</excerpt>

The Delhi High Court on Monday allowed jailed gangster Neeraj Bawania custody parole for one day. He will visit his ailing wife in the ICU and sign the necessary documents for her surgery.

Custody Parole Set for July 1

Justice Manoj Jain granted the parole for July 1, from 10 AM to 4 PM. Bawania’s wife is admitted to Mehta Hospital’s ICU in Delhi’s Pandav Nagar. The court ruled that he can meet only his wife and her doctor—no one else.

Court Weighed Security Concerns

While granting parole, the court considered the prosecution’s concerns. Authorities fear the risk of gang violence if Bawania is out. The Additional Public Prosecutor, Laksh Khanna, told the court that “he is a high-risk prisoner” and “may pose a danger to society or himself.” He also mentioned Bawania is a flight risk.

Defense Pushes for Bail, Then Agrees to Parole

Initially, Bawania had requested interim bail for six weeks to care for his wife. His lawyer, senior advocate N Hariharan, stated that no one else is available to take care of her or to sign for the surgery. Later, he agreed to seek just one-day custody parole.

Hariharan told the court, “Surgery is imminent,” and explained that Bawania’s wife has been in the ICU since the previous night. He also said Bawania had been in jail for 10 years, and the trial has faced delays.

Court Had Earlier Denied Bail

Earlier this year, the Delhi High Court rejected Bawania’s regular bail plea. The APP pointed out that the delay in trial had already been discussed in that order. He also noted Bawania’s criminal history—he is named in 28 cases.

Background of the Case

Neeraj Sehrawat, also known as Bawania, has been in custody since 2015. He faces charges in a case involving the murder of a rival gang member inside a jail van. The court acknowledged the severity of his past but made an exception due to his wife’s critical condition.

The ruling also highlighted the Supreme Court’s 2018 judgment striking down Section 497 of the IPC, which treated women as property.
</excerpt>

In a historic ruling, the Delhi High Court acquitted an adulterous man, bringing in the comparison with the Mahabharata to highlight the risks of thinking of women as property.

While citing the Mahabharata, specifically when Yudhishthira lost Draupadi at gamble, which set off the decimating war, Justice Nina Bansal Krishna spoke of this as an instance of the deep-rooted misogyny prevalent in society, highlighting the lessons learned through such ancient classics.

The case arose from a complaint in 2010 by a husband who charged the man with having an affair with his wife. The husband alleged that his wife would come to the park in the pretext of exercise and charged that she had sex with the accused in a Lucknow hotel, as a married couple without his permission.

Delhi HC Cites Reference from Mahabharat

Justice Krishna’s decision invoked the Mahabharata’s portrayal of the aftermath of treating women as commodities. She noted that Draupadi’s shame being auctioned off by her husband while her brothers did nothing resulted in calamitous outcomes, eventually leading to a devastating war.

The acquitted man had appealed a 2018 lower court decision requiring him to stand trial. In his petition, he argued that the lower court based its decision on the accusations of the husband alone, ignoring documentary evidence for his defense.

Justice Krishna’s ruling is also a sign of a wider social change, pointing to the importance of the Supreme Court’s 2018 judgment in Joseph Shine vs Union of India, in which Section 497 of the IPC was ruled unconstitutional. Section 497 used to criminalise only men for adultery, promoting the idea of husbands as masters of women, something that was rejected by the court.

</excerpt>

While noting the “unwarranted delay” of the Aam Aadmi Party (AAP) government in submitting the papers, the Delhi High Court on Friday turned down a request for a special session of the state assembly to table 14 Comptroller and Auditor General (CAG) reports.

Seven BJP MLAs had applied to the court requesting it to compel Speaker Ram Niwas Goel to call a special assembly session prior to the next Delhi polls—specifically to submit the reports.

The bench of Justice Sachin Datta stressed that it is a constitutional mandate to produce CAG reports. It also observed the excessive delay of the speaker’s reports going.

The judge said, “The court is not inclined to approve the request for a special session for laying the reports.”

The BJP has expressed worry about the postponement of report submission, which covers matters including Delhi’s liquor policy, vehicular pollution, and public health. Particularly with the February 5 Delhi elections approaching, the issue has become a major bone of discord between AAP and BJP.

Regarding the excise policy and expenditure incurred in promoting government programs, the BJP has slammed the AAP administration for deliberate lapses. The AAP has rejected these allegations as “manufactured” and called the BJP’s court petition “politically motivated.”

In court Delhi government argued that presenting the documents before the assembly’s tenure ends would be unfeasible, since the need was politically motivated, not a necessity. Representing the Delhi government, senior counsel Rahul Mehra argued, “Nothing major is going to happen if reports are not placed within 10-15 days. Political impetus, not a requirement, is driving the urgency.”

Meanwhile, BJP’s Senior Advocate Mahesh Jethmalani slammed the Delhi government for delaying the process to avoid examination before the elections and stressed that the findings should be released to assist voters in making educated decisions. Further delaying the process until December 24 last year, the BJP MLAs also observed that the government had not delivered on its pledge to quickly transfer the reports.

</excerpt>

The Delhi High Court has dismissed a petition seeking to annul the registration of the All India Majlis-e-Ittehadul Muslimeen (AIMIM) as a political party. The court upheld the Election Commission of India’s (ECI) decision to register AIMIM, rejecting claims that it violated legal and constitutional principles.

Petitioner’s Claims Against AIMIM’s Registration

The petitioner, Tirupathi Narshima Murari, challenged AIMIM’s registration on the grounds that the party’s constitution primarily seeks to promote the interests of a single religious community, Muslims. This, the petitioner argued, contravenes Section 29A of the Representation of the People Act, 1951, which mandates adherence to secular principles for political parties.

Murari claimed that AIMIM’s objectives violated the secular fabric of the Constitution and should disqualify it from being recognized as a political entity under Indian law.

Court’s Observations and Rationale

The court clarified that the requirements for a party’s registration under Section 29A of the Representation of the People Act, 1951, do not align with the petitioner’s interpretation. It noted that the alleged contraventions cited by the petitioner pertain more to the conduct during elections rather than the foundational principles of party registration.

The court also addressed the petitioner’s reference to Section 123 of the Act, which defines “corrupt practices” in the electoral process, including the disqualification of candidates. It ruled that these provisions are relevant only to election outcomes and disputes, not to the registration of political parties.

The bench emphasized that the issues of “corrupt practices” and disqualification under Section 8A of the Act are separate from the registration criteria laid down in Section 29A.

Based on these findings, the court dismissed the petition, concluding that the petitioner failed to substantiate his claims of non-compliance with legal requirements. The judgment reaffirmed the legality of AIMIM’s registration and rejected allegations of its violation of constitutional principles.

This decision marks another judicial validation of AIMIM’s status as a recognized political party in India.

</excerpt>

The Delhi High Court has ordered the cancellation of the Look Out Circular (LOC) issued against former BharatPe Managing Director Ashneer Grover and his wife, Madhuri Jain Grover, following the quashing of an FIR by the Economic Offences Wing (EOW) of the Delhi Police. Justice Sanjeev Narula issued the directive on Monday after being informed that a coordinate bench had quashed the FIR the previous day.

The petition to quash the FIR was filed by Ashneer Grover and others on the basis of a recent settlement agreement with BharatPe, the fintech company that lodged the initial complaint. The court noted, “Although the copy of the order is not available as of now, this fact has not been disputed by the counsel for the parties involved.”

The court further remarked, “Given the quashing of the underlying FIR, the LOC issued by Respondent No. 3, in the view of the Court, cannot remain in force. Accordingly, the petitions are disposed of with a direction for the Respondents to cancel the LOC against the Petitioners in their records.”

Background of the FIR and Allegations

The LOC was issued by the Bureau of Immigration at the request of Delhi Police’s EOW. The FIR, which was registered under Sections 406 (criminal breach of trust), 408 (criminal breach of trust by clerk or servant), 409 (criminal breach of trust by public servant, banker, merchant, or agent), 420 (cheating and dishonestly inducing delivery of property), 467 (forgery of valuable security), 468 (forgery for the purpose of cheating), 471 (using as genuine a forged document), and 120B (criminal conspiracy) of the Indian Penal Code, was filed following a complaint from BharatPe.

The fintech firm had accused Ashneer Grover, Madhuri Jain Grover, and others, including Deepak Jagdishram Gupta, Shwetank Jain, and Suresh Jain, of misappropriating company funds, causing a loss of approximately ₹80 crore. BharatPe alleged financial irregularities and mismanagement of company assets as part of the charges.

Settlement Agreement and Quashing of FIR

The counsel representing the Grovers and other accused informed the court that a settlement agreement had been reached with BharatPe on September 30. Following this agreement, the parties requested the quashing of the FIR, leading to its dismissal by the High Court.

The settlement marks the conclusion of a high-profile legal battle between Ashneer Grover and BharatPe, which had seen both sides level serious accusations against each other over financial misconduct and corporate governance failures.

The quashing of the FIR and subsequent cancellation of the LOC effectively clear the path for Ashneer Grover and his wife to travel freely without restrictions imposed by the ongoing legal proceedings. The development is seen as a significant step towards resolving the long-standing dispute between the former BharatPe executive and the company.

This decision comes after months of legal wrangling, during which the Grovers faced intense scrutiny over their alleged financial activities, impacting their professional standing in the fintech industry. With the case now settled, the focus is expected to shift back to corporate governance reforms at BharatPe and its efforts to move beyond the controversy.

</excerpt>

The Delhi High Court on Thursday issued a notice to the Central government and three private entities in response to a plea seeking the creation of norms to regulate the resale of concert tickets and block illegal ticket-selling websites. The petition comes in light of recent concerts by artists like Coldplay and Diljit Dosanjh, which saw inflated resale prices.

A division bench led by Chief Justice Manmohan sought responses from the Union ministries of Information and Broadcasting, and Electronics and Information Technology, tagging the matter with an ongoing Public Interest Litigation (PIL) against ticket scalping. The case is scheduled for a hearing on February 18, 2025.

Allegations Against Ticket Resellers

The plea highlights that resellers have violated the Consumer Protection Rules, 2020, by failing to verify tickets or secure undertakings from sellers, allowing the sale of invalid tickets. Resellers also lack an effective grievance redressal mechanism, leaving buyers vulnerable if tickets are not delivered or are fraudulent. The petition notes that resellers benefit by charging a €25 administrative fee from sellers, even if the issue remains unresolved, with no compensation for buyers.

The petition references Section 112 of the Bharatiya Nagarik Sanhita (BNS), 2023, which aims to curb black-marketing and unauthorized ticket sales. This provision introduces stringent penalties, including imprisonment up to seven years, to deter the practice of reselling tickets without the authorization of official platforms or organizers.

Court’s Concerns Over Black Market and Lost Revenue

The petition argues that ticket scalping contributes to a black market for counterfeit tickets, defrauding consumers and depriving the government of tax revenue. The petitioner calls for a comprehensive legal framework, enforcement mechanisms, and technological solutions to ensure fair ticketing practices, consumer protection, and the formal integration of ticket sales revenue into the economy.

On October 9, the Delhi High Court sought responses from authorities regarding the harmful effects of ticket scalping, a practice that involves reselling event tickets at inflated prices for profit.

</excerpt>

Former Wrestling Federation of India Chief Brij Bhushan Sharan Singh has approached the Delhi High Court, requesting an early hearing on his plea to dismiss sexual harassment proceedings initiated by female wrestlers. The court is set to hear his application on October 18, 2024.The Delhi High Court recently issued notices to the state and police regarding Singh’s plea, with the next scheduled hearing set for January 13, 2025. Singh, a former MP, is actively contesting the allegations against him.

Singh’s Justification for Urgent Hearing

In his latest application, Singh noted that the prosecution evidence in the trial court is progressing weekly, and he believes that evidence may be completed by January. He emphasized the urgency of addressing his plea for dismissal, citing the need for a timely resolution given the trial’s current pace.

The fresh application was filed on behalf of Singh by Advocate Rajiv Mohan, with assistance from Advocates Rehan Khan and Rishabh Bhati. Singh’s petition seeks to challenge the ongoing trial court proceedings stemming from the FIR filed by several women wrestlers, aiming to quash the FIR, chargesheet, and the trial court’s order related to the framing of charges against him.

</excerpt>

The Delhi High Court has requested reports from Kalkaji Temple Mahant Surendra Nath and the Delhi Police following the death of a 17-year-old boy who was electrocuted by an uncovered wire during the Navratri event at the temple. Justice Prathiba M. Singh, who is presiding over the case, expressed concern over the recurring nature of such incidents, noting that a similar tragedy occurred last year.

Mahant and Police Ordered to Submit Reports

Justice Singh has directed Mahant Surendra Nath to submit a detailed report on the measures taken to manage the Navratri event and ensure crowd safety. Additionally, the Delhi Police has been asked to provide a status report on the circumstances leading to the teenager’s death.

The court expressed concern over the fact that there is currently no administrator overseeing the temple, despite redevelopment work being underway. It was noted that the court-appointed administrator had not been paid remuneration, and no replacement had been made. The Mahant, acting as the baridar (traditional custodian), has now been tasked with reporting on the crowd management efforts.

The High Court also directed the standing counsel to file a status report ahead of a hearing scheduled for Monday. The court emphasized the need for proper event management at the temple, citing repeated incidents that have occurred in recent years.

</excerpt>

The Delhi High Court has rejected a petition opposing the installation of a statue of Rani Lakshmi Bai in Shahi Idgah Park, located in the Sadar Bazar area. Justice Dharmesh Sharma dismissed the plea filed by the Shahi Idgah Managing Committee, stating that the committee’s claims lacked a legal basis.

Court’s Ruling on Legal Rights and Jurisdiction

In its ruling, the court asserted that the petitioners had no legal or fundamental right to obstruct the installation of the statue, which is being undertaken by the Municipal Corporation of Delhi (MCD). Justice Sharma remarked, “This Court does not see as to how their right to offer prayers or perform any religious rites is being endangered in any manner.”

The court also criticized the status quo order issued by the Delhi Minority Commission, labeling it as lacking jurisdiction. It further clarified that the parks and open grounds surrounding the Shahi Idgah are under the jurisdiction of the Delhi Development Authority (DDA), which is responsible for their maintenance and management.

The petition, filed by Haji Shakir Dost Mohammad, President of the Shahi Idgah Managing Committee, sought to prevent any encroachment on Waqf property, including Idgah Park, and to stop the installation of the statue. The committee expressed concern that the installation would occur on Waqf property and called for the statue to be relocated to an alternative site identified by the DDA.

Background of the Dispute

The court noted that the committee had raised objections after discovering excavation work being conducted at the site, purportedly to install the statue. The petitioners argued that such actions would not only encroach on Waqf property but could also lead to public unrest.

In its judgment, the court highlighted that the surrounding parks are DDA property, intended for recreational use by the public, and reiterated that the DWB does not have authority over the park for purposes beyond religious activities. Ultimately, the court emphasized that it cannot interfere with the MCD’s administrative decisions regarding the statue’s relocation, despite concerns about potential law-and-order issues.

</excerpt>

The Delhi High Court has issued a series of directives to ensure equitable access to education for students from the Economically Weaker Section (EWS) and Disadvantaged Group (DG) quotas in Delhi’s private schools. The Court clearly stated that “we must not allow children or their families from disadvantaged groups to accept inequalities in education as their social or natural fate.

Justice Swarana Kanta Sharma, while hearing a batch of petitions related to EWS/DG admissions, directed schools to appoint a dedicated nodal officer to oversee the admission process for students under these categories. The court also mandated that all circulars and instructions regarding admissions be made available in both English and Hindi. Additionally, schools are required to provide a clear schedule specifying the date and time each student must report for admission.

The court highlighted challenges faced by students transitioning between the Junior and Senior Wings of the same school, often due to separate School IDs. Justice Sharma noted that such administrative hurdles and potential financial difficulties or lack of parental awareness can prevent families from pursuing legal remedies. The court stressed that these barriers are detrimental to children’s educational progress.

The judgment reaffirmed that the Right to Education (RTE) Act is designed to ensure that access to private education is not exclusive to affluent families. The court emphasized that all children, including those from the EWS/DG categories, deserve equal treatment and respect, and schools must ensure that these students do not feel less valued than their more privileged peers.

The court further stated that discrimination against children or parents seeking admission under the EWS/DG categories can have serious negative effects, undermining both the student’s sense of belonging and their self-esteem. Such inequality, whether deliberate or systemic, contradicts the principles of fairness and equal opportunity enshrined in the RTE Act.

“The foundation of a country is laid through the education provided to its children, as the strength of our nation’s future depends on the quality of education we offer today,” the court observed, adding that the RTE Act embodies a vision of securing a strong foundation for the nation’s future.

The court concluded by urging all stakeholders to work towards seamless integration of EWS and non-EWS students, ensuring an inclusive environment in schools that aligns with the spirit of the RTE Act.

</excerpt>

The Delhi High Court has issued a significant ruling, restricting the unauthorized use of content from the popular TV show ‘Taarak Mehta Ka Ooltah Chashmah’. This move comes as a relief to the show’s producers, Neela Film Productions Private Limited, who had raised concerns over the misuse of their intellectual property.

Court’s Injunction Order

Justice Mini Pushkarna of the Delhi High Court passed an ex parte ad interim injunction on August 14, 2024, aimed at protecting the intellectual property rights of the long-running sitcom. The court’s order specifically restrains various YouTube channels, websites, and social media platforms from infringing on or copying any trademark, title, character, or other intellectual property related to the show. This includes platforms illegally selling merchandise, copying characters, and creating AI images, deepfakes, and animated videos without authorization.

In her ruling, Justice Pushkarna emphasized that if the injunction were not granted, the plaintiff would suffer irreparable harm. The court’s order applies to both known and unknown defendants, including John Doe parties, who are involved in the unauthorized use of the show’s content.

Protecting Intellectual Property Rights

Neela Film Productions Private Limited, the creators of ‘Taarak Mehta Ka Ooltah Chashmah’, approached the Delhi High Court to protect their intellectual property. The producers argued that they hold exclusive rights to the show’s title, format, characters, characterizations, mannerisms, dialogues, and other intellectual property elements.

The popular sitcom has been a staple of Indian television for over 16 years, with nearly 4,000 episodes aired. Despite its success, the show has faced challenges from entities misusing its name, character images, and other content for commercial gain. The producers highlighted instances where unauthorized parties were running websites, selling merchandise, and even publishing “sexually explicit and vulgar” videos on YouTube using the show’s content.

Implications of the Court’s Order

The Delhi High Court’s ruling serves as a crucial step in safeguarding the intellectual property rights of content creators in India. The order covers a wide range of platforms and activities, ensuring that ‘Taarak Mehta Ka Ooltah Chashmah’ remains protected from unauthorized exploitation. By restraining the defendants from hosting, streaming, broadcasting, or selling any content that infringes on the show’s intellectual property, the court has set a precedent for the protection of creative works in the digital age.

This ruling is expected to have a significant impact on the unauthorized use of content from popular TV shows and other creative works, sending a strong message to those who attempt to profit from the hard work of content creators without proper authorization.

</excerpt>

Delhi High Court asked the Centre to clarify its stance on a Public Interest Litigation (PIL) which says that the new criminal laws Bharatiya Nyaya Sanhita (BNS) lacks a provision equivalent to Section 377 of the Indian Penal Code (IPC) on Tuesday.

Section 377 had previously criminalized “sodomy” and “unnatural sex,” but was partially decriminalized by the Supreme Court in 2018, stated the plea.

A bench comprising Acting Chief Justice Manmohan and Justice Tushar Rao Gedela has granted the Union of India’s counsel, Anurag Ahluwalia, ten days to take instructions on the matter, with the next hearing scheduled for August 27, 2024. During the hearing, the court questioned whether the BNS addresses non-consensual acts previously covered under Section 377 and whether the omission indicates that such acts are no longer considered offenses.

The PIL expresses concern that the absence of such provisions in the BNS could create a legal gap, removing protections against non-consensual sexual acts and negatively impacting vulnerable communities. The petitioner seeks a directive to temporarily reinstate protections against non-consensual sexual acts as under Section 377 IPC and calls for a declaration that the repeal of Section 377 without equivalent provisions in the BNS is unconstitutional.

The petition argues that this legislative omission violates fundamental rights under Articles 14, 19, and 21 of the Constitution and could harm individuals and communities irreparably. The Centre’s counsel emphasized that the issue has been escalated and requires careful consideration.

</excerpt>

The Delhi High Court on Monday granted interim relief to suspended IAS officer Puja Khedkar, barring her immediate arrest in connection with an anticipatory bail plea. The court issued notices to the Delhi Police and the Union Public Service Commission (UPSC) after Khedkar challenged a district court’s decision denying her bail. The FIR alleges that Khedkar falsified her identity to gain extra attempts in the civil services examination.

Justice Subramonium Prasad, after reviewing the submissions, directed the investigating agency not to arrest Khedkar while the case is under consideration, with a detailed hearing scheduled for August 21. The High Court noted that the trial court’s order lacked substantial discussion and merely referenced the Public Prosecutor’s claims about others’ involvement. As a result, the court instructed the police not to arrest Khedkar until Friday, pending further proceedings.

During the hearing, the UPSC argued that Khedkar was the “mastermind” behind the alleged scheme, asserting that custodial interrogation is necessary. Khedkar’s plea in the Delhi High Court follows the Patiala House Court’s recent denial of her bail request, citing the seriousness of the allegations against her, which include falsifying identity for additional civil services exam attempts.

The trial court judge, Additional Sessions Judge Devender Kumar Jangala, emphasized the need for custodial interrogation to uncover the full extent of the conspiracy and others’ involvement. The judge ruled that this case was not suitable for granting anticipatory bail.

Khedkar faces charges under Sections 420, 468, 471, 120B IPC, 66D of the IT Act, and Sections 89/91 of the Rights of Persons with Disabilities Act, 2016. She is accused of cheating the complainant (UPSC) by misrepresentation, preparing documents to support her claims, and allegedly executing a premeditated conspiracy over several years. The court noted that the accused could not have carried out the conspiracy without assistance.

The court also highlighted the scrutiny of Khedkar’s OBC (non-creamy layer) status and her classification as a person with multiple benchmark disabilities. It emphasized the need for the UPSC, as a Constitutional body conducting exams for prestigious posts, to maintain transparency and fairness in its procedures. The case may represent just the “tip of the iceberg,” potentially indicating broader exploitation of the system.

The court directed the investigating agency to expand its inquiry to include recent candidates who may have similarly exploited the system and to determine whether any UPSC insiders were involved in aiding Khedkar’s illegal actions.

Recently, the Delhi High Court granted Puja Khedkar the liberty to challenge the cancellation of her candidature in the appropriate forum, with the UPSC promising to provide her with the cancellation order within two days.

</excerpt>

The Delhi High Court on Friday fixed August 12 for hearing on former IAS officer Puja Khedkar’s plea challenging a district court’s decision denying her anticipatory bail.

The FIR against her alleges that she faked her identity to gain more attempts than permitted in the civil services examination.

Puja Khedkar’s anticipatory bail hearing has been rescheduled to Monday, as the bench of Justice Subramonium Prasad did not assemble on Friday.

Khedkar’s plea in Delhi High Court follows the dismissal of her plea by Delhi’s Patiala House Court last week, which found the allegations against her–related to falsifying identity for extra attempts in the civil services examination–to be serious and in need of thorough investigation.

The trial court Judge said custodial interrogation of the accused is required to unearth the whole conspiracy and to establish involvement of the other persons involved in conspiracy.

In the present facts and circumstances, said Additional Sessions Judge Devender Kumar Jangala, he was of the considered opinion that it is not a fit case to exercise discretionary powers of anticipatory bail in favour of the accused, The Court noted that in the present case, the applicant/accused has been charged for the commission of offence punishable under Section 420/468/471/120B IPC and 66D IT Act and 89/91 Rights of Persons with Disability Act, 2016. The applicant/accused has cheated the complainant by misrepresentation.

The complainant/UPSC in order to attain the misrepresentation, has prepared various documents to support her claim. The conspiracy has been hatched in a pre-planned manner. The conspiracy was executed by the applicant/accused over many years, said the court.

The applicant/accused alone could not have executed the conspiracy without the assistance of some outsider or insider. It is also contended by lawyer for Delhi Police that the OBC (non-creamy layer) status and person with multiple benchmark disability is also under scrutiny and investigation, noted the Court.

The court further said that the complainant/UPSC, being a constitutional body, is conducting the exams for the prestigious posts to which aspirants from the whole country are applying. Therefore, the complainant is required to maintain the highest degree of transparency and fairness in its standard operating procedure. It is also an admitted case of the complainant that its standard operating procedure(SOP) has been breached by the applicant/accused, therefore, the complainant should introspect because its scrutiny system has fails to curb the breach. The present case may be only tip of the iceberg because if the applicant/accused can breach the scrutiny system of the complainant, why not others.

Therefore, in order to maintain reputation, fairness, sanctity and faith of aspirants and general public, there is need on the part of the complainant to strengthen its SOP to ensure that such an event does not occur in future. The complainant also needs to relook its recommendations made in the recent past to find out the candidates (a) who have illegally availed the attempts beyond permissible limits; (b) who have obtained the OBC (non-creamy layer) benefit despite not being entitled; (c) who had obtained the benefits of persons with benchmark disability, despite being not entitled, said the court.

The Delhi High Court on Wednesday granted former probationary IAS officer Puja Khedkar the liberty to approach the appropriate forum to challenge the cancellation of her candidature by the Union Public Service Commission (UPSC). The UPSC has informed the Court that it will provide Khedkar with the official order canceling her candidature within two days.

Justice Jyoti Singh’s bench disposed of Khedkar’s plea, clarifying that it has not examined or expressed any opinion on the merits of the case. The court also stated that the filing of the petition will not impact the adjudication of the issue by the appropriate forum.

Advocate Indira Jaising, representing Khedkar, referenced a UPSC press release about the cancellation and highlighted Khedkar’s specific requests: the formal delivery of the cancellation order and the quashing of the press release. Naresh Kaushik, representing the UPSC, explained that the press release was issued because Khedkar’s whereabouts were unknown, serving as formal intimation regarding the cancellation.

Khedkar moved the Delhi High Court on Monday, challenging the UPSC’s decision to cancel her candidature. On July 31, the UPSC announced via a press statement that it had decided to cancel Khedkar’s provisional candidature due to accusations of cheating and forgery, which violated the CSE-2022 rules. Khedkar was also debarred from all future exams and selections by the UPSC.

The UPSC stated that Khedkar was given until 3:30 PM on July 30, 2024, to respond to a Show Cause Notice. Despite this final extension, Khedkar failed to submit her explanation within the prescribed time. Consequently, the UPSC cancelled her provisional candidature for the CSE-2022 and permanently debarred her from all future UPSC examinations and selections.

The students were reported to have been trapped in the basement when it flooded and subsequently died. The decision of the court to transfer the probe into the incident and its circumstances to the CBI is for ensuring a thorough probe. The measure reflects the seriousness of the situation and calls for an in-depth look at the coaching centre’s safety measures and emergency response system.

</excerpt>

The Delhi High Court dismissed Bibhav Kumar’s plea challenging his arrest by the Delhi Police in connection with the assault case involving Rajya Sabha MP Swati Maliwal. The decision was made by Justice Neena Bansal Krishna on Friday.

Kumar, a close aide to Delhi Chief Minister Arvind Kejriwal, argued that his arrest was illegal as it was made without a prior notice under Section 41A of the Criminal Procedure Code, which mandates that the police issue a notice to the accused before making an arrest. Kumar’s legal team contended that there was no urgency justifying his arrest, especially since he had indicated his willingness to cooperate with the investigation.

Senior advocate N. Hariharan, representing Kumar, claimed that the FIR was filed with a three-day delay, and that Kumar had been picked up without proper legal procedure. He argued that the arrest was made hastily, despite Kumar’s readiness to cooperate.

In response, Senior Advocate Sanjay Jain, representing the Delhi Police, argued that the arrest was justified based on evidence indicating tampering with evidence. Jain explained that Kumar’s phone was formatted and certain video recordings were missing, which led to the decision to arrest him.

The Delhi Police had arrested Kumar on May 18, following an FIR in the Swati Maliwal assault case. Kumar’s plea also sought compensation for the alleged illegal arrest and called for departmental action against the officials involved in the arrest decision. The High Court, however, upheld the legality of the arrest.

</excerpt>

The Delhi High Court on Tuesday dismissed a Public Interest Litigation (PIL) that sought action against Dalai Lama, the spiritual leader of the Tibetan people, under the Protection of Children from Sexual Offences (POCSO) Act. The PIL was filed in response to a viral video from April 2023 showing Dalai Lama kissing a child on the lips.

The plea, brought by a confederation of NGOs and Jeroninio Almeida, raised concerns about the impact of the incident on the child’s well-being and called for guidelines to protect children during spiritual gatherings. It described the incident as a violation under the POCSO Act and criticized the reactions from the Tibetan community, which cited cultural practices.

In response, the bench of Justice Manmohan and Justice Tushar Rao Gedela noted that the incident had occurred one and a half years ago in public view and that Dalai Lama had issued a public apology on April 10, 2023. The court emphasized that Dalai Lama’s apology addressed the issue, and thus dismissed the PIL.

The plea highlighted broader societal indifference towards child protection and urged stricter enforcement of laws safeguarding children from sexual offences. It underscored the need for responsible behavior towards children by spiritual leaders and other figures in authority.

Dalai Lama’s apology acknowledged the controversy surrounding the incident, which sparked global debate and criticism. Despite the dismissal of the PIL, the case has drawn attention to the intersection of cultural practices, child protection, and legal accountability in spiritual contexts.

This judgement was given today by Justice Swarana Kanta Sharma. Earlier, the court had reserved its order on May 28 after hearing both ED and K Kavitha.

As per Kavitha’s counsel’s submission, Kavitha owing to her gender needs to consider her bail plea as the law keeps woman on a different pedestal.

While both ED and CBI on the other hand were against her bail emphasizing, that she can potentially influence witnesses.

Also, responding on woman clause, the agencies also contended, that a woman is playing a crucial role in this conspiracy and being an active politician, she cannot be kept at a same pedestal with that of vulnerable woman.

Meanwhile, K Kavitha is one of the politicians who was arrested in Delhi excise policy case, as she was a member of ‘South Group’, who allegedly paid AAP kickbacks of Rs 100 crore in exchange for bigger share in liquor licences in Delhi.

</excerpt>

The Delhi High Court on Wednesday ordered the Central government to decide within six weeks on the Aam Aadmi Party’s representation seeking temporary office space in the national capital. The High Court said that the party is entitled to use the housing unit from the general pool for its party office till a permanent allotment of land for the construction of its office. As per an agreement made in the Supreme Court, the party must vacate its current office by June 15.

Justice Subramonium Prasad stated that the party cannot assert a right to use one of its ministers’ accommodations on DDU Marg as a temporary office. The High Court has directed the Central Government to make a decision on the party’s request within six weeks and provide a rationale for its decision. A comprehensive order will be made available online.

On May 27, the High Court concluded its deliberations on a petition from the Aam Aadmi Party (AAP). Nevertheless, the Court emphasized that rejection cannot be based solely on the grounds of unavailability.

Earlier, Kirtimaan Singh, Counsel for Central Government, submitted that the Central Government doesn’t have any land vacant at DDU Marg.
Central Government counsel had also submitted that in 2024, the party was allotted land in Saket and they didn’t accept it. Before 2023 when it became a national party, the Party never asked for land in Central Delhi.

In June 2023, they (AAP) said that there is some land available on DDU Marg. In 2023 We offered them land for permanent allotment. After inspection, we find there is no land available at DDU Marg, Central Government counsel said. In 2024 we offer them two plots in Saket, he added.

Court had said that Their (AAP) arguments you (Centre) are not treating them at par with others. You are throwing them to a distant place.

Senior advocate Sudhir Nandrajog suggested that two plots that have the AAP Minister can be given to the party for their office.

The Court had asked, ” Can they use the plot for their office?”
The plots were not allotted to them. They occupied them. They are in possession, Kirtimaan Singh said. First, they will have to hand over them and they will consider it. They had an office in Kaushambi, he added.

Senior advocate Nandrajog said that It is a strong attempt to misguide the court.
“Is there a waiting list of national political parties,” the court asked.
Are there houses earmarked for political parties?

Senior advocate Nandrajog questioned, ” Can we construct a building by June 15 if land is allotted to us?

During the hearing yesterday, the Court had asked if the plots in the possession of the Delhi Minister can be given to the party for their office on a temporary basis subject to the outcome of the petitions.

</excerpt>

The Delhi High Court has reserved its order on the maintainability plea filed by Arvind Kejriwal’s aide Bibhav Kumar on Friday.

Through his plea, Bibhav Kumar challenged his arrest regarding Swati Maliwal’s assault case at CM’s house in the previous month.

Further, he has also asked for directions to declare its arrest illegal, emphasizing, it is a violation of section 41A provisions under code of criminal procedure.

But, Police’s lawyer has opposed the petitioner’s plea on the grounds, that it’s not maintainable.

Later, the senior counsel also asserted, that the objection regarding section 41A (notice of appearance before police officer) has already been dismissed by the trial court. Thus, contending that petitioner should file revision order against the verdict rather than a writ petition.

However, bibhav kumar’s lawyer emphasized, that his arrest violates fundamental rights of an individual and is against the law.

Furthermore, Kumar’s counsel argued, that there was neither reason nor necessity for the arrest, emphasizing that an individual’s liberty cannot be taken lightly.

In the petition, kumar also stated, that he was arrested with an “oblique motive”, even though his anticipatory bail is still pending in trial court.

He has also asked for “appropriate compensation” for his illegal arrest and actions against those officials, who were involved in the decision-making of the arrest.

Later, after hearing both the sides, Justice Swarna Kanta Sharma, reserved the order, saying “Order reserved on maintainability.”

Earlier on Monday, kumar’s bail plea was rejected by sessions court, asserting there was no ‘pre meditation’ in swati maliwal to register an FIR and her allegations could not be ignored.

What has happened In Swati Maliwal Case So Far?

On May 18, Arvind Kejriwal’s aide, Bibhav Kumar, was arrested and subsequently remanded to five days of police custody by a magisterial court, which noted that his anticipatory bail had become ineffective due to his arrest.

The trial court recently denied bail to Bibhav Kumar, citing concerns about potential witness influence and evidence tampering, as the investigation is still in its early stages. The court noted Kumar’s presence at the CM’s house after his termination from employment and mentioned issues with accessing his mobile phone data and blank CCTV footage from the CM’s office.

During arguments, the complainant’s counsel emphasized Swati Maliwal’s status as an AAP MP and highlighted the severity of her injuries, indicating a long association with the CM’s office and alleging brutal assault by Kumar.

</excerpt>

The Delhi High Court has recently rejected the bail plea of ex-PFI chairman E Abubacker, who was seeking his release under UAPA charges, which are being investigated by NIA, on Tuesday.

While announcing their judgment, the bench consisting of Justices Suresh Kumar Kait and Manoj Jain, said “We hereby dismiss the appeal.”

Earlier, Abubacker sought bail under both merit and medical grounds.

After being arrested by NIA, as part of huge crackdown against the banned organization in September 2022, he initially approached trial court for his interim bail on medical grounds. After its rejection, he eventually knocked the doors of high court. Where his bail plea got dismissed.

However, in February, the high court ordered Tihar Jail’s medical superintendent, to make sure, that Abubacker receives treatment for his illness regularly.

But it has also refused to place Abubaker under house arrest and announced, he’ll be admitted to hospital for treatment, if needed.

Why PFI Was Banned?

As per National Investigative agency, the popular front of India, planned a criminal conspiracy to get funds for committing terror acts in different parts of the country and established training camps to brainwash and train their cadres for this purpose.

Later, leading the crackdown on PFI, a multi-agency operation headed by NIA, was conducted in September 2022, where a huge number of PFI workers were arrested from 11 states, for supporting terror acts in India.

These arrests were made in the following states and union territories- Kerala, Maharashtra, Karnataka, Tamil Nadu, Assam, Uttar Pradesh, Andhra Pradesh, Madhya Pradesh, Puducherry, Delhi and Rajasthan.

Then on September 28, 2022, the government imposed the ban of PFI and its associated organizations under the stringent anti-terror law UAPA (Unlawful Activities & Prevention Act). Alleging, they also have terror links with global terror organizations like ISIS.

</excerpt>

The Delhi High Court has instructed BharatPe co-founder Ashneer Grover and his wife Madhuri Jain Grover to provide a security deposit of Rs. 80 crore before they travel to the US. The court specified that this security should be in the form of a property. Additionally, the court directed the couple to submit their Emirates Card with the court to ensure they do not visit the United Arab Emirates (UAE) as they possess a “golden visa”.

The couple has been permitted to travel to the US separately for their children’s summer school after the court requested the Economic Offences Wing to outline the conditions of their travel. They are required to share details such as their stay, hotel, travel plans, and phone numbers with the court and investigating agencies.

Furthermore, the court has instructed the couple not to create any third-party rights on the BharatPe shares they hold. Ashneer Grover is scheduled to depart for the US on May 26 and return on June 14, while his wife will travel on June 15 and return on July 1.

Previously, the EOW had opposed the travel request of the couple, citing their overseas properties and the risk of them fleeing. The couple is accused of committing a Rs. 81 crore fraud at the fintech firm.

</excerpt>

Former Jharkhand Chief Minister Madhu Koda is making a renewed attempt to suspend the conviction order against him in the coal block allocation scam case, this time by approaching the Delhi High Court. Koda’s plea emphasizes that the elections in Jharkhand are anticipated to take place in November 2024.

He expresses concern that if his conviction is not stayed, he will be unable to participate in these elections. Given his past roles as both Chief Minister and a returning Member of Parliament (MP) and Member of the Legislative Assembly (MLA), Koda fears being deprived of the opportunity to contest in the upcoming polls.

During the recent court hearing, the Central Bureau of Investigation (CBI) objected to Koda’s plea, arguing against its maintainability. The CBI pointed out that a similar plea had been dismissed by the High Court previously, accompanied by a reasoned order. Despite the CBI’s objections, the Delhi High Court has issued a notice regarding the matter. It has scheduled a hearing to determine the maintainability of Koda’s application for August 13, 2024.

Madhu Koda, previously convicted in 2017 for criminal misconduct and under the Prevention of Corruption (PC) Act, is seeking suspension of the conviction order as he aims to contest in the upcoming assembly elections in Jharkhand. The court had sentenced him to three years of rigorous imprisonment and imposed a fine of Rs 5 lakh. Although Koda was granted bail and a stay on the fine in 2018, the Delhi High Court denied his application for a stay on the conviction order in 2020.

Now, after four years, Koda has approached the Delhi High Court again, citing new factual and legal developments. He argues that his criminal appeal, pending since 2017, has not been listed for a hearing despite the passage of four years since the order dated May 22, 2020. Koda emphasizes the urgency of his plea, stating that he wishes to contest in the forthcoming assembly elections in Jharkhand.

</excerpt>

The Delhi High Court has imposed a fine of Rs 1 lakh on an individual who made Lord Hanuman a co-litigant in an attempt to unlawfully acquire private property. Justice C Hari Shankar remarked on the unusual nature of the case, stating, “I never thought that God would, one day, be a litigant before me. This appears, however, thankfully, to be a case of divinity by proxy.”

The case involved a plea to retain part of a private land under the claim that it housed a public temple. The court clarified that the right to worship at a private temple does not automatically extend to the public unless the owner makes such rights available or the temple transforms into a public one over time.

The plea argued that since there was a public temple on the property, it belonged to Lord Hanuman, and the man involved in the case claimed to be the Lord’s next friend and a worshipper. However, the court dismissed the appeal, describing it as a “rank collusion with an intent to grab” the property. It concluded that there was collusion between the individual, Ankit Mishra, and the current possessors of the land to prevent its transfer to another party.

The court outlined the history of the dispute, noting that the defendants (current possessors) claimed adverse possession of the land and demanded Rs 11 lakh to vacate. Although the plaintiff (the other party) paid Rs 6 lakh, the defendants did not vacate the property.

In response, Mishra, as a third party, filed an objection claiming that there was a public temple on the property dedicated to Lord Hanuman, and therefore, the land belonged to the deity. He argued that he was entitled to protect Lord Hanuman’s interest as his next friend, stating, “There is a public temple on the property dedicated to Lord Hanuman. The land belongs to Lord Hanuman.”

The court dismissed the appeal, directing Mishra to pay Rs 1 lakh as costs. It clarified that Mishra would be solely responsible for paying the costs, despite Lord Hanuman being a co-litigant in the case.
