Delhi Car Horror Case: Murder Section added based on evidence

In the Kanjhawala hit-and-drag case, Section 302 (murder) of the Indian Penal Code (IPC) was added by the Delhi Police on Tuesday.

Meanwhile, the IPC’s Sections 304, “culpable homicide not amounting to murder,” and 302 are used to charge “murder” in the case.

Sagar Preet Hooda, special CP, Law & Order (Zone II, Delhi), said, “After the collection of evidence, police have added IPC Section 302 in place of Section 304.”

Moreover, the murder section was included by the police based on the physical, oral, forensic, and other scientific evidence collected.

However, further investigation into the case is underway.

Earlier in the day, the Rohini Court granted accused Ashutosh bail on a Rs 50,000 bond. Rohini’s court imposed a condition on his departure, stating that he would not leave Delhi without the court’s permission.

Earlier on 12 January the Rohini court rejected Ashutosh Bhardwai’s bail plea because of the gravity and sensitivity of the allegations. The court said that the investigation against Ashutosh is still in its initial stages.

However, Anjali was killed in the early hours of the New Year after her scooter was hit by a car and she was dragged under the vehicle for 13 kilometers on the city’s roads.

Delhi Car Horror Case: Rohini Court grants bail to accused Ashutosh

In the Kanjhawala case, the Rohini Court granted accused Ashutosh bail on a Rs 50,000 bond.

Meanwhile, Rohini’s court imposed a condition on his departure, stating that he would not leave Delhi without the court’s permission.

The court said that the accused would not tamper with the evidence, and would not contact the witnesses. Despite the Delhi Police’s opposition to bail, accused Ashutosh got bail.

The bail plea of Ashutosh was reserved after hearing the submissions of the Delhi police and defense counsel. After which, Ashutosh’s lawyer said that Ashutosh was not present in the car at the time of the incident.

However, Ashutosh Bhardwaj’s counsel, advocate Shipesh Chaudhary, said when the incident took place, his applicant was at home. In this case, Ashutosh’s counsel submitted Ashutosh’s iPhone, which records the live locations.

“The only allegations against him are under 212, 201, and 120B Part, and these are bailable in nature,” Chaudhary said.

Chaudhary further said that when the offense was committed, Ashutosh was not in the car.

“Another suspect, Ankush, is out on bail,” Chaudhary said.

“Before the stage of charge, the document can’t be produced by the defense. The authenticity of this video can’t be established as these are without section 65B of the Evidence Act certificate,” Special public prosecutor (SPP) Atul Srivastava said.

SPP Srivastava also submitted, “We never said he (Ashutosh) was in the car. Our stand is that he provided his vehicle to a person who was not authorized to drive.”

“He did not inform the police regarding the accident for which he was under legal compulsion. He didn’t inform the police about the incident despite having knowledge,” SPP said.

In the Kanjhawala death case, the hearing on the bail plea of Ashutosh Bhardwaj has been adjourned on Tuesday by the Rohini Court, Delhi for Thursday. Ashutosh Bhardwaj is one of the accused in Anjali’s death case.

Meanwhile, the other six accused are under judicial custody. The concerned judge was not available today that’s why the hearing on the bail plea of Ashutosh was adjourned by Link Metropolitan Magistrate.

Accused Ashutosh’s Advocate Shilpesh Chaudhary requested the linked judge to list the matter. Earlier on Monday the court of Metropolitan Magistrate Sanya Dalal asked Delhi Police to reply to Ashutosh Bhardwaj’s bail plea.

Moreover, the Additional public prosecutor (APP) Atul Srivastava for Delhi Police said and urged that the accused be sent to Judicial custody.

The sections which are put up on the accused are 201, 212, and 120B part 2 which are bailable.

Court said, “As of now section 304 IPC is against Ashutosh.”

In the Kanjhawala case, the seventh accused Ankush was also arrested and Ankush was the one who helped the other accused to flee by arranging an auto.

Delhi Car Horror Case: Rohini Court sends 6 accused to 14-day judicial custody

In the Kanjhawala case, Rohini Court on Monday granted 14 days of judicial custody of six accused who allegedly killed a 20-year-old woman and was dragged to death by a car on 1 January 2023.

Meanwhile, in the Kanjawala Death case of all accused Delhi Police had on Monday sought judicial custody. On the bail application of Ashutosh court has asked Delhi police to file a reply by Tuesday.

Earlier on Monday Delhi police revealed that all the accused were aware that Anjali was trapped under their car.

“The accused in the car did not take Anjali out because the accused were afraid that if they got down from the car and took Anjali out, they might get into legal trouble if someone saw them,” Delhi Police said.

In connection with the 1 January incident, the sixth suspect Ashutosh was arrested by the Delhi Police on Friday.

Moreover, in the case, the seventh accused Ankush was also arrested and Ankush was the one who helped the other accused to flee by arranging an auto.

Delhi Car Horror Case: Ashutosh met with accused after incident in CCTV visuals

There is a new development in the Kanjhawala car accident death case in which the new CCTV footage revealed that the accused are seen outside the home of Ashutosh, the owner of the car after a 20-year-old woman named Anjali died after being dragged under a car for several kilometers in Delhi.

In connection with the 20-year-old woman’s death, the sixth suspect Ashutosh was taken into custody by Delhi Police on Friday and for the seventh person the hunt has been launched by the police.

After the accident, Ashutosh was seen talking to the accused in the CCTV visuals. At 4:07 am one of the accused arrived to meet Ashutosh and later he was seen coming and going into his house.

According to the police, the seventh accused in the case is none other than Ankush. Earlier on Thursday the Special Commissioner of Police (Law & Order) Delhi Police Sagar Preet Hooda said the five accused Ashutosh and Ankush Khanna- were friends.

“In the new CCTV visuals, Ankush is also talking to someone on the phone,” Delhi Police said.

“Ankush was talking to the accused on the phone. Ashutosh is last seen on CCTV walking toward his home at 4:52 am. According to the police, at 4.42 am Ashutosh left the house wearing a jacket and returned at around 4:52 am,” police said.

Meanwhile, to find out the truth Delhi Police is interrogating Ashutosh and said, “In the Sultanpuri case, the sixth accused Ashutosh has been arrested who had given false information to the police. Further investigation is on.”

According to the police, the car through which the victim was dragged was Ashutosh’s car and during interrogation, Ashutosh has given false information to the police.

Earlier, police arrested five accused named Deepak Khanna, Amit Khanna, Krishan, Mithun, and Manoj Mittal.

Moreover, for medical examination, all the accused were taken to Sanjay Gandhi Hospital on Thursday. 18 teams of Delhi Police are investigating the case.

“We are trying to file the charge sheet as early as possible. During the post-mortem, no evidence of sexual assault was found,” the Special CP said.

In the Kanjhawala case Nidhi, an eye-witness has not been arrested she has been just called to join the investigation by the Delhi Police on Friday.

Meanwhile, the Delhi Police refuted the reports of Nidhi’s arrest and said, “There are media reports that Nidhi (eyewitness) has been arrested by police. It is clarified that she has been called by the Police to join the investigation.”

Earlier on Tuesday the post-mortem reports of Anjali who was dragged under the car have come which revealed that no sexual assault happened and the cause of death is a vehicular accident.

“She was in a drunken state but insisted on driving the two-wheeler. After being hit by the car, she came under the car and got dragged with it. I was scared and ran away and returned home, didn’t tell anything to anyone. It is the fault of the girl who was driving in an inebriated state. I insisted that she shouldn’t drive. I told her ‘I am conscious, let me drive’. She didn’t trust me and trusted herself instead,” Nidhi claimed that Anjali was drunk while driving the scooty.

According to the police, the car through which the victim was dragged was Ashutosh’s car and during interrogation, Ashutosh has given false information to the police.

Earlier, police arrested five accused named Deepak Khanna, Amit Khanna, Krishan, Mithun, and Manoj Mittal.

Meanwhile, for medical examination, all the accused were taken to Sanjay Gandhi Hospital on Thursday. 18 teams of Delhi Police are investigating the case.

Moreover, the car was driven by Amit and not by Deepak during the interrogation police get to know.

“We can only give a statement if she was drunk or not only after the post-mortem report, it does not have relevance to this case, as it is a case under section 304 of the IPC,” Special CP Hooda said.

2 more involved in Delhi horror case

In the Kanjhawala case, two more people are involved in the accident. After the interrogation of the five accused in the case, the police learned the involvement of two more men – identified as Ashutosh and Ankush. “Our team is conducting raids.
