Meanwhile Delhi Police’s Advocate Sanjay Jain opposed Kumar’s plea on the grounds that he did not disclose his previous plea to trial court, which was later rejected.

But Kumar in his plea alleged that his arrest violates section 41A of CrPC (notice to appearance before police officer).

Earlier, Bibhav Kumar was arrested on May 18 in connection with maliwal’s assault case. Following his arrest, he was sent to Police custody for 5 days magistrate court.

Kumar was arrested on May 18 and initially placed in police custody for five days. Despite his anticipatory bail plea becoming infructuous due to his arrest, he was remanded in custody following a magisterial court’s ruling.

Maliwal accused Bibhav Kumar of repeatedly hitting her with “full force” during the incident on May 13, alleging that he slapped her 7-8 times and kicked her in the chest and abdomen when she visited the chief minister.

</excerpt>

A court here on Friday remanded Chief Minister Arvind Kejriwal’s aide Bibhav Kumar in judicial custody for 14 days, saying the investigation was still at a nascent stage and completing it would require time. Kumar, personal assistant to Kejriwal, allegedly assaulted AAP Rajya Sabha MP Swati Maliwal at the chief minister’s official residence on May 13.

“I feel that investigation is at nascent stage and would require time to complete the investigation. In view of the submissions made by both the parties and facts of the case, accused Bibhav Kumar be remanded to judicial custody for 14 days and be produced on June 14,” Metropolitan Magistrate Gaurav Goyal said.

Additional Public Prosecutor Atul Srivastava submitted an application seeking judicial custody for Kumar for conducting a “proper investigation” and to prevent the accused from tampering with evidence or making any threat or inducement to the witnesses.

Karan Sharma, the counsel for Kumar, opposed the Delhi Police’s plea.

Meanwhile, the Delhi High Court has reserved its order on the maintainability of Kumar’s plea challenging his arrest.

Earlier on Monday, Kumar’s bail plea was dismissed by a sessions court which said there appeared to be no “pre-meditation” by Maliwal in lodging the FIR and that her allegations could not be “swiped away”.

Kumar was arrested on May 18. He was sent to police custody for five days the same day by a magisterial court which observed that his anticipatory bail plea had become infructuous because of his arrest.

He was sent to four-day judicial custody last Friday.

The FIR against Kumar was registered on May 16 under various Indian Penal Code provisions, including for criminal intimidation, assault or criminal force on a woman with the intent to disrobe her and attempt to commit culpable homicide.

</excerpt>

Bibhav Kumar, an aide to the Chief Minister, was sent to 14-day judicial custody by Delhi’s Tis Hazari court regarding the alleged assault on Aam Aadmi Party (AAP) MP Swati Maliwal. Kumar appeared in court after the three-day police custody granted on May 28 expired. He had been arrested by Delhi Police on May 18 in this case.

Metropolitan Magistrate Gaurav Goyal has ordered that Bibhav Kumar be held in judicial custody until his next court appearance on June 14. This decision follows a request from the Delhi Police for a 14-day judicial custody of Bibhav Kumar after questioning.

The Additional Public Prosecutor (APP) argued that the accused’s judicial custody is necessary for a thorough investigation, to prevent tampering with evidence, and to avoid any attempts at influencing witnesses through inducement or threats.

Defense counsels Rajat Bhardwaj and Karan Sharma opposed the judicial custody plea. They submitted that the accused is in no position to interfere with an investigation or tampering with the evidence. It was also stated, “I (Bibhav Kumar) am in no position to induce the witnesses.”

On May 28, APP Atul Srivastava stated that the accused formatted his phone and didn’t share the password. Police received a forensic expert’s interim report on CCTV footage, showing the accused entering the DVR area for 20 minutes, raising concerns of evidence tampering. The complainant also mentioned the accused recording the incident with two phones.

Defense counsel Rajiv Mohan argued against the allegations, pointing out the delay in filing a complaint, lack of medical evidence, and timing of the FIR leading to the accused’s arrest. He claimed police fabrication of evidence to obtain a favorable statement. The absence of CCTV footage was highlighted.

The defense emphasized no weapon involvement, the potential retrieval of mobile data, and the accused’s right not to share their password. They deemed the FIR simple and questioned its interpretation by the prosecution, also challenging the phone’s admissibility without a forensic report.

The defense argued that examining the accused scientifically doesn’t need custody; further custody requires strong justification as there’s no material to confront them with. However, the prosecution countered, citing an interim forensic report on footage blanks, alleging tampering due to the accused’s possession of two mobiles, including a second one.

</excerpt>

The Delhi High Court has reserved its order on the maintainability plea filed by Arvind Kejriwal’s aide Bibhav Kumar on Friday.

Through his plea, Bibhav Kumar challenged his arrest regarding Swati Maliwal’s assault case at CM’s house in the previous month.

Further, he has also asked for directions to declare its arrest illegal, emphasizing, it is a violation of section 41A provisions under code of criminal procedure.

But, Police’s lawyer has opposed the petitioner’s plea on the grounds, that it’s not maintainable.

Later, the senior counsel also asserted, that the objection regarding section 41A (notice of appearance before police officer) has already been dismissed by the trial court. Thus, contending that petitioner should file revision order against the verdict rather than a writ petition.

However, bibhav kumar’s lawyer emphasized, that his arrest violates fundamental rights of an individual and is against the law.

Furthermore, Kumar’s counsel argued, that there was neither reason nor necessity for the arrest, emphasizing that an individual’s liberty cannot be taken lightly.

In the petition, kumar also stated, that he was arrested with an “oblique motive”, even though his anticipatory bail is still pending in trial court.

He has also asked for “appropriate compensation” for his illegal arrest and actions against those officials, who were involved in the decision-making of the arrest.

Later, after hearing both the sides, Justice Swarna Kanta Sharma, reserved the order, saying “Order reserved on maintainability.”

Earlier on Monday, kumar’s bail plea was rejected by sessions court, asserting there was no ‘pre meditation’ in swati maliwal to register an FIR and her allegations could not be ignored.

What has happened In Swati Maliwal Case So Far?

On May 18, Arvind Kejriwal’s aide, Bibhav Kumar, was arrested and subsequently remanded to five days of police custody by a magisterial court, which noted that his anticipatory bail had become ineffective due to his arrest.

</excerpt>

The Delhi High Court on Friday declined to consider a public interest litigation (PIL) aimed at preventing the media from revealing the name of AAP Rajya Sabha MP Swati Maliwal in reports concerning her assault case, as well as from disclosing the contents of the FIR.

A division bench, including Acting Chief Justice Manmohan and Justice Manmeet PS Arora, criticized the petitioner, lawyer Sanser Pal Singh, suggesting that the plea had political motivations. The court questioned Singh’s standing in filing the PIL, noting that Maliwal herself has been discussing the case with media outlets.

“There is a political hue in this petition. It is very, very apparent. You have done this only for publicity,” remarked the bench.

Following these comments, Singh withdrew the plea.

Swati Maliwal had filed a written complaint with the Delhi Police alleging that Bibhav Kumar, a close aide of Chief Minister Arvind Kejriwal, assaulted her during a visit to Kejriwal’s residence on May 13. Kumar was subsequently arrested on May 18.

Singh’s grievance was directed at media outlets ETV Bharat, Gujarat Samachar, and India Today, along with social media platforms Meta, X, and WhatsApp. He claimed that the FIR was being publicly circulated via these channels, newspapers, and social media.

“Disclosing the name along with the contents of such FIR certainly lowers down the dignity of a woman. In the present case, this act has been deliberately done by the respondent no. 5 to 10 and did not even care for the law and judgments/guidelines of this Hon’ble Court and the Hon’ble Apex court in this regard,” Singh’s plea stated.

The PIL also sought directives for the Union Government, Delhi Government, and media and social media platforms to refrain from revealing the name, address, or other identities of victims in sensitive cases such as rape or molestation.

</excerpt>

The Delhi High Court has agreed to hear Bibhav Kumar’s plea challenging his arrest in the assault case involving AAP MP Swati Maliwal on May 31. Kumar, a close aide of Delhi Chief Minister Arvind Kejriwal, filed a plea seeking the declaration of his arrest by Delhi Police as illegal, citing violations of Section 41A of the Code of Criminal Procedure.

The plea also requests appropriate compensation for the unlawful arrest and urges departmental action against officials involved in the decision-making process leading to the arrest.

The trial court recently denied bail to Bibhav Kumar, citing concerns about potential witness influence and evidence tampering, as the investigation is still in its early stages. The court noted Kumar’s presence at the CM’s house after his termination from employment and mentioned issues with accessing his mobile phone data and blank CCTV footage from the CM’s office.

During arguments, the complainant’s counsel emphasized Swati Maliwal’s status as an AAP MP and highlighted the severity of her injuries, indicating a long association with the CM’s office and alleging brutal assault by Kumar.

Former aide to Delhi Chief Minister Arvind Kejriwal, Bibhav Kumar, has escalated his legal battle by petitioning the Delhi High Court after being denied bail by a trial court in an assault case lodged against him by AAP MP Swati Maliwal.

Bibhav Kumar, who faces continued legal troubles, completed four days in judicial custody following the rejection of his bail application by the Tis Hazari court on Monday. Scheduled for a court appearance tomorrow, his legal woes have intensified amidst mounting pressure from the prosecution and the emotional plea from the victim.

The dismissal of the bail plea ensued after a tense courtroom exchange between legal representatives. Senior Advocate N Hariharan, representing Kumar, presented arguments countered by Additional Public Prosecutor Atul Srivastava and advocate Madhav Khurana, representing Maliwal. Despite extensive arguments, the court reserved its decision on Kumar’s bail plea.

Maliwal, who was present at the hearing, vehemently opposed the bail, citing threats she had received and becoming emotional during the proceedings. Initially, Delhi Police opposed the bail, contending that it was not filed in the appropriate court. This claim was challenged by Hariharan, citing jurisdiction and the nature of the charges under Section 308 IPC.

In a compelling rebuttal, Hariharan argued against the severity of the charges, emphasizing the lack of evidence and disputing the allegations outlined in the FIR. Khurana, representing Maliwal, highlighted her right to be heard and the delay in filing the FIR, stressing the significance of the injuries.

Maliwal herself addressed the court, expressing concerns over her safety and alleging political influence on the case. As Kumar maintains his innocence, the legal battle intensifies, with both sides presenting compelling arguments and seeking justice in the complex assault case.

“Faced with false accusations, daily death threats, and degrading insults, along with organized efforts to tarnish my reputation… I’ve grown accustomed to it,” Dhruv Rathee stated.

“The irony lies in the perpetrators portraying themselves as victims. It’s common knowledge who is orchestrating all of this. Their aim is to silence me. But that won’t happen. If one Dhruv Rathee is silenced, a thousand more will emerge. Jai Hind,” the YouTuber added.

Swati Maliwal previously accused the Aam Aadmi Party and its supporters of orchestrating a “character assassination” campaign against her, particularly intensified after Dhruv Rathee’s video. She criticized Rathee for contributing to victim-shaming and expressed disappointment that someone claiming to be an independent journalist would align with AAP’s narrative.

Bibhav Kumar was apprehended by Delhi Police on May 18 in connection with Swati Maliwal’s alleged assault at Arvind Kejriwal’s residence on May 13. In her complaint, the AAP MP accused Kumar of physically assaulting her and issuing death threats.

</excerpt>

The bail application of Bibhav Kumar, a former aide to Delhi Chief Minister Arvind Kejriwal, was dismissed by Tis Hazari court on Monday. Kumar stands accused in the assault case involving Rajya Sabha MP Swati Maliwal. Scheduled for a court appearance tomorrow, Kumar has completed four days of judicial custody. The dismissal came after Senior Advocate N Hariharan, representing Kumar, presented arguments countered by Additional Public Prosecutor Atul Srivastava and advocate Madhav Khurana, representing Maliwal.

Following extensive arguments, the court reserved its decision on Kumar’s bail plea. Maliwal, present at the hearing, opposed the bail, citing threats she had received and became emotional during the proceedings. Delhi Police initially opposed the bail, stating it was not filed in the appropriate court, a claim Hariharan contested, citing jurisdiction and the nature of the charges under Section 308 IPC.

Hariharan argued that Maliwal’s actions lacked permission or appointment and disputed the allegations outlined in the FIR, emphasizing the lack of contemporaneous complaint. He also questioned the severity of the injuries and the circumstances surrounding the incident. Despite assertions of self-inflicted injuries and lack of evidence, Srivastava opposed bail, emphasizing the seriousness of the charges and the impact on Maliwal’s reputation.

Khurana, representing Maliwal, highlighted her right to be heard and the delay in filing the FIR, stressing the significance of the injuries. He also referenced previous incidents involving Kumar and argued against his innocence, pointing to actions taken post-incident, such as phone formatting and complaint filing. Maliwal herself addressed the court, expressing concerns over her safety and alleging political influence on the case.

In rebuttal, Hariharan maintained that the charges did not align with culpable homicide, emphasizing the lack of evidence.

</excerpt>

AAP MP Swati Maliwal arrived at Delhi’s Tis Hazari court for the bail hearing of Delhi CM’s aide, Bibhav Kumar. Senior advocate N Hariharan asserted the maintainability of the bail application, emphasizing the court’s jurisdiction.

Hearing underway for Bibhav Kumar’s bail plea in Swati Maliwal’s case. Here’s his counsel’s statement so far:

The ongoing hearing in Swati Maliwal’s case against Arvind Kejriwal’s aide, Bibhav Kumar, has seen arguments from his counsel. The FIR invoked Section 308 IPC, triable by the Court of Session. Senior advocate Hariharan contended that Maliwal visited the CM’s residence and contacted the PA, but Kumar was absent. He questioned Maliwal’s entry into the CM’s residence, arguing against such access to an official premises.

Bibhav Kumar’s counsel accused Maliwal of premeditated actions before entering the CM’s residence, highlighting her lack of mention about being called by the CM. He questioned whether being an MP granted permission for such actions and cited security statements regarding her entry.

The senior advocate argued that there was trespass and a report was filed, emphasizing Maliwal’s lack of appointment or prior notification of her visit. He referred to a report where Maliwal questioned security personnel about keeping an MP waiting and stated that she waited in the waiting room, asking security to speak to Bibhav Kumar.

The advocate contended that Maliwal’s claims in the FIR were false and not based on an immediate complaint, as the FIR was lodged three days later. He questioned the credibility of the allegations given the presence of many people at the alleged incident location and argued against the severity of the charges, citing the absence of grievous injury or intention to disrobe.

During the defence counsel’s argument, Maliwal broke down. The senior advocate argued that the FIR was an afterthought and reiterated their request for bail rather than acquittal.

CCTV has already been recovered, so there is no question of tempering, sr. Advocate. My (Bibhav) availability to police investigation is from the very beginning, sr. Advocate argued.

Everything is pre-planned and tailor-made to suit her story, sr. Advocate argued. It was an overreach by the prosecution preventing this court from passing an order on anticipatory bail, sr. Advocate submitted. They informed about the arrest when the court was dictating the order, he added.

He has been in custody since May 18, sr. Advocate concluded his arguments. Additional Public Prosecutor Atul Srivastava begins his arguments

Intention is not required to make out a case of Culpable homicide not amounting to murder, knowledge is sufficient, additional public prosecutor (APP) Atul Srivastava submitted.

The accused had beaten a lady who was alone dragged her and her head hit the centre table, will this not cause a death, APP argued If I slap a lady in an open place, it is outraging the modesty of a woman, APP argued.

Additional Public Prosecutor (APP) opposed the submissions of defence counsel that she went there with a premeditated mind to malign Bibhav Kumar.

Her reputation was kept in high esteem by the party chief and was called ‘Lady Singham’, APP submitted. The accused was terminated from his post, APP submitted.

Additional Public Prosecutor (APP) opposed the submissions of defence counsel that she went there with a premeditated mind to malign Bibhav Kumar.

Her reputation was kept in high esteem by the party chief and was called ‘Lady Singham’, APP submitted. The accused was terminated from his post, APP submitted

The accused did not tell the complainant that he was not in service and couldn’t arrange the meeting with the CM. It shows the intention on the part of the accused. There was no occasion earlier when she was asked to take a prior appointment, APP submitted.

Whyn’t the security officer make a call to PCR, APP argued. She was allowed to sit in the waiting room. It was implied permission, where is the question of trespass, APP submitted. When Bibhav Kumar reached there, he asked who allowed her to go inside, APP submitted

All the people at the place of occurrence were reporting to Bibhav Kumar. It shows that he is influential. He can temper the evidence, APP argued

Section 308 (Culpable Homicide not amounting to murder) IPC is made out against the accused, APP submitted. He added that the complainant was taken to AIIMS as she was residing at CR Park, Additional Public Prosecutor (APP) argued.

She (Swati Maliwal) was not maligning the accused, Additional Public Prosecutor (APP) said On the point of delay in FIR, the APP submitted that the complainant did not disclose the entire incident to the police. Even thereafter, police officer visited the place of incident.

In India women are very reluctant to report sexual offences, the Additional Public Prosecutor (APP) argued.

CCTV footage may be missing due to some technical reasons, APP submitted. The court asked, Why police are looking into the phone of the accused? iPhone was handed over after formatting, it is tempering, APP submitted

The accused went to Mumbai to format his phone. We may ask for further police custody. I strongly opposed the bail application, APP submitted Sr. Advocate N Hariharan opposed and said the counsel for the complainant couldn’t address the court. Advocate Madhav Khurana, counsel for Swati Maliwal arguing now Advocate Madhav Khurana is referring to judgement on whether he can address the court or not. He submitted that the victim has the right to be heard.

Bail application can’t be heard without issuing a notice to the victim, Khurana argued. Swati Maliwal is also standing with her counsel before the judge. He submitted that she said that she was going inside, you could call the police. But the police were not called. As per the MLC, the injuries were there even after four days, which shows the magnitude. Three-four days delay is inconsequential in these cases, her Advocate argued. The accused sent a complaint through email on May 17, Advocate Khurana submitted.

The accused was found at the place of occurrence, he was interrogated but was evasive in answering, advocate Khurana said.

He also submitted that the accused allegedly assaulted a public servant earlier. If the accused is innocent, then why format his phone, tempered the CCTV, file a complaint on May 17, Advocate Khurana said.

The complainant is receiving rape and murder threats, advocate Khurana argued.

Triple test not satisfied in this case, Khurana argued Swati Maliwal is addressing the court. She said after recording my statement APP leaders organised a press conference. I was called a BJP agent.

They have a huge troll machinery, they have pumped the machinery, she said. The accused was taken to Mumbai by the leaders of the party. If this accused is released on bail there would be a threat to me and my family

He is not an ordinary man, he uses the facilities used by the ministers, Maliwal said

There are no ingredients to make out the offence of Culpable homicide not amounting to murder, Sr. Hariharan rebutted He added that the DVR had been seized by the police, which is not in my complaint. There is no evidence that I tempered the CCTV.

Swati Maliwal assault case: The court reserves the order on bail of Bibhav Kumar

The proceedings are ongoing, awaiting further developments.

</excerpt>

AAP MP and former DCW chairperson, Swati Maliwal, has refuted claims that Bibhav Kumar, an aide to CM Kejriwal, assaulted her on May 13. Maliwal asserted that the incident followed her refusal to vacate her Rajya Sabha seat to facilitate the party leadership’s plans to appoint another individual who has significantly aided Kejriwal. Despite pressure, Maliwal remains steadfast in her decision not to resign.

In her first detailed statement since the alleged assault, Swati Maliwal addressed accusations of character assassination and victim-shaming, attributing these to efforts by her party to force her resignation. “If they had politely requested my Rajya Sabha seat, I would have considered it. The way they have treated me, I will not resign no matter what,” Maliwal told ANI. “I am determined to continue my work as the youngest woman Parliamentarian and strive to become an exemplary leader.”

Recounting the events, Maliwal alleged that while she was in the drawing room of the CM’s residence, Bibhav Kumar approached her aggressively. When she informed him she was waiting for the CM, Kumar allegedly began shouting and hurling abuses, calling her a “neech aurat” (vile woman) and slapped her multiple times. Despite her pleas for help, no one intervened, Maliwal claimed.

Describing Kumar as a powerful figure within the party, Maliwal highlighted his significant influence and the fear he instills. “He is not an ordinary PA; his house is more luxurious than any minister’s. There is already an assault case against him,” she noted. Maliwal emphasized that Kumar’s anger could spell the end of anyone’s career in the party.

Maliwal expressed her shock at the lack of support from Sunita Kejriwal and Minister Atishi, accusing them of victim-shaming. Drawing parallels with the Nirbhaya case, Maliwal criticized Atishi for making dismissive remarks about the absence of visible injuries. “This is the worst kind of victim-shaming. I never claimed in my FIR that my clothes were torn or that my head was wounded. I documented exactly what happened. I am willing to take a polygraph test to prove my truth,” she stated.

Feeling isolated by her party, Maliwal has called for a “free and fair investigation” by the Delhi Police. She remains resolute in her decision not to resign, committed to serving as a diligent and exemplary Parliamentarian.

</excerpt>

Aam Aadmi Party’s Rajya Sabha MP, Swati Maliwal, stated in an interview with ANI that she would not resign from her Rajya Sabha seat despite any pressure to do so. She emphasized her dedication to her position and her lack of desire for power. Maliwal highlighted her long-standing commitment to public service since 2006, even amidst adversity. Despite facing challenges and character attacks, she affirmed her resolve to continue serving.

Responding to questions about power dynamics within the party, Maliwal remarked on the rise of egos over the years. She reminisced about the earlier days of unity and enthusiasm among members, contrasting it with the current environment marked by ego clashes. Maliwal expressed disappointment over the treatment she received, including physical assault and character assassination, indicating a deterioration in values within the party.

In January of the same year, Maliwal, representing the Aam Aadmi Party, was elected to the Rajya Sabha unopposed. Regarding allegations of assault against a former aide of Chief Minister Arvind Kejriwal, Maliwal’s complaint led to the formation of a Special Investigation Team (SIT) and the arrest of the accused. Despite the gravity of the situation, Maliwal criticized the silence of AAP’s leadership, particularly Chief Minister Kejriwal, on matters concerning women’s safety, implying a lack of prioritization of such issues within the party.

</excerpt>

Recounting what happened on May 13, Aam Aadmi Party (AAP) Rajya Sabha MP Swati Maliwal on Thursday said that she was assaulted by Bibhav Kumar, personal aide of Delhi Chief Minister Arvind Kejriwal adding that she is not giving “clean-chit” to anyone.

In an exclusive interview with ANI, AAP Rajya Sabha MP recounted the entire incident of May 13 at Arvind Kejriwal’s residence.
“On May 13 at around 9 am in the morning, I went to meet Delhi Chief Minister Arvind Kejriwal at his residence. The staff asked me to sit in the drawing room and told her that Arvind Kejriwal ji was at home and he was coming here to meet me. After that the PA of Arvind Kejriwal ji Bibhav Kumar came in a state of aggression and I asked ‘Kya Hua Kejriwalji aa rahe hai. Kya hogya?’ I said this much, after which he slapped me. He (Bibhav Kumar) slapped me 7 to 8 times. When I tried to push him, he held my legs and mujhe ghaseet diya. Ensuring that my head bumped into the center table. I fell to the floor and he (Bibhav) started beating me with his legs. I was screaming and begging for help but no one came there,” Maliwal said.

She further said that she is not aware whether she was beaten on the instructions of anyone or by himself or of his own accord and that this is all a matter of investigation.
“Everything is a matter of investigation. I am very cooperative with the Delhi Police. I am not giving anyone the clean chit. Because the fact is I was in the drawing room and Arvind Kejriwal was at home and I was beaten up very badly. I was literally screaming very badly but no one came to help to out. I never thought what will happen to me and my career. What will they do with me? I just thought that ‘Jo cheez maine saari mahilao ko bola hai ki hamesha sach ke saath khade raho, aap sachi sachi complain karo and jo bhi aapke sath kuch galat hua hai toh uske liye jarur lado, toh aaj mai kaise nhi ladh sakti,’ she said with tears in her eyes.

Following the assault allegations levelled by Aam Aadmi Party MP Swati Maliwal against a former aide of CM Arvind Kejriwal, Delhi Lieutenant Governor VK Saxena said that the silence of the AAP chief on this matter shows his stance about the issue of the safety of women.
AAP Rajya Sabha MP Swati Maliwal has accused party chief Kejriwal’s former personal secretary Bibhav Kumar of assaulting her at the Chief Minister’s residence.
Bibhav Kumar has lodged a counter-complaint with the police on Friday, accusing Maliwal of gaining ‘unauthorised entry’ into the CM’s Civil Lines residence and ‘verbally abusing’ him.
A case was filed against Bibhav Kumar and a Special Investigation Team (SIT) was formed to investigate the case based on Maliwal’s complaint. Bibhav was arrested by the Delhi Police on Sunday, May 19, and is currently in police custody.

In a tweet, Maliwal alleged that there is immense pressure on party members to speak negatively about her and that those who support her are being threatened with expulsion. She described an orchestrated effort involving press conferences, tweets, and fake sting operations to discredit her.

Swati Maliwal asserted that while the party may mobilize against her, she remains steadfast, relying on the truth. “I am not angry with them; the accused is a very powerful man. Even the biggest leaders are afraid of him. No one has the courage to take a stand against him. I don’t expect anything from anyone. I feel sad that the woman minister of Delhi is smilingly maligning the character of an old female colleague of the party,” she added. She vowed to continue her fight for self-respect and justice despite being alone in her struggle.

On Tuesday, the Delhi Police escorted Bibhav Kumar, an assistant to Delhi Chief Minister Arvind Kejriwal, to the airport. He departed for Mumbai to conduct an investigation into the assault case concerning AAP MP Swati Maliwal.

Subsequently, the police arrested Kumar in connection with the assault case involving Swati Maliwal, after detaining him at the CM’s residence. Delhi’s Tis Hazari Court later remanded Kumar to a five-day police custody, citing concerns over the accused’s formatting of a mobile phone and the absence of crucial video footage.

In response, Kejriwal denounced the arrest as a “Jail ka Khel” orchestrated by the Prime Minister, alleging a political vendetta against AAP. Maliwal, the victim, accused AAP of rallying to “save the accused” and highlighted the disappearance of CCTV evidence and manipulation of video footage. Consequently, AAP leaders, including Kejriwal, announced plans to protest at the BJP headquarters, condemning the arrest and threatening further arrests of AAP members.

Meanwhile, Maliwal lamented the disappearance of evidence and criticized the lack of support from her party.
Issuing a statement from Delhi’s Raj Niwas, Saxena claimed that Maliwal had previously called him to discuss her “traumatic experience” due to “sheer anguish.”

He further disclosed, that during their interaction, Swati maliwal recounted the intimidation and shaming she was subjected to by her own colleagues.

“Yesterday, she called me out of sheer anguish, describing at length her traumatic experience, and the subsequent intimidation and shaming that she is being subjected to by her own colleagues. She also expressed concerns over reported tampering of evidence and coercion against her.” said VK Saxena.

What Happened in the Case So Far

Meanwhile, Swati maliwal has accused Kejriwal’s aide Bibhav Kumar of kicking and slapping her several times in the drawing room of CM’s house.

However, Aam Aadmi party are supporting Bibhav kumar, claiming that Maliwal had barged into the house without any appointment.

Later, AAP also claimed, she is working on BJP’s orders to harm Kejriwal.

Moreover, the party has also released various CCTV clips in relation to this incident. Claiming, that Swati Maliwal is walking normally in the video after the alleged assault.

But today, the Bhartiya Janata Party has recently responded to AAP’s claim, questioning how swati maliwal entered the premises without prior appointment, despite the presence of Z plus security.

The court noted, “the fact that the mobile phone was formatted by the accused and the video footage was not found in the pendrive provided by the JE to the IO during the course of the investigation speaks volumes.” Additionally, the court acknowledged that this was not Kumar’s first encounter with the law.

In response to Kumar’s detention, Kejriwal referred to it as “Jail ka Khel,” accusing the Prime Minister of orchestrating a political vendetta against the Aam Aadmi Party (AAP). Kejriwal claimed in a video message shared on Saturday that the BJP-led government is systematically targeting and imprisoning AAP leaders.

</excerpt>

A Special Investigation Team (SIT) has been established to probe the Swati Maliwal case, following accusations by the Aam Aadmi Party (AAP) Rajya Sabha MP against Delhi Chief Minister Arvind Kejriwal’s former personal secretary, Bibhav Kumar, for assault. Police officials stated that the SIT is led by North Delhi’s Additional Deputy Commissioner of Police (DCP) Anjitha Chepyala, who is overseeing the investigation. The team also includes three inspector-rank officers, including the officer from Civil Lines Police Station where the case was filed.

The SIT will present its findings to senior officials after completing the investigation, according to the police.

On Monday, the Delhi Police took Bibhav Kumar to the drawing room of Kejriwal’s residence, where the alleged assault on Maliwal occurred, to reconstruct the events of the morning of May 13. The police documented Kumar’s answers, mapped them sequentially, and took photographs of the crime scene, officials reported.

Sources within the Delhi Police revealed that both the accused and the victim were brought to the crime scene to recreate the incident, and their accounts are now being analyzed. Officials also visited Bibhav Kumar’s residence as part of the investigation.

The police are attempting to retrieve Bibhav Kumar‘s mobile data, hoping it will provide new leads. They are also investigating whether the CCTV footage was tampered with, as alleged by Swati Maliwal. On Sunday evening, the police seized the DVR containing Kejriwal’s CCTV footage and are working to recover the missing portions.

Earlier, on Saturday, Bibhav Kumar was arrested in connection with the alleged assault on Maliwal. He was presented before the Tis Hazari Court, which remanded him to police custody for five days.

In her complaint, Maliwal alleged that Bibhav “slapped” her “at least seven to eight times” while she “continued screaming” and “brutally dragged” her while “kicking” her in her “chest, stomach, and pelvis area.” Following his arrest, Bibhav was taken to Delhi’s Tis Hazari Court, which remanded him to police custody for five days.

On Friday, Bibhav filed a counter-complaint against Maliwal, accusing her of gaining ‘unauthorized entry’ into the Chief Minister’s Civil Lines residence and ‘verbally abusing’ him.

Kumar was apprehended by the police following allegations of assault against AAP MP Swati Maliwal.

Reacting to Kumar’s arrest, Kejriwal accused the Prime Minister of orchestrating a political vendetta against the Aam Aadmi Party (AAP), referring to it as “Jail ka Khel” (game of jail). In a video message shared on Saturday, Kejriwal claimed that AAP leaders are being systematically targeted and incarcerated by the BJP-led government.

The Delhi Court has scheduled May 20 to review the Enforcement Directorate’s (ED) chargesheet against Kejriwal and AAP. Additionally, the police have recorded Swati Maliwal’s statement regarding the alleged assault at the CM’s residence.

While the Supreme Court refrained from engaging in political discussions regarding its decision to grant interim bail to Kejriwal for campaigning during the Lok Sabha polls, it welcomed critical analysis of its judgment. The court clarified that it had not made any exceptions and justified its decision based on what it deemed appropriate.

</excerpt>

Amid the intensifying political conflict between the ruling Aam Aadmi Party (AAP) and the Bharatiya Janata Party (BJP) over the arrest of Chief Minister Arvind Kejriwal’s former aide, new developments have emerged in the alleged assault case involving Rajya Sabha MP Swati Maliwal. Delhi Police sources revealed on Sunday that they are considering adding charges for the destruction of evidence to the case.

The decision follows accusations by Maliwal, former chairperson of the Delhi Commission for Women (DCW), that Bibhav Kumar, the arrested aide, deleted crucial CCTV footage from the CM’s Civil Lines residence. Maliwal claims this footage would have conclusively proven her allegations of assault.

Sources within the Delhi Police disclosed that Kumar, who was arrested on Saturday, has not been cooperating with the investigation. He was produced before the Tis Hazari Court, which remanded him in police custody for five days. Kumar is accused of assaulting Maliwal and is being interrogated for further leads.

Investigators suspect that Kumar may have disposed of or reformatted relevant phone data in Mumbai. They plan to take him there to attempt data retrieval with the assistance of forensic experts. Additionally, Kumar might be taken to the CM’s Civil Lines residence in Delhi to clarify the circumstances surrounding the alleged altercation.

On Saturday, Metropolitan Magistrate Gaurav Goyal authorized five days of police custody for Kumar, who is scheduled to be presented in court again on May 23. Kumar faces charges under several IPC sections, including 308 (attempt to commit culpable homicide), 354B (assault with intent to disrobe), 341 (wrongful restraint), 506 (criminal intimidation), and 509 (insulting the modesty of a woman).

In response to Kumar’s arrest, CM Kejriwal accused the BJP of engaging in a “Jail Ka Khel” (game of incarcerating leaders) against the AAP. He announced plans to lead a “Jail Bharo” march to the BJP headquarters on Sunday, accompanied by top party leaders and supporters.

Ahead of the AAP protest, Delhi Police implemented extensive security measures around the BJP’s national headquarters. A traffic advisory warned of potential congestion on DDU Marg, IP Marg, Minto Road, and Vikas Marg, indicating that DDU Marg might be closed to traffic between 11 am and 2 pm.

Maliwal’s complaint detailed the alleged assault, claiming that Kumar “slapped” her “at least seven to eight times,” “brutally dragged” her, and “kicked” her in the “chest, stomach, and pelvis area” while she “continued screaming.”

The situation continues to unfold, with the political and legal ramifications of the incident remaining a focal point of public and media attention.

</excerpt>

While granting five days of police custody for Bibhav Kumar, the court noted, “the fact that the video footage was not found in the pendrive provided by the JE to the IO during the course of the investigation and the mobile phone was formatted by the accused speaks volumes.” Additionally, the court acknowledged that this was not Kumar’s first criminal case.

Metropolitan Magistrate (MM) Gaurav Goyal remanded Bibhav Kumar in police custody for five days, citing the need for further investigation and the submissions from Delhi Police. The court highlighted that it was essential to grant police custody since the accused needed to be taken to Mumbai and other parts of Delhi.

MM Gaurav Goyal stated in the order, passed on May 19 at 12:45 AM, “Considering the submissions made on behalf of both parties, I find there is necessity of police custody remand in this case. Accordingly, the application moved by the IO is partly allowed and the accused is remanded to police custody remand for a period of 05 days.” The court emphasized the ultimate goal of every investigation is to uncover the truth and instructed that the accused should not be subjected to any torture during police custody. Furthermore, the court allowed the accused to meet his advocates for half an hour daily between 6 PM and 7 PM and also to meet his wife for half an hour daily during custody.

The case was at an early stage, with allegations in the complaint/FIR corroborated by the victim’s statement under Section 164 Cr.P.C. and the victim’s medical examination report. The court also reviewed the case file and diaries, noting the accused’s criminal history was undisputed by defense counsel and that his services had been terminated.

Section 41 A of Cr.P.C. was considered, which gives the IO discretion to arrest or not arrest during the investigation. The MM stated, “I find force in the arguments of learned Addl. PP that there were sufficient grounds to arrest the accused without notice.”

While requesting police custody, Additional Public Prosecutor (APP) Atul Kumar Srivastava argued the seriousness of the case, involving an assault on a public figure and a member of parliament by the accused, whose services were recently terminated. Despite notice by the IO, the DVR containing the incident was not provided, and a pendrive from a JE officer was found blank for the relevant time. The accused’s access to the inside raised possibilities of tampering, necessitating police custody to ascertain these facts, including the formatting of his mobile phone and retrieval of deleted data.

The APP further stated that the weapon used in the assault needs to be recovered. In contrast, defense counsel Rajiv Mohan opposed the custody application, highlighting the delay in the complainant filing the complaint and disputing the severity of the charges under IPC Section 308. He also asserted the accused’s right not to disclose his mobile phone password and denied the accused’s access to CCTV footage controlled by the PWD Department of Delhi.

The defense argued that the complainant had ample opportunity to lodge the complaint earlier but did so after delay and deliberation. APP countered that the investigation was at an early stage and the FIR was not exhaustive, stressing the necessity of police custody to reach a logical conclusion.

APP Srivastava emphasized the seriousness of the case, with corroborating evidence from the FIR, the victim’s statement, and the MLC from AIIMS Hospital. He warned of high chances of evidence tampering, noting the accused’s terminated services and continued presence at the work spot since 2015. The accused’s evasive answers and lack of cooperation were also cited, alongside his previous involvement in a criminal case registered by Noida Police in 2007 for assaulting a public servant.

</excerpt>

Following the arrest of Arvind Kejriwal’s aide, Bibhav Kumar, by the Delhi police in an alleged assault case, his father spoke out against what he perceives as injustice. He emphasized that in the 15 years Bibhav has been with Delhi CM Kejriwal, there have been no complaints against him. Bibhav’s father, Maheshwar Rai, revealed that the BJP has been pressuring Bibhav to distance himself from Kejriwal, implying that doing so would spare him harm. He recounted the incident where Bibhav allegedly confronted Swati Maliwal, asserting that Bibhav merely prevented her from meeting Kejriwal without permission and did not physically harm her.

Bibhav’s background as a student at Banaras Hindu University and his practice of journalism in Delhi were also highlighted. Hailing from Bihar’s Khudru village, Bibhav is described as coming from a socially engaged family with a history of supporting the underprivileged. Former village head Lal Sahib Yadav vouched for Bibhav’s character, denying any criminal inclinations and attributing the situation to political motives.

Despite Bibhav’s arrest, he expressed readiness to cooperate with the ongoing investigation into Maliwal’s assault claim. Simultaneously, he urged authorities to consider his own complaint, where he accused Maliwal of unauthorized entry, verbal abuse, and threats, while alleging BJP involvement.

As details emerged regarding Maliwal’s medical examination report, citing bruises on her left leg and right cheek, questions surrounding the incident intensified. The report, following Maliwal’s examination at AIIMS Delhi, shed light on the physical aftermath of the alleged altercation.

Earlier, an FIR had been filed by Delhi Police based on Maliwal’s complaint against Bibhav, alleging physical assault, including slapping and dragging, while she continued to scream.

</excerpt>

The rift between the Aam Aadmi Party (AAP) and its Rajya Sabha member Swati Maliwal has deepened. AAP accused Maliwal of colluding with the Bharatiya Janata Party (BJP) against Arvind Kejriwal, alleging her involvement in a conspiracy. This accusation stems from an incident involving Kejriwal’s private secretary, Bibhav Kumar, who is accused of assaulting Maliwal, the former Delhi Commission for Women (DCW) chief.

Bibhav Kumar appeared before the Delhi Tis Hazari Court, where the Delhi police requested a 7-day police custody.

The additional public prosecutor (APP) representing the Delhi police stated, “The accused was arrested today, and we have provided the grounds for arrest. The primary reason for seeking police custody is the victim’s status as a public figure and member of parliament. She suffered severe physical assault, including being beaten, kicked in the private parts, and her head was banged, leading to the imposition of relevant sections.”

The APP continued, “The investigating officer (IO) visited the incident scene and received video footage. However, the footage during the incident period was blank upon playing the video. Additionally, the phone provided to us was formatted, and it was discovered that the formatting occurred yesterday.”
