BJP MP Nishikant Dubey criticized Congress MP Rahul Gandhi on Thursday for allegedly pushing BJP MP Pratap Sarangi during a protest inside Parliament. The incident, captured on camera, quickly went viral.

Accusations of Hooliganism

In the video, Dubey is seen sitting next to Sarangi, who sustained an injury to his forehead. When Rahul Gandhi visited Sarangi, Dubey accused him of causing trouble. He remarked, “You don’t have any shame… What Rahul, what? You indulge in gundagardi (hooliganism)… You threw down an elderly person… gundagardi karte ho.”

Rahul Gandhi’s Response

In response, Rahul Gandhi addressed the media, claiming that BJP MPs were blocking his entry into Parliament. He said, “This might be on your camera. I was trying to go inside through the Parliament entrance, but BJP MPs were trying to stop me, push me, and threaten me. So this happened… Yes, this has happened (Mallikarjun Kharge being pushed). But we do not get affected by jostling. But this is the entrance and we have the right to go in. The central issue is that they are attacking the Constitution and insulting the memory of Ambedkar ji.”

BJP Denies Allegations

However, the BJP rejected Rahul’s claims. MP Pralhad Joshi stated, “There was enough space for Rahul Gandhi, but he pushed Sambit Patra as well. It was uncalled for because there was enough space for him… Everyone will know what happened once the CCTV footage is checked.”

Injuries and Prime Minister’s Concern

Union Law and Justice Minister Arjun Ram Meghwal introduced the Constitution (129 Amendment) Bill, 2024, in the Lok Sabha on Tuesday. This bill aims to implement the ‘One Nation, One Election’ proposal, which seeks to synchronize national elections for the Lok Sabha and state assemblies.

In addition to the main bill, Meghwal also proposed amendments to the Government of Union Territories Act, 1963, the Government of National Capital Territory of Delhi Act, 1991, and the Jammu and Kashmir Reorganisation Act, 2019. These amendments are intended to align assembly elections in Delhi, Jammu Kashmir, and Puducherry with the proposed simultaneous elections.

Opposition Voices Concerns Over Constitutional Integrity

Congress MP Manish Tewari voiced strong opposition to the bill, arguing that it undermines the Constitution’s basic structure. He stated, “The essential features are federalism and the structure of our democracy. Therefore, the bills moved by the Minister of Law and Justice are an absolute assault on the basic structure of the Constitution.”

Samajwadi Party MP Dharmendra Yadav echoed Tewari’s sentiments, expressing confusion over the government’s sudden push for the amendment just days after upholding constitutional values. He emphasized the wisdom of the Constitution’s framers and criticized the bill as a threat to its foundational principles.

Cabinet’s Recommendations and Opposition’s Reactions

In September, the Union Cabinet approved recommendations from a High-Level Committee on Simultaneous Elections, chaired by former President Ram Nath Kovind. The committee proposed implementing simultaneous polls in two phases, with local body elections to follow within 100 days of general elections. It also recommended a common electoral roll for all elections.

However, opposition leaders, including those from Congress and the Nationalist Congress Party (NCP), have expressed vehement opposition to the ‘One Nation, One Election’ bill. Congress MP Jairam Ramesh labeled the bill unconstitutional and a threat to democracy, asserting that it aims to undermine accountability in governance. He further claimed that the bill is part of a broader agenda to replace India’s Constitution.

NCP-SCP MP Supriya Sule called for a Joint Parliamentary Committee (JPC) to discuss the bill, emphasizing the need for thorough deliberation. Congress MP Pramod Tiwari criticized the government’s approach, suggesting that an all-party meeting would have been more appropriate for discussing such significant constitutional changes.

Congress MP K Suresh reiterated the party’s strong opposition, stating that the bill threatens India’s democracy and federal structure. He predicted that while NDA allies like TDP and JD(U) may not openly oppose the bill, they are likely against it.

Samajwadi Party MP Ram Gopal Yadav also condemned the bill, asserting that it contradicts various sections of the Constitution. Constitution Day: A Vision of PM Modi

Union Minister Meghwal highlighted the evolution of Constitution Day, an initiative spearheaded by Prime Minister Narendra Modi. “When PM Modi assumed office in 2014, prior to this, November 26 was observed as Law Day. It was PM Modi’s vision, stemming from his days as Gujarat’s Chief Minister, to honor the Constitution. He proposed that this day be observed as Constitution Day.”

Meghwal elaborated on the origins of this observance, stating that in 2015, during Dr. B.R. Ambedkar’s 125th birth anniversary celebrations, the Ministry of Social Justice and Empowerment issued a circular declaring November 26 as Constitution Day. “The cycle was broken due to mid-term polls and Article 356 misused to dismiss state governments,” he stated. Meghwal argued that the frequent imposition of the Model Code of Conduct disrupts governance and development. “PM Modi called an all-party meeting in 2019 on this subject, attended by leaders from all major parties except Congress,” he revealed. He pointed to countries like Indonesia and the U.S. as examples of streamlined electoral processes, urging opposition parties to support the reform.

On the upcoming Census and its implications for the Women’s Reservation Act, Meghwal clarified, “The delimitation process is constitutionally frozen until 2026. After 2026, a Delimitation Commission will determine which seats are reserved for women and reassign SC/ST seats based on population changes. The Women’s Reservation Act, granting 33% reservation in Lok Sabha and Assemblies, will be implemented in subsequent elections.”

Parliamentary Decorum and External Threats

President grants assent to Bill governing Election Commissioner appointments

The President of India, Droupadi Murmu has granted assent to the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023. Introduced in the Rajya Sabha on August 10 by Minister of State for Law & Justice Arjun Ram Meghwal, the bill addresses the legal vacuum highlighted by a Supreme Court judgment concerning the appointment of Election Commissioners.

The bill outlines that the selection committee responsible for appointing the Chief Election Commissioner (CEC) and Election Commissioners (ECs) will be chaired by the Prime Minister and will include a Union Cabinet Minister and the Leader of the Opposition in the Lok Sabha. The bill received approval from the Rajya Sabha on December 12 before being passed by the Lok Sabha on December 21. Former Supreme Court judge Justice Rohinton Nariman expressed concerns, stating that the bill could compromise the independence of the Election Commission of India (ECI). He emphasized that if the bill becomes law, the executive would have the final say in appointing the CEC and ECs, potentially impacting the fairness of elections.

The Supreme Court judgment from March 2, 2023, urged the Central government to establish a law on appointments to the ECI. Winter Session: After passage of landmark J-K Bills in RS, more significant businesses scheduled for today

As the Parliament reconvenes for the ongoing Winter Session, the Upper House has more business scheduled for Tuesday. This comes after the Rajya Sabha passed the Jammu and Kashmir Reservation (Amendment) Bill, 2023 and the Jammu and Kashmir Reorganisation (Amendment) Bill 2023, in response to the Supreme Court’s upholding of the revocation of Article 370 from the extant state.

Both Houses are scheduled to take up important businesses on the ninth day of the Winter Session, as Union Minister Arjun Ram Meghwal is to move the Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023, in the Rajya Sabha for consideration and passage to regulate the appointment, conditions of service and term of office of the Chief Election Commissioner and other Election Commissioners, and the procedure for transaction of business by the Election Commission.

Meghwal will also introduce the Repealing and Amending Bill, 2023, for consideration and passage in the Rajya Sabha on Tuesday in order to amend and repeal a few laws. The Lok Sabha had already approved the bill. Arjun Ram Meghwal on the Karni Sena Chief’s murder: Result of law and order collapse during Congress govt

Union Minister Arjun Ram Meghwal responded to the killing of Rashtriya Rajput Karni Sena president Sukhdev Singh Gogamedi on Thursday by stating that the incident was caused by the breakdown of law and order in Rajasthan during the Congress administration.

“This is a highly condemnable incident and this is a result of the collapse of law and order in Rajasthan during the Congress government. We demand that the criminals should be nabbed by the police at the earliest,” Meghwal said speaking to reporters on Wednesday at the Parliament premises.
Sukhdev Singh Gogamedi was shot dead by unidentified bike-borne criminals in Jaipur on Tuesday.

“Karni Sena chief Sukhdev Singh Gogamedi was murdered in Jaipur. The killers had come to his house on the pretext of discussing something. In this incident, Sukhdev Singh Gogamedi and one of his bodyguards were shot. An accused accompanying the killers was also shot, who has died. Raids are being conducted at the possible hideouts of the miscreants…We spoke to the Haryana DG and assistance has been sought. Rohit Godara gang has taken responsibility for the murder, they will be arrested soon,” Rajasthan DGP said.

Arjun Ram Meghwal, the minister of law and justice, stated on Wednesday that the Bharatiya Janata Party has always supported the empowerment of women. The BJP is the first political party in the nation to have decided to give 33% of party positions to women at its national convention in Vadodara. The Women’s Reservation Bill was never brought up for discussion in the Lok Sabha while the Congress was in power.

Prior to the Lok Sabha’s deliberation on the Women Reservation Bill today, Union Law Minister Arjun Ram Meghwal stated that the bill’s discussion will span the entire day and is unrelated to political matters.

Outside the new Parliament building, Arjun Ram Meghwal said “Discussion on the Bill will be done through the day. It will begin at 11 AM and it has been scheduled to continue till 6 pm. This has nothing to do with politics.”

On September 19, in the inaugural session of the Lok Sabha at the newly constructed Parliament building, the Union Law Minister, Arjun Ram Meghwal, introduced the Nari Shakti Vandan Adhiniyam bill. Arjun Ram Meghwal emphasized that once this bill is enacted, the representation of women in the Lok Sabha will rise to 181 seats.

Additionally, it was brought to attention by Congress leader Adhir Ranjan Chowdhury that the freshly distributed copies of the Constitution on the opening day of the new Parliament building do not include the terms ‘socialist’ and ‘secular.’

Arjun Ram Meghwal said “When the Constitution was drafted, it was like this. An amendment was made later. This is the original copy. Our spokesperson has replied to the same. Kiren Rijju was replaced as Union Law Minister on Thursday. In the fresh cabinet reshuffle, Arjun Ram Meghwal was allotted the independent charge of Minister of State in the Ministry of Law and Justice, besides his present portfolios.This is really astonishing that a Law Minister will be without cabinet rank.

However, Rijiju has been assigned the Ministry of Earth Sciences.

The track record of Mr Rijiju is clean, so he was known as one of the most high profile ministers and a troubleshooter in the Modi cabinet.

After his removal, the outgoing Rijiju posted a note and thanked the Chief Justice of India, DY Chandrachud, and all judges.

A new Law Minister has come at a time when the government and the Supreme Court are not on the same page as far as judges appointments are concerned.

However, Mr Rijiju’s term as a Law Minister was not free from controversy because of frequent run-ins between the government and the judiciary and his critical viewpoint on the Supreme Court over the collegium system of judges appointing judges.

A two-judge Supreme Court bench had expressed their displeasure with the delay in judge appointments and transfers in February, considering it a very severe matter and issuing a warning of “administrative and judicial actions that didn’t look sound”.

Mr Rijiju rejected the warning and made it clear that the country would be governed as per the Constitution. “Sometimes discussion takes place in the country on different issues, and in a democratic setting, everybody has the right to give their opinion. But those who are sitting in a high profile place should think before speaking anything, whether it would be beneficial for the nation or not,” he went on to say at a function, emphasising that “nobody has the right to issue a warning to anyone
