</excerpt>

Yoga mentor Baba Ramdev has told the Delhi High Court that he will remove all videos and social media posts containing his controversial “Sharbat Jihad” remark. This assurance was made in response to a lawsuit filed by Hamdard, the makers of the well-known drink Rooh Afza.

Controversial Comment Sparks Outrage

The dispute began when Ramdev, in a promotional video, allegedly claimed that Hamdard was using its profits to build mosques and madrasas. He referred to Rooh Afza as part of a supposed “sharbat jihad.” Hamdard strongly objected, accusing Ramdev of trying to spread communal tension and damage their brand.

Court Expresses Disapproval

Justice Amit Bansal, who presided over the hearing, reacted sharply to the remark. He said, “When I saw this ad, I could not believe my ears and eyes.” The court criticized the communal tone of the video.

Senior Advocate Rajiv Nayar, appearing for Ramdev and Patanjali, informed the court that the videos would be taken down.

Court Demands Written Commitment

Despite the assurance, the court asked Ramdev to file an affidavit. He must confirm in writing that he will not make such statements again. Justice Bansal remarked, “He can keep these thoughts in his mind but should not express them.” The court has scheduled the next hearing for May 1.

Rooh Afza Remarks Under Scrutiny

The controversy dates back to April 3, when Ramdev, while endorsing Patanjali’s Gulaab Sharbat, criticised Rooh Afza. He accused Hamdard of redirecting its revenue toward religious activities, specifically the construction of mosques and madrasas. He called this alleged campaign “sharbat jihad.” Senior advocates Mukul Rohatgi and Sandeep Sethi represented Hamdard. They argued that Ramdev’s remarks aimed to tarnish their image and incite religious bias.

Broader Concerns Over Communal Speech

The case has raised serious concerns about the use of religiously divisive language in public promotions. The court’s intervention signals a firm stance against rhetoric that threatens social harmony.

Decoding the ‘Sharbat Jihad’ Row Involving Baba Ramdev

<excerpt>Baba Ramdev stirred controversy by labeling a rival rose sharbat as ‘Sharbat Jihad’, alleging it funds mosques and madrasas. Patanjali promoted its own alternative, while Hamdard defended RoohAfza’s purity, prompting widespread backlash and online debates over communal rhetoric.
</excerpt>

Baba Ramdev has stirred controversy once again with a video that recently went viral. While endorsing new rose-flavoured sharbat of Patanjali, he introduced the term ‘Sharbat Jihad’, sparking widespread debate.

In the promotional clip, Ramdev criticised a rival company believed to be Hamdard, the maker of RoohAfza claiming that proceeds from the sale of their beverage are being used to fund religious institutions. “There’s a company which provides you sharbat, but the earnings earned from it are used to build madrasas and mosques,” Ramdev alleged. “If you drink that sharbat, madrasas and mosques will be built. But if you drink this (Patanjali’s rose sharbat), gurukuls and Acharya Kulam will be built and established, and Patanjali University will come into existence.”

We got “Sharbat Jihad” before GTA VI ?? pic.twitter.com/qIuLrkhJxe

— Yash Tiwari (@DrYashTiwari) April 9, 2025

Making a provocative comparison, Ramdev said that just as ‘love jihad’, promoting some drinks is a ‘sharbat jihad’. He also asked netizens to share it widely so that people become aware.

The objectionable video was posted by the Facebook page ‘Patanjali Products’ with a Hindi caption which, when translated, cautioned viewers: “Save your family and innocent children from the toilet cleaner poison sold in the name of ‘sharbat jihad’ and cold drinks. Take only Patanjali sharbat and juices home.”

Hamdard Responds

Though Hamdard did not specifically mention Ramdev or Patanjali, the firm seemingly replied through X (formerly Twitter). Highlighting its dedication to quality, Hamdard pointed out that it follows strict food safety systems like the Hazard Analysis and Critical Control Points (HACCP) and the Food Safety Management System (FSMS).

Furthermore, the company assured its customers that RoohAfza is prepared using only FSSAI-approved herbs and natural ingredients, so it is not adulterated.

Every sip of RoohAfza is made with FSSAI-approved ingredients — from herbs to natural flavors — with no artificial adulteration. We’re committed to delivering quality and authenticity in every bottle.

Social Media Reactions

The internet soon got wind of the ‘Sharbat Jihad’ comment and got into a frenzy of reactions. Some readers remembered past occasions when Ramdev attacked other brands with new product launches. One of them wrote, “Baba ney toh Nestle Maggie mein bhi khaami batai thi jab inka koi naya product aata hai toh yeh aise hi afwah felate hai.” (Baba had also spoken of flaws in Nestle Maggie. Whenever there is a new product of his, he does this kind of spreading of rumors.)

Political cartoonist Satish Acharya too joined the discussion, posting a satirical cartoon called ‘Bottled Hatred’ which severely criticized the rhetoric.

Legal Trouble for Patanjali

This isn’t the first time Patanjali and its founders have come under legal scrutiny. In recent months, the Indian Medical Association (IMA) filed a plea in the Supreme Court against Patanjali Ayurved, accusing the brand of misleading advertisements. The court responded by temporarily halting Patanjali’s ads and issuing contempt notices.

Earlier this year, a Kerala court issued bailable warrants against Ramdev and Patanjali MD Acharya Balkrishna for not appearing in a case regarding fraudulent marketing practices by Divya Pharmacy, a Patanjali group affiliate. A similar case was filed in Kozhikode.

</excerpt>

He’s been making waves after uploading a video online of him gulping donkey’s milk, touting it to have health benefits. An exponent of Ayurvedic solution to everyday lifestyle problems, Ramdev made this unusual beverage known throughout India and the rest of the world.

Baba Ramdev and his Donkey’s Milk Experiment

In the video, Ramdev is seen milking a donkey before tasting the milk for the first time. “I am trying donkey’s milk for the first time in my life. I’ve also tried milk from camels, cows, sheep, and goats,” Ramdev said. He went on to describe the milk as “very tasty” and “exceptional,” highlighting its benefits for both health and beauty.

Historical References and Health Benefits

Ramdev drew a parallel between donkey milk and its reputed use by Cleopatra, the ancient Egyptian queen. According to historical accounts, Cleopatra bathed in donkey’s milk to maintain her beauty. According to Ramdev, donkey milk acts as a “super tonic” and a “super cosmetic,” offering a range of benefits for skin and health.

WATCH THE VIRAL VIDEO:

This lungi chhap Baba increasing his power by drinking a donkeys milk pic.twitter.com/I2jjivPwvg

— Sandeep Singh Deol (@SandeepSin23488) December 3, 2024

Moreover, Ramdev claimed that people with cow’s milk allergy can safely consume donkey milk, which can be an alternative for those who have dietary restrictions.

High Cost of Donkey Milk

Though the product is said to have various benefits, donkey milk is very costly compared to cow’s milk, which costs around Rs 65 per liter in India. Donkey milk can range from Rs 5,000 to Rs 7,000 per liter, and it is a luxury product. Though Ramdev may be supporting its benefits, the high price may not reach many.

Donkey Milk in India: Rare But Legal

Even though the milk is rarely used as food in India, the FSSAI reported that there is no concern with regard to safety and toxicity. Still, absence of a law and regulation for this milk with respect to food product; also, the social taboos and the low yield prevent it from becoming commercially available.

Health Considerations and Expert Opinion

Although some studies show benefits to health from donkey milk, the experts advise consulting a doctor before using it in a diet. Because of its rarity and the high price, most do not consider it an alternative.

The latest in Baba Ramdev’s long list of unorthodox health practices is donkey milk. It is too early to say if donkey milk will become popular, but certainly, Ramdev’s endorsement has created an interest in its possible benefits. Whether it becomes a mainstream health trend or remains a niche product will depend on further public reception and regulatory developments.

Baba Ramdev’s viral donkey milk video might seem an outlier in the health and wellness industry, but it has put the spotlight on a rare product with potential health benefits. As Ramdev’s influence grows, donkey milk might see a surge in popularity—though the high cost and social barriers might limit its widespread adoption.

The court has issued notices to Baba Ramdev and Divya Pharmacy, with the next hearing scheduled for November 28.
</excerpt>

The Delhi High Court has issued notices to Baba Ramdev and Patanjali’s Divya Pharmacy on Friday in response to a petition alleging that the herbal tooth powder, Divya Dant Manjan, contains non-vegetarian ingredients despite being labeled as vegetarian. The petition, filed by Yatin Sharma, challenges the product’s labeling, which the petitioner says displays a green dot—commonly recognized as a symbol for vegetarian products—while the ingredient list includes Sepia officinalis, a substance derived from cuttlefish. The court scheduled the next hearing for November 28.

17% people think that there should be an investigation on Divya Dant Manjan claim to use non-veg materials

Here’s the Survey:

Q1: Despite the Supreme Court’s warning, allegations of misleading information being given on Patanjali products are being made. What action should be taken?

On Monday, the Delhi High Court issued an interim order directing Baba Ramdev, Acharya Bal Krishan, and others to remove statements and social media posts that accuse allopathic medicine and doctors of causing deaths during the COVID-19 pandemic. The court’s order is aimed at addressing concerns that promoting and advertising Patanjali’s Coronil as a COVID-19 treatment could mislead the public and potentially harm the credibility of Ayurveda.

The court observed that branding Coronil as a cure for COVID-19 might amount to mislabeling, which is prohibited under the Drugs and Cosmetics Act, 1940. The court has asked the relevant authorities to look into this issue but refrained from making further comments on the matter.

Justice Anup Jairam Bhambhani instructed the defendants to remove their social media posts promoting Coronil as the sole cure for COVID-19 within three days. If they do not comply, social media platforms will be required to remove the content.

This order came in response to a lawsuit filed by various doctors’ associations against Ramdev. These associations challenged Ramdev’s claim that Coronil is a cure for COVID-19, arguing that it is only licensed as an “immuno-booster.” The plaintiffs have criticized the lack of scientific evidence supporting Ramdev’s claims and contended that such statements are misleading.

The senior counsel for the plaintiffs had previously sought an injunction to prevent further misleading claims about Coronil. They argued that the product’s official license only supports its use as an immunity booster, not a cure.

Ramdev’s senior lawyer assured the court that Ramdev would comply with an undertaking given to the Supreme Court regarding advertisements for Patanjali products and expressed willingness to provide a similar undertaking in the Delhi High Court. The lawyer pointed out that the previous Supreme Court undertaking was related to avoiding casual statements that did not meet legal standards.

Justice Bhambhani acknowledged the specific nature of the misleading claims in this case and reserved his decision. In 2021, several doctors’ associations, including those from AIIMS and other prominent institutions, had filed a lawsuit alleging that Ramdev’s statements undermined public trust in allopathic medicine and COVID-19 vaccines. They claimed that Ramdev was promoting misinformation to boost sales of Coronil and other Patanjali products.

</excerpt>

Yoga guru and entrepreneur Baba Ramdev has expressed his support for the Uttar Pradesh and Uttarakhand governments’ directive that mandates shopkeepers along the Kanwar Yatra route to display their names. Ramdev highlighted the significance of being proud of one’s identity.

“If I have no issue in revealing my identity, why should anyone else? Everyone should take pride in their name. There’s no need to conceal it; only purity in work is necessary. If our work is pure, our religion or community does not matter,” he stated on Sunday morning.

Following suit, Ujjain’s municipal body also issued a directive requiring shop owners to display their names. Ujjain Mayor Mukesh Tatwal announced that violators would face a ₹2,000 fine for the first offence and ₹5,000 for repeated non-compliance.

“Ujjain is a city of religious significance. Visitors come here with faith. They have the right to know the shopkeeper’s identity whose services they use. If dissatisfied or cheated, knowing the shopkeeper’s details helps them seek redress,” he said.

The directive has sparked controversy. AIMIM president Asaduddin Owaisi argued that it reflects growing hostility towards Muslims in India. “Fear on UP’s Kanwar routes: This is the reality of hatred for Indian Muslims. Political parties, leaders of Hindutva, and so-called secular parties are responsible for this visceral hatred,” he stated on ‘X’.

CPI(M) leader Brinda Karat criticized the Uttar Pradesh government, asserting, “The Uttar Pradesh government is undermining the Constitution of India with such orders. They are humiliating an entire community and attempting to divide society. This type of targeting was done by Nazis in Germany. I condemn it.”

Shiv Sena (UBT) MP Sanjay Raut accused the BJP of creating division. “Now you’re directing food stalls to put up nameplates based on caste and religion? Do you want to divide the country? This won’t benefit you. You are disrupting national unity,” he said.

Conversely, West Bengal BJP chief Sukanta Majumdar accused the Opposition of misleading the public, noting that similar notifications were issued during the Mulayam Singh Yadav and Akhilesh Yadav governments.

Anant Ambani, the younger son of Mukesh and Nita Ambani, exchanged vows with Radhika Merchant, daughter of Encore Healthcare CEO Viren Merchant, at Mumbai’s Jio World Plaza on July 12. In an interview he also stated ” Patanjali denotes nationalism and self-pride which this group wants to destroy.

Ramdev also stated that some people have been spreading false news about the company. “People try to damage the reputation of Patanjali, about Ayurveda and natural products” he added.

He also said there is a conspiracy against Patanjali’s research and development facilities, which he claims are even better than government’s Ayurvedic facility.

“Despite all hurdles and struggles we have reached where we are. We didn’t reach here because of any favours. We are here because of our India’s consumers”, Baba said.

Sanjeev Asthana, the CEO of Patanjali foods, dismissed claims that the company’s market share and image of the brand has weakened over the past two years due to quality concerns and increased competition. He stated that Patanjali holds a two-thirds share in the herbal toothpaste market, is the fourth largest biscuit player in the country with sales of Rs. 1,600 crore last year.

</excerpt>

In a setback for yoga guru Ramdev Baba and the managing director of Patanjali Ayurved, Balkrishna, the Supreme Court (SC) refused their affidavits. The document is offering unconditional apologies for publishing “misleading” advertisements. The court remarked that it was not oblivious to the situation and noted that the apologies were only forthcoming after being “caught on the wrong foot.” The case is scheduled for the next hearing on April 16.

Furthermore, the court strongly criticized the State Licensing Authority for its inaction on the matter, stating that it would not tolerate such negligence. The bench issued a stern reprimand, stating, “We will scrutinize your actions thoroughly. Do you possess the courage to stand by what you’re doing? You’re merely acting as a conduit,”

The Uttarakhand government also faced criticism from the court for its failure to take action against Patanjali Ayurved for violating the law.

The Indian Medical Association (IMA) lodged a petition in the Supreme Court in August 2022 following Patanjali’s publication of an advertisement titled ‘Misconceptions Spread by Allopathy: Save Yourself And The Country From The Misconceptions Spread By Pharma And Medical Industry.’

The petition outlined instances where Ramdev had disparaged allopathy as a “stupid and bankrupt science” and made assertions about allopathic medicine’s role in COVID-19 deaths. The IMA also accused Patanjali of contributing to vaccine hesitancy during the pandemic. The association asserted that the “continuous, systematic, and unabated spread of misinformation” coincided with Patanjali’s dissemination of false and baseless claims regarding the efficacy of Patanjali products in curing certain diseases.

Baba Ramdev along with Balakrishnan filed a plea over a Misleading Advertisement by Patanjali which was declined by Supreme Court

Additionally, a criminal complaint has allegedly been lodged against Ramdev, Acharya Balkrishna, and Patanjali for breaching the Drugs and Magic Remedies Act.

The case against Ramdev in the Supreme Court stems from allegations by the Indian Medical Association that his company, Patanjali Ayurved, disparages conventional medicines and continues to publish misleading ads despite a court order to cease.

Ramdev has acknowledged his wrongdoing and his company has issued newspaper advertisements apologizing to the public. In recent weeks, he has appeared before the judges of the Supreme Court clad in his signature saffron-colored robe, seeking forgiveness. However, the judges have thus far not accepted his apology, and they are deliberating whether to pursue contempt charges against Ramdev.

In that order, the court noted assurances from counsel representing Patanjali Ayurved that there would be no further violations of laws, particularly regarding advertising or branding, and no release of casual statements claiming medicinal efficacy or against any system of medicine.

Further talking about the effects of misleading ads, the Supreme Court has further declared that as a result, the health of people is under threat. Especially the vulnerable like babies, school-going children and senior citizens. Who are the customers of these products. “In particular, affecting health of babies, school-going children and senior citizens who have been consuming their products.”

To deal with this malady, the apex court had given directions to central ministries, to file affidavits in regard to the actions taken by on these misleading advertisements in the last three years. Further it has also asked the licensed authorities of the state and Union territories, to be impleaded in this case as parties.

Meanwhile further attacking the petitioner, The IMA, that with regard to the unethical practices, it needs to set its house on order. Especially those acts where prescribed medicines are expensive and unnecessary.

Later opining that it is not here to promote any party. It is here in the largest interest of the consumers or public on how they are being misled. And their entitlement to know the truth and what steps they can take on their behalf.

What is the Root of this Case?

The Supreme court is hearing on a contempt of court case involving Baba Ramdev and Acharya Balkrishna on the misleading ads disseminated by the Patanjali ayurved on 23rd April 2024.

The petitioner Indian Medical association has accused the ayurved company for the propagation of smear campaign against modern medicines and Covid-19 vaccination drives. One of the biggest allegations made by the IMA was the during its promotion, the Patanjali claimed that they can cure diseases like Covid-19 without giving any evidence.

Which violates the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. Which prohibits the advertising of magical & miraculous properties that claim to cure diseases and disorders. It’s punishment is the imprisonment up to 1 year or fine or both.

The court also opined that while the IMA is busy pointing fingers towards Patanjali, four fingers are also being pointed towards it. “Your (IMA) doctors are also endorsing medicines in the allopathic field. If that’s happening, why should we not turn the beam at you (IMA)?”

The Supreme Court has granted a week to Yoga guru Ramdev and Patanjali Ayurved Ltd MD Balkrishna Acharya to rectify their alleged contempt, following their lawyers’ offer to issue a public apology for a case involving misleading advertisements.

Senior advocate Mukul Rohatgi, representing Ramdev and Balkrishna, stated, “I am willing to give a public apology,” to a bench comprising Justices Hima Kohli and Ahsanuddin Amanullah.

The court requested Ramdev and Balkrishna, both present in court, to engage in a dialogue with the bench, emphasizing the importance of them feeling connected to the court.

During the ongoing hearing, the bench is currently in discussion with Ramdev.

Both Ramdev and Balkrishna have submitted “unconditional and unqualified apologies” to the apex court regarding advertisements by the firm that made exaggerated claims about the effectiveness of its products.

In separate affidavits filed before the court, they offered apologies for breaching the statement recorded in the apex court’s order dated November 21 of the previous year.

In that order, the court noted assurances from counsel representing Patanjali Ayurved that there would be no further violations of laws, particularly regarding advertising or branding, and no release of casual statements claiming medicinal efficacy or against any system of medicine.

The court reminded Patanjali Ayurved Ltd of its commitment to these assurances.

The failure to uphold these specific assurances and subsequent media statements displeased the apex court, which subsequently issued a notice to them to explain why contempt proceedings should not be initiated.

</excerpt>

The Supreme Court is hearing a contempt case against Patanjali Ayurved for its deceptive ads and promises regarding a treatment for Covid-19. Yoga guru Ramdev and his partner Balkrishna are appearing in court right now. The court had sharply chastised the Patanjali founders during the previous hearing and chastised the Uttarakhand government for doing little to stop the Haridwar-based company.

This morning, Justices Hima Kohli and A Amanullah acknowledged the significant contributions of the Patanjali founders to yoga. “We respect what you have done for yoga,” the bench remarked. Ramdev and Balkrishna expressed their readiness to issue a public apology, with Ramdev clarifying that it was never his intention to undermine the prestige of the Supreme Court.

However, the court raised concerns about their “attitude” and questioned their dismissal of other medical systems in favor of emphasizing the benefits of Ayurveda. Justice Amanullah emphasized that “the law is the same for everybody,” to which Ramdev assured that he would be more cautious in the future.

The court stated that it would deliberate on the matter considering all previous developments. “We have not decided whether to forgive you or not. You have violated directives thrice. The earlier orders are under our consideration. You are not so innocent that you did not know what’s happening in court,” the court noted. The next hearing is scheduled for April 23, and Ramdev and Balkrishna have been instructed to appear again and demonstrate their sincerity.

Speaking to the media outside the court, Ramdev expressed his confidence in the judiciary, stating, “I have said what I had to. I have full faith in the judiciary.”

Previously, the court had rejected two apologies from Ramdev and Balkrishna, noting that the letters were initially sent to the media. Justice Hima Kohli remarked, “Till the matter hit the court, the contemnors did not find it fit to send us the affidavits. They believe in publicity clearly.”

Justice A Amanullah questioned the sincerity of the apology, stating, “Tendering apology is not enough. You should suffer the consequences for violating the court’s order.”

The case stems from the launch of Coronil by Patanjali during the Covid years, with Ramdev claiming it to be the “first evidence-based medicine for COVID-19.” The Indian Medical Association contested this claim, leading to a legal tussle. Despite assurances from Patanjali’s counsel, the Supreme Court continues to scrutinize the company’s actions, especially regarding misleading advertisements.

Justices Hima Kohli and Ahsanudding Amanullah expressed deep concerns about the countless innocent individuals who had been misled by the medicines, emphasizing the court’s steadfast commitment to holding FMCG companies accountable for their deceptive advertising practices.

They demanded swift action against officials who had neglected their duties, and they mandated responses from district Ayurvedic and Unani officers dating back to 2018. The court underscored the paramount importance of upholding its orders and dismissed the apologies, deeming them as deliberate acts of disobedience.

The affidavit submitted by the State Licensing Authority, attempting to explain its actions regarding objectionable ads, was sharply criticized for its lack of meaningful action. Despite previous apologies, new ones were tendered promising compliance with the law, yet the court remained skeptical, underscoring the gravity of the violations and their impact on its directives.

In firm remarks, the court stated that the apology seemed merely “on paper” and was made due to their dire situation. Justice Hima Kohli emphasized that their actions constituted a deliberate violation of their undertaking.

The court criticized their conduct as deliberate disobedience, refusing to acknowledge the apology. It deemed their actions as a willful violation of the agreement.

Despite Baba Ramdev’s affidavit expressing “unconditional and unqualified” regret, the court emphasized the importance of sending a clear message to society. Additionally, the court noted that the individuals involved first sent their affidavits to the media, indicating their inclination towards publicity.

Baba Ramdev expressed sincere regret in his affidavit, pledging to uphold the law and justice. He also assured that no advertisements claiming to cure diseases would be published and apologized for a press conference held in November 2023.

Similarly, Acharya Balkrishna pledged to prevent such misleading advertisements in the future and promised to be more vigilant.

Previously, the court had instructed both individuals to submit fresh affidavits and appear in person. This came after the company failed to respond to a show-cause notice in contempt proceedings regarding misleading advertisements.

The court had expressed prima facie evidence of a violation of its November 2023 order by Baba Ramdev and Acharya Balkrishna.

</excerpt>

Yoga guru Baba Ramdev and Patanjali Ayurved’s Managing Director Acharya Balkrishna arrived at the Supreme Court on Wednesday to attend the hearing relating to misleading advertisements by Patanjali Ayurved.

Yesterday, Ramdev and Acharya Balkrishna filed an affidavit in the Supreme Court and tendered an unconditional apology regarding the case, and added that they will uphold the majesty of law and justice.
In an affidavit filed before the top court, Ramdev said, “I seek pardon for the aforesaid breach of the statement. I undertake to always uphold the majesty of Law and majesty of Justice.”

Ramdev informed the top court that he sincerely regrets the lapse and wishes to ensure that the same will not be repeated in the future. He also undertook and ensured that the statement shall be complied with in letter and spirit and no such similar advertisements shall be issued.

Ramdev further tendered an unconditional and unqualified apology for the press conference held on November 22 last year.

Acharya Balkrishna said that he undertakes to ensure that such offending advertisements shall not be issued in the future and he will be more vigilant ahead.

In the last hearing, the Supreme Court asked Yog guru Baba Ramdev and Acharya Balkrishna to file fresh affidavits within a week in a matter pertaining to misleading advertisements by the Patanjali Ayurveda.

A bench of justices, Hima Kohli and Ahsanuddin Amanullah, listed the matter for further hearing on April 10 and directed Ramdev and Balkrishna to appear before it.

Earlier, Ramdev and Acharya Balkrishnan tendered unconditional apology before the Supreme Court for violating the apex court’s order for misleading advertisements of Patanjali’s medicinal products.

However, the court took strong exception on the apology tendered by both of them and said that they have violated the undertakings given to the top court so that they are taking it seriously.

The court was dealing with an Indian Medical Association plea seeking to frame guidelines for prohibiting false and misleading advertisements in relation to allopathy and modern medicine.

IMA, in his plea, had sought to pass an order directing the Centre and others to immediately take strict and prompt action, in accordance with law, for the violation of the provisions of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, the Drugs & Cosmetics Rules, 1945 and the Consumer Protection Act, 2019 by the repeated acts of omission and commission of Respondent Patanjali Ayurved Ltd. including by publishing advertisements all over the country making illegal and prohibited claims.

</excerpt>

Yoga guru Ramdev and his associate Balakrishna reached in the Supreme Court today regarding the issue of “misleading advertisements” by Patanjali Ayurved.

The Supreme Court expressed strong dissatisfaction with Ramdev and Balakrishna for their failure to comply with its directives. “Be prepared for action,” the Supreme Court cautioned Ramdev.

Additionally, the Supreme Court declined to accept an apology previously submitted by Patanjali last month. “We are not satisfied with your apology,” the apex court remarked.

Subsequently, Ramdev apologized in court. “We wish to express our regret and are prepared to abide by the court’s decision,” conveyed the yoga guru’s lawyer with folded hands.

On February 27, the Supreme Court had instructed the company to cease all electronic and print advertisements of its medicines containing “misleading” information immediately.

The court also reprimanded the Centre for its lack of action, criticizing them for being passive. “This is highly regrettable. The government must take immediate action,” the bench had emphasized.

The case originated in November last year when the Supreme Court, while addressing a petition filed by the Indian Medical Association (IMA), cautioned Patanjali Ayurved against disseminating “false” and “misleading” claims in its advertisements about its medicines.

The IMA had highlighted various advertisements allegedly portraying allopathy and doctors in a negative light, asserting that certain ayurvedic medicine-producing firms had made “derogatory” remarks to deceive the public.

These advertisements purportedly suggested that medical practitioners themselves were succumbing to ailments despite relying on modern medicines, as outlined by the IMA’s counsel.

The apex court, on Tuesday, served a notice to Patanjali Ayurved and its founders to put a temporary ban on its highly misleading ads claiming to completely cure diseases like diabetes, high blood pressure, arthritis, asthma and obesity.

This came after the court observed that the FMCG company had violated its previous ruling which banned Patanjali from issuing such misleading ads. The court also rapped the centre saying, “The government is sitting with its eyes closed while the entire country was taken for a ride.”

Meanwhile, the Ramdev-led Patanjali Foods said, “The observations of the Supreme Court of India do not relate to the company as it is an independent listed entity and operates in the space of edible oil and food FMCG products only.” Further insisting that the business operations wouldn’t be impacted by the top court’s decision.

The yesterday’s notice came as a response to the plea filed by the Indian Medical Association against the Ramdev-led Ayurved giant for carrying a campaign against allopathic medicines.
