PTI plans to launch a protest led by Khan from jail. His wife Bushra Bibi is also jailed. Government calls for dialogue remain unanswered.
</excerpt>

Imran Khan, former Prime Minister of Pakistan and the founder of Pakistan Tehreek-e-Insaf (PTI), is expected to be released on bail on June 11 in the Al-Qadir Trust case. The Islamabad High Court (IHC) would hear the petitions for suspending the sentences of Khan and his wife Bushra Bibi in the £190 million case.

Khan, 72, is currently behind bars in Adiala Jail since August 2023 on various cases, including convictions. PTI chief Gohar Ali Khan was optimistic about the development. “June 11 is going to be a significant day for both Imran Khan and his wife,” he mentioned, without making any further comments.

Court Postponed Hearing

Previously, the IHC rescheduled the hearing to June 11 after the National Accountability Bureau (NAB) requested extra time to formulate its case, ARY News reported.

Bushra Bibi, who remains in custody, is purportedly being held ‘without any charges’ in an attempt to intimidate Khan. Gohar explained, “No deals will be made for the founder’s release,” and dispelled speculation of power struggles within PTI.

PTI is gearing up to initiate a political movement in coordination with opposition parties. Khan will be leading the movement from jail, the party will address on June 9, Gohar said, adding that a plan for the upcoming budget has already been prepared.

Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur also warned of a mass protest for Khan’s release after Eid al-Adha. Khan himself declared he would organize the protest against the ruling Pakistan Muslim League-Nawaz (PML-N) from behind bars. He claims the February 8 general elections witnessed the ‘Mother of All Rigging’ and dubbed the PML-N and Pakistan Peoples Party (PPP) as ‘mandate thieves’.

Shehbaz Govt Asked for Dialogue

In the meantime, Rana Sanaullah, Special Assistant to the Prime Minister on Political Affairs, asked PTI to answer Prime Minister Shehbaz Sharif’s call for dialogue and sit with the government for the betterment of the country to amend election laws. “They must sit with the government for the welfare of the country,” he stated while addressing Faisalabad.

Details of the Al-Qadir Trust Case

The row arose over a £190 million settlement of the UK’s National Crime Agency (NCA) and Malik Riaz’s family. In 2019, the NCA froze eight UK bank accounts worth £100 million, which were believed to be “derived from bribery and corruption in a foreign country.

The NCA had reported to Khan’s administration, which reportedly instructed Shehzad Akbar, then his accountability aide, to resolve the case. The resolution supposedly permitted Bahria Town’s liabilities to be reconciled against the frozen money intended to go to Pakistan’s treasury.

Bahria Town Ltd, a real estate firm owned by Malik Riaz, was found to have illegally acquired land in Karachi’s Malir district. The company donated hundreds of acres to the Al-Qadir Trust, a non-profit organization co-founded by Imran Khan and Bushra Bibi, who serve as its only trustees.

The High Court of Madhya Pradesh, based in Jabalpur, granted Nisar bail on October 15. In addition to furnishing a personal bond of Rs 50,000 and a solvent surety of the same amount, the court imposed specific conditions for his release. </excerpt>

In the Sunil Fulchand v. Unionof India case, the Supreme Court introduced the idea of bail. In criminal law, bail is well-understood, and the Criminal Procedure Code of 1973 has extensive bail provisions. A person is granted bail if they have been arrested for an offense for which they are not eligible for bail, or if they have been found guilty following a trial. When the accused is granted bail, the court maintains its constructive contract rights based on the terms of the bond it secured from him, releasing the accused from custody.
It is crucial to keep in mind that the legislature has evaluated the strength of the prosecution’s case against the accused as well as the prosecution’s capacity to offer prima facie evidence in support of the accusation when determining whether or not to issue bail. It is not expected that the evidence will establish the accused’s guilt beyond a reasonable doubt at this time. When using judicial discretion, consideration for human and just factors should be given. It should be excluded that bail should not be given in certain cases of severe, horrible, and inhumane crimes, in addition to the democratic ideal of liberty.
The authority to set bail in a bail application shall be applied in accordance with established guidelines, considering the particulars of each case. When determining whether to issue bail, several factors must be considered, including the nature of the charge, the evidence supporting it, the accused’s prior behaviour and character, and the public’s and the state’s significant concerns. However, some prisoners are denied bail because they cannot afford to post the required security, which is a result of their poverty. In situations such as Hussainara Khatoon v. State of Bihar, the legitimate exercise of judicial discretion in granting bail should be based on natural considerations. The trial court found the accused guilty in State of Rajasthan v. Balchand.He was exonerated by the High Court after filing an appeal.
In accordance with Article 138 of the Constitution, the state petitioned the Hon’ble Supreme Court for special leave. The Court gave the accused the order to turn himself in. He then submitted a bail application. Justice Krishna Iyer initially voiced his disapproval of the unfair bail system that was in place at the time. Despite the lengthy history of the financial bail system, it is time to reevaluate. It’s possible that an undertaking will be sufficient in most cases. The State of M.P. case of Moti Ram and Ors. included the conviction of the accused, a poor mason. The Chief Judicial Magistrate was instructed to increase the bail amount by the Supreme Court in an unclear ruling that did not include any specific bonds, sureties, or other requirements.
Justice Krishna Iyer again criticized the unjust bail system that was in place in India in the case of Maneka Gandhi v. Union of India. The code does not define bail, despite classifying certain offenses as either bailable or non-bailable.Justice P.N. Bhagwati further discussed how the bail system is unfair and inequitable when considering an individual’s financial situation. A large number of people who are taken before the courts in criminal matters are so impoverished that even a little amount of money will be impossible for them to afford, even when the amount of bail is substantial for some. When using judicial discretion, the human and just aspects should be considered. It should be ruled out that bail should not be granted in certain cases of heinous, horrifying, and cruel offenses in addition to the democratic concept of liberty. With the use of bail, an accused person can be freed from custody prior to their trial.
A person in jail may apply for bail under Section 439 (1), to the High Court even if their application is rejected by the Court of Session, as the High Court is not using its revisionary authority in these situations, but rather its special authority. However, judicial decorum dictates that the Court of Session should tell the accused to go to the High Court if the new application was intended to overturn the previous ruling that the High Court had denied bail.
It is a well-established rule that unless there has been a substantial change in the circumstances, no further bail application may be granted. Bail applications are not subject to the principles of res judicata, of course, but continually requesting bail without a change in circumstances can set a precedent.
A bail application that is denied does not automatically mean that it won’t be granted in the future if more evidence, fresh information, and different circumstances are presented. Interim directives are not final decisions, and modified reconsideration does not reverse an earlier denial.
Because of our nation’s hierarchical structure, the doctrine of judicial discipline is binding on the courts even though the res judicata principle and other related theories do not apply in criminal cases. When a bail application is being reviewed later after it has already been denied, the rulings of a higher Court or a co-ordinate bench must be carefully taken into consideration. When rejecting the bail application in this instance, the courts must take the previous or higher court’s opinion into account. Generally speaking, previously discussed subjects cannot be brought up again on the same grounds because doing so would create uncertainty and conjecture regarding the administration of justice as well as the potential for forum hunting. Even in bail situations, the ruling of a superior forum is unquestionably binding on the subordinate unless there is a significant change in the facts necessitating a fresh ruling

</excerpt>

After spending 17 months in jail, former Delhi Deputy Chief Minister Manish Sisodia was granted regular bail by the Supreme Court. His release was marked by emotional scenes outside Tihar jail, where he was welcomed by party leaders and supporters. Sisodia, visibly moved, expressed gratitude to Ambedkar and the Constitution for his freedom.

The Supreme Court’s decision to grant bail was grounded in the principle that “bail is the rule, and jail is the exception.” This principle, emphasized by the Court, underscores that bail should generally be granted unless there are specific reasons for denial, such as risks of fleeing justice, obstructing the legal process, or committing further offenses. The Court criticized the lower courts for prolonged detention without trial, affirming that such delays undermine personal liberty.

The principle of “bail is the rule, and jail is the exception” was first articulated in the 1977 ‘State of Rajasthan vs Balchand alias Baliya’ case. This landmark judgment established that bail should be denied only when there are substantial reasons to believe the accused might evade justice or disrupt proceedings.

In cases involving the Prevention of Money Laundering Act (PMLA), securing bail is more complex due to stringent conditions introduced by the 2018 amendment. Under Section 45(1) of the PMLA, an accused must first provide the public prosecutor an opportunity to oppose the bail application, and the court must be convinced of the accused’s likely innocence and non-recidivism. This places a heavier burden on the accused, making bail harder to obtain.

The Supreme Court emphasized the need for a timely trial and the right to a speedy trial as crucial in Sisodia’s case. The Court dismissed requests to impose bail conditions similar to those for Delhi Chief Minister Arvind Kejriwal, stating that each case must be considered on its own merits.

This principle of bail has been reiterated in various Supreme Court judgments, including the 2011 2G spectrum case and the 2019 INX Media case, as well as the 2020 interim bail granted to journalist Arnab Goswami. Chief Justice DY Chandrachud has highlighted concerns about declining adherence to this principle in lower courts, calling for judges to prioritize personal liberty and uphold established legal standards.

</excerpt>

Manish Sisodia, the former Chief Minister of Delhi and senior leader of the Aam Aadmi Party (AAP), walked out of Tihar Jail today after being granted bail by the Supreme Court in the Delhi excise policy case. The court’s decision marked a significant development in the high-profile case, which has been a focal point of political and legal scrutiny. Sisodia’s release follows a period of detention related to allegations in the excise policy investigation.

Earlier the Rouse Avenue court on Friday issued a warrant for the release of Manish Sisodia from Tihar Jail. He was granted bail by the Supreme Court in Delhi Excise policy CBI and ED cases.
He has been granted regular bail after a period of around 17 months.
Special judge Kaveri Baweja accepted the bail bond and surety bonds in both cases.
AAP MLA Prahlad Singh Sahni, Roshan Chauhan, Gaurav Singh Raghav, MCD councillor Punardeep Singh Sahni furnished the surety for Manish Sisodia of Rs. 10 lakh each.
During the day, the court had granted the CBI time to paginate the charge sheet by August 14. Thereafter, the inspection by the counsel for the accused will be done.
The Court has listed the matter for hearing on August 21 at 12 PM.
In the morning Special Judge Kaveri Baweja had extended the judicial custody of Manish Sisodia, K Kavitha and other accused till next date.
However, the Supreme Court granted Manish Sisodia in Delhi Excise policy cases.
Accused were produced through video conferencing.
Manish Sisodia was arrested by the CBI on February 26. Thereafter, he was arrested by the ED in March 2023.
His earlier bail applications were dismissed by the trial court as well as Delhi High Court.

</excerpt>

The Provisions under UAP(A) is harsh and leaves no scope of Bail in the scheduled and sanctioned offence under UAP(A) 1967. In National Investigation Agency v. Zahoor Ahmad Shah Watali (2019) 5 SCC 1. It is held inter-alia that, there is a degree of difference between the satisfaction to be recorded by the Court that there are reasonable grounds for believing that the accused is “not guilty” of such offence and the satisfaction to be recorded for the purposes of the 1967 Act that there are reasonable grounds for believing that the accusation against such person is “prima facie” true. By its very nature, the expression “prima facie true” would mean that the materials/evidence collated by the investigating agency in reference to the accusation against the accused concerned in the first information report, must prevail until contradicted and overcome or disproved by other evidence, and on the face of it, shows the complicity of such accused in the commission of the stated offence. It must be good and sufficient on its face to establish a given fact or the chain of facts constituting the stated offence, unless rebutted or contradicted. The chargesheet has to be read as it is.

However, at least surface-analysis of probative value of the evidence, at the stage of examining the question of granting bail and the quality or probative value satisfies the Court of its worth must be done as laid down in Vernon -vs- The State of Maharashtra & Anr. [2023 INSC 655].

The Watali (supra), remains unchallenged in the Supreme Court. In recent times, in some matters, persons accused were able to secure bail in the scheduled and sanctioned offence under UAP(A) 1967. However, none of the accused were able to secure bail in merits of the case. In most of the cases decided recently, accused were granted bail on the grounds of delay in framing of charges, delay in Trial and on the grounds that the accused remained incarcerated for years without Trial. The aforesaid, Vernon (Supra) may be of some use. Most of such cases are based on the confessional statements of the accused and the statements of the co-accused and protected witnesses. Sometimes the entire case is based on disclosures and the Investigating agencies ends up in filing voluminous documents in relation to the recovery and disclosures.

Now, with regard to disclosures and admissibility, Jaffar Hussain Dastagir v. State of Maharashtra (1969) 2 SCC 872 and Pulukuri Kottaya v. King Emperor (1946) SCC online Privy Council 47, which states that under Section 25 of the Evidence Act no confession made by an accused to a police officer can be admitted in evidence against him. An exception to this is however provided by Section 26 which makes a confessional statement made before a Magistrate admissible in evidence against an accused notwithstanding the fact that he was in the custody of the police when he made the incriminating statement. Section 27 is a proviso to Section 26 and makes admissible so much of the statement of the accused which leads to the discovery of a fact deposed to by him and connected with the crime, irrespective of the question whether it is confessional or otherwise. The essential ingredient of the section is that the information given by the accused must lead to the discovery of the fact which is the direct outcome of such information. Secondly, only such portion of the information given as is distinctly connected with the said recovery is admissible against the accused. Thirdly, the discovery of the fact must relate to the commission of some offence.

The embargo on statements of the accused before the police will not apply if all the above conditions are fulfilled. Section 27 of the Evidence Act is an exception to the general rule under Section 25 that a confession made by an accused to a police officer is not admissible in evidence. The first condition for the applicability of Section 27 is that the information given by the accused must lead to the discovery of the fact, which is the direct outcome of such information. Only such portion of the information given as is distinctly connected with the said discovery is admissible against the accused. There is no embargo to deal with the statements and its admissibility by the Constitutional Courts even at the stage of Bail. The recently decided case of Thwaha Fasal -vs- Union of India [2021 SCC OnLine SC 1000] requires active membership for attracting sections 39 that would be gleaned from overt acts, but also narrows down the kinds of activity with which the association/support can be, by specifying that the “activity” here refers to committing of a “terrorist act”. The “activity” must be done with an intention and mens rea is to be considered. As such in some cases, wherein there are no overt act committed by persons-accused the Judgment of National Investigation Agency v. Zahoor Ahmad Shah Watali supra, may not come into way whilst considering the Bail.

It may be seen from the above, that the Supreme Court may not have granted bail to the accused persons in the recent times in merits but have granted concession due to delay in trial, however cases such as Vernon and Thwaha Fasal may come into play in deciding the future cases where there is embargo in bail, till the time Watali (Supra) is decided by a larger bench.

It is well settled law that an accused cannot be detained under the guise of punishing him by presuming the guilt as held in Vaman Narain Ghiya v. State of Rajasthan, (2009) 2 SCC 281. Also, in Ranjitsing Brahmajeetsing Sharma v. State of Maharashtra [(2005) 5 SCC 294 : 2005 SCC (Cri) 1057] the Hon’ble Supreme Court has held at Paragraph 38, that “We are furthermore of the opinion that the restrictions on the power of the court to grant bail should not be pushed too far.

If the court, having regard to the materials brought on record, is satisfied that in all probability he may not be ultimately convicted, an order granting bail may be passed. The satisfaction of the court as regards his likelihood of not committing an offence while on bail must be construed to mean an offence under the Act and not any offence whatsoever be it a minor or major offence. What would further be necessary on the part of the court is to see the culpability of the accused and his involvement in the commission of an organised crime either directly or indirectly. The court at the time of considering the application for grant of bail shall consider the question from the angle as to whether he was possessed of the requisite mens rea.” The Judgment can be read with the provisions of section 39 (deals with the offences relating to support given to a terrorist organisation), of the 1967 UAP Act. The Judgments of Hitendra Vishnu Thakur and Others -vs- State of Maharashtra and Others [(1994) 4 SCC 602], Niranjan Singh Karam Singh Punjabi, Advocate -vs- Jitendra Bhimraj Bijjaya and Others [(1990) 4 SCC 76] and Usmanbhai Dawoodbhai Memon and Others -vs- State of Gujarat [(1988) 2 SCC 271], the manner in which stringent provisions of a statute ought to be interpreted has been laid down by the Hon’ble Supreme Court. The observation of the Hon’ble Supreme Court has been that the Constitutional Court ought to carefully examine every case, before making an assessment if the Act would apply or not.

When the statutes have stringent provisions the duty of the Court would be more onerous. Graver the offence, greater should be the care taken to see that the offence would fall within the four corners of the Act. Though these judgments were delivered while testing similar rigorous provisions under the Terrorist and Disruptive Activities (Prevention) Act, 1987, the same principle would apply in respect of the 1967 Act as well.

</excerpt>

In a significant development, the Supreme Court of India granted interim bail to Delhi Chief Minister Arvind Kejriwal on Friday in connection with a money laundering case linked to the controversial Delhi excise policy 2021-22. The court’s decision comes after Kejriwal’s arrest by the Enforcement Directorate (ED) on March 21, 2023.

A bench headed by Justice Sanjiv Khanna observed that certain legal questions raised by Kejriwal in his plea challenging his arrest necessitate consideration by a larger bench of the top court. Kejriwal argued that his arrest, which coincided with the announcement of the Lok Sabha elections, was influenced by external factors.

Key Observations by the Supreme Court:

Extended Incarceration: The Supreme Court noted that Kejriwal has been in custody for over 90 days while granting him interim bail in the ED case.

Role as Elected Leader: The court acknowledged Kejriwal’s position as an elected leader and Chief Minister of Delhi, emphasizing the importance and influence of his role. However, the court refrained from directing Kejriwal to step down, leaving the decision to him. “We are conscious that Arvind Kejriwal is an elected leader and the Chief Minister of Delhi. While we do not give any directions as we are doubtful whether a Court can direct an elected leader to step down or not to function as a chief minister or a Minister, we leave it to Arvind Kejriwal to make a call,” the court stated.

Right to Life: Highlighting the right to life, the court ordered Kejriwal’s release on interim bail, given the referral of the matter to a larger bench. “Given right to life is concerned and since matter is referred to larger bench, we direct Arvind Kejriwal to be released on interim bail,” the court ordered.

Grounds for Arrest: The Supreme Court ruled that mere interrogation cannot be a basis for arrest. “We have also held that mere interrogation does not allow you to arrest. That is not a ground under Section 19,” Justice Khanna said.

ED’s Power and Policy of Arrest: The top court raised three questions concerning the ED’s authority and its arrest policies, specifying that Kejriwal will be released on interim bail under the conditions outlined in the May 10 order.

Despite securing bail in the ED case, Kejriwal remains in custody due to an ongoing investigation initiated by the Central Bureau of Investigation (CBI).

</excerpt>

Pakistan’s National Accountability Bureau (NAB) has contested the Islamabad High Court’s decision to grant bail to Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan in a high-profile scandal involving 190 million pounds linked to the National Crime Agency (NCA), as reported by ARY News. The NAB Chairman has taken the matter to the Supreme Court of Pakistan, arguing that the high court overlooked critical facts while granting bail to the former prime minister in the NCA settlement case.

Earlier in May, the Islamabad High Court had approved bail for Imran Khan in the NCA settlement reference. The court, headed by Chief Justice Aamer Farooq and Justice Tariq Mehmood Jahangiri, reserved its verdict after concluding arguments, directing Imran Khan’s release on a Rs 1 million surety bond.

The NAB’s investigation revolves around allegations that Imran Khan, along with his wife Bushra Bibi and others, improperly acquired land in the name of the Al Qadir University Trust, causing a reported loss of 190 million pounds to the national treasury. The case involves accusations that funds amounting to Rs 50 billion were allegedly adjusted to 190 million pounds, transferred by the UK’s NCA to the Pakistani government.

In December 2023, the NAB filed a corruption reference against Imran Khan and seven others, including his wife, regarding the Al-Qadir University project, which was initiated by the PTI chief on December 26, 2019.

On June 20, the Rouse Avenue Court had granted bail to the Aam Aadmi Party (AAP) leader upon the payment of a Rs 1 lakh bond. Kejriwal had been arrested by the Enforcement Directorate (ED) on March 21 in connection with the now-scrapped Delhi Excise Policy case.

The high court ruled that the trial court’s bail order would be stayed until it could properly hear the matter. This decision came after the Rouse Avenue Court denied the ED’s request to delay Kejriwal’s bail for 48 hours to allow time for further legal action.

The ED then took the issue to the high court on Friday. During the hearing, counsels Additional Solicitor General SV Raju and Special Public Prosecutor Zoeb Hossain argued, “We were not given ample opportunity to argue the matter before the vacation judge…I was not even given time to file a written submission.”

</excerpt>

The Delhi High Court has denied former deputy chief minister of Delhi, Manish Sisodia, interim bail for six weeks in relation to the alleged State Excise policy case. However, the court has granted Sisodia permission to meet his ailing wife, who is currently in custody, for one day either at his residence or in the hospital. The court has specified that the meeting should take place between 10 AM and 5 PM on a day of convenience for Sisodia’s wife. It is important to note that Sisodia is prohibited from meeting and making any statements or engaging with the media during this period. He is only allowed to meet his wife and immediate family members.

In the meantime, the Delhi High Court has instructed the Delhi Police to ensure that no media gathering takes place when Sisodia visits his wife, whether at their residence or the hospital. The court has also imposed restrictions on Sisodia’s use of mobile phones and the internet during this period. However, the court has emphasized the importance of providing the best medical treatment to Mrs. Sisodia. While the choice of medical facility remains with the patient and her family, the court has suggested that she undergo examination by a board of doctors to be arranged by the medical superintendent of AIIMS.

Despite these considerations, the court has denied Manish Sisodia’s request for a six-week bail. The court deemed the allegations in the case to be of an extremely serious nature, taking into account the position Sisodia previously held.ED’s Counsel Zohaib Hossain on Saturday submitted a report in relation to Sisodia’s wife’s medical issue and opposed his interim bail plea.There is no substantial change in her health. Sisodia held 18 portfolios as a minister and did not have time to visit his wife.

Justice Dinesh Kumar Sharma, presiding over the bench, reserved the order after the completion of arguments on Friday. This comes after the same bench had previously reserved the order on Thursday regarding the bail plea of Abhishek Boinpally, a Hyderabad businessman involved in the same case. The Trial Court had previously denied bail to all the individuals involved.

Meanwhile, Sisodia’s legal team also moved an interim bail plea in Delhi High Court citing his wife’s medical illness. The interim bail is seeking court direction to grant six weeks of bail.The interim bail is opposed by the ED through Additional Solicitor General SV Raju who can visit his wife in a police escort. The court continues to hear the interim bail plea on Friday.Recently Delhi High Court dismissed the bail plea of Manish Sisodia in a CBI case alleging corruption in the implementation of the previous liquor policy in the national capital.

Last month, Delhi High Court issued notice to ED on Manish Sisodia’s bail petitions in a money laundering case in connection with the alleged excise scam.The Rouse Avenue Court earlier dismissed the bail plea of Manish Sisodia in a money laundering case related to the excise scam stating that “This case of economic offences having serious repercussions upon the general public and society at large as the evidence collected during investigation speaks volumes of his involvement in the commission of the said offence”

In light of his wife’s sickness, he has requested six weeks’ bail and moved for temporary release. On Thursday, the Justice Dinesh Kumar Sharma bench ordered ED to submit a joint response within a week, with the deadline set for May 11. </excerpt>

Manish Sisodia, a former deputy chief minister of Delhi, asserted before the High Court through Senior Advocate Dayan Krishnan that the Central Bureau of Investigation has no proof of his involvement in the alleged irregularities in the formulation and application of the Government’s excise policy.

After filing a FIR in the case more than six months prior, Sisodia was taken into custody on February 26, 2023. Additionally, not a single witness received a threat from the applicant during the whole inquiry that lasted six months prior to his arrest.

Sisodia (Applicant)in his bail stated that the possibility of a threat to witness cannot be said to arise without there being any material or antecedents of the Applicant. The witnesses in this case against the applicant are primarily civil servants, over whom the Applicant exercises no control, especially now since he has resigned from his official post.

After the conclusion of the submission arguements made by Sisodia’s lawyer, the bench of Justice Dinesh Kumar Sharma on Thursday fixed April 26, 2023, for the arguements of the Central Bureau of Investigation.
Meanwhile, Senior Advocate Mohit Mathur, also appeared for Aam Aadmi Party Leader Manish Sisodia submitted that my client was called for questioning for the second time in February 2023, so all these allegations about my being capable of influencing the witnesses is totally wrong.

Earlier the Delhi HC had issued notice to CBI on a bail plea moved by Manish Sisodia challenging a trial court order denying bail to him in a CBI case related to Excise.
Sisodia was arrested by the CBI on February 26, 2023, and is presently in Judicial custody. His bail plea was on March 31, 2023, by the trial Court in the case.
The trial Court while dismissing Sisodia’s bail plea said, “The court is not inclined to release him on bail at this stage of investigation of the case as his release may adversely affect the ongoing investigation and will also seriously hamper the progress”
According to the CBI, Sisodia had played the most important and vital role in the criminal conspiracy and he had been deeply involved in the formulation as well as the implementation of the said policy to ensure the achievement of the objectives of the said conspiracy.

The payment of advance kickbacks of around Rs. 90-100 crores was meant for him and his other colleagues in the GNCTD and Rs. 20-30 crores out of the above are found to have been routed through the co-accused Vijay Nair, Abhishek Boinpally and approver Dinesh Arora and in turn, certain provisions of the excise policy were permitted to be tweaked and manipulated by the applicant to protect and preserve the interests of South liquor lobby and to ensure repayment of the kickbacks to the said lobby, stated CBI.

Sisodia, in his bail petition in a trial court, stated that no fruitful purpose would be served to keep him in custody as all the recoveries in the case have already been made.He also stated that he joined the investigation as and when called for by the CBI. The other accused persons arrested in this case have already been granted bail, Sisodia noted further, adding that he held the important constitutional post of deputy CM of Delhi and has deep roots in the society.

The new application by G Janardana Reddy to ease the bail terms was denied by a bench of justices MR Shah and CT Ravikumar. In light of the forthcoming Assembly elections in Karnataka, senior attorney Meenakshi Arora requested a further prolongation of the easing of his bail condition.

Prior to this, the top court had mandated that Gali Janardhan Reddy’s multimillion-dollar illegal mining case be tried on a daily basis in the district court and allowed him to stay in Bellary until 6 November 2022, but strictly ordered that he not stay in the Bellay from 7 November 2022, till the continuance of trial in the matter.

The SC had directed the trial court to conduct the trial on a day-to-day basis from 9 November 2022 and to conclude the trial within a period of six months from 9 November 2022 without fail.

Earlier the court had granted relief to former Karnataka minister and mining baron, Gali Janardhan Reddy, accused in a multi-million illegal mining cases, by allowing him to visit and stay in the District of Bellary in Karnataka and Kadapa and Anantpuram in Andhra Pradesh with condition.

The court had then modified its January 20, 2015 bail order and relaxed his condition relation to his restrictions on his visit and stay over there.
Reddy was arrested in September 2011 and was granted bail in January 2015. While granting bail the apex court had imposed a condition on him not to visit these Districts.
Later, he filed an application seeking to relax the bail conditions imposed on him.

Kejriwal arrived at the CBI office at around 11 am, accompanied by Punjab Chief Minister Bhagwant Mann and other party leaders. He was questioned for nearly nine years.

His request for bail had been denied previously in February by the Kolkata Sessions Court. Siddiqui was detained in jail until February 15 after being arrested for assaulting officers.
Supporters of the Indian Secular Front (ISF) demonstrated against the detention of party head Naushad Siddiqui and 17 employees on January 25 in Kolkata.

When Siddiqui was speaking at a rally in Kolkata to commemorate his party’s founding day in January, ISF employees and police engaged in combat.

Following a fight with the police in January of this year, Naushad Siddiqui and 17 other party members were detained and held in police detention until February 1.
If the authorities did not release Naushad, the ISF threatened violent demonstrations in Kolkata, the capital of West Bengal. The founder of the Indian Secular Front, Pirzada Md Abbas Siddique, criticised the Trinamool Congress (TMC) administration of West Bengal, claiming that the TMC is attempting to contain the ISF due to its growing power.

“It is really regrettable. Every group is free to carry out its own programmes. That is such a tragic thing that occurred. It represents an effort to kill democracy. Such incidents convey Bengal the wrong message, “In February, Abbas Siddique told to mediapersons.

“ISF strikes the administration with fear. The ISF has a single MP. However, individuals of all linguistic and religious backgrounds are joining the ISF. The TMC officials are now afraid as a result of this “His addition was.

A video of the celebration by Ram Rahim with the giant cake has gone viral on social media.

In his bail application, Ram Rahim had said that he wants to attend an event to mark the birth anniversary of the former Dera Chief Shah Satnam on 25th January.
While dismissing the bail application of the accused Deepak Khanna, Rohini court rapped Delhi Police for filing an evasive and vague reply. The court said, “It appears that Investigation Officer (IO) is not opposing the bail application. The approach of the investigating agency appears to be non-serious.” The reply on future bail applications is directed to be supervised by the concerned DCP.

Additional Sessions Judge Sushil Bala Dagar said, “Further it is pertinent to mention that the reply which has been received to this bail application today is quite evasive, vague and non-specific on all grounds. It appears from the reply that the IO is not opposing the bail application.”

In future any application is moved in this matter, DCP is concerned to personally supervise the same and any response sent to the Court should be routed through the Office of DCP to reflect his supervision and application of mind over the investigation, the court directed.

“The investigation is still in the initial stages. The accused himself has given two versions to the investigating agency as mentioned in the bail application i.e. at the first instance, he stated that he was driving the vehicle and later on he is taking the defense that he was not driving the vehicle. Whether he was present inside the vehicle or not is yet to be investigated,” the court noted.

The Court further said that the arguments of Counsel for the accused regarding his GPS location or CDR are not tenable which seems to be his defence and the matter is still at the initial stage.

Delhi Police said the incident took place on January 8 when Jauhar Ali Khan urinated in the open in front of departure gate 6. He also abused other passengers, police said.

Jauhar Ali Khan was travelling to Dammam, according to the news agency ANI. The incident happened in the midst of controversy surrounding the Air India urination case, which led to the arrest of Mumbai-based businessman Shankar Mishra.

Mishra peed on a female business class passenger during an American-Delhi aircraft while intoxicated. When the passenger complained to Air India about how Mishra was left unpunished when the plane landed in India, the event involving Air India came to light.

Since Air India was criticised for its slow response to the issue, the incident exposed the airline’s current situation.
