</excerpt>

Use of energy-efficiency appliances is Delhi government’s priority, said Delhi chief minister Atishi Marlena on Tuesday. The Delhi government mandated the use of BLDC fans, 5-star rated air conditioners, and other high-efficiency devices, across all its buildings to conserve electricity in the national capital.

Delhi CM further emphasized, “Our goal is to save electricity in government buildings through the use of energy-efficient appliances. This decision will enable us to save crores of rupees annually while contributing to environmental sustainability and reducing carbon emissions.”

Atishi approved the proposal, which will be sent to the Lieutenant Governor for final clearance. This move is expected to significantly cut electricity consumption and save crores of rupees annually, an official release stated.

Sharing details about the initiative, CM Atishi said: “Our government has prioritized energy efficiency by mandating the use of BLDC fans, 5-star rated air conditioners, and other energy-efficient devices in all government buildings. This step will not only reduce electricity consumption and bills but also contribute significantly to building a greener future. Delhi’s initiative will serve as a model for the entire country, demonstrating how technological innovations and effective policies can drive energy conservation.”

Government buildings are among the largest consumers of electricity in Delhi. Each year, Delhi government departments consume over 2000 million units of electricity, costing between Rs8.50 and Rs11.50 per unit. This results in annual electricity bills exceeding Rs 1,900 crore, the release stated.

This initiative shifts the focus from LED lights to fans and air conditioners to reduce electricity consumption.

Also read: Bhagwant Mann and Channi Present 10 ‘Demands for Grants 2024-25’ for Farmers In Lok Sabha

BLDC Fans compared to conventional fans consume 40-45 watts less power, saving approximately 96 units of electricity per fan annually. This translates to monetary savings of Rs950 to Rs1100 per fan each year, release stated.

Additionally, 5 star rated ACs save between 2800 and 3042 units of electricity annually compared to regular ACs, resulting in savings of Rs27,000 to Rs29,000 per AC each year, the release stated.

The primary objective of this initiative is to curb the rising demand for electricity and promote energy efficiency. This summer, Delhi’s peak electricity demand reached 8656 MW, a significant increase from 7438 MW the previous year.

Government buildings, being major electricity consumers, will play a key role in achieving these goals through the efficient use of energy-saving appliances. This step marks a critical contribution to addressing growing energy demands while fostering environmental sustainability, the official release added.

According to the SAMEER app, which tracks air quality updates, the AQI at Lodhi Road was even at a “satisfactory” level.

Key AQI Data for Delhi Today

Relief in Some Areas: Lodhi Road (IITM) recorded an AQI of 95, which is in the “satisfactory” range. However, hazy conditions persisted across most of Delhi and nearby areas.

24-Hour Average AQI: The 24-hour average AQI, measured until 7:30 am, stood at 279, placing it in the “poor” category. This marked a significant improvement from the hazardous 450+ levels recorded on Sunday.

Pollution Levels Across Delhi

Most Polluted Areas: Shadipur recorded the highest pollution, with an AQI of 347, which is in the “very poor” category.

Cleaner Areas: Lodhi Road had the lowest AQI at 95, which is considered “satisfactory.”

Other Areas: RK Puram (275), Sirifort (267), Sri Aurobindo Marg (227), ITO (234), and IGI Airport (260) all had AQIs in the “poor” range.

AQI Categories Explained

The Air Quality Index (AQI) is divided into categories:

0-50: Good

51-100: Satisfactory

101-200: Moderate

301-400: Very Poor

401-450: Severe

Above 450: Severe Plus

PM2.5 was identified as the primary pollutant, with levels reaching 138 at 3 pm.

Stage 4 Restrictions and Air Quality Management

Last Monday, Delhi’s AQI reached 495, the highest of the season. This triggered Stage 4 restrictions under the Supreme Court’s Graded Response Action Plan (GRAP). These measures are taken when air quality levels reach hazardous levels.

Weather Forecast for Delhi

The IMD predicts moderate fog for Monday. Temperatures will range from a high of 28°C to a low of 12°C.

In summary, while Delhi’s air quality has improved, pollution remains a serious concern. Continued monitoring and action are essential to address the ongoing problem.

</excerpt>

The Supreme Court has directed the Delhi government and police to establish checkpoints at all 113 entry points to the capital to monitor truck entries, aiming to enforce the Graded Response Action Plan (GRAP) Stage IV measures against air pollution.

A bench comprising Justices Abhay S. Oka and Augustine George Masih emphasized the need for personnel at these checkpoints to be clearly informed about which essential commodities are permitted entry. The court expressed dissatisfaction with the current enforcement, noting that vigilance is maintained primarily at 13 major entry points, leaving approximately 100 points unchecked. The bench stated, “So far as compliance is concerned, we are not satisfied. Government has not stated clearly as to at how many entry points there are officers present to comply with measures of GRAP IV.”

To ensure compliance, the court appointed 13 advocates as commissioners to inspect these entry points and verify the enforcement of truck entry restrictions. The Additional Solicitor General was instructed to forward their names to the Delhi Police Commissioner to facilitate their visits. The court noted, “Out of 113, almost 100 entry points are unmanned in the sense that there are nobody to check the entry of trucks, we asked members of the bar to go and check those points. We are happy to note that 13 young members of the Bar have volunteered to act as commissioner of this court.”

Additionally, the court directed that CCTV footage from the 13 monitored entry points be provided to the amicus curiae for review. The bench scheduled a review for November 25 to decide whether GRAP-IV restrictions should continue.

Also read: Vinod Tawde Demands Apology in 24 Hr From Congress, Threatens Rs 100 Cr Lawsuit

Under GRAP-IV, the Commission for Air Quality Management (CAQM) has prohibited truck entry into Delhi-NCR as a measure to combat air pollution. The Supreme Court’s directives aim to ensure strict adherence to these measures to improve air quality in the region.

It houses several four-star and higher-rated hotels that operate around the clock. Now, Aerocity restaurants can also extend their hours. This change will provide visitors with more dining options, according to an official statement from PTI.

Chief Minister’s Approval

Chief Minister Atishi has given the green light to this proposal. The goal is to attract more tourists and increase government revenue through higher licensing fees. The shift to 24×7 service is expected to enhance visitor experiences while significantly contributing to the state’s finances.

Learning from Gurugram

This initiative mirrors a successful approach in Gurugram, Haryana. There, extended restaurant hours have led to increased revenue in exchange for additional fees.

Expanding Commercial Operations

On October 29, the Delhi government also approved 24-hour operations for 111 additional shops and commercial establishments. With this latest round of approvals, over 700 entities are now allowed to operate around the clock.

Focus on Food Outlets

Recently, the Delhi government unveiled plans to create modern and affordable infrastructure to support independent food outlets. The aim is to simplify licensing processes and expand job opportunities in this sector. Inspired by former Chief Minister Arvind Kejriwal’s vision, this initiative seeks to reduce regulatory burdens and provide affordable infrastructure through the Delhi State Industrial and Infrastructure Development Corporation.

New Policy for Independent Food Businesses

A new policy will promote the growth of independent food outlets and enhance job opportunities in the industry. This initiative coincides with Diwali celebrations and is expected to be implemented within the next 15 days.

Objectives of the New Policy

Delhi Industries Minister Saurabh Bharadwaj stated, “The policy introduces a pioneering approach to support the growing segment of independent food businesses, including cloud kitchens, ghost kitchens, and other non-dine-in delivery outlets.” He explained that the policy is designed to simplify business operations and promote sustainable growth. It will be effective from 2024 to 2029. The aim is to reduce regulatory hurdles and streamline licensing processes while creating job growth and skill development opportunities throughout the National Capital Territory.

Enhancing Business Operations

In response to rising demand for food delivery services, the new policy will establish a strong regulatory framework for over 20,000 non-dine-in food outlets in the capital. Overall, this initiative aims to enhance the ease of doing business, streamline compliance, and improve operational efficiency. It seeks to foster an environment that encourages entrepreneurial growth and job creation in the food sector.

</excerpt>

In a dramatic turn of events, Dwarka district judge Aman Pratap Singh was terminated from his position by the Delhi government on October 10, following a recommendation from the Delhi High Court. The decision came after a video surfaced on social media, showing Singh standing on his chair and yelling at court staff and the defense counsel.

The Viral Video Incident

The controversial video, which went viral, showed the judge in an unprofessional outburst during a court proceeding. Singh was seen standing on his chair, shouting at the court staff and the counsel of an accused individual, sparking widespread public criticism and a formal investigation.

High Court Recommendation

Following the incident, the Delhi High Court had ordered the withdrawal of Singh’s judicial duties on September 19. Singh, who had been serving in the Dwarka court since June, was placed under probation until the investigation concluded. The high court’s recommendation for his termination ultimately led to the Delhi government’s decision.

A Sudden Fall from Grace

Aman Pratap Singh was appointed as an additional district judge in Delhi in May, after passing the Delhi Higher Judicial Service Examinations. However, his career has now been cut short due to his unprofessional behavior in the courtroom. The termination highlights the serious consequences faced by judicial officers in cases of misconduct.

</excerpt>

The Delhi government has released an additional Rs 100 crore for 12 colleges fully funded by it under Delhi University (DU). This release, approved by Chief Minister Atishi, aims to address ongoing financial difficulties that have disrupted operations and affected faculty and staff benefits, officials said.

In April last year, the government had released its first tranche of Rs 100 crore for these colleges, followed by the second tranche of Rs 100 crore this July.

The relationship between the government and these colleges has been contentious, with the government insisting that funds would only be released if governing bodies were constituted according to rules. Teachers, however, have accused the government of delaying salaries.

The latest installment is part of a broader budgetary allocation of approximately Rs 400 crore for these colleges in the current financial year. “Since the AAP government came to power, funding for these colleges has tripled. In 2014-15, these colleges were allocated Rs 132 crore, which has now increased to approximately Rs 400 crore in the current financial year,” the government said in a statement.

“Under the guidance of (former CM) Arvind Kejriwal, education has always been our top priority,” Atishi said. She stressed that the largest share of the state’s budget has consistently been allocated to education since AAP took office. The government’s focus has extended beyond primary and secondary education to higher education, with three new universities being established and existing institutions being expanded. “The 12 fully funded DU colleges play a crucial role in higher education in Delhi,” she added.

In recent years, there have been allegations of financial mismanagement in some of these colleges, along with delays in salaries and stalled medical and pension benefits for staff and teachers. “With a focus on the welfare of teachers and ensuring their medical and pension benefits, which were stalled due to financial mismanagement, the Delhi government is releasing Rs 100 crore in the third quarter for these 12 Delhi University colleges,” the statement added.

In January, the government stated that it would only continue funding if these institutions were de-affiliated from DU and became part of one of Delhi’s state universities. This statement followed a letter from DU Vice-Chancellor Yogesh Singh to Union Education Minister Dharmendra Pradhan, asserting that these colleges would remain with DU and the state government should maintain funding.

The 12 fully funded colleges are Acharya Narendra Dev College, Aditi Mahavidyalaya, Bhagini Nivedita College, Bhaskaracharya College, Deen Dayal Upadhyaya College, Dr. Bhim Rao Ambedkar College, Indira Gandhi Institute of Physical Education and Sports Sciences, Keshav Mahavidyalaya, Maharaja Agrasen College, Maharshi Valmiki College of Education, Shaheed Rajguru College, and Shaheed Sukhdev College of Business Studies.

</excerpt>

As the festival season approaches, the Delhi government has announced a complete ban on the manufacturing, storage, sale, and use of firecrackers to combat rising pollution levels during the winter months. This ban, which also extends to online sales and deliveries, will be enforced until January 1, 2025. The decision, announced by Delhi Environment Minister Gopal Rai, is aimed at reducing air pollution, particularly during festivals like Diwali, when firecracker usage traditionally spikes. The government hopes this measure will contribute to improving air quality in the capital during the festive period and beyond.

Earlier in the year 2023 ahead of Diwali 2023, the Supreme Court reinforced its earlier orders banning the use of barium and other banned chemicals in firecrackers, extending the prohibition beyond the National Capital Region to the entire country. A bench of Justices A S Bopanna and M M Sundresh clarified that previous orders aimed at minimizing air and noise pollution are binding on all states, including Rajasthan. The clarification came during a hearing related to Rajasthan’s compliance with the ban.

The court emphasized that states must take necessary measures not only during the festival season but throughout the year to reduce air and noise pollution. This decision reaffirms the court’s commitment to regulating harmful practices and protecting environmental health across India.

</excerpt>

The Delhi government has introduced a new initiative aimed at promoting the scrapping of old vehicles by offering substantial tax discounts. This proposal, which is currently awaiting approval from Lieutenant Governor VK Saxena, is designed to encourage vehicle owners to switch to newer, more environmentally friendly vehicles.

Key Details of the Scheme:

For Non-Transport Vehicles:

Owners will receive a 20% reduction in the Motor Vehicles Tax when registering new petrol, CNG, or LPG vehicles, provided they present a Certificate of Deposit from a Registered Vehicles Scrapping Facility (RVSF) confirming that their old vehicle has been scrapped.

For new diesel vehicles, the tax concession will be 15%.

2. For Transport Vehicles:

The concession rates are slightly lower, with a 15% reduction for new petrol, CNG, or LPG vehicles and a 10% reduction for new diesel vehicles.

The tax concession cannot exceed 50% of the scrap value of the vehicle.

The Certificate of Deposit will be valid for three years and can be traded electronically, offering more flexibility for vehicle owners.

Background and Rationale:

This initiative is part of a broader strategy to address pollution issues in the capital. In 2018, the Supreme Court of India prohibited diesel and petrol vehicles older than 10 and 15 years, respectively, from operating in Delhi, with penalties including vehicle impoundment for violators. Additionally, a 2014 order from the National Green Tribunal banned vehicles older than 15 years from being parked in public areas. As a result, Delhi has already deregistered approximately 5.5 million vehicles that exceed the age limit.

Delhi Transport Minister Kailash Gahlot emphasized the purpose of the proposed policy, stating, “By offering tax concessions, we hope to make it easier for vehicle owners to transition to more environment-friendly options,” according to a report from PTI. The goal of this scheme is to incentivize the scrapping of older, more polluting vehicles and promote the adoption of newer, cleaner alternatives.

The initiative reflects the government’s ongoing efforts to mitigate environmental damage and improve air quality in the capital by encouraging the replacement of outdated and polluting vehicles with more sustainable options.

This concession would be available upon submission of a certificate of deposit for an old vehicle handed over for scrapping at a Registered Vehicles Scrapping Facility (RVSF). A proposal for this initiative has been sent to the Hon’ble Lieutenant Governor for approval.

For non-transport vehicles, the concession includes a 20% reduction in the Motor Vehicles Tax for the registration of new petrol, CNG, or LPG vehicles and a 15% reduction for new diesel vehicles. </excerpt>

The Delhi BJP has called on the Delhi government to tackle the escalating prices of vegetables, which have become a significant burden for economically weaker sections and the lower middle class. In a letter addressed to Imran Hussain, the Delhi food and civil supplies minister, Delhi BJP spokesperson Praveen Shankar Kapoor proposed that special vans be deployed to each municipal ward to ensure subsidized vegetables reach the masses.

Additionally, the party has requested the Delhi government to initiate complementary distribution of essential vegetables like onions and potatoes. The letter highlighted that staples such as potatoes are being sold at Rs 40 to 50 per kg, onions at Rs 50 to 60 per kg, and tomatoes at Rs 90 to 100 per kg, making them unaffordable for many. Other vegetables, including lady’s fingers and brinjal, are priced above Rs 100 per kg, while peas are selling at Rs 150 per kg, exacerbating the financial strain on households.

Kapoor urged the minister to take immediate action and provide the common people with potatoes at Rs 20 per kg, onions at Rs 25 per kg, and tomatoes at Rs 40 per kg, reflecting prices from just ten days ago. Furthermore, the BJP has called for other vegetables to be made available at more affordable rates.

The spike in vegetable prices has been attributed to inclement weather, increased transportation costs, and a shortage of labor, causing prices to surge by 25-50% in the first week of July compared to June. This includes tomatoes, which were sold at Rs 60 per kg in the wholesale market a week ago, and other vegetables such as potatoes, lady’s fingers, bottle gourds, and brinjals, which have also seen significant price hikes at the Azadpur auction yard.

Heavy monsoon rains have led to soaring tomato prices in Delhi, with wholesale prices nearly doubling, affecting retail rates. The supply shortages due to rain have also impacted the prices of onions, potatoes, and seasonal vegetables.

Additionally, in Assam, floods have led to increased vegetable prices, affecting over 12.33 lakh people in 24 districts, with a death toll of 90. As water levels recede in many rivers, the Brahmaputra River remains a concern.

So far, 16 departure flights and 12 arrival flights have been cancelled. Delhi experienced 150 mm of rainfall between 2:30 AM and 5:30 AM, marking one of the wettest spells of the year. The India Meteorological Department (IMD) has forecasted continued showers with thunderstorms and winds of 20-40 km/h for the next two hours. This incident highlighted the severity of the disruptions caused by the monsoon rains across the city.

The heavy rain, while offering relief from the sweltering heat, has resulted in significant waterlogging. Visuals shared by news agency ANI on social media platform X show inundated roads and long traffic jams. Many residents have also posted images and videos of the waterlogged streets on their social media accounts.

On Thursday, heavy rain brought Delhi’s temperature down to 35.4 degrees Celsius, with the city recording 5.2 mm of rainfall between 8:30 AM and 5:30 PM. However, this also led to significant traffic congestion and waterlogging. The city’s traffic police received numerous calls about waterlogged streets, traffic jams, and fallen trees, causing inconvenience for commuters.

</excerpt>

Amid a severe water shortage in Delhi, the city government has appealed to the Supreme Court for additional water supply from Haryana, Uttar Pradesh, and Himachal Pradesh for a month. Several areas in Delhi, such as Chanakyapuri’s Sanjay Camp and Geeta Colony, are experiencing acute shortages. Residents in these areas endure long queues in the scorching heat, hoping to fill at least one bucket, as water tankers fail to adequately serve the large populations.

This water crisis coincides with soaring temperatures in the national capital, with the maximum temperature nearing the 50 degrees Celsius mark and the minimum temperature around 30 degrees Celsius, which is 2.8 degrees above normal.

The weather office has predicted that heatwave conditions in Delhi will persist for the next few days and has advised people to “minimise exposure to heat and stay hydrated.”

In response to severe water shortages, the Delhi government has instructed the Delhi Jal Board to take stringent actions against water wastage, including imposing a ₹2,000 fine on violators. Additionally, the use of potable water at construction sites has been banned.

Emergency Measures Announced

Delhi Minister Atishi revealed the new measures, emphasizing the urgency of the situation. “Many car repair and car washing centres are using Delhi Jal Board’s drinking water. We are banning the use of drinking water by the Delhi Jal Board at these centres,” Atishi stated.

Starting tomorrow, teams from the Delhi Pollution Control Committee (DPCC) will inspect car washing and repair centres. “I want to appeal to the people of Delhi… right now, Delhi is facing an emergency because of the heatwave,” she added.

Banned Activities

Central Water Tanker War Room: The Delhi government will establish a central water tanker war room, deploying 200 enforcement teams to crack down on water wastage.

Car Washing: Drinking water from the Delhi Jal Board is banned for washing cars. Washing cars with pipes is also prohibited.

Construction Sites: Using drinking water from the Jal Board at construction sites or for commercial purposes is banned.

Overflowing Water Tanks: Teams will monitor and address overflowing water tanks.

Illegal Water Connections: Illegal water connections at construction sites or commercial establishments will be disconnected.

Public Appeal: The government has urged residents to use water judiciously, warning that failure may lead to the rationalization of water supply.

Impact on Water Supply: Areas currently receiving water twice a day will see their supply reduced to once every 24 hours.

On Wednesday, May 29, Minister Atishi accused the Haryana government of failing to release Delhi’s rightful share of water despite numerous discussions. She indicated that the Delhi government would escalate the matter to the Supreme Court.

These measures underscore the severity of the water crisis in Delhi and the government’s commitment to addressing the emergency through strict regulations and public cooperation.

</excerpt>

As Delhi faces a water shortage in several areas, the Delhi Government has scheduled an emergency meeting on Thursday at the Delhi Secretariat to tackle the issue. The meeting will be led by Water Minister Atishi and Health Minister Saurabh Bhardwaj, with the Chief Secretary and other senior officials in attendance.

This decision follows reports of severe water crises from various parts of the city, where residents have been waiting for hours for water tankers. Residents of Geeta Colony in East Delhi have expressed concerns about the inadequate water supply from the government, stating they only receive half of what is needed.

Vinay, a resident of Geeta Colony, shared with ANI, “We are facing a severe water crisis. Our locality has a population of around 3,000-4,000 people, but the government sends only half the required number of tankers.” He added, “Although a tanker comes daily, but in this scorching heat, the demand for water has significantly increased. Sometimes, they reduce the amount of water in the tanker, due to which we suffer a lot. While in the absence of tankers, the wealthier residents can buy water, but the poorer ones cannot, due to which they have to drink dirty water, which leads to illness.”

Vinay also mentioned, “We have complained to the MLA of the area multiple times, but we have never received a valid response. No one is listening to us.” An elderly resident noted, “I usually come after 10-15 days, sometimes even a month, but as always, I don’t get water.” Another resident, Shabru Khatun, stated, “There are a lot of problems regarding water in this area. We get only one tanker for the entire area. The tanker water is used for drinking and cooking purposes. Sometimes, we don’t even get the tanker, and we are forced to buy bottled water.”

Earlier on Tuesday, Minister Atishi accused the Haryana government of not releasing Delhi’s water share despite “so many talks.” She warned that if the water supply does not improve in the next 1-2 days, they will consider moving to the Supreme Court.

Atishi also urged people to use water judiciously, warning that the government might have to rationalize the water supply in the national capital. She emphasized that fines for excessive water use could be imposed if people do not heed the appeal.

Discussing measures to address the water shortage, Atishi stated, “In the last one week, there has been a water crisis in many areas of Delhi… We have taken various steps but because the water level is decreasing constantly, we have to take more steps. The areas which get a water supply for two times will be reduced to once… We are in an adverse condition where Delhi’s water supply is being halted by Haryana.”

</excerpt>

The Delhi High Court has taken suo motu cognizance of delays by jail authorities in accepting bail bonds, describing the situation as unacceptable. Justice Amit Mahajan’s bench issued a notice to the Director General of Prisons and the Delhi Government, asking them to submit an affidavit. A follow-up hearing is scheduled for March 7.

The court explained its usual procedure for releasing prisoners on bail, noting that orders for release are sent directly to jail authorities through the FASTER cell. Sometimes, bail orders direct the bail bond to be given directly to the jail superintendent to expedite release without the prisoner returning to the trial court.

The court’s decision to initiate the matter came after hearing a petition where the petitioner’s bail bond, ordered to be submitted to the jail superintendent, was not processed. The petitioner had not been released even after 11 days, despite their sentence being suspended by the court’s order.

The court criticized the delay in accepting bail bonds, stating that the purpose of granting bail is to release the accused/convict from imprisonment promptly. The court questioned why the jail superintendent took one to two weeks to accept bail bonds, especially in cases of interim bails granted on medical or other urgent grounds.

It is noticed that the AAP government has always been quick in honoring the service of those personnel who make the ultimate sacrifice in the course of their bona fide official duties.

</excerpt>

The Delhi Government was ordered by the Delhi High Court to refrain from holding the planned Cyclothon and walkathon in the Asola Bhati Sanctuary on Thursday.
Concerns about participant safety and the proposed event were brought up in light of the leopard that had escaped from the Sanctuary and made its way into Sainik Farm. It hasn’t been discovered yet.
“Respondents are restrained from organizing the proposed event until further orders,” remarked Justice Jasmeet Singh.
The parties’ arguments were heard by the high court on December 5, following which it reserved an order.

It had been alleged that the proposed event is not well thought out and is being organised without a proper plan.
It was also alleged that it is proposed to be organised in the dense forest without proper security arrangements even though the forest habitats leopards.
The counsel for the petitioner also submitted that one leopard entered in Sainik Farm colony and has not been caught.
On the other standing counsel for Delhi Government had submitted that the event was well thought out and planned.
During the hearing, the bench noted that despite repeated orders file has not been produced by the forest department. “Standing counsel is unable to explain why,” the court said.

</excerpt>

The Supreme Court on Wednesday upheld the Centre’s decision to extend the tenure of Delhi Chief Secretary Naresh Kumar by six months, a move that came just as he was about to leave office on November 30. A bench of Chief Justice DY Chandrachud along with Justices JB Pardiwala and Manoj Misra stated that the Union government’s decision “cannot be construed to be violative of law.”

The court clarified that its order supporting the extension is based on a prima facie view and does not consider issues pending adjudication before the constitution bench, which is examining the amended law dealing with services in the national capital.

The bench highlighted that the Ministry of Home Affairs has the authority to extend the chief secretary’s tenure, particularly concerning matters related to Entry 1, 2, and 8 (police, public order, and land) of the seventh schedule of the State List of the Constitution. These subjects fall outside the legislative and executive ambit of the Delhi government, indicating that the Centre has the requisite power to extend the chief secretary’s tenure.

The Centre had informed the court on Tuesday of its intention to extend Kumar’s tenure.
The court had then questioned whether the Centre had the necessary power to take such a step and expressed concern about being “stuck with only one person” if no other IAS officer was available for the top bureaucratic post.

The court was hearing the Delhi government’s plea against any unilateral appointment or extension of the chief secretary by the Centre without consultation with the state government.

In a tweet, the chief minister urged all councillors and MLAs to visit relief camps and provide all possible support.

Meanwhile, Delhi’s Directorate of Education, too, ordered all government and private schools to close immediately in flood endangered areas, without waiting for orders. On Thursday, the CM urged people in the national capital to help out each other as much as possible and extend all necessary assistance in flood prone areas in Delhi.

“The water level of Yamuna is increasing continuously. Now the water has reached 208.46 metres. Due to the rising water level, the Yamuna has come on the roads around it. You are requested not to go on these routes. People are being evacuated from the populated areas where there is water. The people living there are requested to cooperate with the administration. Saving the lives of people is most important. There is an appeal to all the people of Delhi to cooperate with each other in every possible way in this emergency”, CM Kejriwal shared in a tweet.

Traffic movement has been impaired in several places due to the rise in the water level of Yamuna and the resultant inundation of low-lying areas. Several areas of the city are under water as the water level of river Yamuna continues to rise following heavy rainfall and the release of water from the Hathnkund Barrage in neighbouring Haryana.

The North East district police have informed that more than 1000 people and around 999 cattle have been rescued from different areas near Yamuna amid the flood situation. The rescue was carried out in Usmanpur, Shastri Park, and Sonia Vihar police station areas.

No commercial vehicles will be allowed between Mukarba Chowk and Wazirabad Bridge, Sarai Kale Khan and IP Flyover, and Akshardham and Sarai Kale Khan.

According to AAP sources, the meeting of the national convenor of the Aam Aadmi Party (AAP) and the national president of the Samajwadi Party will be held in Lucknow. Kejriwal had on May 23 embarked on a nationwide tour to seek support from the Opposition parties against the Ordinance.
The AAP national convenor has so far met with West Bengal Chief Minister Mamata Banerjee, former Maharashtra chief minister Uddhav Thackeray, Jharkhand chief minister Hemant Soren, Telangana chief minister K Chandrashekar Rao, Tamil Nadu chief minister MK Stalin, Nationalist Congress Party (NCP) supremo Sharad Pawar, Bihar chief minister Nitish Kumar and his deputy Tejashwi Yadav.
The Union government on May 19 brought an ordinance to notify rules for the Government of National Capital Territory of Delhi (GNCTD) regarding the ‘transfer posting, vigilance and other incidental matters’. </excerpt>

The Centre on Saturday approached the Supreme Court seeking review of the May 11 Constitution bench judgement in which the apex court held that the Delhi government has “legislative and executive power over services” in the national capital.

The said judgement “suffers from errors apparent on the face of the record and fails to consider the case,” the Centre said in the petition. The Centre also filed an application for an open court hearing of the review petition in the interest of natural justice. “Under the constitutional scheme, the distribution of legislative powers is only envisaged with respect to the parliament and the legislatures of states.” There is no category of distribution of legislative power with respect to the legislative assemblies of Union Territories, and the sole source of legislative power in Union Territories is the Parliament alone,” the review plea submitted.

The Centre yesterday brought an ordinance to create for the first time a National Capital Civil Service Authority (NCCSA) that will have the power to recommend the transfer and posting of all Group A officers and officers of DANICS serving in Delhi. NCCSA will be headed by the Chief Minister of Delhi, with the Chief Secretary and Principal Home Secretary of Delhi being the other two members. On Friday, the Centre brought an ordinance designating the Lieutenant Governor (LG) as the administrator of Delhi, who will have the final say on the postings and transfers of all bureaucrats serving the Delhi government.

The ordinance, promulgated by President Droupadi Murmu, seeks to amend the Government of National Capital Territory (NCT) of Delhi Act, 1991, and effectively negates the Constitution bench verdict that gave the Aam Aadmi Party (AAP) government the power to make laws and wield control over bureaucrats deputed to the Delhi government.

It said that all matters required to be decided by the authority shall be decided by a majority of the votes of the members present and voting. In case of a difference of opinion in the Authority, the final decision will lie with the Lieutenant Governor of Delhi, the ordinance said.

On 11 May, a five-judge Constitution bench unanimously said that the division of administrative powers between the Union and Delhi governments “must be respected” and held that the Delhi government has “legislative and executive power over services” in the national capital, including the bureaucrats, except those relating to public order, police, and land. The apex court, in its 105-page judgement, has said that the government of Delhi is not similar to other Union Territories. “By virtue of Article 239AA, NCTD is accorded sui generis” status, setting it apart from other Union Territories,” the bench stated in its verdict. Article 239AA provides the framework for the exercise of legislative powers by the legislative assembly of the Union territory of Delhi and the Parliament in respect of Delhi. Entry 41 of List II (State List) authorises a state government to frame laws on state public services and the state public service commission.

The executive power of the Delhi government is co-extensive with its legislative power; that is, it shall extend to all matters with respect to which it has the power to legislate, the bench has opined. The bench further said that “in a democratic form of government, the real power of administration must reside in the elected arm of the state, subject to the confines of the Constitution. A constitutionally entrenched and democratically elected government needs to have control over its administration.”

The apex court has also reiterated that, in light of Article 239AA and the 2018 Constitution bench judgement, the Lieutenant Governor is bound by the aid and advice of the Council of Ministers of the Delhi government in relation to matters within the legislative scope of Delhi.

The judgement of the top court has further said that in a democracy, accountability lies with the people, who are the ultimate sovereign. The verdict of the apex court has come on the tussle between Delhi and the Central government on the contentious issue of who should control administrative services in Delhi over the transfers and postings of officers in the national capital.

</excerpt>

Days after a Supreme Court’s order giving it control over services, the Delhi government has asked its various departments to hold back action on directions of Lt Governor V K Saxena issued directly to them in recent months.
After the apex court’s judgement, directions were issued on 12 May by ministers-in-charge to departments concerned asking them to strictly follow transaction of business rules (TBR) and desist from putting up files before them through the chief secretary.

Now, according to a circular issued on Monday by the Delhi government, the various departments have been asked to put on hold implementation of all the directions issued by the LG directly to them in the last few months.
Lt Governor Saxena has issued several directions directly to various departments through the chief secretary, “completely bypassing” the elected government, the circular said.
The Constitution Bench of the Supreme Court in its 2018 order and recent order on 11 May has clearly stated that the LG is bound by aid and advice of Council of Ministers on all subjects, including services, barring only three subjects–land, public order and police, it said.

Therefore, direct orders of the LG to the departments are contrary to the Constitution and orders of the Supreme Court, it added. The circular asked the department heads to provide a list of directions issued directly to them by the LG and take no further action on them till further instructions from the ministers-in-charge.

Prior to the top court’s 11 May order, the services department was under executive control of the LG. The government has also flagged that the provisions of TBR are not being followed and directed for its strict compliance.

It was also directed that the secretary of department concerned will present files directly before the minister-in-charge and not through the chief secretary.
“The secretary of the department will present files directly to the minister and not through the chief secretary in accordance with provisions of Rule 15.2 of the TBR,” read an order issued last week.

Those who put up posters against me should not be arrested”, the chief minister told mediapersons. </excerpt>

The Delhi High Court on Friday issued notice to its registry, the Center, and the government of the national capital territory of Delhi on a plea seeking directions for setting up 42 more commercial courts, as notified by the Delhi Government on 13 April, 2021, to ensure speedy redressal of commercial cases instituted in Delhi in the larger public interest.

The public interest litigation (PIL) has been moved by social activist and practicing advocate Amit Sahni. The bench of Justice Satish Chander Sharma and Justice Subramonium Prasad granted four weeks to the Registry of the High Court to file a response as to why commercial courts have not been set up in terms of the last order.

On 5 July, 2022, the Delhi High Court directed its Registrar General, the Government of NCT Delhi, and others to set up 42 commercial courts within a period of six months for the speedy redressal of commercial cases. However, the same has not been done to date, as stated in the plea.

Earlier, the Delhi High Court’s bench of Justice Satish Chandra Sharma and Justice Subramonium Prasad noted down the submission of its administrative side, stating that a shortage of courtrooms is coming in the way of immediately starting additional commercial courts, which will be established once the infrastructure is completed.

The court also noted the submission of the Delhi Government stating the Chief Secretary, Government of NCT of Delhi, had desired during the meeting dated 7 June, 2022, that the PWD may strictly adhere to the timelines for the construction of prefabricated courtrooms and hand over the same formally within the prescribed timelines.

Taking note of the submission, the bench directed all the respondents to set up the infrastructure for 42 commercial courts within six months. The court granted liberty to petitioner Amit Sahni to re-approach the court if the order is not complied with within the time frame.

“The efficiency of the legal system and the time taken to resolve the commercial disputes is an extremely important factor in deciding the growth of investment and overall economic and social development of the nation,” said the petitioner, Advocate Amit Sahni.

“The delay caused in the dispensation of justice has taken note of the High Courts and the Supreme Court from time to time, and directions have been issued to recruit for the pending vacancies in different courts of the country,” the petitioner added.

According to the petition, at present, a total of 22 commercial courts have been functioning in Delhi, but the additional 42 courts, as approved by the Government of the National Capital Territory (NCT) Delhi on 22 March, 2021, and subsequently notified on 13 April, 2021, have yet to be appointed.

“As against the world’s best practice for the timeline for disposal of commercial disputes of 164 days, Delhi takes 747 days in deciding a commercial dispute. Mumbai, on average, takes only 182 days,” said the petition.

The plea further stated that despite notification of 42 additional commercial courts by the government of NCT Delhi, the said posts have not been created by the High Court of Delhi through its Registrar General.

</excerpt>

The Central Bureau of Investigation (CBI) has registered an FIR against former Delhi Deputy Chief Minister Manish Sisodia and five others over alleged irregularities in the Delhi government’s ‘Feedback Unit’. The FIR registered on Tuesday reads that a preliminary inquiry found that the unlawful manner of creation and working of the Feedback Unit caused wrongful loss to the government exchequer to the tune of approximately Rs 36 lakh.

The inquiry has thus revealed that the FBU was willfully created, staffed, funded and incentivized out of public exchequer in an irregular manner by Sisodia, and Sukesh Jain, the then Secretary Vigilance, along with RK Sinha, (Retired DIG, CISF), working as Special Advisor to the CM and Joint Director, FBU, GNCTD, and P K Punj, (Retired Jt. Deputy Director, IB), working as Deputy Director, FBU, GNCTD in violation of rules and regulations and without mandatory approvals, by abuse of their official position and with a dishonest intention to utilize the FBU for purposes other than those for which it was manifestly created.
