In an emotional and heartfelt farewell, Chief Justice of India DY Chandrachud retired from his esteemed judicial position on Friday, bringing an end to his remarkable tenure at the Supreme Court. During his final appearance in the court, Justice Chandrachud, known for his steady leadership and progressive judgments, took a moment to reflect on his journey. As the ceremonial proceedings unfolded, he expressed gratitude to all those who had supported him throughout his career and sought forgiveness from anyone he may have unintentionally hurt.

HAVE A LOOK AT THE POST:

A Personal Touch: ‘Pilgrims’ in the Court of Justice

The outgoing CJI reminisced about his early days in the judiciary, sharing that when he was young, he would visit the Supreme Court and gaze at the portraits of former justices. “We are here as pilgrims, birds for a short passage of time,” he remarked, emphasizing the transient nature of one’s time in such a prestigious institution. He also reflected on how, at one point, he had wondered about the empty courtroom at 2 PM, not foreseeing his eventual role in it. Justice Chandrachud’s humble words resonated with all present in the courtroom, underlining the collective responsibility of upholding justice.

Commitment to Justice Until the End

Despite the emotional weight of his final day, CJI Chandrachud remained fully committed to his judicial duties, as he had always been. Before the ceremonial bench was convened, he made it clear that he wanted to hear as many matters as possible, a testament to his dedication to justice. “I wouldn’t want to miss the opportunity to do justice till the last time possible,” he said, reinforcing his deep sense of duty to the court and its role in society.

A Thankful Goodbye and Apologies

In his closing words, Justice Chandrachud apologized to anyone he may have hurt during his tenure and thanked the lawyers present for their participation in the farewell. His remarks were met with a resounding acknowledgment from the legal community, including prominent figures like Abhishek Manu Singhvi and Kapil Sibal, who celebrated his legacy and praised his leadership. “It is this court that keeps me going,” he shared, before bidding farewell, leaving behind a lasting impact on the Indian judiciary.

End of an Era: A Dignified Transition

As the Chief Justice prepares to pass the torch to his successor, Justice Chandrachud’s farewell marks the end of an era in the Supreme Court. His legacy, characterized by a deep commitment to justice and fairness, will undoubtedly continue to inspire future generations of legal professionals.

The newly unveiled museum aims to spotlight the role of judicial institutions in delivering justice and upholding citizens’ fundamental rights.

A Vision of International Standards

Speaking at the event, CJI Chandrachud emphasized the year-and-a-half-long process of conceptualizing the museum, which was completed in a record six months. Highlighting its global standards, he said, “We thought that we must have not just a museum of artifacts, but a museum comparable to the best internationally, to project the importance of our institution and the high courts in delivering justice to our citizens and in protecting the fundamental rights of our citizens.”

Design and Execution by Experienced Team

Justice Chandrachud commended the museum designers, who also developed the Pradhanmantri Sangrahalaya and Teen Murti Bhawan. “The executors of this museum were already ahead of time. They had also designed the Pradhanmantri Sangrahalaya at the Teen Murti Bhawan, so they had all the experience of doing a modern museum of the highest international quality,” he stated, underscoring their expertise in bringing the project to fruition.

Describing the NJMA as an interactive space for the younger generation, Justice Chandrachud underscored its significance to the country. “This reflects the ethos of the Supreme Court and the importance of the court to the life of our nation. So on behalf of all my colleagues here, I have pleasure in dedicating this museum to the nation,” he declared.

Chief Justice Chandrachud, the 50th CJI of India, will retire on November 10. His successor, Justice Sanjeev Khanna, was confirmed by the central government in an October 24 notification.

Chief Justice of India (CJI) D.Y. Chandrachud recently addressed the controversy surrounding Prime Minister Narendra Modi’s visit to his residence for Ganpati prayers. He emphasized that there is “nothing wrong” with such visits. Moreover, he called for a sense of maturity in the political sphere regarding these interactions.

Opposition Raises Concerns

Following the PM’s visit, opposition parties, particularly Congress, raised concerns. They questioned the propriety and the separation of powers between the judiciary and the executive. In contrast, the BJP dismissed these concerns as unwarranted, asserting that such visits are part of Indian culture.

Importance of Dialogue

At an event hosted by the Indian Express, CJI Chandrachud explained the necessity of dialogue between the judiciary and the executive. He stated, “The separation of powers concept does not postulate that judiciary and executive are antagonists.” In this regard, he emphasized that these interactions are vital for discussing administrative issues, such as budgeting and technology.

Assurance of Judicial Independence

Regarding the PM’s visit, CJI Chandrachud remarked, “The PM visited my residence for Ganpati puja. I do feel there is absolutely nothing wrong.” He underscored that these meetings do not influence judicial decisions; rather, they form part of the broader interaction between institutions. Consequently, he called for political maturity to understand these relationships, expressing confidence in the impartiality of judges. He added, “What the separation of powers postulates is that the judiciary should not be performing the role of the executive.”

Personal Faith and Impartiality

In addition, CJI Chandrachud identified himself as a “person of faith” who respects all religions. He clarified that his faith does not influence his judgments. For instance, he recounted praying for a solution to the Ayodhya Ram Mandir dispute, explaining that faith can help maintain calm amid conflict.

Views on Past Controversies

CJI Chandrachud also discussed the 2018 press conference held by four Supreme Court judges against former CJI Dipak Misra. He stressed the importance of institutional discipline while also allowing for dialogue. Furthermore, when speaking about his successor, Justice Sanjiv Khanna, he expressed confidence that the court would be in capable hands.

Light-hearted Remarks

In a light-hearted moment, CJI Chandrachud joked about the possibility of including the Leader of Opposition in the Ganesh Puja photo. He stated that it was not a selection committee for key appointments, thereby emphasizing the nature of social visits during significant occasions.

Addressing Delays in Bail Cases

Responding to concerns regarding delays in hearing the bail plea of former JNU student Umar Khalid in the Delhi riots case, CJI Chandrachud noted that the court prioritizes bail cases to ensure personal liberty. Notably, he mentioned that over 21,000 bail cases have been filed since he took office, with many already disposed of.

Commitment to Justice

Finally, CJI Chandrachud reaffirmed that judicial decisions are based on thorough evaluations of each case, regardless of media portrayals. In conclusion, he asserted his commitment to impartiality in granting bail across various cases, stating that “speaking for myself, I have granted bail from A to Z.”

</excerpt>

As he nears retirement in a month, Chief Justice of India D.Y. Chandrachud expressed his concerns and reflections regarding his time in office. Speaking at the 3rd convocation ceremony of the Jigme Singye Wangchuck School of Law in Bhutan, he candidly shared his thoughts about the past and future, pondering questions like: Did I accomplish everything I intended? How will history evaluate my tenure? Could I have made different choices? What legacy will I leave for the next generation of judges and legal professionals?

Embracing Vulnerability

“Pardon me for being a little vulnerable. I will be demitting office as the Chief Justice of India in November this year, after having served my country for two years. As my tenure is coming to an end, my mind has been heavily preoccupied with fears and anxieties about the future and the past. I find myself pondering over questions such as: Did I achieve everything I set out to do? How will history judge my tenure? Could I have done things differently? What legacy will I leave for future generations of judges and legal professionals?”

He acknowledged that the answers to many of these questions lie beyond his control and that he might never find answers to some of them. However, he stated that he has dedicated himself to his role over the past two years, waking up every day with the intent to serve his country. “It is in this that I seek solace,” he added.

Transforming the Judiciary

During his nearly two-year tenure, Chief Justice Chandrachud has focused on transforming the Indian judicial system, making it more accessible to citizens, primarily through the use of technology. His time in office has been marked by significant reforms in judicial, institutional, and administrative frameworks, as well as delivering landmark rulings that uphold personal liberty, women’s rights, human rights, gender equality, the rights of the disabled, and environmental protection.

Reflecting on his journey, he said, “Like many of you, I also grew up as a child with an unrelenting passion to make a difference in the world around me. Driven by this insatiable zeal, I often pushed myself to extremes, habitually working long hours and carrying a heavy burden, as if the world’s problems rested solely on my shoulders. However, over the years, I have come to realize that our ability to contribute to our community is deeply rooted in our self-perception and capacity for self-care.”

The Importance of Well-Being

CJI Chandrachud emphasized the importance of prioritizing well-being and enjoying the journey rather than being fixated solely on the destination. He advised the graduates to occasionally reassess their paths and ask themselves, “Am I running towards a destination, or am I running towards myself?” He underscored the need for leaders driven by purpose, not just ambition.

Wisdom from Kipling

Towards the end of his address, the Chief Justice shared inspiring lines from Rudyard Kipling’s poem, If, encapsulating his message:

“If you can keep your head when all about you

Are losing theirs and blaming it on you,

If you can trust yourself when all men doubt you,

But make allowance for their doubting too;

If you can dream—and not make dreams your master;

If you can think—and not make thoughts your aim;

If you can meet with Triumph and Disaster

And treat those two impostors just the same;

If you can fill the unforgiving minute

With sixty seconds’ worth of distance run,

Yours is the Earth and everything that’s in it,

And—which is more—you’ll be a Man, my son! [or daughter!]”

Addressing Climate Concerns

CJI Chandrachud also highlighted the urgent need for environmentally conscious legal professionals amid India’s unprecedented climate crisis and unchecked economic growth. He emphasized that the traditional values of Indian and Bhutanese communities should not be seen as opposing modern democratic ideals like liberty, equality, and dissent. Instead, these values can complement and enhance contemporary constitutional principles.

He noted that India’s Constitution supports local governance through village panchayats and gram sabhas, intertwining these traditional mechanisms with modern political thought. The Chief Justice asserted that this tradition is crucial for fostering public debate in India’s democracy.

Bhutan’s Commitment to Environment

The Chief Justice praised Bhutan’s commitment to environmental stewardship, emphasizing that the Constitution of Bhutan designates every citizen as a trustee of the kingdom’s natural resources. He expressed admiration for the cultural and intellectual richness that Bhutan contributes, stating that the success of its legal institution would mark a significant milestone for both local and global legal communities.

“I am inspired by the blend of modern, technologically advanced legal education with deep-rooted cultural and ethical values. The immense focus on clinical education, which not only imparts technical skills but also inculcates ethical values and teaches students to appreciate traditional methods of dispute resolution, is a fascinating experiment,” he remarked.

Prime Minister Narendra Modi’s recent visit to Chief Justice of India (CJI) DY Chandrachud’s residence for Ganpati Puja has stirred a debate, with opposition leaders raising concerns about the judiciary’s independence. They questioned the propriety of such a visit and its impact on the transparency of the judicial system. Meanwhile, the Bharatiya Janata Party (BJP) defended the visit, framing it as part of Indian cultural and religious traditions.

Opposition Criticizes the Visit

Shiv Sena (UBT) MP Priyanka Chaturvedi was among those to criticize the visit. In a post on social media platform X, she wrote, “After the festivities are over hopefully CJI will deem fit and be slightly freer to conclude the hearing on Maharashtra and the blatant disregard of Article 10 of the Constitution in Maharashtra.” She seemed to question the timing of the judiciary’s actions, linking it with the upcoming elections.

BJP Leader Defends Modi’s Visit

BJP leader Shehzad Poonawalla responded strongly to these comments. In a video statement, he said, “The most shocking, despicable, and deplorable comment has been made by Priyanka Chaturvedi… Her claim that Prime Minister Modi’s visit to CJI Chandrachud’s house is influencing judiciary decisions is nothing short of contempt of court.” He emphasized that Modi’s visit was a cultural gesture, and accused the opposition of politicizing a religious occasion.

2009- PM Manmohan Singh's Iftaar Party was attended by then CJI KG Balakrishnan- Sshhhh – Yeh Secular hai.. judiciary is safe!

Reference to Past Events

Poonawalla also pointed out instances from the past where similar social gatherings took place, sharing a picture of former Prime Minister Manmohan Singh attending an Iftar party with then-CJI KG Balakrishnan. He questioned why the opposition only had an issue with the Ganpati Puja visit and not with other religious celebrations.

BJP Hits Back at Congress

BJP spokesperson Sambit Patra took the opportunity to attack Congress, particularly targeting Rahul Gandhi’s meetings with controversial figures. He contrasted this with Modi’s Ganpati Puja visit, stating, “If the Prime Minister is meeting the CJI, you have a problem, but if you are meeting anti-national people in the US, then there is no problem.”

BJP‘s General Secretary B L Santhosh responded to opposition, “The crying has begun!!! Civility, cordiality, togetherness, and being fellow travelers on the nation’s journey are all intolerable to these left liberals. Also, this was not just socializing but a devoted Ganapathi Puja, which seems difficult for them to accept. The SCBA is not a moral authority. Take a deep breath.”

Opposition Voices Concerns

Senior advocate Indira Jaising was one of several legal professionals to voice concern over the visit. In a post, she said, “Chief Justice of India has compromised the separation of powers between the Executive and Judiciary.” She called for the Supreme Court Bar Association (SCBA) to publicly condemn the visit, claiming it undermined the independence of the judiciary.

Prashant Bhushan, a senior Supreme Court lawyer, echoed these concerns. He noted that such meetings send a “bad signal” to the judiciary, which should be tasked with protecting citizens’ rights and ensuring the government operates within the bounds of the Constitution.

CJI’s Participation in Puja

In the midst of the controversy, a video surfaced showing CJI Chandrachud and his wife welcoming Modi into their home for the Ganpati Puja. Following the event, PM Modi shared a message on X, expressing his gratitude and wishing for happiness and prosperity for all.

Opposition Continues Criticism

Shiv Sena MP Sanjay Raut also weighed in, accusing the judiciary of bias. He referred to several recent cases where the judiciary ruled against opposition leaders, questioning the impartiality of these decisions. “The Prime Minister chose to visit the Chief Justice’s residence… which has raised doubts and questions over the entire judiciary,” Raut said.

In conclusion, PM Modi’s visit to CJI Chandrachud’s residence for Ganpati Puja has triggered a political storm, with opposition parties questioning the optics and timing of the event, while the BJP defends it as a cultural and religious tradition.

Chief Justice of India (CJI) D.Y. Chandrachud questioned the authorities about the timing of the autopsy, which was reportedly conducted between 1:00 pm and 4:45 pm, and why the FIR was only registered at 11:45 pm, hours after the autopsy had likely indicated the nature of the crime.

The CJI also raised questions on why the victim’s body was handed over to her parents at 8:30 pm, nearly three hours after the postmortem, while the FIR was filed only later that night. The bench also came down heavily on the police and hospital authorities, asking whether the state was unprepared to handle the mob violence that broke out during the midnight protests by doctors.

During the hearing, the Supreme Court directed the Central Bureau of Investigation (CBI) to submit a status report on the progress of the investigation by Thursday, August 22. The West Bengal government was also asked to file a report regarding both the investigation and the mob violence.

CJI Chandrachud emphasized the challenges faced by medical professionals, noting, “Medical professionals face various forms of violence. They work round the clock under conditions that make them vulnerable.”

The Supreme Court was also informed that a case of unnatural death had initially been registered. The CJI expressed shock that even until late at night, no FIR was lodged labeling it as a clear case of murder.

In a significant development, the apex court announced the formation of a National Task Force (NTF) to address the safety of doctors across the country. “We want the CBI to file a status report on the investigation. We are setting up a national task force to recommend safety measures for senior and junior doctors nationwide,” said CJI Chandrachud. The court also questioned how authorities allowed the hospital to be vandalized during the protests.

The matter will be heard next on Thursday, August 22.

</excerpt>

The Supreme Court announced on Tuesday that the Chief Justice of India would make the decisionThe Supreme Court announced on Tuesday that the Chief Justice of India would make the decision regarding the listing of a petition calling for a Special Investigation Team involving quid pro quo agreements between corporations and political parties.

“Don’t worry, that matter is with the CJI Secretariat, they will be fixing a date,” remarked a bench led by Justice Sanjiv Khanna, when advocate Prashant Bhushan brought up the plea for an expedited hearing.

The petition, lodged by NGOs Common Cause and the Centre for Public Interest Litigation (CPIL), sought directives for authorities to probe the funding sources of shell companies and unprofitable firms to various political parties, as revealed in electoral bonds data. It also demanded recovery of funds from political entities if found to be proceeds of crime.

“The investigation in this case would not only need to unravel the entire conspiracy in each instance, which would involve officers of the company, officials of the government, and functionaries of political parties but also the officers concerned of agencies like the ED/IT and CBI etc., who appear to have become part of this conspiracy,” the petitioners said in support of an independent investigation led by a retired Supreme Court judge.

The plea alleged that disclosed data, subsequent to the top court’s annulment of the anonymous Electoral Bonds scheme, indicated that most bonds were given in exchange for favors by corporations to political parties, such as securing government contracts or protection from investigations by authorities like the CBI and the Income Tax Department.

Furthermore, it alleged that various pharmaceutical companies under scrutiny for producing substandard drugs also purchased Electoral Bonds, actions that allegedly contravene the Prevention of Corruption Act, 1988.

In its February ruling, the Supreme Court invalidated the Electoral Bonds Scheme, which permitted anonymous funding to political parties, and instructed the State Bank of India to halt Electoral Bond issuance immediately. The court unanimously struck down the scheme along with amendments to the Income Tax Act and the Representation of People Act, which had enabled anonymous donations.

Chief Justice of India (CJI) Dhananjaya Y Chandrachud emphasized the need for premier investigative agencies like the Central Bureau of Investigation (CBI) to focus on cases that pose significant threats to national security, public order, and economic stability, rather than getting bogged down by trivial matters. He praised the introduction of three new criminal laws by the Centre while stressing the importance of upholding due process and balancing search and seizure powers with individual privacy rights to ensure a fair and just society.

During the 20th DP Kohli Memorial Lecture organized by the CBI, CJI Chandrachud highlighted the necessity for a strategic approach in utilizing investigative resources. He cautioned against overburdening investigative agencies, citing the limited personnel and the importance of prioritizing cases that have substantial implications for the nation’s security and well-being. He referenced instances where the CBI has been involved in investigating cases involving small amounts of bribery, suggesting a need for more focused efforts.

The CJI commended the enactment of three new criminal laws – Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) – which are set to replace colonial-era laws. These laws aim to digitize various aspects of criminal procedure, facilitating better coordination and efficiency in the justice system. Electronic issuance of summons and virtual presentation of testimonies are among the technological advancements envisioned by these laws, aiming to expedite legal proceedings and improve accessibility.

While endorsing the integration of technology into the criminal justice system, CJI Chandrachud underscored the importance of maintaining a balance between investigative needs and individual privacy rights. Sections 94 of BNSS and 185 of BSA grant courts and law enforcement agencies the authority to summon documents and digital evidence for investigation, but the CJI cautioned against unwarranted confiscation of personal devices and stressed the importance of ethical considerations in utilizing technology.

Furthermore, he advocated for a re-evaluation of the investigative framework to address the complexities of modern criminal activities. Proposing the formation of multidisciplinary teams comprising law enforcement officers and domain experts, he suggested leveraging their expertise to enhance investigative capabilities and adapt to evolving criminal networks. Additionally, he recommended the ethical use of technologies like Artificial Intelligence (AI) and emphasized the need for clear guidelines and safeguards to prevent misuse.

</excerpt>

The Supreme Court of India issued a landmark decision today in response to multiple petitions challenging the government’s decision to revoke the provisions of Article 370 of the Constitution, which granted special status to the former state of Jammu and Kashmir.

A five-judge bench led by Chief Justice of India (CJI) D Y Chandrachud, along with Justices Sanjay Kishan Kaul, Sanjiv Khanna, B R Gavai, and Surya Kant, issued three separate but concurring judgments outlining key assertions.

The following are key quotes from the verdict:

‘J&K lacked sovereignty post-accession‘: CJI Chandrachud stated, “Jammu and Kashmir did not retain any sovereignty after accession to India.” He highlighted limitations to the president’s actions after the imposition of the president’s rule, affirming their validity. The CJI emphasized no prima facie evidence indicating mala fide or extraneous exercise of power by the President.

‘Temporary nature of Article 370’: CJI Chandrachud emphasized Article 370 as a temporary provision within its historical context. He underscored the President’s authority to proclaim the cessation of Article 370 even after the dissolution of Jammu and Kashmir’s Constituent Assembly in 1957, asserting that denying such power would hinder the integration process.

‘No mala fide in the President’s exercise of power under Article 370(3)’: The CJI went on to say that there was no malintent in the President’s exercise of power under Article 370(3) to issue the presidential order in August 2019. He confirmed the President’s request for union concurrence, as well as the applicability of all Indian constitutional provisions to Jammu and Kashmir.

‘Validation of Ladakh’s UT status’: CJI Chandrachud upheld the reorganization of Ladakh as a Union Territory. Regarding Jammu and Kashmir’s reorganization into the Union Territory of Jammu and Kashmir and Ladakh, he indicated the temporary nature of the UT status, deferring the determination of the validity of J&K’s reorganization.

‘Objective of Article 370 was gradual parity’: In line with the CJI, Justice S. K. Kaul stated that Article 370 aimed to gradually align Jammu and Kashmir with other Indian states.

Elections in Jammu and Kashmir: The Supreme Court directed the Election Commission of India to take steps to hold elections to the Jammu and Kashmir Assembly by September 30, 2024. It emphasized the importance of restoring the democratic process and legislative representation in Jammu and Kashmir, as well as establishing a clear mandate for the electoral process within a specific time frame.

Proposal for truth and reconciliation committee: Justice SK Kaul proposed forming a “truth and reconciliation” committee to investigate human rights violations dating back to the 1980s. He urged the formation of a time-bound commission to address the grievances of a distrusted generation.

The Supreme Court’s rulings affirming the Article 370 abrogation highlight the legal complexities and nuanced interpretations surrounding Jammu and Kashmir’s constitutional status.

The Chief Justice of India (CJI), Dhananjaya Y Chandrachud, announced on Tuesday that the Supreme Court will establish a special bench to handle only tax cases starting the next week.

There will be a special bench from next week onwards, on Wednesdays and Fridays, to deal with direct and indirect sales tax matters solely,” he told a group of lawyers who were present in his court hall to seek dates of hearing.

The Chief Justice of India, who assumed office on November 9, made a decision that is consistent with the action taken by a previous CJI, justice HL Dattu, who in the early months of 2015 established a bench that would only hear tax cases in recognition of the need to lessen the backlog of cases before the Supreme Court.

Justices AK Sikri and Rohinton F. Nariman were two experienced practitioners of tax law who were on the tax bench at the time. This bench produced about 200 tax law rulings in less than a year, illustrating its success. Since 2007, 2015 saw the largest annual sum of tax judgments delivered, and this allowed for the resolution of almost 500 related cases.

“This is a welcome move, considering the guidance the Supreme Court could provide to the revenue authorities and the litigant for future years and other pending cases. It will help reduce pendency across the courts in the country, besides assisting the calendar management of lawyers who practise in different courts,” said advocate Abhishek A Rastogi of law firm Rastogi Chambers.

A resolution to hear 10 bail cases and 10 transfer petitions each day of the week was adopted at a Supreme Court full court meeting on November 15. Justice Chandrachud said last week that matters of personal liberty would be prioritised under the new system as he informed the lawyers of the meeting.

The Chief Justice of India (CJI) emphasised on Friday that it has been decided to give priority to petitions from people who have spent time in jail or who fear losing their freedom soon.

“After 10 transfer petitions, all the benches shall hear 10 bail matters every day… those are the matters of personal liberty and we will prioritise them. All the courts will start their regular boards after hearing these 20 cases,” he said.

Justice Chandrachud also advised attorneys of the measures he had taken to simplify the listing process and introduce the maximum transparency into how matters are listed in the highest court. In addition, matters registered on Wednesday, Thursday, and Friday will be listed the following Monday for matters registered on Saturday, Monday, and Tuesday for matters registered on Friday for matters listed the following Friday.

His mission is to have a modern and an equal judiciary where district judiciary is treated not as subordinates but as equals and technology can be used to make the working of the Supreme Court more transparent and objective, Chief Justice of India (CJI) Dhananjaya Y Chandrachud said on Monday.

CJI spoke on the challenging reality facing the nation’s district judges at a felicitation event held by the Supreme Court Bar Association (SCBA) on Monday. He also stated, “We should work towards a modern judiciary and an equal judiciary.”

Stating that “If we have to change, we have to change the face of district judiciary first and foremost,” he began by dubbing the expression “subordinate judiciary”, used commonly while referring to district judiciary as part of a “colonial mindset”.

“We have fostered a culture of subordination… A great deal has to be done not only in terms of infrastructure of our district judiciary which is extremely important for which we have to lay the foundation stones today. But we must have to also change our mindset as superior court judges of SC and high courts of how we look at our district judiciary and how we perceive of them.”

A subordinate IAS officer does not view his superior with a sense of inferiority, Justice Chandrachud noted when comparing the executive and judiciary in this regard.

He referred to occasions where it was customary for district judges to rise and even serve food when high court judges were seated at the table for having meals, saying “That is not so in judiciary.”

In another instance, Justice Chandrachud saw district judges who came to brief him in vigilance cases would stand while he was an administrative judge.

“I would go out of the way and say unless you sit, unless you sit with us on the table, I won’t have discussion or we won’t have our food,” CJI added.

He cited another incident in which a district judge remained stationed at the state border’s entry and departure ports whenever the chief justice of a high court had to travel between states.

“All this has to change. We have to inculcate a sense of self-worth in our district judiciary,” Justice Chandrachud said for which he asked the judges of the Supreme Court and high courts to first realise that district judiciary is the “core” and the “cornerstone” of our judicial system.

Speaking about his transition from the bar to the bench, Justice Chandrachud reflected on the lessons he had picked up from the leading members of the bar and the sitting judges who had influenced his career.

Initially when I came to Supreme Court, I realised how uninitiated I was to law. I learnt at the feet of the greats of the bar and bench.”

Justice Chandrachud said, “I am not here to do miracles. I know that challenges are high, expectations are great. I am deeply grateful for your sense of faith.” He said his motto every day is to strive to make the world a better place every single day.

Regarding a contentious case listing issue where the registry frequently delays case listing while some crucial cases are listed out of order,CJI said, “We need to make listing transparent and objective and use technology to eliminate human interface in listing as all discretion tends to be not used properly.”

The new CJI felt that a standard operating procedure (SOP) should be established to institutionalise the process of listing of cases so that it does not depend on who becomes CJI, in light of the concrete improvements implemented by his predecessor, former CJI UU Lalit.

He also referred to judicial vacancies as a “major problem,” noting that 30% of sanctioned high court positions and 25% of district judicial positions are still unfilled.
