</excerpt>

Arvind Kejriwal’s recent remarks in the Delhi Assembly have reignited tensions between the Aam Aadmi Party (AAP) and the Bharatiya Janata Party (BJP), further fueling the ongoing political battle in the capital. Kejriwal disclosed a private conversation with a senior BJP leader, in which the latter allegedly admitted that his arrest had successfully derailed the Delhi government’s operations. This revelation highlights Kejriwal’s claim that the BJP is leveraging legal actions and central agencies to disrupt governance in Delhi.

VIDEO | "Few days back, I met a senior leader (of BJP). I asked him what did they get out of my arrest? He smiled and said that they have derailed the Delhi government by arresting me. I was surprised by what he said. How can a party be happy if people are in distress?" says AAP… pic.twitter.com/7iB7Aa8Igs

— Press Trust of India (@PTI_News) September 27, 2024

The backdrop to this claim stems from Kejriwal’s arrest in March 2024, linked to the Delhi excise policy case. The Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) accused him of corruption, a move seen by AAP as a politically motivated attempt to weaken the party’s influence in the region. While Kejriwal was granted interim bail in May 2024, his legal battles continue to generate significant political friction.

In his Assembly address, Kejriwal also discussed his letter to Rashtriya Swayamsevak Sangh (RSS) Chief Mohan Bhagwat, in which he raised five pressing issues, including the BJP’s alleged tolerance of corrupt politicians. Kejriwal cited the example of Ajit Pawar, who was involved in a corruption case and later inducted into the Maharashtra government as Deputy Chief Minister, questioning Bhagwat’s stance on such political moves. This aligns with AAP’s broader criticism of Prime Minister Narendra Modi’s governance, accusing him of embracing corrupt politicians for political gain.

VIDEO | "Few days ago, I wrote a letter to (RSS chief) Mohan Bhagwat and raised five issues. One of those issues was about how PM Modi is inducting the most corrupt politicians of other parties in his party and does Mohan Bhagwat agree with him? On June 27, 2023, PM Modi said… pic.twitter.com/kGrsvIsNrv

— Press Trust of India (@PTI_News) September 27, 2024

The confrontation between AAP and BJP has intensified ahead of upcoming elections, with AAP framing these legal cases as part of a larger political strategy to suppress opposition. The BJP, on the other hand, maintains that the investigations are based on legitimate legal grounds, particularly in the context of the excise policy probe. This ongoing battle is likely to remain a central theme in Delhi’s political landscape, with both parties gearing up for the 2025 Delhi Assembly elections.

Kejriwal’s claims, especially concerning the BJP’s alleged attempts to derail his government, reflect the heightened political tension, and his reference to corruption within the BJP adds further weight to his broader critique of the ruling party at the national level.

NEW DELHI: Bharat Rashtra Samiti (BRS) leader K. Kavitha was taken to Delhi’s DDU Hospital on Tuesday evening after her health deteriorated. She is currently lodged in Tihar jail in connection with the Delhi excise policy case.

K. Kavitha was arrested on March 15 of this year. Six days later, the Enforcement Directorate arrested Delhi Chief Minister Arvind Kejriwal in a money laundering probe related to the same case.

Initially, K. Kavitha was arrested by the Enforcement Directorate, and the next month, she was arrested by the CBI. She is accused of being part of a group that allegedly gave the AAP kickbacks amounting to ₹100 crore in exchange for formulating a favourable liquor policy.

Earlier this month, K. Kavitha approached a Delhi court seeking “default” bail in the corruption case. In her bail plea, K. Kavitha’s lawyer argued that the chargesheet against her was incomplete. The plea stated that the law requires the CBI to file a complete charge sheet within 60 days of arrest, but she had spent more time in jail than that.

‘It is clear that the third supplementary chargesheet has been filed solely to prevent the release of the applicant on default bail and to circumvent the mandate of Section 309(2) of the Cr.P.C. Such incomplete investigations, aimed at violating the applicant’s right to default bail, cannot be upheld in law,” the plea said.

The court later scheduled the matter for a further hearing on July 22.

In June, the CBI filed a supplementary chargesheet against Kavitha, claiming there was sufficient evidence to prosecute her in the corruption case.

Earlier, she had been questioned by the CBI inside the jail about WhatsApp chats recovered from co-accused Buchi Babu’s phone and about a sum of ₹100 crore allegedly paid to the party.
The ED and the CBI had alleged that irregularities were committed while modifying the excise policy, undue favours were extended to license holders, the license fee was waived or reduced, and the L-1 license was extended without the competent authority’s approval.

Special judge Kaveri Baweja delayed the charge arguments after hearing from Advocate Nitesh Rana, setting a new date for the proceedings. CBI’s Special Public Prosecutor, Advocate DP Singh, stated readiness for arguments on already acknowledged charge sheets.

Earlier, the court had deferred cognizance of a supplementary charge sheet against K Kavitha to July 22, as requested by her counsel. Her bail plea will also be heard on the same day. Kavitha has sought default bail due to alleged defects in the charge sheet filed against her and remains in judicial custody until July 18.

Previously, the court had postponed hearing K Kavitha’s plea for default bail in the Delhi Excise policy case to July 22, following a notice issued to the CBI. Advocate Nitesh Rana represented Kavitha, arguing that the charge sheet was deemed defective during the court’s consideration for cognizance on July 6. He requested default bail, citing the CBI’s failure to file a complete charge sheet within the mandated 60-day period and sought interim bail during the pending bail application.

The Rouse Avenue Court announced the extension of custody on Friday, reflecting the ongoing legal scrutiny of the Delhi Chief Minister. The Supreme Court’s interim bail decision acknowledged Kejriwal’s position as an elected leader and noted his 90-day incarceration period. Justices Sanjiv Khanna and Dipankar Datta emphasized that Kejriwal’s arrest and right to life issues are significant, referring these matters to a larger bench for further deliberation.

Meanwhile earlier on July 12, the apex court also called supreme court has given an interim bail to Delhi CM and AAP supremo Arvind Kejriwal in a money laundering matter in Delhi’s excise policy case.

The Bail was given on the grounds that Kejriwal has dealt with ‘incarceration of 90 days.’

This marks the first such address under the third National Democratic Alliance (NDA) government. Following the President’s speech, both Houses of Parliament will discuss a motion of thanks.

AAP leader Sandeep Pathak emphasized the importance of upholding the supremacy of the President and the Constitution, especially in the face of perceived injustice. He stated, “Today we will protest in the Rajya Sabha against the arrest of Delhi CM Arvind Kejriwal and we will boycott the President’s address.” Pathak clarified that while AAP will boycott, discussions with other INDIA alliance parties regarding similar protests have not taken place.

Meanwhile, the Rouse Avenue Court of Delhi ordered Kejriwal’s CBI remand until June 29, 2024, granting limited visitation rights and allowing him to carry prescribed medications. During the court proceedings, Kejriwal denied allegations made by the CBI against him involving his colleague Manish Sisodia, asserting their innocence and condemning media attempts to tarnish their reputation.

As per special judge for ED and CBI matters, Kaveri Baweja observed, that according to June 6 order, the accused wife has surgery scheduled. Thus, requiring him to care of her.

Also, the judge noted the senior advocate Vikas Pahwa’s submissions, declaring, that accused wife father has already passed away and the mother along with her two brothers are residents of Bengaluru and London, UK.

Further, the judge also observed, that no family member, cousin lives in the house nor visits petitioner’s home to look after his children and wife.

The extended family cannot fill husband’s /father’s absence and look after family members added judge.

‘Having considered the submissions made and ongoing through the record of the case, including the medical documents of the wife of the applicant, the medical condition of his two children, as discussed above and considering the fact that there is no other person either in the family of the applicant or of his wife who could provide the requisite post operative care and support, the application under consideration is allowed,’ said judge.

Later, the judge granted the bail on personal bond of ₹two lakhs with surety of like amount.

The judge also kept the condition, that the accused shall not leave Delhi NCR until it is necessary for wife’s treatment.

In addition, the judge also directed the accused to not destroy case evidence nor influence any witness or even attempt for that matter.

Lastly, shouldn’t indulge in offence of any nature nor abuse the interim bail given to him.

During the proceedings, Pahwa also stated, that Arora was granted interim bail for similar reasons, and there were no allegations of misuse of this relief.

‘There is no allegation that he misused the relief. He appeared before the ED whenever he was asked to.’ said Pahwa to court.

This development coincides with the scheduled delivery of an order by the Delhi High Court on the bail pleas of former Deputy CM Manish Sisodia, regarding the money laundering and corruption charges filed against him by both the CBI and the ED.

Later both ED and CBI opposed Sisodia’s plea saying, there was a conspiracy to delay the charges framing process in this case.

However, the Sisodia’s council alleged, that the investigative agencies are still arresting people in money laundering and corruption cases, even though there is no question of early conclusion.

Manish Sisodia has been in judicial custody since February 26, 2023, after he got arrested by CBI. Subsequently, the former deputy CM was later arrested by ED.

According to the investigative agency, alleged irregularities were found in the modified excise policy. As a result, undue extensions were granted to license holders.

Further, the agency also alleged, the license fee was waived or reduced to favor the holders. Followed by the L-1 extension without the competent authority’s approval.

Later, the beneficiaries also managed to divert these illegal gains to accused involved and made false entries in book accounts to evade detection.

The investigative agency further informed the court, that Arvind Kejriwal is on interim bail, and will likely surrender on June 2.

So far, the court has kept the application pending, which will be likely addressed on the same date.

This significant development coincides with a time, when supreme court has already reserved its verdict on Kejriwal’s plea. Which challenge his arrest by ED in connection to this case.

Later on, Friday, ED in its latest chargesheet has called Kejriwal and Aam Aadmi party as accused in the excise policy case. As per the probe agency, it is filed on the basis of irrefutable evidence’ which proves, that is ”key conspirator” in the money laundering case.

Meanwhile, Delhi’s chief minister Arvind Kejriwal has been granted interim bail till June 1st in money laundering case in connection with Delhi’s excise policy case.
Which challenges the court order for the denial of bail in Delhi’s excise policy case.

The bench of Justice Swarna Kanta Sharma has fixed the date of May 13 for further hearing into the matter. Thus, giving investigative agencies more time to file their responses.

Earlier, ED’s advocate Zoheb Hossain had asked for time; to file a reply in the matter and has further informed the court, investigation officer is already in the middle of filing another supplementary prosecution complaint in this case.

However, the court has also allowed Sisodia to meet his sick wife once a week under custody at his residence.

But later, the applications regarding weekly visits to wife were later dismissed by the trial court. Thus, halting weekly visits of Sisodia.

Later On, April 30, the Rouse Avenue court later dismissed the bail petitions of Sisodia for the second time in the case and said “This court is not inclined to admit the applicant to bail, either regular or interim, at this stage. The application under consideration is accordingly dismissed.”

Manish Sisodia has been in custody since February 26 2023. Later, he got arrested by ED after CBI.

As per both ED and CBI, many irregularities were committed during the modification of excise policy. Under which undue Favours were given to licensed holders.

Further adding that there was a alleged loss of Rs 144.36 crore to the exchequer.

Special judge Kaveri Baweja issued the order on Monday, stating that both bail pleas, in both the ED and CBI cases, were rejected. A detailed copy of the order is awaited.

Senior Advocates Dr Abhishek Manu Singhvi, Vikram Chaudhari, along with advocates Nitesh Rana, Mohit Rao, and Deepak Nagar, represented K Kavitha in the matter.

In her plea, K Kavitha alleged that the ruling party at the Centre is employing investigative agencies to publicly link her to the Delhi Excise policy, aiming for further coercive actions against her. She argued that the investigating agencies are fully aware that there is no basis to the allegation of her involvement in the supposed scam. The petitioner contends that the intent behind the investigation against her is not to establish her role in the alleged scam, as it is evident that she is not involved.

Kavitha, currently in judicial custody for her alleged involvement in a money laundering case linked to the excise policy scam, was initially arrested by the ED from her residence in Banjara Hills, Hyderabad, on March 15. Later, on April 11, she was arrested by the CBI from Tihar jail.

Kavitha’s father and former Telangana Chief Minister K Chandrashekhar Rao denied all allegations against her in the Delhi excise policy case. He accused the Centre of orchestrating the scam to assert control over the Aam Aadmi Party and Bharat Rashtra Samithi (BRS). Rao argued that his daughter is innocent and criticized the prolonged detention of “such prominent leaders.”

Earlier the ED and CBI alleged irregularities in the modification of the excise policy, accusing the “prime suspects” of favoritism towards license holders, fee waivers or reductions, and unauthorized extensions of licenses.

In a related development, the Rouse Avenue Court dismissed the second bail petition of AAP leader Manish Sisodia, implicated in the Delhi excise policy scam, on April 28. Sisodia, in custody since February 26, 2023, sought bail citing trial delays in both CBI and ED cases. This was the second time his bail plea was rejected, following the dismissal of his first plea on March 31, 2023.

The case revolves around allegations of money laundering, with the ED actively probing various aspects of financial irregularities. Manish Sisodia, a prominent leader within the AAP and the Deputy Chief Minister of Delhi, has been under scrutiny in connection with this case.

During the court proceedings, arguments were presented regarding the need for further custody to facilitate a thorough investigation into the alleged financial misconduct. The court considered these arguments and decided to extend the judicial custody of Sisodia, Nair, and the other accused until the 8th f May.

This extension underscores the complexity and seriousness of the allegations being investigated by the ED. The authorities continue to gather evidence and conduct inquiries to establish the facts surrounding the alleged money laundering activities.

</excerpt>

Amidst the clash caused by the insulin between Tihar jail and Arvind Kejriwal, Delhi court on Monday directed All India Institute of Medical Science (AIIMS) to form medical board to medically examine the sitting CM of Delhi.

As per ANI, the medical shall also decide the diet chart and the exercise plan of the AAP supremo. Further declaring that there should be no deviation from the prescribed plan.

Recently Kejriwal on Monday had written to the superintendent of Tihar Jail alleging that he has been asking for insulin every single day and the doctors of AIIMS never said there is no need to worry about his condition. Days after Tihar administration statement that neither the issue of insulin was raised by Kejriwal, nor it was suggested by the doctors.

The CM of Delhi further claimed that Tihar administration is under political pressure.

So far, there is no comment or reaction from the Tihar authorities yet.

Arvind Kejriwal was arrested by Enforcement directorate on 21st Mrach 2024. In relation to the Delhi excise policy case. And is in judicial custody since 1st April.

</excerpt>

Chief Minister and Aam Aadmi Party (AAP) leader Arvind Kejriwal’s appeal, which challenges nine summonses from the Enforcement Directorate (ED) and his subsequent remand by the investigative body in connection with the excise policy-related money laundering case, will be heard by the Delhi High Court on Monday, April 22.

After being summoned to appear before the ED, Arvind Kejriwal requested and was denied interim protection against coercive measures by the High Court. On March 21, the ED arrested him. The national convenor of the AAP has also contested the constitutionality of some of the Prevention of Money Laundering Act’s sections pertaining to detention, questioning, and bail.

In his plea, Kejriwal raises several issues, including whether political parties fall under the purview of anti-money laundering legislation. He contends that the arbitrary application of the PMLA aims to unfairly influence the electoral process in favor of the ruling party at the Centre during the general elections.

A bench comprising Justices Suresh Kumar Kait and Manoj Jain will preside over the proceedings.

On March 23, a day subsequent to his arrest, Kejriwal approached the High Court, alleging a violation of his fundamental rights by the ED, and politicization of the action. However, the court dismissed the plea on April 9, stating that the arrest was lawful as Kejriwal’s repeated refusal to comply with summonses left the probe agency with little choice. The court concluded that the ED had adequate evidence to justify the arrest, asserting that Kejriwal’s actions compelled the timing of his arrest.

Kejriwal subsequently appealed to the Supreme Court, challenging the High Court’s decision. The Supreme Court issued a notice to the probe agency and scheduled the hearing after April 29, denying interim relief to the chief minister.

Meanwhile, the Rouse Avenue Court in Delhi extended the judicial custody of Kejriwal, currently detained at Tihar Jail, until April 23.

</excerpt>

Following his release from prison, Aam Aadmi Party MP Sanjay Singh remarked that it was not a moment for celebration but rather a time to “fight” especially considering that other AAP leaders, including the “topmost leader” Arvind Kejriwal, are incarcerated.

Singh, who had been imprisoned for over six months in connection with the alleged excise policy case, was freed from Tihar jail on Wednesday following the Supreme Court’s grant of bail a day earlier.

“This is not a time of celebration but a time of war. We all have to struggle together. The topmost leader of our party, Arvind Kejriwal, is in jail. Manish Sisodia and Satyendar Jain are also in jail. We have a long fight ahead,” he said.

“We have to go amongst the people of Delhi, wherever the AAP candidates and the INDIA bloc candidates are fighting in the upcoming general elections. We have to work hard to defeat the dictatorial government. We have to throw them out of power,” he added.

He also mentioned that he needs to focus on devising the election strategy and roadmap, emphasizing his commitment to providing support for the candidates from the INDIA bloc.

“Let’s get ready to fight,” he said.

In the meantime, Singh visited Manish Sisodia’s residence, where he met with Sisodia’s wife and other relatives.

Earlier, Sanjay Singh raised the slogan “Jail ke taale tootenge, Arvind Kejriwal chootenge”.

Hailing Delhi Chief Minister and AAP national convenor, Arvind Kejriwal, who is currently serving jail in the case, Singh said, “Jail ke taale tootenge, Arvind Kejriwal chootenge.”

As soon as Singh emerged from jail, he was greeted with loud cheers and slogans. The AAP leader climbed onto a vehicle parked outside the jail and addressed the assembled supporters. Earlier on Tuesday, Singh had been granted bail by the Supreme Court in the money laundering case linked to the Delhi excise policy scam.

The three-judge bench of Justices Sanjiv Khanna, Dipankar Datta, and PB Varale specified that the concession made by the probe agency should not be treated as a precedent.

This decision marks Sanjay Singh as the first senior AAP leader to receive regular bail in the money laundering case associated with the now-defunct liquor policy.

</excerpt>

Targeting Delhi Chief Minister Arvind Kejriwal for his refusal to step down on “moral grounds” following a court’s decision to send him to judicial custody in an alleged money laundering case related to the Delhi excise policy, Bharatiya Janata Party (BJP) MP Sudhanshu Trivedi referenced the instance of former Bihar Chief Minister Lalu Prasad Yadav resigning before his incarceration.

“Lalu Prasad Yadav had at least resigned when he was about to go to jail, but he has not resigned yet,” Trivedi remarked during a press conference today. The Aam Aadmi Party (AAP) is part of the INDIA bloc, in which Lalu Prasad Yadav’s Rashtriya Lok Dal (RLD) is also a partner.

Criticizing opposition parties that have labeled Kejriwal’s arrest as a political conspiracy by the BJP, Trivedi remarked, “Those who try to portray the bogey of victimhood, I would like to underline that today’s judgement of the court is based on concrete evidence of which neither we nor anyone else is privy.”

“It is the jurisprudence of the court that has decided to extend this judicial custody for 15 days. Now it raises certain moral and constitutional questions,” the senior BJP MP said as the Rouse Avenue Court sent Kejriwal to judicial custody till April 15 today.

Referring to Kejriwal’s mentor, Anna Hazare, Trivedi said, “His guru had vowed not to enter into politics. But the student not only entered politics but also became the Chief Minister.”

“Yesterday, there was another rally where he changed his ‘Guru’. His guru became Lalu Prasad Yadav,” Trivedi said, taking a dig at the INDIA bloc meeting held on Sunday.
The senior BJP MP further said, “There are media reports that Arvind Kejriwal has mentioned that the prime accused Vijay Nair used to report to Atishi and Saurabh Bharadwaj.”

Trivedi noted that the AAP involvement in the liquor policy case is becoming apparent, and it remains to be seen what course of action he takes regarding his Chief Ministership.

“The Delhi Government’s situation over liquor policy is becoming clearer and clearer. It has to be seen if Kejriwal resigns or heads towards a new politics,” the BJP leader said.

The AAP has reiterated that Kejriwal will continue to govern Delhi, maintaining his position even during his time in jail.

</excerpt>

A protest by the Aam Aadmi Party (AAP) resulted in the detention of demonstrators outside the Patel Chowk metro station on Tuesday, expressing opposition to the arrest of its convenor and Delhi Chief Minister Arvind Kejriwal.

Among those apprehended was Harjot Singh Bains, a Punjab Minister and AAP leader. Prior to this, Delhi police made announcements outside the Patel Chowk Metro station declaring the absence of permission for protests. They invoked Section 144 of the CrPC, prohibiting gatherings of four or more individuals in an area, and demanded clearance of the area within five minutes.

In anticipation of AAP’s “gherao” protest at the Prime Minister’s residence over Kejriwal’s arrest in a liquor policy case, security measures were intensified, with police deployment outside the Patel Chowk metro station.

Simultaneously, the BJP staged a protest in the capital, demanding Kejriwal’s resignation as Chief Minister. BJP leader Manjinder Singh Sirsa accused Kejriwal of orchestrating a diversion from an alcohol scandal and operating from custody, urging action against falsified documents.

As AAP called for a “gherao” at Prime Minister Narendra Modi’s residence, paramilitary personnel in anti-riot gear were stationed along the route to the PM’s residence and outside the Patel Chowk metro station. Deputy Commissioner of Police, Devesh Kumar Mahla, emphasized the absence of permission for AAP’s protest and announced ample deployment to maintain law and order.

The Lok Kalyan Marg Metro Station remained closed until further notice in light of AAP’s protest plans, with gate no. 3 of Patel Chowk Metro Station and gate no. 5 of Central Secretariat Metro Station similarly closed.

Additionally, the INDIA bloc is planning a rally on March 31 to protest Kejriwal’s arrest by the Enforcement Directorate. Kejriwal was remanded to ED custody until March 28 following his arrest on March 21 in connection with the Delhi Excise Policy case tied to money laundering allegations.

The case revolves around purported irregularities and money laundering in formulating and implementing the Delhi excise policy in 2022, subsequently annulled. Manish Sisodia and Sanjay Singh, senior AAP leaders, are currently in judicial custody related to the excise policy case. Sisodia was arrested by the CBI on February 26, 2023, while Sanjay Singh, a Rajya Sabha member, was arrested by the ED on October 5 last year.

</excerpt>

Bharat Rashtra Samithi (BRS) lawmaker K Kavitha appeared before the Rouse Avenue Court in New Delhi on Saturday in relation to the alleged money laundering case linked to the Delhi excise policy. Kavitha, a Member of the Legislative Council (MLC) and the daughter of BRS founder and former Telangana Chief Minister K Chandrasekhar Rao, was taken into custody following a day-long interrogation and a raid at her Hyderabad residence on Friday.

Before her court appearance, Kavitha stated to reporters, “it is an illegal arrest.” She was presented before Special Judge MK Nagpal at the Rouse Avenue court.

In the arrest order, the Enforcement Directorate (ED) investigation officer stated, “I believe that Smt. Kalvakuntla Kavitha…has been guilty of an offence punishable under the provisions of Prevention of Money Laundering Act, 2002 (15 of 2003).” The officer further added, “Now, therefore, in exercise of the power conferred upon me…I hereby arrest the said Smt. Kalvakuntla Kavitha…”

This action follows nearly two months after the ED issued a summons to the 45-year-old BRS leader. She had been questioned three times last year in connection with this case, with her statement recorded under the Prevention of Money Laundering Act (PMLA).

Earlier today, Delhi Chief Minister Arvind Kejriwal also appeared before the Rouse Avenue Court in the national capital in response to an Enforcement Directorate summons. The court later granted him bail in both complaints filed by the Enforcement Directorate.

Additional Chief Metropolitan Magistrate (ACMM) Divya Malhotra granted bail to the Delhi CM, with bail set at Rs 15,000 and a surety of Rs 1 lakh.

Kejriwal’s appearance followed summons issued to him based on two complaints by the ED regarding the Delhi Excise Policy case. The court reserved an order on the stay of summons issued to Kejriwal on complaints filed by the ED.

</excerpt>

The Enforcement Directorate (ED) is conducting searches at roughly ten places, including the home of Delhi Chief Minister Arvind Kejriwal’s personal secretary, among others associated with the Aam Aadmi Party.

According to sources, the raids are part of the agency’s ongoing money laundering investigation. An ED raid is also apparently underway at AAP MP ND Gupta’s residence in Delhi. More information about Tuesday’s raids is awaited.

These raids come as the agency filed a complaint in a Delhi court against AAP national convenor Arvind Kejriwal for failing to appear for a summons for the fifth time in a matter related to the Excise policy.

On February 3, the ED filed a complaint at Rouse Avenue Court against Delhi Chief Minister Arvind Kejriwal for failing to comply with the agency’s summons in the Delhi liquor policy money laundering case.

After hearing the submissions on Saturday, the Additional Chief Metropolitan Magistrate, Divya Malhotra, scheduled the remaining statements and consideration of the agency’s fresh complaint for February 7.

On February 3, the ED filed a new complaint case under Section 190 (1)(a) Cr.P.C. r/w. Section 200 Cr.P.C., 1973 r/w. Section 174 IPC, 1860 r/w. Section 63 (4) of PMLA, 2002 for non-attendance in accordance with Section 50 of PMLA, 2002.

On February 2, 2024, Delhi Chief Minister Arvind Kejriwal ignored the Enforcement Directorate’s summons for the seventh time in connection with the money laundering investigation into irregularities in the Delhi excise policy 2021-22 case.

The new summons to the Delhi Chief Minister came after he ignored the fourth summons on January 18.The party stated that omitting the fifth summons was “unlawful.” “Kejriwal has so far skipped four previous summons issued by the ED on January 18, January 3, November 2, and December 22, calling them “illegal and politically motivated.”

Earlier this month, a team from the Delhi Crime Branch went to Arvind Kjeriwal’s residence in civil lines and presented him with a notice to join a probe into claims that the BJP attempted to “poach” MLAs to destabilize his government.

</excerpt>

Raghav Chadha, Rajya Sabha MP of the Aam Aadmi Party, has been named in the Enforcement Directorate’s supplementary chargesheet in the Delhi liquor excise policy case.

However, Chadha stated that he has not been named as an accused or a suspect in any complaint filed by the central agency as he said “I have not been named as an accused or even a suspect in any of the complaints filed by ED.

“There are no allegations whatsoever against me in the said complaints. It appears that in the complaint my name is mentioned as an attendee to some meeting, though the basis of making such an allegation is not clear.”

According to the chargesheet filed by the ED, C Arvind, Manish Sisodia’s then-secretary, stated in his statement that Raghav Chadha was also present in a meeting held at Manish Sisodia’s residence.

The chargesheet reads that “In the meeting held at former Deputy Chief Minister Manish Sisodia’s residence, in which Raghav Chadha, ACS Finance of Punjab Govt, Excise Commissioner, Varun Roojam, FCT and officers from Punjab Excise and Vijay Nair was also present.”

The ED also claimed in its prosecution complaint that Hyderabad-based businessman Arun Ramchandra Pillai, who is currently in judicial custody, made false statements during the investigation in violation of Section 50 of the Prevention of Money Laundering Act (PMLA), 2002.

</excerpt>

The Rouse Avenue Court on Thursday extended Manish Sisodia’s judicial custody in the CBI case involving alleged irregularities in the now-scrapped excise policy until May 12.

While extending judicial custody, Special Judge MK Nagpal also directed the CBI to provide an e-copy of the supplementary chargesheet filed by it on April 25. Manish Sisodia’s lawyer, Advocate Rishikesh, argued that because of an “incomplete chargesheet/incomplete investigation,” his client is entitled to “statutory/default bail” under Supreme Court guidelines.

“Prima facie it seems the agency is saying that further investigation is required/pending. Therefore, we reserve the right to file an application for statutory bail,” he said.

The Delhi High Court asked the CBI why they had not mentioned that the investigation into Sisodia had been completed. “You say you have filed a supplementary chargesheet (in the stipulated time), but you have said the investigation is pending in the case. Why have you not mentioned that the chargesheet is filed on completion of the investigation against Sisodia?”

The court noted Sisodia’s counsel’s submission that they need a copy of the chargesheet to determine whether the investigation into Sisodia is complete. It stated that, while this is not the time to provide a copy of the chargesheet, an e-copy of the same should be provided.

The court noted that the bail hearing in the CBI case is still ongoing in the Delhi High Court and that “aspects from this” could be used to seek bail in the High Court.

</excerpt>

In a significant development in the Delhi excise policy case, Delhi Chief Minister Arvind Kejriwal has been summoned for questioning by the Central Bureau of Investigation (CBI).

The national convenor of the Aam Aadmi Party (AAP) has been summoned for questioning. This development comes as former Delhi Deputy Chief Minister Manish Sisodia remains in judicial custody in the same case.

Sisodia was arrested by the ED and CBI as part of an ongoing investigation into alleged irregularities in the formulation and implementation of GNCTD’s excise policy.

On February 26, 2023, the CBI arrested Sisodia in the liquor policy case. After hours of questioning at Tihar Jail, the ED arrested him on March 9.

Following the arrest of Sameer Mahendru, Managing Director of Delhi’s Jor Bagh-based spirits distributor Indospirit Group, in the case, the ED raided nearly three dozen locations in Delhi and Punjab in October and later arrested him. Early this week, the CBI also filed its first charge sheet in the case.

</excerpt>

Former Delhi Deputy Chief Minister and AAP leader Manish Sisodia will appear in court on Monday in a case involving alleged irregularities in the Union Territory government’s excise policy formulation and execution.

Sisodia is scheduled to appear in court today at 2 p.m. Earlier on March 31, the Special Court denied Manish Sisodia’s bail application, stating that the evidence gathered thus far by the CBI not only shows the applicant’s active participation in the aforementioned criminal conspiracy, but also shows the applicant’s prima facie commission of some substantive offences under the Prevention of Corruption (PC) Act.

The court said that there is also nothing apparent on record to infer or show that Sisodia’s arrest, in this case, was illegal or violative of any directions of the Supreme Court or the High Courts and rather, the material placed before this court by the CBI justifies the arrest of the applicant in the case.

Sisodia, in his bail petition in a trial court stated that no fruitful purpose would be served to keep him in custody as all the recoveries in the case have already been made.Sisodia also stated that he joined the investigation as and when called for by the CBI. The other accused persons arrested in this case have already been granted bail, Sisodia noted further, adding that he held the important constitutional post of deputy chief minister of Delhi and has deep roots in the society.

However, Sisodia later tendered his resignation as deputy CM in light of his arrest in the liquor policy case.

The CBI, represented by advocate DP Singh, opposed Sisodia’s bail plea stating, “If he is granted bail this will scuttle and compromise our investigation as the influence and interference are writ large,” CBI said.

The agency further claimed that Sisodia said he destroyed phones because he wanted to upgrade but nothing of the kind happened. “According to us, he did this to destroy the chat. He (Manish Sisodia) might not be at a flight risk, but he is a definite risk who will destroy evidence, this cannot be ignored,” CBI added, opposing Sisodia’s bail plea.
The CBI also submitted that between March 14-17, 2021, the South Group was residing in Oberoi, adding that they prepared a note and took a printout.
