29 and currently, he’s under CBI custody since March 6.

</excerpt>

Taking a significant turn in Delhi’s excise policy case, Delhi’s Rouse Avenue court has extended judicial custody of former Deputy CM Manish Sisodia till May 31st in a liquor policy case on Tuesday.

This development coincides with the scheduled delivery of an order by the Delhi High Court on the bail pleas of former Deputy CM Manish Sisodia, regarding the money laundering and corruption charges filed against him by both the CBI and the ED.

Later both ED and CBI opposed Sisodia’s plea saying, there was a conspiracy to delay the charges framing process in this case.

However, the Sisodia’s council alleged, that the investigative agencies are still arresting people in money laundering and corruption cases, even though there is no question of early conclusion.

Manish Sisodia has been in judicial custody since February 26, 2023, after he got arrested by CBI. Subsequently, the former deputy CM was later arrested by ED.

According to the investigative agency, alleged irregularities were found in the modified excise policy. As a result, undue extensions were granted to license holders.

Further, the agency also alleged, the license fee was waived or reduced to favor the holders. Followed by the L-1 extension without the competent authority’s approval.

Later, the beneficiaries also managed to divert these illegal gains to accused involved and made false entries in book accounts to evade detection.

As per the reports, she passed away at around 3 am at Mumbai’s residence, and over the past few months, her health continued to decline as she was battling with third-stage cancer.

Her funeral will take place in the latter part of Thursday. She is survived by her husband Naresh Goyal and her two children- Namrata and Nivaan Goyal.

As for the career front, she was part of the company’s operations as executive vice president. However, in 2015, she became non-executive vice-president, but she continued to remain part of the board of directors.

Meanwhile, Naresh Goyal, the 75-year-old founder of Jet Airways who has been battling cancer and other health issues, was granted interim bail by the Bombay High Court to be with his ailing wife.

Previously, his lawyer, Harish Salve, had appealed to the high court on humanitarian grounds, emphasizing the businessman’s frail health and his wife’s illness.

Salve also revealed that the Jet airways founder had chosen chemotherapy over other invasive surgery to support his wife during her treatment.

Why Did Naresh Goyal Go To Jail?

On 1st September 2023, Jet airways owner Naresh Goyal was arrested in connection to money-laundering.

The Enforcement Directorate (ED) made an accusation on Goyal for borrowing money from a consortium of 10 banks to manage his daily expenses, even though he owes Rs 6,000 crore to these banks.

According to the Enforcement Directorate, approximately ₹1,152 crore was diverted under the guise of consultancy and professional fees. Additionally, ₹2,547.83 crore was allocated to the sister company, Jet Lite Limited, for the clearance of its loan.

Recently in February 2024, his request for interim bail on medical grounds was denied.
