The Jharkhand High Court on Monday dismissed the FIR registered against nine people, including BJP MPs Nishikant Dubey and Manoj Tiwari, for allegedly trespassing into the Air Traffic Control (ATC) room and forcing the officials to allow their chartered plane to fly from the Deoghar airport.
The incident occurred on 31 August, 2022 and an FIR was lodged in the Kunda police station in Deoghar on the complaint of DSP Suman Anand, while he was posted at the airport
A bench of Justice Sanjay Kumar Dwivedi, after hearing a petition, quashed the FIR filed in the Kunda police station in Deoghar in August last year. As per the FIR, this was against the security protocol maintained in airports. Dubey’s advocate told the court that the flight on 31 August, last year, from Delhi to Deoghar was delayed. He further added that as per the aviation rule a flight can take off half an hour after sunset. On that day the sun set at 6:03 pm and the flight took off at 6: 17 pm, which means there was no violation of aviation regulations, the counsel said. The counsel went on to say that the politicians were framed in a false case, which is nothing more than a political vendetta. However, Additional Advocate General Sachin Kumar justified the FIR and said that there is no landing and take off facilities at the Deoghar airport at night. The two MPs used their political influence and put severe pressure on the airport authorities to get clearance for flying and risking the lives of the others.
