</excerpt>

A 20-year-old woman, Elizabeth Benassi, has been awarded £30,000 (₹32,20,818) in compensation after being unfairly dismissed for wearing trainers to work. Benassi, who joined Maximus UK Services in 2022, argued that she was singled out for her footwear, even though other colleagues wore similar shoes without any issues.

Claims of Age-Based Discrimination

Benassi, who was 18 when hired, testified at an employment tribunal in Croydon, South London, stating that she was treated like a child by her manager for wearing trainers. She claimed that she was unaware of the company’s dress code and was unfairly targeted, especially as she was the youngest employee at the company.

Tribunal Ruling and Compensation

The tribunal ruled in Benassi’s favor, awarding £29,187 in compensation for victimization. Employment Judge Forwell criticized the company’s handling of the situation, highlighting the unfairness of the dismissal, especially considering Benassi was new to the role and might not have known the dress code.

Broader Concerns About Age Discrimination

Although Benassi’s claim of age-related harassment was dismissed, the tribunal’s ruling raised concerns about how young employees are treated in professional settings. Maximus UK Services denied wrongdoing, but the case has sparked discussions on fair treatment in the workplace, particularly for younger workers.

</excerpt>

First Victims of UK Blood Scandal Offered Compensation

The UK blood scandal, one of the most significant public health controversies of the late 20th century, left thousands of individuals with devastating health issues due to the tainted blood they received in the form of transfusions. These transfusions, largely administered during the 1970s and 1980s, were meant to save lives. However, they ended up causing irreparable harm. The blood products, which were primarily sourced from donors in the United States, were contaminated with viruses such as HIV and hepatitis C. This scandal has forever altered the lives of those involved, and the long fight for justice has spanned decades.

In recent years, there has been a long-awaited acknowledgment of the suffering caused by this scandal. The UK government has offered compensation to the first victims of this crisis, marking a significant step in addressing the decades of pain and injustice faced by those who were affected. While the compensation offer is a crucial gesture, it also highlights the extent to which this scandal has been neglected by authorities for so long.

This article delves into the UK blood scandal, exploring the impact it had on victims, the subsequent cover-ups, and the eventual compensation offer. It also considers the importance of transparency, accountability, and the need for ongoing efforts to ensure that no one ever faces such a tragic situation again.

The UK Blood Scandal

The origins of the UK blood scandal can be traced back to the 1970s and 1980s when blood products were sourced from paid donors in the United States. At the time, the blood used for transfusions was not rigorously screened for viruses, and many of the blood donations were from high-risk groups, including individuals with a history of drug use or unprotected sex.

As a result, a large number of recipients of these blood products were exposed to life-threatening viruses, most notably HIV and hepatitis C. In the early years of the crisis, many of the affected individuals were unaware of the risks associated with receiving blood transfusions, as the contamination was not known or understood at the time.

By the mid-1980s, scientists and healthcare professionals began to understand the connection between contaminated blood products and the transmission of these viruses. The damage was already done for thousands of patients who had unknowingly received infected blood. As a result, many of these individuals contracted HIV, hepatitis C, and other viral infections that led to chronic illnesses, lifelong disabilities, and, tragically, premature death.

The UK government, along with health authorities, initially downplayed the risks associated with contaminated blood products and failed to take adequate action to prevent further harm. Victims were often left in the dark about the cause of their illnesses, with many being stigmatized and marginalized by society. This lack of transparency and accountability led to decades of suffering and frustration for the victims and their families.

The Long Struggle for Justice

The victims of the UK blood scandal were forced to fight for recognition and justice over the course of many years. Early efforts to raise awareness about the issue were met with resistance, as authorities downplayed the scale of the crisis and attempted to suppress information about the contaminated blood products. Many victims faced rejection from their own communities, as the stigma surrounding HIV and other diseases led to discrimination and isolation.

A key turning point in the fight for justice came in 1991, when the UK government established an inquiry into the blood scandal. The inquiry, which was led by Lord Archer, sought to determine the extent of the contamination and the role that health authorities had played in the crisis. However, the inquiry was criticized for being insufficiently thorough, with many victims feeling that their voices were not heard, and important evidence was overlooked.

Over the years, various individuals and organizations, including patient advocacy groups, fought tirelessly for a more comprehensive investigation into the scandal and for the victims to receive proper compensation. These efforts were hampered by a lack of political will, as well as the long-standing stigma surrounding the issues of HIV and hepatitis C. Many of the affected individuals were told that their illnesses were the result of their own behavior, further compounding the pain and injustice they felt.

Despite the lack of action from authorities, the voices of the victims and their supporters continued to grow louder. In the 2000s, as awareness of the extent of the blood scandal increased, pressure mounted on the UK government to provide compensation for those affected by the crisis. The campaign for justice gained momentum, and several high-profile legal battles were fought in an attempt to hold those responsible accountable.

The Offer of Compensation

After decades of waiting, the UK government finally acknowledged the suffering of the victims of the blood scandal and offered compensation to the first group of affected individuals. This offer, while a long-awaited victory for those involved, came after years of emotional and financial strain on the victims and their families.

In 2021, the UK government announced that it would offer compensation to the first group of victims who had been infected with HIV and hepatitis C through contaminated blood products. The offer came after the UK’s Infected Blood Inquiry, which was established in 2017, had uncovered significant evidence of negligence and misconduct by health authorities. The inquiry revealed that the authorities had known about the risks of contaminated blood products for years but had failed to take appropriate action.

The compensation scheme was designed to provide financial support to those who had been infected with HIV or hepatitis C as a result of receiving contaminated blood products. The scheme included both lump-sum payments and ongoing financial support, depending on the severity of the victim’s condition. It also acknowledged the pain and suffering experienced by the victims and their families, providing a form of restitution for the harm caused.

For many victims, the compensation offer was a bittersweet victory. While the financial assistance was important, it could never undo the physical and emotional toll of the years spent fighting for justice. The damage caused by the contaminated blood products was irreversible for many, and the compensation could never fully make up for the lost years of health, opportunity, and happiness.

Nonetheless, the compensation offer marked a significant step in acknowledging the suffering of the victims and providing them with some form of recognition. It was also a victory for the advocacy groups and individuals who had worked tirelessly to bring attention to the scandal and demand justice for the victims.

Ongoing Challenges and the Need for Continued Support

While the compensation offer is an important step, it is only one part of the broader effort to address the legacy of the UK blood scandal. For many victims, the damage caused by contaminated blood products has been life-changing, and ongoing support is needed to help them cope with the long-term consequences of their illnesses.

Many of the victims continue to face significant health challenges as a result of the viruses they contracted. HIV and hepatitis C are chronic conditions that require ongoing treatment and management, and many victims have developed other health complications as a result of the infections. Additionally, the emotional and psychological toll of living with a stigmatized illness has been profound for many individuals and their families.

Furthermore, many victims have faced financial hardship as a result of their illnesses. The cost of medical treatment, along with the loss of income due to illness, has left many individuals struggling to make ends meet. The compensation scheme, while helpful, cannot fully address these financial burdens, and continued support from the government and healthcare system is necessary to ensure that victims are able to live with dignity and security.

Another key challenge is ensuring that the voices of the victims are heard and that their stories are not forgotten. The UK blood scandal has left a lasting mark on the healthcare system, and it is essential that the lessons learned from this tragedy are not ignored. The government must continue to invest in research, education, and support programs to ensure that such a scandal never happens again.

The UK blood scandal has highlighted several important lessons about transparency, accountability, and the need for vigilance in healthcare. First and foremost, it underscores the importance of ensuring that medical products are rigorously tested for safety before they are administered to patients. The contaminated blood products that caused the scandal were not adequately screened for viruses, leading to widespread harm. This failure to prioritize patient safety resulted in thousands of preventable infections and deaths.

The scandal also highlights the importance of government accountability in the healthcare sector. For years, the UK government and health authorities failed to acknowledge the risks associated with contaminated blood products, and they downplayed the scale of the crisis. In the aftermath of the scandal, it is crucial that public health officials are held accountable for their actions and that steps are taken to prevent similar tragedies from occurring in the future.

Finally, the scandal underscores the need for support and compassion for those affected by healthcare failures. The victims of the blood scandal were left to fight for justice on their own, often facing stigmatization and isolation. It is essential that those affected by healthcare disasters are given the resources and support they need to recover and rebuild their lives.

The UK blood scandal remains one of the most devastating public health crises in modern history. While the offer of compensation to the first victims is an important step in addressing the injustice caused by this scandal, much more needs to be done to support those affected and ensure that such a tragedy never occurs again. The fight for justice continues, and it is crucial that the government, healthcare providers, and advocacy groups work together to provide the necessary resources, recognition, and accountability for the victims of the blood scandal. Through continued efforts, it is hoped that those affected can finally find the support and justice they deserve.

</excerpt>

The British government announced on Thursday that it will allocate 75 million pounds ($96 million) to compensate LGBTQ military veterans who were dismissed from the armed forces due to their sexual orientation.

Until a reform in 2000, lesbians, gays, bisexuals, and transgender people were barred from serving in the British military. Those discovered to be LGBTQ often faced harassment, abuse, and dismissal, as highlighted in a government-commissioned report released last year.

In an effort to right these “historic wrongs,” former armed forces members or employees who were sacked due to their sexuality or gender identity will each be eligible for a £50,000 compensation, a larger amount than originally anticipated, according to the Defence Ministry.

“The historic treatment of LGBT veterans was a moral stain on our nation. Our government is determined to right the wrongs of the past and recognise the hurt that too many endured,” Defence Secretary John Healey said in a statement.

Beyond losing their jobs and enduring public humiliation, many veterans had their pension benefits stripped, resulting in lives lived in poverty. “We fully welcome our LGBT veterans back into Defence, and acknowledge their vital contribution to keeping the nation safe,” said Minister for Veterans Alistair Carns.

Additional compensation ranging from £1,000 to £20,000 will be provided based on the individual suffering, including instances of harassment, brutal interrogations, or imprisonment, officials said.

Veterans will also have the option to request the reinstatement of their military rank and medals.

While Parliament is set to debate the measure on Thursday, veterans can already begin submitting their compensation requests online.

A report commissioned by the Conservative Party government in July 2023 revealed the “horrendous” treatment of LGBTQ veterans who served between 1967 and 2000. On the day the report was published, then-prime minister Rishi Sunak issued an apology on behalf of the government and initiated the process that led to Thursday’s reparations announcement.

</excerpt>

A 21-year-old man from China, identified by his surname Jiang, has been arrested for scamming over 60 hotels by falsely claiming unsanitary conditions in order to receive free stays and compensation. Jiang, who had checked into over 300 hotels in the past 10 months, was able to manipulate hotel staff into giving him refunds or free nights by fabricating complaints about the cleanliness of the establishments.

The Deceptive Scheme

Jiang’s scam was exposed after investigations revealed that he intentionally planted items such as cicadas, dead cockroaches, used condoms, and strands of hair at various hotels. He would then report these findings, accusing the hotels of providing unhygienic conditions and threatening to expose them online if they didn’t offer him free accommodation or compensation.

The man’s actions were part of an elaborate scheme to secure financial benefits to help fund his education and enroll in college. By exploiting minor flaws or even planting bugs and debris himself, Jiang was able to successfully scam hotels for nearly a year.

How the Scam Unfolded

According to reports from the South China Morning Post, Jiang’s tactic involved staying at hotels across the country and planting evidence to support his fabricated complaints. His goal was to force the hotels into providing compensation, either in the form of free stays or monetary refunds, in order to avoid negative reviews and potential damage to their reputation.

In total, Jiang scammed a total of 63 hotels, managing to extort approximately $5,200 (Rs 4.40 lakh). His actions were reportedly driven by a desire to fund his education, as he had been trying to save enough money to enroll in a college.

Police Investigation and Arrest

Jiang’s scamming spree finally came to an end when he was arrested during one of his recent hotel stays. Police uncovered the full extent of his deceptive practices and revealed that he had been systematically exploiting hotels over several months. A local police officer commented on the situation, stating, “Jiang would exploit minor flaws or plant insects, bugs, and hair to threaten hotels with complaints or online exposure, demanding free stays or compensation.”

Authorities have now taken legal action against Jiang, who has been charged for his fraudulent actions. His case serves as a reminder of the lengths to which some individuals will go to deceive businesses and exploit situations for personal gain.

Hotel Industry’s Response

This case has sparked a discussion within the hotel industry regarding the need for stricter verification processes when handling guest complaints. Many businesses are now looking at ways to implement better methods of investigating complaints to prevent future scams and ensure they aren’t being taken advantage of by customers with malicious intent.

Jiang’s arrest sheds light on the growing issue of scam artists targeting hospitality businesses for personal gain. His actions not only cost hotels money but also damaged the trust between businesses and their customers. As the investigation continues, it raises important questions about how the hotel industry can safeguard itself from such fraudulent activities.

The woman, who uses the handle @GirlFromMalmo, received a text from the Swedish railways informing her of a 50% ticket refund in the form of a voucher. The railways also apologized for the inconvenience caused to the passengers.

“Why I don’t complain too much about taxes in Sweden,” she wrote.

According to the screenshot posted on X, the text reads, “The AC on your train is out of order. You will automatically be compensated for 50% of the ticket price in the form of a voucher that can be used to buy new SJ tickets. You will receive your voucher via email. We apologize for the inconvenience.”

The message further directed her to visit a website if she wanted to “rebook her journey free of charge” or “cancel and receive a refund.”

Public Reactions

One user commented, “It’s not about the tax you pay, it’s about the quality of life/value for tax that you get in return that people mostly complain about.” Another shared, “My train was delayed in London for 20 minutes, and I got a cheque as compensation sent to me in Australia!”

“Exactly! That accountability factor makes the difference,” expressed a third. The trains aren’t late like in Germany,” joined a fifth.

The incident highlights the contrast in public transport services and customer service standards between Sweden and other countries.

He emphasized that while severe cold and heatwaves are indeed considered natural disasters, the current regulations do not account for compensation in such cases. However, the Rajasthan High Court has taken proactive measures by directing the government to provide compensation for heatwave-related deaths. Addressing journalists at the Secretariat on Friday, Meena assured that steps would be taken to amend the existing rules. He expressed his intention to request the Chief Minister to draft a letter to the central government, proposing amendments to the State Disaster Response Fund (SDRF) guidelines. The objective is to ensure that individuals who succumb to heatwaves receive compensation comparable to that provided for other natural disasters, as no such provisions currently exist for heat-related fatalities.

Additionally, Dr. Kirori Lal Meena outlined various measures implemented in response to the severe heat conditions. The timing of the MNREGA program has been adjusted, and payment for work has been streamlined, considering 70 percent completion as equivalent to 100 percent. Night shelters have been established to accommodate those affected by extreme cold, while provisions such as shade, tents, and hydration solutions are being provided to combat dehydration. Meena expressed his intention to discuss these matters with Chief Minister Bhajanlal Sharma.

</excerpt>

The Delhi High Court has instructed the Delhi Government to establish a new policy within eight weeks for providing compensation to victims of fatalities or limb injuries resulting from the use of Chinese Manjha. The court has requested the government to present the policy in court.

The High Court expressed distress over the recurrent incidents where individuals are losing their lives and limbs due to Chinese Manjha annually.

The High Court has instructed the Delhi Police to take action against individuals involved in manufacturing and selling the Manjha. Additionally, the court has requested a report on this matter. Justice Subramonium Prasad issued this directive during the hearing of several petitions, noting that it seems the State Government has not yet formulated the policy, and no status report has been submitted by Delhi Police.

“The State Government is directed to frame the policy and file it in Court within eight weeks from today,” Justice Prasad ordered on April 29.

The High Court has summoned the most recent status report from the Delhi police. “Let the latest status report be filed as well by the Delhi Police showing the action taken against those persons who are manufacturing and selling Chinese Manjha from the year 2017 to 2024,” Justice Prasad directed.

The case has been scheduled for further hearing on August 23, 2024. The High Court noted that it has issued several orders instructing the respondents to take measures to prevent the sale of Chinese Manjha in the market.

“Though Orders under have been passed by this Court, this Court is pained to note that a number of persons are losing their life and limbs because of Chinese Manjha year after year,” Justice Prasad expressed his displeasure.

On August 9, 2023, the High Court instructed the Delhi Police to submit a status report detailing the actions taken against individuals involved in manufacturing and selling Chinese Manjha. Additionally, the State Government was directed to submit a comprehensive policy for compensating individuals who have suffered fatalities or limb injuries due to such accidents.

In April 2023, the Delhi High Court directed the Delhi Police to persist in their efforts to prevent the sale of prohibited Chinese Manjha in Delhi during the kite-flying season and the Independence Day period.

“It is directed that Delhi Police shall continue to take steps to restrain the sale of Chinese manjha in Delhi even during the forthcoming Independence Day period, which is the kite-flying season,” Justice Prathiba Singh said in the order passed on August 8.

The High Court also examined the status report detailing the measures implemented by the Delhi police to curb the sale of Chinese Manjha in the national capital.

“A perusal of the above would show that steps are being taken by the Delhi Police to stop the sale of Chinese manjha within the territory of Delhi. The Delhi Police have also interacted with the e-commerce websites and have sensitised them of the danger of selling Chinese manjha,” the bench noted.

The Delhi High Court was reviewing the petition filed by the relatives of four bikers whose deaths resulted from the use of Chinese Manjha, along with another petitioner. They have requested compensation from the Delhi Government and adherence to regulations and advisories issued by the authorities.

In February 2023, the bench instructed the crime branch to probe the four death cases that occurred in August 2021, July, and August 2022. FIRs have already been lodged.

The court had directed, ” The crime branch of Delhi police shall investigate the case and file a comprehensive Status and an affidavit within six weeks.”

The court specified that the status report should include details about the manufacturers/importers selling the Chinese Manjha, the markets where it is available, whether the shopkeepers are named as accused or not, and the status of the FIR or any other FIR filed.

The Indian government banned Chinese Manjha in 2017.

Following the chief minister’s directives, Narowal Deputy Commissioner Syed Hasan Raza and MPA Ahmad Iqbal visited the home of the victim, Muhammad Abubakar, in village Jasar. They offered their condolences to the grieving parents and conveyed the chief minister’s sympathies. On behalf of the chief minister, they presented a PKR 2.5 million cheque to Abubakar’s father, Fakhr Ayaz, according to Dawn.

MPA Ahmad Iqbal expressed the government’s shared sorrow with the victim’s family.

The incident occurred on April 18 when 23-year-old Abubakar tragically lost his life in an accident allegedly involving the chief minister’s protocol car on the Narowal-Shakargarh Road. Narowal police reports indicated that two motorcycles, one of which belonged to Abubakar, collided with each other, and subsequently, a ‘government vehicle’ struck him, resulting in his untimely demise.

Maryam Nawaz promptly took notice of the incident and requested a comprehensive report from the DC regarding the matter. Abubakar was employed at a filling station, while his father, Fakhr Ayaz, worked as a laborer. The chief minister also directed the authorities to take necessary legal actions against the driver of the official vehicle, Dawn reported.

Maryam’s motorcade was involved in another incident where it allegedly hit a motorcyclist while she was traveling from Narowal to Kartarpur for the three-day celebrations of the Baisakhi festival. Despite the accident, the CM’s motorcade did not stop to take the injured to the hospital.

Ali Rizwan, a cousin of the deceased, mentioned that Abubakar was heading from home to a filling station where he was employed. Upon hearing the news of his son’s death, Abubakar’s father, Fakhar Ayaz, fainted from shock and was subsequently treated at the District Headquarters Hospital, Narowal.

</excerpt>

Italian Prime Minister Giorgia Meloni has requested a compensation of 100,000 euros following the uploading of few deepfake videos of her online, according to a BBC report.

Meloni is set to testify in a Sassari court on July 2.

According to the BBC report, a 40-year-old individual, suspected of creating the videos, along with his 73-year-old father, are currently under investigation. They allegedly replaced Meloni’s face with that of an adult film actor in the purported video.

Both individuals now face defamation charges.

The suspects were reportedly located by authorities through tracing the mobile device used to upload the purported adult videos, as per the report.

Information provided by Meloni’s legal representative indicates that the videos were posted on an adult content site in the US, where they accumulated “millions of views” over numerous months. Significantly, the deepfake videos were uploaded prior to her assuming office as Prime Minister in 2022, as per the BBC report.

Maria Giulia Marongiu, Meloni’s lawyer, characterized the compensation requested by the Prime Minister as ‘symbolic’ and stated that if awarded, she would donate the amount to a fund to support women who have been victims of male violence.

“The compensation was meant to send a message to women who are victims of this kind of abuse of power not to be afraid to press charges,” the report quoted Marongiu as saying.

In compliance with Italian law, specific defamation cases can lead to criminal charges and potentially result in imprisonment.

Deepfake videos are a form of synthetic media where the appearance of a person in an existing image or video is substituted with the likeness of someone else.

Even in India, numerous deepfake videos featuring Bollywood actors such as Rashmika Mandanna, Katrina Kaif, Nora Fatehi, and others were posted on social media.

In November 2023, a deepfake video of Rashmika Mandanna gained traction on social media. The video depicted the face of British-Indian influencer Zara Patel, clad in a black top, which was digitally altered and substituted with that of the Bollywood actress. In January, Delhi Police apprehended a B-Tech graduate from Andhra Pradesh responsible for producing the video.

Speaking about the seal on outlets, Ashish Singh, District Magistrate of Indore, stated, “Following the instructions given by Chief Minister, a joint team of police and administration is being formed and checking is being done on firecracker factories, warehouses, and shops. They are also being sealed for not having a licence or not following safety standards. Six such institutions have been sealed.”

The crackdown on illicit fire manufacturers in Madhya Pradesh comes after a horrific blast and fire at a firecracker factory in Harda district that killed 11 people and injured 173.
On Tuesday morning, a large fire erupted inside a firecracker factory in the Bairagarh area of Harda district.

Due to the tremendous explosion, the entire neighborhood was shrouded in black smoke, with window glass of nearby residences and shops destroyed.
The catastrophe destroyed dozens of surrounding houses. Locals reported that it felt like an earthquake had struck Harda. The explosions also caused several automobiles to catch fire.
Earlier, authorities reported that three persons had been arrested in connection with the firecracker factory disaster.

Following the incident, MP Chief Minister Mohan Yadav declared Rs 4 lakh in compensation for each of the fatalities, as well as free treatment for the injured.
Prime Minister Narendra Modi also expressed condolences for the sad Harda factory blast and announced an ex-gratia of Rs 2 lakh from the Prime Minister National Relief Fund to each of the deceased’s next of kin. He also pledged Rs 50,000 to the injured.

There are reports of heavy damage to crops due to bad weather in North India. The crops of the farmers in many districts of Punjab were ruined, after which the farmers demanded compensation. Punjab Chief Minister Bhagwant Mann and several other officials personally visited the crop fields to assess the damage caused to the crops. After assessing the crops, he held a meeting with the officials.

Taking this to Twitter, CM Bhagwant Mann released a video on his personal account saying, ‘We have changed the method of compensation of the previous government, and now, unlike the previous government, we will not only announce the compensation but will also give it.’

He said that we will not distribute checks for Rs 54 or Rs 111, but farmers will be given timely compensation in a transparent manner. CM Bhagwant Mann said that earlier, 12 thousand rupees were given for 75 percent to 100 percent loss, but now 15 thousand rupees will be given for 75 percent to 100 percent loss. In the previous government, Rs 5400 was given for a 33 to 50 percent loss, but now Rs 6750 will be given.

Taking it to the CMO Punjab Twitter account, he said, “The laborer’s will get 10 percent as compensation, of which Rs 95,100 will be paid as compensation for complete house damage and Rs 5,200 will be given for minor damage to houses. The state government will soon introduce a crop insurance scheme for farmers”.

</excerpt>

The Supreme Court on Tuesday dismissed the Center’s curative plea for enhanced compensation for the victims of the 1984 Bhopal Gas tragedy from US-based firm Union Carbide Corporation, now owned by Dow Chemicals.

“The sum of Rs 50 crores lying with the Reserve Bank of India (RBI) shall be utilized by the Government of India to satisfy pending claims,” the Supreme Court said while dismissing the Center’s curative plea for enhanced compensation for the victims of the 1984 Bhopal Gas tragedy. The judgment was pronounced by a five-judge constitutional bench headed by Justice Sanjay Kishan Kaul. The bench also comprised Justices Sanjiv Khanna, Abhay S. Oka, Vikram Nath, and JK Maheshwari.

“If it is reopened, then it may open Pandora’s box and will be detrimental to the claimants. The curative petition cannot be entertained,” the court said. The court noted that the failure to take insurance policies is gross negligence on the part of the Indian government.

On January 12, the Supreme Court on Thursday reserved its verdict on the Center’s curative plea for enhanced compensation for the victims of the 1984 Bhopal Gas tragedy from US-based firm Union Carbide Corporation, now owned by Dow Chemicals.

The Center’s curative plea for enhanced compensation for the victims sought a direction to Union Carbide and other firms to pay an additional Rs 7,400 crore over and above the earlier settlement amount of USD 470 million (RS 715 crore at the time of settlement in 1989) for paying compensation to the gas tragedy victims.

The government sought a re-examination of the apex court’s February 14, 1989 judgment, which fixed compensation at USD 470 million, contending that the 1989 settlement was seriously impaired. The contention of the central government was that the compensation, determined in 1989, was arrived at on the basis of assumptions of truth unrelated to realities.

During the hearing, successor firms of the Union Carbide Corporation told the apex court that the depreciation of the rupee since 1989, when a settlement was reached between the company and the Center, cannot be a ground to now seek a top-up of compensation for the victims.

As protests by locals and hotel owners grew on Wednesday, the authorities in Uttarakhand’s sinking town of Joshimath stopped demolition work. As the authorities prepared to begin the Malari Inn’s demolition, the owner broke down in tears.

Residents of the area protested the government of Uttarakhand’s decision to demolish two hotels, Malari Inn and Mount View. Protesters demanded compensation in accordance with the master plan for Badrinath Dham.

The owners of the hotels that will need to be torn down will receive compensation based on market value, the government announced on Wednesday. The government will finish its assessment of the state of the homes within a week, and as of right now, just the two hotels—Malari Inn and Mount View Hotel—are scheduled to be demolished. Despite the fact that land subsidence is a long-standing problem in this region, Joshimath residents began reporting cracks in their homes in December. Within days, these cracks developed into a major catastrophe.

Every affected family would receive an instant payment of Rs 1.5 lakh as compensation for the loss of their home.
“723 houses have developed cracks. No other residential properties will be dismantled as of now. The two hotels will be dismantled carefully under the supervision of CBRI, “R Meenakshi Sundaram, Secretary to Uttarakhand CM, Pushkar Singh Dhami said.

The state government of Rajasthan came under fire from the Rajasthan high court for compensating victims who perished and were injured in a fire that followed a gas cylinder explosion at Bhungra in Jodhpur last month without justification or logic.

It asked whether a fixed sum should be given in all such cases or can the state settle on any amount regardless of the cause and nature of the deaths or accidents that too when there is no negligence on its part.

After the cylinder explosion on December 8 that started the protests, a fire broke out in Bhungra, killing 35 people. The demonstrators sought the highest level of compensation and government employment for the surviving family members of the deceased. Later, the state consented to provide 17 lakh compensation and jobs.

Sandeep Mehta and Kuldeep Mathur, two justices on a division bench of the high court, received the case after a single bench judge of that court took cognizance of it.

“The affidavit shall also indicate as to whether there exists any policy or guidelines for grant of compensation or jobs in the event of such accidents more particularly when the state’s negligence or involvement is completely absent.”

The single judge bench said uncertainty regarding the disbursement of the compensation and the quantum from the state coffers, which belong to the public, is a matter of concern. “…there seems to be no policy or guidelines on the basis whereof the funds of the state are being disbursed and jobs conferred.”

The bench said a large number of similar incidents have taken place and corresponding compensation paid also merits attention. It said the compensation needs to be paid judiciously and equitably.

Hundreds of villagers in Odisha’s Sundargarh district clashed with police on Saturday, demanding additional compensation for the land they had to give up for coal mining. This led to a fight between the villagers and the authorities. Additionally, they asked that Vedanta cease mining at a coal block that was assigned to the company.

Hundreds of displaced villagers barged in with two women from Jamkani village, Jema Gond and Seema Gond, whose land was being used for the bhumi pujan ceremony. However, 16 police platoons stopped them and used a mild lathi charge to scatter the crowd.

“We not only have lost agricultural income following the acquisition of our lands but have failed to find an alternate source of employment due to delays in mining operations. As the land was acquired for mining projects which did not start, the government washed off its hands and did not undertake any local development. We should be compensated under the new land acquisition law,” said Jema Gond.

The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act of 2013 was being invoked by the locals as justification for their claim for compensation.

Despite Vedanta’s further ex-gratia and compensation offer of Rs. 6 lakh per acre, the locals have refused to move, claiming that new land acquisition is required.

In accordance with the Land Acquisition Act of 1894, more than 800 hectares of land in the villages of Jamkani, Mendra, Girisuan, and Jharpalam in the Hemgir block of the Sundargarh district were initially purchased for the Jamkani coal block between 2006 and 2011 for Bhusan Power and Steel Ltd. It was given to Vedanta after Bhushan withdrew, and in February 2020, the company signed a Coal Mine Development and Production Agreement with the Ministry of Coal.

With regard to location, yearly capacity, reserves, and production readiness, the Jamkhani coal block is one of the most suitable coal blocks for the company’s Jharsuguda aluminium smelter plant.

An earlier lawsuit brought by a woman and 14 other residents of Jamkani village, who disregarded the Coal Bearing Areas (Acquisition and Development) Act of 1957, questioned the state government’s authority to use IDCO to purchase land for the coal block. According to the petitioners, land acquisition in coal-rich areas should only be left to the central government or its authorised agencies.

Sundargarh additional district magistrate (Revenue) Abhimanyu Behera, however, said the land acquisition was completed in 2011 and all the affected families have received compensation. “The demand for fresh land acquisition has no validity. IDCO has transferred the land to Vedanta and it can start mining,” Behera said.
